Partimos da reflexão das interações socioculturais e escolares mediante uma práxis dialógica entre Educação, Arte e Saberes Ancestrais, discorrendo sobre o corpo do negro como discurso no mundo e a afetividade como uma tecnologia humana no processo de (...) pertencimento e reconhecimento histórico e social para a reconexão da memória do povo africano em diáspora. The nature, possibility, and implications of ethics expertise in general and of bioethics expertise in particular has been the focus of extensive debate for over thirty years. What is ethics expertise and what does it enable experts to do? Knowing what ethics expertise is can help answer another important question: What, if anything, makes a claim of expertise legitimate? In other words, how does someone earn the appellation “ethics expert?” There remains deep disagreement on whether ethics expertise is possible, and (...) if so, what constitutes such expertise and what it entails and legitimates. Discussion of bioethics expertise has become particularly important given the growing presence of bioethicists in the clinical setting as well as efforts to professionalize bioethics through codes of ethics and certification efforts. Unlike in the law or in engineering, where there may be a body of knowledge that professional organizations or others have articulated as important for education and training of experts, ethics expertise admits of no such body of knowledge or required experience. Nor is there an entity seen as having the authority to articulate the necessary scope of knowledge. Questions about whether there is such a body of knowledge for particular areas within bioethics have emerged and played a central role in professionalization efforts in recent years, especially in the area of clinical ethics. The subject of this paper is the debate between externalism and internalism about mental content presented by Tim Crane in Chapter 4 of his book Elements of Mind. Crane’s sympathies in this debate are with internalism. The paper attempts to show that Crane’s argumentation is not refuting the Twin Earth argument and externalism, and that in its basis it does not differ much from externalism itself Crane’s version of the argument for externalism features two key premises: (1) The content of (...) a thought determines what the thought is about/what it refers to (the Content Determines Reference Principle); and (2) Twins are referring to different things when they use the word “water”. From these, in a few simple steps, Crane’s externalist infers: Therefore, their thoughts are not “in their heads”. Crane suggests denying the Content Determines Reference Principle in the light of indexical thoughts. In the first stage, Crane reduces “content” to “some aspect of content”, although he needs all aspects of content to secure identity of thoughts. However, his view then comes close to something acceptable to externalists. In the second stage, Crane makes content relative to context, but then reference still determines content. (shrink)

United States service members’ personal mental health information lacks the protection afforded by Health Insurance Portability and Accountability Act (HIPAA), diverging from the legal safeguards granted to other citizens. The Public Welfare Law and the Department of Defense (DoD) reduces these protections through clauses, outlining nine conditions where service members’ information can be disclosed to their commanders, who may lack formal HIPAA or medical confidentiality training. Once a commander is notified, the information may be shared with others without the Service (...) Members consent, creating an unregulated spread of private health information. Additionally, the military environment, marked by a stigma surrounding mental health issues, compounds this vulnerability. Therefore, Service Members seeking mental health support may encounter adverse consequences upon returning to their command through the propagation of stigma, which may further foster a culture of reluctance to seek help. A fictional character within the military serves as a conduit for nonmilitary providers to understand the contextual intricacies while highlighting the ethical dilemma faced by providers adhering to Congressional law, American Psychological Association (APA) Ethics Code, and DoD standards while also serving their clients. Key ethical considerations include informed consent, disclosures, maintaining confidentiality, discussing the limits of confidentiality, avoiding harm, and conflicts between ethics and organizational demands. No presente artigo, iremos analisar a crítica feita por Karl Marx em seus Cadernos Etnológicos ao assim chamado “método” dos juristas analíticos. Para isso, passaremos pelos comentários de Marx ao jurista Henry Sumner Maine, fazendo um exame extenso de um trecho específico, no qual essa crítica aparece de forma mais direta. Ao longo de nossa exposição, pretendemos demonstrar que a crítica ao “método” dos juristas analíticos está inserida na perspectiva de uma crítica à teoria do direito como um todo. Então, (...) dissecaremos a associação feita por Marx entre a economia política e a teoria do direito, em especial a de John Austin, passando pela crítica ao método da economia política com base nos Grundrisse: Manuscritos econômicos de 1857-1858, e também pela diferenciação entre economia política, economia vulgar, e apologética conforme exposta em obras anteriores do autor de O capital. O que Maine chama de “método” dos juristas analíticos é, para Marx, um dogmatismo formalista comum à teoria do direito, que traz elementos distorcidos da economia política de modo cabalmente apologético. A temática perpassa discussões que acompanharam Marx por toda sua vida, como a relação entre burguesia e a produção científica, bem como o papel da teoria do direito na defesa de interesses burgueses. Ademais, acreditamos que uma leitura dedicada dos Cadernos etnológicos tem muito a oferecer para o pensamento marxista, e nosso artigo fornece algumas pontuais contribuições nesse sentido. (shrink)

Las Instituciones Nacionales de Derechos Humanos cumplen, fundamentalmente, con dos funciones: proteger a las personas a partir de recomendaciones, garantizándoles una reparación si se comente una violación a sus derechos, y prevenir futuras violaciones a los derechos humanos. Sobre esta base están llamadas a ser los organismos que guíen hacia una cultura ciudadana a favor de los derechos humanos. Para lograr la culturización en este campo, se requiere educar en derechos a través de la educación formal e informal. En el (...) caso de México, la Comisión Nacional de los Derechos Humanos es la institución encargada de realizar esta labor. Su posición flexible y dinámica, así como su autonomía dentro del Estado mexicano, le dan la posibilidad de propiciar esa cultura, ya que es una institución de configuración diferente al sistema tradicional de impartición de justicia, por lo que hace que mantenga una línea de investigación enfocada en los derechos humanos. La culturización empieza por el ámbito nacional o interno y se debe extender hacia el exterior, como un movimiento social internacional. (shrink)

Arthur Schopenhauer’s Mirror: the Will, the Suffering, the Compassion as Philosophical Challenges. In philosophy, the celebration of Arthur Schopenhauer has already ended. Only the last year was anniversary (of his birth and of the publication of the first volume of The World as Will and Representation), but the importance of this non-conformist creator is never superfluous to highlight. In this article, there is, certainly, a very limited/selective focus on the thinking of Schopenhauer, and no biographical approach: the goal is only (...) to stress two aspects of his philosophy in their logic. Schopenhauer was an enthusiastic Kantian: first of all, by taking over his maestro’s seminal paradigm, the constructivism (that does not pertain only to the theory of knowledge, but marks the entire existence analysed at different philosophical levels). Secondly, by the ethical focus and accent, continuing Kant’s exceptional emphasis of the ultimate reason of the tableau of the world, the human reason and its power to treat the others in a moral manner. And certainly, Schopenhauer was not an epigone, but a creator, using and at the same time giving other content to the Kantian form of ethical revolution. Schopenhauer had, obviously, contradictory ideas – as that between his constructivism and his metaphysical treatment of the will, i. e. as the only principle explaining the world – and also with disputable significance, including for the actual life and thinking. But he had a bad publicity from the dominant philosophy – namely, some of his ideas (as that of the moral of compassion) were, and still are, absolutely ignored, while other ones were simplified or transformed in the conception of Schopenhauer, reducing this one to some ideas out of context – and even nowadays this tradition is dominant. And it’s pity, because Schopenhauer’s philosophy was and represented a dramatic moment in the history of the 19th century thinking and culture: as it is a strange mirror for the present much graver situation. In order to critique the present it’s not necessary to do it from Schopenhauer’s perspective. However, just his contradictory ideas and pathetic accent on compassion show better than ever that neither philosophy – as theoretical position – nor the urging for moral activism are more than vox clamantis in deserto: if the historical facts, which include this urging and the spring of thinking but are not confined to them, are missing. Issues of institutional identity and integrity in Roman Catholic health care institutions have been addressed at the level of individual institutions as well as by organizations of Catholic health care providers and at various levels in the Church hierarchy. The papers by Carol Taylor, C.S.F.N, Thomas Shannon, Kevin O’Rourke, O.P., Gerard Magill in this volume provide a significant contribution to concerns of Roman Catholic health care institutions as they face the challenges of providing health care in a secular, pluralistic, market-driven (...) economy. One way to understand institutional integrity is as a measure of the coherence between what an institution identifies as its commitments (its stated moral character), what an institution does (its manifest moral character) and an institution’s fundamental moral commitments (its deep moral character). The essays in this volume support this model of integrity. Although it is not their explicit focus, the four essays together provide a vision of institutional integrity for Catholic health care institutions. Each author focuses on one of the three central aspects of integrity: what one identifies as one’s commitments (Taylor), how one's actions reflect one’s values (Shannon and Magill), and what one is or what one values at a deep level (O’Rourke). I will offer a brief overview of the ways in which the integrity of Catholic health care institutions has been addressed. Then I will consider the four essays and show how each offers an analysis of one of the three critical elements of integrity. (shrink)

Este trabajo tiene el objetivo de argumentar cómo se manifiesta la generosidad en la vida y obra de José Martí. Muestra la necesidad e importancia de recurrir a sus obras para fortalecer este valor desde los escenarios familiares, escolares, comunitarios y sociales. Se concluyó que la generosidad constituye en la actualidad una tarea pedagógica de gran importancia y el legado martiano es una vía obligada a recorrer. This work has the objective of analyzing how the generosity in Marti's life and (...) work is expressed. It shows the need and importance of turning to his works to strengthen this value from the family, scholar, community and social scenes. It was concluded that generosity constitutes at the present time a pedagogical task of great importance and the Martian legate is an obligated way to travel. (shrink)

This article analyzes the evolution of aesthetic role of the nature in the Middle Ages from the point of view of the philosophical systems influence on the interpretation of the corporal as a legitim way to the knowledge of the truth. it studies the intimate approach of neo-platonism, the shaping of its premises in the rejection of physical beauty and the change that occured after the assimilation of Aristotelianism toward a naturalistic outsourcing of the intellectual and artistic interests.

El presente artículo aborda las connotaciones y los fundamentos de la paráfrasis cum canere vellem en Serv. Ecl. 6. 3. El análisis del sentido del verbo volo en este contexto y la confrontación del pasaje con Serv. Ecl. 6. 5 revelan que Servio interpreta la frase cum canerem reges et proelia como referencia a un temprano empeño de Virgilio en componer poesía épica, del que pronto desistió. Esta interpretación está condicionada por la idea de que la secuencia cronológica Églogas - (...) Geórgicas - Eneida tiene un correlato jerárquico, idea que se funda en noticias biográficas y en la teoría de la tripertita varietas. This paper focuses on the connotations and grounds of the paraphrase cum canere vellem in Serv. Ecl. 6. 3. The analysis of the sense of verb volo within this context, as well as the confrontation between that passage and Serv. Ecl. 6. 5, show that Servius interprets the clause cum canerem reges et proelia as a reference to Virgil's early endeavor to compose an epic poem, from which he shortly desisted. This interpretation is conditioned by the idea that the chronological sequence Eclogues - Georgics - Aeneid has a hierarchical correlate, an idea which is founded on biographical information and the theory of tripertita varietas. In this article the author attempts to establish whether we can find a “theory of appearance” in the philosophy of Jan Patočka. The “appearance” for Patočka is basically composed of two elements. First there is a “primeval movement” which accounts for an infinite possibility of phenomena. The second element is the relation of this movement with an “addressee”, the subjectivity. If we begin to analyse the unity of these two elements we fundamentally come across three problems: what is it that (...) appears, when appearance presupposes a certain totality of appearance; how does this total appearance come forth; and, finally, is this whole “structure of appearance” taken as a free movement, kept once and for all within the boundaries of phenomenology, which is founded on a precise and positive term of “appearance” — or do we have to stipulate a special “experience” as the starting point of a phenomenology, which accepts the abyssal impossibility to control its frame? El trabajo presenta los resultados del proyecto El paisaje sonoro como contexto de aprendizaje interactivo, transversal e interdisciplinar (PAISO) que se desarrolló durante los cursos 2019-2020 y 2020-2021 en la Facultad de Magisterio de la Universidad de Valencia. La muestra participante estuvo formada por 748 estudiantes de 16 asignaturas de los grados en Maestro/a en Educación Primaria e Infantil y los Másteres de Secundaria y Máster en Investigación en Didácticas Específicas de la Universidad de Valencia y de la Universidad de (...) The paper presents the results of several substantiation studies concerning public facilities assessment for various Romanian municipalities, made in order to substantiate urban development plans. The study outlines main methodological steps for public amenities assessment emphasizing the importance of the territorial context, socio-economical context, as well the necessity of development of a compulsory legal frame at national level. The studies conducted by the authors tried to develop specific methodologies designated to assess public facilities provision at city level in order to (...) propose their enhancement if case. The study compares different public facilities assessment conclusions for several cities in Romania and outlines that the average offer and need is generated by different elements, not only the perceived urban barriers but also the unseen elements. Also, one of the conclusions of this survey is that public amenities are one of the main features of urban structure that has to be addressed when planning development at urban or zone level. This focus on public amenities approach can substantiate development decisions at urban level, despite that it is the most disregarded element due to urban development pressures, especially within the new urban development areas. Assessment of public facilities provision at urban level should be subject of the urban development plans in terms of sustainable urban development. (shrink)

This is the first systematic analysis of Aristotle's concept of lexis. Ana Kotarcic argues that it should be approached on three interconnected levels: the first dealing with language as a system, the second with actual language usage, into which sociolinguistic factors come into play, and the third with prescriptions for the kind of language to be used in poetic and rhetorical compositions. She introduces ideas and concepts from classics and modern linguistics into the analysis alongside the philosophical approaches which have (...) prevailed until now. The results reveal that Aristotle's ideas on lexis are complex, well-developed and intimately connected to many other fundamental concepts in his works, such as aretē, energeia, ēthos, logos, mimēsis, pathos, phantasia and technē. A major component of his thought is therefore illuminated comprehensively for the first time. (shrink)

The paper deals with one of the key notions in Epicurean epistemology, preconception. Together with perceptions, preconceptions are the second criterion of truth. The aim of the paper is to explore their epistemological status on the basis of their origin and formation. I argue that the process of formation of preconception is purely empirical, since they are produced through repeated perceptions of individual instances of a particular type of thing. Given the way they are formed, I claim that preconceptions are (...) the means by which we recognize types of object and as such are fundamental to Epicurus’ account of how we gain knowledge of things. Exactly this gives them a distinctive criterial role, since preconceptions––unlike perceptions––enable us to engage in the process of interpretation of perceptual content. (shrink)

Discussing the relationship of mathematics to chemistry is closely related to the emergence of physical chemistry and of quantum chemistry. We argue that, perhaps, the most significant issue that the 'mathematization of chemistry' has historically raised is not so much methodological, as it is philosophical: the discussion over the ontological status of theoretical entities which were introduced in the process. A systematic study of such an approach to the mathematization of chemistry may, perhaps, contribute to the realist/antirealist debate. To this (...) end, in this paper we briefly discuss Lewis' introduction of fugacity and activity to his chemical thermodynamics and more fully analyze the issues surrounding the appropriation of resonance by Linus Pauling into quantum chemistry, particularly as these issues arose in organic chemistry as discussed by George W.
