The article “The EU Top Court Rules that Married Same-Sex Couples Can Move Freely Between EU Member States as “Spouses”: Case C-673/16, Relu Adrian Coman, Robert Clabourn Hamilton, Asociaţia Accept v Inspectoratul General pentru Imigrări, Ministerul Afacerilor Interne”, written by “Alina Tryfonidou” was originally published electronically on the publisher’s internet portal on 23 April 2019 without open access.

In the Coman case, the European Court of Justice was asked whether the term “spouse”—for the purposes of EU law—includes the same-sex spouse of an EU citizen who has moved between EU Member States. The ECJ answered this question affirmatively, holding that a refusal to recognise a same-sex marriage and the resultant refusal to grant family reunification rights to a Union citizen who moves to another Member State, would constitute an unjustified restriction on the right to free movement that Union (...) citizens enjoy under EU law. This case comment analyses the judgment, arguing that the Court’s pronouncement is a very welcome first step towards marriage equality at a cross-border level in the EU. At the same time, following the delivery of this ruling, a lot of questions have arisen and gaps in the protection of same-sex couples persist, and these are also analysed in this piece. (shrink)

The paper considers three main models of temporal consciousness proposed in grappling with the “paradox of temporal awareness”. They are based on the notion that there is a basic element of perception in the form of some “mental frame” or “apparent present” which, while effective for describing some perceptual features, does not fully reflect our phenomenal experience. It is argued that a two-level model based on the separation of the “specious present” and “current present” is best correlated with higher-order theories (...) of consciousness and should act as a basis for further development of the temporal model of consciousness. New neural models for anorexia nervosa are emerging as a result of increased research on the neurobiology of AN, and these offer a rationale for the development of new treatment technologies such as neuromodulation. The emergence of such treatment technologies raises new ethical questions; however these have been little discussed for AN. In this article, I take an empirical approach and explore how young women who suffer from AN perceive treatment technologies in light of the concept of authenticity. Interview data (...) showed that participants in this study did not seem to unconditionally adhere to treatment modalities that only imply laborious self-work, such as therapy. The data also showed that they were willing to accept new treatment possibilities such as pharmacological or brain-directed treatment strategies, which they view as having potential instrumental value in coping with certain symptoms of the illness. However, such modalities can pose threats to patients’ authenticity, especially with regard to self-discovery. I argue that, in a context where there is an increased interest in brain-directed treatment strategies for AN, studies should continue to explore the ethical and psychological impact of such treatment technologies on individuals. The aim of the paper is to establish a relation between the cooperative principle formulated by H.P. Grice in pragmatics and the principle of sincere cooperation laid down in the founding Treaties on the European Union and interpretated by the Court of Justice of the European Union, intimately linked to the ethical imperative of cooperation, in a cultural framework shared by the Member States. The key concepts are ratio and value and the case-law analysed is provided by the recent cases (...) of the Romanian magistrates. The principle of cooperation reasserted also as the Cooperation and Verification Mechanism is the main obligation and it implies compliance with agreements and action to obtain certain effects. This paper represents a theoretical-methodological incursion on the requirements of higher education institutions to achieve sustainability. The relevance of the topic derives from the need to assess the potential of higher education institutions in order to achieve sustainability. The aim of the research is to assess the potential of universities in the context of sustainability. The paper focuses on making an approach to achieving educational performance, in terms of assessing the human, innovative potential of higher education institutions which represents a (...) vital factor in achieving university sustainability. Universities as active actors in sustainable development must demonstrate the necessary training, competent human potential, viable educational policies, and effective tools to achieve sustainability. The research methodology focused on the use of the following methods such as: analysis, synthesis, qualitative research, scientific abstraction, which contributed to a comprehensive and complex study on the training of Moldovan universities to achieve sustainability. In conclusion, we reiterate that universities as “vectors of change” are demanded to develop successful strategies to achieve sustainability, in terms of certain effective activities that would ensure their sustainable development. The undertaken research allowed us to elucidate that Moldovan universities do not have a model for achieving university sustainability. In this context, we can point out the need to develop a viable tool for assessing the steps taken by universities to achieve sustainability. (shrink)

The purpose of the study is to research intermediary transactions in the oil and gas producing industries and present them based on the results of the internal audit. In accordance with this goal, the article discusses and analyzes the theoretical aspects of accounting and methods of conducting an internal audit of settlements for intermediary transactions in oil companies. Attention is focused on the fact that intermediary operations are important in regulating the mechanism of market relations of both manufacturing companies and (...) purchasing companies. The article analyzes the current methodological guidelines of oil companies on the accounting of intermediary operations and the rules for conducting internal audits. As a result, shortcomings in the accounting of intermediary operations were identified and methodological recommendations for their improvement were presented, confirming the scientific novelty of the study. The purpose of this article is to present some reflections on the problems and solutions concerning the lexical meaning determination. First, to determine the meaning of the words it is specified the status of conceptual layer in the semiotic triangle. According to the German linguist Jost Trier, it is emphasized that semantic changes concern not only the individual words but the whole lexical field to which they belong, and thus the entire vocabulary. Thus, the meaning of a word is a (...) part of the language content and each language evaluates and organizes the reality according to its own laws. Some examples compare the organization of the language content in different languages. It is necessary to study the lexical meaning in relation with the language content. (shrink)

This introductory paper analyzes the Orthodox, Catholic, and Protestant sects, which form the core of the Ecumenical movement. The development of the feminine problem in the ecumenical movement took shape in 1948, at the first Conference of the E.C.C., when Sarah Chakko presented a report on the place and role of women in church. Among the most important women’s achievements we must mention: The International Day of Prayer, the creation of the Department on Cooperation of Men and Women in Church (...) and Society (1954), and The Ecumenical Decade for Churches in Solidarity with Women (1988- 1998). Beyond the dogmatic and theological differences between the three sects and between the places that they assign to women, women’s contribution to the development of the Ecumenic Movement is increasing. For both Gadamer’s project of a philosophical hermeneutics as for Heidegger’s early understanding of facticity (Faktizität) as practical knowledge, the problem of application is central and is always linked to the specific conditions under which an individual decides to act within a community. Both also agree on the fact that the sciences of man do involve more than the epistemic subject, this is why the context i.e. the phenomenological concept of ‘world’ becomes part of the understanding process, one that cannot (...) be ignored or transformed into an abstract matter. Understanding is therefore also in a specific way ‘historical’, as the application is dictated by momentary circumstances in life situations, which come before any use of theoretical knowledge and thus do not represent an appendix to theory. While Gadamer continuously insisted on the idea of a practical knowledge (Wissen) that surpasses the separations between theory and praxis, sophia and phronesis, Heidegger radicalized the idea of active thinking as an experience of language in connection to an essential ‘perception’ of Being itself, that goes beyond any subjectivity. The term by which he often characterizes this essential thinking (wesentliches Denken) is Vernehmen: a kind of receptive thinking. This conception of receptive thinking, as some conversations around the Zollikon Seminars and Le Thor/Zähringen will briefly show, lead Heidegger also to some interesting considerations on the human body. The aim of this study is twofold. Firstly, it intends to highlight the value of constructivist insights for religious studies by showing that various forms of approach to issues related to religion are mere constructs. In contrast to this viewpoint, the discipline of religious studies had traditionally sought a higher degree of objectivity in the scientific reflection of religious topics, but that has been a fraught path. Secondly, the example it refers to is worthy in itself. The reception of Judaism (...) in contemporary China is not only an under-investigated topic endowed with a great potential to reveal to what extent the Chinese ordinary man as well as the academic succeed to understand Western thought and to differentiate among the varied cultural traditions generally subsumed by them under the notion Western, but it also shows that the constructivist approaches preserve their validity in non-European contexts as well. Judaism’s reception in contemporary China will be pursued on four different levels: popular literature, fake books, articles in the Christian Chinese media and academic productions. The four categories of texts represent four different degrees of comprehension of the object of study, primarily offering information about the worldviews of the authors of the texts. The process of reception of thought is regarded as a form of encounter where the active part is striving to get out of its own mindset and move towards the other. (shrink)

The aim of the experiment was to evaluate the adaptive responses of biomechanical and electromyographic parameters to vertical unloading when walking during the 4-month isolation experiment SIRIUS-19 in the ground-based space station model. The study involved 6 healthy international crew members of the SIRIUS-19 project aged 34 ± 6.2 years. Body Weight Unloading conditions was created by the h/p/cosmos airwalk system. The locomotor test included walking with a sequential change of BWU modes: 5-min walking with 0% BWU, 5-min walking with (...) 65% BWU and 5-min walking with 85% BWU. Ground Reaction Force was recorded by the h/p/cosmos treadmill device. Muscle Lab Model 4000e device was used to record the electromyographic signals of the hip and shin muscles. The locomotor test was performed twice before GBI, monthly during GBI and 1 week after leaving isolation. The results obtained before GBI demonstrate that the changes of support and proprioceptive afferentation signals play significant role in reorganizing of the biomechanical structure of motor acts and the development of new movement patterns. The results of the study are consistent with the previously obtained results of other studies in this direction. Despite the fact that during the GBI the participants of the experiment performed regular physical training, a decrease in the performance indicators values was detected, especially pronounced after 100 days of GBI. This is probably due to limited space of a space station model, as well as the development of a special motor stereotype in it. Noteworthy are the results obtained after the 4th session of the experiment, indicating the effect of sensorimotor learning. We think that the data obtained in this study will be useful in research both in gravitational physiology and in clinical medicine. (shrink)

The urgency of the issue in question lies in the need to improve anti-discrimination legislation in Ukraine. The article aims to summarize the current state of combating discrimination in sports. Research methods include analysis, generalization, and the formal-logical method. The article summarizes international acts that promote the prohibition of discrimination and the need to combat it. One of the main problems in world sport is racial discrimination, and there are three types of racism in sports. The main disadvantage of laws (...) that lead to imperfect prosecution mechanism is entirely criminal liability for discrimination, even though the law on preventing and combating discrimination also implies administrative and civil liability. The article analyzes some positive foreign experience in combating and counteracting in sports. It shows that the priority areas for combating and counteracting discrimination in sports in Ukraine should be: improving the legislation in terms of prosecution; establishing a special body responsible for combating and counteracting discrimination in sports; introducing educational tools in schools and among members of sports organizations that promote human rights, regardless of race, colour or other characteristics. Emphasis is placed on the fact that an effective mechanism of legal regulation together with preventive measures should guarantee the protection of the rights of both athletes and fans. The obtained results can serve as the basis of legislative proposals to improve the fight against discrimination in sports, which will ensure the protection of human rights. (shrink)

The article seeks to present the different status of scientific theory in a comparative analysis of philosophical conceptions of science (inductivism, hypothetism, paradigmatism and intuitionistic conception of science).

The article describes the basic elements of an ethical infrastructure that manifest themselves as mechanisms regulating the relationship between public servants and the public, being the part of professional activities. Ethics for public servants is defined as the system of regulations of conduct, procedure and rules, and relationships and principles of public-service relationship that is most appropriate set of deeply understood and concretized norms of morality inherent in this society.
