Legal ethics theory focuses on the moral problem of lawyers pursuing morally suspect (but lawful) ends and using morally suspect (but lawful) means. It considers possible justifications for lawyers' conduct arising from moral or political philosophy, and how those justifications may require shifts in the lawyer's role. This paper argues that legal ethics theory needs to expand its focus to consider other ethical aspects of the lawyer's role and, in particular, the extent to which being a lawyer can complicate, or (...) contribute to, the accomplishment of a meaningful life. Meaning—defined by Susan Wolf as 'loving something (or a number of things) worth of love, and being able to engage with it (or them) in a positive way'—will be affected in positive and negative ways by the moral dimensions of the lawyer's role, but also by broader aspects of legal practice. The paper further argues that legal ethics theory needs to be more sensitive to contextual variations in legal practice. The ethical challenges and opportunities of legal practice, both its meaning and its morality, are contextually specific in ways legal ethics theory has not sufficiently accounted for. The paper discusses how meaning and context can be included in analysis of the ethics of a lawyer's life. (shrink)

Most people, including philosophers, tend to classify human motives as falling into one of two categories: the egoistic or the altruistic, the self-interested or the moral. According to Susan Wolf, however, much of what motivates us does not comfortably fit into this scheme. Often we act neither for our own sake nor out of duty or an impersonal concern for the world. Rather, we act out of love for objects that we rightly perceive as worthy of love--and it is (...) these actions that give meaning to our lives. Wolf makes a compelling case that, along with happiness and morality, this kind of meaningfulness constitutes a distinctive dimension of a good life. G e moore and ludwig wittgenstein were very different teachers, both because of their differing views on the nature and aims of philosophical investigation, and because of the differences in the way they thought, their educational backgrounds, and the kind of persons they were. this paper records experiences of the two philosophers as teachers and as personalities, and indicates the features of their teaching which stemmed from their views and from their personalities.

While discussions of the imagination have been limited in philosophy of science, this is beginning to change. In recent years, a vast literature on imagination in science has emerged. This paper surveys the current field, including the changing attitudes towards the scientific imagination, the fiction view of models, how the imagination can lead to knowledge and understanding, and the value of different types of imagination. Examining, for a symposium on xenophilia, the views of some of the period’s most open-minded and tolerant thinkers, as well as the historical development of Christian writers’ treatment of Muslims, this article considers whether the term Islamophilia can be applied to any Christian’s attitudes during the Middle Ages. The analysis considers what qualifies as an expression of love for Muslims, the distinction between positive regard for Islam and positive regard for Muslims, and whether Islamophilia essentializes Muslims in the same way (...) that Islamophobia does. The author argues that any search for Christian Islamophilia must be broad enough to encompass evidence found in unexpected places. For instance, due to the Christian belief that Muslims who did not convert to Christianity would suffer eternally, a desire to convert them may well qualify as a stance of love toward them, despite the offense to modern sensibilities that such implies. Paradoxically, indifference toward Muslims’ religion, such as on the part of neighbors or business partners, might also have a place in a discussion of Islamophilia, precisely because it rejects essentialism. The current explosion of genetic knowledge and the rapid proliferation of genetic tests has rightly provoked concern that we are approaching a future in which people will be labeled and disadvantaged based on genetic information. Indeed, some have already suffered harm, including denial of health insurance. This concern has prompted an outpouring of analysis. Yet almost all of it approaches the problem of genetic disadvantage under the rubric of “genetic discrimination.”This rubric is woefully inadequate to the task at hand. It (...) ignores years of commentary on race and gender demonstrating the limits of antidiscrimination analysis as an analytic framework and corrective tool. Too much discussion of genetic disadvantage proceeds as if scholars of race and gender had not spent decades critiquing and developing antidiscrimination theory.Indeed, there are multiple links among race, gender, and genetics. Dorothy Roberts has discussed the historical links between racism and genetics, while she and others have begun to map connections between gender and genetics. (shrink)

Philosophers of science have typically focused on “beauty”, “simplicity”, and “elegance” in their accounts of aesthetic values in science. But this is too narrow: other properties ought to be considered when thinking about aesthetics in science. In this chapter, Alice Murphy expands the discussion by asking: What makes a scientific experiment “profound”? To address this question, she draws on two accounts of profundity as developed in the philosophy of art to consider them in the scientific context. On the first (...) view, profound experiments are those which, due to their design, bring about understanding of some profound subject matter. On the second view, profound experiments are those which resist a straightforward interpretation, and can even prompt the development of new theories and concepts. To flesh out these two aspects of profundity, Murphy brings together theories from philosophy of art and topics in the epistemology of experiment. The chapter ends by demonstrating how broadening our class of aesthetic values to include profundity puts pressure on the scope of a central view brings together the epistemic and aesthetic by associating aesthetic experiences with “feelings of fluency”. In 2009, Greenpeace launched an aggressive campaign against Nestlé, accusing the organization of driving rainforest deforestation through its palm oil suppliers. The objective was to damage the brand image of Nestlé and, thereby, force the organization to make its supply chain more sustainable. Prominent cases such as these have led to the prevailing view that sustainable supply chain management is primarily reactive and propelled by external pressures. This research, in contrast, assumes that SSCM can contribute positively to the reputation of (...) an organization as a “good citizen” and, thereby, counter the impression that external stakeholder pressure is the only driver of SSCM. The study draws on Resource Dependence Theory in analyzing the three competing models of the potential stakeholder, SSCM and the corporate sustainability performance relationship. A dataset of 1,621 organizations allows the statistical comparison of these three models. Findings suggest that stakeholder pressure and SSCM both contribute to an organization’s sustainability performance. Thus, supply chain managers will perceive benefits from SSCM other than merely the reduction of risk from reputational damage through stakeholder activism. (shrink)

In his works on argumentation, Aristotle develops three main forms: apodeictical, dialectical, and rhetorical argumentation; dialectic is subdivided into several subspecies. The purpose of this paper is to discuss all of the forms described by Aristotle, to examine their differences and to point out their interrelations. This leads to an examination of the differentiating criteria and their applicability in the case of each argumentation form—and in particular to the question regarding the number of criteria that are necessary to describe each (...) form clearly and unambiguously. It is argued that Aristotle’s works on argumentation contain an implicit system of argumentation forms that is based on no more than three criteria. (shrink)

Both bioethics and law have governed human genomics by distinguishing research from clinical practice. Yet the rise of translational genomics now makes this traditional dichotomy inadequate. This paper pioneers a new approach to the ethics of translational genomics. It maps the full range of ethical approaches needed, proposes a “layered” approach to determining the ethics framework for projects combining research and clinical care, and clarifies the key role that return of results can play in advancing translation.

Product differentiation has emerged as a central dynamic in contemporary agrofood systems. Departure from the mode of standardization emblematic of agrofood modernization raises questions about future technical trajectories and the ways in which learning will be sustained. This article examines two innovation trajectories: the rapid coupling of biotechnologies and information technologies to yield products differentiated by constituent components—a model based on a cognitive logic of decomposition/ recomposition—and the proliferation of product networks that mobilize distinctive, localized resources to create complete identities—a (...) model based on a cognitive logic of identity. The article analyzes the information structures—institutional mechanisms that support information exchange and learning—in each of these opposed development paradigms. We find that knowledge creation under each of the logics occurs through mechanisms not recognized within the respective paradigms. On this basis, we derive institutional hybridity as a fundamental resource in systems of innovation. (shrink)

RESUMO Este texto discute alguns problemas metodológicos e históricos concernentes à fenomenologia da consciência de imagem elaborada por Edmund Husserl e algumas de suas repercussões teóricas. Primeiramente será tematizado o escopo mais amplo em que a abordagem filosófica das imagens auferiu relevância no século XX, a saber, a assim chamada “virada icônica” ou “pictórica”, conforme as respectivas formulações de Gottfried Boehm e William Mitchell. Será situada nesse contexto a fenomenologia da imagem e, mais especificamente, a fenomenologia da consciência de imagem (...) elaborada por Husserl, considerando-se, em especial, os eixos norteadores dos três direcionamentos que sobressaem nas teorias contemporâneas da imagem, a saber: as abordagens antropológica, semiótica e perceptiva. A partir da retomada de nuances semióticas remanescentes na fenomenologia da consciência de imagem, serão apresentados alguns pontos críticos acerca da classificação das análises de Husserl no escopo do direcionamento perceptivo e, finalmente, apontadas implicações do copertencimento à apresentação intuitiva da imagem daquilo que se denominará “circunstancialidade indicativa”. ABSTRACT This text addresses some methodological and historical problems concerning the phenomenology of image consciousness elaborated by Edmund Husserl as well as some of its theoretical repercussions. At first, I examine the broader scope in which the philosophical approach to images became relevant in the 20th century, the so-called “iconic turn” or “pictorial turn”, according to the respective terms proposed by Gottfried Boehm and William Mitchell. In this context I situate the phenomenology of image and, more specifically, the phenomenology of image consciousness elaborated by Husserl, considering, in particular, the guiding axes of three directions that stand out in contemporary theories of image, namely: the anthropological, the semiotic and the perceptual approach. By the resumption of semiotic nuances remaining in the phenomenology of image consciousness I present some critical points about the classification of Husserl’s analyses in the scope of perceptual approach. Finally, I point out some implications of the co-belonging to the intuitive image presentation of what can be called “indicative circumstantiality”. (shrink)

The threat from possible future superintelligent AI has given rise to discussion of the so-called “value alignment problem”. This is the problem of how to ensure artificially intelligent systems align with human values, and thus (hopefully) mitigate risks associated with them. Naturally, AI value alignment is often discussed in relation to morally relevant values, such as the value of human lives or human wellbeing. However, solutions to the value alignment problem target all human values, not only morally relevant ones. Is (...) there a value alignment problem in other domains? In this paper, I explore whether the AI value alignment problem extends beyond morally relevant values to include aesthetic values. I demonstrate that the value alignment problem as typically framed includes aesthetic values, and, using examples from computer vision, put forward that AI may be misaligned with human values in the artistic realm. Whilst misalignment may be cause for concern when considering AI creativity, I argue that aesthetic value is a case in which we do not want AI to be fully aligned with human values. In doing so, I offer support to Peterson’s moderate value alignment thesis. (shrink)

Volume 20 of _The Annual of Psychoanalysis_ ably traverses the analytic canvas with sections on "Theoretical Studies," "Clinical Studies," "Applied Psychoanalysis," and "Psychoanalysis and Philosophy." The first section begins with Arnold Modell's probing consideration of the paradoxical nature of the self, provocatively discussed with John Gedo. Modell focuses on the fact that the self is simultaneously public and private, dependent and autonomous. Alice Rosen Soref next explores innate motivation and self-protective regulatory processes from the standpoint of recent infancy research; (...) her notion of a lifelong two-track model of self and relatedness helps establish a normative baseline that can anchor psychoanalytic theory. George Mahl makes an interesting contribution to Freud studies in the form of a new chronology of Freud's works and the number of pages they contain in the _Standard Edition_. The section ends with Robert Galatzer-Levy and Mayer Gruber's "quasi-experiment about disgust." They test and disconfirm the hypothesis that disgust is an affective response to an abstract sense of disorder rather than a transformation of a concrete, bodily experience by systematically exploring references to concepts of disgust in the Old Testament. Section II, on "Clinical Studies," opens with Henry Smith's fascinating elaboration of Freud's notion of "screen memories" into a theory of screening that denotes the general process by which mental content is organized. He illustrates his thesis by invoking the "screen language" employed by a patient throughout her analysis. Ernest Wolf next explores the tension between being a "scientist" and a "healer" in Freud and his followers to illuminate struggles within the psychoanalytic movement and to help account for current attitudes toward abstinence, neutrality, and gratification. Kenneth Newman focuses on this same triptych of technical precepts. He argues, in the spirit of Winnicott and Kohut, that analysts can only alter the hostile internal environments of their patients by becoming "usable" objects and cultivating an optimally responsive analytic environment. A particularly rich collection of applied analytic studies forms Section III of the volume. Individual chapters focus on the childhood of Vincent van Gogh ; the psychological healing process depicted in George Eliot's _Silas Marner_ ; the self-psychological meaning of "blood brotherhood" in D. H. Lawrence's _Women in Love_ ; ecstatic mysticism in the 19th-century Indian saint Sri Ramakrishna ; the disintegration of the Tyrone family in Eugene O'Neill's _Long Day's Journey into Night_ ; and the nature and analytic significance of Freud's aesthetic response to Michelangelo's _Moses_. Finally, in Section IV, George Brook examines the commonsense psychological knowledge of everyday life, that is, the nonpsychoanalytic knowledge on which much of clinical psychoanalysis ultimately depends. Taken together, the four sections of Volume 20 of _The Annual_ offer an exciting overview of contemporary psychoanalysis. Section I highlights recent trends in psychoanalytic theorizing and the testing of psychoanalytic propositions; Section II explores the relevance of new theoretical perspectives to clinical work; Section III demonstrates the applicability of these new perspectives to psychobiographical and literary analysis; and Section IV provocatively explores the points of connection between everyday ideas and attitudes and the tenets of psychoanalytic practice. This interpretive study proposes a framework with which to explore the ethical significance of classroom-based literacy practices. Overly narrow views of literature as a source of role models or moral precepts take insufficient account of the complexity of text and experience. Through analyses of telling examples from student writing and discussion in response to literature, the occurrence and interaction of six forms of ethical engagement are documented: judging, distancing, empathizing, affiliating, disclosing and resisting. The study concludes that ethical matters are (...) interwoven with the socially accomplished, situated work of engaging with literature and with specific pedagogical structures. (shrink)

There are aspects of privacy theory that are analogous to quantum theory. In particular one can define distillable key and key cost in parallel to distillable entanglement and entanglement cost. We present here classical privacy theory as a particular case of information theory with adversaries, where similar general laws hold as in entanglement theory. We place the result of Renner and Wolf—that intrinsic information is lower bound for key cost—into this general formalism. Then we show that the question of (...) whether intrinsic information is equal to key cost is equivalent to the question of whether Alice and Bob can create a distribution product with Eve using I M bits of secret key. We also propose a natural analogue of relative entropy of entanglement in privacy theory and show that it is equal to the intrinsic information. We also provide a formula analogous to the entanglement of formation for classical distributions. (shrink)
