The article analyses the process of transformation and reinvention of patriarchal gender order at times of radical changes caused by violent conflict and life in emigration. The case study draws a comparison between younger and older generations of Chechen women in Austria, Poland and Germany and their radically different gender practices. The analysis shows that the turn towards more conservative gender relations, which can be observed among the younger generation, cannot be explained by a reference to the Chechen culture as (...) inherently patriarchal. Nor can it be ascribed solely to the insufficient reception and the lack of recognition experienced by refugees in the receiving countries. Rather, it is an outcome of women’s different conditions of socialization that have affected their hierarchy of values and continue to exert significant influence on their adaptation strategies in exile; most notably, on how the women perceive and make use of the opportunity structures in the receiving contexts. We present an experiment designed to investigate three different mechanisms to achieve impartiality in distributive justice. We consider a first-person procedure, inspired by the Rawlsian veil of ignorance, and two third-party procedures, an involved spectator and a detached observer. First-person veiled stakeholders and involved spectators are affected by an initially unfair distribution that, in the stakeholders’ case, is to be redressed. We find substantial differences in the redressing task. Detached observers propose significantly fairer redistributions than veiled stakeholders or involved spectators. (...) Risk preferences partly explain why veiled stakeholders propose less egalitarian redistributions. Surprisingly, involved spectators, who are informed about their position in society, tend to favour stakeholders holding the same position as they do after the initial distribution. (shrink)

This paper explores the alleged role of a conception of human nature for Kant’s justification of the duty to leave the state of nature and the related right to coerce others to enter the civil condition in the Doctrine of Right (1797). I criticise the interpretation put forward by Byrd and Hruschka, according to which Kant’s postulate of public right is a preventive measure based on a “presumption of badness” of human beings. Although this reading seems to be supported by (...) § 42 of the Doctrine of Right, I shall argue that the paragraph neither offers a justification of why we have a duty to leave the state of nature, nor explains why individuals are allowed to coerce others to do so. I offer an alternative interpretation of § 42 by focusing on the difference between formal and material violations of right and argue that the rationale behind the postulate of public right is the idea that remaining in the state of nature is a formal violation of the concept of right. It is therefore not prudential reason that authorizes us to coerce others to enter the lawful condition. (shrink)

Semantic realism fits Millikan's account of kind terms in its focus on information-theoretic abilities and strategic ways of gathering information in human communication. Instead of the traditional logical necessity, we should interpret rigid designation in a dynamic semantics as a legislative act to constrain possible ways in which our belief may change.

We distinguish scanning switches, which only enumerate states, from function switches which transform input states into output states. For the latter we introduce a logical network symbolism. Our history of early computer switching begins with the suggestions of Ramon Lull and Gottfried Leibniz, surveys the evolution of mechanical scanning switches and the first mechanical function switches, and then describes the first electromechanical function switches. The main themes of the present paper are that William S. Jevons built the first substantial function (...) switch (his logical piano), and that his work led to the design by Allan Marquand of the first substantial electromechanical function switch, as well as to Charles S. Peirce's idea for an electrical general-purpose programmable computer. These events all occurred fifty years before the first general-purpose programmable computers were constructed (in the 1940's), but they had no influence. (shrink)

DNA evidence has rapidly become a significant and routine feature of modern criminal prosecutions. The first introduction of DNA evidence in a U.S. Court occurred in 1987. By 1994, 42 percent of local prosecutors reported that they had used DNA evidence in a felony case at least once. By 2001 that number had increased to 68 percent. Moreover, from a technical point of view, the potential benefits of DNA testing are substantial. Early hurdles to admissibility during trial have been overcome (...) by the adoption of rigorous standards for DNA analysis. Rapid development of identification technology, fueled in significant part by the Human Genome Project, and the resultant development and expansion of national forensic DNA databases, has increased the potential of DNA to play a major role in crime solving. Indeed, over three million offender profiles, collected by state and federal authorities, now reside in the National DNA Index System. This number is likely to increase as more states and the federal government are expanding compelled DNA collections to individuals arrested for certain crimes. (shrink)

This doctoral thesis analyzes the systematic role of Kant’s conception of happiness in his moral, legal and political theory. Although many of his conclusions and arguments are directly or indirectly influenced by his conception of human happiness, Kant’s underlying assumptions are rarely overtly discussed or given much detail in his works. Kant also provides different and apparently incompatible definitions of happiness. This research explores the domains of Kant’s practical philosophy in which his conception of happiness plays a systematic role: the (...) relation between the natural need of human beings to pursue happiness and the ends-oriented structure of the human will; Kant’s anti-eudaimonism in ethical theory; Kant’s claim that we have an indirect duty to promote our own happiness and the problem that under certain circumstances, the indeterminacy of happiness makes it not irrational to choose short term satisfaction at the costs of one’s overall, long term happiness, given Kant’s conception of non-moral choice as expectation of pleasure; Kant’s justification of the duty to adopt the happiness of others as our ends and the latitude and eventual demandingness of this duty; finally, since Kant also subsumes subsistence needs and welfare under the concept of happiness of individuals, I also engage with the question of state provision for the poor in the Kantian Rechtsstaat and explore Kant’s conception of equity or fairness as an alternative to the traditional minimalist and the welfare interpretations of the Kantian state. This study analyzes Portuguese seniors’ Internet activity and determine their reasons, benefits, and motivations for web use as well as the obstacles faced by non-users. Results were derived from a questionnaire completed by 189 seniors enrolled in universities for seniors. 68.1% defined themselves as Internet users. The seniors asked principally go online to check e-mail and gather information. They state that the Internet is useful, helps them to stay up-to-date, and to preserve relationships. Non-user status is not attributed to old (...) age or health reasons. According to the technology acceptance model, ease of use and perception of utility were related to both Internet use and its intensity of use. Family influence also played a key role. Gender differences were not found in Internet use, intensity of use, or in use motivations. (shrink)

Alice Crary is a moral and social philosopher who has written widely on issues in metaethics, moral psychology and normative ethics, philosophy and feminism, critical animal studies, critical disability studies, critical philosophy of race, philosophy and literature, and Critical Theory. She has written on philosophers such as John L. Austin, Stanley Cavell, Cora Diamond, John McDowell, Iris Murdoch and Ludwig Wittgenstein. This is the first of two parts of the interview with Crary conducted in a single exchange in the (...) first weeks of January 2022, where she discusses ordinary language philosophy and feminism, Wittgenstein’s conception of mind and its relation to feminist ethics, the link between Wittgenstein and Critical Theory, and her own views about efforts to bring about social and political transformations. This piece continues an exchange between David Beaver and Jason Stanley, on the one hand, and Alice Crary, on the other, to which Beaver’s and Stanley’s “Neutrality” (immediately above) is a contribution. All three authors agree that the critique of ideology, propaganda, and oppressive structures should not be conceived as eliminating socially-situated perspectives and subjectively-mediated sensibilities from an allegedly neutral discursive space. Their exchange began with Crary’s 2018 article, “The Methodological as Political: What’s the Matter with ‘Analytic Feminism’?” which (...) attacks appeals to neutrality, including one Crary finds in Stanley’s 2015 book, How Propaganda Works, for obscuring a pivotal methodological insight of radical feminist thought, namely, that feminism’s political radicalism is complemented by a “methodological radicalism that involves making use of the practical power of ethically non-neutral resources, conceived as in themselves cognitively authoritative” (Crary 2018: 47). This new reply argues that Beaver’s and Stanley’s practice-based image of language, while at first seemingly aligned with this rejection of neutrality as an ideal for political discourse, fails to fully respond to her original complaint. The ideal of neutrality is problematic, not only in masking social location, but in wrongly impugning as ‘non-cognitive’ or ‘irrational’ critical resources drawn from socially-situated perspectives—the sorts of perspectives to which notable strands of feminist theory give voice precisely for their cognitive value. The current piece claims that to address this further danger it is necessary to go beyond Beaver’s and Stanley’s study of meaning and critically examine engrained philosophical assumptions about how to construe logical notions such as objectivity and truth. It closes by suggesting that, within philosophy of language broadly conceived, the tradition of ordinary language philosophy provides a more promising source of resources and illumination for struggles to make gender-based and overlapping forms of structural bias socially visible. Au-delà de ces rôles miroirs et constructifs, nous vivons l'expérience d'une intimité épistémique avec des amis simplement par les manières distinctes dont (...) nous nous occupons d'eux, et dont ils s'occupent de nous. For too long the questions of how we treat animals and how we treat our fellow human beings have been considered separately. But the contours of the current animal crisis make it clear – the harms we are inflicting on the nonhuman world have devastating impacts on humans: zoonotic diseases caused by habitat destruction and animal exploitation have brought human life to a standstill; mass production of animals for food is poisoning the ground and contributing to catastrophic climate change. Animal (...) Crisis responds to this fractured relationship between human beings and animals by exploring the complex social and political contexts in which animals are harmed, revealing the connections between our callous and cruel attitudes to the animal world and those same attitudes towards vulnerable human groups. Marking a stark contrast to traditional theories in animal ethics, Alice Crary and Lori Gruen argue that there can be no animal liberation without human emancipation. Borrowing from critical social theory and ecofeminism, they build a framework for understanding and combatting the structural forces that shape and enable the diminishment of some for the advantage of a few, isolating critical resources that are crucial for animal and human emancipatory struggles alike. This essay investigates the way in which Wolff takes an interest in the hypothesis of an emendatio of the prima philosophia from Leibniz’s incitement in De primae philosophiae emendatione, et de notione substantiae (1694) to re-found metaphysics. This makes it possible, secondly, to examine the way in which Wolff takes Johannes Clauberg’s ontology as a model, even though it represents in his view only a failed attempt at that same emendatio. Through the analysis of the texts, this article considers the (...) possibility of a new reading of the ‘failure’ attributed by Wolff to Clauberg, which would consist in his having ‘emended’ first philosophy by expelling it from the domain of ontology and finally identifying it with Cartesian prima philosophia.
