In this paper we describe a method for the specification of computationalmodels of argument using dialogue games. The method, which consists ofsupplying a set of semantic definitions for the performatives making upthe game, together with a state transition diagram, is described in full.Its use is illustrated by some examples of varying complexity, includingtwo complete specifications of particular dialogue games, Mackenzie's DC,and the authors' own TDG. The latter is also illustrated by a fully workedexample illustrating all the features of the game.

Stories can be powerful argumentative vehicles, and they are often used to present arguments from analogy, most notably as parables, fables or allegories where the story invites the hearer to infer an important claim of the argument. Case Based Reasoning in Law has many similar features: the current case is compared to previously decided cases, and in case the similarity between the previous and current cases is deemed sufficient, a similar conclusion can be drawn for the current case. In this (...) article, we want to take a further step towards computationally modelling the connection between stories and argumentation in analogical reasoning. We show how story schemes can be used to investigate and determine story similarity, and how the point of a story – that is, the conclusion that the storyteller intends the hearer to draw – can be likened to the ratio decidendi in a legal case. Finally, we present some formal tools for modelling stories based on computational models of practical reasoning. (shrink)

Reasoning with cases has been a primary focus of those working in AI and law who have attempted to model legal reasoning. In this paper we put forward a formal model of reasoning with cases which captures many of the insights from that previous work. We begin by stating our view of reasoning with cases as a process of constructing, evaluating and applying a theory. Central to our model is a view of the relationship between cases, rules based on cases, (...) and the social values which justify those rules. Having given our view of these relationships, we present our formal model of them, and explain how theories can be constructed, compared and evaluated. We then show how previous work can be described in terms of our model, and discuss extensions to the basic model to accommodate particular features of previous work. This paper is an introduction to a virtual special issue of AI and Law exploring the legacy of the influential HYPO system of Rissland and Ashley. After describing HYPO, in this introduction to the special issue I look at various aspects of its influence on AI and Law: the developments led by Rissland at Amherst; the developments led by Ashley in Pittsburgh; the expression of these ideas in terms of rule based systems, and their subsequent formalisation; value based theories, which were inspired by a critique of HYPO; and contemporary approaches which revive the idea of dimensions. In this paper, we take up an old issue that of pragmemes, broached by Mey and further explored by Capone. It is not easy to define pragmemes and distinguish them sufficiently from speech acts (units of language use broached by Austin and Searle) or from Wittgensteinian language games or from macro speech acts (see van Dijk on macrostructures) or from Goffman’s scripts. The best idea we could develop about pragmemes is that they instantiate the triple articulation of language, proposed (...) by Jock Wong; being essentially composed of phonological-syntactic units, that have a certain content relative to a social situation and to a certain culture, pragmemes express a certain function (or illocutionary force), like, e.g., modifying society or some aspect of it. They are part of a chapter that can be called either “societal pragmatics” or “emancipatory pragmatics,” to use the words by Mey. In fact, knowledge of how language is used to diminish the rights of people and to propagate the “status quo” may be instrumental to give rights and power to ordinary human beings who are oppressed by political and economical structures. -/- . This book shows how pragmatics and philosophy are interconnected, and explores the consequences and ramifications of this innovative idea, especially in addressing and solving the problem of breaking Grice's circle. The author applies philosophy in order to get to a better understanding of pragmatics, and pragmatics in order to get a better understanding of philosophy. The book starts with a chapter on the non-cancellability of explicatures and the role that this idea plays in the resolution of Grice’s circle, and proceeds (...) with the discussion of other topics in which explicatures or cancellability play an important and decisive role. While the reader proceeds in the reading of this book, they accumulate notions and pieces of knowledge which will be of invaluable use when arriving at the chapter on conversational presuppositions, where the author expresses his most radical views: namely that presuppositions are indeed cancellable, contrary to what many believe. In this paper, I develop a pragmatic view of the poetic function of language by resorting to the ideas of contextualism, inferential pragmatics, and pragmemes (Mey, 2001, Capone, 2005), developing considerations on the poetic function of language on the basis of considerations by Jakobson (1960) and Waugh (1980). I argue that pragmatics plays an important role in elucidating the poetic function of language and that even in everyday language (not only in anthologies) we find cases of texts where the (...) poetic function coexists with (or aids) other functions. Contextualism allows us to interpret a poem: referents must be fixed or need not be fixed due to the requirements of the discourse; citations are brought in through pragmatic ways; polyphony is achieved via sedimentation of citations in a current text; the vicinity of a certain word, or concept, or line is likely to affect the interpretation of a certain expression. Polyphony is what allows the text to live on in a dimension that transcends the limits of the subjective experience of the poet but allows the text to be inserted in a tradition in which each verse reverberates with memories of other verses. The poetic text can take different forms, from graffiti to discourse at the market-place, to discourse between lovers. All these forms of poetic text would not exist if the notion of poetry did not include the idea of semantic/pragmatic compression which is matched, in interpretation, by expansions. In this paper, I also try to tackle the issue of the universal appeal of some poems, even if I am aware that this topic is as mysterious as fascinating. Paradoxically, a contextual approach to poetry seems to be at odds with the claim that the most acclaimed examples of poems have a universal appeal and touch a universal chord in the readers’ hearts. What is genuinely puzzling is the contrast between the need to fully contextualize a text and the fact that such a text can have a universal appeal across cultures. (shrink)

Reconstruction of human ecosystems and their stability over time provides knowledge of the processes of adaptability developed by isolated communities. Seasonality of vital events is a good indicator of the effects of different lifestyles, which in turn depend on the ecological context in which a population developed specific subsistence models. Seasonality of births reflects the cultural attitude towards the best time to conceive, in relation to work activities and loads; the latter may also affect physiological functions related to fertility. The (...) present research concerns gross birth rates and seasonality of births and conceptions during four centuries in south-central Italy. Birth rates were between 33·0 and 36·5 per 1000. The pattern of seasonality of births and, by extension, of conceptions defines a southern-type agricultural area for the earlier periods. However, it also shows a progressive shift towards an increasing concentration of conceptions in spring namely from April to August – with a large increase in summer in the 19th century with respect to the previous periods. The new 19th century pattern is reported by Crisafulli, Dalla Zuanna & Solero (2000) as being representative of the central Adriatic region, a geographical classification to which Abruzzo can also be attributed. This volume articulates and develops new research questions and original insights regarding the philosophical dialogue between Hegel’s philosophy, his heritage, and contemporary phenomenology, including, among others, Husserl, Heidegger, Merleau-Ponty, and Ricoeur. The collection discusses methodological questions concerning the relevance of Hegel’s philosophy for contemporary phenomenology, addressing core issues revolving around the key concepts of history, being, science, subjectivity, and dialectic. The volume fills a gap in historiography, expanding the knowledge of the impact of Hegel's philosophy on contemporary philosophy and raising (...) new questions on the transformation of transcendental philosophy in post-Kantian philosophy. We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. As a whole, the subsections build into (...) a history of the last quarter century of the field, and provide some insights into where it has come from, where it is now, and where it might go. The recent debate on pragmatics and the law has found ways to circumvent an important distinction, originally drawn by Dascal and Wróblewski (1991), between the historical law-maker, the current law-maker, and the ideal/rational law-maker.1 By insisting on the relationship between the rational law-maker and contextualism and textualism (see Manning 2005, 2006), I want to redress this fault in current discussions. In this paper, I start with general considerations on pragmatics, intentionality in ordinary conversation, and intentionality in the context of judiciary (...) proceedings and legal texts. I then move on to considerations on rationality as a prerequisite for understanding the law and on the rational law-maker, an ideal construct proposed by Dascal and Wróblewski (1991). I argue that contextualism (of the moderate kind) is the best way to carry out the program by Dascal and Wróblewski on interpretation and the rational law-maker (also see considerations by Fish 2005); (on contextualism see Dascal and Weizman 1987). I argue that bearing in mind the rational law-maker postulated by Dascal and Wróblewski is a guidance to interpretation of statutes whose texts create interpretative difficulties. I conclude by saying that the considerations on the rational law-maker constitute a compromise between Scalia’s (1997) textualism and contextualism (see Manning 2005, 2006 on the divide between textualism and contextualism). This article reports three experiments that investigated the relationship between working memory capacity and syllogistic and five-term series spatial inference. A series of complex and simple verbal and spatial working memory measures were employed. Correlational analyses showed that verbal and spatial working memory span tasks consistently predicted syllogistic and spatial reasoning performance. A confirmatory factor analysis showed that three factors best accounted for the data--a verbal, a spatial, and a general factor. Syllogistic reasoning performance loaded all three factors, whilst spatial (...) reasoning loaded only the general factor. The implications of these findings are discussed in the context of reasoning theories and contemporary accounts of the structure of working memory. (shrink)

Background: When infertility is diagnosed, physicians have the difficult task to break bad news. Their communication skills play a central role in improving patients' coping abilities and adherence to infertility treatments. However, specific guidelines and training courses on this topic are still lacking. The aim of the present study is to provide some practical advice for improving breaking bad news in infertility diagnosis through a systematic literature review of qualitative and quantitative studies. Methods: Electronic searches were performed in the MEDLINE, (...) Embase, PsycINFO, Cumulative Index to Nursing and Allied Health Literature, and Psychology and Behavioral Sciences Collection databases. All articles focusing on the communication of the diagnosis of infertility were included. The main findings of each included article were then summarized. Results: Literature search identified 11,838 references that were screened for eligibility. Full texts of 81 articles were retrieved, and their analysis led to the inclusion of 4 articles, which treated the theme of communication of infertility only partially. The main addressed aspects concerning the communication of the infertility diagnosis were the following: the value that patients give to healthcare professionals' communication skills; the importance of giving clear information on diagnostic procedures and treatments in order to decrease patients' anxiety; and the importance of involving both partners. Conclusions: This review pointed out that the communication of the infertility diagnosis is still underinvestigated. Specific guidelines are currently not available, but other protocols could be used. Taking into account the principal aspects of communication highlighted with this review, in this study, we suggested an adaptation of the original SPIKES protocol that could be used by healthcare professionals for the communication of the infertility status. Quasi-proper names and quasi-quasi proper names.

The design and analysis of norms is a somewhat neglected topic in AI and Law, but this is not so in other areas of Computer Science. In recent years powerful techniques to model and analyse norms have been developed in the Multi-Agent Systems community, driven both by the practical need to regulate electronic institutions and open agent systems, and by a theoretical interest in mechanism design and normative systems. Agent based techniques often rely heavily on enforcing norms using the software (...) to prevent violation, but I will also discuss the use of sanctions and rewards, and the conditions under which compliance by autonomous agents (including humans) can be expected or encouraged without sanctions or rewards. In the course of the paper a suggested framework for the exploration of these issues is developed. (shrink)

Explicatures are not cancellable. Theoretical considerations.

This research is part of the project "Corporate Social Responsibility in Ecuadorian savings and credit cooperatives. A multi-case analysis and proposal for the development of a cooperative education program" and examines the synergy between cooperative principles, the Sustainable Development Goals (SDGs) and the dimensions proposed for a Cooperative Social Responsibility (CSR) measurement model in Ecuador. It explores how these dimensions converge to promote ethical, sustainable and socially responsible practices, aligned with current regulatory compliance. CSR has become increasingly important in cooperatives, (...) becoming a fundamental practice that encompasses cooperative governance, economic, social, environmental, ethical and technological dimensions. This study describes the methodological process for the validation of a CSR instrument in cooperatives, reviewed and validated by experts from Spain, Ecuador, Guatemala, Argentina and Cuba, using the Delphi method to reach a consensus on the relevance and clarity of the questionnaire items. This process ensures that the instrument is suitable for assessing CSR practices in credit unions, providing a reliable tool for the continuous improvement of their operations. (shrink)

The objective of the current study was to propose a sensitivity analysis of a 3D left ventricle model in order to assess the influence of parameters on myocardial mechanical dispersion. A finite element model of LV electro-mechanical activity was proposed and a screening method was used to evaluate the sensitivity of model parameters on the standard deviation of time to peak strain. Results highlight the importance of propagation parameters associated with septal and lateral segments activation. Simulated curves were compared to (...) myocardial strains, obtained from echocardiography of one healthy subject and one patient diagnosed with intraventricular dyssynchrony and coronary artery disease. Results show a close match between simulation and clinical strains and illustrate the model ability to reproduce myocardial strains in the context of intraventricular dyssynchrony. (shrink)

In this paper we describe an approach to practical reasoning, reasoning about what it is best for a particular agent to do in a given situation, based on presumptive justifications of action through the instantiation of an argument scheme, which is then subject to examination through a series of critical questions. We identify three particular aspects of practical reasoning which distinguish it from theoretical reasoning. We next provide an argument scheme and an associated set of critical questions which is able (...) to capture these features. In order that both the argument scheme and the critical questions can be given precise interpretations we use the semantic structure of an Action-Based Alternating Transition System as the basis for their definition. We then work through a detailed example to show how this approach to practical reasoning can be applied to a problem solving situation, and briefly describe some other previous applications of the general approach. In a second example we relate our account to the social laws paradigm for co-ordinating multi-agent systems. The contribution of the paper is to provide firm foundations for an approach to practical reasoning based on presumptive argument in terms of a well-known model for representing the effects of actions of a group of agents. In this article, I argue that there is philosophy of science since philosophy existed. Thus, the idea that the philosophy of science was born with neopositivism is historically wrong and detrimental to the development of the philosophy of science itself. Neopositivism tried to found the philosophy of science as an anti-philosophical discipline, as a field of study that came to replace simple philosophy. The attempt was maintained for thirty years, but failed. Now, this does not mean that we cannot make (...) good philosophy of science today, but that the philosophy of science has returned to the common house of philosophy, it is gradually recovering the connection that it should never have lost with the main philosophical traditions and disciplines. This is a reply to Gipps' commentary on my 'The Concept of Mental Disorder'.

This volume offers the reader a singular overview of current thinking on indirect reports. The contributors are eminent researchers from the fields of philosophy of language, theoretical linguistics and communication theory, who answer questions on this important issue. This exciting area of controversy has until now mostly been treated from the viewpoint of philosophy. This volume adds the views from semantics, conversation analysis and sociolinguistics. Authors address matters such as the issue of semantic minimalism vs. radical contextualism, the attribution of (...) responsibility for the modes of presentation associated with Noun Phrases and how to distinguish the indirect reporter’s responsibility from the original speaker’s responsibility. They also explore the connection between indirect reporting and direct quoting. Clearly indirect reporting has some bearing on the semantics/pragmatics debate, however, there is much controversy on “what is said”, whether this is a minimal semantic logical form or a much richer and fully contextualized logical form. This issue will be discussed from several angles. Many of the authors are contextualists and the discussion brings out the need to take context into account when one deals with indirect reports, both the context of the original utterance and the context of the report. It is interesting to see how rich cues and clues can radically transform the reported message, assigning illocutionary force and how they can be mobilized to distinguish several voices in the utterance. Decoupling the voice of the reporting speaker from that of the reported speaker on the basis of rich contextual clues is an important issue that pragmatic theory has to tackle. Articles on the issue of slurs will bring new light to the issue of decoupling responsibility in indirect reporting, while others are theoretically oriented and deal with deep problems in philosophy and epistemology.
