As social media becomes increasingly popular, human subjects researchers are able to use these platforms to locate, track, and communicate with study participants, thereby increasing participant retention and the generalizability and validity of research. The use of social media; however, raises novel ethical and regulatory issues that have received limited attention in the literature and federal regulations. We review research ethics and regulations and outline the implications for maintaining participant privacy, respecting participant autonomy, and promoting researcher transparency when using social (...) media to locate and track participants. We offer a rubric that can be used in future studies to determine ethical and regulation-consistent use of social media platforms and illustrate the rubric using our study team’s experience with Facebook. The number of children with chronic critical illness (CCI) is a growing population in the United States. A defining characteristic of this population is a prolonged hospital stay. Our study assessed the proportion of pediatric patients with chronic critical illness in U.S. hospitals at a specific point in time, and identified a subset of children whose hospital stay lasted for months to years. The potential harms of a prolonged hospitalization for children with CCI, which include over treatment, infection, disruption of (...) family life, and the intensive utilization of resources—combined with the moral distress experienced by the clinicians who care for the children, suggest the need for ethical analysis of this growing issue to identify actions that could be taken at the clinical and health systems levels to reduce the harms associated with prolonged hospital stay.In this article we present three real cases from our study that involved a very long hospital stay. We applied a framework developed by Mackenzie, Rogers, and Dodds to analyze inherent, situational, and pathogenic vulnerabilities to examine the ways that interventions intended to remedy one source of harm for the children in our cohort inadvertently created other harms. We examined the complex ways that children with protracted hospitalization are vulnerable to the choices made by their family and clinicians, as well as by healthcare systems and communities. Finally, we used this analysis to summarize actions and ethical responses to this growing patient population. Such an understanding is essential to making clinical and ethical decisions that arise for children who are at risk for a very long stay in the hospital. (shrink)

The paper provides a new argument against the classical invariance criterion for logical terms: if all terms with a permutation invariant extension qualify as logical, then for any arbitrary true contingent sentence K of the meta-language, there would be a logically true object-language sentence 'φ' such that K follows from the sentence 'φ is true'. Thus, many logically true sentences would be a posteriori. To prevent this fatal consequence, we propose to alter the invariance criterion: not only the term's extension, (...) but also its semantic clause must satisfy certain invariance conditions. The paper ends with the observation that the new criterion makes explicit the dependency of the classification of terms into logical and non-logical ones at the different levels of the Tarskian hierarchy of languages. We prove an effective version of the Lopez-Escobar theorem for continuous domains. Medical-legal partnerships connect legal advocates to healthcare providers and settings. Maintaining effectiveness of medical-legal partnerships and consistently identifying opportunities for innovation and adaptation takes intentionality and effort. In this paper, we discuss ways in which our use of data and quality improvement methods have facilitated advocacy at both patient (client) and population levels as we collectively pursue better, more equitable outcomes.

Business Ethics: A European Review, EarlyView.

Recently, two apparently quite different duality-based approaches to automata minimisation have appeared. One is based on ideas that originated from the controllability-observability duality from systems theory, and the other is based on ideas derived from Stone-type dualities specifically linking coalgebras with algebraic structures derived from modal logics. In the present paper, we develop a more abstract view and unify the two approaches. We show that dualities, or more generally dual adjunctions, between categories can be lifted to dual adjunctions between categories (...) of coalgebras and algebras, and from there to automata with initial as well as final states. As in the Stone-duality approach, algebras are essentially logics for reasoning about the automata. By exploiting the ability to pass between these categories, we show that one can minimize the corresponding automata. We give an abstract minimisation algorithm that has several instances, including the celebrated Brzozowski minimisation algorithm. We further develop three examples that have been treated in previous works: deterministic Kripke frames based on a Stone-type duality, weighted automata based on the self-duality of semimodules, and topological automata based on Gelfand duality. As a new example, we develop alternating automata based on the discrete duality between sets and complete atomic Boolean algebras. (shrink)

Il semble que la mise en oeuvre des droits reconnus par les législateurs et les tribunaux en contexte d’avortement tardif et d’aide médicale à mourir connaît, en pratique, un problème d’effectuation. En effet, nous nous trouvons actuellement dans une ère où le droit accorde énormément d’importance à l’autonomie individuelle dans le domaine médical, mais où les pratiques et les autres normativités viennent considérablement limiter cette autonomie. Il convient, dès lors, de poser un regard critique sur le concept d’autonomie en contexte (...) d’avortement tardif et d’aide médicale à mourir. Ces constats soulèvent des questionnements sur le rôle et les limites du droit étatique lorsque transposé en contexte clinique, ainsi que sur le peu d’attention que porte le droit aux destinataires de la norme. Le défi consiste alors à faire cohabiter les différentes normes et valeurs afin que les mécanismes de prises de décisions traduisent un souci réel d’assurer le vivre ensemble. (shrink)

Recent arguments claim that behavioral science has focused – to its detriment – on the individual over the system when construing behavioral interventions. In this commentary, we argue that tackling economic inequality using both framings in tandem is invaluable. By studying individuals who have overcome inequality, “positive deviants,” and the system limitations they navigate, we offer potentially greater policy solutions.

Over the past twenty years, Private Military and Security Companies (PMSCs) have become significant elements of national security arrangements, assuming many of the functions that have traditionally been undertaken by state armies. Given the centrality of control over the use of coercive force to the functioning and identity of the modern state, and to international order, these developments clearly are of great practical and conceptual interest. This edited volume provides an interdisciplinary overview of PMSCs: what they are, why they have (...) emerged in their current form, how they operate, their current and likely future military, political, social and economic impact, and the moral and legal constraints that do and should apply to their operation. The book focuses firstly upon normative issues raised by the development of PMSCs, and then upon state regulation and policy towards PMSCs, examining finally the impact of PMSCs on civil-military relations. It takes an innovative approach, bringing theory and empirical research into mutually illuminating contact. O presente trabalho analisa o itinerário do ensino de filosofia no Brasil, analisando o percurso da ausência desta disciplina nos currículos escolares, até a recente obrigatoriedade legal, que fundamenta a criação de propostas tais como a do Programa Institucional de Bolsas de Iniciação à Docência (PIBID). Abordamos os objetivos e os resultados do programa desenvolvido na Universidade Federal da Bahia (UFBA), contextualizando as ações empreendidas na escola pública, desde 2010, tendo como enfoque o projeto Filosofia na Cozinha.

Este artigo tem como objetivo analisar a teoria dialética de Karl Marx, evidenciando suas contribuições para a filosofia. Por meio de uma revisão bibliográfica, que visa descrever as principais teorias sobre o assunto, será apresentado ao leitor que o ponto de partida para o pensamento de Marx é uma crítica a toda filosofia hegeliana, sendo a partir do confronto de ideias com o Filosofo Hegel e da esquerda hegeliana, que Marx vai construir as bases para o seu pensamento filosófico. Sua (...) teoria que posteriormente seria chamada de materialismo histórico dialético pelos seus interpretes, seria uma síntese da dialética hegeliana e do materialismo de Feuerbach, sendo concebida como um conjunto de leis que explicam a evolução da natureza como uma relação determinada por elementos da economia, sociedade e história. Essa idéia utópica compartilhada por Marx, Engels e seus sucessores foi refutada por desenvolvimentos subsequentes da filosofia. What is 'intellectual property'? This book examines the way in which this important area of law is constructed by the legal system. It argues that intellectual property is a body of rules, created by the legal system, that regulate the documented forms of abstract objects, which are also defined into existence by the legal system. Intellectual property law thus constructs its own objects of regulation and it does so through the application of a collection of core concepts. By analyzing the (...) metaphysical structure of intellectual property law and the concepts the legal system uses to construct 'intellectual property', the book sheds new light on the nature of this fascinating area of law. It explains anomalies between social and intellectual property uses of concepts such as authorship - here dubbed 'creatorship' - and originality and it helps to explain the role of intellectual property from a structural perspective. The book discusses the central notion of logic, the concept of logical consequence, and its model-theoretic definition as truth-preservation in all models. Whether the model-theoretic definition captures the modal and epistemological features of our pre-theoretic notion depends on what models model. The book argues that, given a non-formal understanding of models, the universal quantifier used in the definition of consequence must be restricted: if literally all models had to be considered, no argument would ever be logically valid. A central challenge (...) of the philosophy of logic is therefore to supplement the model-theoretic definition by a criterion for admissible models. The problem of logical constants, so prominent in the current literature on logical consequence, constitutes but a special case of this much more general demarcation problem. The book explores the various dimensions of the problem of admissible interpretations and proposes that the standard views are unjustified or even unjustifiable. As a consequence, it develops a new vision of logic and suggests in particular that our notion of logical consequence is deeply imbued with metaphysics. (shrink)

Post-war Japan has seen profound and rapid social change and transformation. One of the most visible areas of change in Japan has been medicine, and particularly the ethical practices and policies that guide medical decision-making. The formal discipline of bioethics, Seimei Rinri in Japanese, has grown by leaps and bounds since the late 1970s, when it began to appear in the curriculum and professional activities of Japanese medical schools and philosophy departments. The introduction of bioethics to Japan was timely, as (...) innovation in medicine and technology was evolving in ways that revealed that the intersection of medicine, traditional Japanese values, and new cultural trends was an area of great moral complexity. In its infancy, bioethics in Japan was more or less an import from the United States, where the discipline took its roots. Quickly, however, it became clear that Japan's history and tradition would call for a different approach, and the engagement of slightly different ethical issues. Organ transplantation, for example, sparked much greater controversy in Japan than it ever did in the United States. Today, Japan has one of the most dynamic bioethics programs in the world, and it is one that reflects both traditional Japanese culture and the need for inter-cultural engagement in an increasingly global world. Through a series of original chapters written by bioethicists and covering a range of ethical issues, this anthology shows that, in contrast to previous assumptions, Japanese bioethics has, in fact, taken on an identity that is undoubtedly separate from its American origins. Rich philosophical questions raised by medicine, human subjects research, and psychiatric care are being posed by scholars in a way that reflect Japanese tradition and is no longer simply reflective of, or shaped by, American traditions and philosophical problems. The book highlights and showcases these trends through a series of chapters written by some of the leading scholars in contemporary Japanese bioethics, many of whom were pioneers of the field when it began and are now nearing retirement. The three papers in this dissertation attempt to explore and defend a kind of middle ground with respect to the question of moral objectivity. In the first paper I use the case of disgust to show how not to go about raising skepticism about moral judgment; in doing so, I argue that disgust can be vindicated with an account on which it tracks social contagion as well as physical contamination. Therefore, the question of whether disgust is an appropriate reaction to (...) moral wrongness can sometimes be answered in the affirmative. In the second paper, I use empirical data from anthropology and psychology to argue that moral disagreement makes trouble for the claim that morality is objective, but I don’t reject objectivity entirely— in the third paper I go on to argue that moral relativism best makes sense of a morality that appears to be objective with respect to some questions but not others.
