This article provides an ethical critique of the Good Clinical Practice (GCP) and Declaration of Helsinki (DoH) documents. While the previous criticisms of GCP are entirely correct, there is much more wrong with the document than has previously been acknowledged, including a circular definition and an astonishing vagueness about ethical principles. In addition to its failure to provide adequate ethical protection of participants, the procedurally dense nature of GCP lends itself to a box-ticking culture where important ethical issues are overlooked (...) because they are not ‘mentioned on the form’. In contrast, the DoH is a much more effective ethical document, but actually goes too far in one respect. It transpires that the best ethical guidelines for clinical research would be neither over-prescriptive in regard to particular ethical issues (as the DoH is) nor neglectful of them (as GCP is); correctly framed ethical principles will provide sufficient protection to participants while also ensuring a culture of ethicovigilance in clinical trials. Cultural evolution studies are characterized by the notion that culture evolves accordingly to broadly Darwinian principles. Yet how far the analogy between cultural and genetic evolution should be pushed is open to debate. Here, we examine a recent disagreement that concerns the extent to which cultural transmission should be considered a preservative mechanism allowing selection among different variants, or a transformative process in which individuals recreate variants each time they are transmitted. The latter is associated with the notion of “cultural (...) attraction”. This issue has generated much misunderstanding and confusion. We first clarify the respective positions, noting that there is in fact no substantive incompatibility between cultural attraction and standard cultural evolution approaches, beyond a difference in focus. Whether cultural transmission should be considered a preservative or reconstructive process is ultimately an empirical question, and we examine how both preservative and reconstructive cultural transmission has been studied in recent experimental research in cultural evolution. Finally, we discuss how the relative importance of preservative and reconstructive processes may depend on the granularity of analysis and the domain being studied. (shrink)

In this paper, we consider how certain longstanding philosophical questions about mental representation may be answered on the assumption that cognitive and perceptual systems implement hierarchical generative models, such as those discussed within the prediction error minimization framework. We build on existing treatments of representation via structural resemblance, such as those in Gładziejewski :559–582, 2016) and Gładziejewski and Miłkowski, to argue for a representationalist interpretation of the PEM framework. We further motivate the proposed approach to content by arguing that it (...) is consistent with approaches implicit in theories of unsupervised learning in neural networks. In the course of this discussion, we argue that the structural representation proposal, properly understood, has more in common with functional-role than with causal/informational or teleosemantic theories. In the remainder of the paper, we describe the PEM framework for approximate Bayesian inference in some detail, and discuss how structural representations might arise within the proposed Bayesian hierarchies. After explicating the notion of variational inference, we define a subjectively accessible measure of misrepresentation for hierarchical Bayesian networks by appeal to the Kullbach–Leibler divergence between posterior generative and approximate recognition densities, and discuss a related measure of objective misrepresentation in terms of correspondence with the facts. This article puts pressure on moral motivational internalism and rejects normative motivational internalism by arguing that we should be aesthetic motivational externalists. Parallels between aesthetic and moral normativity give us new reason to doubt moral internalism. I address possible disanalogies, arguing that either they fail, or they succeed, but aren’t strong enough to underwrite a motivational difference between the domains. Furthermore, aesthetic externalism entails normative externalism, providing further presumptive evidence against moral internalism. I also make the case that, regardless of (...) these particular conclusions, examining different normative domains alongside each other is a fruitful way to move debates forward. (shrink)

What is considered to be fair depends on context-dependent expectations. Using a modified version of the Ultimatum Game, we demonstrate that both fair behavior and perceptions of fairness depend upon beliefs about what one ought to do in a situation—that is, upon normative expectations. We manipulate such expectations by creating informational asymmetries about the offer choices available to the Proposer, and find that behavior varies accordingly. Proposers and Responders show a remarkable degree of agreement in their beliefs about which choices (...) are considered fair. We discuss how these results fit into a theory of social norms. This essay examines a recent line of thought in aesthetics that challenges realist-leaning aesthetic theories. According to this line of thought, aesthetic diversity and disagreement are good, and our aesthetic judgments, responses, and attachments are deeply personal and even identity-constituting. These facts are further used to support anti-realist theories of aesthetic normativity. I aim to achieve two goals: (1) to disentangle arguments concerning diversity, disagreement, and personality; and (2) to offer realist-friendly replies to all three.

This paper presents a formal account of how to determine the discourse relations between propositions introduced in a text, and the relations between the events they describe. The distinct natural interpretations of texts with similar syntax are explained in terms of defeasible rules. These characterise the effects of causal knowledge and knowledge of language use on interpretation. Patterns of defeasible entailment that are supported by the logic in which the theory is expressed are shown to underly temporal interpretation.

It is commonly assumed that ‘ought’ implies ‘can’, that is, that if we ought to do something, then it must be the case that we can do it. It is a frequent quip about this thesis that any account must specify three things: what is meant by the ‘ought’, what is meant by the ‘implies’, and what is meant by the ‘can’. Something is missed, though, when we state the thesis in its shortened, three-word form. We overlook what it means (...) to do something. It is, I think, not mere coincidence that nobody has discussed this issue: It is very difficult to specify what it means to do something in the relevant sense. First-in-human clinical trials represent a critical juncture in the translation of laboratory discoveries. However, because they involve the greatest degree of uncertainty at any point in the drug development process, their initiation is beset by a series of nettlesome ethical questions [1]: has clinical promise been sufficiently demonstrated in animals? Should trial access be restricted to patients with refractory disease? Should trials be viewed as therapeutic? Have researchers adequately minimized risks? The resolution of such ethical questions inevitably turns on claims (...) about future events like harms, therapeutic response, and clinical translation. Recurrent failures in clinical translation, like Eli Lilly's Alzheimer candidate semagacestat, highlight the severe limitations of current methods of prediction. In this case, patients in the active arm of the placebo-controlled trial had earlier onset of dementia and elevated rates of skin cancer [2]. Various authoritative accounts of human research ethics state that decision-making about risk and benefit should be careful, systematic, and non-arbitrary [3]–[5]. Yet, these sources provide little guidance about what kinds of evidence stakeholders should use to ensure their estimates of such events ground responsible ethical decisions. In this article, we suggest that investigators, oversight bodies, and sponsors often base their predictions on a flawed and inappropriately narrow preclinical evidence base. (shrink)

Should we restore degraded nature, and if so, why? Environmental theorists often approach the problem of restoration from perspectives couched in much broader debates, particularly regarding the intrinsic value and moral status of natural entities. Unfortunately, such approaches are susceptible to concerns such as the baseline problem, which is both a philosophical and technical issue related to identifying an appropriate restoration baseline. Insofar as restoration ostensibly aims to return an ecosystem to a particular baseline state, and depends upon clearly identifying (...) this baseline for success, the very project of restoration appears impossible to get off the ground. Recasting environmental restoration in terms of obligations, instead of status, value, or worth, can avoid this and other classic challenges. If obligations to restore nature follow from intersubjectively validated reasons to justify our actions, we can salvage restoration from the threat of the baseline problem. (shrink)

In face-to-face interaction, speakers make multimodal contributions that exploit both the linguistic resources of spoken language and the visual and spatial affordances of gesture. In this paper, we argue that, in formulating and understanding such multimodal contributions, interlocutors apply the same principles of coherence that characterize the interpretation of natural language discourse. In particular, we use a close analysis of a series of naturally-occurring embodied discourses to argue for two key generalizations. First, communicators and their audiences draw on coherence relations (...) to establish interpretive connections between successive gestures and between gestures and speech. Second, coherence relations facilitate meaning-making by resolving the underspecified meaning of each communicative act through constrained inference over entities, propositions, and spatial frames made salient in the prior discourse. Our approach to gesture interpretation improves on previous work in better accounting for its flexibility, in capturing its constraints, and in laying the groundwork for formal and computational models. At the same time, it shows that gesture provides an important source of evidence to sharpen the theory of coherence relations and contextual resolution. (shrink)

The trend towards postponement of childbearing has seen increasing numbers of women turning towards oocyte banking for anticipated gamete exhaustion (AGE banking), which offers a realistic chance of achieving genetically connected offspring. However, there are concerns around the use of this technology, including social/ethical implications, low rate of utilisation and its cost-effectiveness. The same societal trends have also resulted in an increased demand and unmet need for donor oocytes, with many women choosing to travel overseas for treatment. This has its (...) own inherent social, medical, financial and psychological sequelae. We propose a possible pathway to address these dual realities. The donation of oocytes originally stored in the context of AGE banking, with appropriate compensatory mechanisms, would ameliorate AGE banking concerns, while simultaneously improving the supply of donor oocytes. This proposed arrangement will result in tangible benefits for prospective donors, recipients and society at large. (shrink)

Background: how mind functions is subject to continuing scientific discussion. A simplistic approach says that, since no convincing way has been found to model subjective experience, mind cannot exist. A second holds that, since mind cannot be described by classical physics, it must be described by quantum physics. Another perspective concerns mind's hypothesized ability to interact with the world of quanta: it should be responsible for reduction of quantum wave packets; physics producing 'Objective Reduction' is postulated to form the basis (...) for mind-matter interactions. This presentation describes results derived from a new approach to these problems. It is based on well-established biology involving physics not previously applied to the fields of mind, or consciousness studies, that of critical feedback instability. -/- Methods: 'self-organized criticality' in complexity biology places system loci of control at critical instabilities, physical properties of which, including information properties, are presented. Their elucidation shows that they can model hitherto unexplained properties of experience. -/- Results: All results depend on physical properties of critical instabilities. First, at least one feed-back or feed-forward loop must have feedback gain, g = 1: information flows round the loop impress perfect images of system states back on themselves: they represent processes of perfect self-observation. This annihilates system quanta: system excitations are instability fluctuations, which cannot be quantized. Major results follow: -/- 1. Information vectors representing criticality states must include at least one attached information loop denoting self-observation. -/- 2. Such loop structures are attributed a function, 'registering the state's own existence', explaining -/- a. Subjective 'awareness of one's own presence' -/- b. How content-free states of awareness can be remembered (Jon Shear) -/- c. Subjective experience of time duration (Immanuel Kant) -/- d. The 'witness' property of experience – often mentioned by athletes 'in the zone' -/- e. The natural association between consciousness and intelligence -/- This novel, physically and biologically sound approach seems to satisfactorily model subjectivity. -/- Further significant results follow: -/- 1. Registration of external information in excited states of systems at criticality reduces external wave-packets: the new model exhibits 'Objective Reduction' of wave packets. -/- 2. High internal coherence (postulated by Domash & Penrose) leading to a. Non-separable information vector bundles. b. Non-reductive states (Chalmers's criterion for experience). -/- 3. Information that is: a. encoded in coherence negentropy; b. non-digitizable, and therefore c. computationally without digital equivalent (posited by Penrose). -/- Discussion and Conclusions: instability physics implies anharmonic motion, preventing excitation quantization, and totally different from the quantum physics of simple harmonic motion at stability. Instability excitations are different from anything hitherto conceived in information science. They can model aspects of mind never previously treated, including genuine subjectivity, objective reduction of wave-packets, and inter alia all properties given above. (shrink)

This article examines methodological debates in legal philosophy by focusing on two methodological claims in H. L. A. Hart’s 1961 book, The Concept of Law: that Hart’s theory is both general and descriptive, and an exercise in both linguistic analysis and descriptive sociology. It considers what these claims reveal about Hart’s theoretical ambitions and methodological commitments, and what light they shed on debates in legal philosophy since then. In particular, it discusses the most important elements of Hart’s theory, such as (...) the union of primary and secondary rules in law, the “rule of recognition” as a social rule, and the relationship between legal and moral norms. It also explores several objections to Hart’s approach to the problems of legal philosophy, including one that questions the fruitfulness of the methodology of conceptual analysis. Scholars are increasingly concerned about social biases in facial analysis systems, particularly with regard to the tangible consequences of misidentification of marginalized groups. However, few have examined how automated facial analysis technologies intersect with the historical genealogy of racialized gender—the gender binary and its classification as a highly racialized tool of colonial power and control. In this paper, we introduce the concept of auto-essentialization: the use of automated technologies to re-inscribe the essential notions of difference that were established under colonial (...) rule. We consider how the face has emerged as a legitimate site of gender classification, despite being historically tied to projects of racial domination. We examine the history of gendering the face and body, from colonial projects aimed at disciplining bodies which do not fit within the European gender binary, to sexology's role in normalizing that binary, to physiognomic practices that ascribed notions of inferiority to non-European groups and women. We argue that the contemporary auto-essentialization of gender via the face is both racialized and trans-exclusive: it asserts a fixed gender binary and it elevates the white face as the ultimate model of gender difference. We demonstrate that imperialist ideologies are reflected in modern automated facial analysis tools in computer vision through two case studies: commercial gender classification and the security of both small-scale and large-scale spaces. Thus, we posit a rethinking of ethical attention to these systems: not as immature and novel, but as mature instantiations of much older technologies. (shrink)

Life is confused (...) and superabundant, and what the younger generation appears to crave is more of the temperament of life in its philosophy, even though it were at some cost of logical rigor and formal purity." - William James (1904). -/- Abstract: The study of model-based reasoning (MBR) is one of the most interesting recent developments at the intersection of psychology and the philosophy of science. Although a broad and eclectic area of inquiry, one central axis by which MBR connects these disciplines is anchored at one end in theories of internal reasoning (in cognitive science), and at the other, in C.S. Peirce’s semiotics (in philosophy). In this paper, we attempt to show that Peirce’s semiotics actually has more natural affinity on the psychological side with ecological psychology, as originated by James J. Gibson and especially Egon Brunswik, than it does with non-interactionist approaches to cognitive science. In particular, we highlight the strong ties we believe to exist between the triarchic structure of semiotics as conceived by Peirce, and the similar triarchic stucture of Brunswik’s lens model of organismic achievement in irreducibly uncertain ecologies. The lens model, considered as a theory of creative abduction, provides a concrete instantiation of at least one, albeit limited, interpretation of Peirce’s semiotics, one that we believe could be quite fruitful in future theoretical and empirical investigations of MBR in both science an philosophy. I present Modern Symbolic Logic, an introductory philosophy course in first-order logic, as a blended course. A blended course integrates online video learning with in-class activities, out of class supports, and deliverables into a cohesive and mutually supporting package. Blended courses are an enhancement on hybrid courses, which focus on online video learning but not on the additional supports needed for an effective learning experience. This paper has two central aims. The first is to present a blended course in action (...) in order to address a need in the literature for detailed reports of blended classes. The second is to advance an iterative approach to blended course design that significantly lowers the bar of entry for instructions hoping to create a blended course. (shrink)

Disjoint n-amalgamation is a condition on a complete first-order theory specifying that certain locally consistent families of types are also globally consistent. In this article, we show that if a countably categorical theory T admits an expansion with disjoint n-amalgamation for all n, then T is pseudofinite. All theories which admit an expansion with disjoint n-amalgamation for all n are simple, but the method can be extended, using filtrations of Fraïssé classes, to show that certain nonsimple theories are pseudofinite. As (...) case studies, we examine two generic theories of equivalence relations, Tfeq∗ and TCPZ, and show that both are pseudofinite. The theories Tfeq∗ and TCPZ are not simple, but they have NSOP1. My paper has two aims: to underscore the importance of differently time-indexed ‘ought implies can’ principles; and to apply this to the culpable inability problem. Sometimes we make ourselves unable to do what we ought, but in those cases, we may still fail to do what we ought. This is taken to be a serious problem for synchronic ‘ought implies can’ principles, with a simultaneous ‘ought’ and ‘can’. Some take it to support diachronic ‘ought implies can’, with a potentially temporally (...) distinct ‘ought’ and ‘can’. I will argue that this problem is not avoided by diachronic ‘ought implies can’. (shrink)

Este texto pretende apresentar reflexões acerca do pensamento em constelação proposto por Adorno para problematizar as práticas formativas colocadas em movimento nos contextos educativos. Para tanto, nos utilizamos da pesquisa bibliográfica para pensar criticamente sobre a formação dos sujeitos nos contextos educativos. Inspirados no pensamento adorniano nos reportamos ao conceito de constelação e, posteriormente, às categorias de emancipação e autorreflexão. As problematizações construídas nesse trabalho podem contribuir para o desvelamento da multiplicidade de questões que envolvem a complexidade do campo educativo (...) e dos sujeitos que ali se constituem. Indicam a necessidade de compreender que um conceito se entrelaça com outros conceitos, que ultrapassa a linearidade e a busca de um ponto de chegada. Nessa direção, é imprescindível redimensionar os processos de formação docente, ampliando as perspectivas de formação e promovendo experiências de autorreflexão da própria razão. This article offers a new reading of the Muse in Empedocles’ Physica. I aim to show that she is integrated into the poet’s physiological conception of the cosmos and that she also plays a central role in the furtherance of his eschatological purposes. Empedocles, it will be suggested, first put the Muse at the service of the philosophical logos, and in taking that step, he embraced and transcended the conventions of Muse-invocation not only in epic-didactic poetry but in the lyric (...) and elegiac traditions as well. On this reading, the “Muse of the agathos logos ” will emerge as a strikingly innovative creation, one that was to exercise a powerful and enduring influence on Greek and Roman conceptions of the goddess Muse in relation to the mind of the poet. This article explores the relationship between Gilles Deleuze's philosophical endeavours and Marxism, with a particular focus on his unfinished work, Grandeur de Marx. Despite the collapse of Soviet socialism, Deleuze acknowledged that his philosophical pursuits were profoundly intertwined with Marxist thought. His insistence on this connection was not a mere expression of regret or an apology for his political leanings. In the 1990s, as neoliberal globalisation spread beyond the United States and Europe, Marxism persisted as a rallying cry for resistance. (...) The ascendancy of global capitalism was not a consequence of Marxism's failure; rather, it was a manifestation of what Marx had presciently predicted in his works. Thus, Deleuze's unfinished project on Marx can be viewed as a response to anti-Marxist reactionism from a distinct vantage point. While several interpretations of Deleuze's unwritten Marx exist, the argument in this essay is that Deleuze attempted to recreate the conditions for Marx's critical analysis by employing communism as an event. Skill building is a widely recognized teaching goal in philosophy. Some well-researched skill building techniques include scaffolded assignment design, low-stakes assignments, and peer-review. Many papers have highlighted the efficacy of these techniques by demonstrating novel course and assignment design; for example, the use of blogging in philosophy courses has been shown to have positive results on student writing. While the efficacy of skill building centered course design on student learning seems uncontroversial, two major problems are typically raised: the time investment (...) for such course design is significant and implementing these techniques in large classes is not possible. The central aim of this paper is to combat this second claim. I present a course designed around skill building that has been successfully implemented in classes of from 120 to 450 students. I show some techniques that make this implementation possible and not unwieldy, and I argue that students both improved their philosophical skills and enjoyed the course design. (shrink)

It’s interesting and a bit surprising how little attention philosophy has given to the status of emoji, those funny little symbols that punctuate text messages, Twitter, and other digital spaces. They have become ubiquitous, but maybe because they’re seen as frivolous or a “lower” form of communication, philosophy hasn’t paid them much mind. But they are an interesting aesthetic phenomenon. They are part language, part representational image. They are phenomenologically interesting in their effect on how we experience the written word. (...) They punctuate, accentuate, emphasize, and add flavor to our communication in ways that are difficult to achieve otherwise. It would not be ridiculous to say that they represent a genuine linguistic development—a change in conventional orthography, and of an almost unbelievably sudden and dramatic, even revolutionary, kind. What does the open-carried gun tell us about the contemporary political structure of whiteness, and how do such objects operate to reinforce this structure? To work through these questions, this article brings together political theories of racialized democracy and political theoretical analyses of gun-rights debates with insights from interdisciplinary scholarship on guns to generate a political theoretical account of the relationship between guns and white democracy. To do so, we analyze two open-carry spectacles: recurring Second Amendment protests featuring the prominent (...) display of open-carried weapons, and open-carrying protestors in Michigan demonstrating against stay-at-home orders in response to COVID-19 in 2020. Our analysis of these two cases illuminates our central arguments about guns and white democracy. We argue that guns operate to politically align white bodies amid the ongoing constitution of political whiteness: open-carried firearms work to reinforce and reproduce white democracy. We further claim that the force of open-carried guns in sustaining white democracy works through two linked dynamics: first, guns extend, generate, and secure the wages of whiteness; second, they protect and assert white dominion. Taken together, these dynamics explain how guns uphold white democracy, but also illuminate, we argue, the contingency of that political power. It is that contingency which suggests that the open-carried firearm might also help contest it in turn, a point illustrated by turning to scholarship on the relation of firearms to the civil rights movement. The Aedes Herculis Musarum (AHM), embodying musical harmony, was a symbolic focal point for political concordia at Rome. The treatment of its cult honorands in high poetry also embraces Juno Regina, whose contemporary temple was adjacent to the AHM. Juno (as Moneta) and the Muses are further associated in the function of "memory," and Juno, when offended, is susceptible to musical propitiation. The AHM is prominently identified with concord and Junonian reconciliation at the end of the Fasti, and in the (...) Aeneid, Vergil evokes his Muse's Roman cult identity in exploring Juno's hostility towards the "Herculean" Aeneas, as also when he foreshadows her assent to the existence of Rome. (shrink)

This paper takes as its starting point an examination of the current status of some of the concerns that were raised in the mid?1980s about methodological problems faced by educational researchers using the behavioural approach in schools. These concerns included the measurement of agreement between observers, the interpretation of raw data extracted, the potential influences of observers and the inherent properties of research designs. The decision to initiate invasive, first-in-human trials involving Parkinson’s disease presents a vexing ethical challenge. Such studies present significant surgical risks, and high degrees of uncertainty about intervention risks and biological effects. We argue that maintaining a favorable riskbenefit balance in such circumstances requires a higher than usual degree of confidence that protocols will lead to significant direct and/or social benefits. One critical way of promoting such confidence is through the application of stringent evidentiary standards for preclinical studies. In recent years, scholars have paid considerable attention to moderation in Montesquieu’s De l’esprit des lois. Still, little scholarship has considered how Montesquieu develops moderation as a concept and practice. In this article, I argue Montesquieu’s complementary defense of moderation and critique of despotism rely on immoderate argumentative practices of omission that enable him to reshape extant laudatory narratives of China and Japan. Through an analysis of Montesquieu’s primary texts on climate and commerce, I demonstrate that, absent these practices, Montesquieu’s (...) “Asian despotism” collapses, revealing the moderate natures of both countries. This conclusion is paradoxical insofar as we take seriously Montesquieu’s claim that De l’esprit des lois upholds the spirit of moderation as of paramount importance. Moreover, I argue that this analysis of Montesquieu’s paradoxical spirit brings to light under-examined dimensions of Montesquieu’s work and alerts political theorists to how different reading practices can recast his “moderate” reputation. Few scientific disciplines have the potential of cognitive science to speak to the problems which people face every day in dealing with an increasingly complex technological, social, and cultural environment. In principle, understanding activities such as perceiving, learning, reasoning, speaking, deciding, and acting should be relevant to improving either ourselves or our situations when cognition is necessary for achieving our goals. Whether by improving our inner world (e.g., through education) or our outer world (e.g., through design), cognitive science promises to (...) provide resources to help people better adapt to their environments and better adapt their environments to themselves.
