In recent years, scholars have paid considerable attention to moderation in Montesquieu’s De l’esprit des lois. Still, little scholarship has considered how Montesquieu develops moderation as a concept and practice. In this article, I argue Montesquieu’s complementary defense of moderation and critique of despotism rely on immoderate argumentative practices of omission that enable him to reshape extant laudatory narratives of China and Japan. Through an analysis of Montesquieu’s primary texts on climate and commerce, I demonstrate that, absent these practices, Montesquieu’s (...) “Asian despotism” collapses, revealing the moderate natures of both countries. This conclusion is paradoxical insofar as we take seriously Montesquieu’s claim that De l’esprit des lois upholds the spirit of moderation as of paramount importance. Moreover, I argue that this analysis of Montesquieu’s paradoxical spirit brings to light under-examined dimensions of Montesquieu’s work and alerts political theorists to how different reading practices can recast his “moderate” reputation. Cultural evolution studies are characterized by the notion that culture evolves accordingly to broadly Darwinian principles. Yet how far the analogy between cultural and genetic evolution should be pushed is open to debate. Here, we examine a recent disagreement that concerns the extent to which cultural transmission should be considered a preservative mechanism allowing selection among different variants, or a transformative process in which individuals recreate variants each time they are transmitted. The latter is associated with the notion of “cultural (...) attraction”. This issue has generated much misunderstanding and confusion. We first clarify the respective positions, noting that there is in fact no substantive incompatibility between cultural attraction and standard cultural evolution approaches, beyond a difference in focus. Whether cultural transmission should be considered a preservative or reconstructive process is ultimately an empirical question, and we examine how both preservative and reconstructive cultural transmission has been studied in recent experimental research in cultural evolution. Finally, we discuss how the relative importance of preservative and reconstructive processes may depend on the granularity of analysis and the domain being studied. (shrink)

Research suggests that interventions involving extensive training or counterconditioning can reduce implicit prejudice and stereotyping, and even susceptibility to stereotype threat. This research is widely cited as providing an “existence proof” that certain entrenched social attitudes are capable of change, but is summarily dismissed—by philosophers, psychologists, and activists alike—as lacking direct, practical import for the broader struggle against prejudice, discrimination, and inequality. Criticisms of these “debiasing” procedures fall into three categories: concerns about empirical efficacy, about practical feasibility, and about the (...) failure to appreciate the underlying structural-institutional nature of discrimination. I reply to these criticisms of debiasing, and argue that a comprehensive strategy for combating prejudice and discrimination should include a central role for training our biases away. (shrink)

Those who want to deny the ‘ought implies can’ principle often turn to weakened views to explain ‘ought implies can’ phenomena. The two most common versions of such views are that ‘ought’ presupposes ‘can’, and that ‘ought’ conversationally implicates ‘can’. This paper will reject both views, and in doing so, present a case against any pragmatic view of ‘ought implies can’. Unlike much of the literature, I won't rely on counterexamples, but instead will argue that each of these views fails (...) on its own terms. ‘Ought’ and ‘can’ do not obey the negation test for presupposition, and they do not obey the calculability or the cancelability tests for conversational implicature. I diagnose these failures as partly a result of the importance of the contrapositive of ‘ought implies can’. I end with a final argument emphasizing the role the principle plays in moral thinking, and the fact that no pragmatic account can do it justice. (shrink)

In the last decade there has been a torrent of work at the intersection of philosophy and linguistics on predicates of personal taste, subjective expressions like fun and tasty that are used to express opinions rather than matters of fact. In each section of this paper I discuss a phenomenon that has been largely overlooked in the literature on PPTs. In Section 1, I identify a neglected experiential reading of these adjectives. All other theories of expressions like fun take them (...) to express some standing property, but distributional and compositional considerations suggest that the basic meaning of fun adjectives is experiential. In Section 2, I discuss the relation between fun claims relativized to particular experiencers and their unrelativized counterparts, arguing that previous theories fail to capture the evaluativity unique to the latter. Targeted modifications of the human epigenome, epigenome editing (EE), are around the corner. For EE, techniques similar to genome editing (GE) techniques are used. While in GE the genetic information is changed by directly modifying DNA, intervening in the epigenome requires modifying the configuration of DNA, for example, how it is folded. This does not come with alterations in the base sequence (‘genetic code’). To date, there is almost no ethical debate about EE, whereas the discussions about GE are voluminous. (...) Our article introduces EE into bioethics by translating knowledge from science to ethics and by comparing the risks of EE with those of GE. We, first (I), make the case that a broader ethical debate on EE is due, provide scientific background on EE, compile potential use-cases and recap previous debates. We then (II) compare EE and GE and suggest that the severity of risks of novel gene technologies depends on three factors: (i) the choice of an ex vivo versus an in vivo editing approach, (ii) the time of intervention and intervention windows and (iii) the targeted diseases. Moreover, we show why germline EE is not effective and reject the position of strong epigenetic determinism. We conclude that EE is not always ethically preferable to GE in terms of risks, and end with suggestions for next steps in the current ethical debate on EE by briefly introducing ethical challenges of new areas of preventive applications of EE (III). According to telling based views of testimony (TBVs), B has reason to believe that p when A tells B that p because A thereby takes public responsibility for B's subsequent belief that p. Andrew Peet presents a new argument against TBVs. He argues that insofar as A uses context-sensitive expressions to express p, A doesn't take public responsibility for B's belief that p. Since context-sensitivity is widespread, the kind of reason TBVs say we have to believe what we're told, is (...) not widespread. Peet doesn't identify any problem with his own argument though he does attempt to limit its sceptical potential by identifying special contexts in which TBVs stand a chance of success. A more general defence of TBVs can be provided by showing Peet's argument to be unsound. I argue that Peet's argument is unsound because it requires us to wrongly suppose that speakers do far less labour than their audiences in context-sensitive linguistic communication. I aim to show why—in the context of the epistemology of testimony and the philosophy of language—it's important to recognize the labour that speakers can do, and so can can be held responsible for not doing, in episodes of context-sensitive linguistic communication. In this work, we propose a variant of so-called informational semantics, a technique elaborated by Voishvillo, for two infectious logics, Deutsch’s |${\mathbf{S}_{\mathbf{fde}}}$| and Szmuc’s |$\mathbf{dS}_{\mathbf{fde}}$|⁠. We show how the machinery of informational semantics can be effectively used to analyse truth and falsity conditions of disjunction and conjunction. Using this technique, it is possible to claim that disjunction and conjunction can be rightfully regarded as such, a claim which was disputed in the recent literature. Both |${\mathbf{S}_{\mathbf{fde}}}$| and |$\mathbf{dS}_{\mathbf{fde}}$| are formalized in (...) terms of natural deduction. This allows us to solve several problems: to develop a natural deduction calculus for |${\mathbf{S}_{\mathbf{fde}}}$| containing the standard form of disjunction elimination (in contrast to the calculus by Petrukhin), to introduce the first natural deduction calculus for |$\mathbf{dS}_{\mathbf{fde}}$| and to reflect the fundamental symmetry between |${\mathbf{S}_{\mathbf{fde}}}$| and |$\mathbf{dS}_{\mathbf{fde}}$| on proof-theoretical level forming a convenient basis for obtaining their well-known extensions |$\mathbf{K}^{\mathbf{w}}_{\mathbf{3}}$| and |$\mathbf{PWK}$|⁠. The often poorly explained notion of gender identity, and the attendant cisgender/transgender distinction, are critically examined.

This article explores Sylvia Wynter’s analysis of gender as a category differentially applied across the global color line and María Lugones’ account of the coloniality of gender. While Wynter’s and Lugones’s work offer consequential insights for queer, trans, and intersex studies and activism, they have deliberately engaged these particular discourses and histories of struggle in limited ways. Wynter analyzes the contradictions of Western feminists’ organizing against female genital cutting in Africa, but she does not link her conclusions to their ramifications (...) for activism against genital cutting on children deemed intersex. Lugones uses the existence of intersex people as a turning point in her critique of Aníbal Quijano when developing her concept of the coloniality of gender, but she does not go further to connect global intersex activism and decolonial feminist struggles. This article explores the work of Wynter and Lugones for their compatibility with trans and intersex studies and activism, and the places where their work can be furthered through insights from trans and intersex studies. It concludes that to move beyond the coloniality of gender requires trans and intersex liberation and that trans and intersex liberation must be understood in a broader decolonial feminist framework. The incommensurability of two theories seems to problematize theory comparisons, which allow for the selection of the better of the two theories. If so, it becomes puzzling how the quality of theories can improve with time, i.e. how science can progress across changes in incommensurable theories. I argue that in papers published in the 1990s, Kuhn provided a novel way to resolve this apparent tension between incommensurability and scientific progress. He put forward an account of their compatibility which worked not (...) by downplaying the negative consequences of incommensurability but instead by allowing them to reach their natural end: a process of specialisation. This development in Kuhn’s thought has yet to be properly recorded but it is also interesting in its own right. It shows how a robust version of incommensurability—one which really does have severe negative consequences for scientists’ capacity to perform comparative evaluations of incommensurable theories—need make no puzzle of the progress of science. This paper provides a unifying axiomatic account of the interpretation of recursive types that incorporates both domain-theoretic and realizability models as concrete instances. Our approach is to view such models as full subcategories of categorical models of intuitionistic set theory. It is shown that the existence of solutions to recursive domain equations depends upon the strength of the set theory. We observe that the internal set theory of an elementary topos is not strong enough to guarantee their existence. In contrast, (...) as our first main result, we establish that solutions to recursive domain equations do exist when the category of sets is a model of full intuitionistic Zermelo–Fraenkel set theory. We then apply this result to obtain a denotational interpretation of FPC, a recursively typed lambda-calculus with call-by-value operational semantics. By exploiting the intuitionistic logic of the ambient model of intuitionistic set theory, we analyse the relationship between operational and denotational semantics. We first prove an “internal” computational adequacy theorem: the model always believes that the operational and denotational notions of termination agree. This allows us to identify, as our second main result, a necessary and sufficient condition for genuine “external” computational adequacy to hold, i.e. for the operational and denotational notions of termination to coincide in the real world. The condition is formulated as a simple property of the internal logic, related to the logical notion of 1-consistency. We provide useful sufficient conditions for establishing that the logical property holds in practice. Finally, we outline how the methods of the paper may be applied to concrete models of FPC. In doing so, we obtain computational adequacy results for an extensive range of realizability and domain-theoretic models. (shrink)

_The Revenge of History_ is a frontal assault on the widely accepted idea that the East European revolutions of 1989 mark the death of socialism. Alex Callinicos seeks to vindicate the classical Marxist tradition by arguing that socialism in this tradition can only come from below, through the self-activity of the working class. Stalinism from this standpoint was a counterrevolution, erecting at the end of the 1920s a state capitalist regime on the ruins of the radically democratic socialism briefly (...) achieved in October 1917. Callinicos argues that the collapse of Stalinism at the end of the 1980s is one aspect of a worldwide transition from nationally organized to globally integrated capitalism. The result is likely to be greater economic and political instability. Against this background socialism—in Marx's sense—is all the more necessary. Callinicos contends that Marx's vision of a classless communist society would be both practically feasible and profoundly democratic. He concludes that the collapse of Stalinism should be less the moment to abandon socialism than to resume unfinished business. (shrink)

This paper considers an important recent contribution by Miguel Hernán to the ongoing debate about causal inference in epidemiology. Hernán rejects the idea that there is an in-principle epistemic distinction between the results of randomized controlled trials and observational studies: both produce associations which we may be more or less confident interpreting as causal. However, Hernán maintains that trials have a semantic advantage. Observational studies that seek to estimate causal effect risk issuing meaningless statements instead. The POA proposes a solution (...) to this problem: improved restrictions on the meaningful use of causal language, in particular “causal effect”. This paper argues that new restrictions in fact fail their own standards of meaningfulness. The paper portrays the desire for a restrictive definition of causal language as positivistic, and argues that contemporary epidemiology should be more realistic in its approach to causation. In a realist context, restrictions on meaningfulness based on precision of definition are neither helpful nor necessary. Hernán’s favoured approach to causal language is saved from meaninglessness, along with the approaches he rejects. (shrink)

When people must either save a greater number of people from a smaller harm or a smaller number from a greater harm, do their choices reflect a reasonable moral outlook? We pursue this question with the help of an experiment. In our experiment, two-fifths of subjects employ a similarity heuristic. When alternatives appear dissimilar in terms of the number saved but similar in terms of the magnitude of harm prevented, this heuristic mandates saving the greater number. In our experiment, this (...) leads to choices that are inconsistent with all standard theories of justice. We argue that this demonstrates the untrustworthiness of distributive judgments in cases that elicit similarity-based choice. (shrink)

I argue that we should rethink the nature and scope of Spinoza’s “one and the same” relation. Contrary to the standard reading, the nature of this relation is not identity but a union, and its scope includes all idea-object pairs, even God and the idea of God. A crucial reason we should adopt this dual picture is that the idea of God must be one and the same as something found when Nature is conceived under each of the other attributes. (...) If “one and the same” is interpreted as a relation of identity, this requirement cannot be met. However, maintaining that God and the idea of God are one and the same not only fulfills this requirement, but also is independently motivated. This paper seeks to determine the significance, if any, of epidemiological evidence to prove the specific causation element of liability in negligence or other relevant torts—in particular, what importance can be attached to a relative risk > 2, where that figure represents a sound causal inference at the general level. The paper discusses increased risk approaches to epidemiological evidence and concludes that they are a last resort. The paper also criticizes the proposal that the probability of causation can be estimated (...) with reference to the RR, such that RR > 2 is necessary and sufficient for causation. It is argued, following arguments by Sander Greenland and others, that RR > 2 is not necessary for proof of specific causation, except under restrictive biological assumptions that are not known to be satisfied for any important disease, and therefore must never be required. However, the paper argues that in some circumstances RR > 2 can be sufficient to prove causation at law. This position is defended against the widely held judicial and academic view that epidemiological evidence must be accompanied by something else, particular to the case at hand, if it is to have probative force for specific causation. It is argued that far from being epistemically irrelevant, to achieve correct and just outcomes it is in fact mandatory to take epidemiological evidence into account in deciding specific causation. Failing to consider such evidence when it is available leads to error and injustice. The conclusion is that in certain circumstances epidemiological evidence of RR > 2 is not necessary to prove specific causation but that it is sufficient. This “sufficiency” is confined to circumstances where there is no other evidence, as a way of getting clear on what the epidemiological evidence says. Excerpt: 1. Introduction This chapter provides insight into the diverse ethical debates on genetics and epigenetics. Much controversy surrounds debates about intervening into the germline genome of human embryos, with catchwords such as genome editing, designer baby, and CRISPR/Cas. The idea that it is possible to design a child according to one’s personal preferences is, however, a quite distorted view of what is actually possible with new gene technologies and gene therapies. These are much more limited than the editing and (...) design metaphors suggest. Such metaphors are therefore highly problematic phrases in the context of new gene technologies, for two reasons. On one hand, to design a child of choice by modifying the genome would require modifying any gene of choice, which is more than can be done with current gene technologies, such as CRISPR/Cas. On the other hand, a modification of genes would need to be enough to create any characteristic of choice in the future child. The latter presupposes the assumption of genetic determinism. Moreover, the CRISPR/Cas technology can not only be used in a potentially therapeutic manner at the germline level. In addition, there is the (more likely) scenario of a future clinical therapeutic use of these new gene technologies for modifying the DNA sequence of other cells of the body (somatic genome editing). There is also the option of modifying the epigenome, that is, the spatial configuration of DNA (epigenome editing) (see table 1). Like genetics and genome editing, epigenetics has been at the center of recent popular scientific and ethical discourse as well as scientific debates. The concept of epigenetics has given rise to very different notions of inheritability and responsibility for health, which, however, are oftentimes based on scientifically controversial basic assumptions. That there continues to be covert genetic determinism in the form of epigenetic determinism (see table 2) in debates about epigenetics has been pointed out in ethical analyses of epigenetics. Neither genetic determinism nor epigenetic determinism has been confirmed scientifically. It is therefore important to recognize the concepts that are discussed (and sometimes harshly criticized) in debates about genome editing and epigenetics—for example, concepts about the causal role of DNA for our own life course. This importance is based on the fact that if we understand such controversial concepts, we will be able to remain critical when evaluating scientific knowledge and ethical arguments about genome editing and epigenetics. This chapter, therefore, explains some of these concepts. For an ethical analysis of epigenetics as well as of genome editing, it is necessary to understand and critically reflect upon the underlying concepts of genetic determinism and other, related -isms. The following section offers a detailed introduction to these -isms (section 2; see also table 2). Section 3 provides an ethical analysis of genome editing and epigenetics based on the explanations in section 2. Section 3 focuses on inheritability and responsibility, justice, safety, the problem of consent, and the effects of genome editing and epigenetics on embryos and future generations. This section does not discuss in detail further points that can be found in ethical debates about epigenetics as well as in ethical debates about genome editing. These points include (among others): • fear that the findings of epigenetics and that the methods of genome editing are misused—this also with respect to eugenics and enhancement; • naturalness—an issue we mention in passing a few times in the following analysis; • a possible connection between the genome/epigenome and the concept of human dignity, and the derived danger of instrumentalization and infringement of autonomy when intervening in the genome or epigenome. Since current discourse about ethical issues associated with genome editing focuses mainly on germline interventions, which are, for instance, interventions into a human embryo’s genome, we mainly focus on germline interventions when comparing the debates on genome editing and on epigenetics in section 3. Although a broad and eclectic area of inquiry, one central axis by which MBR connects these disciplines is anchored at one end in theories of internal reasoning (in cognitive science), and at the other, in C.S. Peirce’s semiotics (in philosophy). In this paper, we attempt to show that Peirce’s semiotics actually has more natural affinity on the psychological side with ecological psychology, as originated by James J. Gibson and especially Egon Brunswik, than it does with non-interactionist approaches to cognitive science. In particular, we highlight the strong ties we believe to exist between the triarchic structure of semiotics as conceived by Peirce, and the similar triarchic stucture of Brunswik’s lens model of organismic achievement in irreducibly uncertain ecologies. The lens model, considered as a theory of creative abduction, provides a concrete instantiation of at least one, albeit limited, interpretation of Peirce’s semiotics, one that we believe could be quite fruitful in future theoretical and empirical investigations of MBR in both science an philosophy. This paper presents methodological reflections on power sharing and shifts of power in various interview situations. Narratives are said to be shaped by our attempts to position ourselves within social and cultural circumstances. In an interview situation, power can be seen as something that is created and that shifts between the interviewer and the interviewed. Reflexivity is involved when we as interviewers attempt to look at a situation or a concept from various perspectives. A modified form of discourse analysis inspired (...) by subject positioning was used to reflect on power relations in four different interview situations. The analyses indicate that reflection on the power relations can lead to other forms of understanding of the interviewee. The main conclusion that can be drawn from this study is that power relations are created within an interview situation and therefore it is important to be aware of dominant perspectives. Researchers and nurses face the challenge of constantly raising their level of consciousness about power relationships, and discursive reflexivity is one way of doing this. Thus, reflexivity is an important part of the qualitative research process. (shrink)

Though this question is posed in many dialogues with re- spect to myriad topics, in every instance it receives but one answer: it is something, namely something that is. The dialogue devoted to why this question always meets with an affirmative answer would appear to be the Parmenides, for there Parmenides throws into question whether the eidē are, only to (...) establish that, if we have opinions that there is some unity in being, such unity must be. Nevertheless, the dramatic setting of the Parmenides is the quarreling of the Pre-Socratic schools, and the popular dismissal of philosophy that their quarreling engendered. For a dialogue that establishes that the object of inquiry is simply because we have opinions about it, we must, as I hope to show, turn to the Euthyphro. (shrink)

In this paper, I will defend an alternative account of disposition ascriptions influenced by considerations from possible worlds semantics for modals according to which disposition ascriptions express modals relations characterized by a particular restriction on accessible worlds. My focus will be on the "modal problem" for disposition ascriptions (precisely what kind of modality do these claims express?), and the approach I adopt reflects this starting point. Most analyses – like the Simple Conditional Analysis – have explained disposition ascriptions by suggesting (...) schematic truth-conditional equivalences with other modal claims in English. This only indirectly addresses the modal problem – for instance by first drawing a truth conditional equivalence between disposition ascriptions and counterfactuals and then explaining the modal relation expressed by counterfactuals. I will try to give a ‘direct’ answer to the modal question -- that is, to analyse disposition ascriptions in a general possible worlds framework in which we can compare the analysis to actual and possible analyses for other modals – in particular, counterfactuals. The framework I’ll use is a simple version of Angelika Kratzer’s relational analysis of modals. I'll focus on two problems that nicely connect the dispositional and the modal – (a) the challenge of purportedly ‘extrinsic dispositions,’ and (b) the problem of the "granularity" of possibilities we’re quantifying over (are they situation- or world-sized?). Determining which moral principles should guide political action is a vexing question in political theory. This is especially true when faced with the "toleration paradox": believing that something is morally wrong but also believing that it is wrong to suppress it. In this book, Alex Tuckness argues that John Locke's potential contribution to this debate--what Tuckness terms the "legislative point of view"--has long been obscured by overemphasis on his doctrine of consent. Building on a line of reasoning Locke made (...) explicit in his later writings on religious toleration, Tuckness explores the idea that we should act politically only on those moral principles that a reasonable legislator would endorse; someone, that is, who would avoid enacting measures that could be self-defeating when applied by fallible human beings.Tuckness argues that the legislative point of view has implications that go far beyond the question of religious toleration. Locke suggests an approach to political justification that is a provocative alternative to the utilitarian, contractualist, and perfectionist approaches dominating contemporary liberalism. The legislative point of view is relevant to our thinking about many types of disputed principles, Tuckness writes. He examines claims of moral wrong, invocations of the public good, and contested political roles with emphasis on the roles of legislators and judges. Ronald Aylmer Fisher is today remembered as a giant of twentieth-century statistics, genetics and evolutionary theory. Alongside his influential scientific contributions, he was also, throughout the interwar years, a prominent figure within Britain's eugenics movement. This essay provides a close examination of his eugenical ideas and activities, focusing particularly upon his energetic advocacy of family allowances, which he hoped would boost eugenic births within the more ‘desirable’ middle and upper classes. Fisher's proposals, which were grounded in his distinctive explanation for (...) the decay of civilizations throughout human history, enjoyed support from some influential figures in Britain's Eugenics Society and beyond. The ultimate failure of his campaign, though, highlights tensions both between the eugenics and family allowances movements, and within the eugenics movement itself. I show how these social and political movements represented a crucial but heretofore overlooked context for the reception of Fisher's evolutionary masterwork of 1930, The Genetical Theory of Natural Selection, with its notorious closing chapters on the causes and cures of national and racial decline. It is contended that unless everything is necessarily what it is, the essence of an object cannot be a property of the object which the object could not have failed to have. But if everything is necessarily what it is, then no identity statement is contingent.

The virtue of mercy is widely admired, but is now marginalized in contemporary public life. Yet for centuries it held a secure place in western public discourse without implying a necessary contradiction with justice. Alex Tuckness and John M. Parrish ask how and why this changed. Examining Christian and non-Christian ancient traditions, along with Kantian and utilitarian strains of thought, they offer a persuasive account of how our perception of mercy has been transformed by Enlightenment conceptions of impartiality and (...) equality that place justice and mercy in tension. Understanding the logic of this decline, they argue, will make it possible to promote and defend a more robust role for mercy in public life. Their study ranges from Homer to the late Enlightenment and from ancient tragedies to medieval theologies to contemporary philosophical texts, and will be valuable to readers in political philosophy, political theory, and the philosophy of law. Este trabalho tem como objetivo fazer uma análise da motivação da enfermeira italiana que, após o diagnóstico positivo para o novo coronavírus SARS-CoV-2, cometeu suicídio. Desde que esta doença se tornou uma pandemia, distintas reações das pessoas têm sido observadas nas várias sociedades pelo mundo. Para efeito de referencial teórico-filosófico, debruçaremos sobre a ética schopenhaueriana a fim de refletir sobre o suicídio de Daniela Trezzi. Inicialmente, traremos, em linhas gerais, o contexto e o fato ocorrido. Em seguida, abordaremos as justificativas (...) do julgamento condenatório do filósofo alemão a respeito do suicídio. No segundo momento deste trabalho, confrontaremos o suicídio da italiana dentro da filosofia schopenhaueriana e refletiremos a respeito das motivações morais. Seria este suicídio motivado, não por conta dos males que a doença lhe traria, ou seja, motivado não em virtude do sofrimento pessoal, mas sim por compaixão ao imaginar o mal que ela causaria aos outros?
