Philosophers have rightly condemned lookism—that is, discrimination in favor of attractive people or against unattractive people—in education, the justice system, the workplace and elsewhere. Surprisingly, however, the almost universal preference for attractive romantic and sexual partners has rarely received serious ethical scrutiny. On its face, it’s unclear whether this is a form of discrimination we should reject or tolerate. I consider arguments for both views. On the one hand, a strong case can be made that preferring attractive partners is bad. (...) The idea is that choosing partners based on looks seems essentially similar to other objectionable forms of discrimination. (In particular, the preference for attractive partners is arguably both unfair and harmful to a significant degree.) One can try to resist this conclusion in several ways. I consider three possible replies. The first has to do with the possibility of controlling our partner preferences. The second pertains to attractiveness and “good genes”. The last attempts to link certain aspects of attractiveness to a prospective partner’s personality and values. I argue that the first two replies fail conclusively, while the third only amounts to a limited defense of a particular kind of attractiveness preference. So the idea that we should often avoid preferring attractive partners is compelling. (shrink)

In this chapter I deal with indirect reports in terms of language games. I try to make connections between the theory of language games and the theory of indirect reports, in the light of the issue of clues and cues. Indirect reports are based on an interplay of voices. The voice of the reporter must allow hearers to ‘reconstruct’ the voice of the reported speaker. Ideally, it must be possible to separate the reporter’s voice from that of the reported speaker. (...) When we analyze the language game of indirect reporting, we ideally want to establish which parts belong to the primary voice and which parts belong to the reporter’s voice. In this paper I apply considerations on language games by Dascal et al. and I explore the dialectics between abstract pragmatics principles and considerations about situated uses that are sensitive to cues and clues. During the twentieth century, the view that assertions and norms are valid insofar as they respond to principles independent of all local and temporal contexts came under attack from two perspectives: the partiality of translation and the intersubjective constitution of the self, understood as responsive to recognition. Defenses of universalism have by and large taken the form of a thinning out of substantive universalism into various forms of proceduralism. Alessandro Ferrara instead launches an entirely different strategy for transcending the (...) particularity of context without contradicting our pluralistic intuitions: a strategy centered on the exemplary universalism of judgment. Whereas exemplarity has long been thought to belong to the domain of aesthetics, this book explores the _other_ uses to which it can be put in our philosophical predicament, especially in the field of politics. After defining exemplarity and describing how something unique can possess universal significance, Ferrara addresses the force exerted by exemplarity, the nature of the judgment that discloses exemplarity, and the way in which the force of the example can bridge the difference between various contexts. Drawing not only on Kant's _Critique of the Power of Judgment_ but also on the work of Hannah Arendt, John Rawls, Ronald Dworkin, and Jürgen Habermas, Ferrara outlines a view of exemplary validity that is applicable to today's central philosophical issues, including public reason, human rights, radical evil, sovereignty, republicanism and liberalism, and religion in the public sphere. The aim of this paper is to provide an intuitive semantics for systems of justification logic which allows us to cope with the distinction between implicit and explicit justifiers. The paper is subdivided into three sections. In the first one, the distinction between implicit and explicit justifiers is presented and connected with a proof-theoretic distinction between two ways of interpreting sequences of sentences; that is, as sequences of axioms in a certain set and as sequences proofs constructed from that set (...) of axioms. In the second section, a basic system of justification logic for implicit and explicit justifiers is analyzed and some significant facts about it are proved. In the final section, an adequate semantics is proposed, and the system is proved to be sound and complete whit respect to it. (shrink)

Elaborating on the notions that humans possess different modalities of decision-making and that these are often influenced by moral considerations, we conducted an experimental investigation of the Trolley Problem. We presented the participants with two standard scenarios (‹lever’ and ‹stranger’) either in the usual or in reversed order. We observe that responses to the lever scenario, which result from (moral) reasoning, are affected by our manipulation; whereas responses to the stranger scenario, triggered by moral emotions, are unaffected. Furthermore, when asked (...) to express general moral opinions on the themes of the Trolley Problem, about half of the participants reveal some inconsistency with the responses they had previously given. We defend a noetic account of intramathematical explanation. On this view, a piece of mathematics is explanatory just in case it produces understanding of an appropriate type. We motivate the view by presenting some appealing features of noeticism. We then discuss and criticize the most prominent extant version of noeticism, due to Inglis and Mejía Ramos, which identifies explanatory understanding with the possession of well-organized cognitive schemas. Finally, we present a novel noetic account. On our view, explanatory understanding arises from (...) meeting specific explanatory objectives. We defend a cluster-concept account of explanatory objectives and identify four important subfamilies within the relevant network of resemblance relations. The resulting view is objectivist (in the sense that it takes explanatory success to be a matter of observer-independent fact), broader in scope than why-question-based accounts, compatible with empirical findings on experts’ explanatory judgments, and capable of generalizing (with appropriate provisos) to scientific explanation as a whole. It thus fulfills Friedman’s half-century-old demand for a general and objectivist theory which accounts for the link between explanation and understanding. (shrink)

This paper is an example of how contextual information interacts with the interpretation of noun phrases (NPs) in discourse. When we encounter an NP escorted by the definite article or a proper name, the expectation is triggered that the speaker is referring to some referent x that the hearer can normally identify. Strawson and Russell have agreed that a referent must be associated with a definite description so that the assertion containing it can be said to be true. In the (...) case where a description does not refer to anything, the assertion is considered by Russell to be false, while Strawson says that the issue of truth or falsity does not arise. In this paper, we examine a case in which contextual information interacts with the interpretation of NPs in discourse and the hearer is not expected to identify a referent when hearing a proper name. In this case, the issue of truth or falsity does not arise, because the hearer does not identify the referent. In fact, s/he does not intend for the discourse to about a referent at all. These situations are primarily represented by sentences uttered during the course of a grammar lecture, in which the lecturer is explaining a rule of language and does not focus on external reality. The hearers are aware of this focus and do not process the NP (in general a proper name) to identify a specific referent. In this paper, I distinguish between linguistic and non-linguistic presuppositions. I also propose that we should be interested in conversational presuppositions, which could also be called speaker-meant presuppositions or speaker's presuppositions. I also distinguish between potential and actual presuppositions. I propose that, in some cases, presuppositions can be conversationally implicated and cancellation is possible. I specify what the hard cases are and I try to explain them through ontological considerations. I try to reduce the hard cases through (a) the notion (...) that all actual presuppositions are speaker-meant; (b) the distinction between ontological and linguistic presuppositions; and (c) the uncontroversial notion that even ontological presuppositions are susceptible to semantic under-determination that has to be tackled though pragmatic intrusion. Pragmatic intrusion for presuppositional cases, however, cannot really amount to completing or expanding or in any case computing an explicature in an ordinary sense, as explicatures have to do with truth-conditions and aim to create propositionally complete forms that are truth-evaluable, unlike propositional fragments or schemata that are usually expressed in sentences (; , 2012). They are processes similar to explicatures, but since presuppositions are only pre-conditions for an utterance's being true or false (; Macagno; 2016; ; ), we cannot say that these processes are completely like those of explicatures. Nevertheless, they are pragmatically-motivated, even if hard to cancel. (See on lack of cancellability or on entrenched meanings.) This more or less brings my approach in line with contextualism (even if I accept semantic invariantism, along the lines of or (Invariantism is also shared by , in a form that is compatible with her contextualism.)). The recent debate on pragmatics and the law has found ways to circumvent an important distinction, originally drawn by Dascal and Wróblewski (1991), between the historical law-maker, the current law-maker, and the ideal/rational law-maker.1 By insisting on the relationship between the rational law-maker and contextualism and textualism (see Manning 2005, 2006), I want to redress this fault in current discussions. In this paper, I start with general considerations on pragmatics, intentionality in ordinary conversation, and intentionality in the context of judiciary (...) proceedings and legal texts. I then move on to considerations on rationality as a prerequisite for understanding the law and on the rational law-maker, an ideal construct proposed by Dascal and Wróblewski (1991). I argue that contextualism (of the moderate kind) is the best way to carry out the program by Dascal and Wróblewski on interpretation and the rational law-maker (also see considerations by Fish 2005); (on contextualism see Dascal and Weizman 1987). I argue that bearing in mind the rational law-maker postulated by Dascal and Wróblewski is a guidance to interpretation of statutes whose texts create interpretative difficulties. I conclude by saying that the considerations on the rational law-maker constitute a compromise between Scalia’s (1997) textualism and contextualism (see Manning 2005, 2006 on the divide between textualism and contextualism). In this paper, I develop a pragmatic view of the poetic function of language by resorting to the ideas of contextualism, inferential pragmatics, and pragmemes (Mey, 2001, Capone, 2005), developing considerations on the poetic function of language on the basis of considerations by Jakobson (1960) and Waugh (1980). I argue that pragmatics plays an important role in elucidating the poetic function of language and that even in everyday language (not only in anthologies) we find cases of texts where the poetic (...) function coexists with (or aids) other functions. Contextualism allows us to interpret a poem: referents must be fixed or need not be fixed due to the requirements of the discourse; citations are brought in through pragmatic ways; polyphony is achieved via sedimentation of citations in a current text; the vicinity of a certain word, or concept, or line is likely to affect the interpretation of a certain expression. Polyphony is what allows the text to live on in a dimension that transcends the limits of the subjective experience of the poet but allows the text to be inserted in a tradition in which each verse reverberates with memories of other verses. The poetic text can take different forms, from graffiti to discourse at the market-place, to discourse between lovers. All these forms of poetic text would not exist if the notion of poetry did not include the idea of semantic/pragmatic compression which is matched, in interpretation, by expansions. In this paper, I also try to tackle the issue of the universal appeal of some poems, even if I am aware that this topic is as mysterious as fascinating. Paradoxically, a contextual approach to poetry seems to be at odds with the claim that the most acclaimed examples of poems have a universal appeal and touch a universal chord in the readers’ hearts. What is genuinely puzzling is the contrast between the need to fully contextualize a text and the fact that such a text can have a universal appeal across cultures. (shrink)

The expressive nature of musical improvisation is dissected, navigatingbetween two predominant theses: The Transparency Thesis (1) which proposes thatexpressiveness in improvisation transparently reflects the musician’s subjectiveaffectivity, and the Objective-Generic Expressiveness Thesis (2) asserting that ithinges only on the musicpractice’s objective components. This article challenges boththeses, arguing against (1) by emphasizing that musical expressivity transcends a merenatural outburst, and counteracting (2) by highlighting that it is not merely anenactment of objective expressive topoi. This paper considers the issue of musical improvisational interactions in the digital era by pursuing the following three steps. 1) I will raise the question of the meaning and value of liveness, and in particular of live musical improvisation, in the age of the internet and discuss some effects of the so called digital revolution on improvisation practices. 2) Then I will suggest that the interactions made possible by the web can be understood as kinds of live improvisational practices and (...) I will briefly outline how such practices also involve musical improvisation. 3) Finally, I will focus on some aesthetic and philosophical aspects of new kinds of live improvisation made possible by recent progress in artificial intelligence research. Therefore it highlights the conditions that determine the appearance and the operation of the political discourse, then it clarifies because, according to Foucault, political discourse should not be analyzed in a format which opposes science to ideology, but as an act of discourse located in a strategic field and fighting with other discursive formations. The paper aims at analyzing some Wagnerian figures in order to show that the influence of Schopenhauer’s philosophy on Wagner is not as strong as commonly held – at least not in his operas. The figures that shall be considered are: Wotan and Brünnhilde, Tristan and Isolde, and finally Parsifal, who appears to be the only Schopenhauerian character of all.

This article aims at exploring one specific facet of pluralism: How can we conceive of a variety of democratic cultures that are not just local adaptations of one basic western-centric understanding of the democratic ethos? Drawing on Islamic, Jewish, Hindu, Buddhist and Confucian sources, a convergence among diverse democratic cultures is cursorily highlighted on such elements as the priority of the common good, the acceptance of pluralism, the desirability of collegial deliberation, the equality of citizens, and the value of individuality. Then two important points of dissonance are analysed in greater detail – the idea of the priority of rights over duties and the role of political conflict within a democratic polity – and shown not to be correlative with a divide between western and non-western contexts. A great deal of work in analytic philosophy of art is related to defining what counts as art. So far, cognitive approaches to art have almost entirely ignored this literature. In this paper I discuss the role of intuition in analytic philosophy of art, to show how an empirical research program on art could take advantage of existing work in analytic philosophy. I suggest that the first step of this research program should be to understand how people intuitively categorize something (...) as art. Drawing on results from cognitive science and analytic philosophy, I show that the intuitive categorization of an artifact as art rests on the intentions attributed (frequently implicitly) to the creator of the artifact based both on its appearance and on background knowledge. I discuss how the issue of categorization is related to other empirical issues concerning our relationship to works of art, such as perception, appreciation, interpretation and evaluation. (shrink)

The circumscription of taxa and classification of organisms are fundamental tasks in the systematization of biological diversity. Their success depends on a unified idea concerning the species concept, evolution, and taxonomy; paradoxically, however, it requires a complete distinction between taxa and evolutionary units. To justify this view, I discuss these three topics of systematics. Species concepts are examined, and I propose a redefinition for the Taxonomic Species Concept based on nomenclatural properties, in which species are classes conventionally represented by a (...) binomial. Speciation is subsequently discussed, to demonstrate that concepts on the evolutionary process are damaged when species are considered as evolutionary units. Speciation should be considered a transition among patterns of a population and, consequently, always a sympatric process. This view contrasts with the majority of speciation models, which analyze cladogeneses and classify speciation geographically, usually considering allopatry the essential condition for the differentiation process. Finally, taxonomy is considered, to show that the equivalence between evolutionary and taxonomic units may also damage the practice of biological systematization. Principles and rules of nomenclature and classification should offer freedom to accommodate divergent opinions about systematics and to incorporate the evolution of knowledge; therefore, they should remain independent of biological theories. The essay deals with the debate between neo-republicans and liberals. It discusses particularly the positions of Quentin Skinner, Philip Pettit and Maurizio Viroli. While not operating an exhaustive critical examination of the positions of these three thinkers, it focusses an aspect they have in common: the idea that the republican tradition stays in an irreducible conflict with the liberal tradition and with a certain conception of democracy. The essay analizes briefly the three main concepts of republicanism also in order to (...) point out to some historical and theoretical problems. It further compares the position of republican thinkers with the position of the liberal-democratic tradition which is their main target of their critics. In this context the essay introduces a further position which the neo-republicans quite curiously leave aside: constitutionalism. (shrink)

The article examines some of the consequences of the migration of musical works in cyberspace, particularly with regard to their ways of being and the ways in which we listen to them. Streaming is interpreted as the last stage in the expansion of a phenomenon that arose with the advent of phonography, namely, the ubiquity and availability of the works. A new development consists in the production of musical units in modular terms: works can consist of independent parts, which can (...) be replaced or constituted, in an order that depends on the user, taking inspiration from the model of the playlist. The diffusion of works on the web has also facilitated the development of the remix practice, changing listening standards and generating new conceptual conflicts concerning the identity of the works. The web weakens the distinction between the medium of communication and the medium of recording. It also favors the formation of new cognitive dispositions and generates more flexible and interactive ways of listening, generally different from those implicated in the era of the disc. (shrink)

How much is a moral judgment on a single act influenced by circumstances which have little to do with the nature of the act itself? How much have certain moral judgments to do with the common history and shared experience of a certain group of individuals? Using two cases taken from life (a German musician and a German CEO behaving both in a morally wrong way but with very different consequences from the point of view of moral judgement and with (...) very different reactions from the German public), the article tries to give an answer to these questions, touching issues like: guilt, moral responsibility, collective responsibility, and collective identity. We extend to the predicate frame a previous characterization of the maximal intermediate propositional constructive logics. This provides a technique to get maximal intermediate predicate constructive logics starting from suitable sets of classically valid predicate formulae we call maximal nonstandard predicate constructive logics. As an example of this technique, we exhibit two maximal intermediate predicate constructive logics, yet leaving open the problem of stating whether the two logics are distinct. Further properties of these logics will be also investigated.

Wittgenstein has often explored language games that have to do with musical objects of different sizes (phrases, themes, formal sections or entire works). These games can refer to a technical language or to common parlance and correspond to different targets. One of these coincides with the intention to suggest a way of conceiving musical understanding. His model takes the form of the invitation to "hear (something) as (something)": typically, to hear a musical passage as an introduction or as a conclusion (...) or in a certain tonality. However one may ask to what extent or in what terms (literal or metaphorical) these procedures, and usually the intervention of language games, is requested by our common ways of understanding music. This article shows through the use of some examples that aspectual perception inherent to musical understanding does not require language games as a necessary condition (although in many cases the link between them seems very strong), in contradiction with the thesis of an essential linguistic character of music. At a basic level, it seems more appropriate to insist on the notion of a game: to understand music means to enter into the orbit of "music games" which show an autonomous functioning. Language games have, however, an important function when we develop this comprehension in the light of the criteria of judgment that substantiate the manner in which music is incorporated in and operates within specific forms of life. L’articolo si propone di ricostruire criticamente il processo di crisi e trasformazione del concetto di impero a ridosso delle rivoluzioni settecentesche. A partire dalla Histoire des deux Indes di Raynal, e dalla critica illuminista ai differenti modelli imperiali, Pandolfi delinea il passaggio dal colonialismo classico – costruito attorno al rapporto tra coloni, selvaggi e schiavi – a una fase contraddistinta invece dallo sfruttamento indiretto della forza lavoro. La trattazione porta alla luce l’ambivalenza illuminista nei confronti della questione dell’impero, dimostrando come (...) l’opera di Raynal intersechi e restituisca al lettore le tensioni fondanti della seconda metà del Settecento. Così, ripercorrendo l’analisi di Diderot, l’autore dimostra come l’avanzamento morale dell’umanità sia il prodotto della costante interazione tra la retorica imperialista del commercio e le rivoluzioni che, in luoghi e momenti diversi, hanno attraversato lo spazio coloniale. A teoria habermasiana do direito reivindica uma terceira via entre a normatividade das teorias “abstratas” da justiça e o funcionalismo de teorias como a de Luhmann. Na verdade, a posição de Habermas é normativa num sentido forte e, apesar do funcionalismo de sua reivindicação, enfoca apenas o direito positivo moderno, na medida em que não distingue claramente entre direito e moralidade. Outrossim, termina por incorrer nesta aporia, culminando numa espécie de legalização da moralidade.

Armut hat viele Aspekte, unter denen materielle Entbehrung wohl den offensichtlichsten und allgemein anerkanntesten darstellt. Mit ihr verbunden sind aber andere Sorten von Mangel: an Würde, Selbstvertrauen, Selbstrespekt und auch an Autonomie, wie mehrere Autor*innen schon betont haben. Die Beziehung zwischen individueller Autonomie und Armut wird nichtsdestotrotz von den meisten Sozialprogrammen zur Armutsbekämpfung kaum thematisiert. Ein Grund dafür ist womöglich im Umstand zu finden, dass Autonomie kein leicht zu definierender Begriff ist.

Armut wird allgemein als ein Zustand aufgefasst, in dem die Menschen nicht imstande sind, ihre Grundbedürfnisse zureichend zu befriedigen. Obwohl diese allgemein verbreitete Vorstellung der komplexen, vielseitigen Natur von Armut nicht gerecht wird, kommt ihr eine gewisse Berechtigung insofern zu, dass in Armut lebende Menschen meistens nicht imstande sind, sich adäquat zu ernähren und zu kleiden, oder dass sie prekär wohnen – wenigstens im Vergleich mit anderen Mitgliedern ihrer Gesellschaft. Nichtsdestotrotz steht der Begriff von Bedürfnis kaum im Zentrum der wichtigsten (...) Theorien sozialer Gerechtigkeit der letzten fünfzig Jahre. (shrink)
