Since the latest political changes, the FRY faces a choice of a transition strategy and privatization model whithin it. After ten years of transition in East Europen countries, well established patterns in marked oriented reforms and subsequent results are observed and could serve as policy lessons for the FRY. Regarding the significant impact that initial conditions have on efforts and results of transition macroeconomic policy and structural reform implementation, the paper presents the prevailing institutional setting of the Yugoslav economy inherited (...) from the communist regime. Also, the ten years of Yugoslav privatization experience is reported to have weak results due to the poor concept. Debates on privatization, as well on structural reforms and macroeconomic policy, have again become lively in the FRY.Depuis les derniers changements politiques, la République Fédérale de Yougoslavie fait face à un choix de stratégies de transition et de modèles de privatisation. Après dix années de transition dans les pays de l’Europe de l’Est, des schémas bien établis de réformes menant à l’économie de marché et les résultats qui en découlent sont observés et pourraient servir de leçon pour la République Fédérale de Yougoslavie sur le plan politique. Eu égard à l’impact significatif qu’ont les conditions initiales sur les efforts et les résultats de la politique macroéconomique de transition et d’instauration de la réforme structurelle, l’article souligne que l’environnement institutionnel de l’économie yougoslave est un héritage du régime communiste. Aussi, les dix années de privatisation en Yougoslavie ont donné lieu à des résultats peu significatifs, précisément à cause de l’héritage évoqué. My aim in this article is to defend the view that art is a relevant source of knowledge, including moral knowledge, in the absence of empirical evidence corroborating this view. In the first part, I discuss what is known as the causal question, that is, the question regarding art's impact on spectators. I argue that the alleged failure of art to impact us may be a matter of moral motivation and the particular circumstances of moral reasoning more than the cognitive (...) and ethical character of a work. To support my claim, I rely on contemporary research on moral reasoning. I conclude by sketching a wider context within which we should consider art's impact, stressing the relevance of cognitive sciences and moral psychology. (shrink)

In order to show the validity of here proposed conception of social ontology and its advantages over descriptive theories of social reality, which in the analysis of the socio-ontological status of human rights find only legally understood normativity as present in social reality, we will first lay out Searle’s interpretation of human rights. In the second step, we will introduce the methodical approach and basic concepts of our socio-ontological position, and explain the structure of the relationship between justice, law, morality, (...) social institutions and collective intentionality. At the end we will show how our theory of social ontology is better than Searle’s legal positivism in examining the ontological status of human rights. At the end, we show in what ways such a theory of social ontology more intuitively and with wider arguments explains the ontological status of institution of human rights than Searle’s legal positivism. In this paper I follow Ted Nannicelli in the project of establishing boundaries of television works. I focus on serialized television works pertaining to a particular genre and I set out to provide an account of their identity. My claim is that external identity of such works is determined by their specific genre-affiliation, given the way in which generic norms determine the content of the series, namely, its characteristic storylines and regular set of characters. From the internal perspective, a series’ (...) identity is determined by the particular way in which it implements abstract generic norms. I describe the process of such implementation as creation of series-specific formulaic patterns, and I analyze different layers of works where such patterns are evident. My central claim is that series-specific formulaic patterns create a coherent set of norms which, through repeated instantiation in the series’ episodes, become associated with that particular series. The function of this set is to establish the series’ boundaries, and to maintain its identity when different modifications to the patterns are made. (shrink)

Inclusion of children in medical decision making, to the extent of their ability and interest in doing so, should be the default position, ensuring that children are routinely given a voice. However, optimizing the involvement of children in their health care decisions remains challenging for clinicians. Missing from the literature is a stepwise approach to assessing when and how a child should be included in medical decision making. We propose a systematic approach for doing so, and we apply this approach (...) in a discussion of two challenging clinical cases. The approach is informed by a literature review, and is anchored by case studies of teenagers' refusal of clinical care, regulatory requirements for research assent, and the accepted approach to involving cognitively impaired adults in medical decisions. This article lies at the intersection of two problems: the one concerning the potential of fictional works to inform us about our social reality and foster our understanding of its various aspects, and the one concerning their potential to engage with philosophical issues. I bring these two together by analyzing the hit television series Law and Order: Special Victims Unit. According to my interpretation, the series is informative about our social world, and it raises philosophical concerns about it. This makes (...) it well-equipped to fulfill the educative function attributed to mass art by Noël Carroll, and to stand out as an example of what he calls popular philosophy. To support this interpretation, I rely on contemporary views regarding the nature of our engagements with fictional narratives. I then explore how philosophical concerns are generated and I elaborate on the role they have in deepening one’s understanding of one’s social circumstances. I further show how the series provides innovative and independent philosophical knowledge by means specific to the medium of generic serialized fiction. The central part of my argument is an analysis of the narrative strategies which enable the informative and philosophical aspects of the series to generate the series’ educative function. (shrink)

Communication in law provides a space for alternatives, a Third Space, wherein boundaries between various systems are strongly anchored to a country’s language, history and societal development. Transfers, modifications, and integrations of such systems into other target languages may result in many effects of distortions and appropriations, reformulations and renewals as well as of misinterpretations in communication. Hence, Third Space is a necessary prerequisite for negotiation, transformation and translation from culture A to culture B, since it operates as a multi-stage (...) dynamic where such mechanisms should be analyzed in a fair and equitable manner. The doctrine of the twelve Kālīs is one of the earliest developments of the Śākta tradition of the Kālīkula/Kālīkrama/Mahānaya and it is well known in the later exegetical works of Abhinavagupta, Kṣemarāja, and Maheśvarānanda. Although the twelve Kālīs have been treated to some extent in secondary literature, a systematic study of the development and reception of this doctrine has not been undertaken yet. This is mainly due to the fact that most of the Kālīkula scriptures are available in manuscript form, (...) and methodical analysis of their contents remains a desideratum. In this article, I intend to examine selected tantric scriptures teaching the doctrine of the twelve Kālīs, focusing on the development of the constituent elements of this doctrine, as they appear in different tantric sources. This article traces the origins of the twelve Kālīs to the esoteric teaching of the Sun-Goddess, linked to the tradition of the Skeleton of Kālī. It will argue that in the subsequent phase of the doctrine’s development the solar context gradually diminished and an emphasis on the twelve goddesses’ function as the destroyers of time became more and more pronounced. This tendency, in turn, influenced the codification of the twelve Kālīs as the fully-fledged doctrine of time-consumption, popular in the Trika and the Trika-inspired Krama sources. (shrink)

In a departure from the mainstream methodology of a positivist-oriented jurisprudence, Collective Rights provides the first legal-theoretical treatment of this area. It advances a normative-moral standpoint of 'value collectivism' which goes against the traditional political philosophy of liberalism and the dominant ideas of liberal multiculturalism. Moreover, it places a theoretical account of collective rights within the larger debate between proponents of different rights theories. By exploring why 'collective rights' should be differentiated from similar legal concepts, the relationship between collective and (...) individual rights and why groups should be recognised as the third distinctive type of right-holders, it presents the topic as connected to the larger philosophical debate about international law of human rights, most notably to the problem of universality of rights. One of the key behavioral effects of attractiveness is increased visual attention to attractive people. This effect is often explained in terms of evolutionary adaptations, such as attractiveness being an indicator of good health. Other factors could influence this effect. In the present study, we explored the modulating role of sexual orientation on the effects of attractiveness on exploratory visual behavior. Heterosexual and homosexual men and women viewed natural-looking scenes that depicted either two women or two men who varied systematically (...) in levels of attractiveness (based on a pre-study). Participants’ eye movements and attractiveness ratings towards the faces of the depicted people were recorded. The results showed that although attractiveness had the largest influence on participants’ behaviors, participants’ sexual orientations strongly modulated the effects. With the exception of homosexual women, all participant groups looked longer and more often at attractive faces that corresponded with their sexual orientations. Interestingly, heterosexual and homosexual men and homosexual women looked longer and more often at the less attractive face of their non-preferred sex than the less attractive face of their preferred sex, evidence that less attractive faces of the preferred sex might have an aversive character. These findings provide evidence for the important role that sexual orientation plays in guiding visual exploratory behavior and evaluations of the attractiveness of others. (shrink)

In this paper, I address the question of engaged philosophy with an emphasis on aesthetics and the philosophy of art. Referring to some specific problems discussed in these areas – in particular climate change, ecological crisis and immoral art – I demonstrate that philosophy can be engaged in two ways: (i) in its aspiration to question social reality, culture, human experience and the strategies for making sense of and finding value in that experience; (ii) in the aspiration to contribute to (...) the well-being of individuals and society through its contribution to understanding that reality and experience. First, I point to the connection between the philosophical questions and the fundamental intellectual aspirations of human beings as social and cultural beings, but also as autonomous knowers and valuers. Second, I respond to two objections that can be directed against engaged philosophy: (i) one that points to a lack of consensus among philosophical responses (the problem of disagreement), and (ii) one that highlights the irrelevance of philosophical debates to our social practice. In this article, I defend the cognitive value of certain generic television series. Unlike media and television scholars, who have been appreciative of the informative capacity of television fiction, philosophers have been less willing to acknowledge the way in which these works contribute to our understanding of our social reality. My aim here is to provide one such account, grounded in aesthetic cognitivism, that is, the view that fiction is a source of knowledge. Focusing on crime and courtroom dramas, I (...) start by offering some examples of the cognitive benefits available in some of these series and I argue that the more beneficial cases establish superior mimetic relations with reality, enhancing their capacity to present ethically challenging issues. I then examine whether the fictional dimension of these works presents an obstacle to their informative potential and I conclude that it does not. A central aspect of my account is the claim that the degree of cognitive benefit depends on the underlying narrative strategy of the series. Specifically, there are clues in any given show, including the treatment of ongoing characters, which signal the extent to which it can be taken as mimetically reliable and thus, cognitively valuable. I complete my account by addressing anti-cognitivists’ arguments which call to doubt the informative aspect of television series and their capacity to address ethical concerns. (shrink)

The concept of well being has become the main criterion to assess quality of life in contemporary society. Individual well-being describes the individual quality of life, while social well-being refers to quality of life in a society. Given that well-being has a multitude of dimensions, a unique definition of it is elusive to scholars. In this article social well-being is conceptualised as a dynamic process within the context set by social integration as one?s relationship to society and the community. This (...) includes the quality of interaction between the individual and society and one?s?social actualisation? understood as the realisation of one?s social capacities. Social actualisation also involves one?s ability to influence social processes and to benefit from social cohesion, which consists, in any society, of the quality, organisation and functioning of the social world. Hence the ability to impact society is an integral part of individual well being. This paper suggests that philosophical practice as a new paradigm in the humanities holds out promise for the improvement of both individual and social well-being. (shrink)

Information-seeking behaviour of sniffer dogs during match-to-sample training in the scent lineup Qualitative and quantitative changes in dogs' information-seeking behaviours during the subsequent phases of operant conditioning training using a scent lineup, were investigated. Particular interest was paid to behaviours which may have an impact on errors committed by dogs at work in a scent lineup and thus on the reliability of the canine identification of humans on the base of scent. Significant individual differences were found in dogs' performance in (...) operant conditioning during match-to-sample trials. The style and time of sniffing the pattern scent sample as well as the searching time and number of stations sniffed in the lineup were found to influence the percentage of errors made by dogs. The effects of the dogs' routine e.g. omitting stations, using other cues than olfactory ones and effects of the non-verbal communications between handler and dog have been discussed. (shrink)

Although there are numerous similarities between Duhem and Quine, there are strong arguments which suggest that what can be isolated as Quine?s thesis would be unacceptable to Duhem. On the other hand, they both share Duhem?s holistic thesis: empirical statements are interconnected in such a way that they cannot be confirmed or refuted taken in isolation. Since Quine?s holism is more radical, as we shall show, his thesis claims that we can always keep a statement by making necessary adjustments somewhere (...) else in the system. We will try to show that only the first thesis can be rightfully ascribed to Duhem, that these two thesis are not identical, and that they are both different from what is usually called the theses of underdetermination. As we shall see, neither of them speaks about the possibility of empirically equivalent theories. They are, first and foremost, holistic theses which, under certain additional assumptions, have the thesis of underdetermination as their consequence. (shrink)

The study is devoted to the study of actual state of the archival materials of V.S. Solovyov which are held in different funds of Russia. During the working process was carried out the analysis of Solovyov’s related materials in a number of archives of Moscow and St. Petersburg. In the context of this topic, documents from such archive funds as: RGALI, GARF, TsAGM, OR RSL (Moscow), OR RNL, IRLI RAS, RGIA (St. Petersburg) were reviewed. Particular attention was paid to the (...) 1880s as the least researched period of philosopher’s work in his biography due to the insufficient availability of sources and to the restrictions of spiritual censorship in connection with the church-political content of Solovyov’s works of this period (“The Great Debate and Christian Politics”, 1883; “The History and Future of Theocracy”, 1887, etc.). In this regard, special attention was paid to the Solovyov funds in such archives as RGALI (F. 446) and OR RNB (F. 718). In the course of the study, many storage units were identified containing unsorted, draft materials, notebooks and notes of the philosopher, which need to be systematized and studied. The work carried out allows us to establish the scale and determine the priority areas of current research on the creative biography and philosophy of V.S. Solovyov based on the study of primary sources in the archives of Russia. (shrink)

Though a common language of science allows for easier communication of the results among researchers, the use of lingua franca also comes with the cost of losing some of the diverse ideas and results arising from the plurality of languages. Following Quine’s famous thesis about the indeterminacy of translation, we elaborate on the inherent loss of diverse ideas when only one language of science is used. Non-native speakers sometimes experience epistemic injustice due to their language proficiency and consequently, their scientific (...) insights get marginalized. Thus, it is important epistemically to include the results of all researchers independent of their native language. As a solution, we promote epistemic equity and inclusion both on the individual level and on the level of the scientific community. Epistemic equity means that researchers who suffer disadvantages because of their language skills get support from the rest of the scientific community that will compensate for their disadvantage and at the same time facilitate their epistemic inclusion. This can be achieved through the introduction of mitigating agents – the individuals and organizations that ought to serve as a communication bridge between individual researchers and the scientific community. This paper argues that the missing voice in clinical ethics is that of informal caregivers. Despite their substantial contribution to care provided to individuals with disabilities, chronic illness or dementia, informal caregivers are rarely thought of as members of the healthcare team and their narratives are rarely listened to and included in clinical and ethical decisions. Addressing this gap, this paper discusses the reasons for the systemic misrecognition of informal caregivers in healthcare systems and argues for their greater narrative inclusion (...) on the clinical, legal and social planes. Infertility Accepted treatment is replete with bioethical dilemmas regarding the limits of available medical therapies. Poland has no legal acts regulating the ethical problems associated with infertility treatment and work on such legislation has been in progress for a long time, arousing very intense emotions in Polish society. The purpose of the present study was to find out what Polish women undergoing infertility treatment think about the most disputable and controversial bioethical problems of assisted reproduction. An Attitudes towards Bioethical Problems (...) of Infertility Scale was constructed specifically for this study. Items were taken from the Bioethics Bills currently under discussion in Polish Parliament (Seym). 312 women were enrolled in the study. Women experiencing infertility favoured more liberal legislation. Participants disagreed, for example, with the following regulations: prohibition of embryo freezing, prohibition of preimplantation genetic diagnosis of embryos, age limits for women using in vitro fertilisation and prohibition of in vitro fertilisation for single women. The opinions of patients undergoing infertility treatment are an important voice in the Polish debate on the Bioethics Bills. (shrink)

Racism is a pervasive issue in patient care and a key social determinant of health. Clinical ethicists, like others involved in patient care, have a duty to recognize and respond to racism on both individual and systems-wide levels to improve patient care. Doing so can be challenging and, like other skills in ethics consultation, may benefit from specialized training, standardized tools and approaches, and practice. Learning from existing frameworks and tools, as well as building new ones, can help guide clinical (...) ethicists to systematically approach racism as it affects clinical cases. Here, we propose an expansion of the commonly used four-box method to clinical ethics consultation, where racism is considered as a potential factor in each of the four boxes. We apply this method to two clinical cases to highlight ethically salient information that might be missed using the standard formulation of the four boxes but captured with the expanded version. We argue that this expansion of an existing clinical ethics consultation tool is ethically justified insofar as it (a) creates a more just approach, (b) supports individual consultants and services, and (c) facilitates communication in contexts where racism impinges on effecting good patient care. The aim of the article is to discuss the legal language transformations from a diachronic perspective taking into account the following factors: (i) spatial and temporal, (ii) linguistic norm changes, (iii) political, (iv) social (customs), and (v) globalization as well as (vi) EU-induced. Spatial and temporal factors include legal relations influenced by climate and the cycles of nature. Linguistic factors include spelling reforms and grammatical changes each language undergoes, for example, as a result of usage. As far as the law (...) is concerned, normative changes can be observed when laws are amended. Other factors such as customs, usage, etc. cannot be neglected when discussing the language of the law. Analogously political correctness and usage can be observed in gender sensitive language and the introduction of such terms as chairperson instead of chairman. Social factors should not be overlooked. As a result of social changes, numerous terms have been introduced to legal lexicons in many countries starting with same-sex unions or same-sex-marriages. The so-called political correctness enforces some language changes and leads to the introduction of new terms and at the same time the abandonment of others. Consequently, some terms cease to be used and consequently become archaic. The aim of the article is to focus on diachronic changes in legal languages and present the communication problems resulting from them from intra- and inter-lingual perspectives. (shrink)

The paper deals with the problem of translating selected insolvency terminology from Polish into English and from English into Polish. The re- search corpora encompassed the Insolvency Act 1986 as amended and Ustawa z dnia 28 lutego 2003. Prawo upadłościowe i naprawcze [the Act on Polish Insolvency and Rehabilitation Law of 28th February 2003 as amended]. The research methods included: the comparison of parallel texts, the method of axiomatisation of the legal linguistic reality, the termino- logical analysis of the corpus (...) material, the concept of adjusting the target text to the communicative needs and requirements of the community of recipients and the techniques of providing equivalents for non-equivalent terminology. The research hypothesis has been so formulated that the parametrisation of legal reality may assist in finding more adequate equivalents and determine differences in meaning of compared source and target language terms, which in turn facilitates the choice of a more adequate technique of providing equivalents for non-equivalent or partially equivalent legal terminology meeting the com- municative needs of translation recipients. The research results revealed that insolvency terminology is highly system-bound and available equivalents may often be misleading for the community of target text recipients. (shrink)

Exposure Therapy (ET) has demonstrated its efficacy in the treatment of phobias, anxiety and Post-traumatic Stress Disorder (PTSD), however, it suffers a high drop-out rate because of too low or too high patient engagement in treatment. Virtual Reality Exposure Therapy (VRET) is comparably effective regarding symptom reduction and offers an alternative tool to facilitate engagement for avoidant participants. Neuroimaging studies have demonstrated that both ET and VRET normalize brain activity within a fear circuit. However, previous studies have employed brain imaging (...) technology which restricts people’s movement and hides their body, surroundings and therapist from view. This is at odds with the way engagement is typically controlled. We used a novel combination of neural imaging and VR technology—Functional Near-Infrared Spectroscopy (fNIRS) and Immersive Projection Technology (IPT), to avoid these limitations. Although there are a few studies that have investigated the effect of VRET on a brain function after the treatment, the present study utilized technologies which promote ecological validity to measure brain changes after VRET treatment. Furthermore, there are no studies that have measured brain activity within VRET session. In this study brain activity within the prefrontal cortex (PFC) was measured during three consecutive exposure sessions. Plans Not Needed if You Have High and Stable Self-Efficacy: Planning Intervention and Snack Intake in the Context of Self-Efficacy Trajectories Forming action plans is expected to move people from intention to action. We hypothesized that the effects of planning interventions may depend on changes in self-efficacy beliefs. Participants were assigned to the control or the planning intervention groups and reported their self-efficacy, sweet and salty snack intake at the baseline and four months later. The results suggest that an increase (...) of efficacy beliefs over time augmented the effects of the planning intervention and resulted in the lowest snack intake. Planning intervention also prompted lower unhealthy snacking if efficacy beliefs were decreasing. Those who have stable-high self-efficacy were able to achieve low snack intake regardless of the group assignment. (shrink)

By analising the specific use made by Thomas Aquinas of the verb ‘ostendere’ in the context of systematic philosophical conclusions as well as his presentation of biblical events and by scrutinizing the narrative strategies relative to ‘ostentatio’ (in the sense of displaying, hinting at, demonstrating) in ‘Der Saelden Hort’, a late medieval text on salvation, this paper makes clear that ostentation is a central category of mediality in the Middle Ages.

This paper presents a study of Rāmacandra–Guṇacandra’s theory of aesthetics in light of the Kashmiri rasa ideology and demonstrates that the Jain authors offer a new and original conceptualization of aesthetic experience, in which the spectator remains cognitively active in the course of watching the drama. In their model, the relationship between rasa and pleasure is mediated by a cognitive error, and the feeling of pleasure does not coincide with the savoring of rasa but emerges after the savoring of rasa (...) ceases. This paper argues that Rāmacandra and Guṇacandra demystify the Kashmiri theory of aesthetics by identifying affinities between the lived world and the fictive world of drama and by rendering the regular means of knowledge, such as inference and memory, as instrumental for the experience of rasa. It further suggests that this new conceptualization, in which pleasure is contingent upon the dissolution of illusion, may have facilitated the development of playwrighting among Jain monks from the twelfth century on. In this paper I discuss the political value of the right to privacy. The classical accounts of privacy do not differentiate between privacy as the right of a citizen against other citizens vs. the right to privacy as the right against the state or the government. I shall argue that this distinction should be made, since the new context of the privacy debate has surpassed the historical frames in which the intelligence methods used by governments were comparable to those available (...) to individuals. I also present cases in which political privacy serves as an instrument of protecting important collective agendas exceeding the context of personal privacy. I argue that due to its function, political privacy should be considered a necessary element of democratic governance with the rule of law, imposing legal bounds on governments’ discretionary actions. The purpose of this article is to show the Roman home theater of Queen Marie Casimire Louise de La Grange d’Arquien as a topic she addressed in her letters. The sources are based on her correspondence with her eldest son; these sources are one-sided, as only the queen’s letters are known, while the letters of Prince James have not survived or have not been found. In 1698, the widowed Marie Casimire left Poland and moved to Rome to spend the Jubilee (...) year there. Eventually, she remained on the Tiber for almost fifteen years. Following in the footsteps of Queen Christina, she wished to be a patron of artists, and since she had already organized theatrical performances at her court in Poland, she decided to patronize musical, theatrical and operatic performances in Rome as well. She was assisted in this endeavor by Prince Alexander, who also resided in Rome. It soon became apparent that her son was not only an active patron, but also had artistic talents and an aptitude to take on the role of director, writer, and even a dancer in ballet scenes. The queen’s granddaughter and namesake, Marie Casimire, was also involved in preparing the performances. At her uncle’s side, she learned the art of preparing performances, but she also took part in ballet scenes. In her letters to her eldest son, James, the queen marveled at the versatile talents of both and assured him that she would spare no expense or effort to provide them with opportunities to entertain, and to bring splendor and widespread acceptance to herself and her theater. In her correspondence, the Queen never touched on the topic of the plays themselves, gave their titles, or wrote anything about the subjects they addressed. From the Queen’s correspondence, one cannot learn much about her home theater, but much about the pride that filled her at the thought of her son’s and granddaughter’s artistic achievements.
