Abstract In 1995, the constitution of the Mexican state of Oaxaca was reformed to recognise indigenous usages and customs for the election of municipal governments. This recognition is problematic from a normative perspective, as women, new?comers and dwellers in municipal sub?units are disenfranchised in a good number of indigenous municipalities of the state. Nevertheless, this article argues against a summary assessment of the (presumably illiberal) consequences of this recognition policy. Following James Tully, it advocates an intercultural, dialogical and inclusive procedure (...) to tackle the perils of the politics of recognition in Oaxaca and Mexico. However, this procedure?based approach raises problems of its own related to the issues of representation and intra?communal divisions. As a result, the ultimate role of substantive commitments, in particular to individual rights, needs to be recognised. Despite these shortcomings, though, an approach based on an intercultural, dialogical and inclusive conflict?solving procedure is the best option to deliver more just answers to indigenous demands for recognition. When should we expect compliance with international human rights norms? Previous literature on the causal mechanisms underlying compliance have focused independently on the roles of state willingness, thought of as the preferences of the regime leadership, and on state capacity, in improving human rights practices within a state. We build an argument that neither of these factors are sufficient on their own to improve compliance with human rights norms. Instead, improved human rights practices require both “the will and the way.” (...) Our central hypothesis is that capacities and willingness, acting jointly, are key determinants of improvements in compliance with international human rights norms. The paper confirms this proposition using two-staged and single-stage regression models and a time-series cross-sectional approach at the country-year level. A highly capable bureaucracy and a state that has signaled its willingness through the acceptance of individual complaint and inquiry procedures in the UN treaty regime are jointly necessary for improved human rights practices. Drawing on behavioral economics, nudges (policy interventions based on choice architecture) have the capacity to strategically shape policymaking, subtly guiding individual behavior by adjusting their decision environment. Applied to enhance vaccinations, boost retirement savings, or promote healthy habits, these interventions align with consensus-defined well-being. As governments adopt nudges, scholars have explored their role in fostering virtues. This paper argues that nudges have the potential to efficiently contribute to virtuous development by instilling and sustaining habits, respecting individual choice, and ensuring deliberation. (...) The purpose of this essay is to articulate a specific desideratum for any theory of Latinidad, namely, that there is no adequate conception of Latinx without an attendant conception of Afro-Latinx. In order to be reflective of those whom it purports to describe in the U.S. and elsewhere in the hemisphere, the term Latinx must be plastic enough to encompass the many internal differences, and even antagonisms, between its different constituent parts. Within it, we argue here in particular, it must (...) include its Afro-descended history, which includes not just African-descended people but also a denial of the influences of African-descended culture writ large. Our central claim here, then, is that a certain African-descendedness is constitutive of Latinidad in multiple registers, including history, cultural practices, and social identificatory processes despite Latinidad’s pernicious exclusionary history. This introduction to this collection of essays presents diverse perspectives on social identities, inviting readers to reconsider established notions and explore new approaches to understanding these complex social phenomena. The contributions challenge traditional philosophical boundaries, intersecting ontological, epistemological, ethical, and political considerations. // The authors situate different views on the ontology of social identities within some extant options. Thus, they contrast their "social identity affordance view" with two alternative approaches: the Cambridge Social Ontology group's positioning theory and Weichold & Thonhauser's (...) broad conception of social identities. Their view understands social identities as realities that structure social life and shape individuals' self-conceptions, emphasizing the importance of historical contingency and social context. // The introduction then proceeds to review the contributions to the volume. The following study shows the main qualitative results obtained by means of a two follow up study with a group of telephone interpreters who previously participated in an ad hoc emotional regulation program designed according to their specific needs.The study aimed to evaluate the impact of the intervention program in the long term.The results demonstrated the positive effect of the program on the interpreters’ lives and on their emotional management.The need of verifying the effect of this kind of programs in (...) order to totally measure their impact through the time is discussed. Traditionally, corruption is seen as a rational pursuit of profit, focusing on personal gain. However, this view overlooks behavioral, social, and systemic influences. This paper focuses on the behavioral aspects of corruption, providing a deeper understanding of its complexities by addressing the factors overlooked by conventional approaches. Reviewing some of the literature, we highlight how researchers have approached the study of corruption from the perspective of behavioral sciences. Additionally, we examine how the emerging discipline of Behavioral Public Policy (BPP) employs (...) innovative methods to reduce corrupt practices, offering new insights and strategies that transcend traditional approaches. The core contribution of our paper lies in its novel approach: showing a path for corruption decrease by replacing traditional regulations and bureaucratic burdens, which research shows can increase its likelihood, with non-regulatory behavioral tools such as nudges and sludge audits. By reducing regulations and administrative red tape, these tools simplify processes minimizing opportunities for corrupt behavior in certain contexts, while aligning with liberal principles. In this article, we aim to infuse corruption research with a behavioral twist and a liberal perspective, offering policymakers alternative strategies to foster transparency, accountability, and ethical governance. While this approach will not completely eradicate corruption, it strives to show how BPP can reduce its occurrences. (shrink)

Este artículo presenta y defiende una concepción expresiva del mundo perceptual que depende de la intersubjetividad. En un primer momento se muestra el desarrollo del concepto de expresión en Husserl y en Merleau-Ponty. El punto central de este desarrollo es que, en contraste con la concepción tradicional del concepto de expresión que es lingüística y consiste en el manifestarse exteriormente de algo interno, se propone ahora una idea de expresión que ya no separa radicalmente lo expresado de la expresión, no (...) se concibe como traducción, y se aplica a la relación entre subjetividad y corporalidad. Para ajustar la aplicación de la expresión a la percepción, se argumenta que las apariencias perceptuales requieren de una cualificación en términos de la posición o perspectiva del sujeto que percibe. Esta “posición” o perspectiva no es únicamente espacio-temporal, sino que también es pragmática. Finalmente, se introduce la intersubjetividad, entendida pragmáticamente, a través de la idea de que hay maneras de explorar el mundo con los sentidos que son constituidas socialmente por los diferentes grupos sociales de los que hacemos parte. Se argumenta que esta concepción pragmatista, diferente a la ruta predominante en fenomenología basada en el significado como un asunto de conciencia de la experiencia, también es defendible en el terreno fenomenológico, particularmente a través de la noción husserliana de toma de posición (Stellungnahme) y la idea merleau-pontiana de las maneras de interrogar el mundo perceptualmente. -/- This article presents and defends an expressive and intersubjectively dependent conception of the perceptual world. The first section deals with the phenomenological development of the concept of expression in Husserl and Merleau-Ponty. In this development, and in contrast with the traditional conception of expression –a linguistic conception based on the external manifesting of something inner–, a new conception appears: one that doesn’t keep a hard separation between the expression and what is expressed, is not modeled after translation, and can be applied to the relationship between subjectivity and corporeality. To further precise the way expression and perception fit together, I argue that perceptual appearances require being qualified in terms of the position or perspective of the perceiving subject. This “position” or perspective is not only spatiotemporal but also pragmatic. Lastly, a pragmatically understood intersubjectivity is brought into play. I look at the fact that there are different ways of exploring the world with our senses that are socially constituted. This constitution takes places in and through the different social groups to which we belong. I argue that this pragmatist conception, while different from the dominant phenomenological understanding that takes meaning to be about the consciousness of experiences, is also defensible on phenomenological grounds. This alternative understanding finds support in Husserl’s idea of position-taking (Stellungnahme) and Merleau-Ponty’s claim that there exist different ways of interrogating the world perceptually. The military defeat and the economic depression do not lead to the Spanish thinkers towards the modernity. They reject the scheme "subject-object" and they looks for the encounter between a radical subjectivity and a transobjetive reality. These common characteristics are in Unamuno, Ortega y Gasset, Zubiri, Millán-Puelles and L. Polo.

¿Necesitamos representaciones del cuerpo para llevar a cabo actividades como cruzar la calle, montar en bicicleta o salir por la puerta? En este trabajo se defiende la idea de que la ejecución de este tipo de acciones involucra representaciones del cuerpo con contenido no conceptual. Primero se discuten los argumentos en contra de la noción de representación del cuerpo en la acción, para extraer sus principales consecuencias. Se propone una versión delcontenido de las representaciones del cuerpo involucradas en la acción (...) cotidiana, y se finaliza con una discusión acerca de una objeción potencial, y con una reflexión sobre la relación entre contenido conceptual y contenido no conceptual. Las siguientes páginas versan sobre la propuesta humanista de nueva ilustración (Aufklärung) de José Ortega y Gasset (1883-1955) en Misión de la Universidad (1930), una obra donde el filósofo enfatiza el valor de una cultura de humanidades o cultura general que, como sistema de ideas sobre el mundo y la humanidad impulsaron las universidades medievales y que se necesita recuperar para contrarrestar la barbarie del especialismo o el terrorismo de los laboratorios que invade la universidad. En un mundo global que (...) cada vez reclama una mayor atención a la interdisciplinariedad para comprender mejor los asuntos que más nos conciernen y que no son otros que los plenamente humanos, la universidad juega un rol fundamental, debiendo potenciar el estudio de las humanidades pues, como dice Ortega, la espléndida palabra «humanidades» designa las disciplinas todas que se ocupan del conjunto de los hechos exclusivamente humanos. Este artículo se concentra en la recepción y el legado de Michel Foucault en el ámbito estadounidense, en particular en la Universidad de California, Berkeley (1980-1981 y 1983). Durante ese último año, Foucault formó un seminario de investigación dedicado a esbozar los primeros trazos de una “genealogía del biopoder”. Los trabajos en Berkeley tocaron diversos ejemplos. Sin embargo, ninguno de ellos fue directamente relacionado con lo que, sostengo, describe mejor el funcionamiento contemporáneo del biopoder; esto es, el dispositivo médico-sanitario, o (...) la “medicalización”. Se parte de dos premisas principales: (1) bajo el marco de una discusión acerca de los diversos usos del concepto de biopoder, busco poner de relieve su extraordinario potencial histórico crítico para comprender qué está pasando en este preciso momento; en otras palabras, abonar a eso que Foucault entendió por una “ontología de la actualidad”. (2) Hacer notar que es casi imposible comprender el funcionamiento de esta modalidad de ejercicio del poder sin la intervención del modelo médico, en la medida de su esfera de influencia en las sociedades actuales. Esto último se muestra en casos como el origen -y pervivencia- del Estado asistencial (welfare), los experimentos de eugenesia, las técnicas de reproducción asistida, las políticas públicas de combate a la propagación viral y el consiguiente “temor al contagio” poblacional, la explotación indiscriminada de los alimentos transgénicos y -de manera un poco más prolija-el papel de la medicina genómica preventiva. This essay discusses political disorientation and what I define as a legibility crisis ushered in by the election of Donald Trump in 2016. After defining these concepts, it provides evidence for them and fleshes out how they were expressed in prophecies about Trump in white evangelical communities. A legibility crisis is the realization that some fundamental aspects of the symbolic domain (language, civic values, political practices, and institutions) are no longer binding or recognizable. There is a loss of touch with (...) what was once expected political conduct, but this loss gravitates toward something that is not fully graspable in its conceptual and emotional dimensions. In examining political disorientation, I refer to a three-dimensional condition encompassing the personal, the institutional, and the analytical. This disorientation challenges our expectations about institutional norms and forces us to realize that the respectability and legitimacy of those institutions have been hollowed out. This essay will also address the culture of prophecy in some evangelical groups and how prophetic utterances shape these groups’ understanding of the American Constitution and political reality. Se busca rastrear la imagen que Platón tiene de Heráclito y articularla con la estructura argumentativa del Cratilo, para comprender las necesidades textuales a las que responde la doctrina del flujo perpetuo, es decir, la discusión sobre la corrección (ὀρθότης) del nombre. Gracias a la inclusión del testimonio heraclíteo, resulta posible rastrear la presunta consolidación de la tesis sobre los nombres primarios y los secundarios como el eje de la separación entre dos planos de realidad (uno estable y uno móvil) (...) y de la teoría de las Ideas -es decir, como la base de la epistemología platónica presente en los diálogos de madurez-. The article seeks to trace the image Plato has of Heraclitus and connect it with the argumentative structure of the Cratylus in order to understand the textual needs that give rise to the doctrine of perpetual flux, that is, the discussion regarding the correctness (ὀρθότης) of names. The inclusion of Heraclitus's testimony makes it possible to trace the alleged consolidation of the thesis regarding primary and secondary names as the axis of separation between two levels of reality (one stable, the other, changing) and the theory of Ideas -that is, as the basis of Plato's epistemology as set forth in the late dialogues-. En las últimas décadas, la tendencia a pensar la estética a partir del carácter autónomo de su objeto ha sido dominante en la discusión filosófica alemana. Sin embargo, la crítica a la estética de la autonomía ha cobrado recientemente un nuevo aliento. Uno de los intentos más ambiciosos por destronar la centralidad de este paradigma en la estética actual corresponde al filósofo Georg W. Bertram. El propósito de este artículo es reconstruir la teoría estética de Bertram y exponer cómo ella (...) se inserta en la disciplina estética. Paralelamente, se mostrarán algunas dificultades de la revitalización de una ontología del arte basada en la continuidad entre praxis artística y vida cotidiana. (shrink)

Nota crítica sobre PornoXplotación: la explosión de la gran adicción de nuestros tiempos, de Mabel Lozano y Pablo J. Conellie, Barcelona, Editorial Alrevés, 2020, 286 pp.

Después de un breve recorrido por la crítica a la obra de Juan Rulfo, y la discusión que en ella se presentó entre la dicotomía nacionalismo versus cosmopolitismo, proponemos con el análisis de Retales. Compilación de Juan Rulfo y algunas de sus entrevistas, que el autor jalisciense desarmó la dicotomía existente (nacionalismo versus cosmopolitismo) y logró empoderar a la literatura mexicana al presentar un canon personal de autores de la periferia occidental. Este canon de autores de la periferia nos permite (...) ver dos acciones significativas de la obra de Rulfo, siguiendo la metodología de Pascale Casanova, y son: 1) la obtención de los “marcadores de diferencia” de la literatura mexicana, y 2) la adopción de formas de escritura de vanguardia, ya existentes en los autores escandinavos y suizo, que conformaron su canon literario personal. Aquí intentaremos hacer una relectura de él que, a partir de desnudar sus debilidades, haga lucir sus bondades, especialmente para comprender tanto el lugar clave que el libro ocupa dentro de la obra del filósofo noruego, como los elementos del sistema de Leibniz que hicieron posible las conexiones que nos presenta. During the last few months, several pioneer genome‐wide transcriptomic, proteomic and metabolomic studies have revolutionised the understanding of bacterial biological processes, leading to a picture that resembles eukaryotic complexity. Technological advances such as next‐generation high‐throughput sequencing and high‐density oligonucleotide microarrays have allowed the determination, in several bacteria, of the entire boundaries of all expressed transcripts. Consequently, novel RNA‐mediated regulatory mechanisms have been discovered including multifunctional RNAs. Moreover, resolution of bacterial proteome organisation (interactome) and global protein localisation (localizome) have unveiled an (...) unanticipated complexity that highlights the significance of protein multifunctionality and localisation in the cell. Also, analysis of a complete bacterial metabolic network has again revealed a high fraction of multifunctional enzymes and an unexpectedly high level of metabolic responses and adaptation. Altogether, these novel approaches have permitted the deciphering of the entire physiological landscape of one of the smallest bacteria, Mycoplasma pneumoniae. Here, we summarise and discuss recent findings aimed at defining the blueprint of any prokaryote. (shrink)
