pt. 1. O materialismo juridico e suas fontes.

O presente estudo tem por objetivo discutir a recepção do platonismo na produção lírica de Raul de Leoni (1895-1926). Atualmente, o nome de Leoni é majoritariamente ausente da matriz curricular do ensino de poesia brasileira; sua figura foi praticamente esquecida nos círculos acadêmicos. Não obstante essa lacuna, seu único livro publicado, intitulado Luz mediterrânea (1922), gozou de grande reconhecimento e prestígio entre poetas e críticos do período, dentre eles Alceu Amoroso Lima, Ribeiro Couto e Múcio Leão. A fim (...) de melhor explorar sua obra, o artigo se divide em dois momentos: na primeira seção, aborda-se o lugar da poesia de Leoni e suas peculiaridades; enquanto, na segunda seção, analisam-se os elementos clássicos constituintes de sua produção, demonstrando de que modo o poeta faz uso habilidoso de concepções geralmente atribuídas a Platão. In its first part, this paper is devoted to presenting Maurice Merleau-Ponty’s phenomenology of space through some of his texts. Between 1942’s The Structure of Behavior and the 1953 courses, Merleau-Ponty is refining a philosophy of movement, the most important concept of which is that of motor intentionality, which articulates the phenomenological theme of intentionality in relation to the problem of a subject’s understanding of observed movement. Movement is thus related to intersubjectivity and Einfühlung. Next, we present the general aspects (...) of and some problems with mirror neuron theory, which were already addressed elsewhere in Merleau-Ponty’s phenomenology: the brain-body relation, the definition of the capability of mirroring in the other individual, the role of the environment in intersubjectivity, and the idea of meaning as “direc­tion” toward goals. We suggest that a transdisciplinary approach can help solve some of the problems wrongly attributed to mirror neuron theorists. (shrink)

The noetic model is the first theory of any kind to explain qualia in physical terms. The formal delineation of the life principle or élan vital explains not only the origin of self-organisation in living systems, providing the basis for the first comprehensive dualist theory, but also is what makes the model empirically testable allowing this volume to make history. Il saggio muove da una ricostruzione storico-concettuale dell’interpretazione merleau-pontyana del manoscritto di Husserl Rovesciamento della dottrina copernicana nell’interpretazione della corrente visione del mondo, con cui Merleau-Ponty è in dialogo sin dalla Fenomenologia della percezione, per ripercorrere gli sviluppi del tema della Terra nell’avanzare della riflessione merleau-pontyana sul corpo-proprio, sull’organismo vivente, sulla dimensione carnale dell’essere. La proposta di un ritorno alla Terra, intesa come Boden irriducibile dell’esperienza, trova infatti il suo risvolto ontologico nell’idea di Spielraum, che già Husserl definiva come “ambito (...) di possibilità”, e che in Merleau-Ponty assume il senso di un margine di gioco sempre aperto nella carne. Boden e Spielraum, non a caso tematizzati da Merleau-Ponty in due corsi paralleli tenuti al Collège de France nell’anno 1959-1960, permettono una rivalutazione del vivente secondo un modello che, contro il riduzionismo meccanicista, privilegi la spontaneità e la contingenza, e aprono allo sviluppo dell’ontologia porosa che il filosofo andrà proponendo negli ultimi anni. Ricostruendo la funzione della riflessione sulla corporeità e sul rapporto del vivente al mondo-ambiente in questa maturazione, si argomenterà che la critica che Merleau-Ponty muove al dualismo empirismo-idealismo trovi nell’idea di Terra un momento chiave, che contribuisce ad orientarla in direzione di una filosofia della carne. Questo passaggio riconfigura la Natura stessa, pensata non già come un originario, ma in quanto ambito di possibilità processuale e transindividuale, come quel quasi-oggetto, come lo definiva, ancora, Husserl, che presenta un’irriducibile resistenza ad un pensiero di sorvolo, proprio in quanto è condizione del pensiero stesso e ancoraggio della vita tutta.This essay begins with a historico-conceptual reconstruction of the Merleau-Pontian interpretation of Husserl’s manuscript, “Foundational Investigations of the Phenomenological Origin of the Spatiality of Nature,” with which Merleau-Ponty is in dialogue from Phenomenology of Perception onward, and revisits the development of the theme of the Earth in the progression of Merleau-Ponty’s reflection on le corps propre, the living organism, and the carnal dimension of being. The proposal for a return to the Earth, taken as irreducible Boden of experience, indeed finds its ontological reverse side in the idea of Spielraum, which Husserl already defined as a “milieu of possibilities,” and which in Merleau-Ponty takes on the sense of a margin of play always open in the flesh. Boden and Spielraum, two notions that Merleau-Ponty does not thematize by chance in the two parallel courses given at the Collège de France over the years 1959-1960, enable a reassessment of the living being according to a model that, against mechanistic reductionism, privileges spontaneity and contingency, and opens to the development of the porous ontology that the philosopher would propose in his final years. Reconstructing the function of reflection on corporeality, and on the relationship of the living being with its milieu in the process, it will be argued that the criticism directed by Merleau-Ponty against the dualism of empiricism-idealism finds in the idea of the Earth a key moment that contributes to orienting him in the direction of a philosophy of the flesh. This passage reconfigures Nature itself, no longer conceived of as an originating, but as a milieu of processual and transindividual possibilities, like that quasi-object, as Husserl again defined it, that presents an irreducible resistance against high-altitude thinking, precisely as the condition of thought itself and the anchorage of all life.Cet essai commence avec une reconstruction historico-conceptuelle de l’interprétation merleau-pontienne du manuscrit de Husserl, Renversement de la doctrine copernicienne, avec lequel Merleau-Ponty est en dialogue depuis la Phénoménologie de la perception, et revisite les développement du thème de la Terre dans la progression de la réflexion merleau-pontienne sur le corps propre, sur l’organisme vivant, sur la dimension charnelle de l’être. La proposition d’un retour à la Terre, prise comme Boden irréductible de l’expérience, trouve en effet son envers ontologique dans l’idée de Spielraum, que Husserl déjà définissait comme « milieu de possibilités » et qui chez Merleau-Ponty prend le sens d’une marge de jeu toujours ouverte dans la chair. A startup ecosystem is a dynamic environment in which several actors, such as investors, venture capitalists, angels, and facilitators, are the protagonists of a complex interplay. Most of these interactions involve the flow of capital whose size and direction help to map the intricate system of relationships. This quantity is also considered a good proxy of economic success. Given the complexity of such systems, it would be more desirable to supplement this information with other informative features, and a natural choice (...) is to adopt mathematical measures. In this work, we will specifically consider network centrality measures, borrowed by network theory. In particular, using the largest publicly available dataset for startups, the Crunchbase dataset, we show how centrality measures highlight the importance of particular players, such as angels and accelerators, whose role could be underestimated by focusing on collected funds only. We also provide a quantitative criterion to establish which firms should be considered strategic and rank them. Finally, as funding is a widespread measure for success in economic settings, we investigate to which extent this measure is in agreement with network metrics; the model accurately forecasts which firms will receive the highest funding in future years. Despite globalization a progressively increasing economic and financial concentration in the ‘cores’ of the world economy (e.g. EU) as well as the rise of new socioeconomic marginalization of peripheries (e.g. Maghreb and Mashraq) has been observed since the early 1980s. Marginalization has produced its own models of specialization in production which reflect in various countries and regions the needs of the ‘cores’ economy forces. A regional strategy for regional co-operation, so called co-development, is advanced to overcome the current economic and (...) social problems faced by marginalized regions in relation to world economic trends. This essay builds on two questions: the relation of the child with the other and the child’s way of knowing, in which the resistance of the unreflected is not yet problematized. Through a reconstruction of Merleau-Ponty’s critique of Piaget’s idea of the child’s linear intellectual progression toward reflexive abstraction, I highlight the moment of unreflection by taking up the notion of ultra-thing, which Merleau-Ponty borrows from Henry Wallon. These ultra-things are entities with which the child entertains a vague relation and (...) which always remain at the horizon of her perception without yet being possessed in a representation or grasped in a concept. They include, for example, the sun, the sky, the Earth, the body as an object, existence before the birth of the child – uninhabitable dimensions or, to the contrary, ones that are necessarily inhabited. The concept of ultra-thing has not been sufficiently explored in Merleau-Pontian studies and its importance remains underappreciated. This essay thus formulates a hypothesis about the relation between ultra-things and hyper-reflection. (shrink)

Gianluca De Fazio’s book Avversità e margini di gioco. Studio sulla soggettività in Merleau-Ponty presents precise and original research along several nodes of great importance in Merleau-Ponty’s philosophical production, such as subjectivity, expression, passivity, nature, history. By focusing on, without limiting himself to, the 1950’s period, the author declares that he aims at a denaturalization of nature and a dehistoricization of history: an overcoming of dichotomies which, though faithfully following the Merleau-Pontian path, does not fail to have a Deleuzian overtones. Este artigo analisa e compara os modos como Joseph Chan e Jonathan Quong relacionam liberalismo e perfeccionismo, mostrando que nenhum deles consegue formular adequadamente uma das possibilidades dessa relação, o perfeccionismo político. Inicialmente, será mostrado que aquilo que Chan apresenta e defende é um perfeccionismo liberal abrangente e intuicionista, que ele classifica adequadamente como moderado, mas nomeia equivocadamente como político. Em seguida, a análise constata que Quong consegue apontar a possibilidade formal do perfeccionismo político, mas de modo inconsistente, na medida (...) em que recua repetidamente para uma posição em que ele se confunde com um perfeccionismo abrangente. Como conclusão, busca mostrar que o perfeccionismo político ainda precisa ser adequadamente formulado como uma possibilidade concreta e promissora para as democracias liberais. (shrink)

The general mitigating and aggravating circumstances of criminal liability are elements attached to the crime that, when they occur, affect the punishment quantum. Cuban criminal legislation provides a catalog of such circumstances and some general conditions for their application. Such norms give judges broad discretion in assessing circumstances and adjusting punishment based on the intensity of those circumstances. In the interest of broad judicial discretion, the law does not establish specific ways for measuring circumstances’ intensity. This gives judges more freedom (...) and autonomy, but it also imposes on them more social responsibility and challenges them to manage the uncertainty and subjectivity inherent in this complex activity. This paper proposes a model to aid the linguistic assessment of circumstances’ intensity and to provide linguistic and numerical recommendations to determine an appropriate punishment interval. M-LAMAC determines the collective evaluation of circumstances of the same type, determines the prevalence of a type of circumstance by means of a compensation function, recommends the required modification in the input interval, and finally recommends a numerical interval adjusted to the judges’ initially expressed preferences. The model’s applicability is demonstrated by means of several experiments on a fictitious case of bank document forgery. (shrink)

Este artigo investiga as posições do liberalismo político de John Rawls e do republicanismo de Hannah Arendt em relação ao humanismo cívico e ao republicanismo clássico. Defende que o republicanismo de Arendt não deve ser considerado um humanismo cívico abrangente e que há uma proximidade entre o liberalismo político e o republicanismo clássico, pois sustenta que um perfeccionismo minimalista baseado em virtudes políticas informa as duas teorias.

Legitimate corporations exist within a common space that is shared with a different type of organization, one that is engaged in illicit or criminal activities.Activities taking place in this sector of the global commons threaten the integrity of the global markets and contribute to public distrust of corporations. In addition, they are placing legitimate organizations in an unanticipated and unwelcomed role within a larger law enforcement regime that requires them to participate in preventing the legitimization of illicit monetary gains through (...) money laundering. This paper provides information on the global initiatives implemented to curb money laundering. It concludes with a discussion of needed research. (shrink)

Se ha señalado con frecuencia el escaso tratamiento de Heidegger acerca del amor. Se busca recuperar y articular algunas alusiones importantes. Cabe distinguir tres registros temáticos: como modo de “encontrarse”, como “actitud” con los otros y como rasgo del “ser mismo”. Se intenta no solo comprender el fenómeno amoroso en el pensamiento heideggeriano, sino mostrar la incidencia que habría tenido en la interpretación de otras cuestiones y, sobre todo, en el asunto central sobre el sen-tido del Ser.
