The reference class problem arises when we want to assign a probability to a proposition (or sentence, or event) X, which may be classified in various ways, yet its probability can change depending on how it is classified. The problem is usually regarded as one specifically for the frequentist interpretation of probability and is often considered fatal to it. I argue that versions of the classical, logical, propensity and subjectivist interpretations also fall prey to their own variants of the reference (...) class problem. Other versions of these interpretations apparently evade the problem. But I contend that they are all “no-theory” theories of probability - accounts that leave quite obscure why probability should function as a guide to life, a suitable basis for rational inference and action. The reference class problem besets those theories that are genuinely informative and that plausibly constrain our inductive reasonings and decisions. I distinguish a “metaphysical” and an “epistemological” reference class problem. I submit that we can dissolve the former problem by recognizing that probability is fundamentally a two-place notion: conditional probability is the proper primitive of probability theory. This paper revisits the Pasadena game (Nover and Háyek 2004), a St Petersburg-like game whose expectation is undefined. We discuss serveral respects in which the Pasadena game is even more troublesome for decision theory than the St Petersburg game. Colyvan (2006) argues that the decision problem of whether or not to play the Pasadena game is ‘ill-posed’. He goes on to advocate a ‘pluralism’ regarding decision rules, which embraces dominance reasoning as well as maximizing expected utility. We rebut Colyvan’s argument, (...) offering several considerations in favour of the Pasadena decision problem being well posed. To be sure, current decision theory, which is underpinned by various preference axioms, leaves indeterminate how one should value the Pasadena game. But we suggest that determinacy might be achieved by adding further preference axioms. We conclude by opening the door to a far greater plurality of decision rules. We suggest how the goal of unifying these rules might guide future research. (shrink)

We discuss a recent attempt by Chris Daly and Simon Langford to do away with mathematical explanations of physical phenomena. Daly and Langford suggest that mathematics merely indexes parts of the physical world, and on this understanding of the role of mathematics in science, there is no need to countenance mathematical explanation of physical facts. We argue that their strategy is at best a sketch and only looks plausible in simple cases. We also draw attention to how frequently Daly and (...) Langford find themselves in conflict with mathematical and scientific practice. (shrink)

Philosophers have tended to dismiss John Stuart Mill’s claim that ‘all silencing of discussion is an assumption of infallibility’. I argue that Mill’s ‘infallibility claim’ is indeed open to many objections, but that, contrary to the consensus, those objections fail to defeat the anti-authoritarian thesis which lies at its core. I then argue that Mill’s consequentialist case for the liberty of thought and discussion is likewise capable of withstanding some familiar objections. My purpose is to suggest that Mill’s anti-authoritarianism and (...) his faith in thought and discussion, when taken seriously, supply the basis for a ‘public interest’ account of ‘freedom of expression as the liberty of thought and discussion’ which is faithful to Mill in spirit, if not to the precise letter. I outline such an account, which – as I say in conclusion – can serve as a valuable safeguard against ad hoc, reactive legislation, and the demands of a spurious communitarianism. (shrink)

This paper examines recent developments in U.K. utility regulation from a business ethics perspective. The regulatory framework that facilitated privatisation of the utility companies has foundations based upon free market principles involving a transfer from regulation to competitive markets wherever possible. Where competition is not feasible, continuing economic regulation is relied upon, designed to mirror the competitive market to induce, through comparative competition and the price capping mechanism, incentives for greater efficiency. The New Labour Government, having fundamentally reviewed this framework (...) when it came to office, has surprisingly endorsed its basic tenets. However, it wishes to superimpose social responsibility regulations designed to achieve social policy rather than economic objectives. This interventionist approach is in itself in conflict with the free market inspired regulatory framework but additionally, the imposition of social policy objectives creates fundamental ambiguities within the framework for the key stakeholders. The paper concludes that the Government''s policy, by eliciting stakeholder confusion and perverse behaviour, could be counter-productive but that ethical theories and frameworks can contribute to thinking in this vital area of the economy. One of the most pressing challenges facing virtue theorists is the conflation problem. This problem concerns the difficulty of explaining the distinction between different types of virtue, such as the distinction between moral virtues and intellectual virtues. Julia Driver has argued that only an outcomes-based understanding of virtue can provide an adequate solution to the conflation problem. In this paper, I argue against Driver’s outcomes-based account, and propose an alternative motivations-based solution. According to this proposal, intellectual virtues can be identified (...) by the shared motivation for cognitive contact with reality, while moral virtues are identified by appeal to the characteristic motivations of kindness and justice. I defend the proposal by demonstrating that it produces plausible verdicts concerning the virtue status of candidate moral and intellectual virtues. (shrink)

Illness creates a range of negative emotions in patients including anxiety, fear, powerlessness, and vulnerability. There is much debate on the ‘therapeutic’ or ‘helping’ nurse–patient relationship. However, despite the current agenda regarding patient-centred care, the literature concerning the development of good interpersonal responses and the view that a satisfactory nursing ethics should focus on persons and character traits rather than actions, nursing ethics is dominated by the traditional obligation, act-centred theories such as consequentialism and deontology. I critically examine these theories (...) and the role of duty-based notions in both general ethics and nursing practice. Because of well-established flaws, I conclude that obligation-based moral theories are incomplete and inadequate for nursing practice. I examine the work of Hursthouse on virtue ethics’ action guidance and the v-rules. I argue that the moral virtues and a strong (action-guiding) version of virtue ethics provide a plausible and viable alternative for nursing practice. I develop an account of a virtue-based helping relationship and a virtue-based approach to nursing. The latter is characterized by three features: (1) exercising the moral virtues such as compassion; (2) using judgement; and (3) using moral wisdom, understood to include at least moral perception, moral sensitivity, and moral imagination. Merits and problems of the virtue-based approach are examined. I relate the work of MacIntyre to nursing and I conceive nursing as a practice: nurses who exercise the virtues and seek the internal goods help to sustain the practice of nursing and thus prevent the marginalization of the virtues. The strong practice-based version of virtue ethics proposed is context-dependent, particularist, and relational. Several areas for future philosophical inquiry and empirical nursing research are suggested to develop this account yet further. (shrink)

Explicates the mutually fundamental commonalities between the methods and practices of Western psychotherapies, especially those whose bases are social, interpersonal, and communicational, and the disciplines of Buddhism, Vedanta, Yoga, and Taoism.

Starting with the distinction between epistemological and ontological naturalism, this chapter focuses most on Quine’s epistemological naturalism, not the ontological anti-naturalism he thought it leads to. It is argued that naturalised epistemology is not central to Quine’s epistemology. Quine’s key epistemological principle is:- follow the methods of science, and only those. Can Quine demarcate scientific methods from non-scientific ones? The problems which have been raised here, e.g. in the case of mathematics, are considered. A main theme is the relationship between (...) Quine’s naturalism and reductionist forms of ‘scientistic’ naturalism. Quine is generally taken to be an anti-reductionist, unsurprisingly given his explicit anti-reductionist pronouncements from ‘Two Dogmas’ onwards. It is argued that the situation is more complex than this and that key Quinean arguments are driven by a positivistic reductionism he never entirely broke free from. (shrink)

There is a good deal of biomedical research that does not produce scientifically useful data because it fails to recruit a sufficient number of subjects. This fact is typically not disclosed to prospective subjects. In general, the guidance about consent concerns the information required to make intelligent self-interested decisions and ignores some of the information required for intelligent altruistic decisions. Bioethics has worried about the ‘therapeutic misconception’, but has ignored the ‘completion misconception’. This article argues that, other things being equal, (...) prospective subjects should be informed about the possibility of non-completion as part of the standard consent process if it is or should be anticipatable that there is a non-trivial possibility of non-completion and that information is likely to be relevant to a prospective subject's decision to consent. The article then considers several objections to the argument, including the objection that disclosing non-completion information would make recruitment even more difficult. (shrink)

This paper discusses comparison classes—sets that relativize the interpretation of gradable adjectives, often specified with for-clauses as in John is smart for a linguist. Such a discussion ultimately lends support to the thesis that scales, degrees, measure functions, and linear orders are grammatically derived from more basic relations between individuals. Three accounts of comparison classes are compared and evaluated. The first proposes that such classes serve as an argument to a function that determines a standard of comparison. The second maintains (...) that these classes restrict the domain of a measure function used to map entities to degrees. The third proposes that these classes limit the kind of individuals that participate in a binary relation; this relation is then used in the construction of a scale and a measure function. It is this third account that is most consistent with the empirical data. It can explain how comparison classes fix a standard of comparison, induce presuppositions concerning the comparative subjects, and induce incommensurability in comparative constructions. (shrink)

If all organisations which produce mission statements, codes of practice or ethical codes were, therefore, ethical in conduct and performance, business ethics would be non-problematic. However, the effectiveness of corporate codes of ethics is dependent, inter alia, on the day-to-day behaviour of managers.Interest in the impact of ethical codes and mission statements on managerial behaviour has grown in recent years. The assumption underlying this paper is that one way of enriching our understanding of the (...) ethical behaviour of managers is to focus on actual behaviour in real organisations. (shrink)

One criticism of David Lewis's account of counterfactuals is that it sometimes assigns the wrong truth-value to a counterfactual when both antecedent and consequent happen to be true. Lewis has suggested a possible remedy to this situation, but commentators have found this to be unsatisfactory. I suggest an alternative solution which involves a modification of Lewis's truth conditions, but which confines itself to the resources already present in his account. This modification involves the device of embedding one counterfactual within another. (...) On the revised set of truth conditions, counterfactuals with true components are sometimes true and sometimes false, in a way that is more in keeping with our intuitive judgments about such statements. The metaphorical nature of biological language is examined and the use of metaphors for providing the linguistic context in which similarities and differences are made is described. Certain pervasive metaphors which are characterised by systemic properties are noted, and in order to provide some focus to the study, systemic metaphors associated with machine, text and organism are discussed. Other systemic metaphors such as society and circuit are also reported. Some details concerning interrelations between automaton and organism are presented in the (...) light of the previous discussion.An approach towards the analysis of biosystem metaphors is outlined which relates part-whole, organisational level and systemic metaphors in a single model. Examples are provided throughout the discussion and mainly come from computing. The potential for metaphorical transfers between these domains is considered. (shrink)

Metaphor influences the construction of biological models and theories and the analysis of its use can reveal important tools of thought. Some aspects of biological organisation are investigated through the analysis of metaphors associated with treating biosystems as a kind of text. In particular, the use of glue and verbs is considered. Some of the reasons why glue is important in the construction of hierarchies are pursued in the light of specific examples, and some of the conceptual links between glue (...) in biology and other domains is discussed. Verbs are shown to be important in the construction of networks. Some of the relations between glue, verb and text are considered and the text metaphor is placed within a much broader context of ideas associated with form, relation and system. The paper concludes with comments on the nature of biological information and the need for extending or better understanding the verbal vocabulary. (shrink)

Recent research on patient decision-making reveals a disconnect between theories of autonomy, agency, and decision-making and their practice in contemporary clinical encounters. This study examines these concepts in the context of female patients making oncofertility decisions in the United Kingdom in light of the phenomenon of “being guided.” Patients experience being guided as a way to cope with, understand, and defer difficult treatment decisions. Previous discussions condemn guided decision-making, but this research suggests that patients make an informed, autonomous decision to (...) be guided by doctors. Thus, bioethicists must consider the multifaceted ways that patients enact their autonomy in medical encounters. (shrink)

This article examines the extent to which the concept of social quality could contribute to a transformation in the debates about the welfare sustainability in Asia and Europe. The article starts by outlining the concept of social quality: its constitutional, conditional and normative components and the origins of its development as a European conceptual framework. Then a bridge is created between Europe and Asia by looking briefly at the similarities and differences between social quality and human security, a concept that (...) is more familiar in the latter region than the former one. is is followed by a critique of the global discourses on 'sustainability' and, in particular, their dominance by economism. The final part of the article utilizes the concept of social quality to propose a more open and balanced approach to sustainability that brings in social and ecological considerations alongside economic ones. Some tentative suggestions are made concerning the operationalisation of a social quality approach to welfare system sustainability. (shrink)

In 1964, the American Medical Association invited liberal theologian Abraham Joshua Heschel to address its annual meeting in a program entitled “The Patient as a Person” [1]. Unsurprisingly, in light of Heschel’s reputation for outspokenness, he launched a jeremiad against physicians, claiming: “The admiration for medical science is increasing, the respect for its practitioners is decreasing. The depreciation of the image of the doctor is bound to disseminate disenchantment and to affect the state of medicine itself” [1, p. 35]. Heschel’s (...) reference to “disenchantment” suggests that he may have been familiar with the work, or at least the outlook, of sociologist Max Weber, whose 1917 address “Science as a Vocation” portrays the modern world as disenchanted by the progress of rationalism. Heschel’s life’s vocation had been to uncover the inner meaning of religious faith and to translate that faith into principled action. Heschel saw disenchantment not as an inescapable aspect of modern life but rather as the byproduct of physicians’ conscious choices to seek worldly success and material comfort. Yet, because of their privileged position as witnesses to human vulnerability, physicians possess an obligation to develop their own personhood, to re-enchant medicine, and through medicine to spark a positive transformation in all of modern life. As Heschel says, “The doctor must realize the supreme nobility of his vocation, to cultivate a taste for the pleasures of the soul. … The doctor is a major source of moral energy affecting the spiritual texture and substance of the entire society” [1, pp. 34, 38]. While Heschel’s conception of the physician’s role is romanticized and idealized, changes in the organization and practice of medicine have validated his concerns. (shrink)
