Fontane Effi Briest by the German director Rainer Werner Fassbinder is arguably one of the greatest adaptations from literature to screen, and the best Effi Briest adaptation. Although the first reception of the movie, when it appeared in 1974, was not without unmixed reviews, most scholars nowadays share the conviction that it is a masterpiece. Elke Siegel defines the film as a success both at the Berlinale and at the box office. Kreft Wetzel, however, in an interview with Fassbinder in (...) 1974, refers to the ambivalent attitude of the critics abroad at the time of the movie‘s release, to which Fassbinder replies that Fontane‘s language is the foundation of the movie and, hence, the film works to its full extent only in German. Forty years after this interview and judging from the scholarly work carried out on Fassbinder in general and Fontane Effi Briest in particular, it is plausible to claim that Fassbinder‘s art has moved beyond the language barriers and appeals to an audience beyond the German culture and language. Through a critical engagement with Jeremy Waldron’s work, as well as the work of other writers, I offer an account of the relative scope of the morality of war, the laws of war, and war crimes. I propose an instrumentalist account of the laws of war, according to which the laws of war should help soldiers conform to the morality of war. The instrumentalist account supports Waldron’s conclusion that the laws of war justifiably prohibit attacks on civilians even if it (...) turns out that some civilians lack a moral right not to be killed. Importantly, the instrumentalist account also offers what Waldron thinks impossible: a non-consequentialist defense of the failure of the laws of war to prohibit the killing of nonthreatening combatants. Finally, I argue that new war crimes can be broader than the morality of war as well as established laws of war and that many of the arguments for defining war crimes more narrowly than either the morality of war or the laws of war are unconvincing. In all of these ways, I hope to carry forward Waldron’s project of exploring the relationship between law and morality in war. (shrink)

Brenda Almond throws down a timely challenge to liberal consensus about personal relationships. She maintains that the traditional family is fragmenting in Western societies, causing serious social problems. She urges that we reconsider our attitudes to sex and reproduction in order to strengthen our most important social institution, the family.

There is consensus that children have questionable decisional capacity and, therefore, in general a parent or a guardian must give permission to enroll a child in a research study. Moreover, freedom from duress and coercion, the cardinal rule in research involving adults, is even more important for children. This principle is embodied prominently in the Nuremberg Code (1947) and is embodied in various federal human research protection regulations. In a program named "SATURN" (Student Athletic Testing Using Random Notification), each school (...) in the Oregon public-school system may implement a mandatory drug-testing program for high school student athletes. A prospective study to identify drug use among student-athletes, SATURN is designed both to evaluate the influence of random drug testing and to validate the survey data through identification of individuals who do not report drug use. The enrollment of students in the drug-testing study is a requirement for playing a school sport. In addition to the coercive nature of this study design, there were ethically questionable practices in recruitment, informed consent, and confidentiality. This article concerns the question of whether research can be conducted with high school students in conjunction with a mandatory drug-testing program, while adhering to prevailing ethical standards regarding human-subjects research and specifically the participation of children in research. The philosophy of religion and theology are related to the culture in which they have developed. These disciplines provide a source of values and vision to the cultures of which they are part, while at the same time they are delimited and defined by their cultures. This book compares the ideas of two contemporary philosophers, John Hick and Seyyed Hossein Nasr, on the issues of religion, religions, the concept of the ultimate reality, and the notion of sacred knowledge. On a (...) broader level, it compares two world-views: the one formed by Western Christian culture, which is religious in intention but secular in essence; the other Islamic, formed through the assimilation of traditional wisdom, which is turned against the norms of secular culture and is thus religious both in intention and essence. The laws are not silent in war, but what should they say? What is the moral function of the law of armed conflict? Should the law protect civilians who do not fight but help those who do? Should the law protect soldiers who perform non-combat functions or who may be safely captured? How certain should a soldier be that an individual is a combatant rather than a civilian before using lethal force? What risks should soldiers take on themselves to avoid (...) harming civilians? When do inaccurate weapons become unlawfully indiscriminate? When does 'collateral damage' to civilians become unlawfully disproportionate? Should civilians lose their legal rights by serving, voluntarily or involuntarily, as human shields? Finally, when should killing civilians constitute a war crime? These are the questions that Law and Morality at War answers, contributing to a cutting-edge international debate. Drawing on the concepts and methods of contemporary moral and legal philosophy, the book develops a normative framework within which the laws of war and international criminal law can be evaluated, criticized, and reformed. While several philosophical works critically examine the moral status of civilians and combatants, this book fills a gap, offering both an account of the laws of war and war crimes, and proposing how the law could be improved from a moral point of view. : The thought of the Qurʾān consists of certain concepts. The concept of “fiṭrah” that expresses the physical and spiritual side of the people, is one of crucial concepts which stands for the conseption of the Qurʾān. Therefore this concept has become the one drawing attention of scholars from the earlies. Usually, the concept of “fiṭrah” is interpreted as the religion of Islam and the initial creation or the human potentiality of acception a religion and whether they can change or (...) not. In this context, it has been established a connection between the “word of khalqullah” in the Surah of Rūm and the same word in the Surah of Nisā. In this study, the essence of “fiṭrah” will be examined and the basic elements of “fiṭrah” will be focused on. Also, whether wisdom, affection, love, and ugliness are among the basic components of fiṭrah or not, will be discussed. In addition, whether there is any connection between the verse of “fiṭrah” and the words of “tabdīl” and “taġyīr” will be investigated. Summary: The Qur’ānic view of human has been set forth with certain concepts. According to our understanding, there is a strong relation between the Qurʾānic definition of human and the terms of tafsīr and ta’wīl. If the Qur’ānic view of human is put forth correctly, then the explanation and interpretation of the Qurʾān will also be more accurate. Therefore, we think that there is an important link between the characteristic of Qurʾānic view of human and the ta’wīl of naṣṣ. For this reason, we have based our study on the term, fiṭrah which explains the nature of human beings and the context of this term in the Qur’ān. In this regard we have tried to take into account in our comments the consistency through the mention of the term of fiṭrah that comes in the 30th verse of the surah al-Rūm with the relation to other verses. Main focus of the study is to see whether the essential aspects of human nature is in correlation with compassion, mental potentiality, power to produce, seeking for truth, wanting to do good and avoiding bad deeds. In the etymological dictionaries of Arabic language and in tafsir books the term of fiṭrah has been explained in various meanings such as “religion of Islam”, “unity of God”, “the first creation of human beings”, “mental capability”, “ability to accept the truth”, “initial agreement”, “pre-eternity of human destiny”, “inborn creed”, “tattoing”, “plucking females hairs” and “to geld animals”. The verse of “la tabdīla li khalqillāh” is explained that there should not be changed things and qualities which are parts of the nature of human being. The verse of "I am going to command humans and they are going to change God's creation" is associated with above mentioned fiṭrah verses. In this context neglecting to worship to Allah and taking means through other idols that are worshiped, sacrificing in the name of idols, replacing religious motives with other motives, denial of creed, making permissible acts impermissible or impermissible acts permissible, females plucking their hair, etc., have been interpreted as changing Allah’s creation. However, we do not think that the interpretation of nature that is mentioned in the verse regarding the replacement of Allah’s creation has no relation with the replacement of Allah’s creation which occurs in Surah al-Nisā. Because changing khalqullāh in al-Nisā is not to change fiṭrah which is accepted same as religion and there is no relation between two issues. The mention of nature along with the concept of religion comes to show the value of Islam is in accordance with human nature. Yet when the Qurʾān is interpreted in the correct manner, a better understanding of the human nature will be seen. The samples and types of i’rāb regarding the link between the terms of fiṭrah and dīn show that there is also a strong relation between religion and human nature. This shows that religion entails all the values and qualities that human nature contains. In the context of the Qurʾān, the term of fiṭrah consists of spiritual qualities, such as reflection, love, desire to find the truth, inclination to good deeds, avoiding bad deeds, creativity and worship rather than physiological qualities such as the desire to eat and drink, need of shelter and sexuality. These are core foundations of human nature which cannot be changed. However, these natural qualities can be lead the opposite direction. This is the reason why there is frequent mention of natures spiritual qualities in the Qurʾān. However, if the Qurʾān and the Sunnah are falsely interpreted, the core qualities of nature will be understood incorrectly which may not be a prototypical that the Qurʾān aims. The Qurʾān frequently makes mention and condemns those that do not use their logic, which comes to show the importance of nature. In order for the other nature qualities to be functional, first the logic must be functional. Likewise, since early ages people try to understand the objects in their environment and start to question them is again natures manifestation. The past and today's philosophical movements, scientific research and as a result the information and findings derived from them is a result of human nature. One of the main components of nature is the belief of the unity of God and acknowledging that the creator is Allah therefore comprehending that He is only worthy of worship. Thus, this belief provides the mental and emotional integrity of person. In times of difficulty, through the natural instinct people show towards the Creator is an act of the reaction shown which is coursed by natural creed properties. It should be said that another important natural human quality is love and affection. As the Qurʾān has expressed that human being is created from "alaq" also comes to the meaning of compassion. It is the human’s natural instinct to incline to those that he has compassion for. Once this inclination is made stronger the compassion turns into love. Desiring good or evil is also part of human nature as these two opponents are in men’s structure. Men being virtuous comes from choosing the good. Another important feature of human nature is desiring those that are aesthetically beautiful and disliking those that are aesthetically ugly. Men does not only desire those that are aesthetically beautiful but rather those that are spiritually attractive such as knowledge, modesty and bravery. It dislikes ignorance, lies and other bad qualities. Qurʾān’s phonetic structure can be counted as a proof to this. One of human’s natural instinct is to create and constantly update information. The word "khalq” is used commonly to bring anything to existence when it was absent totally, therefore this is used for mankind as a metaphor. As a result, it is possible to say that the most important human instinct qualities are reason, the ability of accepting of the unity of God, compassion, human and divine love, creativity, evoking good deeds, avoiding evil, valuing those that are ecstatically nice and avoiding those that are ugly. The different meanings and definitions of fiṭrah in tafsīr books and dictionaries such as dīn, pre-eternity of human destiny, initial agreement, and to geld animals are not the essential aspects of fiṭrah but the manifestations of the basic elements. First, two aspects of the partiality issue are identified: (1) Is it right/reasonable for professionals to favour their clients interests over either those of other individuals or those of society in general? (2) Are special non-universalisable obligations attached to certain professional roles?Second, some comments are made on the notions of partiality and reasonableness. On partiality, the assumption that only two positions are possible – a detached universalism or a partialist egoism – is challenged and it is suggested that partiality, e.g. (...) to family members, lies between these two positions, being neither a form of egoism, nor of impersonal detachment. On reasonableness, it is pointed out that reasonable is an ambiguous concept, eliding the notions of the morally right and the rational. (shrink)

Most of the literature on phase one trials has focused on ethical and safety issues in research on patients with advanced cancer, but this article focuses on healthy, adult subjects. The article makes six specific recommendations for protecting the rights and welfare of healthy subjects in phase one trials: 1) because phase one trials are short in duaration (usually 1 to 3 months), researchers should gather more data on the short-term and long-term risks of participation in phase one studies by (...) healthy subjects; 2) researchers should develop strict inclusion/exclusion criteria that exclude unhealthy or vulnerable subjects, such as decisionally impaired people, in phase one studies; 3) subjects should not participate in more than one phase one study at the same time and should wait at least 30 days between participating in different studies; 4) researchers should develop a database to keep track of phase one participants; 5) subjects should be guaranteed a minimum wage equivalent to the equivalent type of unskilled labor, but there should be no upper limits on wages; and 6) subjects should be allowed to engage in collective bargaining with research sponsors. *Disclaimer: The ideas and opinions expressed in this article are the authors' personal views and do not represent the views of the National Institute of Environmental Health Sciences, the National Institutes of Health, or the United States government. Jensen’s inequality is one of the fundamental inequalities which has several applications in almost every field of science. In 2003, Mercer gave a variant of Jensen’s inequality which is known as Jensen–Mercer’s inequality. The purpose of this article is to propose new bounds for Csiszár and related divergences by means of Jensen–Mercer’s inequality. Also, we investigate several new bounds for Zipf–Mandelbrot entropy. The idea of this article may further stimulate research on information theory with the help of Jensen–Mercer’s inequality.

This article examines the question of the existence of non-Adamic persons-both terrestrial and extra-terrestrial-in early modern Europe. More particularly it looks at how the existence of non-Adamites seriously called into question the credibility of the central themes of the Christian story of the creation, fall and redemption in Jesus Christ in early modern Europe. It analyses the impact on the Christian view of history caused by the discovery of the inhabitants of the New World, speculations about the polygenetic origins of (...) the human race, and discussions about the plurality of worlds. It concludes with some reflections on the monogenetic and polygenetic accounts of the origin of humans in a post-Darwinian context. (shrink)

Discussing the origins of the malevolent being who at different times was cursed as Belial, Nero (...) or Damien, the author reveals how Christianity in both East and West has imagined this incarnation of absolute evil destined to appear at the end of time. For the better part of the last two thousand years, Almond suggests, the human battle between right and wrong has been envisaged as a mighty cosmic duel between good and its opposite, culminating in an epic final showdown between Christ and his deadly arch-nemesis. ABSTRACT Conventions on human rights give priority to parents in education but modern states tend to make uniform provision, tending towards a monopoly position. Education itself is not incompatible with liberty but is a condition of it. A three-sided conflict exists, however, between the state, parents and professionals as to who should represent the interests of children. Liberty is best preserved if the conflict is resolved in favour of parents, for only parental decision-making guarantees educational variety and change. Veba, kızamık, sıtma, kolera, İspanyol gribi gibi salgın hastalıklar Osmanlı’yı her açıdan etkilemiş ve dönemin konjonktürüne göre çeşitli alanlarda çeşitli tedbirler alınmıştır. Bu çalışmada özellikle son dönemin seçilme sebebi, hem daha fazla salgın tespitinin yapılmış olması hem de bu dönem kayıtlarının fazla olmasıdır. 1800’lerden sonra Osmanlı’da belirli sebeplerle belirli süreçler ve sonuçlarıyla farklı salgınlar yaşanmıştır. Bunlardan bir kısmı mikro düzeyde bazıları ise makro düzeyde etkilemiştir devleti. Salgınlardan en çok etkilenen kesim şüphesiz çocuklar olmuştur, özellikle eğitim çağındaki çocukların hem hastalıktan etkilenme (...) süreci hızlanmış hem de en çabuk müdahale grubu olmuştur. Osmanlı salgınlarda eğitim ile ilgili ayrı tedbirler almıştır. Okulları, öğretmenleri, öğrencileri, kaldıkları yerleri ve ebeveynleri de zaman zaman içine alan bu önlem çabaları, devleti kurumsal anlamda etkilemiştir. Arşiv belgelerine baktığımızda, okulların tatil edilmeleri, aşılama politikaları, dezenfekte çalışmalarının yaygınlaştırılması, öğrencilerde ve ebeveynlerinde bu konuda bilinç oluşturma, bu konular için ayrı ödenekler ayarlanması, öğretmenlerin bu konuda maddi manevi desteklenmesi gibi hususlar salgın ve eğitim tedbirleri konusunda en çok dile getirilen meseleler olmuştur. Çoğunlukla Osmanlı ve Cumhuriyet arşiv belgeleri ve dönemin kroniklerine dayanarak, doküman analizi yöntemi ile hazırlayacağımız bu çalışma, dönemin salgınları karşısında eğitimin aksamaması için devletin aldığı tedbirleri ortaya çıkarmayı hedeflemektedir. This volume is a lively, wide-ranging introduction to ethics. It provides accessible coverage of the main ethical theories which offer the basis for an exploration of key issues and recent developments in applied ethics. The author's approach differs from other recent introductions, eschewing the utilitarian approach in favor of a rights and virtue ethics alternative.

Tolerance is not neutrality, nor should tolerance in counselling be equated with a spiritual and emotional vacuum. Tolerance applies to style rather than stance, and a counsellor needs a conception of the ideal — broadly speaking, a moral position. Originally proclaimed against religious and political tyranny, the political ideal of tolerance has in the twentieth century become confused with permissiveness, and is thus sometimes charged with generating many of the ills of modern society, including crime and family breakdown. Counselling has (...) become the universal remedy, replacing punishment and compulsion. The counsellor needs (a) a view of human nature (b) a conception of what is good for those possessing that nature. Constants in the first mean there cannot be too much variation in the second. Society is varied and plural, so the counsellor must be non‐judgemental, but while this means accepting the person, it does not necessarily mean endorsing the conduct. A distinction is drawn between therapeutic and philosophical counselling; the latter considers a problem, where the former focusses on the client, but both may fall short of offering a holistic view. Counselling may also exacerbate some of the problems of modern life by too readily accepting the conditions which cause them. Some ethical problems raised by confidentiality and informed consent are discussed. It is concluded that the counsellor must be tolerant, but not morally ambivalent, nor a relativist. (shrink)

Onun yaklaşımının temelinde sosyal ve tarihsel bir fenomen olarak din ile insanın doğasında yer alan dinselliğe dayalı öznel dindarlık ayrımı yer almaktadır. Simmel’a göre "belirli bir manevi nitelik" veya "ruhun tutumu" olarak insan doğasında yer alan dindarlık, insanın dünyaya bir bütün olarak bakmasına ve dinin kültürel bir ürün olarak oluşmasına imkân tanımaktadır. Dini insan etkileşimleri ile temellendirmeye çalışan Simmel, insanın birçok ilişkisinin özünün dinî karakterde (...) olduğunu savunmuştur. Türkçe literatürde Simmel’ın din teorisine ve din sosyolojine katkısına dair bir makale dışında bütünlüklü bir çalışma bulunmamaktadır. In lieu of an abstract, here is a brief excerpt of the content:Experimenting with Islam:Nietzschean Reflections on Bowles’s AraplainaIan AlmondIn a letter to his friend Köselitz dated March 13 1881, Nietzsche wrote: "Ask my old comrade Gersdorff whether he'd like to go with me to Tunisia for one or two years.... I want to live for a while amongst Muslims, in the places moreover where their faith is at its most devout; this way my eye and judgement for all things (...) European will be sharpened."1 Various motifs in the work of Paul Bowles—a fascination with cruelty, an obsession with destruction, a predilection for abysses (metaphorical and literal) in the landscapes of his stories—invite some kind of reference to Nietzsche, however brief. Nietzsche's desire to live in the most intense pocket of Islam he could find had, one suspects, less to do with Islam than with his desire for a "trans-European eye"2 —four years after his remarks on Tunisia, Nietzsche would say the same thing about Japan in a letter to his sister.3 Nietzsche's proposed trip to Tunisia would lead to a better understanding of Europe, not Islam, and would provide him with an outside perspective on the European disease of modernity—a different set of lenses for his Kantian spectacles. This conception of Islam was, therefore, a means to self-knowledge, a handy instrument for diagnosing one's own illness, and a useful mirror to observe with greater clarity the more unattractive elements in one's own features. Most of Nietzsche's references to Islam and Islamic culture—and there are well over a hundred and fifty of them in the Gesamtausgabe—become clearer when one keeps this functional, almost anthropological, approach to the Islamic Other in mind.Although there is nothing new about this idea of the Orient as a tool of European self-awareness—as early as the 1780s, Sir William Jones was [End Page 309] already hoping the study of Sanskrit and Arabic would offer a "more extensive insight into the human [read "European"] mind"4 —an awareness of the genealogy of such Western interest in Arabs and Mohammedaner certainly helps us better understand Bowles's own eerie fascination with the faith. The parodies of missionaries, academics, and policemen which we find in stories such as "The Time of Friendship" and "A Distant Episode" confirm the distance Bowles attempted to put between his own texts and those Orientalist traditions of both Christian (i.e., Islam as a pool of potential believers) and Imperialist (Muslims as potential human resources) provenance. In attempting to escape such vocabularies and textual traditions, Bowles ultimately replicates and reshapes their original representations, producing an irony of delicate complexities, which is the object of this article.Near the beginning of Bowles's witty, though somewhat caustic autobiography Without Stopping, a moment takes place that gives an insight into the way, in later years, the narrator would approach different cultures with the intention of constructing new worlds. At age five, Bowles relates how he often found himself alone in his parents large upstate New York house. Abandoned to his own devices, the young narrator began to entertain himself by fabricating and mapping out new countries with his own imagination: "Soon I invented a planet with landmasses and seas. The continents were Ferncowland, Lanton, Zaganokworld and Araplaina. I drew maps of each and gave them mountain ranges, rivers, cities and railways."5 The image is captivating not only for its visual appeal, of a five-year-old Bowles, future author of Sheltering Sky, sitting on the carpet, crayoning out his map of Araplaina. It also suggests the presence, very early on, of what will always be a central motivation in Bowles's fascination with the world of Islam: a desire for novelty, for the really new, as an escape from boredom. Bowles's Tangiers would later provide the very Araplaina he had been seeking all along.In the world of Bowles's North African short stories, a number of common features seem to unite the otherwise disparate collection of tales found in The Time of Friendship and The Delicate Prey. Older adults were considered a vulnerable group for the COVID-19 infection and its consequences, including problems with sleep.AimTo evaluate the prevalence of sleep disorders in older adults, to describe their sleep patterns, as well as to analyse if there were any changes in comparison with the period pre-pandemic.Materials and MethodsOnline survey used for data collection received answers from 914 elderly age range 65–90 years, from April to August 2020. Results: 71% of the sample reported a pre-existent sleep disorder, and some (...) of them worsened during the pandemic, especially Insomnia in women and Obstructive Sleep Apnea in men. No difference in sleep duration before and during the pandemic was found, although there was a worsening of some aspects related to sleep, such as sleep quality, sleep efficiency, awakening quality, sleep latency and nocturnal awakenings, especially in the female gender. Educational level influenced sleep latency, indicating higher sleep latency among those with primary education when compared with the ones with Ph.D.ConclusionThe pandemic had influenced sleep patterns among the elderly, as well as worsening of pre-existent sleep disorders. Female gender and low educational level were considered risk factors for sleep alterations, and high educational level, on its turn, appeared to be a protective factor. (shrink)
