If laws and rights were to be understood cumulatively, as anamount of quantitative data, branches and specialties, we wouldnot have understood it properly. The understanding of law thatthe legal theory provides, is not reached until the law is seen asa complex whole, avoiding any kind of arbitrary simplifications.This comprehension of the law accepts it as plural and diverse,while unitary and organic. However, these plurality and diversitycan only be adequately appreciated in its true measure from itsunity and socio-historical organization.--.

Though it is held that some models in science have explanatory value, there is no conclusive agreement on what provides them with this value. One common view is that models have explanatory value vis-à-vis some target systems because they are developed using an abstraction process. Though I think this is correct, I believe it is not the whole picture. In this paper, I argue that, in addition to the well-known process of abstraction understood as an omission of features or information, (...) there is also a family of abstraction processes that involve aggregation of features or information and that these processes play an important role in endowing the models they are used to build with explanatory value. After offering a taxonomy of abstraction processes involving aggregation, I show by considering in detail several models drawn from different sciences that the abstraction processes involving aggregation that are used to build these models are responsible for their having explanatory value. This paper proposes an application of Enrique Dussel’s ethics of liberation to an issue of crucial importance to US minorities: the debate on affirmative action. Over the past fifty years, this debate has been framed in terms of the opposition between advocates of affirmative action who claim that it is needed in order to achieve the integration and participation of traditionally oppressed groups to society without which there is no equality of rights, and critics who argue that affirmative action violates (...) equality by enforcing a double standard that undermines the ideal of a color-blind society. In this paper, I show how the basic principles of Dussel’s ethical theory (which are best expounded in his book Ethics of Liberation) allow us to address what I take to be the main demands of both advocates and critics of affirmative action in a satisfactory way. This article examines the exchange between Montoro and Sor Juana about the nature of jealousy and its connection with romantic love. First, it shows that, while Montoro's position echoes Augustine's view of love, Sor Juana's position has strong parallels with views held in the courtly love tradition. Second, the article considers Sor Juana's responses to Montoro, which aim to establish that jealousy is not inherently wrong (as Montoro holds) and that it cannot be severed from love. Finally, the article shows (...) that Sor Juana's insights provide support for those who defend the importance of jealousy in human life. (shrink)

Van Fraassen has presented in Scientific Representation an attractive notion of measurement as an important part of the empiricist structuralism that he endorses. However, he has been criticized on the grounds that both his notion of measurement and his empiricist structuralism force him to do the very thing he objects to in other philosophical projects—to endorse a controversial metaphysics. This paper proposes a defense of van Fraassen by arguing that his project is indeed a ‘metaphysical’ project, but one which is (...) very similar to Strawson’s ‘descriptive metaphysics’; if this is the case, van Fraassen’s project may be taken, following recent suggestions made by Ney and Paul, as a form of metaphysics that can potentially make a crucial contribution to scientific inquiry. In this paper, I examine the humanism articulated by Jean-Paul Sartre in Existentialism is a humanism and I show that his proposal is underpinned by some problematic assumptions and biases that shape its deployment. I also argue that the Mexican philosopher Emilio Uranga offers us in his most important work, Analísis del Ser del Mexicano, some conceptual resources that allow us to articulate a humanism that does not fall prey to the problems faced by that of Sartre.

The present paper argues that the Venezuelan-Chilean philosopher Andrés Bello constitutes an important but heretofore neglected prefiguration of Richard Rorty. I argue for this thesis by articulating first an Inter-American philosophical narrative (based on previous work by Alex Stehn and Carlos Sanchez) that enables me to highlight certain common characteristics in philosophical projects that flourished across the Americas. Having done this, I show that Rorty’s anti-representationalism and anti-foundationalism are prefigured in Bello’s most important philosophical treatise, Filosofía del Entendimiento, to the (...) extent that Bello recognizes the problems posed by the ocular metaphors that are systematically used by Early modern philosophers such as Descartes or Locke, and suggests their elimination and replacement by other metaphors. Finally, I conclude that, if my arguments are correct, the intellectual geography of neo-pragmatism needs to be expanded beyond traditional geographies such as Europe and the US. (shrink)

Latin American and Latinx philosophers have a long and rich history of deep engagement in public life through a variety of different projects and venues. This chapter offers a brief survey of the historical development and practice of philosophy in public life in Latin American and Latinx traditions. Because of their unique histories, it engages public philosophy in Mexico and Argentina separately. The chapter shows that a guiding thread in Argentinian public philosophy is a deep‐rooted concern about the threats created (...) by political and intellectual authoritarianism and strategies for pushing back against this oppression by developing emancipatory practices and democratic alternatives. This work runs through a long line of Argentinian philosophers from José Ingenieros and Alejandro Korn to María Lugones and Diana Maffía. Public philosophy is clearly a vibrant and ongoing enterprise in contemporary Mexico. Argentina also possesses a long and rich tradition of public philosophy. (shrink)

In a recent paper, Ladyman (2011) has argued that the empirical stance, which has been championed by Van Fraassen (2002), and the materialist stance are compatible with each other –a thesis which is important for Ladyman since it paves the way for the project of developing a ‘radically naturalized metaphysics’ that he has defended along with Ross (2007). Though Ladyman puts forth a compelling case for the thesis that the two stances are compatible, I find his argument for the thesis (...) to be problematic. In this paper, I argue, pace Ladyman, that the two stances cannot be reconciled since there is an inconsistency between the epistemic requirements needed to adopt both stances. (shrink)

Contrasting two models of deliberative democratic multiculturalism, one by Seyla Benhabib and another by Luis Villoro, this paper contends that the differences between these two models outweigh the similarities, and that Villoro’s model is more promising insofar as it preserves the trust required in the institutions that mediate democratic deliberation in multicultural societies.

We consider the problem of mixing in the f 0(980)–a 0(980) system when width effects are taken into account. By explicit calculation we show that two mixing angles are necessary to describe the phenomenon.

In recent decades, philosophers of science have devoted considerable efforts to understand what models represent. One popular position is that models represent fictional situations. Another position states that, though models often involve fictional elements, they represent real objects or scenarios. Though these two positions may seem to be incompatible, I believe it is possible to reconcile them. Using a threefold distinction between different signs proposed by Peirce, I develop an argument based on a proposal recently made by Kralemann and Lattman (...) (in Synthese 190:3397–3420, 2013) that shows that the two aforementioned positions can be reconciled by distinguishing different ways in which a model representation can be used. In particular, on the basis of Peirce’s distinction between icons, indices and symbols, I argue that models can sometimes function as icons, sometimes as indexes and sometimes as symbols, depending on the context in which they are considered and the use that they are developed for because they all have iconic, indexical and symbolic features. In addition, I show that conceiving models as signs enables us to develop an account of scientific representation that meets the main desiderata that Shech (in Synthese 192:3463–3485, 2015) presents. This essay discusses Jorge Portilla’s phenomenological analysis of values and freedom in his essay, “The Phenomenology of Relajo.” Portilla argues that genuine freedom requires seriousness and sincerity; it requires wholehearted participation in cultural practices that one finds truly valuable. To support his argument, Portilla examines the ways that values and freedom are undermined when cultural practices are disrupted and break down as a result of the antics of the so-called "relajiento," a kind of “class clown” figure in Mexican culture who (...) refuses to take anything seriously. Carlos Sánchez has criticized Portilla's rejection of the relajiento, suggesting that the relajiento’s disruptive behavior may be a liberatory act of defiance against the legacy of colonialism. I argue, however, that Portilla was right to see the relajiento’s behavior as counterproductive in the fight for liberation from oppression. (shrink)

Pathological tremor is a common but highly complex movement disorder, affecting ~5% of population older than 65 years. Different methodologies have been proposed for its quantification. Nevertheless, the discrimination between Parkinson’s disease tremor and essential tremor remains a daunting clinical challenge, greatly impacting patient treatment and basic research. Here, we propose and compare several movement-based and electromyography-based tremor quantification metrics. For the latter, we identified individual motor unit discharge patterns from high-density surface electromyograms and characterized the neural drive to a (...) single muscle and how it relates to other affected muscles in 27 Parkinson’s disease and 27 essential tremor patients. We also computed several metrics from the literature. The most discriminative metrics were the symmetry of the neural drive to muscles, motor unit synchronization, and the mean log power of the tremor harmonics in movement recordings. Noteworthily, the first two most discriminative metrics were proposed in this study. We then used decision tree modelling to find the most discriminative combinations of individual metrics, which increased the accuracy of tremor type discrimination to 94%. In summary, the proposed neural drive-based metrics were the most accurate at discriminating and characterizing the two most common pathological tremor types. (shrink)

Unpleasant emotions can be strongly “propulsive,” spurring us to make changes to our situation, perspective, values, and commitments. These changes are often positive, even crucial to our pursuit of the good life. But under what conditions are unpleasant emotions strongly propulsive? I argue that the source of affective propulsion should not be located in the mere unpleasantness of a given emotion, but, rather, in the emotional context in which the emotion arises. Drawing on Martin Heidegger’s comparative analysis of “shallow” and (...) “deep” boredom, I claim that the propulsive quality of an emotion arises not from its intrinsic properties but from the ambivalence generated when two affective states simultaneously influence our sense-making activity in opposing ways. The author asks whether there was a “scientific ‘68”, and focuses on aspects of two specific methodological proposals defined in the 1940s and 50s by the terms “action research” and “mixing methods”, applied particularly to social sciences. In the first, the climate surrounding the events of 1968 contributed to heightening the participative element to be found –by definition– in “action research”; that is: the importance of making the research subjects themselves participants in the design, execution and application of the study (...) of which they are the focus. This approach captured the democratic and anti-authoritarian spirit at the heart of the proposal, which was part of the prevailing climate in those days. The repercussions of 1968 on “mixing methods” focused on studying what had actually occurred, especially between the youth and workers, and therefore, particularly from the point of view of sociology and social psychology, using a “mixed methods” approach. The author explores the proposal of Norman Denzin; but traces the recent origins of both “mixing methods” and “action research” back to the proposals of mainly Kurt Lewin and the Chicago School. Studies have shown that a person can consciously believe that they value racial equality and desire not to perpetuate racial stigmas, but unwittingly exhibit racist attitudes and beliefs. In order to explain this discrepancy between conscious beliefs and behavior, scholars have turned their attention to unconscious racial prejudice. One approach that is gaining wide acceptance is the Implicit Bias Model, which appeals to distinct implicit and explicit cognitive processes, coupled with an account of the ways in which people unconsciously internalize (...) widespread stereotypes and stigmas. This article claims that although the Implicit Bias Model is in many respects useful, it leaves out a central aspect of unconscious racial prejudice: the underlying motivations and incentives for harboring racist attitudes and beliefs, which generate psychological resistances to knowing about or changing prejudices. A more complete account of unconscious racial prejudice can be developed by turning to theories of active ignorance, which contribute to what this article calls the Resistance Model. (shrink)

This paper describes the introduction of a new electronic identity card including an electronic identity (EID) for local physical and online authentication in 2006. The most significant difference to any European country is the decentralized issuing at 256 police stations employing an automatic printing machine. This is the most visible element in a high degree continuation, as the previous paper based ID cards were also personalized and issued at the police stations. Similarly the attributes defining the identity and the legal (...) framework were not changed either. While there was some delay in the planning phase, the role-out of the new eID cards was rather smooth. At the end of 2009, approx. 13 Mio Spanish citizens out of more than 46.5 Mio inhabitants (www.ine.es) were in possession of an eID card. But this does not necessarily mean that they are using the eID function for online authentication. The reasons for this application gap will be discussed with reference to online tax declaration, where the eID so far covers less than one percent of all online declarations while authentication by software certificates still make up for 98 percent. El objetivo del artículo es operacionalizar teóricamente la complementariedad significativa, de tres niveles de significación social (representaciones sociales, imaginarios y mitologías), a través de la construcción discursiva en la prensa alternativa digital chilena. A nivel metodológico, se aplica el análisis de contenido cualitativo, analizando dos notas de prensa pertenecientes a El Desconcierto y El Mostrador, haciendo alusión a la temática de la Marcha más Grande de Chile acaecida durante el Estallido Social de 2019. En términos de hallazgos y conclusiones se (...) evidencia a nivel teórico y operativo la estrecha dialéctica y complementariedad entre las tres nociones teóricas de significación mencionadas. It now seems technically feasible to culture human embryos beyond the “fourteen‐day limit,” which has the potential to increase scientific understanding of human development and perhaps improve infertility treatments. The fourteen‐day limit was adopted as a compromise but subsequently has been considered an ethical line. Does it remain relevant in light of technological advances permitting embryo maturation beyond it? Should it be changed and, if so, how and why? What justifications would be necessary to expand the limit, particularly given that (...) doing so would violate some people's moral commitments regarding human embryos? Robust stakeholder engagement preceded adoption of the fourteen‐day limit and should arguably be part of efforts to reassess it. Such engagement could also consider the need for enhanced oversight of human embryo research. In the meantime, developing and implementing reliable oversight systems should help foster high‐quality research and public confidence in it. (shrink)

Este artículo examina cuestiones y desarrollos de la Crítica de la Economía Política de Marx que permiten abordar las relaciones de género en el capitalismo. Para ello, se analizan la especificidad de la dominación capitalista, los límites de la crítica de Marx para abordar cuestiones de género y su potencial desarrollo a partir de la relación entre la reproducción de la fuerza de trabajo y de la totalidad social. Siguiendo esta línea, se exponen críticamente los desarrollos de la crítica de (...) Marx que han llevado a cabo el colectivo Endnotes y R. Scholz para analizar la relación interna entre género y capital. Estas propuestas plantean la existencia de un otro del valor vinculado material y simbólicamente a las categorías «mujer» y «feminidad». Se trata, en última instancia, de pensar la especificidad de la opresión de género en el capitalismo y la forma que adopta en la actualidad. (shrink)

The goal of this paper is to argue that the Neptuno Alegórico and the Theatro de Virtudes Políticas, which were composed in 1680 by the Novohispanic philosophers Sor Juana Inés de la Cruz and Carlos de Sigüenza y Góngora to accompany respectively two arches erected to celebrate the entry of the Spanish viceroy to Mexico City, are notable not only as examples of panegyrical Baroque literature but also as philosophical texts aimed at moral instruction. To be specific, I argue that (...) the Neptuno and the Theatro belong to a hybrid genre that I label ekphrastic moral mirrors. Ekphrastic moral mirrors, which constitute a subset of the traditional speculum principis, are characterized by offering moral instruction to a prince indirectly, by means of an elaborate ekphrasis of a work of art (which, in the case of the Neptuno and the Theatro, were the two arches that they were paired with). I also argue that, insofar as the Neptuno and the Theatro create different audiences that are mutually aware of each other in virtue of systematically relying on ekphrasis deployed in a public setting, they are potentially more effective for moral instruction than other traditional mirrors of princes. Desde el Homo sacer: el poder soberano y la nuda vida y luego en Medios sin fin. Notas sobre la política, Agamben expone, apelando a la antigua Grecia, la dificultad original —si se quiere— del hecho de que esta civilización no disponía de un término único para expresar lo que nosotros queremos decir con la palabra vida. Y esta palabra está hondamente ligada a sacerización, dado que cuando esta se expresa, aquella se desvanece o, mejor, desaparece en su acepción más (...) mínima. La sacerización es el fin de la vida, en la nuda vida. Dice nuestro autor que los términos que usaban los griegos eran semántica y morfológicamente distintos: zoé expresaba el simple hecho —continúa Agamben— de vivir que es común a todos los vivientes, mientras que bíos significaba la forma o manera de vivir propia de un individuo o de un grupo. Esta oposición desapareció gradualmente en las lenguas modernas sin dejar viva ninguna diferencia sustancial. Nos preguntamos por la expresión forma de vida entendiendo, sin desprendernos de Agamben, que esta se refiere al hecho de que una vida que no puede separarse nunca de su forma es una vida en la que nunca es posible aislar algo como una nuda vida. Entonces planteamos que, una vez reducida la vida a una nuda vida en la sacerización, la democracia queda en manos del latrocinio político y la corrupción, lo cual provoca paulatinamente su declive en tanto expresión popular originaria. Although previous treatments of affective injustice have identified some particular types of affective injustice, the general concept of affective injustice remains unclear. This article proposes a novel articulation of this general concept, according to which affective injustice is defined as a state in which individuals or groups are deprived of “affective goods” which are owed to them. On this basis, I sketch an approach to the philosophical investigation of affective injustice that begins by establishing which affective goods are fundamental, and (...) then considers which subsidiary goods—such as freedoms, resources, opportunities, and forms of recognition—may be necessary for the provision of those fundamental affective goods. Drawing from and developing ideas in the extant literature, I argue that two such fundamental affective goods include subjective well-being and emotional aptness. I then show that by analyzing deprivations of the subsidiary goods that enable a person to pursue and attain subjective well-being and emotional aptness, it is possible to shed new light on the cases of affective injustice that have been described in the extant literature, while also identifying other kinds of cases that have not been theorized to the same extent. The processes of globalization, embraced with such eagerness in the 1990s, started being reviewed a decade later, having revealed a vicious underside. Behind the diverse masks of globalization hide murderous identities that promise different types of violence. During Brexit, the referendum in June 2016 that was to decide whether the United Kingdom left the European Union or stayed in it, Britain rejected what the EU represents—a common identity—to pursue a road on its own—a separate identity.1 Significantly, one of the elements (...) that analysts regarded as central to Brexit was immigration. Though Indigenous women in Mexico have traditionally exhibited some of the highest levels of maternal mortality in the country—a fact that some authors have argued was an important reason to explain the EZLN uprising in 1994—there is some evidence that the rate of maternal mortality has fallen in Zapatista communities in the Chiapas Highlands in the last two decades, and that other health indicators have improved. In this article, we offer an account of the modest success that Zapatista communities have (...) achieved in improving their health levels. In particular, we argue that Zapatista women have implicitly used a form of feminist standpoint theory to diagnose the epistemic injustice to which they have been traditionally subjected and to develop an epistemology of resistance that is manifested in actions such as becoming health promoters in their communities. We also argue that this epistemology of resistance is partially responsible for the improvement of health levels in their communities. Finally, on the basis of our discussion of the Zapatista case, we suggest that standpoint theory could play an important role in other healthcare settings involving oppressed minorities. (shrink)

The aim of our research is to analyze how different religions influence business ethics. We develop an index of practices in the field of business ethics, made up of 19 items containing practices related to workers, consumers, products, human rights, management of ethical conflicts, and crime prevention. Also, we consider a wide range of religion affiliations. To undertake this research, we use a panel data sample composed of 11,956 firm‐year observations from 18 countries. Drawing on stakeholder theory, we posit some (...) hypotheses based on the religions considered. The results obtained show that a higher percentage of religious adherents in the country where a company does business usually involve the implementation of more ethical practices in the corporate field. These findings are obtained for Christian, Islamic, Jewish, and Hindu religions. In contrast, this does not stand for Buddhist and folk religions. Also, countries where there is no predominant religion do not show a confluence between religion and ethical corporate practices. (shrink)

In this chapter, I argue that the insurrectionist ethics initially articulated by Leonard Harris, and further developed by other scholars such as Lee McBride III, Jacoby Carter, and Kristie Dotson, can fruitfully be deployed to understand how resistance movements and liberatory struggles have been framed in Mexico by some prominent intellectuals. To be more precise, I argue that one can read the historical work México a través de los siglos. El Virreinato from the nineteenth century Mexican historian and novelist Vicente (...) Riva Palacio as articulating a form of insurrectionist ethics adapted to the Mexican context to the extent that it exemplifies the core features that Harris identifies in insurrectionist ethics. Una explosión tan violenta y sangrienta como la producida en los primeros meses de la guerra civil o una manifestación tan radical de rechazo del significado eclesial como el que encontramos en parte de nuestra sociedad actual no resulta explicable si no volvemos nuestra mirada a la historia, repasamos algunos hitos fundamentales de los dos últimos siglos y reflexionamos sobre sus posibles causas.

Desde los inicios de la humanidad hasta finales de la Edad Media, la imagen del universo reflejaba una visión teológica, para girar en torno al hombre en el siglo XVI. Con la llegada de la revolución industrial, de la concepción cíclica del tiempo propugnada por el Humanismo se pasa a la idea moderna de progreso. Por último, se produce la evolución de la sociedad disciplinaria organizada en torno a la fábrica como lugar cerrado y en la que el individuo sabe (...) quien ostenta el poder, hasta la sociedad de control en la era tecnológica actual deslocalizada en empresas con individuos que tienen acceso a la información hasta cierto nivel. El hombre se sitúa en el panóptico y sabe que está siendo observado, convertido en una forma de entretenimiento voyeurístico y exhibicionista. La perversión del mundo informatizado en el que el optimismo ante la posibilidad de verlo todo, se contrapone al control de la información y a la vigilancia permanente. Esta deshumanización afecta también al terreno plástico, que pretende dar soluciones a través de un arte participativo con nuevos planteamientos, estéticas y soportes. Mixing methods is a well-known innovative meth- odologic proposal for research in the second half of the 20th century social sciences. Reading literature about it, I observed the aspect that justifies this paper: Authors of theoretical contributions on mixing methods recognized that this was known to be a practice already in use many centuries ago. Some of them even have re-examined the whole history of the scientific method to search precedents. They are however individual and theoretical precedents. I add in (...) this paper the practical projection of these and other methodological theories on people’s training from Greek classical times. My hypothesis is that liberal arts was the basic syllabus in Western -and westernized- educaion for more than a millennium in such a way that results of their training precisely involved to mixing methods. In return, to understand the liberal arts in the light of mixing methods shows new aspects of their historical interest. I study the theoretical basis of this syllabus from Cicero to Alcuin. More important for future research, I conclude that Alcuin’s thesis about the correspondence between the gifts of the Holy Spiritu and the seven liberal arts can be extended to the Aristotelian dianoethics habits and to Dilthey’s 20th-century sciences of mind.
