İlk dönem İslâm fırkalarından biri olan İbâziyye, Türkiye’de İslâm mezhepleri tarihi başta olmak üzere kelâm, hadis, tefsir, fıkıh gibi bilim dalları kapsamında incelenmiş ve önemli akademik araştırmalara konu olmuştur. Cumhuriyet döneminde İbâziyye fırkasına dair yapılan akademik araştırmalar bilhassa yirmi birinci yüzyılda hızlı bir artış göstermiştir. Bu çalışmada İslâm mezhepleri tarihi alanı başta olmak üzere İslâmî ilimlerde İbâzîlik üzerine yazılan kitap, lisansüstü tez, makale ve bildirilerin bir bibliyografyası hazırlanmış ve Cumhuriyet döneminde İbâziyye araştırmalarının tarihi seyri incelenmiştir. (...) İslâm mezhepleri tarihi bilim dalında İbâzîlik üzerine yapılan çalışmalarda iki temel yaklaşımın benimsendiği görülmüştür. Birinci yaklaşıma göre, Sünnî bakış açısıyla geleneksel mezhepler tarihi kaynakları esas alınarak, İbâziyye Hâricîlerin devamı olarak kabul edilmiştir. Bununla birlikte İbâzîlerin bu konudaki itirazları göz ardı edilmiştir. İkinci yaklaşıma göre ise, Sünnî kaynakların yanında İbâzî kaynaklar da esas alınarak fırka anlaşılmaya çalışılmıştır. Burada müellifler İbâziyye’yi kendi kaynakları üzerinden tanımlayarak, Hâriciyye’den bağımsız bir mezhep olarak değerlendirmişlerdir. İbâziyye’nin Hâricî düşünce yapısından farklılaşan yaklaşımları nedeniyle onlardan ayrılarak, günümüze kadar ulaşmayı başardığını vurgulamışlardır. Mezheplere ilişkin yapılan araştırmalarda objektif veriler ortaya koymak için kaynakların karşılaştırmalı olarak ele alınması gerekmektedir. Aksi hâlde yapılan çalışmalar, doğru verileri yansıtmak yerine sonuçları bilimsellikten uzak, tek taraflı bakış açısının ürünü olarak kalmaktadır. Bu sebeple fırkalar incelenirken, kendi kaynaklarındaki tanımlamalarına da yer verilmelidir. Ancak İbâziyye fırkasına ilişkin kaynakların birçoğunun günümüze kadar ulaşmamış olması yahut siyasî, itikadî, fıkhî görüşlerinin yeterince tanınmamış olması gibi nedenler; İbâziyye’nin gerçekte olandan farklı bir zeminde, yanlış bilgiler üzerinden tanınmasına sebebiyet vermiştir. Bunun yanı sıra mezheplerin, teşekkül sürecinin ardından sistematik hâle gelmesine kadar ki dönemde dinamik yapıda olmaları da göz ardı edilmemesi gereken bir diğer husustur. Bu bağlamda araştırmacılar İbâziyye mezhebinin ortaya çıkışından sistematikleşmesine değin oluşturduğu kendine has görüşleri açıklığa kavuştururken, birincil kaynaklar üzerinden mukayeseli okumalar yaparak, bütüncül olarak analiz etmeleri gerekmektedir. Çalışmamızda Cumhuriyetin ilk yıllarından günümüze kadar İbâzîlik üzerine yapılan araştırmaların bir bibliyografyasını sunduk ve yukarıda belirtilen yaklaşım biçimlerini analiz ettik. Bu kapsamda İslâmî ilimler literatüründe İbâziyye fırkasına ilişkin veriler sunan araştırmacıların konuya dair yaklaşımlarını literatür taraması sonucunda tespit ederek kronolojik olarak sıraladık. Araştırmamız neticesinde, İbâzîlerin kendi kaynaklarını temel alan özgün akademik çalışmaların uzun süre sınırlı kaldığı ve sayıca az olduğu ancak son yıllarda bu alandaki araştırmaların belirgin bir artış gösterdiği sonucuna ulaştık. Bu araştırmaların ivme kazanmasına yönelik çözüm önerilerinde bulunarak İbâziyye ile ilgili çalışmaların daha ileri bir noktaya taşınmasının gerekliliğini ortaya koyduk. (shrink)

Çocuk evliliği, tarih boyunca farklı toplumlarda bilinen ve uygulanan sosyal bir olgu olsa da son zamanlarda, modern duyarlılıkları giderek daha fazla rahatsız eden bir hal almıştır. Son iki asır öncesine kadar, Avrupa hukuki düşüncesinde çocuklar yargı önünde farklı bir muamele görmelerine imkan veren istisnai bir statüye sahip değildi. Diğer taraftan, İslam hukukunun çocuklara, özel bir hukuki statü kazandırma konusunda bazı öncü adımlar attığını söyleyebiliriz. Nitekim, en eski İslam hukuku kitaplarının bile, insanın fiziksel ve zihinsel gelişim aşamalarına ve her bir aşamada (...) ortaya çıkan hukuki hükümlere dair son derece teknik ayrıntılarla dolu olduğunu görebiliriz. Ancak çocuk hakları konusundaki bu erken farkındalığa rağmen, çocuk evliliği olgusu hem İslam toplumlarında hem de İslam hukukunda kendini gösterebilmiştir. Çünkü, İslam çocuk hukuku, ilk ortaya çıktığı dönemin kültürel şartlarından ciddi şekilde etkilenmiştir. Üstelik bu kültürel şartlar, İslam dünyası boyunca İslam çocuk hukukunun temel zemini olma işlevini sürdüre gelmiştir. Bu çalışma, alimlerin çocuk evliliğini delillendirmek üzere yapageldikleri bazı aşırı yorumları ortaya koymaya ve konuyla ilgili âyetleri metinsel bağlamıyla daha uyumlu bir şekilde okumaya çalışmaktadır.Özet: Her bağlam için geçerli olabilecek, standart bir çocuk tanımı yapmak göründüğünden daha güçtür. Bu nedenle çocuk araştırmaları sahasında çalışan akademisyenlerin, muhtelif sosyal disiplinler tarafından yapılacak herhangi bir çocuk tarifi konusunda memnuniyetsizlik içinde olması doğaldır. Diğer yandan, İslam hukukunda baştan beri ayrıntılı bir çocuk hukuku teorisi mevcuttur. İslam hukuk düşüncesinde, insanlar doğum ile yetişkinlik arasındaki gelişim döneminde üç aşamadan geçerler: Çocukluk (küçüklük), buluğ ve rüşt. Bütün fıkıh mezhepleri, insanın doğumu ile ergenliği arasındaki dönemde küçük çocuk sayılacağı kanaatindedirler. Bu çocukların mallarının en iyi şekilde idare edilebilmesi için yasal temsilcileri bulunmak zorundadır. Fakîhler çocuğun velisinin, özellikle de baba veya baba tarafından dedenin, velâyeti altındaki küçük çocuklar üzerinde mücbir bir yetkisi olduğu (velâyet-i mücbire) konusunda geniş bir fikir birliğine sahiptirler. Buna göre veliler, velâyetleri altında bulunan çocukları uygun gördükleri kişilerle evlendirme yetkisine de sahiptirler. Fakat zaman zaman beşik kertmesi olarak da anılan bu uygulama bir ön sözleşmeden ibarettir. Yani bu sözleşme doğrudan doğruya fiziksel boyutları da olan müşterek bir evlilik hayatını meşru kılmamaktadır. Çünkü cinsel hayatın ancak buluğdan sonra gerçekleşmesi ön görülmektedir. Modernite öncesi İslam tarihi boyunca, İbn Şubrume (ö. 144/761), Ebû Bekr el-Esamm (ö. 200/816) ve Osman el-Bettî (ö. 143/760) gibi bir kaç fakih dışında küçük çocukların evlenmesine kategorik olarak karşı çıkan kimselere pek rast gelinmemektedir.Hanefi mezhebinde, herhangi bir zihinsel özrü olmaksızın buluğa eren erkek ve kız çocuklar evlilik konusunda mücbir velâyetin kapsamı dışına çıkarlar. Bu, evlilik sözleşmelerini bizzat gerçekleştirebilecekleri anlamına gelmektedir. Fakat veli, uygunsuz bulduğu evliliğe karşı dava açarak bunu yargı yoluyla geçersiz kılma yoluna gidebilir. Diğer üç Sunnî mezhep ise erkek ve kız çocuklar arasında bir ayrım yapar: Buluğa eren erkek kendi evlilik akdini yapabilme hakkını elde ederken aynı durumdaki kız çocuklar velâyet altında kalmaya devam ederler. Şâfiʿî mezhebine göre, velâyeti gerekli kılan illet (bekaret) hâlâ geçerliliğini korumaktadır. Dolayısıyla veli, kızları evlendirme konusundaki icbâri yetkisini elinde tutmaya devam etmektedir. Bu durumda kızın rızasının alınması, akdin geçerliliği için şart olmaktan ziyade sadece nezaket gereğidir. Rüşte ulaşmak veya fizyolojik olgunlaşma sürecini tamamlamak ise İslam hukukunda evlilik için şart görülmemiştir.Modern zamanlara kadar geleneksel İslam hukukunun erken evlilik lehinde gösterdiği bu yaklaşımda herhangi bir değişiklik olmamıştır. 1917 yılında çıkan Hukuk-ı Aile Kararnamesi daha önce benzeri görülmemiş bir dizi düzenleme getirmiştir: İlk olarak, evlilik yaşı erkek için on sekiz kız için ise on yedi olarak belirlenmiştir. On sekiz yaşın altındaki erkeklerin hakimden evlenme izni alması; on yedi yaşından küçük kızların ise hem veli onayı hem de hakim iznine sahip olması zorunlu hale getirilmiştir. On iki yaşın altındaki erkekler ile dokuz yaşından küçük kızların ise asla evlendirilemeyeceği kararlaştırılmıştır.Mantıkî bağlam ve sentaktik yapı elverişli olmamasına rağmen fakihler çocuk evliliğini desteklemek üzere bazı Kur’ân âyetlerine (Nisâ 4/3-6, Nisâ 4/127, Talâk 65/4) referansta bulunmuşlardır. Makale içeriğinde detaylı şekilde açıklandığı üzere zorlama yorumlamalarda bulunmuşlardır. Bu makale, söz konusu âyetlere daha tutarlı bir yorum getirmeye çalışmaktadır. Aynı şekilde, Kur’an’ın çocuk evliliğini kolaylaştırıcı bir tavır içerisinde olmadığını, çocukların evlendirilebilmesi yönündeki yaklaşımların tarihsel ve kültürel şartlara bağlı olarak yapılan bazı zorlama yorumlara dayandığını ileri sürmektedir.Hz. ʿÂişe’nin Hz. Peygamber ile oldukça erken bir yaşta evlendiğine dair nakledilen rivâyet de konuyla ilgili olarak ileri sürülen başka bir argümandır. Bu rivâyetin sahih olduğuna inanılmaktadır. Buna rağmen ilginç bir şekilde bu rivâyet çok az fakih tarafından kullanılmıştır. Bunun sebebi, fakîhlerin Hz. Peygamberin mahremiyetinden bahsetmek istememeleri olabilir. Rivâyetin hücciyeti konusuna kuşkuya kapılmış olmaları da mümkündür. Söz konusu rivâyete daha yakından bakıldığında, ifadedeki menfi üslup hemen dikkat çekmektedir. Çünkü rivâyette Hz. ʿÂişe, Hz. Peygamberle evlendiği günü anlatırken sürekli olarak fizyolojik ve psikolojik açıdan olumsuz koşullardan bahsetmektedir. Nitekim Hz. ʿÂişe birden bire oynamakta olduğu salıncaktan alınmakta ve kendisinin de bilmediği bir yere doğru götürülmektedir. Rivâyet, sadece çocuk evliliğinin cevazını ortaya koymakla yetinmemekte, sanki aynı zamanda çocukların uygunsuz koşullardaki evlilik taleplerine bile itaatkar olmaları gerektiğini salık vermektedir. İçerik yanında teknik olarak bakıldığında bu rivâyet, haber-i vâhiddir. Çünkü rivâyet, sadece Hz. ʿÂişe tarafından bilinebilecek detayları içermektedir. Tarihî açıdan bir öneme sahip olmasına rağmen dinî hükümlere kanıt olma niteliğinden yoksundur. Çünkü bu rivâyette, râvi konuyla ilgili Hz. Peygamber’e ait resmi bir açıklamayı nakletmemekte; sadece kendi zaviyesinden maruz kaldığı bir durumdan bahsetmektedir. (shrink)

Öz: Bu çalışmama İslam’da bireyin kamuya karşı sorumluluk alanı ile bağlantılı bir ilkesini; “Emr-i bi’l- Ma’ruf ve Nehyi Ani’l-Münker”i İslam İnanç Ekolleri içerisinde nasıl algılandığını ve nasıl uygulandığını ele alacaktır. Bundaki amacım birey- kamu ilişkisinde, bireyin özgürlük alanlarının ihmal edildiği yönündeki varsayımımdır. Bu girişten sonra, çalışmada İslam inanç ekollerinin konuya ilişkin yaklaşımları ve bu yaklaşımlarına kaynak teşkil eden metinlere yer verilecektir. Çalışmamızda ekollerin kronolojik tarihlerini göz önünde bulunduran bir sıralama takip edeceğiz. Bundaki amacımız özellikle “Emr-i bi’l- Ma’ruf ve Nehyi Ani’l- (...) Münker” ilkesinin ekollerde ele alınışının erken dönem İslam Siyasal Tarihi ile önemli oranda bir ilişkisi olduğu anlayışımız sebebiyledir. İslam siyaset kuramının birlikte yaşam, özgürlük ve adalet iddia ve idealleri çerçevesinde konuya İslam teolojik mezhepleri yakın ilgi göstermişlerdir. Ekollerin “Emr-i bi’l-Ma’ruf ve Nehyi Ani’l-Münker” ilkesine yoğun ilgilerine karşın, farklı yaklaşımlar gösterdikleri de söylenebilir. İslam geleneği içerisinde bu kurucu ilke birey özgürlüğü ve kamu düzeni arasındaki gerilimler nedeniyle politik yorumları da beraberinde getirmiştir. “Haricî” ekoller her bir Müslüman için gereken bir sorumluluk olarak yorumlamış ve “ayn-i vacib” olduğunu dile getirmişlerdir. Diğer ekoller ise bu ilkeyi ” kifa-i bir vucûb” olarak kabul etmişlerdir. Diğer yandan Mu’tezile ekolü bu ilkeyi usulu’l-hamse’ den biri olarak kabul etmiştir. In the history of Islamic thought, it is prominent to examine the sects according to certain facts. In this research, it is aimed to read the development of the sect through aqāid works by taking the aqāid texts into the center. By centering Ash'ariyyah, we determine the aqāid literature of this sect in general terms and center two Ash‛ari aqāid works. These two aqāid texts that we have examined are the works identified with the Seljuk and Ottoman madrasahs. Al-Juwaynī’s al-Aqīda (...) an-Nizamiyyāh and al-Ījī’s al-Aqāid al-adudiyya hare extremely valuable identity texts in terms of Ash‛arī aqāid tradition. As a product of the Seljuk world of thought, al-Juwaynī’s work deals with aqāid issues with much broader titles and explanations. Al-Juwaynī lists his criticisms by targeting Mu‛tazila on most issues. Al-Ījī’s al-Aqāid al-adudiyya is one of the basic books of Ottoman madrasahs. In al-Ījī’s work, on the other hand, plain narration and a concise aqāid presentation attract attention. When we look at the work, it draws attention that the audience has changed and the opposition to the Mu‛tazilite is not too dominant. In addition, while a political interpretation over the imamate/caliphate issue is included in the creed in al-Ījī’s text, virtuousness, which is the perception of the Sunni companions, is also emphasized. The aqāid works of al-Juwaynī and al-Ījī bear the traces of the historical development of Ash‛arism, depending on their addressees, the period in which they were written, and many other reasons. There is a close relationship between Ashʿarism and Ḥanbalism since the emergence of Ashʿarism. However, they often conflicted with each other as they approached to religious matters from different perspectives. These conflicts were not only limited to theological discussions but also turned into social conflicts, which occasionally resulted with deaths. First massive events occurred in 429/1038 in Baghdād between Ashʿarites and Ḥanbalities. When Niẓām al-Mulk was appointed as vizier, the conflicts reached a peak. The apparent reason of the conflicts was (...) the theological controversy between these two sects. However, the rise of Ashʿarism, which was usually against Ḥanbalism, was the main reason of the social conflicts. Supports of the Ashʿarite thought by the leading statesmen of the era such as Niẓām al-Mulk and Ayyūbid sultans, and accusations of some Ashʿarite preachers about Ḥanbalities relying on this political support were also among the factors that led to these conflicts. Nevertheless, even if any accusation was not made, it occurred that the members of both sects resorted to violence in case of criticisms about their beliefs. This shows that the most important reason of the conflicts was sectarian fanaticism.Summary: Ashʿarism is the name of the sect that was formed around the ideas of Abū al-Ḥasan al-Ashʿarī. It is a continuation of Kullābism in terms of general thought system. Ashʿarism replaced Kullābism by the end of the 5th century of the Hijrah, and started to be called as an independent sect. It spread mostly among the Shāfiʿites and Mālikites in Iraq, Khurāsān, Damascus, Maghreb, and Yemen. When it was arrived to the last quarter of the 5th century, it became the common theological sect of most of Shāfiʿites and Mālikites. Bāqillānī (d. 403/1013), Ibn Fūrāk (d. 406/1015), and Abū Isḥāq al-Isfarāyīnī’s (d. 418/1027) efforts played an important role in rising of Ashʿarism in this period. In the following periods, contribution of the Seljuk vizier Niẓām al-Mulk (d. 485/1092) to Ashʿarism was massive by establishing the Niẓāmiyah Colleges to strengthen the Ashʿarites against the Hanafites in Khurāsān and against the Ḥanbalites in Baghdād. The Niẓāmiyah Colleges were donated by Niẓām al-Mulk to Shāfiʿite scholars for the mission of primarily limiting the influence Shīʿī thought. The condition of belonging to Shāfiʿites in waqfiyyah (endowment certificate) of the colleges provided some important advantages for Shāfiʿites and Ashʿarites. On the other hand, the Ayyūbids provided important contributions to Ashʿarites in the regions of Egypt, Damascus and Yemen. They worked for strengthening Ashʿarism during their ruling for two centuries. It was a state policy for the Ayyūbids to support Ashʿarism starting from the founder of the state, Ṣalāḥ al-Dīn al-Ayyūbī (d. 589/1193).This rapid rise of Ashʿarism led to a tense relationship between the Ashʿarites and the Ḥanbalites who became the most important representative of Aṣḥāb al-ḥadīth (people of the traditions of the Prophet) after the period of Miḥnah (period of religious persecution). Undoubtedly, the first respondents of these tense relations were Kullābite scholars. At the beginning of the 4th century of the Hijrah, Abū al-Ḥasan al-Ashʿarī became the natural inheritor of the Ḥanbalite reaction to the Kullābites. He conflicted with the Ḥanbalites because of his different approach on the debate regarding creation of the Qur’ān. Ḥanbalite reactions to Imam al-Ashʿarī continued after his death. When he died in Baghdād in 324/935, officials buried him secretly as they worried about Ḥanbalite attacks against his funeral. Hence, after his burial some Ḥanbalites tried to destroy his tomb several times. After Ashʿarī died, the first social events between the Ashʿarites and the Ḥanbalites took place in Iṣfahān, one of the most important cities of West Khurāsān, in the end of the 4th century of the Hijrah. The debate started around the question of whether the letters of the Qur’ān were created or uncreated between the Ḥanbalite scholar Ibn Mandah (d. 395/1005) and Ashʿarite scholar Abū Nuʿaym al-Iṣfahānī (d. 430/1038). This debate led to prolonged events between the supporters of these scholars. Abū Nuʿaym, saved his life from various attacks and finally he had to leave Iṣfahān.The tense relationships between the Ashʿarites and the Ḥanbalites reached the peak in the 5th century of the Hijrah. Many events occurred in Baghdād during this century. The discussion on interpretation of the revealed attributes of Allah turned into conflict between the two sides from time to time. The Ashʿarite scholars accused the Ḥanbalites with tashbih (affirming Allah’s similarity to humanity) and tajseem (anthropomorphism) by pointing at Abū Yaʿlā al-Farrā’s work titled Ibṭāl al-taʾwīl al-ṣifāt. The ʿAbbāsid caliphs generally supported the Ḥanbalites in this debate. For example, when al-Qāim bi-Amr Allāh re-published the famous declaration known as the Qādirī Creed in 433/1042, he proclaimed that rejection of the Ḥanbalite approach on the issue of the revealed attributes of Allah would be regarded as a cause of blasphemy. The paper was read in a meeting where several scholars from various sects were present. It was signed firstly by Ashʿarite scholar Abū al-Ḥasan ʿAli ibn ʿUmar al-Qazwīnī (d. 442/1051). However, he was one who had criticized Ibṭāl al-taʾwīl al-ṣifāt in 429/1038, which caused conflicts in society at that time. This shift in his position is remarkable as it shows that the declaration was primarily response to him.In the middle of the 5th century of the Hijrah, Ashʿarite scholar al-Khatīb al-Baghdādī (d. 463/1071) became a victim of the tension between the Ashʿarites and Ḥanbalites. Khatīb had protection of vizier Ibn al-Muslima and under his protection he lectured on Hadith in the Mansur Mosque. However, after the death of the vizier, he was subjected to harassment of the Ḥanbalites because of some expressions in his work titled Tarīkh Baghdād. So much so that he began to worry about his life, thus he had to leave Baghdād and went to Damascus in 451/1059.The tense relations between the Ashʿarites and the Ḥanbalites reached the summit in the period of Niẓām al-Mulk who was the vizier of Seljuk Empire. In fact, some events resulted with deaths. For example, in the events of 469/1076, which lasted years, the Ḥanbalites attacked Ashʿarite scholar Abū Naṣr ibn ʿAbd al-Karīm al-Qushayrī (d. 514/1120) who accused them with tashbeeh and tajseem. As a result, around twenty people died during these events. The gradual rise of the Ashʿarite thought with the support of Niẓām al-Mulk and abusive discourses of some Ashʿarite scholars who relied on this support can be mentioned among the basic reasons of the events at that time.After the death of Niẓām al-Mulk in 485/1092, for a long time there was no serious event between the Ashʿarites and the Ḥanbalites. In the middle of the 6th/12th century, the relations started to become tense again in the regions of Egypt, Damascus, and Yemen under the Ayyūbid dynasty. In addition to these places, various events occurred in Khurāsān region, in cities such as Marw. Nevertheless, unlike some previous events, the current tensions were not against a whole sect but only targeted some individual scholars. Moreover, unlike the previous periods, oppressed and victimized people were mostly Ḥanbalite scholars this time. No serious events took place between two sects after this period. Therefore, it can be said that their struggle to dominate society led to the above-mentioned events. (shrink)

İslam’ın selef nesline dayalı bir biçimde anlaşılması ve yaşanması ülküsünü güden Selefîlik, ortaya çıkışının ardından araştırma ve tartışmalara konu edinilerek birbirinden farklı anlama ve yorumlama çabalarına maruz bırakılmıştır. Bu doğrultuda Selefîliğin selef olgusuyla yani sahâbe, tâbiîn ve tebe-i tâbiîn ile ilişkisi; ehl-i hadis, Hanbelîlik, Ehl-i Sünnet, Vehhâbîlik, ıslahat hareketleri, radikal akımlar hatta Haricîlikle benzer ve farklı yönleri analiz edilmiştir. Ayrıca (...) Selefîliğin Ahmed b. Hanbel, İbn Teymiyye ve Muhammed b. Abdilvehhâb ile bağlantısı; tarihlendirilmesi, tanımlanması ve tasnif edilmesi, bu anlama ve yorumlama çabalarının mihverini oluşturmuştur. Her ne şekilde olursa olsun Selefîlik, özellikle içerisinde bulunduğumuz asırda araştırmacıların dikkatini çekmiş ve son dönemlerde ortaya çıkan dinî-siyasî akımlardan belirgin bir şekilde ayrılacak düzeyde yoğun analizlere tabi tutulmuştur. Ülkemize ek olarak dünyanın büyük bir kısmında Selefîlikle ilgili yayın faaliyetlerinin artarak devam ediyor olması, bu durumun en önemli göstergesidir. Böylece Suûd yarımadasında ortaya çıkarak başta İslam ülkeleri olmak üzere dünyanın büyük bir kısmında yayılım gösteren Selefîlik, her bölgede aynı etki düzeyine sahip olmasa da ilgi açısından başta Türkiye olmak üzere birçok ülkenin dikkatini çekmiştir. Bu durumun neticesinde Selefîlik, son yılların önemli tartışma konularından biri konumunda bulunmakta ve oldukça farklı mecralarda araştırma konusu olarak varlığını sürdürmektedir. Çoğunlukla makale veya tebliğ konusu şeklinde ele alınan Selefîlik, tez ve kitap çalışmalarında da kendisine yer bulmaktadır. Son yılların yazın faaliyetine bakıldığında Selefîlik konusunu ele alan sempozyumların ve özel sayıların da yayımlandığı görülür. Diğer yayın türlerine nazaran Selefîlik konusunu ele alan özel sayıların konuyu daha derli toplu ve konsantre bir şekilde etüt ettiği belirtilmelidir. Özel sayılar, Selefîlik olgusunun belirli ve daha dar bir alanda ayrıca mukayeseli bir biçimde ele alınmasını sağlamaktadır. Bize bu imkânı sağlayan yayınlardan biri de İstanbul Müftülüğü’nün hakemli resmî yayın organı olan Din ve Hayat Dergisinin Selefîlik özel sayısıdır. Derginin 2023 yılının Temmuz ayında yayımlanan 47. sayısı, Selefîlik konusuna hasredilmiştir. Bu sayıda farklı uzmanlık alanlarına sahip 19 akademisyen tarafından Selefîlikle ilgili muhtelif konuları içeren makaleler kaleme alınmıştır. Özel sayı olması nedeniyle kendine özgü hususiyetleri barındıran bu yayın faaliyeti, Selefîlik olgusunun farklı yönleriyle analizi açısından önem taşımaktadır. Bu nedenle makalemizde Din ve Hayat Dergisi Selefîlik özel sayısında yer alan makaleler, inceleme konusu yapılmıştır. Böylece bu özel sayı üzerinden Türk ilahiyat akademyasının Selefîlik birikim ve anlayışının günümüzde geldiği nokta, imkânlar dâhilinde ortaya koyulmaya çalışılmıştır. Bu amaçla makalemizde Selefîlik olgusunun ilgili metinler üzerinden etraflı ve karşılaştırmalı analizine odaklanılmıştır. İlgili analiz faaliyetinin gerçekçi sonuçlara ulaşması adına Selefîlik araştırmalarının en sorunlu yönleri olan tanımlama, tarihlendirme, ilişkilendirme ve konumlandırma gibi hususlar ön planda tutulmuştur. Böylece hem Selefîlik araştırmalarının önümüze çıkardığı sorun alanlarına dikkat çekilmiş hem de bu sorunlara dönük bazı çözüm önerilerinde bulunulmuştur. Tüm bu girişimlerin oldukça yakın bir zamanda kaleme alınan metinler üzerinden gerçekleştirilmiş olması ayrıca önemlidir. Nitel araştırma yaklaşımına dayalı olarak yürüttüğümüz çalışmamızda doküman analizi yöntemi benimsenmiştir. Söz konusu doküman analizi, metinler üzerinde derinleşme ve mukayeseli kaynak kritiği şeklindeki usûl ilkeleriyle somutlaştırılmıştır. İlgili metinlerin kapsamlı ve mukayeseli analizi neticesinde Selefîlikle ilgili araştırmalarda görülen bazı sorunların günümüzde devam ettiği ve bu sorunların tanımlama, tarihlendirme ve ilişkilendirme gibi hususlar etrafında şekillendiği tespit edilmiştir. Qadianism is a sect that emerged in India at the end of the 19th century, within the framework of the ideas of Mirza Ghulam Ahmad. Ghulam Ahmad emerged with Messianic claims such as Mujaddid, Mahdi, Messiah and Nabi. The period when Ghulam Ahmad declared himself the savior coincided with the 18th century when there was great despair and disappointment in the society due to the British plans to invade India. Ghulam Ahmad said that jihad will be realized not by sword (...) but by peace. He claimed that he was commissioned by God for this. Resulting from these claims of Ghulam Ahmad, Qadianism has been declared a "non-Islamic" sect in the Islamic world. For this reason, they had to go to other countries from India to some Balkan countries. Qadianis were first encountered in the Balkans in 1929. They carried out activities in many areas such as many social organizations, book translations, humanitarian aid and education in the Balkans. The Qur'an was translated into Albanian by Qādiyani Muhammad Zakaria Khan in 1990 within the framework of the views of the Qādianī sect. This was a turning point for them. Khan has become an important figure of the Qadiyani sect with this translation of the Qur'an in the Balkans. In this study, we discussed the verses that Khan interpreted in terms of Mahdism and Messianism of the Qadiyani sect. He tries to prove that Ghulam Ahmad is the Mahdi and the messiah in the aforementioned verses. As a method, Qadiyani sources and classical Islamic books that give information about this subject were used. (shrink)

Şiî halk dindarlığının en güçlü unsuru Muharrem ayında icra edilen matem merasimleridir. Muharrem matemi ve benzeri dinî merasimler Şiî Müslümanlara İmam Hüseyin başta olmak üzere On İki İmam’la olan bağlarını tazeleme ve toplumsal hafızalarını canlı tutma imkânı vermektedir. Bireysel dindarlığın önemli bir bileşenini oluşturan bu merasimler aynı zamanda kapsamlı bir toplumsal ve siyasî muhtevaya sahiptir. Bunun günümüz İran’ındaki en önemli örneği, merasimleri icra etmek için bir araya gelmiş insanlardan müteşekkil dinî heyetlerdir. Fütüvvet geleneğinin etkilerinin görüldüğü dinî heyetler, modern dönemde İran (...) toplumunun ürettiği özgün bir fenomendir. Heyetlerin düzenlediği dinî meclislerde farklı ekonomik ve sosyal sınıflara ait kimseler ortak bir platformda buluşmakta, böylece dayanışma ve yardımlaşma ağı inşa etmektedir. Heyetler, sivil ve gayri resmî olmaları sebebiyle hareket kabiliyeti yüksek ve dinamik yapılardır. Bu dinamiklik İran İslâm Devrimi ve sonrasında da İran-Irak savaşında kilit bir rol oynamalarını sağlamıştır. Toplumsal şartlar değiştikçe heyetler de değişime uğramış, bu durum yönetimin heyetleri kontrol altına almak istemesine sebep olmuştur. Bu çalışma heyetlerin tarihsel ve dinî kökenlerini, yapısını, işlevlerini ve siyasetle ilişkisini konu edinerek, halk dindarlığının toplumsal ve siyasal etki gücünü ortaya koymaktadır. (shrink)

In the Taḥkīm case, when it was realized that two people would arbi-trate despite the call made to the Ḳurʼān, the Khāridjites started to argue that God's judgment was not applied. The Khāridjites, who demanded the implementation of the judgement from Ali due to their subordina-tion/obedience, subsequently broke away when they were unable to achieve their desired outcome and formed a separate group. The Khāridjites deemed it acceptible to eliminate those who held opposing beliefs on the path they set out (...) to make Allah's judgment. The Khāridji group called al-Azāriḳa, which was born in 64/683 as a result of a schism, designated their own territory as dār al-Islām and all other regions as dār al-ḥarb and slaughtered those in dār al-ḥarb regardless of their identity. The objective of this study is to examine the influence of the dār al-ḥarb on the actions of the Khāridjites against Muslims. The persistence of the mentality, which spread fear and terror among Muslims in the early period, has not disappeared and continues to the present day. This makes the studies on the subject signifi-cant. The present study is confined to the examples of Muḥakkima al-ūlā and al-Azāriḳa within the context of what isti‘rāḍ is, how it is applied, and its relationship with the dār al-ḥarb. The study concludes that the Khāridjites with a propensity to kill initially sought to ascertain whether individuals were opposed to the Taḥkīm. Those who did not express such opposition were subjected to death. After the establishment of al-Azāriḳa, they designated all territories apart from their own as dār al-ḥarb and were not hesitant to kill those who remained in these regions. (shrink)

İngiltere’deki azınlık topluluklar arasında en fazla nüfusa sahip olan Müslüman toplumun kendi içinde mezhebi unsurların etkin olduğu bir gerçekliktir. Son çeyrek yüzyılda özellikle küresel çapta adından sıklıkla bahsettiren Selefilik hareketinin İngiltere’de yaşayan Müslümanlar üzerine etki ettiği bilinmektedir. Temel hedefleri arasında inanç ve ibadetler açısından standart bir Müslüman yapısı oluşturmak isteyen Selefilik hareketi, özellikle İngiltere’de dünyaya gelmiş genç Müslümanları hedef kitlesi olarak görmekte ve onları kendi saflarına dâhil etmek için bir gayret sarf etmektedir. Diğer taraftan karşısında geleneksel din anlayışını korumak isteyen (...) Barelvî ve Deobandî gibi Hint-alt kıtası kökenli Sûfî eğilimli akımlar da Selefilik akımının karşısına çıkıp onların radikal olarak adlandırılabilecek anlayış ve uygulamalarını eleştirmektedir. Hz. Peygamberin vefatıyla birlikte, hilâfet tartışması başta olmak üzere ashap birçok problemle karşı karşıya kalmış, sorunlar çözülmüş gibi görünse de bu dönem, sonradan ortaya çıkacak olan mezhep ve fırkaların oluşum sürecini tetiklemiştir. Hilâfetin ilk otuz yılında yaşanan olumsuz hadiselere, Emevî devletinin kurucusu Muâviye (ö. 60/680)’nin izlediği siyaset anlayışından kaynaklanan bazı olumsuzluklar da eklenince ümmet arasında fırkalaşma dönemi başlamıştır. Önce bazı Emevî sonra da bazı Abbasî halifelerinin yanlış uygulamalarına şahit olan Ebû Hanîfe (ö. 150/767), çözüm odaklı görüşleriyle ümmetin bu ihtilaf dönemine (...) damga vurmuştur. O, aklî bilgiyi önceleyen ve nassların açıklanmasında kullanan düşünürlerin başında gelmektedir. Onun itikadî eserleriyle İslâm düşüncesine kazandırdığı yenilikçi yaklaşım özellikle de akaide dair ilk metin kabul edilen el-Âlim ve’l-müte‘allim’deki görüşleri, eleştiri oklarının kendisine yönelmesine sebep olmuş, onu hadis taraftarlarının galiz ithamlarının hedefi yapmıştır. Ehl-i Rey’in lideri ve Mürcie’nin iman akîdesinin destekçisi olmasının da bu eleştirilerde payı büyük olmuştur. Ayrıca onu kendilerinden sayan Mu‘tezile’ye eleştiriler yöneltmesi; Mu‘tezile mensuplarınca onun herhangi bir itikadî eseri olmadığı iddialarını dillendirmesine sebep olmuştur. Diğer taraftan Zehebî, el-Âlim ve’l-müte‘allim’in Ebû Hanîfe’ye değil, Ebû Mukātil es-Semerkāndî’ye nispet edildiğini söylemiştir. Bu görüş F. Kern, J. Schacht, W. Madelung ve U. Rudolph gibi bazı müsteşrikler tarafından kabul görmüş ve Ebû Hanîfe’ye nispet edilen itikad eserlerinin otantik olup olmadığı tartışmalarını beraberinde getirmiştir. Özellikle Schacht tarafından bazı varsayımlar yapılarak, el-Âlim ve’l-müte‘allim’in Ebû Hanîfe’ye aidiyeti reddedilmiştir. Hatta Schacht bu eseri ilk dönemin Mürcie kaynaklarından biri kabul ederek, Ebû Hanîfe’ye ait olmayışının en büyük delili saymıştır. Ancak Âlimlerin çoğunluğuna göre el-Âlim ve’l-müte‘allim ve kendisine nispet edilen diğer eserlerindeki itikadî görüşler Ebû Hanîfe’ye aittir. Bu kanaatin oluşmasında etkili olan en büyük faktör, Hanefî-Mâtürîdî ekolünün mimarlarından olan Mâtürîdî (ö. 333/944) olmuştur. O, el-Âlim ve’l-müte‘allim’in râvilerinden birisi olduğu gibi, Te’vîlât’ında bu eseri Ebû Hanîfe’ye nispet etmiş ve eserden nakillerde bulunmuştur. Onun Kitâbü’t-Tevhîd’deki büyük günahlara dair görüşleri de el-Âlim ve’l-müte‘allim’de bu konuda yer verilen görüşlere benzemektedir. Bu araştırmada; el-Âlim ve’l-müte‘allim’in rivayet zincirinde bulunan ve eserin Semerkant’ta yayılışına katkı sunan âlimler hakkında kısaca bilgiler verilmiştir. Eserin içeriğini oluşturan itikadî münakaşalardan; imanın mahiyeti, iman-amel ayrılığı, imanda eşitlik, din-şeriat ayrımı, büyük günah ve ircâ meseleleri o günün güncel konularıdır. Bu başlıklar üzerinden, eserin Mâtürîdî üzerindeki önemli izleri de tespit edilmeye çalışılmıştır. Hanefî-Mâtürîdî düşüncenin itikadî nüvesini teşkil eden bu eserin, günümüze kadar geçirdiği sürecin değerlendirilerek kaynak kritiğinin yapılmış olması, araştırmayı benzerlerinden ayırmaktadır. Although there are fundamental differences between Ahl al-Sunnah and Shī‘a on the issue of Mahdī, one of the controversial issues among Islamic sects, Shī‘a has attached much greater importance to the issue. In this study, after the information about Mahdiship in the primary sources of Islam is conveyed, the opinions of the Ahl al-Sunnah and Shī‘a will be given and an evaluation will be made about the evidence and opinions put forward by the two sects. The Shiites, who formed the (...) principles of belief based on the theory of imamate, explained the issue of Mahdism in the axis of imamate and gave it a religious dimension, but the Shi‘ī sects disagreed on the subject of Mahdī. Shi‘ī sources tried to show that the claim of Mahdiship is an important issue, which has preoccupied Muslims, by dating the claim of Mahdiship back to Ali ibn Abi Talib's son, Muhammad ibn Hanafiyah. In a very early period, it was claimed that Muhammad ibn Hanafiyya did not die but was still living on a mountain called Razva in Madinah, and he was the anticipated (muntaẓar) Mahdī. Most of the Zaydiyya did not consider the issue of Mahdiship an important fundamental basis of belief. Ismailiyya maintain that Muhammad ibn Ismail did not die and will come and amend the world one day. Imāmiyya believe that Hasan, whom they accept as the last imam, will reappear as the Mahdī in the latest days of the world, and in line with this belief, they have made great efforts to find proof from the Qur’ānic verses and hadiths and interpreted them. In this way, they attached more importance to the understanding of Mahdiship on the axis of imamate than the other Shi‘ī sects. According to Imāmiyya, since the world cannot be left without a prophet, an open, or a secret imam, Muhammad b. Hasan will remain hidden as long as he wants and appear as the Mahdī near the Doomsday. Based on the clear statement of the Messenger of Allah (pbuh) that twelve caliphs would come after him, the Imāmiyya restricted the number of Imams from Ahl al-Bayt to twelve and claimed that the twelfth imam would come again as Mahdī. Although the Imāmiyya believe that the Mahdī will be from the Ahl al-Bayt, just like the other imams, they have not been able to provide valid evidence for the belief that the twelfth imam will be hidden and appear near Judgment Day. Although Imāmiya tried/have been trying to prove that it is possible for a person to live for centuries (more than a thousand years), which is called al-Ghaybat al-Kubrā by Imamiyya, it cannot be said that they have succeeded in doing so. Osmanlının son dönemlerinde doğup Cumhuriyetin ilk yıllarında yaşayan Tâhir Harîmî Balcıoğlu (ö. 1951), şer‘î ilimlerin tarihini anlatmak amacıyla bir eser kaleme almış ve Naklî İlimler Tarihi adını verdiği bu eserini on yılı aşkın bir sürede tamamlamıştır. Müellifin en meşhur eseri Tarihi Medeniyette Kütüphaneler, oldukça erken bir vakitte, 1931 senesinde yayımlansa da Naklî İlimler Tarihi’nin neşri için 2022 yılını beklemek gerekmiştir. Bir mukaddime ve altı bölümden oluşan eser, Kur’ân/Tefsir, Hadis, Fıkıh ve Kelâm ilimlerinin tarihlerini ele almaktadır. Bölümlerin dağılımları söz konusu olduğunda (...) eserin yarıdan fazlasının kelâm tarihine ayrıldığı görülmektedir. Fakat müellifin kelâm tarihi ile kastettiği esasında mezhepler tarihidir. Zira bu bölümde İslâm toplumundan neşet etmiş mezhep ve fırkalar ele alınmış, kelâm ilmine bölüm sonunda kısaca yer verilmiştir. Yazıldığı dönem ve bölge bağlamında değerlendirildiğinde eser; içerdiği konu çeşitliliği ve zengin kaynakçası sebebiyle oldukça kıymetli olup Cumhuriyetin ilk yıllarındaki İslâmî ilimlere dair bilgi birikimi göstermesi itibariyle de ayrıca önemlidir. Çalışmamızda geç dönem Mu‘tezilesinin önemli temsilcilerinden birisi olan Ebû Reşîd en-Nîsâbûrî’nin Mu‘tezile mezhebindeki konumunu ve ekol içerisindeki polemiklere yaklaşımını ele aldık. Kâdî Abdülcebbâr’ın önde gelen talebelerinden birisi olan Nisâbûrî, hocasının vefatından sonra Basra Mu‘tezilesinin riyasetini üstlenmiştir. Kaynaklarda hayatına dair fazla bilgi bulunmasa da ömrünün ilk yıllarında Bağdat Mu‘tezilesine mensup olduğu ve Horasan bölgesinde büyük bir üne sahip olan Ebü’l-Kâsım el-Belhî’nin görüşlerinden etkilendiği aktarılmaktadır. Günümüze ulaşan ve Basra Mu‘tezilesinin bakış açısıyla kaleme alınan eserlerinde Belhî’nin görüşlerine yoğun bir şekilde atıfta bulunmaya devam (...) etmektedir. Ömrünün ilk yıllarında Bağdat ekolüne mensup olması ve daha sonra Basra ekolüne intisap etmesi, kendisine her iki ekolü yakından tanıma fırsatı sunmuştur. Bu tecrübesinden hareketle iki ekol arasındaki polemiklere dair bir eser telif etmiş ve eserde Ebû Hâşim el-Cübbâî’nin görüşlerini Bağdat Mu‘tezilesine karşı savunmuştur. Nîsâbûrî’nin görüşlerini yakından incelediğimiz zaman Mu‘tezile içerisinde Şiî temâyüllerin başladığı Büveyhiler döneminde yaşamasına rağmen Mu‘tezilî bakış açısını büyük oranda muhafaza ettiğini söyleyebiliriz. Farklı fikirler ve yaklaşımlar ileri sürmekten ziyade hocasının yolunu takip ederek Mu‘tezilî mirası daha sistematik ve anlaşılır bir hale getirmeye çalışmıştır. Ayrıca kendine özgü birtakım yaklaşımlar da ileri sürmüştür. Özellikle sarfe konusunda Nazzâm gibi ilk dönem Mu‘tezilî düşünürlere ciddi eleştiriler yönelterek genel sünnî görüşe yakın bir tutum sergilemiştir. Şehristânî’nin de ifade ettiği üzere Basra Mu‘tezilesinin sünnî düşünceye bu yakın konumlanışını Nîsâbûrî’nin nübüvvet ve keramet konularında da görmek mümkündür. Çalışmamızda dokümantasyon tekniği kullanılarak Nîsâbûrî’nin hem yazma hem de matbu olarak günümüze ulaşan eserleri tespit edilmiştir. Abu Hanifa's theological ideas were not represented at the same level in every region where Hanafism spread. Although Iraq is the region where Abu Hanifa's jurisprudence views were systematized, Abu Hanifa's theological views were largely developed in the Transoxiana region. However, followers of Abu Hanifa in different regions adopted and defended the distinctive views of Hanafism. However, while in some regions these views were limited to basic theological ideas, in others a systematization was made based on this and thus a (...) comprehensive theological structure was formed. The followers of Abu Hanifa in the Transoxiana region are among the leading Hanafis who established a traditional theological structure around his views. This theological structure, which was called Maturidism in the process, was limited to the region where it was born for a long time and was spread to the west from the 11th century. When the Maturidis, who had a rich literature, came to the west, they encountered small and scattered Hanafi masses who regarded the theological views of the sect as consisting of basic theological ideas. Although they belong to the same fiqh tradition, this theological difference between them has created a new ground on which the two Hanafi factions will interact. With the power of their theological knowledge, the Maturidis tried to include the Hanafis in Iraq and Syria in their theological traditions with the texts they wrote as well as their teaching activities. Ahmad b. Muhammad al-Ghaznawi (d. after 593/1197), one of the Maturidis who migrated to the west, draws attention as one of the names that took part in this effort. His works called Usul al-din and al-Hawi al-qudsi are the first examples where this effort is clearly reflected in the texts. In these works, al-Ghaznawi uses the phrases of al-Aqīdah al-Tahawiyyah either exactly or with some minor changes, and adds Maturidi-specific views, especially the attribute of takwin. With this, al-Ghaznawi, on the one hand, reveals the compatibility of al-Aqīdah, which is the main text of non-Maturidi Hanafis, with Maturidi views, on the other hand, carries the Maturidi views to them with the expressions he added to the text. In this study, this activity of Ghaznawi, which can be described as a synthesis of al-Aqīdah al-Tahawiyyah and Maturidism, will be tried to be revealed in detail through the mentioned works. Imāmiyya holds that the theory of imāmate must rely on scriptural evidence and designation and that the Imām, the successor to Muḥammad, is in charge of all political and religious issues. The authority of the Imām includes some religious and social duties such as executing the legal punishments, collecting almsgiving, sustaining social order and declaring holy war. The fulfillment of these duties requires actual leadership of the Imām or his deputy. With the beginning of the great occultation in 329/941, there (...) was an uncertainty among the Imāmiyya followers about who would uphold these responsibilities. In this period, Shīʿī ʿulamā began to undertake the duties of the Imām in order to overcome this uncertainty and to avoid the possible schism. In the beginning, this delegation of authority was limited to the religious sphere; but, later, its scope gradually became wider. This process of delegation of power, which covers a long process, needs to be examined in its various periods. In this study, this subject will be considered with special reference to the scholars of the fifth century of hijra (hijrī). An effort is made in this article to reveal how the issues of the Imām’s powers are discussed in the context of the problem of expanding or narrowing the authority of the scholars who played significant roles in systemization of Uṣūlī (rationalist) thought in the period after Shaykh al-Mufīd.Summary: In the issues of Imām/Caliphate which led to political division among Muslims after the Prophet Muḥammad, Imāmī Shīʿa opines that the Imāmate theory relies on scriptural evidence and designation. According to this theory, apart from scriptural evidence and designation, personal qualities such as immaculacy, knowledge, bravery, and vantage are found in Ali, Ḥasan, Ḥusayn and nine people from the lineage of Ḥusayn. The Imām as a successor to the Prophet Muḥammad is a person who has both religious and political power which includes implementation of punishments, collecting alms, ensuring justice, declaring holy war. For the Imāmī Shīʿa, there is a need for imām or his deputy who has absolute power to fulfill these duties.Imāmī Shīʿa, who held that the disappeared twelfth Imām would return back to restore justice in the world, had to confront various problems in finding solutions to some issues related to the existence of Imām himself, as well as theological issues during the period of great occultation. Particularly, the period of great occultation (329/941), in which the link with the Imām was severed completely, the Shīʿī community were uncertain on how to fulfill the responsibilities of the Imām probably due to the lack of religious sources. Shaykh al-Mufīd draws attention to the issue of khums (a one-fifth share of the spoils of war and of other specified forms of income). In this period of uncertainty, the Shiite scholars came into prominence in order to fill the gap and to prevent the social disorder. Referring to a tawqī‘ (rescript) from the Twelfth Imām, they claimed that they would take responsibility for the Twelfth Imām on his behalf. In the beginning, the delegation of the power was limited to the religious sphere. It was gradually extended to other spheres by the contribution of some scholars. It reached the largest dimension with the implementation of “wilāyat al-faqīh” theory.From that period until our times, the era when Sharīf al-Murtaḍā and his disciples lived can be considered as the beginning of this period. In the fifth century when Sharīf al-Murtaḍā and his disciples lived the delegation of power was limited to the religious sphere. In this article, how the scholars who played a role in the systematization of Uṣūlī thought dealt with the issue of the limits of the authority of Imām and how they defined the role of the Imāmī jurists (faqīh) will be examined.Sharīf al-Murtaḍā and his disciples were sometimes cautious on the issue of the delegation of the power of Imām. They, however, pointed out the role of the faqīh in the occultation period in order to overcome the uncertainty. As a matter of fact, Shaykh al-Ṭūsī and al-Qādī Ibn al-Barrāj made significant contributions to the issues of collection and distribution of khums. However, Sallār al-Daylamī’s contribution to the subject is more crucial. He considered khums as the grace of God and believed that it can be allocated by taking into account the share of the Imām. They put forward the views that explained in details the role of the faqīh in the collection and distribution of alms. Even Ibn al-Barrāj opined that in the absence of Imām and his deputy alms are to be allocated to the Faqihs on the ground that they know better how to distribute it. Therefore, in the absence of Imām and his deputy, by suggesting that faqīh must be in charge of collecting and distributing alms, they proposed a remedy in an early period.On the issue of leading the Friday prayer (ṣalāt al-jum‘a), which is one of the social duties of Imām, Sharīf al-Murtaḍā and his disciples considered the presence of the Imām or his deputy as a condition for a valid Friday prayer. In addition to this condition, Al-Ḥalabī, also added that a person who meets the necessary conditions can be also considered in leading Friday prayer. This addition by Ḥalabī was an important contribution to the solution of the problems encountered during the period of great occultation on both Friday prayer and delegation of Imām religious and political authorities to faqīh. On the other hand, Sallār, another disciple of Sharīf al-Murtaḍā, opposed the idea of the faqīh leading the Friday prayer in the absence of the Imām even when the necessary conditions are met. It can be said that this approach of Sallār led to the opinion of some Imāmis which considered Friday prayer unlawful in the absence of Imām. In the occultation period, Sharīf al-Murtaḍā and his disciples showed a cautious attitude about the implementation of the punishments. They argued that only Imām could implement the punishments. However, the major step was taken by Shaykh Ṭūsī on the issue of who implements the punishments in the occultation period. He argued that the Imām’s designated the faqihs to implement the punishments. In addition to this subject, Shiite scholars discussed the issue of whether a Shiite officer under the reigning rule in the occultation period implemented the punishments. On this issue, Sharīf al-Murtaḍā compiled a treaty untitled Mas’ala fi’l-‘amal ma‘a’al-sulṭan. For him, the main criteria are whether such person has necessary responsibilities and qualifications. Sharīf al-Murtaḍā and his disciples also continued their master’s conciliatory attitude. In the final analysis, the contribution of Sharīf al-Murtaḍā and his disciples on the issue of who will undertake the duties and responsibilities of the Imām is crucial in the systematization of the idea of transferal of the power of the Imām to faqīh including political one. In fact, Sharīf al-Murtaḍā’s advice to take part in the existing administrations has been considered a way out for the scholars who want to establish relations with the authorities in the later periods. Muhammed ile başlayan ve Cumhuriyetin ilanına kadar iktidarın soyundan gelenlerin devam ettirdiği dönem bulunmaktadır. Ancak Kâsımîler dönemi olarak bilinen bu sürece dair literatürde yeterli bilgi bulunmamaktadır. Mansûr-Billâh Kâsım b. Muhammed’in akaid, fıkıh, usul gibi alanlarda kıymetli eserlerinin yanı sıra kaleme aldığı ufak bir risalesi de bulunmaktadır. Bu çalışmada ise Kâsımî Hanedanlığının kurucusu olarak bilinen Mansûr-Billâh Kâsım b. Muhammed’in oğlu Müeyyed-Billâh (...) Muhammed b. Başta Kur’ân-ı Kerîm olmak üzere İslâm dininin kaynaklarının büyük ölçüde Arapça olması, nasslardan hüküm çıkarma gayesini güden Fıkıh usûlünün Arap dili grameriyle yakından ilgilenmesine vesile olmuştur. Lafızlarla ilgili pek çok konu arasında istisnâ konusu da kendine haklı bir yer bulmuş ve hem dilcilerin hem de fıkıhçıların ilgi odağı olmuştur. İstisnâ konusu birçok eserde özel bölüm olarak ele alındığı gibi bu konu hakkında müstakil eserler de kaleme alınmıştır. İstisnânın istisnâsı konusu ise üzerinde çokça tartışılan ve neredeyse hiçbir noktasında görüş birliğine (...) varılamayan spesifik bir konu olarak belirmiştir. Nasslarda kullanımına neredeyse hiç rastlanmaması nedeniyle karşılığı olmayan fakat farazî fıkıh malzemesi olarak çokça kullanılan bu konu, fürû örneklerinin kısır döngüsüne sahne olmuş ve nihaî bir karara bağlanamayarak sonuçsuz kalmıştır. Gerek dil ekolleri gerek fıkıh mezhepleri arasında derinleşen ihtilaf, ekol ve mezhep içi ihtilaflara da sahne olmuş, çözümü oldukça zor bir kördüğüm halini almıştır. İstisnânın istisnâsını dil açısından olabilir görenler dahi, müstesnâ ile müstesnâ minh arasında cins farklılığı olmasının dışında sayılar alanında bunu ispatlayacak bir delil ve kullanım alanı gösterememişlerdir. Alvin Plantinga, analitik felsefe düşüncesi içerisinde yetişmiş ve bu gelenek içinde teistik din felsefesinin oluşumuna katkıda bulunmuş bir filozoftur. Ayrıca teizmin savunusu için yaptığı çalışmalarla, çeşitli üniversitelerden aldığı onur ödülleri ve 2017 yılında kazandığı Templeton Prize ödülüyle, haklı bir üne kavuşmuş bir şahsiyettir. Bu çalışmayı yapmamızdaki en önemli amaç, Plantinga’nın dini epistemoloji üzerine yaptığı çalışmaları analiz edip bu düşüncelerinin ardalanına dair bir tespitte bulunmaktır. Bu çalışmada yararlandığımız öncelikli kaynaklar, Plantinga’nın Nicholas Wolterstorff ile birlikte kaleme aldığı “Faith and Rationality” adlı eser (...) ile birlikte son dönem epistemik fikirlerinin çerçevesini belirleyen üç ciltlik “Warrant and Proper Function”, “Warrant: The Current Debate”, “Warranted: Christian Belief” isimli eserler olmuştur. Plantinga’nın ilk dönem epistemoloji çalışmalarının gayesini bir tür olumsuzlama diyebileceğimiz klasik temelciliğin ve evidentializmin eleştirisi oluştururken, ikinci döneminde bu eleştirilerden yola çıkarak Tanrı inancının haklı bir temelde ve güvenceye sahip olduğunu gösterme amacına yönelmiştir. Plantinga’nın teolojik fikirlerini oluşturan Kalvinci ekol, onun dini epistemolojisinin de özünü oluşturmaktadır. Plantinga’nın dini epistemolojisini iki boyutlu olarak değerlendirdiğimizde, içe dönük olarak Hristiyan inancıyla ilgilense de çalışmalarının dışsal yönünü daha genel olarak teizmin Tanrı’sı ve onun rasyonelliği oluşturmaktadır. Açıkçası Plantinga’nın epistemolojik külliyatı bir tür kavram zenginliğini de beraberinde getirmektedir. Çalışmamız içerisinde ele aldığımız kadarıyla uygun işlevsellik, tasarım planı, güvence (warrant) gibi kavramlar onun Tanrı inancının epistemik mahiyetini ortaya koymak için ne derece kararlı olduğunu göstermektedir. Netice itibariyle Tanrı inancının ve onun bilgisinin rasyonel olabileceğini ifade eden Plantinga, her ne kadar Hristiyan inancının belli bir koluna mensup olsa da diğer mezhepleri dışlamaz. Ayrıca Plantinga, birçok çalışmasında belirttiği üzere projesinin Yahudilik, İslam gibi diğer teistik dinlere yönelik olduğunu da belirtmektedir. (shrink)

يهدف هذا البحث، إلى بناء مقياس للاتجاه المذهبي والتأكد من صلاحيته وتطبيقه على عيّنة من طلبة جامعة اليرموك الأردنيّة، من خلال استخدام مسائل فقهيّة مشتهرة الاستعمال في بابي: الطهارة والصلاة، من فقه المذاهب الأربعة: الحنفي والمالكيّ والشافعيّ والحنبليّ، وقد اعتمد البحث منهجيّة الاستقراء في اختيار القضايا الفقهيّة المشتهرة في الاستعمال، من القول المعتمد في فقه المذاهب الأربعة، من بابي: الطهارة والصلاة. والمنهجيّة الوصفيّة التحليليّة، واستخدام الاستبانة أداةً لبناء مقياس الاتجاه المذهبيّ، وتطبيقه على عينة الدراسة. وقد خلصت الدراسة، إلى وجود تمايزات (...) مذهبيّة للطلبة؛ بناء على الدولة التي قدموا منها، كما بيّنت الدراسة أنّ أغلب الطلبة يخلطون بين أكثر من مذهب فقهيّ في تطبيقهم لمسائل الطهارة والصلاة. وقد أظهرت الدراسة أنّ الطلبة الأردنيين يتّجهون في أدائهم وتطبيقاتهم إلى المذهبين: الحنبليّ والشافعيّ، في حين كان توجّه الطلبة الأتراك إلى المذهبين: الحنفيّ والشافعيّ، وكشفت الدراسة عن أنّ توجّه الطلبة الصينيين كان إلى ثلاثة مذاهب هي: الحنبليّ والشافعيّ والحنفيّ، بينما ظهر أنّ توجّه الطلبة من دول جنوب إفريقيا كان إلى المذهب الشافعيّ وبدرجة مرتفعة ثمّ المالكيّ والحنبليّ بدرجة متوسطة، وأن الطلبة الماليزيين والتايلنديين يتّجهون إلى المذهب الشافعي بدرجة متوسطة مع انخفاض استجاباتهم نحو المذاهب الثلاثة الأخرى. Fıkıh usulü alimlerinin genel kanaatine göre kıyas, bilgi üretmede kullanılan temel yöntemler arasında yer alır. Sünni mezhepler içerisinde kıyas karşıtlığı fikri ile temayüz eden Zâhirîliğin en önemli temsilcilerinden olan Endülüslü âlim İbn Hazm (öl. 456/1064), usûl ve fürû-i fıkha dair yazdığı eserlerle Zâhirî düşüncenin gelişimine ciddi katkılar sunmuştur. Bu çalışmada, İbn Hazm’ın fıkıh usulü açısından geçerliliğine şiddetle karşı çıktığı kıyasa, Hanefîlerin uygulamaları özelinde pratikte ne tür eleştiriler getirdiği hususuna odaklanılmıştır. Bu çerçevede Hanefîlere izafe ettiği temsil gücü yüksek bazı kıyas uygulamaları (...) seçilerek onun bu uygulamalar hakkındaki itiraz ve tenkitleri ortaya koyulmuş, ayrıca söz konusu meselelerde Hanefîlerin görüşleri kendi kaynakları üzerinden araştırılmıştır. İbn Hazm, Hanefîler başta olmak üzere kıyası benimseyen mezhepleri, kendi belirledikleri kaide ve şartlara riayet etmemekle, dolayısıyla kıyas yapmayı bilmemekle itham etmiştir. Çalışmada, İbn Hazm’ın bu hususta büyük ölçüde hasmı ilzam amaçlı cedelci bir yöntemi takip ettiği tespit edilmiştir. (shrink)

Sadrüşşerîa’nın (ö. 747/1346) Fahreddin er-Râzî’nin (ö. 606/1210) insanın ihtiyârî fiillerini nefyettiği argümanını çü- rütmeye çalıştığı ve Hanefî-Mâtürîdî geleneğin bu husustaki prensiplerini nazarî bir dille yeniden temellendirdiği dört mu- kaddimesi (mukaddimât-ı erba‘) ile Mehmed Birgivî’nin (ö. 981/1573) bu mukaddimeler üzerinden geliştirdiği açıklamaları, diyar-ı Rum’daki düşünürlerin insan fiilleri ve cüz’î iradeye dair tartışmalarına yön vermiştir. On yedinci yüzyılda Hicaz topraklarında faaliyet gösterip Eş‘arî-Ekberî geleneği merkeze alarak ihtiyârî fiillere dair yazdığı eserleriyle bu geleneğin nispeten güçlü olduğu Hicaz, Şam ve Kuzey Afrika’da etki uyandıran (...) İbrâhîm el-Kûrânî (ö. 1101/1690), Hanefî-Mâtürîdî gelenekte Sadrüşşerîa ve Birgivî’nin görüşleri etrafında cereyan eden tartışmalara da bigâne kalmamış, bu âlimlerin me- tinlerini merkeze alarak kaleme aldığı Cilâü’l-enzâr risalesiyle o zamana kadar dolaylı ve nispeten zayıf irtibatının olduğu diyar-ı Rum havzasındaki tartışmalara dahil olmuştur. Kûrânî, bu eserle yaşadığı dönemdeki hâkim Hanefî-Mâtürîdî gele- neğe yönelik eleştiri ve değerlendirmelerde bulunmuş, bu çerçevede insanın sorumluluğunun cüz’î irade ve îkâ üzerinden ispatlanıp ispatlanamayacağı, hallerin yaratmaya konu olup olmadığı ve iradenin tercihinde bir sebebe bağlı olup olmadığı gibi belli meseleleri ele almıştır. Ayrıca mutlak hürriyet (tefvîz) ile mutlak zorunluluk (cebr) arasındaki orta yolun nasıl tesis edileceği konusuna da yoğunlaşmıştır. Kûrânî’nin diğer ilim havzalarıyla kurduğu irtibatlarda olduğu gibi Hanefî-Mâtürîdî geleneğin eleştirisi üzerinden diyar-ı Rum ile kurduğu ilişkinin aynı zamanda kendisinin eğilim ve mezhepleri uzlaştıran fikirlerine alan açmaya matuf olduğunu iddia eden bu çalışma, zikri geçen risalede yer verilen eleştiri ile değerlendirmelerin ortaya çıkarılmasını ve bunun tarihî-fikrî bağlamına yerleştirilmesini amaçlamaktadır. This study highlights various totalitarian and undemocratic practices in which Bangladesh’s current Awami League-led coalition regime engages. It shows that since its inception in early 2009, the regime has tried to mobilize and manipulate public support from within through—among other means—creating the discourse of “war crimes” and to obtain international support through the discourse of “Islamism” and terrorism. Although “a secular plan” to combat and replace “Islamism” may soothe the nerves of many in the international community, its deployment in Bangladesh (...) has paradoxically produced a dangerous culture of disappearances and extrajudicial killings, infringements on freedom of speech and the stifling of dissenting voices, and the interception of opposition programs and the torture of opposition leaders and activists. The regime has also made a mockery of the law and the country’s judicial system. Many commentators believe that the country’s law courts are now simply an extension of the regime’s political clout. In these circumstances, political repression continues unabated, and victims of persecution are left with inadequate legal recourse. In the name of combating “Islamic terrorism,” Bangladesh’s ruling regime has resorted to a reign of terror that is in many respects tantamount to what we know as fascism. (shrink)

Animals have encountered cruelty and suffering throughout the ages. It is something perpetrated up till this day, particularly, in factory farms, animal laboratories, and even in the name of sports or amusement. However, since the second half of the twentieth century, there has been growing concerns for animal welfare and the protection of animal rights within the discourse of environmentalism, developed mainly in the West. Nevertheless, a recently developed Islamic Ecological Paradigm rooted in the classical Islamic traditions contests the ‘Western’ (...) monopoly of modern environmentalism, sug­gesting that there is much in Islamic traditions dealing with environmental issues in­cluding non-human animal species. IEP asserts that several centuries ago Islamic traditions significantly focused on and strongly advocated for animal welfare and animal rights. This paper explores and examines animal rights within the broader spectrum of Islamic environmentalism or Islamic eco-ethic. While the philosophical roots of IEP concerning animal rights date far back in seventh century, it can potentially make both ethical and educational contributions to the twenty-first century environmentalism and animal rights movements. Following their violent suppression of the Indian Revolution of1857, the British founded and consolidated their secular empire in the IndianSubcontinent, which marginalized and bypassed religion as far as possible,particularly Islam, which had been the official religion of the Mughal ancienrégime. Contemporaneous Ottoman efforts to counter European imperialism ledto Sultan Abdul Hamid II’s policy of pan-Islamism, particularlythe call for Islamic unity against the Russian aggression against Turkey in1877. It was at this critical juncture that some Indian Muslim scholars gallantlyvolunteered to counter (...) this threat, and to preserve the Islamic faith and heritageworldwide, despite the severe problems faced by the Muslims in India itself.This study highlights the role of an eminent scholar in this movement, namelyAllama Shibli Nu’mani, who in 1914 conceived the idea offounding the world-famous Islamic research institute Darul Musannefin ShibliAcademy in his home town of Azamgarh, Uttar Pradesh, India. Shibli was veryactive and instrumental in collecting donations from the wealthy landowners among the Muslim elite in his hometown of Azamgarh for theOttoman cause, raising 3,000 rupees, which was handed to Husain HasibAfendi, the Ottoman Consul in Bombay in 1877. Furthermore, his eloquentpoetry rallied Muslims across India to support the valour and heroism displayedin the jihad by Ghazi Usman Pasha against the Russians. Shibli travelled toIstanbul in 1892 and met with the Pasha, on whose efforts Tamgha-i Majidi was granted to Shibli on 13th Muharram, 1310/7th August, 1892.This article is based on Shibli’s major works in Urdu, particularly his arousingeulogies, Turkish archival reports, newspapers and magazines, andsecondary sources in Urdu and English. This paper aims at helping trainees to overcome the difficulties they face when dealing with Arduino platform by describing the design of a desktop based intelligent tutoring system. The main idea of this system is a systematic introduction into the concept of Arduino platform. The system shows the circuit boards of Arduino that can be purchased at low cost or assembled from freely-available plans; and an open-source development environment and library for writing code to control the board topic of Arduino (...) platform. The system is adaptive with the trainee’s individual progress. The system functions as a special tutor who deals with trainees according to their levels and skills. Evaluation of the system has been applied on professional and unprofessional trainees in this field and the results were good. (shrink)

Ethical principles are among the topics that are widely emphasised in the Islamic society. Ethics is a set of values, do's and don'ts that can play an important role in the effective management of organisations. If employees of organisations, especially medical staff, are working in the atmosphere of Islamic ethics, they show functional behaviours in line with the goals and missions of organisation. Due to the direct relationship and treatment of nurses with recipients of medical services, nurses' behaviours have significant (...) impact on the quality of services provided by medical centres. Therefore, the purpose of this study is to explore the relationship between Islamic ethics and commitment of 1100 Muslim nurses in Indonesia in 2021. This study was performed by descriptive-analytical correlational method. Data were collected using Islamic ethics and organisational commitment questionnaires and measured by Pearson correlation coefficient in Statistical Package for the Social Sciences (SPSS) and structural equation modelling analysis (SEM) in linear structural relationships (LISREL). The results indicate that Islamic ethics have significant and positive relationship with nurses' commitment as p = 0.542 and t = 5.63. CONTRIBUTION: According to the research findings, it can be concluded that commitment of nurses can be improved by applying Islamic ethics in medical centres. (shrink)

Rationale: Patients with advanced dementia experience multifaceted vulnerabilities because of their diminished capacities for decision making. The dominant versions of person-centred care (PCC) emphasise patient preferences and autonomy, which often undermines a recognition of their distinct unfulfilled needs. Determining whether an individual autonomy conception of personhood applies to patients with advanced dementia is morally problematic from various theoretical perspectives and leads to the one-approach-fits-all problem when caring for this patient population. -/- Aims and Objectives: The availability of patients' advanced directives (...) varies depending on their cultural backgrounds. The goal of the study is to argue that PCC, with a focus on relational autonomy, should be the first step for caring for patients with advanced dementia. -/- Method: The study engages in a critical exploration of inclusivity and diversity in ethical thinking within a framework of PCC and uses philosophical argumentation to assess the viability of a relational autonomy conception of PCC. -/- Results and Conclusion: By taking relationality seriously, especially in caring for patients with advanced dementia in a multicultural society, and by considering the moral nexus of unmet needs through the perspective of PCC, we can resolve the problem of one-approach-fits-all in dementia care. We provide evidence of the relationship between corporate social responsibility (CSR) and corporate financial performance (CFP) in Palestine, a highly unstable political context. Annual reports of all firms listed on the Palestine Exchange (PEX) for the period 2016-2019 were manually content analysed. A checklist of reported CSR items is summarised into four areas: environmental information, human resources, community involvement, and product and customer service quality. Results indicate a robust positive connection between each of the four dimensions and the composite CSR (...) index with three performance indicators: ROA, ROE, and Tobins Q. Results also find better performing companies with a higher degree of community involvement being greatly appealing, while the environmental dimension was the least resilient. We discuss the significance of community engagement for an unstable context like Palestine from a community cohesion standpoint. (shrink)

Arguing that psychology and business ethics are best brought together through a multi-level, broad-based agenda, this essay articulates a vision of psychology and business ethics to frame a future research agenda. The essay draws upon work published in JBE, but also identifies gaps where published research is needed, to build upon psychological conceptions of business ethics. Psychological concepts, notably, are not restricted to phenomena “in the head”, but are discussed at the intra-psychic, relational, and contextual levels of analysis. On the (...) basis of this presentation, I discuss future directions for development in psychology and business ethics, including but not limited to studies of personality, emotion, decision making, motivation, and the biological bases of psychology and business ethics. An inclusive approach to these and related areas, it is argued, will both bring about depth of understanding on the psychological bases of business ethics, and allow dialogue across disciplinary areas within JBE. This study investigated the neuromodulatory effects of transspinal stimulation on soleus H-reflex excitability and electromyographic activity during stepping in humans with and without spinal cord injury. Thirteen able-bodied adults and 5 individuals with SCI participated in the study. EMG activity from both legs was determined for steps without, during, and after a single-pulse or pulse train transspinal stimulation delivered during stepping randomly at different phases of the step cycle. The soleus H-reflex was recorded in both subject groups under control conditions (...) and following single-pulse transspinal stimulation at an individualized exactly similar positive and negative conditioning-test interval. The EMG activity was decreased in both subject groups at the steps during transspinal stimulation, while intralimb and interlimb coordination were altered only in SCI subjects. At the steps immediately after transspinal stimulation, the physiological phase-dependent EMG modulation pattern remained unaffected in able-bodied subjects. The conditioned soleus H-reflex was depressed throughout the step cycle in both subject groups. Transspinal stimulation modulated depolarization of motoneurons over multiple segments, limb coordination, and soleus H-reflex excitability during assisted stepping. The soleus H-reflex depression may be the result of complex spinal inhibitory interneuronal circuits activated by transspinal stimulation and collision between orthodromic and antidromic volleys in the peripheral mixed nerve. The soleus H-reflex depression by transspinal stimulation suggests a potential application for normalization of spinal reflex excitability after SCI. (shrink)

Social practices of quantification, or the production and communication of numbers, have been recognized as important foundations of organizational knowledge, as well as sources of power. With the advent of increasingly sophisticated digital tools to capture and extract numerical data from social life, however, there is a pressing need to understand the ethical stakes of quantification. The current study examines quantification from an ethical lens, to frame and promote a research agenda around the ethics of quantification. After a brief overview (...) of quantification research and its uses in state and market organization, I discuss quantification in terms of three core subprocesses—capture, specification, and appropriation, illustrating and identifying ethical concerns around each process. Linking these processes to the performative effects of measures, I present a working model of quantification from which the discussion builds ideas for developing a research agenda around quantification. This paper will provide a solution to one specific problem that arises from this situation, namely the lack of tool/mechanism to demonstrate how an expert system is well-suited for supporting decision-making activities drawn from existing records and relevant legal requirements aligned existing records stored in various databases.We present a Rule-based reporting systems architecture, which is intended to integrate databases, in particular, relational databases, with a logic-based reasoner and rule engine to assist in decision-making or create reports according to legal norms. We argue that the resulting RuleRS provides an efficient and flexible solution to the problem at hand using defeasible inference. To this end, we have also conducted empirical evaluations of RuleRS performance. (shrink)

This study traces the history of the origin and development of Unanimedicine in the Islamic world and its later blossoming in Persia. Relativistic mean field theory with mesons σ, ω, π and ρ mediating interactions and nucleons as basic fermions has been very successful in describing nuclear matter and finite nuclei. However, in heavy-ion collisions, where the c. m. energy of two colliding nucleons will be in the hundreds of GeV region, nucleons are not expected to behave as point-like particles. Analyses of elastic pp and ¯pp scattering data in the relevant c. m. energy range show that the nucleon is a composite (...) object—a topological soliton or Skyrmion embedded in a condensed quark-antiquark ground state. Against this backdrop, we formulate an effective field theory model of nuclear matter based on the gauged linear σ-model where quarks are the basic fermions, but the mesons still mediate the interactions. The model describes the nucleon as a Skyrmion and produces a q¯q ground state analogous to a superconducting ground state. Quarks are quasi-particles in this ground state. When the temperature exceeds a critical value, the scalar field in the ground state vanishes, quarks become massless, and a chiral phase transition occurs leading to chiral symmetry restoration. We explore the possibility of a first order phase transition in this model by introducing suitable self-interactions of the scalar field. Internal structures of the Skyrmions are ignored, and they are treated as point-like fermions. (shrink)

In this editorial essay, we argue that Generative Artificial Intelligence programs (GenAI) draw on what we term a “hypercommons”, involving collectively produced inputs and labour that are largely invisible or untraceable. We argue that automatizing the exploitation of common inputs, in ways that remix and reconfigure them, can lead to a crisis of academic authorship in which the moral agency involved in scholarly production is increasingly eroded. We discuss the relationship between the hypercommons and authorship in terms of moral agency (...) and the ethics of academic production, speculating on different responses to the crisis of authorship as posed by GenAI.
