We present a way out of Russell’s paradox for sets in the form of a direct weakening of the usual inconsistent full comprehension axiom scheme, which, with no additional axioms, interprets ZFC. In fact, the resulting axiomatic theory 1) is a subsystem of ZFC + “there exists arbitrarily large subtle cardinals”, and 2) is mutually interpretable with ZFC + the scheme of subtlety.

The thesis defended in this article is that by uttering or publishing a great many declarative sentences in assertoric mode, one does not actually assert that their conjunction is true – one rather asserts that the vast majority of these sentences are true. Accordingly, the belief that is expressed thereby is the belief that the vast majority of these sentences are true. In the article, we make this proposal precise, we explain the context-dependency of belief that corresponds to it, we (...) point out why our everyday oral practice of single assertions is not affected by it, and we argue that the proposal leads to a way out of the Paradox of the Preface. A ‘way out’ expresses a movement which looks completely different depending on whether one views it prospectively or retrospectively: in the first instance, it signifies ‘to emerge from’, which suggests a relationship of continuity; in the second it signifies ‘to breach a threshold’, a distancing, that is to say, a rupture. Which of these two meanings should we ascribe to the expression ‘Foucault’s way out of Hegel’ – that of a connection, which emerges when we look behind us, or that (...) of a disjunction, which appears when we look ahead? According to the judgement of the European Court of Justice in 2014, human parthenogenetic stem cells are excluded from the patenting prohibition of procedures based on hESC by the European Biopatent Directive, because human parthenotes are not human embryos. This article is based on the thesis that in light of the technological advances in the field of stem cell research, the attribution of the term ‘human embryo’ to certain entities on a descriptive level as well as the attribution of a (...) normative protection status to certain entities based on the criterion of totipotency, are becoming increasingly unclear. The example of human parthenotes in particular demonstrates that totipotency is not at all a necessary condition for the attribution of the term ‘human embryo’. Furthermore, the example of hiPSC and somatic cells particularly shows that totipotency is also not a sufficient condition for the attribution of a normative protection status to certain entities. Therefore, it is not a suitable criterion for distinguishing between human embryos worthy of protection and human non-embryos not worthy of protection. Consequently, this conclusion has repercussions for the patenting question. The strict delineation between an ethically problematic commercial use of human embryos and the concomitant patenting prohibition of hESC-based procedures and an ethically unproblematic commercial use of human non-embryos and the therefore either unrestrictedly permitted or even unregulated patenting of procedures based on these alleged alternatives becomes increasingly blurred. This article seeks to illustrate the relevance of social theory for the study and practice of law. As social theory reports on changes that influence societal structures, the question for lawyers is how these changes affect law and what this means for its role and function. To this end, the article draws on Ulrich Beck’s theory of the risk society and reflexive modernization to provide the relevant perspective. This theory reports upon and explains the so-called side effects of modernization that (...) take the shape of environmental, industrial and political risks. It is these side effects that constitute the problem in risk society and dealing with them demands a reflexive approach towards modernization. The article seeks to highlight the relevance of this theory for law by placing it in the tradition of social contacts theory. It does so by reformulating the central problem of the risk society and by identifying the main social actors who would be party to a “new” social contract. The article then identifies and formulates the instruments of negotiation, at which point it becomes clear what the role of law may be. It concludes with a tentative indication of what the main terms of the social contract could look like. (shrink)

I show that Frege's statement (In the Epilogue to his Grundgesetze der Arithmetic v. II) of a way to avoid Russell's paradox is defective, in that he presents two different methods as if they were one. One of these "ways out" is notably more plausible than the other, and is almost surely what Frege really intended. The well-known arguments of Lesniewski, Geach, and Quine that Frege's revision of his system is inadequate to avoid paradox are not affected by the ambiguity (...) of Frede's statement. But a rectnt argument by Linsky and Schumm (Analysis 82 (1971-72), 5-7), intended as a very simple derivation of a contradiction within Frege's revised system, is valid only for the less plausible of the two versions of Frege's way out, and thus is not an effective attack on the revision that Frege intended to make. It theorizes a framework of how group killing played a selective function in the emergence of our species, but it leaves open plenty of questions and concerns for productive, critical dialogue. Wolfgang Palaver has (...) written a short affirmation of the book, and Melvin Konner reviewed it for The Atlantic.1 But as one who has taken keen interest in the evolutionary and theological dimensions of mimetic theory,2 I offer here a longer engagement with the book and the author. I begin by extrapolating Wrangham's argument, I offer some critique, and then I share an edited version of my extended conversation with him.Wrangham's overall paradox is that humanity emerged through killing our way out of violence. More precisely, proactive coalitionary killing against aggressive, alpha-male individuals selected out, in a genetic pressure over hundreds of thousands of years, the more temperamental threads of Homo, resulting in a species (sapiens) who are relatively more domesticated and docile.3 [End Page 63]The argument proceeds as follows. First: Domestication is a real, genetic thing. Various domesticated species tend to share an odd, seemingly unrelated set of features called a "domestication syndrome." This refers to some combination of phenotype differences as compared to nondomesticated cousins: reduced skeleton mass, reduced/rounder cranium sizes and jaw lines, floppier ears, white patches of fur, extended juvenility, more frequent fertile periods, males with greater approximation to female characteristics, and so on. Beneath all these is a genetic reduction in "reactive aggression," which is the propensity for violence related to irascibility and short-fused tempers.Two: Domestication can happen intentionally or just randomly in nature. Humans have domesticated foxes in quick succession, breeding only ones with reduced reactive aggression, resulting in a domestication syndrome.4 The same seems to have happened slowly, with increasing intentionality over time, in the domestication of wolves into dogs. (This perhaps first began with the natural selection of wolves who were least aggravated by getting near humans to eat their camp detritus.) But domestication can also happen outside the human sphere, as in bonobos, who are basically a domesticated cousin of chimpanzees—evidenced not only in their reduced aggression but in their own domestication syndrome.5 This happened, he argues, largely through contingent, niche ecological features related to landscape, dramatic climate variations, and changes in competition over food.Three: It has long been asked whether humans are a "domesticated" species or whether such a thought is just anthropocentrism. The answer is definitely yes, but who domesticated us? A traditional answer, of course, was that God made us (or that some humans are properly domesticated, and others savage); but what if we ask in a more specifically scientific, causal framework? One early anthropologist posed that perhaps some now-extinct super-species domesticated us.6 Wrangham's answer is that we unintentionally domesticated ourselves by persistently killing off the genetic lines of the most aggressive individuals. This has resulted in Homo sapiens being basically a domesticated version of Homo neanderthalensis, erectus, and so on. Girard's not-unrelated answer is that religion domesticated us. By "religion" Girard means an integrated pattern of chaotic/exceptional and ordered/normal behaviors that contain violence, mediated through our mimetic capacity: chaotic mimetic violence restrained and channeled through mimetic ritual, taboo, and myth. This created an increasing feedback loop that exercised and intensified our mimetic capacity while protecting against its dangerous excess. In this essay, I trace a rhetorical affinity between feminist postmodern theory and an Enlightenment narrative of development. This affinity consists in the valorization of mobility and the repudiation of locatedness. Although feminists deploy this rhetoric in order to accommodate differences and to accustom readers to the instability that results from such accommodation, I show how this rhetoric works to justify Western colonial development and to efface women's very different experiences of mobility in the early twenty-first century.

If Europe wants to overcome its current crisis, it urgently needs to develop a new political vision and a new concept for political integration. By focusing on the idea of a cosmopolitan Europe, this article outlines such a political vision for Europe. To this end, it first suggests reformulating the concept of cosmopolitanism in such a way that it is not tied to the ‘cosmos’ or the ‘globe’. With the aid of such a generalized concept of cosmopolitanism it then presents (...) a novel, cosmopolitan approach to European integration that is no longer concerned with harmonizing rules and eliminating (national) differences, but with recognizing them. Finally, it outlines a new, post-national model of democracy for Europe that no longer disenfranchises citizens and instead gives them an active role in European decision-making processes. (shrink)

The ‘Di‰tetik’ reveals a Kantian body in which the orifices–the ways in and out of the body–are problematized, and exchange with the world of objects via these orifices is strictly regulated. The Kantian body is a ‘classic’ body in Bakhtinian terms; its ‘grotesque’ counterpart–the feminine body–is explored in a range of Enlightenment and (...) Romantic texts–philosophical, medical, sociological. The Enlightenment is a turning point in the history of gender difference, when the naturalness of incommensurable sexual difference is asserted. The Kantian body is part of this project. The motif of bodily fluids, and their transgression of corporeal boundaries, is considered within the context of an emerging consumer economy, and the changes being wrought on the ‘body politic’. Coleman achieves remarkable rigor in bringing together in one volume her long-standing interests in process philosophy and theology, womanist theology and ethics, African diaspora studies, West African religions, and African American women’s literature. Making a way out of No Way (2008) is a tour de force in contemporary African American constructive theology and especially in womanist discourse on the religious experience(s) of African American women. Western Australia, like Tasmania, can slip too easily off the map, a periphery on the periphery, its significance occluded by the hegemony of the eastern states of Australia. Yet Western Australia is core to Australia’s economy, not least through mining, and through its proximity to Asia. The West is itself connected more closely to region, in both the local and transnational senses. Its tradition of secessionist thinking indicates a kind of exceptionalist culture. Let us begin by assembling some signs of the present philosophical situation. On the one hand, the most important living French philosopher, Alain Badiou, calls for a “return to Plato,” despite the movement of anti-Platonism that dominated French and German thought in the 20 th century. On the other hand, the present moment sees a resurgence of naturalism in philosophy in general (including and especially Anglophone analytic philosophy), despite the criticisms of naturalism that have appeared throughout the 20 th century. (...) Phenomenology seems to be at the center of both of these movements. On the one hand, it is the idea of a mathematized ontology that requires the return to Plato, a mathematized ontology constructed without a reflection on its transcendental grounds. On the other, the resurgence of naturalism is so strong that a book could be imagined and published with the bastard name of Naturalizing Phenomenology , as if the transcendental moment of phenomenology did not transform the very meaning of nature. These signs seem to indicate that we have entered into a phase of regression or even decline in philosophical thinking. If this interpretation of the signs is correct, if we have indeed entered into a phase of regression -- a twofold regression toward Platonism and toward naturalism -- we must ask the following question: is it possible for us to define something like a project or even a research agenda that would allow us to define a way of thinking that might lead us out of the present situation, a situation, it must be said, that seems dire for philosophy in general? If we can determine such a research agenda, perhaps we can also begin to understand what the tradition of “continental philosophy” has stood for. (shrink)

This article examines the transformation of Dante’s image in post-Soviet scholarship. The author shows how Russian philologists Vladimir Bibikhin, Olga Sedakova, and Georgii Chistiakov introduced a new image of Dante to post-Soviet readers in fresh translations of his work, scholarly writings, and lecture courses that revealed previously obscured philosophical and theological dimensions of his texts. The post-Soviet reader came into contact with a more complex image of Dante than previously portrayed in official Soviet literary scholarship: Dante the philosopher, the Christian (...) humanist, the spiritual guide who calls upon individuals to embark upon a difficult but crucial existential journey. The author also shows how the unstable and transitional decade of the 1990s was a time of a particularly active study of Dante’s philosophical and poetic anthropology. Dante’s main themes (personal salvation, activism, living in tradition) resonated profoundly with intellectuals during the late Soviet and early post-Soviet years, which were marked by a special soteriological attitude and a belief that individuals and society not only can but must change. In the second section I explain and partly endorse Ockham’s response to the second argument: that only propositions strictly about the past are accidentally necessary, and past propositions about God’s knowledge of the future are not strictly about the past. Despite the continuous efforts to understand coping processes, very little is known about the utilization of best coping strategies during the COVID-19 pandemic. In this study, we aimed to analyze the coping strategies of individuals who scored high on an adaptive coping questionnaire in order to understand the most adaptive coping strategies during the COVID-19 pandemic. We used consensual qualitative analysis in a team of four researchers and one auditor. The convenience sample from which we identified the high scorers comprised (...) 1,683 participants with a mean age of 31.02 years ranging between 18 and 77 years old. Based on their scoring in the COPE Inventory, nine participants were selected from the sample with the highest scores in coping skills in at least two out of its 15 subscales. In-depth repeated interviews with six participants for the main analysis were conducted, and three were added to check the data saturation. The results showed that the most adaptive coping strategies used during the COVID-19 pandemic could be categorized into four main domains: self-compassion, compassion to others, compassion from others, and mutual compassion. The most frequently mentioned and the most elaborated upon by our respondents was the domain of self-compassion. The most interesting finding was the emergence of the fourth type of compassion, labeled mutual compassion, which referred to deliberate attempts to take care of oneself and others while suffering together in order to elevate the suffering for both. This kind of compassion might arise in the situations of collective suffering, such as a catastrophe or a pandemic and might have the additional benefit of bringing people closer to each other in difficult times. It is hard to think of a more banal statement one could make about the law than to say that it necessarily claims legal authority to govern conduct. What, after all, is a legal institution if not an entity that purports to have the legal power to create rules, confer rights, and impose obligations? Whether legal institutions necessarily claim the moral authority to exercise their legal powers is another question entirely. Galileo asked in his Dialogue of the Two New Sciences what relationship exists between the size of the set of all natural numbers and the size of the set of all square natural numbers. Although one is a proper subset of the other, suggesting that there are strictly fewer squares than natural numbers, the existence of a simple one-to-one correspondence between the two sets suggests that they have, in fact, the same size. Cantor famously based the modern notion of cardinality (...) on the second intuition, but recent advances in mathematical logic (most notably, numerosity theory) have renewed an interest in the question whether Cantor’s way out of Galileo’s paradox was the only possible one. I present a new solution to Galileo’s paradox and argue that it is a better alternative to the Cantorian solution than numerosity theory. In fact, I argue that it is the best possible way out of Galileo's Paradox that can be based on the "Euclidean" intuition that the whole is always greater than any of its proper parts. (shrink)

I defend the view that morality depends on God against the Euthyphro dilemma by arguing that the reasons that God has for determining the moral-natural dependencies might be personal reasons that have non-moral content. I deflect the 'arbitrary whim' worry, but I concede that the account cannot extend to the goodness of God and His will. However, human moral-natural dependencies can be explained by God's will. So a slightly restricted version of divine commandment theory is defensible.

Value analysis establishes a way to practice functional analysis which enables to think all matter as sets of functions. The study of the correlations between the phases of activation of these functions leads to consider the aggregation of correlated activation functions as an attractor in a configuration space. This point of view allows figuring out general behaviors reducing the conceptual gap between microeconomics and macroeconomics. Then, based on a characterization of complex adaptive systems in terms of functional attractors, the theory (...) links together value and physical magnitudes, like work or energy and action. The evolution of these systems is studied from the viewpoints of learning or of voluntary and involuntary interactions with others described in the ultimate way by the strategies, or operators, of which they make use. Three kinds of uncertainties are emphasized among which the uncertainty between the structure and the business outlook of a system is recreated through an analogy between physics and economics. The rationality of the complex functional systems economics is based on value and on market or environment awareness. Equilibria establish potential of agents or players whose profiles are built through the equivalence between a time-dependent payoff at equilibrium and the regular value of the corresponding attractor. The law of supply and demand is naturally founded on unbiased profiles of agents and can be a means of uncertainty reduction and of growth. Freedoms are opportunities to grow, when they result in confidence, and to bear risks in decision-making through an innovative process. (shrink)

This article asks to what extent R.G. Collingwood's 'logic of question and answer' is compatible with the central tenets of Giovanni Gentile's 'actualism'. It is argued that, interpreted as an actualist device, Collingwood's 'logic' offers useful insights into the mechanisms underlying Gentile's theory. Both must confront what I call the 'Actualist Dilemma,' which holds that if there is no reality independent of actual thinking, truth becomes entirely relative to whatever beliefs a thinker happens to have, including those regarding the structures (...) and conditions by which truth is determined. Understood as attempts to address the basic problem of the relation between truth and inquiry, these theories are more alike than they first appear. For both, the foundation of truth is an interpersonal standard regarded from the subjective standpoint of actual thinking. (shrink)
