The paper discusses possible roles of consciousness in a semiotic activity of a cognitive agent. The discussion, we claim, is based on two related approaches to consciousness: on Chalmers’ theory of phenomenal and psychological consciousness and on Damasio’s neural theory, which draws a distinction between core and extended consciousness. Two stages of cognitive-semiotic processing are discussed: the moment of perception of a sign as a meaningful entity and the metasemiotic processes understood as the human capacity to reflect on (...) signs and their usage, analyse and control processes of recognition, interpretation of signs and to detect and correct errors in semiotic activity. In the case of the first stage, it is argued that signs as meaningful entities have a distincly experiential character. The feeling of meaningfulness is a result of phenomenal consciousness, in particular a result of the so-called valuation features of phenomenal experience. I claim that this aspect of cognitive-semiotic activity is possible owing to a special neural mechanism called a semiotic marker. It is argued that semiotic systems have to be able to use signs as signs, i.e. they should display some metacognitive capacities, in particular an ability to analyse semiosis at a metalevel. It is argued that such metasemiosis is dependent on psychological consciousness and is realized at the neural level in the form of extended consciousness. The paper is based on a particular understanding of cognitive semiotics as a discipline involving analyses of cognitive processes as semiotic processes, i.e. processes requiring usage of signs. From a semiotic point of view, the experience of sudden change can involve either an excess of signs or an absence of signs, both of which lead to an incapacity to form coherent representations and, thus, understandings. The comparative study of ethnographic and historical accounts of sudden change requires attention to contextual contingencies, the role of semiotic markers, degrees of heightened consciousness, and modes of symbolic indirection.

Most bodies in this world do not have brains and the minority of animal species that do have brained bodies are descendents from species with more distributed or decentralized nervous systems. Thus, bodies were here first, and only relatively late in evolution did the bodies of a few species grow supplementary organs, brains, sophisticated enough to support a psychological life. Psychological life therefore from the beginning was embedded in and served as a tool for corporeal life. This paper discusses the (...) semiotically controlled dynamics of bodily existence that has allowed the evolution of these seemingly ‘unnatural’ mental and even linguistic kinds of species. It is shown how the skin, on the one hand, makes us belong in the world, and on the other hand, is part of the huge landscape of membranes across which the semiotic self incessantly must be reconstituted. The discussion moves on to the intracellular world of signal transduction through which the activity of single cells are put to service for bodily needs. The paper further considers the mechanisms behind homeostasis and the semiotics of the psycho-neuro-endocrine integration in the body. The concept of semiotic emergence is introduced and a holistic marker hypothesis for why some animals may have an experiential life is suggested. (shrink)

The use of facial recognition systems in concerts provides a perfect pretext to semiotically discuss the role of the face in contemporary culture, identifying different strategies and axiologies (systems of values). In his visionary essay Bruits (“noises”) from 1977, the French thinker Jacques Attali establishes a close connection between music and power and locates it in the site of the collective unfolding of music: the concert hall. Following this hint, the article reconstructs the current debate on facial recognition systems in (...) the music business, with a particular focus on concerts and festivals. The different positions (of musicians, authorities, and professionals) are outlined (some are openly in favor, others openly against), key moments are identified (Beyoncé’s concert in Cardiff, 2017; Jacky Cheung’s in Nanchang, 2018; Taylor Swift’s at the Rose Bowl in Pasadena, 2018; the “banfacialrecognition.com” campaign launched in 2019; the case of Barbara Hart at Brandi Carlile’s show at the Madison Square Garden, 2022) and, finally, the issue is framed within the broader debate about the face as an indexical marker of presence, identity, and humanity (the contrast between Italian philosopher Giorgio Agamben and American sociologist and design theorist Benjamin Bratton is addressed). This chapter develops a semantic theory for maps and situates it within the broader geography of meaning and semiotic significance. The discussion focuses on three central aspects of map semantics: the use of space, line marking, and linguistic tags. It is argued that the treatment of space in maps must be based on geometrical projection from a viewpoint rather than the traditional analysis in terms of spatial isomorphism. The chapter then shows how to integrate the projection-based semantics of maps (...) and the symbolic semantics of markers and tags, within the framework of possible-world semantics. TThis paper aims to evidence the inherently metonymic nature of co-speech gestures. Arguing that motivation in gesture involves iconicity (similarity), indexicality (contiguity), and habit (conventionality) to varying degrees, it demonstrates how a set of metonymic principles may lend a certain systematicity to experientially grounded processes of gestural abstraction and enaction. Introducing visuo-kinetic signs as an umbrella term for co-speech gestures and signed languages, the paper shows how a frame-based approach to gesture may integrate different cognitive/functional linguistic and semiotic accounts (...) of metonymy (e.g., experiential domains, frame metonymy, contiguity, and pragmatic inferencing). The guiding assumption is that gestures metonymically profile deeply embodied, routinized aspects of familiar scenes, that is, the motivating context of frames. The discussion shows how gestures may evoke frame structures exhibiting varying degrees of groundedness, complexity, and schematicity: basic physical action and object frames; more complex frames; and highly abstract, complex frame structures. It thereby provides gestural evidence for the idea that metonymy is more basic and more directly experientially grounded than metaphor and thus often feeds into correlated metaphoric processes. Furthermore, the paper offers some initial insights into how metonymy also seems to induce the emergence of schematic patterns in gesture which may result from action-based and discourse-driven processes of habituation and conventionalization. It exemplifies how these forces may engender grammaticalization of a basic physical action into a gestural marker that shows strong metonymic form reduction, decreased transitivity, and interacting pragmatic functions. Finally, addressing basic metonymic operations in signed lexemes elucidates certain similarities regarding sign constitution in gesture and sign. English and German multimodal discourse data as well as German Sign Language (DGS) are drawn upon to illustrate the theoretical points of the paper. The study is aimed to test the governing-law anchor in the comparative analysis of legal terminology to harmonize the clash of legal cultures in legal translation. It is considered as an adjustment to a juritraductological approach to legal translation which invites legal translators to merge the tools of jurilinguistics, comparative law and traductology in the comparative analysis of legal concepts before selecting a suitable translation solution (Monjean-Decaudin, in: Research methods in legal translation and interpreting, Routledge, 2019). Rather than transposing a (...) text from a source law system to a target law system, legal translators are believed to operate in the bi-semiotic environment of two legal cultures as navigators of their recipients toward understanding the legal concepts under the governing law of the document. To this end a comparative conceptual analysis, that correlates with the parametrization method (Matulewska in Stud Logic Gramm Rhetor 45:161–174, 2016), should be anchored in the analysis of the source law concepts (Šarčević in New Approach to Legal Translation, Kluwer Law International, The Hague, 2000). First, the componential and taxonomic analyses were used to identify conceptual markers/parameters of source concepts to serve as tertia comparationis for the subsequent search of their functional equivalents in the target legal culture. Source concepts and their functional equivalents were subsequently subject to a comparative componential analysis aimed to reveal a degree of their match based on which coinage operations were activated in selecting suitable translation strategies. We hypothesized that the change in the governing-law perspective would trigger changes in translation solutions. The governing-law-anchored process of comparative analysis was detailed and exemplified by the analysis of the conceptual field of Homicide in the Slovak law, English law, and the US Model Penal Code. The subject of the study is the Seljuk cultural code in the cultural landscape of the Crimea. The object of the study is the Seljuk style in the decorative and applied arts and architecture of the Crimea. The article uses the following methods: culturological (ontological and semiotic) analysis in deciphering the meanings of Seljuk elements, the method of historicism in the ontology of Seljuks in the Crimea, the method of analysis of previous studies, the method of synthesis in the (...) identification of ethnic signs. The article discusses the following aspects of the topic: The semantics of the Seljuk code in the cultural landscape of the Crimea is revealed, examples and ways of applying Seljuk stylistics in decorative and applied art and architectural decor of modern and postmodern are considered. 1. The multinational cultural landscape of Crimea consists of the cultures of ethnic groups that inhabited the Crimea in different periods. The leading marker of the definition and self-determination of ethnic groups is religion and folk mythology, embodied in national traditions. A clear example demonstrating ethnic identity and its continuity is folk art. 2. The appearance of the Seljuks in Crimea and the wide spread of the Seljuk style, which has become one of the main components of the "Crimean style" in modern and postmodern architecture, is not accidental and is due to centuries-old ethnic migrations and the mutual influence of cultures. The Seljuk style, therefore, ceases to be purely ethnic, and becomes part of the cultural landscape of the Crimea, used in the decor regardless of the ethnic origin of the author / owner. 3. A special contribution of the authors to the study is the identification and justification of the Seljuk code as one of the main ones in the Crimean stylistics. Sociology of religion is an interdisciplinary formation at the intersection of sociology and religious studies. While trying to explain the relationship of religion -as a noticeable parameter- with other variables and analyze the current pattern, the unity of social sciences and basic Islamic sciences is occasionally needed. It is expected that the intersection points with the auxiliary sciences will be clearly explained, and the research will represent the field by positioning at the center of the sociology of religion. The valid (...) way for readers to understand texts that are written within the discipline of the sociology of religion is to increase the textual representation of research. The basic issue to increase this representation is locked on the determination of the method as in other sciences. Although it can be mentioned that the studies focusing on the method in the field of sociology of religion are based on the philosophy of science and methodology-oriented evaluations, it is clear that the subject does not receive the necessary attention. This study questions the schematic feasibility of the method that can be used in researches within the field of sociology of religion hypothetically. By schematizing, it is meant to show the main tricks of the method use in the sociology of religion and draw a design. For this reason, firstly the problems encountered in the determination of the method will be addressed and then methodological scheme that can be followed in the studies of the sociology of religion will be evaluated together with the mental, the actional and the semiotic process added as an original category. The article focuses on principal information on how to use the method while studying the sociology of religion; however, does not promise an in-depth study of how the method can be used in practice. The most general output of the research is that by following the signs shown in the study, in-depth examples for further studies can be presented. The study emphasizes that the method as the umbrella concept used jointly by the natural and social sciences is not the only mental processes such as induction and deduction, and also explains that it cannot be labeled as actional processes such as research technique, pattern, model, or theory and approach. It is suggested that the method, which is the product of both abstract and concrete effort, should be taken into account not only with its mental and actional aspects, but also with its semiotic process. In the specialized scheme, while the mental and actional categories have more in common with markers in other sub-branches of sociology, the semiotic side differentiates as a new category. The first point to be mentioned is the necessity to draw attention to the indicative meaning of every object seen in the scientific process. Before the research plan, when a sociologist of religion internalizes that every object around him/her is a part of the body of signs, countless inventories of topics worth investigating are presented. Various protocols suggested by semiotics are followed in the process of providing inventory. Secondly, the researcher is expected to discover his/her own semiotic identity. Since the scholars of the sociology of religion, have largely received theological education, there is a greater possibility that their embodied knowledge will be reflected in the text. Through the inclusion of the semiotic process in the method, the researcher learns before the mental process that he/she cannot conduct a scientific study with a subjective perspective in a way to legitimize his own values and tenets. Through this awareness, he/she recognizes his semiotic identity and reaches the kitchen of meaning. When the researcher is closest to objectivity, receptors understand that they are not reading dogmatic text. This situation, on the one hand, leads to an increase in the studies of the sociology of religion to be carried out in a free arena, on the other hand, it allows to establish a stakeholder with dehumanized sociology texts. The reflection of the principle, sociology not sociologies, to the texts improves the use of related concepts by developing the common language, and the arranged conceptual material helps to prevent schematic clutter. Also the researcher of the sociology of religion expands the doors of a cognitive process as much as possible to get more than they think. Reasoning forms such as induction, deduction or hypothetical-deduction determine the direction of whole and particular. The fact that the researcher takes into account both the whole and the part, and the multi-directional connection between them and indicate which mental process he/she followed according to the course of the research, enables the reader to comprehend the method. This commentary addresses the concept of learning stemming from Eva Jablonka and Simona Ginsburg’s theory of the emergence of consciousness. Jablonka and Ginsburg find strong support in biosemiotics for their argument that learning offers an evolutionary transition marker for the emergence of consciousness. Indeed, biosemiotics embraces a view on evolution that integrates both phylogeny and ontogeny. It does not polarize learning and evolving. At the same time, Jablonka and Ginsburg’s argument gives both biosemiotics and learning theory a shake, forcing scholarship (...) in these fields to tackle difficult questions on agency, selfhood, consciousness and anthropological difference. I explore some of the main questions that arise from this theoretical development, particularly in reference to Andrew Stables’ semiotic learning theory, which has been easily nested in a biosemiotic framework. Introduction. The rapid dynamics of the present world results in its complication and construction. Reality turns out to be woven from many quote fragments, representing a collage that a person creates and comprehends through the prism of various texts. Constantly transformable forms come to the fore and, as a result, there exists a plurality of meanings. Models of the world are continuously generated, replacing the actual reality with a multi- tude of spectacular simulacra. The search for ways to comprehend reality (...) through the identification of markers of its transformations is noted, and under- standing becomes the basis of ontology and one of the dominants of consciousness in the last quarter of the 20th and first quarter of the 21st centuries. Signs and symbols of subculture, determined by the context of culture and presented by various means, become one of the markers of the social reality transformations. The purpose of the study is to show the markers of the transformation of the total communication society. Methods. Methodological framework is in G. Gadamer’s hermeneutic approach and the provi- sions of M. Halliday’s social semiotics to coding/de- coding the meanings of operators-markers of social transformations. In addition, other methods were used in the work - methods of analogy, analysis and synthesis. Fragments of the study devoted to the study of chanson as a creolized text required the use of a systematic method. Scientific novelty of the research. The authors re- vealed the specificity of the chanson as a creolized text and present understanding of the subculture as a marker of the social reality transformations, which is manifested by sign-symbolic forms of con- tinuously generated creolized texts, thanks to the technique and technologies of communication. Results. Markers of social reality transformations represent them in the format of creolized texts. What is broadcast in them is filled with a person and, consequently, his responsibility for their con- tent is growing. Semiotic methodology based on the synthesis of the intellectual capital of hermeneutics and linguistics makes it possible for us to consider them as a product of human sign-symbolic activity and decode the content. Conclusions. The specificity of human existence is determined by the existence of a person in the lin- guistic aspect of the world around him - the world is given by language, which involves the search for meaning and understanding of the world. Thinking and language are ontologically connected: mean- ing is expressed by linguistic means. Although the nature of the markers of social reality transforma- tions is different, nevertheless, it is presented and framed as a text, the understanding of which is one of the ways to comprehend social reality. Introduction. Artificial intelligence is a trend of NBIC-convergence and information technologies in particular. Since the 70s of the 20th century it has been a subject of intense debate in the scientific community. A direct indicator of the importance of the topic is the publication dynamics and the annual increase in the number of indexed articles. According to the statistics, Western social sciences are in the top five industry leaders. The purpose of the study is to analyze the Scopus database and (...) identify the key mythologems of the scientific discourse of social sciences (in the field of artificial intelligence). The latter go beyond the boundaries of research norms and standards and express non-reflective research intentions. Methods. The reference base of scientific arti- cles includes works published during the decade (2010—2020). Methods for detecting verbal mark- ers and content analysis were used. At the same time, the emphasis was mainly placed not on quan- titative, but on qualitative analytics as well. The basis for the choice of markers was the frequency of their use in abstracts (abstracts), headings (titles) and keywords. The selection of verbal markers was made in accordance with two conditionally desig- nated categories: «trends», or frequency engineering, technical and social and humanitarian terms, expressing the direction of research practic- es and «mythologemes», or elements of a second- ary semiotic system. Scientific novelty of the study. Scientific novelty is due to the specification of the research subject. In the West, the direction of the so-called «Tech- nological mythology», which focuses mainly on the discourses of art and ideological documents is being developed. The analytics of scientific content makes it possible to remove the existing research limitations of the subject and identify prospects for further study of modern mythology. Content analysis made it possible to identify some extreme- ly general formulations of technological mythologe- mes, which can be refined and concretized. Results. Following the results of the study, a de- scription of three metatrends was made — techno- logical, social and anthropological. All key directions within the boundaries of each trend are listed. At the same time, it is argued that the anthropotrend has a relatively smaller share in the discourse of Western social sciences. As a debatable aspect of the study, five scientific mythologemes were iden- tified and conditionally designated. Interpretations and characteristic examples of the functioning of each are offered. Conclusion. The technological trend is constituted by the data of technical sciences and engineering developments with a social orientation. Sociotrend is determined by the spectrum of technology application areas. The conclusion is made about the diffusion of two trends and the discourses serving these trends. Discursively, the technotrend serves to construct a strictly scientific discourse based not on abstract, but on specific and precise proposi- tions. Particular attention is paid to the discursive mainstream of «smartization», which is characteris- tic of the scientific content of the second decade of the 21st century. Several lines of research within developmental psychology, experimental semiotics and language origins studies have recently converged in their interest in pantomime as a system of bodily communication distinct from both language (spoken or signed) and nonlinguistic gesticulation. These approaches underscore the effectiveness of pantomime, which despite lack of semiotic conventions is capable of communicating complex meanings. However, very little research is available on the structural underpinnings of this effectiveness, that is, the specific properties of pantomime that determine its communicative (...) success. To help fill in this gap, we conducted an exploratory rating study aimed at identifying those properties of pantomime that facilitate its understanding. We analysed an existing corpus of 602 recordings of whole-body re-enactments of short transitive events, coding each of them for 6 properties, and found out that the presence of salient elements (conspicuous objects in a specific semantic space), image mapping (representing the physical orientation of the object), and gender markers (distinguishing between the represented characters) increased the guessability of pantomimes. Recently, the relationship between evolutionary ecology and perceptual science has received renewed attention under perception-mediated selection, a mode of natural selection linking perceptual saliency, rather than veridicality, to fitness. The Interface Theory of Perception (ITP) has been especially prominent in claiming that an organism’s perceptual interface is populated by icons, which arise as a function of evolved, species-specific perceptual interfaces that produce approximations of organisms’ environments through fitness-tuned perceptions. According to perception-mediated selection, perception and behavior calibrate one another as organisms’ (...) capacities to experience and know the objects and properties of their environments lead to responses highlighting certain environmental features selected for survival. We argue this occurs via the Umwelt/Umgebung distinction in ethology, demonstrating that organisms interact with their external environments (Umgebung) through constructed perceptual schema (Umwelt) that produce constrained representations of environmental objects and their properties. Following Peircean semiotics, we claim that ITP’s focus on icons as saliency-simplified markers corresponds to biosemiotics’ understanding of perceptual representations, which manifest as iconic (resembling objects), indexical (referring), or symbolic (arbitrary) modalities, which provide for organisms’ semiotic scaffolding. We argue that ITP provides the computational evidence for biosemiotics’ notion of iconicity, while biosemiotics provides explanation within ITP for how iconicity can build up into indices and symbols. The common contention of these separate frameworks that the process of perception tracks saliency rather than veridicality suggests that digital/dyadic perceptual strategies will be outcompeted by their semiotic/triadic counterparts. This carries implications for evolutionary theory as well as theories of cognition. (shrink)

Attention is viewed here as a complex of semiotic processes that leads to animals’ choices and behavioral decisions. Besides the focusing role of attention, many other processes, such as prioritizing and binding perceptions to coherent reality, have historically been considered to be parts of attention. Semiotic tools can help to understand relations between perception and meaning-making and, therefore, to solve questions of attention’s active or passive nature. Are animals actively shaping it, or is it something that happens to (...) them? This article attempts to synthesize different theories of attention from the cognitive sciences and Uexküllian semiotics into a model that shows how meaning-making can be the basis for future attention. For this several different theories of attention belonging to different disciplines have been revisited and synthezised. Here, it is claimed that although it seems that something in the environment can capture attention without animals’ active participation, attention is actually an active process that depends on meaning-making and interpretation. Attention is also viewed in the context of search behavior and connected with Jakob von Uexküll’s terms of ‘search image’ and ‘search tone’, to which a a new term ‘search schema’ was added. Additionally, it is suggested that some animals can use qualisigns as category markers for attendance. The process of prioritizing attention depends on the construction of sense organs, which makes it species-specific and also from the individual experiences, meanings, and habits of the organism. Jakob von Uexküll imagined Umwelt as a “soap bubble” containing everything an animal can perceive. Attention limits perception in the current moment even more, being metaphorically speaking, a smaller dynamic bubble inside a big Umwelt bubble. (shrink)

The idea that a sign has meaning only in context invites serious inquiry into the meaning of meaning, context, and meaning-in-context. In this paper, and following Bateson’s ecological approach to the mind, I suggest that meaning is a form of coordination between interacting agents, and that this form of coordination is orchestrated through context markers, the variability of the sign, and symmetric transformation of the agents. Rhythm is generally taken to refer to a temporal pattern of events. Yet in recent years, across diverse fields in the arts, humanities, and social sciences, it has come to serve as the conceptual marker for a wide range of new approaches to understanding relations and relationality, following most explicitly from the late work of Henri Lefebvre. This article explores the temporal aspect of such relational thinking, in particular asking how time is implicated in relations, and how it can be (...) meaningful in those relations. The sense of time is surveyed from the perspectives of both cognition and metaphysics as well as with reference to music scholarship and social theory, and key threads are drawn, from the writings of Gaston Bachelard and Charles Sanders Peirce in particular, in order to suggest that time can be a sign, and that the signifying properties of rhythm have critical social consequences. The purpose of this study seeks to analyze the problem of Unity in Diversity as a Source of Politics and Cultural Identity of the Indonesian Nation in Legal Formation. In general, the process of establishing customary, national, regional and international law in various parts of the world no one knows even uses Bhineka Tunggal Ika as the source of legal formation. However, often the formation of law in Indonesia refers to the philosophical meaning of Unity in Diversity. The formulation of (...) the research problem: 1) What are the markers of Unity in Diversity in Legal Formation?; 2) Why is Bhineka Tunggal Ika so important in the Formation of Law in Indonesia?; 3) Is there a contribution of Bhineka Tunggal Ika in the formation of customary law? This research was completed using qualitative methods. All data in this study are descriptive which have been collected directly or indirectly. Data acquisition is optimized through a literature study. All data were analyzed qualitatively to solve the research problem. The results showed that: 1) Unity in Diversity can be a marker of Indonesian national cultural identity in Legal Pluralism; 2) Bhineka Tunggal Ika in the formation of state law is considered relevant as a political source that is able to accommodate Customary Law and Religious Law into State Law; 3) Unity in Diversity as the identity of Indonesian Nation Culture, as well as political sources, has contributed in the spirit of the formation of Customary Law in the midst of the times. Statues, monuments, cenotaphs and markers litter the landscape of Plato’s Phaedrus. By drawing together these numerous references and examining the economy of these silent symbols, we can gain an insight into Plato’s project, especially as it relates to questions of narrative, speech and writing. While the examination of the myth of Theuth is familiar to scholars of both Plato and Derrida, what is often overlooked is the way in which writing and speech are represented in the text by monuments, (...) which speak through silence, and more often than not memorialize those who can no longer speak, or whose speech is, like themselves, rendered dead in writing. Like the pharmakon of writing itself, statuary operates within the economy of signs, an economy of reminding, which within the system of metaphysics leads not to the transcendent realm of ideas but ties us to the realm of opinion. However, by examining the role of myth and its relation to statuary in the Phaedrus, a new interpretation emerges, which allows for myth and the silent voices of the dead as a way to initiation. The aim of this qualitative analysis is to test whether the linguistic evidence available supports the allegation that the participation in these recordings by one of the accused, Mohamed Houli Chemlal, had been planned by his interlocutors. Results show, first, that the exchanges analyzed present features indicative of both spontaneity and (limited) planification. Second, that Houli makes key contributions to the unfolding of the interactions shown in the recordings and that he does so in a cooperative and apparently relaxed manner, which could at best provide only partial support to his allegations. It is claimed that forensic linguistic analysis can generate valuable insights within terrorism-related legal proceedings. (shrink)

This paper is aimed at assessing how power, control, and resistance come into play and how resistance counteracts power and control in police investigative interviewing. Considering that the Philippines was once a colony of the United States, it is essential to compare the two samples as the Philippine legal system is highly patterned after the American jurisprudence (Mercullo in JForensicRes 11:1–4, 2020). A total of 10 Philippine and American police interviews were examined. While the Philippine corpus was obtained from the Pasay City Police Station, Metro Manila, the American corpus was culled from forensicling.com, an open-access website containing forensic linguistic data. Findings revealed that power and control were employed by the police in both contexts with 109 evidential markers (50.7%) and 2,443 representative speech acts (63.3%) having the highest frequency of occurrence. What is striking is the fact that police officers in both Philippine and American contexts show power and control in their utterances to be able to achieve the goal of police interviewing, that is, to gather information and elicit voluntary responses from the interviewees. Through this study, it is hoped that interviewers will be able to explore a better system of the questioning process that may lead the interviewees to cooperate more with them and arrive at a more accurate information. Photographs by one of French cinema's most influential and enigmatic artists. Any new film and any new book by French filmmaker Chris Marker is an event. Marker gave film lovers one of their most memorable experiences with La Jetée —a time-travel montage set after a nuclear war that inspired Terry Gilliam's Twelve Monkeys. His still camerawork is not as well known, but Marker has been taking photographs as long as he has been making films. Staring Back presents 200 black-and-white photographs (...) from Marker's personal archives, taken from 1952 to 2006. Some of the photographs are related to his classic films, others are portraits of famous faces, but most are pictures of people Marker has encountered as he has traveled the world. The central section of the book contains a series of photographs documenting political protests Marker has witnessed, including the march on the Pentagon in 1967, the events of May 1968 in Paris, and the tumultuous 2006 demonstrations protesting the French government's proposed employment policies. The photographs are accompanied by several unpublished texts by Marker, including the English language text of The Case of the Grinning Cat and Marker's annotations for some of the photos. The book—which appears in conjunction with an exhibition at the Wexner Center for the Arts at The Ohio State University—also includes essays by Wexner Center curator Bill Horrigan and art historian Molly Nesbit. In light of new threats in the field of human rights stemming from global geopolitical shifts, criminal law is facing a myriad of new challenges that require adequate responses. Given this context, it is crucial to develop and refine criminal legal measures (CLMs) in order to safeguard societal interests and maintain stability in social relations. This paper undertakes an analysis of contemporary problems in the area of legal regulation and CLMs, as well as assesses the effectiveness of CLMs for individuals (...) engaged in criminal misconduct. The research provides grounds for arguing that the absence of a clear definition of CLMs in Ukrainian legal science renders the term potentially problematic. Moreover, there are currently no taxonomic markers or criteria for classifying CLMs, nor methods for evaluating the effectiveness of specific measures. Within the framework of the announced reforms in Ukraine’s criminal law, it becomes imperative not only to revisit the concept of CLMs but also to develop robust methodologies for assessing their effectiveness. This measure appears necessary both in light of the need to legally formalize CLMs and to systematize them in the future. (shrink)

Since its inception in the Middle Ages, the university classroom can be characterized by students gathered around a sage who imparts his or her knowledge. However, the effective classroom of today looks vastly different: First-year engineering students not only learn basic engineering principles, but are also guided to consider their own inner values and motivations as they design and build adaptive devices for people with disabilities; students in a large chemistry lecture work animatedly together in small groups on inquiry-based activities (...) while an instructor and teaching assistants circulate and guide their learning; students learning differential equations practice explicit metacognitive skills while problem-solving in class. Even though educational research, especially research that is targeted at STEM disciplines, demonstrates what most effectively engages students and supports their learning, many of today's classrooms look much like they did a century ago, with a professor delivering a primarily one-way lecture and students passively sitting in seats bolted to the floor. At this juncture in history, colleges and universities face a public call to engage a more diverse representation of students in effective learning, persistence, and degree attainment, and to do so economically and efficiently. It is essential that institutions draw upon methods demonstrated to effectively increase student learning and success. Educational researchers have thoroughly explored the "basic" science in this area, and a body of literature documents effective evidence-based instructional practices, hereafter referred to as EBIPs. While the complexities of interpreting in constrained legal contexts such as trials may gradually be getting better understood by legal professionals, the particular difficulties of interpreting for the Deaf remain largely overlooked, and the recent involvement of citizen judges in Japan’s justice system makes it even more important to raise awareness about this aspect of language disadvantage. This paper focuses on a key feature of Japanese Sign Language: the non-manual markers produced by facial and body movements that accompany hand (...) and finger signs. Research shows such markers to be poorly understood by non-Deaf observers and indeed even sign language interpreters sometimes conflate them with gestures used by hearing people. (shrink)
