The practice-dependent approach to justice has received a lot of attention in post-millennium political philosophy. It has been developed in different directions and its normative implications have been criticized, but little attention has been directed to the very distinction between practice-dependence and practice-independence and the question of what theoretically differentiates a practice-dependent account from mainstream practice-independent accounts. The core premises of the practice-dependent approach, proponents argue, are meta-normative and methodological. (...) A key feature is the presumption that a concept of justice is dependent on the function or aim of the social practices to which it is supposed to be applied. Closely related to this meta-normative thesis is an interpretive methodology for deriving principles of justice from facts about existing practices, in particular regarding their point and purpose. These two premises, practice-dependent theorists claim, differentiate their account since they are not accepted by practice-independent accounts and they justify different principles of justice than practice-independent accounts. Our aim in this article is to refute both and, demonstrating that practice-independent accounts may indeed accept the meta-normative and methodological premises of the practice-dependent accounts, and that we are given no theoretical reason to think that practice-dependent accounts justify other principles of justice for a practice than do practice-independent accounts. In other words, practice-dependent theorists have not substantiated their claim that practice-dependence is theoretically differentiated from mainstream accounts. When practice-dependent proponents argue for other principles of justice than mainstream theorists, it will be for the usual reason in normative theory: their first-order normative arguments differ. An increasingly popular approach to global justice claims we should be ‘integrationist,’ where integrationism represents an attempt to unify our theorising between different domains of global politics. These political theorists have argued that we cannot identify plausible principles in one domain, such as climate justice, which are not sensitive to general moral concerns. This paper argues we ought to reject the concept of integrationism. It shows that integrationism is either trivial, or it obscures relevant disagreement by ignoring the distinctive (...) methodological and substantive commitments held by its opponents. The paper then argues that the relevant disagreement is actually about the role of practices for political philosophy and, as such, should be framed in terms of the distinction between practice-dependent and practice-independent theory. Finally, I provide my own account of that distinction, identifying a practice-dependent claim that those concerned about the narrowness of prominent accounts of global justice should target. In this paper, I make three points. The first is that there is indeed a distinctive approach to moral methodology, different from standard moral reasoning, that can be described as “practice-dependence”. I argue that its distinctness lies in recommending an aptness claim , namely that moral principles for regulating social practices must be principles for better fulfilling the point of those practices, a point discoverable in shared understandings of the practice. Participants treat domestic political societies as having (...) a different point to the practice of international relations. On this approach, then, different moral principles apply in each case: principles of distributive justice between citizens in the former and principles of cooperative fairness between states in the latter. My second point is that this approach fails, however, an important test which I call the justifiability constraint . Any formulation of a moral principle assigning rights and duties, benefits and burdens, to people should be justifiable to those persons by reference to a moral value. Yet, as I show, the practice-dependence view cannot offer any justification based on moral value for the aptness claim. My last point is that both endorsers and critics of practice-dependence have mistakenly attributed this approach to theorists who restrict the scope of justice on the basis of moral justification. Such views are, in fact, incompatible with the aptness claim given that they offer plausible independently derived moral grounds for restricting the scope of justice. They are also compatible with the justifiability constraint. For these reasons, I conclude that practice-dependence is a red herring for debates on global justice. (shrink)

The practice-dependence approach offers a new way of theorizing about human rights and distributive justice that promises to settle some of the ongoing disputes about their justification, content, and scope. In sharp contrast with naturalistic theories, which conceive of human rights as an abstract moral ideal, practice-dependence theories regard human rights as a public political doctrine constructed to play a specific regulatory role in contemporary world politics. They maintain accordingly that the content of those rights should be (...) determined in light of the role played by human rights in the contemporary practice of international politics. Similarly, those theories do not conceive of distributive justice simply as a moral virtue proper to all human beings, but rather as a political value arising as necessary to the regulation of certain social and political practices. In this view, the content and scope of justice should depend on an interpretation of the structure and point of the practices in question. The articles gathered in this volume propose a comprehensive introduction to the practice-dependence approach by some of its major supporters, as well as a critical discussion of its theoretical promises. A shared presumption among practice-dependent theorists is that a principle of justice is dependent on the function or aim of the practice to which it is supposed to be applied. In recent contributions to this debate, the condition of epistemic uncertainty plays a significant role for motivating and justifying a practice-dependent view. This paper analyses the role of epistemic uncertainty in justifying a practice-dependent approach. We see two kinds of epistemic uncertainty (...) allegedly playing this justificatory role. What we call ‘normative epistemic uncertainty’ emerges from dealing with the problem of value uncertainty in justifying applied principles when our higher-level principles are open-textured, that is, when their content is too vague or unclear to generate determinate prescriptions. What we call ‘descriptive epistemic uncertainty’ emerges from dealing with uncertainty about empirical facts, such as the problem of moral assurance, that is, the problem that the requirements of justice cannot go beyond arrangements that we can know with reasonable confidence that we can jointly establish and maintain. In both cases, practice-dependent theorists conclude that the condition of epistemic uncertainty justifies a practice-dependent approach, which puts certain restrictions on theorizing regulative principles and has wide-ranging practical implications for the scope of justice. Our claim in this paper is that neither kind of epistemic uncertainty justifies a practice-dependent approach. (shrink)

This review essay discusses two recent attempts to reform the framework in which issues of international and global justice are discussed: Iris Marion Young's ?social connection' model and the practice-dependent approach, here exemplified by Ayelet Banai, Miriam Ronzoni and Christian Schemmel's edited collection. I argue that while Young's model may fit some issues of international or global justice, it misconceives the problems that many of them pose. Indeed, its difficulties point precisely in the direction of practice (...) dependence as it is presented by Banai et al. I go on to discuss what seem to be the strengths of that method, and particularly Banai et al.'s defence of it against the common claim that it is biased towards the status quo. It is often claimed that in normative political theory political imagination should remain unaffected by real-world contingencies: our idea of how the world “ought to be” should be independent from how the world “actually is”. According to the practice-dependent thesis, instead, “[t]he content, scope, and justification of a conception of justice depends on the structure and form of the practices that the conception is intended to govern”. This methodological approach conceives the relationship between theory and practice (...) as an interplay: normative theory applies to practice, but practices are also able to affect the content of normative theory. In this paper, I argue that the interplay between theory and practices that the practice-dependent method generates has not been fully understood. Though it may – at a superficial look – appear as a method compliant with the status quo, I will show that this method implies an idea of political theory as an activity of continuous critical engagement. Given an extended account of the method, political imagination has boundaries but these are not fixed nor easilydefinable: the real-world fact that constrains practice-dependent principles is the point and purpose of the practice they are meant to apply to, but this fact in itself is partly shaped and critically assessed by the theorist. In recent years, several political theorists have argued that reasonable principles of justice are practice-dependent. In this paper it is suggested that we can distinguish between at least two main models for doing practice-dependent theorizing about justice, interpretivism and constructivism, and that they can be understood as based in two different conceptions of practices. It is then argued that the reliance on the notion of participants that characterizes interpretivism disables this approach from adequately addressing certain (...) matters of justice and that a better way of developing the idea of practice-dependence can be found in a constructivism that starts from the Rawlsian idea of overlapping consensus, but which shifts the focus of that approach from societies to a more open-ended category of domains, and which understands the parties to a possible overlapping consensus as stakeholders in a certain set of interconnected practices. The right to religious liberty as for instance set out in the European Convention of Human Rights protects acts of religious observance. Such protection can clash with other considerations, including laws aimed at protecting other state interests. Religious freedom therefore requires an account of when the right should lead to exemptions from other laws and when the right can legitimately be limited. Alan Patten has proposed a Fair Opportunity view of the normative logic of religious liberty. But Patten’s view faces (...) several problems. The normative work in his view is mainly done by added accounts of reasonable claims and of justifiability. So, the Fair Opportunity view in itself does not provide a normative criterion. Defenses of the Fair Opportunity view must therefore turn on the theoretical preferability of its structural features. But the Fair Opportunity view has the wrong form to capture the right to freedom of religion. The form of the right to freedom of religion is due to how its point is to address how states limit the liberty of citizens. Given a practice dependent approach, which assigns importance to the point and purpose of the right to freedom of religion, Patten’s theory is thus problematic. (shrink)

The practice-dependent approach to global justice makes a welcome attempt to steer a course between egalitarian liberal cosmopolitanism, on the one hand, and statism and nationalism, on the other. In so doing, it seeks to reconcile the universality of justice with the particular role principles of justice play within the context of different social practices. In this paper, I argue, however, that the “practice turn” in theorising about justice has not gone far enough, either methodologically or (...) substantively. Methodologically, it is necessary to move beyond the residual positivism of the practice-dependent approach to an interpretive approach that takes account of the reflexive, developmental nature of social practices. Substantively, focusing on the reflexivity of social practices, and particularly practices of reflexive constitution-making, provides a framework for a republican approach to international justice concerned with reconciling Kant’s idea of the universality of justice with the emphasis on popular sovereignty of Rousseau and Hegel. BackgroundRecent advancements in neuroscientific techniques have allowed us to make huge progress in our understanding of memories, and in turn has paved the way for new memory modification technologies that can modulate memories with a degree of precision, which was not previously possible. With advancements in such techniques, new and critical ethical questions have emerged. Understanding and framing these ethical questions within the current philosophical theories is crucial in order to systematically examine them as we translate these techniques to the (...) clinic.Main bodyIn this paper, we discuss the ethical implications of modern neuroscience techniques that aim to disrupt or enhance memories. We attempt to frame the MMTs in the context of existing ethical philosophical theories to provide a cohesive analysis of the myriad of ethical quagmires that might emerge from such technologies. We argue the application of Aristotle’s Golden Mean and multiple accounts of authenticity are useful in approaching the ethical questions surrounding MMTs. We then propose a framework in which ethical considerations can be systematically examined. Lastly, we provide caveats and considerations for the use of this framework. Overall, we provide a practical approach for the ethical use of MMTs depending on the situation.ConclusionWhile at face value, our model appears to put severe limitations on the application of MMTs, we are not completely opposed to their use, but rather our framework guides the agent to consider the implications before making any decisions. Most importantly, we argue that the use of MMTs does not reduce the responsibility of the initial decision, and the agent must accept the post-MMT self as the new “true self” regardless of the outcome. As the developmental trajectory of MMTs suggests we are getting closer to practical clinical applications, ethical concerns across a wide range of disciplines need to be addressed to develop best strategies and policies when dealing with MMTs. If this can be achieved, we believe the ethical use of MMTs is not only possible but would also be of tremendous benefit to many people suffering from memory-related mental disorders. (shrink)

The empirical study of language is a young field in contemporary linguistics. This being the case, and following a natural development process, the field is currently at a stage where different research methods and experimental approaches are being put into question in terms of their validity. Without pretending to provide an answer with respect to the best way to conduct linguistics related experimental research, in this article we aim at examining the process that researchers follow in the design and implementation (...) of experimental linguistics research with a goal to validate specific theoretical linguistic analyses. First, we discuss the general challenges that experimental work faces in finding a compromise between addressing theoretically relevant questions and being able to implement these questions in a specific controlled experimental paradigm. We discuss the Granularity Mismatch Problem (Poeppel and Embick, 2005 ) which addresses the challenges that research that is trying to bridge the representations and computations of language and their psycholinguistic/neurolinguistic evidence faces, and the basic assumptions that interdisciplinary research needs to consider due to the different conceptual granularity of the objects under study. To illustrate the practical implications of the points addressed, we compare two approaches to perform linguistic experimental research by reviewing a number of our own studies strongly grounded on theoretically informed questions. First, we show how linguistic phenomena similar at a conceptual level can be tested within the same language using measurement of event-related potentials (ERP) by discussing results from two ERP experiments on the processing of long-distance backward dependencies that involve coreference and negative polarity items respectively in Dutch. Second, we examine how the same linguistic phenomenon can be tested in different languages using reading time measures by discussing the outcome of four self-paced reading experiments on the processing of in-situ wh -questions in Mandarin Chinese and French. Finally, we review the implications that our findings have for the specific theoretical linguistics questions that we originally aimed to address. We conclude with an overview of the general insights that can be gained from the role of structural hierarchy and grammatical constraints in processing and the existing limitations on the generalization of results. Eoin Carney | : Continuing on from recent discussions on the overlap between Paul Ricoeur’s philosophy and care ethics, this article will aim to clarify the status of practice in Ricoeur’s work. I will argue that even though Ricoeur’s philosophy is indeed marked by its “desire for a foundation,” as care ethicist Joan Tronto has pointed out, this aim is more of a fragile wager than a principle, and is always at risk of being overturned by practices and other (...) worldviews. I will demonstrate this point by arguing that Ricoeur’s hermeneutic approach to practice leads to the view that objective methods of knowledge and explanation are always grounded by the broader hermeneutic task of practical understanding and care for the self; in moral reasoning, Ricoeur’s analysis of the conflict between respect for the rule and respect for persons results in his prioritizing of respect for the singular other rather than the universal rule, meaning that the other can always disrupt and reorient universal or foundational modes of reasoning; and finally within healthcare relations Ricoeur aims to develop an alternative understanding of respect that places it in a dialectical relation with care. These practice-oriented readings of hermeneutics, morality, and respect aim to open up a dialogue between care ethics and philosophical approaches that have often been placed outside of care ethics. | : Poursuivant les récentes discussions concernant les recoupements entre la philosophie de Paul Ricoeur et les éthiques du care, cet article a pour objectif de clarifier le statut de la pratique dans l’oeuvre de Ricoeur. Those advocating practice-dependent approaches to political philosophy have tended to conceptualize justice as a constraint on politics—a position the author calls the "constraint model." This article instead argues that justice is a distinctive purpose or telos of politics—the "internalist model." If the internalist model is sound, justice is no more a constraint on politics than beauty is a constraint on art. The author argues that the constraint model cannot meet two challenges: It cannot distinguish the principles of justice (...) from the requirements of political legitimacy, and it cannot explain how we can gain critical purchase on our practices without collapsing into practice-independent theory. Every academic endeavour rests ultimately on a particular assumption of human nature. Two views of human nature are compared and contrasted: (1) a utilitarian naturalistic humanism which holds essentially the view that human nature is materialistic, and (2) an Aristotelian-Thomistic natural law/virtue ethics humanism which holds the view that human nature is both materialistic and spiritualistic. This paper argues that the latter view better captures and explains the metaphysical realities of human nature. In addition, the role of virtues and its (...) applications in management practice are presented. Organisational policy mechanisms and managerial implications will depend on which view of human nature one adopts. The failure to integrate the virtues and natural law ethical principles into management practice threatens the stability and survival of the firm since they are required to correct the dysfunctional aspects and ethical deficits of the current business philosophy. The two center time dependent Dirac equation, for an electron in the external field of two colliding ultrarelativistic heavy ions is considered. In the ultrarelativistic limit, the ions are practically moving at the speed of light and the electromagnetic fields of the ions are confined to the light fronts by the extreme Lorentz contraction and by the choice of gauge, designed to remove the long-range Coulomb effects. An exact solution to the ultrarelativistic limit of the two-center Dirac equation is (...) found by using light-front variables and a light-fronts representation. Previously unexplained experimental results obtained at CERN's SPS are explained in this way and predictions are made as to where one should look, in momentum space, and in space-time, if one wants to study and observe non-perturbative electromagnetic pair-production effects in extremely relativistic heavy-ion collisions. Contrary to comparativist critics of ideal theory, I argue that ideal institutions become relevant for issues of nonideal theory through their role as part of the ideal guidance approach (IGA). So far, the most important argument against the IGA has been the second-best argument. However, this argument is only damaging for the IGA under certain conditions: Firstly, when the ideal is not realizable, and, secondly, when the path to the ideal does not contain the second-best world. Since it is (...) an empirical question whether this is the case, the article discusses the empirical relevance of the second-best argument. By employing causal mechanisms identified in the institutionalist literature – path dependence and institutional complementarity – I argue that the IGA actually offers better prospects for the evaluation of nonideal alternatives than the comparative approach. This is, because the latter systematically excludes the information of how an ideal institutional design looks like from consideration. I also discuss and reject the objection that a more comprehensive version of the comparative approach could take these issues into consideration: Such an approach is either epistemically infeasible or very similar to the IGA. This paper begins by reviewing dominant themes in current teaching of professional ethics in engineering education. In contrast to more traditional approaches that simulate ethical practice by using ethical theories to reason through micro-level ethical dilemmas, this paper proposes a pragmatic approach to ethics that places more emphasis on the practical plausibility of ethical decision-making. In addition to the quality of ethical justification, the value of a moral action also depends on its effectiveness in solving an ethical dilemma, (...) cultivating healthy working relationships, negotiating existing organizational cultures, and achieving contextual plausibility in everyday professional practice. This paper uses a cross-cultural ethics scenario to further elaborate how a pragmatic approach can help us rethink ethical reasoning, as well as ethics instruction and assessment. This paper is expected to be of interest to educators eager to improve the ability of engineers and other professional students to effectively and appropriately deal with the kinds of everyday ethical issues they will likely face in their careers. An existential-dialectical-phenomenological approach is applied to the understanding of the universal tensions between multicultural and transcultural value-laden modalities of existence. Differences in cultural comportments are described as variations in local human ways in dealing with universal and bipolar existential modalities, values, or needs, such as freedom versus limitation, independence versus dependence, and connectedness versus separateness. Cultures are described as being organized around and as providing their members with ways of dealing with these value-laden dialectical dilemmas. Cultures are further depicted (...) as legitimating one dialectical pole to the detriment of the other dialectical pole. Some cultures, for example, legitimate the dialectical poles of freedom, independence, and separateness, while deemphasizing or denying the dialectical poles of limitation, dependence, and connectedness. Other cultures legitimate the opposite. These one-sided value orientations of cultures are referred to as cultural tilts. The implications for the practice of multicultural counseling and phenomenologically-based qualitative research are delineated. (shrink)

Evidence-based medicine (EBM) has thus far failed to adequately account for the appropriate incorporation of other potential warrants for medical decision making into clinical practice. In particular, EBM has struggled with the value and integration of other kinds of medical knowledge, such as those derived from clinical experience or based on pathophysiologic rationale. The general priority given to empirical evidence derived from clinical research in all EBM approaches is not epistemically tenable. A casuistic alternative to EBM approaches recognizes that (...) five distinct topics, 1) empirical evidence, 2) experiential evidence, 3) pathophysiologic rationale, 4) patient goals and values, and 5) system features are potentially relevant to any clinical decision. No single topic has a general priority over any other and the relative importance of a topic will depend upon the circumstances of the particular case. The skilled clinician must weigh these potentially conflicting evidentiary and non-evidentiary warrants for action, employing both practical and theoretical reasoning, in order to arrive at the best choice for an individual patient. This article discusses practice-near research in human services, a cluster of methodologies that may include thick description, intensive reflexivity, and the study of emotional and relational processes. Such methods aim to get as near as possible to experiences at the relational interface between institutions and the practice field. Psychoanalytically informed approaches to research are particularly fruitful here. In this article these are discussed in relation to the reflective practice and critical reflection traditions which have been widely discussed (...) within social work, healthcare, education, and allied fields. Drawing on Clifford Geertz's distinction between experience-near and experience-distant inquiry, this article also discusses the relationship between practice-near and practice-distant approaches. These may be used in parallel to investigate different but related objects of interest and can be used to triangulate different data when focussing on the same object; finally practice-near and practice-distant methods can be combined in interpretive procedures which depend on an oscillation between immersion within and distancing from the field. It is within such interpretive activity that habits of attention and interpretation developed in clinical settings, and described in the work of Wilfred Bion, can be brought to bear usefully on data analysis. My dissertation covers a number of different topics in Kant scholarship, but is driven by one central question: how do our sense-based capacities to perceive, desire, and feel relate to our capacity to reason? I take the answer to this question to be key to understanding much about Kant’s philosophical system. For topics as diverse as the role that sensation plays in practical knowledge, the character of moral motivation, the nature of evil, or Kant’s theory that we are morally required (...) to believe in our immortality and God’s existence, I claim that the correct reading turns on a novel approach to the relation between our rational and sensitive capacities. To properly understand this relation, we must overcome the deeply entrenched thought that Kant inherits his conception of reason from the rationalists, and his conception of sense experience from the empiricists. This would be to adopt a fundamentally dualistic philosophy, on which reason and the senses are independently intelligible and sometimes even diametrically opposed. On Kant’s actual view, our capacities to perceive, feel, and desire are metaphysically interdependent with and thus not intelligible in isolation from our capacity to reason. Developing the details of this more unified position leads to satisfying philosophical accounts of a number of controversial issues in Kant scholarship that have suffered under a dualistic framework. Over the last few decades, skepticism about political and moral experts has grown into a serious social problem, undermining the functioning of liberal democratic regimes. Indeed, meritocracy-that is, government by hard working, public-spirited people with high levels of relevant expertise-has never looked so promising as an alternative to the dangers of know-nothing populism. One cultural tradition has devoted sustained attention to the idea of meritocracy, as well as to the cultivation of true expertise or mastery: Confucianism. Mastery, Dependence, and the (...) Ethics of Authority presents a compelling analysis of expertise and authority, and examines classical Confucian conceptions of mastery, dependence, and human relationships in order to suggest new approaches to these issues in ethics and political theory. Contemporary Westerners are heirs to multiple traditions that are suspicious of authority, especially coercive political authority. We are also increasingly wary of dependence, which now often seems to signify weakness, neediness, and pathology. Analysts commonly presume that both authority and dependence threaten human autonomy, and are thus intrinsically problematic. But these judgments are mistaken. Our capacity for autonomy needs to be cultivated over time through deliberate practices of training, in which we depend on the guidance of virtuous and skilled teachers. Confucian thought provides a subtle and powerful analysis of one version of this training process, and of the social supports such an education in autonomy requires-as well as the social value of having virtuous and skilled leaders. Early Confucians also argue that human life is marked by numerous interacting forms of dependence, which are not only ineradicable, but in many ways good. On a Confucian view, it is natural, healthy, and good for people to be deeply dependent on others in a variety of ways across the full human lifespan. They teach us that individual autonomy only develops within a social matrix, structured by relationships of mutual dependence that can either help or hinder it, including a variety of authority relations. Social practices are a key concept in Raimo Tuomela’s work on sociality, they help us understand many aspects of sociality, including customs, traditions, and institutions. The key elements in his analysis of social practices are we-attitudes and pattern-governed behaviors. I am sympathetic to Tuomela’s approach to sociality to the extent that it recognizes and spells out many sufficient and necessary conditions for different types of social activity that together make up sociality. I agree with him that the complexity and (...) multiplicity of human agency, both when acting individually as well as when acting collectively or cooperatively, indeed calls for such an analysis with multiple sufficiency conditions. I especially appreciate his acknowledgement of the role of habits, customs, and the like for sociality. His three most recent books all pay attention to this aspect of human being. In this paper, I will zoom in on this aspect of Tuomela’s work and look at how he integrates habits, customs, and skills. In Tuomela’s words, I will zoom in on pattern-governed behaviors and social practices. On the one hand he gives them an important role and mentions customs often, as the “collective counterpart of habits” (Tuomela, Raimo. The Philosophy of Social Practices: A Collective Acceptance View. Cambridge: Cambridge University Press. https://doi.org/10.1017/CBO9780511487446, 2002, p. 121). At the same time, the analysis of habits and customs left me wanting. I will argue that they are too strongly dependent on and are integrated in a context in which we-attitudes are the key explanatory element. (shrink)

The term “emotional practices” is gaining currency in the historical study of emotions. This essay discusses the theoretical and methodological implications of this concept. A definition of emotion informed by practice theory promises to bridge persistent dichotomies with which historians of emotion grapple, such as body and mind, structure and agency, as well as expression and experience. Practice theory emphasizes the importance of habituation and social context and is thus consistent with, and could enrich, psychological models of situated, (...) distributed, and embodied cognition and their approaches to the study of emotion.It is suggested here that practices not only generate emotions, but that emotions themselves can be viewed as a practical engagement with the world. Conceiving of emotions as practices means understanding them as emerging from bodily dispositions conditioned by a social context, which always has cultural and historical specificity. Emotion-as-practice is bound up with and dependent on “emotional practices,” defined here as practices involving the self , language, material artifacts, the environment, and other people. Drawing on Pierre Bourdieu's concept of habitus, the essay emphasizes that the body is not a static, timeless, universal foundation that produces ahistorical emotional arousal, but is itself socially situated, adaptive, trained, plastic, and thus historical. Four kinds of emotional practices that make use of the capacities of a body trained by specific social settings and power relations are sketched out—mobilizing, naming, communicating, and regulating emotion—as are consequences for method in historical research. Combating homophobia, racism, sexism, and other forms of discrimination and violence in our society requires more than just focusing on the overt acts of prejudiced and abusive individuals. The very intelligibility of such acts, in fact, depends upon a background of shared beliefs, attitudes, and behaviors that together form the context of social practices in which these acts come to have the meaning they do. This book, inspired by Wittgenstein as well as feminist and critical race theory, shines a critical (...) light on this background in order to show that we all share more responsibility for the persistence of oppressive social practices than we commonly suppose—or than traditional moral theories that connect responsibility just with the actions, rights, and liberties of individuals would lead us to believe. First sketching a nonessentialist view of rationality, and emphasizing the role of power relations, Peg O’Connor then examines in subsequent chapters the relationship between a variety of "foreground" actions and "background" practices: burnings of African American churches, hate speech, child sexual abuse, coming out as a gay or lesbian teenager, and racial integration of public and private spaces. These examples serve to illuminate when our "language games" reinforce oppression and when they allow possibilities for resistance. Attending to the background, O’Connor argues, can give us insight into ways of transforming the nature and meaning of foreground actions. (shrink)

Research on behavioral ethics is thriving and intends to offer advice that can be used by practitioners to improve the practice of ethics management. However, three barriers prevent this research from generating genuinely useful advice. It does not sufficiently focus on interventions that can be directly designed by management. The typical research designs used in behavioral ethics research require such a reduction of complexity that the resulting findings are not very useful for practitioners. Worse still, attempts to make behavioral (...) ethics research more useful by formulating simple recommendations are potentially very damaging. In response to these limitations, this article proposes to complement the current behavioral ethics research agenda that takes an ‘explanatory science’ approach with a research agenda that uses a ‘design science’ approach. Proposed by Joan van Aken and building on earlier work by Herbert Simon, this approach aims to develop field-tested ‘design propositions’ that present often complex but useful recommendations for practitioners. Using a ‘CIMO-logic’, these propositions specify how an ‘intervention’ can generate very different ‘outcomes’ through various ‘mechanisms’, depending on the ‘context’. An illustration and a discussion of the contours of this new research agenda for ethics management demonstrate its advantages as well as its feasibility. The article concludes with a reflection on the feasibility of embracing complexity without drowning in a sea of complicated contingencies and without being paralyzed by the awareness that all interventions can have both desirable and undesirable effects. The practice-independent approach to theorizing justice holds that the social practices to which a particular conception of justice is meant to apply are of no importance for the justification of such a conception. In this paper I argue that this approach to theorizing justice is incompatible with the method of reflective equilibrium because the MRE is antithetical to a clean separation between issues of justification and application. In particular I will be maintaining that this incompatibility renders Simon (...) Caney’s cosmopolitan theory of global justice inconsistent, because Caney claims to endorse both a humanity-centered PIA and the MRE. (shrink)

Inspired by interviews conducted with scientists who primarily use participatory research forms, the article develops the concept of epistemic caring as a proposal for a participatory research practice that is sensitive for epistemological difference and the associated consequences. Based on the observation that participatory research has so far hardly been able to produce an equal co-constitution of knowledge, the article points out epistemological pitfalls that exist in it and analyses two specific concepts as examples of the risk of problematic (...) epistemological and hegemonic tendencies sneaking into this kind of research practice with harmful consequences for the non-academic participants, that is: empowerment and participation/co-production. Following the recent debate on care in the Environmental Humanities and Karen Barad’s methodological thoughts on diffraction, the article reconceptualizes participatory research as a matter of care consisting of multiple care relations in order to be able to grasp the complex epistemic entaglements and intra-dependencies contained within it. Conceiving these relationships between academic and non-academic participants as an ecology of care themself helps to understand that they are fundamentally precarious and transformative and thus inherently ethical. Can the existence of a social practice justify practical authority? A medieval debate between hierocrats and caesaropapists may help to illuminate this question. Focusing mainly on Marsilius of Padua, with reference to John of Paris, this article suggests that caesaropapists can be read as developing a 'practice conception' of the structure and scope of ecclesiastical authority. Because it brings the conflict over authority to a new battleground, the practice conception supplies caesaropapists with a source of dialectical leverage (...) over hierocratic doctrine. Satr al-awrah (Hijab /veiling) is one of the obligatory provisions for men and women in Islam. Satr al-awrah, as a religious/jurisprudential term, means covering the parts of the body (awrah) that should be covered by religion. Islamic jurisprudents have disagreed on whether satr al-awrah is a condition of validity for prayer. There are two basic approaches to this issue, one of which belongs to the public (jumhūr including the Hanafī, Shafiī and Hanbalī schools) and the other to the Mālikīs. According (...) to the majority (jumhūr), satr al-awrah is a validity condition of the prayer. Therefore, a prayer performed without fulfilling the satr al-awrah condition is not valid. A prayer performed in this way must be re-performed absolutely within or outside of time. There are two approaches in the Mālikī school regarding whether the satr al-awrah is a condition for the validity of the prayer. The first approach is (partly) the same as the jumhūr. According to the second approach (without any distinction between prayer and outside the prayer), satr al-awrah is a general obligation in Islam and is not a valid condition for prayer.According to the Mālikīs who accept this second view, it is sunnah to comply with the satr al-awrah condition in prayer. On the other hand, in the Mālikī school, awrah is divided into two as ʿawrah mughallaẓa and ʿawrah mukhaffafa in terms of its effect on the validity of prayer. The disagreement about whether the satr al-awrah is a condition of validity for the prayer is related to the ʿawrah mughallaẓa. On the other hand, there is an agreement that the ʿawrah mukhaffafa is not a condition for the validity of the prayer. The disagreement in the classical fiqh doctrine about whether the satr al-awrah is a condition for the validity of the prayer has some jurisprudential consequences. As a matter of fact, according to the majority, whether it is ʿawrah mughallaẓa or mukhaffafa, a prayer performed with an uncovered awrah is not valid and must be re-performed absolutely. In the Mālikī school, there are different opinions depending on whether it is ʿawrah mughallaẓa or mukhaffafa. If the place uncovered on the body is ʿawrah mughallaẓa; According to those who accept the satr al-awrah as a condition for the validity of the prayer, the prayer is not valid and must be re-performed absolutely. After the time has passed, the prayer does not have to be repeated. If the place uncovered on the body is ʿawrah mukhaffafa, according to all Mālikīs, unanimously the prayer is valid. Although it is recommended to reperformed it in time, it is not required to be returned after the time has passed. The following can be said about the practical examples of the disagreement in the classical fiqh doctrine regarding whether the satr al-awrah is a condition for the validity of the prayer, especially in terms of ʿawrah mukhaffafa: According to Mālikīs, who do not accept the validity of the satr al-awrah for prayer, it is valid for women to pray with their heads down, below the knees and with their arms uncovered. Again, according to them, it is valid for men to perform prayers with their thighs/hips (fakhz) uncovered, since it is considered one of the private parts. (shrink)

Practice-dependent approaches to moral responsibility appeal to our practices of moral responsibility in order to identify and justify the conditions for holding each other responsible. Yet, our practices are shaped by oppressive norms. For example, attributions of praise can be shaped by ableist norms, antifat norms, and norms of toxic positivity. I argue that such cases pose methodological and justificatory challenges for practice-dependent approaches of various stripes. In considering what resources these approaches might have to confront (...) these challenges, I formulate some supplementary norms for theorizing about our practices of moral responsibility and for structuring those practices themselves. This paper makes the following novel contributions: First, it advances examples that show that reactive attitudes can be oppressive irrespective of patterns of comparative distribution. Second, it articulates the implications of oppressive reactive attitudes for a range of post-Strawsonian approaches to moral responsibility. Third, it more fully articulates the norms that ought to shape our responsibility practices and locates them in relation to two recently proposed approaches to moral responsibility, from Shoemaker and Ciurria. This paper develops a domination-based practice-dependent approach to justice, according to which it is practices of systemic domination which can be said to ground demands from justice. The domination-based approach developed overcomes the two most important objections levelled to alternative practice-dependent approaches. First, it eschews conservative implications and hence is immune to the status quo objection. Second, it is immune to the redundancy objection, which doubts whether empirical facts and practices can really play an (...) irreducible role in grounding justice. In theorising dominating practices in terms of practices of social power, a domination-based approach makes justice dependent on factual information in three ways: First, the principle of non-domination is indeterminate and can only be spelled out by taking into view particular contexts of domination. Second, the principle of non-domination is conditional on the existence of practices of social power. Third, social power possesses a structural ontology – to know whether A has social power over B we need to turn to social rules distributing agents' higher order status of normative authority towards each other. This explains in what way practices of social power – and of domination – are both factual and normative practices and hence how such practices are non-redundant in grounding justice. (shrink)

The Tanner Lectures on Human Values, which honor the American scholar, industrialist, and philanthropist Obert Clark Tanner, are presented annually at each of nine universities in the United States and Great Britain. They were established at the University of California, Berkeley, beginning in the 2000/1 academic year. The Berkeley Tanner Lectures Series has been established in the belief that these distinguished lectures, together with the lively debates stimulated by their presentation in Berkeley, deserve to be made available to a wider (...) audience. The Practice of Value is an exploration of a pervasive but puzzling aspect of our world: value. At the core of the book are the Tanner Lectures delivered at Berkeley in 2001 by Joseph Raz, who has been one of the leading figures in moral and legal philosophy since the 1970s. His aim is to make sense of the dependence of value on social practice, without falling back on cultural relativism. In response, three eminent philosophers, Christine Korsgaard, Robert Pippin, and Bernard Williams, offer interestingly different approaches to the subject. We discuss how the approach taken by regulators to address financial reporting issues has a significant influence on tone at the top. While tone must ultimately be established internally, regulators are more likely to have a positive impact on the quality of financial reporting by addressing organizational tone. A strong tone at the top should ensure that the financial reports are characterized by greater transparency and complete disclosures, and a regulator’s response will depend upon their perspective as to what (...) motivates management. A compliance-based approach, rooted in agency theory’s assumption that managers act in their own best interests, seeks to mandate desirable behavior through elevated monitoring and reduced managerial discretion. Alternatively, an empowerment-based approach rooted in stewardship theory views managers as trustworthy guardians and grants them greater discretion without burdensome external monitoring. In practice, regulations fall on a continuum between these two approaches. To illustrate the continuum between compliance and empowerment, we present three cases in financial and tax reporting and examine the outcomes of these recent regulatory responses. We then provide conclusions regarding the effectiveness of each regulation by considering how tone was influenced within organizations. (shrink)

In a recent article in this journal, Krzysztof Poslajko reconstructs—and endorses as probative—a dilemma for interpretivism first posed by Alex Byrne. On the first horn of the dilemma, the interpretivist takes attitudes to emerge in relation to an ideal interpreter (and thus loses any connection with actual folk psychological practices). On the second horn, the interpretivist takes attitudes to emerge in relation to individuals’ judgements (and thus denies the possibility of error). I show that this is a false dilemma. By (...) taking a model-theoretic approach to folk psychology, and marrying interpretivism with dispositionalism, interpretivists can viably reject the notion of an ideal (or canonical) interpreter—and relativize attitudes to actual lay interpreters—without taking on board the unacceptable epistemological consequences of allowing that attitudes are judgement-dependent. Designing an integrative research program requires that research leaders negotiate a balance between the scientific interest of research and the practical interests of non-scientific partners. This paper examines the ways integrated research is formally categorised, and analyses the tangible expressions of the practical politics involved in reconciling scientific and practical interests. Drawing on a comparative study of two Australian Cooperative Research Centres, I argue that categories used by the research leaders to describe the research programs embody three different strategies for (...) structuring the relationships between researchers and their partners. These include matching research program categories to partners' implementation program categories, reproducing existing integrative partnership models, and filling gaps in understanding with new technical approaches. These strategies offer different advantages and disadvantages. The cases suggest that the integrative approach favoured by each Centre depended on issues such as the geographic scope of policy arenas, sources of scientific credibility, and the political risks facing partners. The practical politics of research organisation offers a new lens for understanding both the practice and theory of integrated research. (shrink)

In this thesis I defend the principle of global egalitarianism. According to this idea most of the existing detrimental inequalities in this world are morally objectionable. As detrimental inequalities I understand those that are not to the benefit of the worst off people and that can be non-wastefully removed. To begin with, I consider various justifications of the idea that only those detrimental inequalities that occur within one and the same state are morally objectionable. I identify Thomas Nagel’s approach (...) as the most promising defence of this traditional position. However, I also show that Nagel’s argument does not even justify the elimination of detrimental inequalities within states. A discussion of the concept of political legitimacy rather shows that egalitarian justice is not a necessary condition of the justifiability of the exercise of coercive political power. I, then, consider other, more Rawlsian approaches to the question of detrimental inequalities. These views appear more plausible than Nagel’s position and argue that egalitarian duties also arise in certain international contexts. But also these more global theories of distributive justice suffer from shortcomings. Since they make the application of duties of justice dependent on the existence of social practices they cannot adequately account for the justified interests of non-participants that are affected by these practices. The counter-intuitive implications of practice-dependent theories lead me to investigate the plausibility of a theory that does not limit justice to existing practices and that argues for the inherent value of equality. This theory is global egalitarianism. I defend global egalitarianism by debilitating three objections that opponents of this idea frequently present in the relevant literature. Finally I also address two particular objections to the idea that global egalitarian duties are institutionalizable with the help of coercive global authorities. (shrink)

There has been a long-standing interest in the putative roles that various so-called ‘theory of mind’ abilities might play in enabling us to understand and enjoy narratives. Of late, as our understanding of the complexity and diversity of everyday psychological capacities has become more nuanced and variegated, new possibilities have been articulated: (i) that our capacity for a sophisticated, everyday understanding of actions in terms of reason (our folk psychology) may itself be best characterized as a kind of narrative (...) class='Hi'>practice and (ii) that acquiring the capacity for supplying and digesting reasons explana- tions might (at least normally) depend upon having a special training with narratives. This introductory paper to the volume situates the claims of those who support the narrative approach to folk psychology against the backdrop of some traditional and new thinking about intersubjectivity, social cognition and ‘theory of mind’ abilities. Special emphasis is laid on the different reasons for being interested in these claims about narrative practice and folk psychology in light of various empirical and philosophical agendas. (shrink)

This dissertation examines the conceptual limitations of Kant's ethical theory with the purpose of assessing its suitability as a model of practical philosophy based upon the idea of autonomy. My aim is not only to exhibit the specific weaknesses in Kant's treatment of morality, but also to explore a contrast between two different approaches in ethical theory. This contrast can be characterized in terms of an opposition between a 'formal-individualistic' and a 'social-historical' model for the analysis and derivation of ethical (...) principles. The crucial problem here is whether an ethical theory can be constructed on the exiguous basis of concepts such as the 'rationality' or 'freedom' of the will, or whether it requires an insight into the connection between moral principles and specific conditions of historical and social life that constitute the real foundation of moral judgment. ;The dissertation is composed of four chapters. In Chapter One I consider the deficiencies in Kant's treatment of the historical and temporal dimensions of moral volition. I focus especially upon his neglect of the conditions of historical genesis that underlie the framework of moral concepts he analyzes. In the second and third chapters I examine Kant's failure to attend to the social dimension of morality and distinguish two separate parts to this objection: difficulties resulting from his restriction of the scope of moral freedom to the domain of an agent's inner intentions, so that a consideration of the consequences of action is excluded, and problems arising from his monological interpretation of the universalization procedure. Finally, in Chapter Four I argue that Kant's neglect of the historical and social dimensions of morality is by no means accidental. Rather, it is a function of his reliance upon a two-world metaphysical framework in which moral principles are understood essentially as the laws governing a purely rational, non-natural order. The dependence of Kant's ethical theory upon 'problematic' metaphysical premises--particularly in his justification of the moral law--suggests that the two dimensions he excludes from his analysis--history and society--must be integrated within it in order to yield a more convincing elaboration of the basic concepts of morality. This article has a twofold purpose: first, it explores how Leonardo Polo's personalist anthropology enriches and enhances neo-Aristotelian virtue ethics and second, it highlights how this specific personalist approach brings new perspectives to servant leadership. The recently revived neo-Aristotelian virtue ethics tradition finds that MacIntyre's scholarship significantly contributes to virtue ethics in business—particularly his conception of practices, institutions, and internal/external goods. However, we argue that some of his latest insights about the virtues of acknowledged dependence and human vulnerability remain (...) underdeveloped because of the underlying anthropology that neo-Aristotelian virtue ethics relies on. To overcome this limitation, we introduce Polo's transcendental anthropology as a possible foundation of a personalist approach that enriches virtue ethics. To do so, we address how transcendental anthropology can enrich two central aspects of virtue ethics, namely (1) the understanding of human beings and their flourishing and (2) the relationship of virtue to praxis and human work. Finally, to address the practical implications for business leadership and work that can derive from assuming transcendental anthropology, we address how servant leadership acquires a new perspective in light of this personalism and its logic of gift, highlighting interpersonal self-giving as a way of service. This monograph investigates the collaborative creation of scientific knowledge in research groups. To do so, I combine philosophical analysis with a first-hand comparative case study of two research groups in experimental science. Qualitative data are gained through observation and interviews, and I combine empirical insights with existing approaches to knowledge creation in philosophy of science and social epistemology. -/- On the basis of my empirically-grounded analysis I make several conceptual contributions. I study scientific collaboration as the interaction of scientists within (...) research groups. Thereby, I argue that research groups and their role in scientific practice deserve more philosophical attention than they have hitherto received. In contemporary natural science, research groups are key to the formulation and corroboration of scientific knowledge claims prior to their publication. Specifically, I suggest epistemic difference and the porosity of social structure as two conceptual leitmotifs in the study of group collaboration. With epistemic difference, I emphasize the value of socio-cognitive heterogeneity in group collaboration. With porosity, I underline the fact that a research group as social structure does not entirely contain the inter-individual efforts necessary to formulate and corroborate knowledge claims. -/- In my analysis of research groups, I focus on the division of epistemic labor among group members. Through their complementary collaborative efforts single scientists engage in relations of mutual epistemic dependence. To deepen philosophy’s understanding of scientific practice in its diversity, a distinction should be made between opaque and translucent epistemic dependence. While opaque epistemic dependence involves asymmetries in expertise, translucent epistemic dependence does not. As epistemic dependence is facilitated by trust, I investigate the dynamics of epistemic trust in group collaboration. Trust among collaborating scientists is inherently incomplete, and I show that scientists make use of diverse strategies to increase and to supplement personal trust. Based on my reflections on trust and dependence, I give an account of the relation between individual knowing and collaboratively created knowledge in research groups. Together these investigations contribute to the discussion of philosophical methodology in the study of scientific practice and promote the use of empirical methods. (shrink)

In this thesis I argue that what we tend to see in contemporary accounts of human service practice in the relevant literature is a ‘common-sense’ informed by a complex mix of neoliberal political and policy imperatives and various kinds of technical-rational styles of administration and management. These accounts of practice can inadvertently contribute to the problems they are meant to address and can do more harm than good. Common-sense accounts of practice also align with how human services (...) are typically regulated and they align with prevailing ways the education of human services takes place, including in universities. Consequently, the same types of problems that take place with human service practice also take place with the institutionalisation and reproduction of human services. If we are serious about achieving good practice in human services, then we need to think more clearly about what practice in human services is. <br /><br />There is a good case for articulating a theory of human service practice to inspire new and better ways of achieving good practice. The theory of good practice outlined here draws on the philosophy of Aristotle and neo-Aristotelian accounts of practice. It draws especially on Dunne who argues that a theory of practice should offer a defensible account of how we should conceptualise the stuff that human services deal with, and the sorts of knowing, action and ends that best accord with such conceptualisations. <br /><br />I argue that the beings at the centre of human services should be understood as complex, emergent, unpredictable, and ‘wicked’ in the sense that Rittel and Webber talk about. This highlights the possibility that the people, problems and practices of human services can be revealed in multiple and contrary ways. Accordingly, human services hold both promises and dangers for people and good practice is far from self-evident and is highly contestable in each individual case. <br /><br />I argue that phronesis (practical wisdom) is the way of knowing that best corresponds to and is most suited to deal with the uncertain, messy, contingent and context-dependent beings of human services, which require and deserve ongoing deliberations and good determinations on each occasion that are at the same time always tentative and remain open to other suggestions and modification especially because our knowledge may be erroneous and incomplete. I argue that good practice also requires reflexivity and value rationality to help identify and alleviate the problems associated with neoliberal approaches to practice and as an alternative to technical rationality and value neutrality. <br /><br />I make the case for praxis (good action) along with a range of other human activities including value-rational deliberation as the forms of action that best align with and are most appropriate for dealing with the ever-changing, often inexplicable and always difficult beings of human services. Praxis is in accordance with phronesis and can be understood in part as durable practice and in part as responding to each case in new ways. In particular, it involves figuring out and enacting the most desirable course of action in each instance of practice while at the same time remaining receptive to other possibilities and to doing things differently particularly because we might not always be immediately aware of what we are doing, and our actions could be doing more harm than good. <br /><br />I show that clarity about our telos will help to re-orient human services to pursuing preferred ends and securing goods that are better suited to the entities of human services compared to instrumentally designed relations between widely applicable and transferable techniques and pre-determined outcomes. I argue for the telos of youth work to be enabling young people to live the good life. Following my accounts of phronesis and praxis this orientation of human services towards more desirable and ethical purposes takes the form of a commitment that is always carefully reconsidered at the same time as determinedly pursued. However, unlike outputs that can be wholly predetermined, efficiently sought after and completely achieved, this is an end that is never fully attained. This is especially the case because there is always more that can be known and done and because there are always disagreements on the goods to be secured. <br /><br />This theory of practice should correspond to and supports the education of people for professional practice. In particular, the education of human services needs to reproduce how the beings of human services are to be conceptualised and the ways of knowing, forms of action and ends that cohere. At the same time, university-based human service education should support the development, exercise and experience of good practice-as-praxis guided by phronesis. <br />. (shrink)
