Richard Rudner famously argues that the communication of scientific advice to policy makers involves ethical value judgments. His argument has, however, been rightly criticized. This article revives Rudner’s conclusion, by strengthening both his lines of argument: we generalize his initial assumption regarding the form in which scientists must communicate their results and complete his ‘backup’ argument by appealing to the difference between private and public decisions. Our conclusion that science advisors must, for deep-seated pragmatic reasons, make value judgments (...) is further bolstered by reflections on how the scientific contribution to policy is far less straightforward than the Rudner-style model suggests. The nature of the relation between jurisprudential theories and first-order legal judgments is a strangely uncontroversial matter in contemporary legal philosophy. There is one dominant conception of the relation according to which jurisprudential theories are second-order or meta-legal theories that specify the ultimate grounds of first-order legal judgments. According to this conception, difficult first-order legal disputes are to be resolved by jurisprudential theorizing. According to an alternative conception that Ronald Dworkin has influentially advocated, jurisprudential theories are not second-order (...) theories about the nature of law, but instead covert first-order legal theories. These two conceptions of the relation between jurisprudential theories and first-order legal judgments dominate the contemporary legal philosophical scene and crowd out other possible conceptions. This article scrutinizes the two conceptions, and in the process raises the possibility of a different and arguably more credible conception. According to this new conception, our first-order legal views and a jurisprudential theory that we accept are supposed to form a mutually disciplining and supporting set of views that we accept in our pursuit of the epistemic ideal of wide reflective equilibrium. The two sets of views are supposed to constrain and discipline each other; but neither is meant to underwrite, certify, or ultimately determine the contents of the other. This new conception, which allows the relation between jurisprudential theories and first-order legal judgments to be much looser, untidier, and more complex than what the two dominant conceptions imply, should facilitate progress in legal philosophy and in first-order legal thinking. When we judge an action as morally right or wrong, we rely on our capacity to infer the actor's mental states. Here, we test the hypothesis that the right temporoparietal junction, an area involved in mental state reasoning, is necessary for making moral judgments. In two experiments, we used transcranial magnetic stimulation to disrupt neural activity in the RTPJ transiently before moral judgment and during moral judgment. In both experiments, TMS to the RTPJ led participants to rely less on (...) the actor's mental states. A particularly striking effect occurred for attempted harms : Relative to TMS to a control site, TMS to the RTPJ caused participants to judge attempted harms as less morally forbidden and more morally permissible. Thus, interfering with activity in the RTPJ disrupts the capacity to use mental states in moral judgment, especially in the case of attempted harms. (shrink)

I defend the thesis that Kantian analytic judgments are about objects (as opposed to concepts) against two challenges raised by recent scholars. First, can it accommodate cases like “A two-sided polygon is two-sided”, where no object really falls under the subject-concept as Kant sees it? Second, is it compatible with Kant’s view that analytic judgments make no claims about objects in the world and that we can know them to be true without going beyond the given concepts? I (...) address these challenges in two steps. First, given Kant’s distinction between an object in general = x from an object of sensible intuition, I argue that analytic judgments are about objects in the former sense, no matter whether the purported objects can be given in our intuition. Second, using Kant’s method of representing certain logical relations of concepts with such figures as circles, I construct a model to show that analytic truths are truths about objects in general = x and yet can be determined solely by the intensional relation between the given concepts plus certain Kantian-logical laws. Analytic truths are thus shown as formal in the Kantian sense that they do not presuppose the purported objects as givable in our intuition. This account of the formality of analytic truths captures Kant’s diagnosis of the Leibnizian illusion that we can make material claims about the world by analytically true judgments. (shrink)

Philosophers have accused locke of holding a view about propositions that simply conflates the formation of a propositional thought with the judgment that a proposition is true, and charged that this has obviously absurd consequences.1 Worse, this account appears not to be unique to Locke: it bears a striking resemblance to one found in both the Port-Royal Logic (the Logic, for short) and the Port-Royal Grammar. In the Logic, this account forms part of the backbone of the traditional logic expounded (...) in the text. As a result, the account’s alleged faults seem to seriously threaten the coherence and value of the whole approach to logic. Kant’s analytic-synthetic distinction is often construed in terms of the question of whether or not the predicate is contained in or can be derived from the concept of the subject. Few have observed that Kant has another formulation of the distinction, a formulation that is based on the determinate-indeterminate distinction. In fact, it is this formulation that will shape the development of one of the main tasks of post-Kantian German idealism. It is my aim to explain how Kant, Maimon, and (...) Because metacognition consists in our having mental access to our cognitive states and mental states are conscious only when we are conscious of them in some suitable way, metacognition and consciousness shed important theoretical light on one another. Thus, our having metacognitive access to information carried by states that are not conscious helps con?rm the hypothesis that a mental state.

Visual illusions provide a means of investigating the rules and principles through which approximate number representations are formed. Here, we investigated the developmental trajectory of an important numerical illusion – the connectedness illusion, wherein connecting pairs of items with thin lines reduces perceived number without altering continuous attributes of the collections. We found that children as young as 5 years of age showed susceptibility to the illusion and that the magnitude of the effect increased into adulthood. Moreover, individuals with greater (...) numerical acuity exhibited stronger connectedness illusions after controlling for age. Overall, these results suggest the approximate number system expects to enumerate over bounded wholes and doing so is a signature of its optimal functioning. (shrink)

Moral Judgments, Moral Virtues, and Moral Norms The paper consists of two basic parts. In the first, contemporary approaches to moral judgments and their relations with moral virtues and moral norms are analyzed. The focus is on comparing the role of the emotions and reason, and conscious and unconscious processes in forming and/or justifying moral judgments. The second part examines views on the current broader socio-political situation in Western countries and points to the growing feelings of insecurity (...) among people mainly due to the fact that traditional ways of life have been losing solid ground, settled norms and ethical systems are weakening and at the same time the social trust in various state institutions and bureaucratic structures involved in power is decreasing. In conclusion the author argues for the potential of the ethic of autonomy that would lead to still greater cooperation in globalized ethic, primarily thanks to our moral emotions and moral judgments. In a recent article, Kiel Brennan-Marquez and Stephen E. Henderson argue that replacing human judges with AI would violate the role-reversibility ideal of democratic governance. Unlike human judges, they argue, AI judges are not reciprocally vulnerable to the process and effects of their own decisions. I argue that role-reversibility, though a formal ideal of democratic governance, is in the service of substantive ends that may be independently achieved under AI judges. Thus, although role-reversibility is necessary for democratic governance when human (...) judges are on the job, it may not be so when AI judges replace them. One broader implication for normative evaluation of disruptive technologies follows: formal and substantive ideals that often align must be independently examined in the evaluation of disruptive technologies. This is because these formal and substantive ideals may no longer align under the factual circumstances that come to govern when such technologies are deployed. (shrink)

Baron assumes that ethical decision-making can be evaluated without specifying more general features of the cognitive system within which it occurs. It is suggested that ethical principles are heuristics employed during goal-oriented action planning. Heuristics are bound to generate suboptimal decisions in some cases. It is rational to replace a particular heuristic only when the cost of associated error exceeds the cost of constructing and installing a more successful alternative.

In this article I lay the foundations towards a tentative characterization of clinical reasoning, one that highlights its reflective and inferential character, as well as its fallibility and orientation towards action. To this end, I put forward some epistemic considerations on medical knowledge followed by addressing the following questions: _what tools exist for teaching clinical reasoning_? and _how to develop a clinical competence through critical thinking_? Moreover, I offer an overview of clinical reasoning through the lenses of two theoretical perspectives (...) in philosophy: the cognitive and the logico-argumentative and finally, I put forward my own approach belonging to the latter one. The role of judgments of beauty in scientific theory evaluation is the subject of significant debate in contemporary philosophy of science. This book advances that debate by broadening its scope. In Judgments of Beauty in Theory Evaluation, the author argues that judgments of beauty are a justified part of theory evaluation of all sorts: not only scientific theory evaluation, but also philosophical theory evaluation. The author argues for this thesis by providing an account of beauty—inherited from Kant (...) and Mothersill—on which the distinctive nature of judgments of beauty is that they are unprincipled, yet possible. The author then analyzes two important methods of theory evaluation—reflective equilibrium and simplicity—and argues that these methods require making judgments of beauty so understood. Finally, the author argues that these methods of theory evaluation are not anomalies, but that they point to a deeper lesson about the nature of theorizing and the necessity of using judgments of beauty to evaluate systems, like theories. This conclusion has implications for the debate in philosophy of science over judgments of beauty, but also prompts a reckoning in philosophy itself over the use of judgments of beauty in philosophical theory evaluation.
