Prison as a Torturous Institution Philosophers working on torture have largely failed to address the widespread use of torture in the U.S. prison system. Drawing on a victim-focused definition of torture, I argue that the U.S. prison system is a torturous institution in which direct torture occurs (the use of solitary confinement) and in which torture is allowed to occur through the toleration of sexual assault of inmates and the conditions of mass incarceration. The use and toleration of (...) torture expresses and reinforces the moral exclusion of those subjected to it, particularly African Americans. Importantly, this moral exclusion and the experience of torture may be created and reinforced through institutional practices independently of the intentions of individuals acting within those institutions. By prioritizing torture victims’ experiences and severing the link between torture and intention, my account forces a recognition that, far from being inconsistent with U.S. values, torture is deeply embedded within U.S. institutions. One of the important determinants of development during the transition to adulthood is the undertaking of social roles characteristic of adults, also in the area of finishing formal education, which usually coincides with beginning fulltime employment. In the study discussed in this paper, it has been hypothesized that continuing full-time education above the age of 26, a phenomenon rarely observed in Poland, can be considered as an unpunctual event that may be connected with difficulties in the process of identity formation. (...) Relationships between identity dimensions and identity statuses, and age and educational context were analyzed. 693 individuals aged 19-35 took part in the study. The participants attended three types of educational institutions: full-time university studies, part-time university studies, and full-time post-secondary school. Among the students of full-time university studies predictable dependencies, also in respect of highlevels of indicators of identity crisis and a high frequency of diffused identity occurrence, were observed. Such dependencies were not found in the group of full-time post-secondary school students. (shrink)

This paper argues that business can be helpfully conceived of as a mediating institution. Drawing upon neo-conservative theology, the author argues that mediating institutions serve a vital function in a free society to provide social justice out of an expanded civil society and provide a framework for a flourishing free market. Such institutions also nourish the attitudinal orientation of solidarity in applying the principle of subsidiarity by which self-interest becomes fulfilled through concern for others.The author further argues that businesses (...) also be conceived of as mediating institutions and thereby be held to criteria of meeting associationalneeds. When I was an undergraduate in Oxford, we were taught economics almost as though it were a natural science. The subject matter of economics might be different from physics, but only in the way that the subject matter of chemistry or biology is different from physics. The actual results were presented to us as if they were scientific theories. So when we learned that savings equals investment, it was taught in the same tone of voice as one teaches that force (...) equals mass times acceleration. And we learned that rational entrepreneurs sell where marginal cost equals marginal revenue in the way that we once learned that bodies attract in a way that is directly proportional to the product of their mass and inversely proportional to the square of the distance between them. At no point was it ever suggested that the reality described by economic theory was dependent on human beliefs and other attitudes in a way that was totally unlike the reality described by physics or chemistry. Some years ago, when I published The Construction of Social Reality, I was aware that it had implications for the ontology of economics, but I was not aware that there had already been an important revival of the tradition of institutional economics. It would be an understatement to say that I welcome this interest in institutions; I enthusiastically support it. But I think that in the institutional literature there is still an unclarity about what exactly an institution is. What is the ontology, the mode of existence, of institutional reality? This article tries to add to this discussion. Economics as a subject matter, unlike physics or chemistry, is largely concerned with institutional facts. Facts about money and interest rates, exchange and employment, corporations and the balance of payments, form the very heart of the subject of economics. When Lionel Robbins, in a classic work, tells us that “Economics is a study of the disposal of scarce commodities,”2 he takes for granted a huge invisible institutional.... (shrink)

In this article, Zhu Xueqin provides an overall view of Rousseau’s political philosophy as he discusses Rousseau’s notion of the general will, the social contract, and the differences between Rousseau and thinkers such as Hobbes and Locke. Zhu argues that Rousseau’s political philosophy is deeply flawed as it advocates a moralization of politics that seeks to build a heavenly kingdom on earth, an ideal that has left a significant imprint on the modern world.

Accordingly, liberties are not full-blooded rights, since my having a right to do X has the additional implication that others are not at liberty to interfere with my doing X . This article examines the issue of the paradoxicality of institution, de-institutionalization, or the counter-institutionalization in classical Chan thought by focusing on the texts of Hongzhou School. It first analyzes the problem of 20th century scholars in characterizing the Chan attitude toward institution as iconoclasts, and the problem of the recent tendency to return to images of the Chan masters as traditionalists, as opposed to iconoclasts. Both problems are examples of imposing an oppositional way of thinking on the Chan (...) masters. The essay then introduces a new paradigm for interpreting the Chan attitude toward institution, the model of de-institutionalization, which borrows certain insights from Derrida’s idea of the counter-institutional. However, the new model is supported by the Chan heritage of Mahayana Buddhist philosophy. This model can more consistently construe the Chan understanding of the paradoxicality of institution, the subtle Chan relationship of being “with and against” institution, and the Chan “middle way” to make institution remain open to its outside and to transformation. The paper shows different approaches to creativity, i.e. emergence of new meanings, in Merleau-Ponty and Patočka. The comparison is based mainly on Merleau-Ponty’s lectures L’institution dans l’histoire personnelle et publique (1954/55) and Patočka’s project Negative Platonism (1953). Despite some similarities evident in the key concepts “institution” and “transcendence”, there is a decisive difference between the two approaches concerning the temporality of creation. Whereas Merleau-Ponty likens the temporality of institution to future perfect tense, emphasizing the intertwining of present (...) and future events, Patočka understands novelty as something totally different from the present state of affairs. In his eyes, the question of how something new can arise equals the question of how an attitude of distance to existing traditions can be achieved. Contrary to Patočka, Merleau-Ponty argues that any living tradition tends towards its own transformation and presents a case of self-transcendence because it is governed by the principle of divergence (écart). In this contribution, we analyse the treatment of professional practice in two training sequences dedicated to the teaching of written French. Firstly, we examine the characteristics of the training devices organised with a combination of school field and training institution scheme. We then focus on interactions between trainer and trainees within two training activities aimed at sharing and reflecting on practicum. This is the first book to examine behavioral theories on social preference from institutional and philosophical perspectives using economic experiments. The experimental method in economics has challenged central behavioral assumptions based on rationality and selfishness, proposing empirical evidence that not only profit seeking but also social preferences matter in individuals' decision making. By performing distribution experiments in institutional contexts, the author extends assumptions about human behavior to understand actual social economy. The book also aims to enrich behavioral theories of economics (...) directed toward institutional evolution. The author scrutinizes how specific institutional conditions enhance or mute individuals' selfish incentives or their fairness ideals such as egalitarian, performance-based, labor-value radicalism or libertarianism. From experimental results and their analysis, implications for actual problems in social economy and institutional change are derived: why performance-based pay often fails to promote workers' productivity; why labor wages decline whereas shareholder's values increase after financialization; and whether socially responsible investment can be a social institution for corporate governance. The book is also addressed to philosophers of social sciences interested in how experimental methods can contribute to developing cognition of human behaviors and be extended to social theories. Referring to behavioral theorists in the history of economic thought, the author discusses the meanings of experiments in the methodology of social sciences. CiolaIntroductionThe present study proposes a philosophical analysis of John of Rupescissa's Liber Ostensor [=LO], Treatise XI. John of Rupescissa (OFM, 1310 ca. – 1366)2 is a particularly interesting, eclectic and somewhat extraordinary [End Page 7] author writing around the second third of the 14th century in the wake of the Spiritual Franciscan movement in the South of (...) France.3 In LO XI, Rupescissa theorizes and systematically articulates a complex relationship between inspired knowledge and the normative portrait of what he believes the Franciscan Order should ideally be; he does so against the background of his eschatological concerns. Per Rupescissa's style of exposition and argumentation, these different elements — i.e., inspired epistemology, eschatology, and ecclesiology — are tightly intertwined on a theoretical and foundational level that goes beyond that of mere rhetorics.These themes are both recurrent and pivotal throughout Rupescissa's extremely prolific intellectual output, which counts numerous theological, ecclesiological, eschatological and alchemical treatises.4 LO, composed in [End Page 8] 1356 during Rupescissa's own "Avignon Captivity," is in many ways a sum of Rupescissa's prophetical and eschatological thought within the framing of the author's self-apologetic aims and of his ecclesiological views, in particular concerning the future of the Franciscan Order.5 [End Page 9]Treatise XI is undoubtedly the most theoretical book in LO; with its 489 paragraphs, it is also the longest. While this extremely dense text broaches on a great variety of topics, it is first and foremost about and for Spiritual Franciscans. Overall, LO XI is both a great portrayal of the Franciscan order as it is and as it should be, as well as a handbook addressed to the elect among the Spirituals, in order to help them face the eschaton and the tribulations to come. Per Rupescissa's eschatological views, such trials would affect the Franciscan Order the hardest and for the longest — hence the need for a detailed guide. At its core, then, LO XI is a deeply ecclesiological treatise and as such it is complementary to the larger systematization established in the Sexdequiloquium.6 It is in this framework that LO XI offers a complex theory of prophecy and illuminative knowledge as they should be embodied in the practices of a true Franciscan.7Given its highly abstract nature and cardinal function within one the most complex works of Rupescissa's maturity, LO XI, combining relevant insights on Rupescissa's ecclesiological, epistemological and prophetical positions, constitutes the ideal case study in order to assess Rupescissa's most refined and articulated account on inspired knowledge, particularly insofar as true and actual prophecy is concerned. This inspired knowledge, according to Rupescissa, is an indispensable tool for the elect to be able to victoriously face the imminent end of times. In the account presented in LO XI, such knowledge is possible exclusively through a form of institutional embedding: divine inspiration, culminating in true prophecy, is in service of the Franciscan Order's soteriological role within the Church as a whole, and can only be achieved by those who are faithful to the spirit of Francis's Rule.8 [End Page 10]Here, I analyze Rupescissa's theory of evangelical poverty and its role as a necessary condition for inspired knowledge, following the internal articulation of LO XI.Overall, in Rupescissa's view, Franciscan poverty and inspiration are two inseparable sides of the same coin. On the other hand, the true institutional role of the Franciscan Order and its soteriological aims can be fulfilled exclusively by the true Spiritual Franciscans, whose moral, spiritual and epistemic perfection is divinely inspired. For Rupescissa, not only is poverty the source of all virtues both for the Franciscan Order and for the rest of the Church, but it also constitutes the ideal moral and social model, tout court. This paper addresses issues of agency and self-identity on the basis of a phenomenology of embodiment. It considers a tension in accounts of embodiment between, on the one hand, the body as the locus of subjectivity, lived experience, and agency, and, on the other hand, the body as constructed, as the site where discursive regimes of power are inscribed. In exploring this tension I consider Frantz Fanon’s and Sarah Ahmed’s phenomenological accounts of racism to illustrate the ways in which social (...) power and violence come to be implicated in these conflicts within our embodied identities. I also consider Foucauldian “power” in relation to Merleau-Ponty’s concept of “institution.” I argue that only the phenomenological concept of institution, by drawing our attention to the ambiguities of lived embodiment, succeeds in offering us resources for thinking about the interplay between passivity and agency in the life of the subject, and, in particular, about a form of agency not wholly reducible to the effects of power. Regress threatens throughout Lyotard’s Differend, especially where the argument appears to make normative ethical or political claims. How a term, a case or an example “links onto” a phrase serves as a way of examining how instituting can be non-regressively grounded, and with what consequences for abstract political subjectivity. The essay offers an alternative to liberal philosophical and jurisprudential schemata of political institution.

The purpose of this study is a philosophical analysis of the phenomenon of social responsibility and the peculiarities of the process of its transformation, which took place in the context of globalization. The objective of the study is to determine the nature of the impact of the globalization process on the transformation of the institution of responsibility. In the course of the research, systematic, formal-logical and historical methods of scientific cognition were used. A civilizational approach was also applied, in (...) which the analysis of the object and subject of research was carried out taking into account civilizational features. As a result of the research, we came to the conclusion that globalization in its modern form is a process of modernization within the whole of humanity. Currently, in the vast majority of the most economically and technologically developed countries of the planet, there is such a negative phenomenon as negative demographic dynamics. In turn, this phenomenon is accompanied by a deep crisis of the institution of the family, and with it a massive departure from traditional norms and values. In such conditions, such an important institution and instrument regulating public relations as the institute of social responsibility inevitably undergoes a serious transformation. In the course of this process, there is a transition to the so-called modern society, the fundamental difference of which from the traditional one is that it is focused on the innovative component of culture, which in fact means the ever-increasing predominance of innovative elements over traditional ones, the secular nature of public life, development, which has a progressive, and not cyclical, the formation of democratic institutions, the mass nature of education, the dominance of the universal over the local, etc. All these innovative elements of culture, taken both separately and in combination, have a decisive influence on the entire Worldview of people, including their perception of justice and responsibility. This paper argues that the practical implementation of blockchain technology can be considered an institution of property similar to legal institutions. Invoking Penner's theory of property and Hegel's system of property rights, and using the example of bitcoin, it is possible to demonstrate that blockchain effectively implements all necessary and sufficient criteria for property without reliance on legal means. Blockchains eliminate the need for a third-party authority to enforce exclusion rights, and provide a system of universal access to knowledge (...) and discoverability about the property rights of all participants and how the system functions. The implications of these findings are that traditional property relations in society could be replaced by or supplemented with blockchain models, and implemented in new domains. (shrink)

It is metaphysical, because for some religious beliefs, it involves the deed-consequences scheme in terms of rewards and punishments, even beyond this world into the otherworldly life. It is an instrument (...) used in one's own life (suicide), in the simple family, in the small-scale societies, as well as in the multi-ethnic social settings. It can be a national, multinational and universal phenomenon. It presents some contradictions, because, though it is abhorred in general, some individuals or states use it as a means to achieve ultimate good or misuse it for their own selfish interests. It becomes more of a repulsive mystery when it is seen as institutional and integral partofreligionwhich fundamentallyshould avoid it. Between April and July 1994, the media ofthe world brought images ofthe mostviolent episode ofRwandan history into the living rooms ofthis planet's population. The magnitude ofthe genocide of 1994 was unprecedented in this century. Up to one million of people are estimated to have been killed within only one hundred days. It is difficult to understand the magnitude ofthis violence. Tribal conflicts in Rwanda, colonial powers, political manipulations and economic problems alone are not enough to explain whathas happened. Political analysts, sociologists, anthropologists have tried to understand whetherthe political instability ofthe late 80s, the malfunction of political institutions, the October War (1990-94) and the 40Malachie Munyaneza consequent war atrocities could have necessarily culminated in the genocide the world witnessed. Fundamental questions about the whole philosophy oflife and religion in the history ofRwandaand its relationship to violence are to be addressed too, because they touch the inner being of the outward physical person. People have the right to know what has gone wrong all along in all areas of their life. This paper will try to look at religious beliefs and violence as institution in ancient and modern Rwanda in its magico-religious context and its implications in the social structure. He is all-knowing as in the name "Bizimana" (they [all things] are known by God). He rules over everything as King, Judge and Master as expressed in the name "Hategekimana" (everywhere it is God who rules). Unfortunately Rwandans believedthatwhatever befell them was pre-ordained by God and most ofthe time fatalism dominated their lives. They confronted violence or fate with resignation thinking that the origin is in God's will or from angry spirits they did not control. Rwandans also believe in the existence ofa spiritual realm. The spirits of the dead lived further and roamed about. They would come back to trouble their relatives, especially when they felt some duties due to them were neglected. They could even kill through sickness, insanity or provoke infertility. They hold people under the siege ofconstant mental terror. Recent scholarship has cast welcome light on the political relevance of Hobbes’s extensive treatment of theology and sacred history. Building on extant contributions, this article argues that God’s historical founding of a Kingdom lends insights into well-known difficulties attaching to Hobbes’s exposition of the Commonwealth by Institution. Although there are evident discrepancies between sacred history and man's natural estate, Abraham and Moses each faced political challenges that persist into the present. Acting as God’s authorized representatives not only allowed them (...) to assuage epistemic uncertainty, it enabled Moses to wield sovereign authority while preserving a claim to natural equality. I argue that Leviathan suggests this model of prophetic authority – conceived of as a particular kind of prudence – is key to meeting the challenges arising from the anthropological vulnerabilities of ignorance and fear. Hobbes’s interest in the role of founding prophets also helps to explain Leviathan’s novel inclusion of representation. This paper examines the relationship between Merleau-Ponty's lectures on institution and his lectures on passivity. I argue that the relationship depends on Merleau-Ponty's internal critique of institution as outlined in Husserl's ouevre. That is, institution is not only human institution, which rests on temporality and time-consciousness, but also animal, biological and even virological, which rests on a certain, non-euclidian space of the body. Merleau-Ponty's focus in the course is animal institution: animal morphology, menstruation, puberty, etc. (...) These are what tie institution and passivity together, and especially the passivity that Merleau-Ponty calls the "symbolic matrix," the touchstone of which is the "implex." While the paper discusses, Merleau-Ponty's critique of Husserl and the consequent understanding of a passivity in institution, it opens the possibility that the virological may be yet another kind of passivity that has instituted a new trajectory in human institution. This paper examines the discursive transformation of the historic American public market from that of a municipally regulated institution intended to ensure fair trade and equitable food distribution to “a public place” that emphasizes community identity and sociability. Using a semiotic analysis of interviews with 31 market managers of 30 historic and contemporary American public markets, data from historic documents, and multiple site visits, we compare the social construction of the contemporary public market to farmers markets, supermarkets, and the (...) early twentieth century public market. We analyze the meanings managers create in the contemporary public market to understand the administrative rationalities within which the public market operates. Our analysis reveals evidence of competing imaginaries active in the public market, organized around broad notions of “public benefit,” “community culture” and “institutional viability.” We propose that these tensions are embedded in the public market as an institution historically implicated in regimes of food distribution. In the contemporary context, we conclude, public markets largely substitute the spectacle of community and the image of an historic public life for a legally instated commitment to the just governance of food systems. Benjamin Hoadly's Original and Institution of Civil Government is a founding text for the American republic. Writing in 1710 this response to Tory High Church attempts to revive extreme monarchical theories of government, Hoadly, a Low Church Whig and Anglican clergyman, advanced new ideas of political authority. He was committed to the political settlement that followed the Glorious Revolution of 1688 and the limited parliamentary monarchy it established in Great Britain; he was also responsible for popularizing John Locke's theories (...) of government. In the Original and Institution of Civil Government, Hoadly challenged patriarchal political systems and denied that civil authority could be compared with a parent's authority over children. Instead, Hoadly argued that civil authority arose from the people and was conditionally given to a leader. (shrink)

We are in an era of uncertainty over whose rules will govern global economic integration. With the growing market share of Chinese firms and the power of the Chinese state it is unclear if Western firms will continue to dominate transnational governance. Exploring these dynamics through a study of contract rules in the global cotton trade, this article conceptualizes commodity chain governance as a contested process of institution-building. To this end, the global commodity chain/global value chain framework must be (...) revised to better account for the broader institutional context of commodity chain governance, institutional variation across space, and strategic action in the construction of legitimate governance arrangements. I provide a more dynamic model of GCC governance that stresses how strategic action, existing institutions, and dominant discourses intersect as firms and states compete for institutional power within a commodity chain. This advances our understandings of how commodity chain governance emerges and changes over time. (shrink)

The paradox of girls’ academic gains over boys, across race and class, has perplexed scholars for the last few decades. Through a 3-year longitudinal ethnography of two predominantly economically marginalized and racially minoritized schools, I contend that while racially marginalized girls may have made academic gains, school is nevertheless a hostile institution for them. Focusing on the case of Black girls and recent immigrant girls of color, I identify three specific ways in which school functions as hostile institution (...) for them: gendered racial harassment from teachers, erasure of intellect, and estrangement within their communities. Furthermore, the denigration of immigrant girls becomes the conduit for misogynoir. I find that the gains of some racially marginalized girls in school often justify hostility against all of them. Bringing into conversation a feminist analysis of schooling that rejects girls’ educational gains as ubiquitous evidence of a gender revolution with a Black-colonial education framework that emphasizes schooling as a technology of oppression, I explore the current role of school as a hostile institution for Black girls and immigrant girls of color. Boston College We need both to define our terms and to indicate whether we are using them in a normative or descriptive sense. Thus the question: "Is Christianity"—or, if you will—"Are the institutions of Christianity violent or nonviolent?" can be answered with either a Yes, or a No, or with anything in between, depending on the meaning we (...) attach to theterms "violence," "institution," and "Christianity" (Daly 1997, 321-43). When we speak normatively, or take Christianity and its institutions accordingto its best ideals, Christianity isessentially nonviolent. But when we speak descriptively, i.e., take Christianity according to what the institutions ofChristianity have actually done, and according to how those who call themselves Christian have actually acted, we can make the argument that Christianity is violent, ffanalogous distinctions can be made from within the other four traditions, this might offer a good starting point for discussion. Recent research suggests that corporate social responsibility is institutionalised amongst multinational corporations. Yet CSR scholarship faces considerable challenges. An agreed definition is lacking, even amongst researchers adopting aligned approaches. Studies remain heavily focused on making a business case for CSR, despite its widespread acceptance into business practice. Few studies examine CSR’s on-ground implications for the communities it purports to help, favouring instead a macro-level focus. And concerns about CSR’s sincerity, motivations and ethics perpetuate questions about its integrity. This article argues (...) that new institutionalism is well placed to respond to these core challenges for CSR, and that new institutionalist perspectives can complement and enrich other common theoretical approaches. It contributes a social mechanism-based framework for CSR, identifying and exploring the key social mechanisms that institutionalise it; namely, discourse, mimesis, normative learning and coercion. Understanding CSR as an institution facilitates new and different explorations of its causes and effects and opens new avenues for scholarly inquiry. Illustrative examples from a 3.5-year study of CSR in the global mining industry are presented to explore the implications of CSR as an institution and to suggest pathways for innovative research.
