The article examines the theories of decolonization that have originated in the north of the Americas and Oceania and Latin America. It compares settler colonial theories developed by Australian historians Patrick Wolfe and Lorenzo Veracini with the theory of the coloniality of power of the Peruvian sociologist Aníbal Quijano. The author argues that Wolfe’s and Veracini’s theory of settler colonialism creates a conceptual distancing from what they call exploitation colonialism that is not only theoretically unsound, but also historically inaccurate. The (...) land/labor binary that they build in their theory of settler colonialism holds up only if it excludes Latin America from the analysis. This becomes evident in their analyses of the state, race, and miscegenation. Both theories, however, largely ignore gender in the description of colonization, a gap that Latin American decolonial theorists and feminist indigenous theorists of the north must fill. The article considers two different interpretations of the reason model of precedent pioneered by John Horty. On a plausible interpretation of the reason model, past cases provide reasons to prioritize reasons favouring the same outcome as a past case over reasons favouring the opposing outcome. Here I consider the merits of this approach to the role of precedent in legal reasoning in comparison with a closely related view favoured by some legal theorists, according to which past cases provide reasons (...) for undercutting (or ‘excluding’) reasons favouring the opposing outcome. After embedding both accounts within a general default logic, I note some important differences between the two approaches that emerge as a result of plausible distinctions between rebutting and undercutting defeat in formal models of legal reasoning. These differences stem from the ‘preference independence’ of undercutting defeat. Undercutting reasons succeed in defeating opposing reasons irrespective of their relative strength. As a result, the two accounts differ in their account of the way in which precedents constrain judicial reasoning. I conclude by suggesting that the two approaches can be integrated within a single model, in which the distinction between undercutting and rebutting defeat is used to account for the distinction between strict and persuasive forms of precedential constraint. This scenario-based study examines the perceptions of university students in the United States and Australia regarding the ethics and acceptability of various sales practices. Study results indicate several significant differences between U.S. and Australian university students regarding the perceptions of ethical and acceptable sales practices. These differences centered on company-salesperson and salesperson-customer relationships. The findings are significant for the employer, and have consequences for customers and competitors. They also have implications for recruiters and managers of salespeople, academics with an interest (...) in understanding cross-national differences in sales ethics, and educators preparing students for future careers as business professionals. This article provides an overview of recent results on lexicographic, linear, and Bayesian models for paired comparison from a cognitive psychology perspective. Within each class, we distinguish subclasses according to the computational complexity required for parameter setting. We identify the optimal model in each class, where optimality is defined with respect to performance when fitting known data. Although not optimal when fitting data, simple models can be astonishingly accurate when generalizing to new data. A simple heuristic belonging to the (...) class of lexicographic models is Take The Best (Gigerenzer & Goldstein (1996) Psychol. Rev. 102: 684). It is more robust than other lexicographic strategies which use complex procedures to establish a cue hierarchy. In fact, it is robust due to its simplicity, not despite it. Similarly, Take The Best looks up only a fraction of the information that linear and Bayesian models require; yet it achieves performance comparable to that of models which integrate information. Due to its simplicity, frugality, and accuracy, Take The Best is a plausible candidate for a psychological model in the tradition of bounded rationality. We review empirical evidence showing the descriptive validity of fast and frugal heuristics. (shrink)

Thinking is known to be state dependent but a systematic study of how thinking in dreams differs from thinking while awake has not been done. The study consisted of analyzing the dream reports of 26 subjects who, in addition to providing dream reports also provided answers to questions about their thinking within the dream. Our hypothesis was that thinking in dreams is not monolithic but has two distinct components, one that is similar to wake-state cognition, and another that is fundamentally (...) different. We found that cognition within a dream scenario was similar to that of wake-state cognition, but that thinking about the scenario itself was deficient and very different than wake-state thinking. Using data from the China Education Panel Survey, which was a nationally representative sample of junior high school students, this study examined the association of internal migration with depression among migrant and left-behind children, while exploring the moderating effect of gender difference and the mediating effects of social relationships. The results showed that migrant children had a significantly lower level of depression than left-behind children. Further, the difference in mental health between migrant children and left-behind children was more prominent for (...) boys than girls. The mechanism analyses indicated that compared to left-behind children, internal migration positively predicted parent–child relationships and peer relationships of migrant children, which in turn reduced their depressive symptoms. Although migrant children suffered from a higher level of teacher discrimination than their left-behind counterparts, it had no significant relationship with depression after controlling for children’s social relationships with parents and peers. Our findings suggested that migrating with parents was helpful to reduce children’s depressive symptoms in comparison with being left behind. Therefore, actions should be implemented to reduce the occurrence of involuntary parent–child separation and the prevalence of children’s depressive disorders due to institutional constraints. In addition, necessary treatments are needed to improve the psychological wellbeing of disadvantaged children, especially among left-behind children with mental illness. (shrink)

Scepticism is central to Nietzsche’s philosophical project, both as a tool of criticism and, through its role in self-transformation, as a tool for responding to criticism. While its importance in his thought and its complexity have been acknowledged, exactly what kind of scepticism Nietzsche calls for still stands in need of analysis. Jessica Berry’s [Nietzsche and the Ancient Skeptical Tradition. New York: Oxford University Press, 2011] comparison between Nietzsche and Pyrrhonian scepticism recognized the importance of the practical dimension of (...) Nietzschean scepticism but distorted Nietzsche’s philosophy in attempting to paint it as Pyrrhonian in character. Earlier discussions recognize Nietzsche’s opposition to Pyrrhonian suspension of judgement and tranquillity. They have not, however, explored in sufficient detail Nietzsche’s sceptical practice and how it affects the individual. In this article, I combine Berry’s emphasis on scepticism as a practice with attention to the important differences between Nietzsche and Pyrrhonism. I outline Nietzsche’s scepticism as a transformative practice, arguing that its differences from Pyrrhonian scepticism are as illuminating as any similarities. The scepticism that Nietzsche advocates involves not just destruction of our beliefs but destruction of who we are, and at the same time as cultivating the capacity to do without certainty, requires an experimental engagement with our drives – allowing the creation of new values. In this paper, we present a striking parallel between Greek and Korean in the formation and interpretation of metalinguistic comparatives. The initial observation is that both languages show an empirical contrast between “regular” comparative and metalinguistic comparative realized in (a) the form of a designated metalinguistic comparative MORE; and (b) in the form of THAN employed. We propose (building on our earlier analyses in Giannakidou and Stavrou 2009, Giannakidou and Yoon 2009) that the metalinguistic comparative is perspectival, i.e. it introduces (...) the point of view of an individual towards a sentence, and argue that the individual expresses invariably an attitude of preference: she prefers one sentence (the sentence itself, or the proposition it expresses) in a given context over another. The preference may come out as completely negative in certain cases, and this is manifested as yet another lexicalization in Korean (charari), which selects nuni-THAN, which itself carries a negative expressive index (in the sense of Potts 2007), we will claim. Expressive negativity is not equivalent to negation in syntax, as nuni alone cannot license NPIs that need negation. If our analysis is correct, it has one important implication that goes beyond just the metalinguistic comparatives in the individual languages we are considering. It allows the generalization that metalinguistic functions in language are indeed part of the grammar. In particular, they are reflexes of grammaticalization of perspective and subjective mode, on a par with predicates of personal taste discussed by Lasersohn 2005, 2008, 2009, mood choice, and similar phenomena. In comparatives, subjective mode is manifested as an ordering of preference. (shrink)

Despite an increase in international business ethics research in recent years, the number of studies focused on Latin America and China has been deficient. As trade among Pacific Rim nations increases, an understanding of the ethical beliefs of the people in this region of the world will become increasingly important. In the current study 208 respondents from Peru and China are queried about their ethical ideologies, firm practices, and commitment to organizational performance. The empirical results reveal that Chinese workers are (...) more relativistic and less idealistic than their Peruvian counterparts. One explanation for the disparity between these two groups is likely the variation in collectivism that can be traced to different levels of importance across ingroups and outgroups. As political and economic systems of the world become increasingly globalized, education systems in developed nations have established standardized curriculum. Meanwhile, opposing interpretations of globalization, neoliberalism and progressivism, have inspired the growth of different paradigmatic models for global education. Grounded in neoliberalism, the human capital model views education as a means for preparing a skilled workforce; derived from progressivism, the world systems model focuses on educating individuals for global citizenship and civic participation. The purpose of this document analysis is two-fold: (...) (1) to examine the social studies content standards of the U.S. and other developed countries to determine how globalization is presented in state-mandated curricula, and (2) to evaluate whether the depiction of globalization in each set of standards reflects a human capital or world systems model. Our findings indicate that U.S. state content standards heavily emphasize the economics of globalization; non-U.S. standards present a more holistic picture of globalization. Consequently, U.S. standards are more aligned with a human capital model of education whereas non-U.S. standards reflect a world systems interpretation. These findings suggest that students in the U.S. are prepared differently than their counterparts in other developed countries, which has implications for international relations. (shrink)

The present paper has two aims. First, we reconstruct the core of molecular genetics (MOLGEN) i.e. the array of theoretical assumptions which underly all or most applications of molecular genetics. Second, we define a reduction relation p reducing character-factor genetics (CFG) to MOLGEN. That p is a reduction relation is proved by establishing that p satisfies the two major conditions which are discussed in the literature as necessary or ‘essential’ for reduction. This substantiates the claim that molecular genetics is ‘better (...) than’ or ‘more progressive-than’ character-factor genetics-which is commonly held true today. The paper continues, and relies heavily on the definitions given in part 1 (Balzer and Dawe [1985]). The enumeration of the definitions and sections in the present paper continues that of part 1. Considering the fair amount of ancient authors who compiled works on the subject of the ‘History of Philosophy’, it is remarkable—and regrettable—that there is no solid basis for a comparative analysis of their structures. Most ancient histories of philosophy are only preserved in a few fragments or excerpts and hardly allow any meaningful non-trivial comparison of the structure and order of the philosophers and schools discussed. The only more or less entirely preserved ‘History of Philosophy’ is Diogenes Laertius’ famous (...) treatise. Although his work seems to offer an idiosyncratic rendering in some respects, and is hardly representative of the genre, some structural similarities with Sotion's Διαδοχαί (Successions) can be identified. Generally, a crucial question concerning the structure is how the philosophers and their schools were arranged in these works. Did the works basically follow a chronological order? How were the Διαδοχαί arranged? Were certain schools or philosophers dealt with together in a single book or in more than one book, or were they presented in a certain order? (shrink)

Governments are increasingly inviting patient organizations to participate in healthcare policymaking. By inviting POs that claim to represent patients, representation comes into being. However, little is known about the circumstances under which governments accept POs as patient representatives. Based on the analysis of relevant legislation, this article investigates the criteria that self-help organizations, a special type of PO, must fulfil in order to be accepted as patient representatives by governments in Austria and Germany. Thereby, it aims to contribute to the (...) discussion on the role of governments in steering SHOs. There are different degrees of regulation. Governments in both countries not only formulate explicit criteria for SHOs with respect to patient representation but also guide SHOs representing patients through implicit criteria for associations. We discuss the findings against concepts of responsiveness, authorization, and accountability. Our findings indicate that governmental steering is not negative per se as indicated by previous research but—depending on legislative criteria—can promote transparency and democratic quality in patient representation. While niche construction theory locates animal artefacts in their constructors’ environment, hence treating them as capable of exerting selective pressure on both the constructors and their descendants, the extended phenotype concept assimilates artefacts with their constructors’ genes. Analogous contrasts apply in the case of endoparasite and brood parasite genes influencing host behaviour. The explanatory power of these competing approaches are assessed by re-examining the core chapters of Richard Dawkins’ _The Extended Phenotype_. Because animal artefacts have multiple evolutionary consequences for their (...) constructors, the extra-body effects of a gene seemingly include feedback effects on multiple other genes, a result which is more consistent with niche construction theory than with selfish gene theory. In the case of endoparasite genes influencing host behaviour, Dawkins’ argument leaves out what appears to be the key explanatory component, namely the role of the host’s own bodily systems in making it possible for such genes to exist. For action at a distance, it is unclear whether the key genes have extended effects because they sit in the body of the manipulating organism, or alternatively do not have such effects because they sit in the body of its victim. It is argued that niche construction theory offers a superior explanation in all three cases, regardless of whether the extended phenotype concept is interpreted in selfish gene or selfish organism terms. In current debates about coming to terms with individual and collective wrongdoing, the concept of forgiveness has played an important but controversial role. For a long time, the idea was widespread that a forgiving attitude — overcoming feelings of resentment and the desire for revenge — was always virtuous. Recently, however, this idea has been questioned. The contributors to this volume do not take sides for or against forgiveness but rather examine its meaning and function against the backdrop of a (...) more complex understanding of moral repair in a variety of social, circumstantial, and cultural contexts. The book aims to gain a differentiated understanding of the European traditions regarding forgiveness, revenge, and moral repair that have shaped our moral intuitions today whilst also examining examples from other cultural contexts (Asia and Africa, in particular) to explore how different cultural traditions deal with the need for moral repair after wrongdoing. -/- . This chapter examines when and how mental simulation--the consideration of alternatives to present reality--produces emotional responses that reflect either contrast or assimilation. The chapter begins with a description of a comparison domain that is most commonly associated with mental simulation--counterfactual thinking. Then the authors consider how mental simulation plays a critical role in determining assimilative and contrastive responses to other type of comparisons. In Rationalities in history, the distinguished historian David d'Avray writes a new comparative history in the spirit of Max Weber. In a strikingly original reassessment of seminal Weberian ideas, d'Avray applies value rationality to the comparative history of religion and the philosophy of law. Integrating theories of rational choice, anthropological reflections on relativism, and the recent philosophy of rationality with Weber's conceptual framework, d'Avray seeks to disengage 'rationalisation' from its enduring association with Western 'modernity.' This essay examines the relationship that obtains between Merleau-Ponty and Derrida through exploring an interesting point of dissension in their respective accounts of decision-making. Merleau-Ponty's early philosophy emphasizes the body-subject's tendency to seek an equilibrium with the world (by acquiring skills and establishing what he refers to as 'intentional arcs'), and towards deciding in an embodied and habitual manner that minimizes any confrontation with what might be termed a decision-making aporia. On the other hand, in his later writings, Derrida frequently (...) points towards a constitutive 'undecidability' involved in decision-making. He insists that a decision, if it is genuinely to be a decision, must involve a leap beyond all prior preparations, and this ensures that an aporia surrounds any attempt to decide. One must always decide without any equilibrium or stability, and yet these are precisely the things that Merleau-Ponty claims that our body moves us towards. Most of this essay will explore the significance of this disparity, and it will be argued that many of Merleau-Ponty's insights challenge the Derridean conception of the undecidability involved in decision-making. This becomes most obvious when comparing the decision-making processes of those expert in a particular field to those who are merely competent (for example chess), and this essay will attempt to establish that the aporia that Derrida discerns can actually be seen to constrict. In this article, I compare WANG Bi’s 王弼 rendition of Dao 道 as the nameless, unfathomable root of language and the totality of beings, with Derrida’s analysis of the term khōra. Both cases include a text that presents itself as a commentary on another text, namely the Laozi 老子 for Wang Bi and Plato’s Timaeus for Derrida, whose matter is declared as elusive and ungraspable. I analyze the analogies between these two attempts to convey the unsayable, as well as the (...) philosophical differences in highlighting the “ipseity,” or the “otherness,” of what resides beyond the edge of discourse. On the basis of my analysis, I claim that decisive parallelisms can be found in the homology between text and theme, in the linguistic strategies and common metaphors, whereas the main difference lies in the metaphysical background. Whereas the Dao presumes a harmonious ability for self-ordering, khōra is centered on the concept of absolute otherness, whose unsayability is that of an entity that is constantly removing itself from any determination and which properly consists in dispossessing itself.
