The International Olympic Committee (IOC) has always been plagued by what queer theorist Judith Butler calls gender trouble. In 2000, the IOC discontinued their practice of sex-testing because medical experts could not agree on what defined a genetic female and so an adequate medical testing measure could not be found. In response to outside pressure, the IOC adopted a policy enabling transsexual athletes to compete in the 2004 Olympic Games. This article argues that the IOC policy on sex reassignment does (...) not operate to guard against discrimination and harassment against transsexual athletes but that it operates to maintain the popular illusion that there are two, binary gender designations. While both transsexual and Olympic bodies have unique histories and vastly different experiences in the social and political realms, using psychoanalysis we contend that the need to test gendered bodies is incited by an anxiety about bodily deterioration, aging, and, ultimately, mortality. This article allies the 1997 PlayStation video game Final Fantasy VII with Slavoj Žižek’s writings on ecology to critique the area of legal philosophy known as ‘earth jurisprudence’. Earth jurisprudents argue that law bears a large part of the responsibility for humanity’s exploitation of the environment, as law helps to bar nature from subjectivity. However, as Žižek warns—and as FFVII illustrates—the desire for meaning incites people to manufacture a harmonious vision of nature that obscures the chaotic forces at work in (...) the environment and ultimately absolves humanity of responsibility towards the world. Therefore, earth jurisprudence’s program of using legal rights to limit human intervention should be rejected in favour of an approach that enables people to take an active role in addressing the ecological crisis. In this paper I ask whether in Aristotle's metaphysical system the form of a non-living sensible substance, such as the form of this house, is or is not universal. I argue that his position as it stands is self-contradictory, and then try to give some account of the pressures that led to this central contradiction in Aristotle's metaphysical thought.

Although widely accepted to be the capacity to exercise control in one’s learning, there remains confusion about what exactly this means. Failure to reconcile contradictions has left the field resigned to pluralism, describing ‘versions’ of learner autonomy according to divergent theoretical orientations. However, each version is incomplete, rendering it unreliable as a basis for practice: educational initiatives that seek to foster learner autonomy from one perspective, run the risk of inadvertently undermining it from another. In an attempt to rectify this, (...) I turn to philosophies of personal autonomy, which I analyse in relation to learner autonomy to identify criteria for its achievement, regardless of version. If we acknowledge that learners are ever embodied, emplaced and sociohistorically situated, as we must, learning is a process of identity construction in relation to context. To be in control of this process is to define ourselves in terms of authentic values, the expression of which may require resolve to stay one’s path or resistance to pressure to act otherwise, all of which is contingent on affordances and constraints that are inherent to our embodied, emplaced and sociohistorical constitution. Historically, entities with a vested interest in a product that critics have suggested is harmful have consistently used research to back their claims that the product is safe. Prominent examples are: tobacco, lead, bisphenol A, and atrazine. Research literature indicates that about 80–90 % of studies with industry affiliation found no harm from the product, while only about 10–20 % of studies without industry affiliation found no harm. In parallel to other historical debates, recent studies examining a possible relationship between (...) mercury exposure and autism spectrum disorder show a similar dichotomy. Studies sponsored and supported by industry or entities with an apparent conflict of interest have most often shown no evidence of harm or no “consistent” evidence of harm, while studies without such affiliations report positive evidence of a Hg/autism association. The potentially causal relationship between Hg exposure and ASD differs from other toxic products since there is a broad coalition of entities for whom a conflict of interest arises. These include influential governmental public health entities, the pharmaceutical industry, and even the coal burning industry. This review includes a systematic literature search of original studies on the potential relationship between Hg and ASD from 1999 to date, finding that of the studies with public health and/or industry affiliation, 86 % reported no relationship between Hg and ASD. However, among studies without public health and/or industry affiliation, only 19 % find no relationship between Hg and ASD. The discrepancy in these results suggests a bias indicative of a conflict of interest. (shrink)

Varela's enactive approach to cognitive science has been elaborated into a theoretical framework of agency, sense-making, and sociality, while his key methodological innovation — neurophenomenology (NP) — continues to inspire empirical work. We argue that the enactive approach was originally expressed in NP as three core tenets: (1) phenomenological pragmatics, (2) embodied cognition, and (3) conscious efficacy. However, most efforts in NP have focused on applying tenet 1, while tenet 2 has received notably less attention, and there is even explicit (...) distancing from tenet 3. By way of a critical review of four case studies, we show how NP thereby falls short of its full potential. Crucially, it needs to demonstrate that the first-person perspective matters, not only as a source of correlations with third-person data, but because lived experience, as such, makes a difference in its own right to the living body's dynamics. Given that methods for improving subjective reports have become accepted in human neuroscience (tenet 1), and given the increasing availability for recording multi-scalar organismic activity during embodied action (tenet 2), we propose it is time to integrate these research strands by using this issue of conscious efficacy as a pivot point (tenet 3). The development of genuinely experience-involving accounts of neurophysiological activity during embodied action holds promise for rebooting neurophenomenology in stronger form. (shrink)

Patients who are dying of cancer usually give up eating and then stop drinking. This raises ethical dilemmas about providing nutritional support and fluid replacement. The decision-making process should be based on a knowledge of the risks and benefits of giving or withholding treatments. There is no clear evidence that increased nutritional support or fluid therapy alters comfort, mental status or survival of patients who are dying. Rarely, subcutaneous fluid administration in the dying patient may be justified if the family (...) remain distressed despite due consideration of the lack of medical benefit versus the risks. Some cancer patients who are not imminently dying become dehydrated from reversible conditions such as hypercalcaemia. This may mimic the effects of advanced cancer. These conditions should be sought and fluid replacement therapy should be given along with the specific treatments for the condition. (shrink)

The authors of this essay have been committed practitioners and teachers of Philosophy for Children in a variety of educational settings, from pre-schools through university doctoral programs and in adult community and religious education programs. The promotion of critical thinking has always been a primary goal of this movement. But communal practices of critical thinking need to include other kinds of democratic conversation that prompt us to see others as full-fledged persons and to be curious about how our being in (...) community with them makes growth and self-correction possible. As we continue to experiment and innovate in new contexts we see ourselves continuing the inquiry around expanding the inclusivity of conversations about basic human concerns. In this essay we describe an inclusive strategy called the story circle, that was first developed as a method of popular education in Denmark and was then adapted as a tool of social change among poor and dis-empowered American citizens in Appalachia. Story circles were later utilized in a philosophical living-learning community and most recently coupled with Lipman and Sharp’s dialogue method of the community of philosophical inquiry. The authors of this paper have combined story circles with the community of philosophical inquiry in a variety of contexts. In each iteration, telling one’s own story and listening carefully to the stories of others can be equally revelatory actions. (shrink)

Since the Fall of 1993, at the Centre Interdisciplinaire de Recherche sur l'Apprentissage et le D/span>veloppement en /span>ducation of the Universit/span> du Qu/span>bec /span> Montr/span>al, two mathematicians and one philosopher have collaborated to design and develop a research project involving philosophy, mathematics and sciences. Previous observations in the classroom had led the researchers to realize that, within the school curriculum, children like some subject matters and dislike others. Most of them usually succeed in arts, physical education and language arts, but (...) many have difficulties in succeeding in mathematics. Why? On the one hand, as Matthew Lipman advocates, the school curricula are not sufficiently "meaningful" for children. On the other hand, some studies in the field of mathematics suggest that there are myths and prejudices about mathematics in primary schools and that the school system is partly responsible for this. Indeed, the school system does not invite children to express emotions in class about mathematics nor does it favor creativity. It does not allow dialogue among peers about mathematical concepts and problems, nor the construction of mathematical knowledge by the students themselves. (shrink)

THE DISCUSSION OF THE TERMS we use to speak of experiences on the boundaries between spirituality and mental disorder is very important. Jackson and Fulford (1997) have gone a long way to avoid flattening the concepts into a single conceptual scheme, too far for some of (...) their critics like Littlewood (1997) and Storr (1997), but not far enough for Bratton and Marzanski (2002), who eventually accuse them of "anthropocentric psychologism." They want to preserve theological categories intact, mainly because this is how the subjects themselves see their experiences, but also because there is, they hold, additional explanatory value in such a language schema. As evidence they point to unremarkable attitudes and practices, which are nonetheless demonstrably part of the Christian way of life.The borderlands between theology and psychiatry are not alone in witnessing this dispute. A similar conflict has arisen in the discussion of public policy. In politics, people of religious conviction or representatives of faith communities have sometimes been told either to hold their tongues (because "not many people believe these things nowadays" or because "it's wrong to impose your beliefs on other people") or to formulate their proposals in nonreligious language. It is far from obvious that this is not a sophisticated form of discrimination, nonetheless objectionable for its being practiced by nonreligious people. The creation of genuine equality of access to the space for public discussion of political proposals is not at all easy.I have personal experience of the analogous difficulty in psychiatric practice. In a discussion of the overinvolvement of carers for a person with mental health problems self-sacrificing behavior was used with a negative connotation. But, as in the case of Carol, how were these actions to be construed—were they normal for a Christian or psychopathological? My personal response is that it is correct to say that a boundary exists between ordinary Christian spiritual experience (the kind that religious believers would immediately recognize as part of their religious lives) and disturbed or distorted perceptions that are the result of mental illness and can be mitigated by appropriate treatment. But the fact that a boundary exists in principle does not necessarily imply that it is always easy to draw the distinction in practice. Typically the cases that cause the most difficulty lie on the borderlands. Although on the face of it, it looks attractive to demonstrate the security of the criteria by making discriminations in precisely this area (and the point of the cases in Jackson and Fulford is precisely that they raise these complexities), in [End Page 381] fact it may be that such instances require both languages. In this case, Bratton and Marzanski are correct to argue for the retention of a theological frame of reference. The strength of their argument lies precisely in the support that fellow members of the respective faith communities are able to give to the people who, despite their manifest illnesses, persist in religiously justifiable courses of action.The paper raises one very important matter that bedevils a lot of the current literature, namely how spirituality is to be understood. In my view, there is a lot of purely arbitrary definition of this term, whose meaning has developed rapidly under specific social conditions (Sykes 2000a). In medicine, it functions best when it is taken to be a reminder that a patient may have had contact with a specific religious tradition that has contributed or still contributes to her worldview. In modern Western society, account has to be taken both of residual religiosities or fallback positions, and of new religions, as well as of traditional religious groupings. Each contributor conveys the ways in which people challenge the ascribed moral standards of custom, religious belief, bureaucratic policies through passionate words such as anecdotes, joke, rumors, and gossip. Tyreman and Loughlin make many varied and interesting comments, but neither, it is encouraging to find, is prepared to defend the psychogenic inference. Indeed, Loughlin finds the paper “somewhat shocking.” “The psychogenic inference,” Loughlin writes, “seems such an obvious fallacy, yet he [Sykes] shows, with detailed reference to both diagnostic practice and the literature on mental disorders, the extraordinary pervasiveness of its influence, extending even to the systematic ambiguities built into key diagnostic terms” (2010, 305). As a performative activity, music has the potential to help explain the interpretive and rhetorical work of lawyering. As an aesthetic creation that reflects and shapes individual identities and social bonds, music is a cultural force that may contest or enhance political and legal power. The papers in this special issue contribute to the expanding field that pairs law and music by examining how music has affected legal practices and legal thinking in particular historical and cultural instances.

Peripersonal space (PPS) is frequently defined as a plastic, pragmatic and goal-directed multisensory buffer that connects the brain-body with its immediate environment. While such characterisations indicate that peripersonal spatiality is profoundly embodied and enactive, comparatively few attempts have aimed to systematically synthesise PPS literature with compatible phenomenological accounts of lived space provided by Heidegger and Merleau-Ponty. Moreover, in traditional cognitive neuroscience, neurophysiological activity is thought to map onto discrete ‘cognitive correlates’. In contemporary 4E approaches to cognition, however, phenomenology-derived notions such (...) as ‘pre-reflective cognition’ and ‘motor-intentionality’ frequently appear, yet their neural correlates may be comparatively difficult to pin down. Pre-reflectively, agents seemingly do not thematise spatial properties as operationalised in key experimental paradigms (e.g., spatial rotation tasks) but are instead inherently spatially embedded within the world. To refine this distinction, I survey how tools co-determine this distinctly spatial ‘world-embeddedness’ using a neurophenomenological methodology (Varela, _Journal of Consciousness Studies, 3_(4), 330–349, 1996 ). Specifically, I conduct two neurophenomenological analyses of tool-perception and tool-use, examining both how distance modulates affordance-perception and how tool-use remaps bodily space via the withdrawal of tools from intentional-objects into co-constituting motor-intentionality itself. I conclude by briefly distinguishing this interpretation of spatial cognition from cognitivist frameworks. Thereafter, I briefly highlight the temporal scaffolding underlying PPS while conceptually grounding my account within Embodied Simulation Theory (Gallese, _Reti, Saperi, Linguaggi_, (1), 31–46, 2018 ). What is at stake is thus both an explicitly embodied-enactive account of bodily space that is qualitative and situational instead of quantitative and positional, as well as a viable, interdisciplinary strategy for unifying pre-reflective cognition with neurophysiological data. In their Bioessays review ‘Current views of collagen degradation’, Gillian Murphy and John Reynolds gave an outline of the molecular structure of the members of the collagen family and described their traditional role in providing stable tissue frameworks.1 This short review considers the relationship between the different members of that family and what gene structure reveals about their evolution.
