Mary Ann Meeker’s article admirably reminds readers that family members are involved in—or “responsively manage”—the care of relatives with severe illness in ways that run considerably beyond the stereotypes at play in many bioethical discussions of advance directives. Her observations thus make thinking about the role of families in healthcare provision more adequate to the facts, and this is an important contribution. There’s reason to be worried, however, that one explicit aim of the article—to ease the standing anxieties that (...) many clinicians and ethicists have about the reliability of family members as proxy decision makers—will be frustrated by its very success. Those already inclined to suspicion may tend to think that the more intricate and pervasive the ways in which families influence the healthcare decision making of their sick, the more chances they have for altering the connection between patients’ interests and the actions of professional providers.To determine whether and when such alterations are something to be concerned about, we’ll need to supplement a better grasp of the pertinent facts with a deeper sense of how human agency works and why we value it. We may also need some reminders about the defensibility of diverse moral understandings. Although both professionals and family members may profess an ethic that sets patients’ interests above those of non-patients—as Meeker’s own results suggest—any strict allegiance to such a framework may be more notional than normative—as her findings also hint. The actual working norms (among professionals, as well as within families) will likely be more complex, but not necessarily any the less defensible for that. (shrink)

This dissertation presents an objection to Wittgenstein's concept of family resemblances, three possible solutions to the objection, evaluations of the solutions, and a sketch of Wittgenstein's approach to the objection. My thesis is that none of the three proposed solutions is satisfactory, but that Wittgenstein can deal with the objection. ;Chapter I presents the Problem of the Under-Determination of Extension, the claim that family resemblances are not enough to explain the extension of a concept, since resemblances may be (...) postulated between cases falling under different concepts. ;Chapters II and III discuss three solutions proposed by commentators on family resemblances. The Basic Predicates Solution claims that points of family resemblance are sufficient conditions, and is incorrect since Wittgenstein denies that one can infer the applicability of a concept based on the presence of a resemblance to an instance of the concept. The Simple Properties Solution claims that only some concepts are family resemblance concepts, and depend upon concepts which are not family resemblance concepts, and is incorrect, since Wittgenstein does not require that family resemblance concepts be reducible to non-family resemblance concepts. The Bi-Directional Determination of Concepts Solution is the claim that a concept is determined by an interaction between facts about cases subsumed under it, and needs and purposes of language-users. This solution is non-Wittgensteinian by ignoring the ramifications of his concepts of grammar and language-games. ;Chapter IV argues that Wittgenstein deals with the original objection by developing new models for understanding language, involving the concepts of grammar and language-games. The Western focus on personal autonomy as the normative basis for securing persons’ consent to their treatment renders this autonomy-based approach to informed consent vulnerable to the charge that it is based on an overly atomistic understanding of the person. This leads to a puzzle: how does this generally-accepted atomistic understanding of the person fits with the emphasis on familial consent that occurs when family members are provided with the opportunity to veto a prospective donor’s wish to donate after (...) she has died and her organs are being considered for harvesting? It is argued in this paper that this charge can be met and this puzzle dissolved once it is recognized that autonomy is an inherently social concept. (shrink)

A spectator of the passing philosophical scene, recently encountering the current controversy about “resolute readings” of the Tractatus, might be forgiven for finding it difficult to figure out what the debate is supposed to be about and who exactly is on which side and why. This chapter demonstrates, through a reconstruction of some relevant features of “the” debate, that at one point there are in fact several orthogonal debates taking place, confusedly cast as contributions to a single debate. It indicates (...) some of the respects in which the term “resolute reading” has come to acquire different meanings, and sometimes even a different logic. The chapter traces the shifts in the meaning of the term “resolute reading” and the related family of cognate and contrastive expressions. On the one hand, the societal, economic, and family contexts of William James are addressed, and connected a modern academic context of business ethics research, marketing and purchasing decision making, and the continuing financial crisis. We first relate Lambert Strether's embassy seeking Chad's return to Woollett to what Alexander Pope famously designated the "Embassy to Achilles," i.e., the Achaean effort to induce Achilles's return to battle. Achilles impassionedly rejects the embassy's hypocrisy; he will not be bought. We then find Chad Newsome conspiratorially excluding Strether from the family fortune via intended marriage to Mrs. Newsome. The following little paper has a rather large scope. No particular issue or problem has occasioned this text; rather, it presents a mini-treatise on love, marriage, and parenting. The attempted method is quasi-Hegelian: to allow one topic to engender a further topic, and this in turn to engender a third, etc., while avoiding at any stage anticipations of later topics. If reasoning in accordance with this dialectical method is successful, the result is a system of topics, but it is contingent (...) whether or not these topics can be employed as knowledge of the historical world. Indeed, some of the topics considered below cannot be employed descriptively under present historical conditions. Thus, those who would execute this dialectical project must renounce any claim that the system of topics has more than a contingent relation to knowledge, but it would be utter misology to denigrate this project merely because it requires this renunciation. How ought we to understand the sources and limits of the authority of family members to make health care decisions for their decisionally incapacitated relatives? This question is becoming increasingly crucial as the population ages and the power of medical technology waxes. It is also becoming increasingly contested, as faith in advance directives shows signs of waning, and the moral complexities of intimate relationship become more theoretically patent.This last point—the newly visible moral richness of intimate relationship—provides this paper with (...) its field. I am interested in probing the images of the relationship between self and other, particularly self and intimate other, that seem presupposed by some leading attempts to determine the basis for proxy decision-making authority, and what constraints it must observe. In the light of both recent work in the philosophy of mind and considerations closer to common experience, the reigning images seem too slight to support the weight of current practices and beliefs about proxy authority; supplanting them with images more faithful to our experience will have implications for our practice with proxies. Behavior genetics is a controversial science. For decades, scholars have sought to understand the role of heredity in human behavior and life-course outcomes. Recently, technological advances and the rapid expansion of genomic databases have facilitated the discovery of genes associated with human phenotypes such as educational attainment and substance use disorders. To maximize the potential of this flourishing science, and to minimize potential harms, careful analysis of what it would mean for genes to be causes of human behavior is needed. (...) In this paper, we advance a framework for identifying instances of genetic causes, interpreting those causal relationships, and applying them to advance causal knowledge more generally in the social sciences. Central to thinking about genes as causes is counterfactual reasoning, the cornerstone of causal thinking in statistics, medicine, and philosophy. We argue that within-family genetic effects represent the product of a counterfactual comparison in the same way as average treatment effects (ATEs) from randomized controlled trials (RCTs). Both ATEs from RCTs and within-family genetic effects are shallow causes: They operate within intricate causal systems (non-unitary), produce heterogeneous effects across individuals (non-uniform), and are not mechanistically informative (non-explanatory). Despite these limitations, shallow causal knowledge can be used to improve understanding of the etiology of human behavior and to explore sources of heterogeneity and fade-out in treatment effects. Feminist and socialist movements both aim at emancipation yet have often been at odds. The socialist feminists of the Paris Commune provide one of the few examples in late nineteenth-century Europe of a political movement combining the two. This article offers a new interpretation of the Commune feminists, focusing on the working-class women’s organisation the Union des femmes. We highlight how the Commune feminists articulated the specific form of oppression experienced by working-class women as both women and workers, which consequently (...) required a joint, yet differentiated, struggle to overcome. We explore three aspects of this framework. First, the Commune feminists offered a vision of the transformation of the social through reforms to girls’ education, the family and women’s work. Second, they practised a politics of coalition building by connecting their struggle with those of other oppressed groups, such as male workers, peasants and workers of other nations. Third, these ideas were instantiated in the Union des femmes’ novel proposal for women’s worker co-operatives as part of a socialist re-organisation of the economy. (shrink)

With the development of the division of labor, the household has declined in importance as a unit of economic production. Yet even as the individual wage earner has assumed a central place in modern exchange economies, the household has still been seen as an important unit of distribution, in which wage earners provide for their non-income-producing family members. With the breakdown of the family in recent decades, however, the communal income-sharing function of the family has, in significant (...) part, been taken overby the state. In this essay, I examine this fundamental change in the structure of production and distribution in modern exchange economies. Going beyond this, I propose a new structure of markets–markets for rights to influence collective decision-making within a society. We know from the research literature that psychotherapy is effective, but we also know that hundreds of diverse therapies are being practiced that have not been subjected to scientific scrutiny; thus, in some circumstances iatrogenic effects do occur. Therefore, it is crucial that we recognize and implement therapeutic interventions that are evidence based rather than succumb to ethical dilemma, frustration, and complacency. Recommendations for family therapists are discussed, including the need to (a) keep abreast of research findings, (b) translate (...) research findings and developments as they apply to clinical practice, (c) prioritize techniques and intervention models, and (d) reexamine funding priorities and research foci. Objections that Nancy's position is apolitical and ethically ambiguous take insufficient notice of the different task he has set himself. The preposition "with" names this new ontological conception of community, relieving it of a unifying point. Interactions with global markets offer development opportunities for Indigenous communities. They also place pressure on the natural resources that communities depend upon for their livelihood and, in many cases, their political and cultural autonomy. These markets often interact with family-based enterprises embedded within commons, with important implications for the social relationships and shared territorial resources that characterise such regimes. In this paper, we analyse the relationships that exist between commons, global markets, and small-scale family enterprises, using the case (...) of mezcal production—an alcoholic beverage made from agave—in an Indigenous community in Oaxaca, Mexico. Most mezcal production is organized at the family level; yet the raw materials and inputs necessary for making mezcal are held communally and regulated by locally-crafted institutions. Empirical data show that as family enterprises engage with an emergent global market for mezcal, the commons become essential for not only protecting territorial resources but also maintaining a degree of autonomy from powerful global markets and value chains. However, this requires substantial investment in monitoring and enforcement, and for community members to value sustainable commons management over short-term economic self-interest. To seek autonomy while participating in global markets, producer families also join together to develop cooperative strategies to access markets on better terms. (shrink)

Some Bayesians have suggested that beliefs based on ambiguous or incomplete evidence are best represented by families of probability functions. I spend the first half of this essay outlining one version of this imprecise model of belief, and spend the second half defending the model against recent objections, raised by Roger White and others, which concern the phenomenon of probabilistic dilation. Dilation occurs when learning some definite fact forces a person’s beliefs about an event to shift from a sharp, point-valued (...) subjective probability to an imprecise spread of probabilities. Some commentators find dilation disturbing, both from an epistemic and a decision-theoretic perspective, and place the blame on the use of sets of probabilities to model opinion. These reactions are based on an overly narrow conception of imprecise belief states which assumes that we know everything there is to know about a person’s doxastic attitudes once we have identified the spreads of values for her imprecise credences. Once we recognize that the imprecise model has the resources to characterize a much richer family of doxastic attitudes than this, we will see that White’s charges of epistemological and decision theoretic incoherence are unfounded. Is “good” a family-resemblance concept? Wittgenstein holds it is, since cases of goodness may not have anything in common, but there may be a continuous transition from some cases to others. Von Wright and Hacker argue it is not. They hold that family-resemblance concepts satisfy two conditions that goodness does not satisfy. I assess their arguments and then present a constitutivist account of goodness that Wittgenstein seems to endorse. The constitutivist account is what one would expect if goodness (...) was a family-resemblance concept. The article by Professor Baergen and Dr. Woodhouse makes a succinct and serious contribution to progress in bioethical understanding of deciding for others. They begin with what is by now a familiar claim: family proxy decision makers may sometimes make decisions on behalf of incapacitated relatives that depart from what might be optimal from the patient’s point of view, since the well-being of family members, or of the family as such, may be substantially affected by the direction (...) of a patient’s care. They then develop this idea, noting that others apart from family members can also be substantially affected by a patient’s treatment, and arguing that the interests of strangers ought also to sometimes have a role in determining the aims and means of a patient’s treatment.Baergen and Woodhouse also devote attention to how extra-familial interests might be implemented in medical decision making. While I unearth a troubling consequence of the effort to realize their theoretical conclusion practically, my chief task is to point to some disanalogies between families and strangers, and consider the extent to which they call into question the relevance of the interests of strangers to the treatment of patients. The wife of a childhood friend was a close match and gave him one of her kidneys. Before his transplant, aerobic exercise was difficult; a few months after transplant, (...) Slakter could ride his bike, hike, and work out with a personal trainer. He no longer had to weigh food or gauge his potassium consumption, a concern for people with kidney failure. For Slakter, “life post-transplant has been a significant improvement.”Individuals or family members of those who have received an organ transplant from a living or deceased donor share their stories in this issue of Narrative Inquiry in Bioethics. The symposium is titled “Receiving the Gift of Life: Stories from Organ Transplant Recipients.” Organ transplantation can extend an individual’s life by decades. It can also greatly improve an individual’s quality of life, as was Slakter’s experience. At the same time, organ transplantation is expensive and stressful. Recipients can experience complications, including organ rejection, and there are few appealing alternatives.After her heart transplant, author Leilani R. Graham required four open-heart surgeries, ECMO, and an intra-aortic balloon pump. She experienced delirium, necrotizing pneumonia, and severe muscular atrophy that required her to re-learn how to walk. She struggled with weight gain, explosive mood swings, hair loss, and was terrified that her body would reject the new heart. For Graham, “[Transplant] was not the miracle [she] was hoping for.” Graham says she felt unprepared for and inadequately informed about what to expect after her transplant, which left her “battered, beaten, and bruised” with a 12-inch line from neck to navel and “bullet holes” up and down her torso from the chest tubes. When reflecting on her experience post-transplant, Graham says, “It wasn’t the physical trauma that hurt the most. It was that no one seemed surprised [by the aftereffects of transplant].” Seemingly no one, that is except Graham, who calls on transplant providers to “prioritize empathy.”The symposium editors are Jason T. Pearlman. The relief of suffering is a primary goal of medicine. However, the authors note that clinicians often miss or ignore suffering because they focus on the causes rather than the experience of suffering, or the subjective nature of suffering makes it difficult to discuss. The authors believe that “the key to communicating about suffering lies in finding [End Page vii] the right kind of words to describe the experience” and say that figurative language offers a promising approach. In their research, the authors performed qualitative analysis on 52 works of literature and identified 254 excerpts of figurative language with themes of non-physical or psychological suffering. The authors found 13 salient themes: brokenness, diminishment, disorientation, drowning, emptiness, imprisonment, battle, darkness, isolation, invisibility, lifelessness, punishment, and torture. The authors reiterate that developing a shared language of suffering could foster a therapeutic patient-clinician relationship and improve clinicians’ ability to recognize and address a patient’s experience of suffering.María Susana Ciruzzi wrote the first of two case studies included in this issue. “The Sword of King Solomon” addresses a tragic and difficult subject—how to navigate the situation posed by conjoined twins when “any decision will produce damage and suffering.” The case involves two infant male patients born at 37 weeks gestation as omphalo-ischiopagus conjoined twins...
