Panichas, longtime editor of the conservative quarterly Modern Age, brings to a conclusion a critical trilogy, really a tetralogy, which includes The Reverent Discipline, The Courage of Judgment, and The Critic as Conservator. The unusual title is inspired by Plato’s Phaedrus, with Panichas writing at one point—concerning literary scholar Austin Warren’s “open celebration of great ideas, great writers, great souls”—that, “Literary greatness for him meant spiritual greatness, this is, the kind of greatness that gives (...) us guidance and helps to orient us towards the good, or, as Plato puts it, to make us ‘grow wings to overcome gravity’”. Hume, for these purposes, represents 'radical' empiricism, and the attempt to base knowledge solely on experience and what can be validly inferred from it, regardless of how far this leads one from everyday notions and beliefs. Reid, (...) in contrast, represents 'common sense' empiricism, and the view that the. results of experience and deduction must conform to a number of 'first principles or intuitive judgments' (Essays on the intellectual powers of man, VI, 4), which aie unprovable, but which no one can avoid accepting. It is important to be clear about the status of Reid' s 'intuitive judgments', or 'principles of common sense'. They are not merely the general beliefs of a particular culture, which could be 'vulgar errors or preJUdICeS''. Nor are they merely beliefs generally held by people uncorrupted by philosophy. They are assumptions which have to be made if theoretical or practical activity is to be possible at all, principles which are always accepted in practice even by those who deny them in theory. For example, although the uniformity of nature is not a logically necessary truth, everybody always thinks and acts in ways that presuppose that it is true: 'Nature is governed by fixed laws, and if it were not so, there could be no such thing as prudence in human conduct.... the whole fabric of natural philosophy is built upon this principle.' (Essays, VI, 5) Again, everyone, even a theoretical determinist, makes moral judgments and deliberates what to do; and these activities presuppose a belief in human free will. (Essays, ibid.) Hume himself, as Reid was aware, accepted the validity of some principles of this sort, notably of the 42. uniformity of nature. But Reid was dissatisfied with Hume's account, partly because he thought Hume had rejected far too much, and partly because of the grounds Hume gives for accepting, for example, the validity of induction, and the existence of the external physical world. Hume regards these beliefs as non-rational, and deriving from our psychological make-up; it is nature and not reason which causes the belief in an ordered physical reality. In Hume's eyes this is a sufficient justification: if our nature compels us to believe something, this is as good a ground for believing it as any other. Reid, on the other hand, believed, first, that there were many more principles of this sort than Hume had acknowledged, and secondly, that the justification of them was rational, and not merely psychologically determined, since it was based on the impossibility of thinking and acting coherently without them. Hence, even though Hume builds up with one hand what he pulls 'down with the other, and destroys the rational basis for belief only to replace it by one based on human nature and psychology, Reid continues to treat him as the archsceptic. In constructing his list of first principles in Essays, VI, 5, Reid explicitly or implicitly attacks Hume's 'scepticism' on five points - the existence of the mind; the existence of the physical world and the reliability of our senses; the reliability of memory; the reliability of reason; and the uniformity of nature. Against this scepticism he deploys three types of argument. The first is the argument from the universal beliefs of mankind, particular!/ as displayed in the structural features supposedly common to all languages. By the turn of the twenty-first century, women writing about electing to share their lives with female canines directly confront a strange sort of backlash. Even as their extensions of the feminist forms of personal criticism contribute to significant developments in theories of sex, gender, and species, they become targets of criticism as “indulgent” for focusing on their dogs. Comparing these elements in and around popular memoirs like Caroline Knapp's Pack of Two: The Intricate Bond between People and Dogs (...) (1998) and Deirdre McCloskey's Crossing: A Memoir (1999), as well as academic studies like Alice Kuzniar's Melancholia's Dog: Reflections on Our Animal Kinship (2006) and Donna Haraway's When Species Meet (2007), this essay elaborates the ways in which living with and writing about female canine companions informs poststructuralist and feminist questions about the embodiment and performance of structures of authority, including those of academic writers, “dog-mom” stereotypes, and reproductively silenced bodies. Situating these texts amid discussions of form in and around feminist/dog-writing, I argue that together they move narrative beyond the abstract model of the lone “authoritative” human individual, reframing feminist politics as intra-active, even trans-species, from the ground up. What exactly do we do when we try to make sense of other people e.g. by ascribing mental states like beliefs and desires to them? After a short criticism of Theory-Theory, Interaction Theory and the Narrative Theory of understanding others as well as an extended criticism of the Simulation Theory in Goldman's recent version (2006), we suggest an alternative approach: the Person Model Theory . Person models are the basis for our ability to register and evaluate persons having mental as (...) well as physical properties. We argue that there are two kinds of person models, nonconceptual person schemata and conceptual person images , and both types of models can be developed for individuals as well as for groups. Moral agency is limited, imperfect, and structurally constrained. This is evident in the many ways we all unwittingly participate in widespread injustice through our everyday actions, which I call ‘structural wrongs’. To do justice to these facts, I argue that we should distinguish between summative and formative moral criticism. While summative criticism functions to conclusively assess an agent's performance relative to some benchmark, formative criticism aims only to improve performance in an ongoing way. I show that the negative sanctions associated (...) with summative responses are only justifiably imposed under certain conditions when persons exercise their agency wrongly — conditions that do not always hold for structural wrongs. Yet even in such cases we can still use formative responses, which are warranted whenever agents fall short of moral ideals. Expanding our repertoire of moral criticism to include both summative and formative responses enables us to better appreciate both the powers and limitations of our agency, and the complexity of moral life. Most recent discussions of reasons in art criticism focus on reasons that justify beliefs about the value of artworks. Reviving a long-neglected suggestion from Paul Ziff, I argue that we should focus instead on art-critical reasons that justify actions—namely, particular ways of engaging with artworks. I argue that a focus on practical rather than theoretical reasons yields an understanding of criticism that better fits with our intuitions about the value of reading art criticism, and which makes room for a nuanced (...) distinction between criticism that aims at universality and criticism that is resolutely personal. Stephen Carpenter II (bio)Technological media catapults our perception into what Marshall McLuhan called "new transforming vision and awareness."1 As our lives become more and more immersed in such technologies as television, film, and interactive computers, we find ourselves inundated with a heightened sense of mindfulness—an aesthetic experience made possible through such computer technological characteristics as hyperlinks, hypermedia, and hyperreality. In these (...) terms, the prefix "hyper" represents various linking devices inherent to computer technology that allure and transport us between, above, below, and toward vast areas of information, places, and peoples. Hypermediacy, according to Bob Cotton and Richard Oliver, is "an entirely new kind of media experience born from the marriage of TV and computer technologies. Its raw ingredients can be brought together in any combination. It is a medium that offers random access; it has no physical beginning, middle, or end."2 In other words, there is no set or static structure inherent in technological media. It is not so much an "anything goes" apparatus as it is an "anything is possible" system. The seemingly vast possibilities inherent to technological media offer us many and alternate views of the world.Just as technological media encourage multiple means of viewing the world, no single approach to art criticism can be considered dominant, as several methods, methodologies, and approaches exist for responding to [End Page 1] works of art. We conceive of art criticism as a complex means of making meanings about works of art and communicating those meanings to other people. Following the lead of art educator Terry Barrett,3 art criticism hinges on the four activities of describing, interpreting, judging, and theorizing about art. Barrett suggests that, although all four overlap, interpretation is the most important and most likely the most complex aspect of art criticism. Although interwoven with description, analysis, and judgment, interpretation of the meanings of individual works of art is of foremost concern in contemporary art criticism. Similarly, we situate hypermediated art criticism as a synthesis of our descriptions, interpretations, judgments, and theories—both verbal and visual—with the various ways in which computer technology facilitates the simultaneous existence, representation, storage, and presentation of these and other forms of meaning making about works of art.Hypermediated art criticism is built upon our own technological abilities to both create and follow divergent paths, ideas, and beliefs according to our choices. Hypermediated art criticism is inclusive of the ways that our choices change daily depending upon our situation, role, and purpose, or simply as a result of what we witness or experience in a moment. This study discusses the treatise of Jalāl al-Dīn Davvānī (d. 908/1502) named Risāla fī taʻrīf ʻilm. This treatise criticizes a definition of knowledge adopted by some theologians in the late period (mutaʾakhkhirīn). The definition of knowledge at issue consists of three components: Attribution, discernment, no possibility of contradiction. Knowledge is an attribute as a category and with this attribution, a discernment is obtained. As a result of this process knowledge is acquired and there should be no possibility of this knowledge (...) to be inconsistent. Davvānī examines eight possibilities of the definition on knowledge. In each of these eight possibilities a different problems arises. According to Davvānī, the definition mentioned is problematic in all probability. Nonetheless, Davvānī does not propose another definition of knowledge that can replace the definition of knowledge that he criticizes. This article represents the process of reaching the definition of knowledge stated in the history of theological thought. The definitions on knowledge made from the first period (al-mutaqaddimīn) are summarized and the strengths and weaknesses of these definitions are explained. There are two main approaches regarding the nature of knowledge in Islamic thought: According to the first approach pioneered by Fakhr al-Dīn Rāzī (d. 606/1202), absolute knowledge is a priory (badīhī) and undefinable. According to the second one, the nature of absolute knowledge is a posteriori (naẓarī) and definable. The first part of this article includes the definitions and criticisms of knowledge in Islamic thought. The second part discusses the claim of originality. In the second part, Davvānī’s treatise will be evaluated for the first time. According to the conclusion of the treatise, the definition made to find the essence of knowledge is unfounded in all respect. It is important to evaluate the treatise as a reflection of anti-essentialism in the history of Islamic thought. Most contemporary studies do not count this treatise among Davvānī’s works. In the biography book al-Aʿlām written by Khayr al-Dīn al-Ziriklī (d. 1976), Risāla fī taʻrīf ʻilm is counted among the works of Davvānī. In the introduction of more than one manuscript, the work is clearly attributed to Davvānī. As a result of the double-sided research, it has been ensured that the work belongs to Davvānī. However, in other two manuscripts containing the same treatise, the work is shown as belonging to an unknown person named Şāirzāda. But there is no information found about this person. This name seems more like a copyist (mustansıh) than an author. Possibly, such a mistake occurred as a result of confusing the two names. Davvānī’s small volume treatise sheds light on the intellectual atmosphere and level of its period. The definition of knowledge mentioned in the classical theology book of ‘Aḍud al-Dīn al-Ījī (d. 756/1355) called al-Mawāqif is superior to other definitions of knowledge. Instead of this definition of knowledge, which is presented as perfect, Jurjānī (d. 816/1413) preferred the definition of knowledge attributed to al-Māturīdī (d. 333/944) in the Sharḥ al-Mawāqif. This preference has been accepted as an implicit criticism for future generations, including Davvānī. Those who claimed that Jurjānī did not taken a random choice, carried on their criticism by going over the definition. The fine craftsmanship revealed in the treatise reveals that critical thinking is used intensively. The properly understanding of the treatise depends on knowing the science of logic and following it with intense attention. The definition of knowledge is examined from various angles with the help of concepts such as conception, ratification, judgment and contradiction (nakz) of the science of logic. In the science of logic, every layer of knowledge such as certainty, conjecture, imitation, doubt is investigated one by one. In the science of kalām, attention is paid that the ideal level of knowledge is precise. An uncertain knowledge is not considered knowledge according to kalām. Because the main goal of theologians is to build religious beliefs on the obtained certain knowledge. It is not accepted to base knowledge to a probable information on imprecise knowledge. For a knowledge among the knowns to reach the level of certainty, it must be correct and exclude other possibilities. Another condition is required for certainty in the definition of knowledge that Davvānī examines in his treatise is that the opposite is wrong. The fact that a piece of information is considered true depends on the fact that its reverse is false. In this treatise, it is discussed how to look for the contradictions or discrepancy that are wanted to be excluded. Knowledge is inseparable from the human mind, from outside of the world, or from the relationship between the two. (shrink)

The person-affecting restriction, in its slogan form, states that an outcome can be better than another only if it is better for someone. It has a strong intuitive appeal and several theorists have suggested that it avoids certain counterintuitive implications in population ethics. At the same time, the restriction has highly counterintuitive implications and yields non-transitive orderings in some nonidentity cases. Many theorists have taken this criticism to be decisive. Recently, however, there have been some reformulations of the restriction, suggesting (...) that the restriction survives this “old” criticism. This paper investigates the viability of those reformulations, which are versions of “Comparativism,” and argues that most of them either have counterintuitive implications or are extensionally equivalent with impersonal theories, but that “Soft Comparativism” seems to have an advantage over impersonal theories. Hegel’s Philosophy of Law deals in theLaw section of the categories: person, property and contract. Research critically reconstructs this theory from a Marxist perspective. In the concept of person, first of all, the singular will is reduced to a solipsist will unrelated to intersubjectivity. Then, the concept of Hegelian property bases the private appropriation of property as the externalization of the singular will. This legal property guarantees the maintenance and reproduction of private property, that is, it will guarantee the private (...) accumulation of capital, Marx will say. Anyway, the theory of the contract would link the autonomy of the contracting wills, however, it is a mere appearance, because, in fact, the owners’ wills are under the domination of the capitalist market, as it is explained in Marx’s Capital. The theoretical deficit of Hegel’s Philosophy of Law in general is that the legal concepts of person and property correspond to the abstract will. Hegel describes the juridical description of the legal system of the modern state as the development of free will that legitimizes the asymmetry of civil society in its socioeconomic inequalities. It is suggested that the current hierarchical (Frankfurt-Dworkin) model of personal autonomy in philosophical anthropology gives expression to the fundamental presupposition of self-determination in much educational practice and pedagogical theory. Radical criticisms are made of the notions of self-identification and self-evaluation which are of the utmost importance to this model. Instead of relying on such ‘acts of the will’ as decision and choice for the explanation of self-identification and self- evaluation, the non-intentional as well as the non-individualistic character of (...) these processes is stressed and analysed in terms of volitional necessity and social dependence. His empiricism dissolves self-inspecting minds into heaps of distinct perceptions and turns cognitive faculties into successions of causally related, discrete impressions and ideas. Whatever regularities the complex ideas and their bundles or heaps display are explained by laws of association of ideas, which are supposed to play the same role in the mental world as Newton’s laws of gravitation play in (...) physical nature. Criticism of Locke's account of personal identity has proceeded cumulatively. Three years after the publication of the chapter “Of Identity and Diversity”, John Sergeant raised an objection which, in Bishop Butler's hands, was to become famous as the dictum that “one should really think it self-evident that consciousness of personal identity presupposes, and therefore cannot constitute, personal identity: any more than knowledge, in any other case, can constitute truth, which it presupposes”. Berkeley added, in effect, that when (...) consciousness is taken to be the criterion of personal identity, one must admit that a man conscious of segments of his life at some times and not at others both is — because “conscious of” states a transitive relation — and is not — because of lack of consciousness—the same person. Self-criticism is a trait associated with increased psychopathology, but self-criticism is also a personality state reflecting an action that people do in moments of time. In the current study, we explored factors associated with heightened self-criticism in daily life. Participants (N = 197) received five random prompts per day for one week on their mobile phones, where they reported their current affect (negative and positive affect), willpower self-efficacy, distress intolerance, degree of support and criticism from others, current context (location, activity, (...) hunger, tiredness) and momentary self-criticism. We first demonstrated that self-criticism varies over time and across contexts, and is associated with heightened trait self-criticism. Then, using multilevel modelling, we explored the contextual factors associated with greater self-criticism. We found that self-criticism was higher when people were at home, and more tired. We also found higher self-criticism to be associated with greater negative and lower positive affect, greater distress intolerance, lower willpower and greater perceived criticism from others. In addition, self-criticism predicted subsequent distress intolerance, willpower and positive affect in lagged analyses. This study provides evidence that both environmental and psychological factors are associated with the dynamics of self-critical thoughts. (shrink)

Online retailers are using advances in data collection and computing technologies to “personalize” prices, i.e., offer goods for sale to shoppers at their reservation prices, or the highest price they are willing to pay. In this paper, I offer a criticism of this practice. I begin by putting online personalized pricing in context. It is not something entirely new, but rather a kind of price discrimination, a familiar pricing practice. I then offer a fairness-based argument against it. When an online (...) retailer personalizes prices, it competes unfairly for the social surplus created by a transaction. I defend this argument against objections, and offer a simple remedy: online retailers should either disclose that they are personalizing prices, or stop doing so. (shrink)

The article intends to show the significance of Ch. Peirce’s ideas for the development of contemporary philosophy, to find out the main directions of his criticism of the principles of Cartesian and more broadly modern philosophy (where it comes from Descartes) and to consider the positive program of his philosophy, which he offers as an alternative to Modern philosophy. Peirce starts from a pragmatic and semiotic approach to human nature, consciousness and cognition. Thanks to this approach, he managed to undermine (...) the key ideas of the modern understanding of cognition, human, language, namely: individualism, linguistic atomism, dogmatism, dualism, representationism, nominalism, foundationalism, etc. And, instead, to propose a new theory of knowledge, a new ontology and anthropology. Peirce asserts the indirectness of human cognition by signs (linguistic, cultural, sensory), the impossibility of introspection and intuition, advocates holism, fallibilism, pragmatism, realism, synechism, inferentialism and offers a new understanding of the personality — all this makes him a relevant and contemporary thinker. Peirce’s ideas offer a fresh perspective on modern scientific practice. Peirce’s rethinking of the foundations of knowledge puts him alongside many thinkers of the 20th and 21st centuries. The articles examines the teleofunctional solution to the problem of mental causation, presented by Dmitry Volkov in his recently published book Free Will. An Illusion or an Opportunity. D.B. Volkov proposes solutions to three big metaphysical problems – mental causation, personal identity, and free will. Solving the first problem, Volkov creatively combines the advantages of Dennett’s teleofunctional model and Vasilyev’s local interactionism. Volkov’s teleofunctional model of mental causation seeks to prove the causal relevance of mental properties as non-local higher (...) order properties. In my view, its substantiation is based on three points: (a) critics of the exclusion problem and Kim’s model of mental causation, (b) “Library of first editions” argument, (c) reduction of the causal trajectories argument (CTA 1) by Vasilyev to the counterpart argument (CTA 2) by Volkov. Each of these points faces objections. Kim’s criticism is based on an implicit confusion of two types of reduction – reduction from supervenience and from multiple realizability. The latter type does not threaten Kim’s ideas, but Volkov uses this very type in his criticism. The “Library of first editions” argument does not achieve its goal due to compositional features and because non-local relational properties are a type of external properties that cannot be causally relevant. The reduction of CTA 1 to CTA 2 is unsuccessful since, in the case of this reduction, important features of CTA 1 are lost – these are local mental properties, due to which the influence of non-local physical factors occurs. My main objection is that the concept of causally relevant non-local properties is incompatible with the very concept of cause. The set of causally relevant properties of cause can only be local. Pike This article seeks to define more precisely the nature of the individual transaction that occurs between reader and text and the potential for aesthetic reading in literature classrooms by relating knowledge of the way pupils engage in literary transactions to theoretical (...) perspectives that address the issue. The validity of Louise Rosenblatt's transactional theory of the literary work, expounded in Literature as Exploration and The Reader, The Text, The Poem, and its relevance for contemporary educators, particularly in the field of English education, has recently been reasserted by Jeanne Connell in her timely and cogent article in this journal. 1 The present article, however, seeks to refocus debate by problematizing and subsequently developing some aspects of key theories such as Rosenblatt's while examining the individual and social nature of reading in schools. Rosenblatt's view that aesthetic experiences can have both social origin and effect certainly deserves further theorizing if aesthetic experience in school communities and classrooms is to flourish.The influence of John Dewey's Art as Experience upon Rosenblatt is evident as this seminal text conceives of our primary task as the restoration of "continuity between the refined and intensified forms of experience that are works of art and everyday events." 2 Such continuity with experience is vital because, for Dewey, "experience is the fulfillment of an organism in its struggles and achievements in a world of things, it is art in germ." 3 Applying such a notion to education in schools, Rosenblatt saw the aim of literature lessons as the growth of experience rather than the acquisition of knowledge. Yet, despite such progress, in the United Kingdom, teachers of English are in the unenviable position of having to deliver an extensive body of knowledge prescribed by the National Curriculum and also to focus explicitly upon the features of certain types of text as they teach the National Literacy Strategy. 4 In Rosenblatt's work the emphasis on our experience of [End Page 61] literary works provides a much needed alternative to positions such as that adopted by New Criticism where "it is never what a poem says which matters, but what it is" because we acknowledge we can only ever gain access to what a poem says as "the sentence that seems to need no interpretation is already the product of one." 5 Clearly, understanding the reader's transaction with texts is where we must begin if we wish to foster aesthetic reading in our classrooms.Transactional theory also appears to be closely related to Martin Heidegger's thought in Being and Time where Dasein (givenness, existence, being) is seen as a distinctive characteristic of the human being as our consciousness projects things of the world and is also subjected to the things of the world which belong to us, in some sense, only as long as our consciousness is projecting them. 6 The validity of Dewey's view, where experience is not separated from art, can be seen when we acknowledge that we can "never adopt an attitude of detached contemplation, looking down on the world as if from a mountain top" for we are "inevitably merged with the very object of our consciousness." 7Such a view reflects Hans-Georg Gadamer's position in Truth and Method in which Heidegger's explanation of situation is applied to literary theory because, for Gadamer, the literary work cannot appear as a packaged and completed artefact in which meaning is neatly wrapped because it is influenced by a particular reader's actions at a particular moment. 8 Rosenblatt's realistic conception that "each reading involves a particular person at a particular time and place" is developed in this article as it seems that, even now, many reader response critics and curriculum designers "write as though people read literature in a vacuum or in a generalized kind of academic setting" which often does not apply... More than a century after Guido Adler's appointment to the first chair in musicology at the University of Vienna, Music, Criticism, and the Challenge of History provides a first look at the discipline in this earliest period, and at the ideological dilemmas and methodological anxieties that characterized it upon its institutionalization. Author Kevin Karnes contends that some of the most vital questions surrounding musicology's disciplinary identities today-the relationship between musicology and criticism, the role of the subject in analysis and the (...) narration of history, and the responsibilities of the scholar to the listening public-originate in these conflicted and largely forgotten beginnings. Karnes lays bare the nature of music study in the late nineteenth century through insightful readings of long-overlooked contributions by three of musicology's foremost pioneers-Adler, Eduard Hanslick, and Heinrich Schenker. Shaped as much by the skeptical pronouncements of the likes of Nietzsche and Wagner as it was by progressivist ideologies of scientific positivism, the new discipline comprised an array of oft-contested and intensely personal visions of music study, its value, and its future. Karnes introduces readers to a Hanslick who rejected the call of positivist scholarship and dedicated himself to penning an avowedly subjective history of Viennese musical life. He argues that Schenker's analytical experiments had roots in a Wagner-inspired search for a critical alternative to Adler's style-obsessed scholarship. And he illuminates Adler's determined response to Nietzsche's warnings about the vitality of artistic and cultural life in an increasingly scientific age. Through sophisticated and meticulous presentation, Music, Criticism, and the Challenge of History demonstrates that the new discipline of musicology was inextricably tied in with the cultural discourse of its time. Should we take into account an artist's personal moral failings when appreciating or evaluating the work? In this essay, I seek to expand Berys Gaut's account of ethicism by showing how moral judgment of an artist's private moral actions can figure in one's overall evaluation of their work. To expand Gaut's view, I argue that the artist's personal morality is relevant to our evaluation of their work because we may only come to understand the point of view of (...) the work, and therefore the work's prescribed attitude, by examining the values, attitudes, and behaviors of the artist. This view is defended against a rival account offered by Bernard Wills and Jason Holt, which holds that the artistic evaluation of an artist's work is independent from the moral evaluation of their life except in extreme cases. A good chunk of the recent discussion of hypocrisy concerned the hypocritical “moral address” where, in the simplest case, a person criticises another for $$\phi $$ -ing having engaged in $$\phi $$ -ing himself, and where the critic’s reasons are overtly moral. The debate has conceptual and normative sides to it. We ask both what hypocrisy is, and why it is wrong. In this paper I focus on the conceptual explication of hypocrisy by examining the pragmatic features of the situation (...) where accusations of hypocrisy are made. After rejecting several extant views, I defend the idea that moral criticisms are best understood as moves in an agonistic or hostile conversation, and that charges of hypocrisy are attempts to prevent the hypocrite from gaining an upper hand in a situation of conflict. I finish by linking this idea to frame-theoretic analysis and evolutionary psychology. (shrink)

Without extending the historical analysis, this article analyzes the relationship between the legal concept of person with regard to the notion of living independently. The concept is normatively established in Article 19 of the CRPD and is presented as a legal fiction. The legal technique of fictio iuris is the premise for analyzing contemporary problems, for example, the attribution of responsibilities to non-human personalities, such as robots. The article, however, develops the problem of attributing rights to persons with disabilities. The (...) contraposition of robots and disabled people, understood as opposing visions of anthropological and human models, is part of the philosophical dispute between humanism and post- or transhumanism. The conception of man appears different if created in the image and likeness of God, or as the fruit of evolution from primates, or as a transhumanist entity that can be replaced by the robot. The latter vision is rooted in the mechanization of the mind triggered by cybernetics and cognitive sciences and referable to problems of justice theory and political philosophy concerning the inclusion in society of disabled people. In this article I will limit myself to analyzing, against the background of this complex problem, the link between person, legal fiction and the right to disability starting from the criticism addressed by Nussbaum to Rawls based on the convention and following the methodology developed by Marchisio and Curto in order to clarify the legal connection between thirdness, disability, and person.However, I go one step further by including the issue of disability as justice within the evolution of the notion of the legal person, through the inclusion of fictio iuris and rhetorical methodology in positive law, as a criterion for the interpretation of art. 19 CRPD. In The Second-Person Standpoint and subsequent essays, Stephen Darwall develops an account of morality that is “second-personal” in virtue of holding that what we are morally obligated to do is what others can legitimately demand that we do, i.e., what they can hold us accountable for doing through moral reactive attitudes like blame. Similarly, what it would be wrong for us to do is what others can legitimately demand that we abstain from doing. As part of this account, Darwall (...) argues for the proposition that we have a distinctive “second-personal reason” to fulfill all of our obligations and to avoid all wrong-actions, an “authority-regarding” reason that derives from the legitimate demands the “moral community” makes of us. I show that Darwall offers an insufficient case for this proposition. My criticism of this aspect of Darwall’s account turns in part on the fact that we have compunction-based or “compunctive” reasons to fulfill all of our obligations and to avoid all wrong actions, a type of reason that Darwall seemingly overlooks. Paul Benson and Andrea C. Westlund have proposed conceptualising personal autonomy in terms of the readiness to respond to criticism that targets the agent’s actions and intentions (Benson) or commitments (Westlund). While incorporating this dialogical facet into a theory of personal autonomy is a step in the right direction, a theory of personal autonomy that is exclusively construed in terms of this facet and that posits discursive accountability as the sole criterion against which actions, choices, and commitments (...) can be judged as autonomous or not is too restrictive and entails counterintuitive ideas. In this article, an alternative conceptualisation is proposed, one that avoids reductively construing personal autonomy exclusively in terms of the discursive and communicative facet and that conceptualises this facet in terms of communicative spaces which agents can claim authority over and in which and through which they can take ownership of claims, actions, and commitments. This alternative conceptualisation is initially formulated – by way of analogy – in terms of the normative requirement to respect the physical space of individuals. The article also outlines a set of conditions which indicate when one should claim authority over communicative spaces and the manner in which one takes ownership of claims, actions, and commitments in order to be autonomous. The Synoptic Problem is a puzzle that scholars have desired to solve since the 18th century. The discussion has a religious background, because it is about the first three canonical Gospels of the Church, namely Matthew, Mark and Luke, which came to be called the Synoptic Gospels. The discussion, in the most basic context, concentrates on the point that there is a possible relationship or connection between the Synoptic Gospels and that each one is substantially similar to another but at (...) the same time includes different aspects. This theoretical discussion separates the Gospel of John from the Synoptic Gospels and does not see it as a main source for the history of Jesus. The method of discussion is based on the reading of the Synoptic Gospels from a birds-eye-view, as seen together, and as comparatively in relation to each other. The aim of the discussion is to reach accurate historical information about Jesus and the birth of Christianity by analyzing the possible relationship between the Synoptic Gospels through their sources. Several hypotheses have been proposed for the solution of the Synoptic Problem. However, all the modern studies in the context of the problem are carried out by Western scholars. In other words, Synoptic Problem is a relatively unknown subject in the Turkish academic circles. So in this paper the aim is to draw the attention of the Turkish academy to the substance and framework of the Synoptic Problem through an introductory survey. In addition, some results that can be reached in this context will be exemplified by getting help from the redaction criticism. There have been many dimensions of these discussions. However, whether the Gospels contain contradictory information or not has always been at the forefront. Pagan writers, such as Celsus or Porphyry, criticized the Gospels in this respect. Christian writers, such as Marcion or Tatian who lived in the second century when the Gospels were not seen as canon yet, raised some suggestions based on the doubts that the Gospels were incompatible with the Jewish scriptures and contained contradictions among themselves. Marcion included a single Gospel that was close to the Gospel of Luke in his New Testament canon. Tatian made a mixed version of the four Gospels. In the next stage, the contradictions in the Gospels were explained by the Christian writers, such as Origenes or Augustine. However, the four Gospels were more prominent in this new era and they were regarded as canons by the Church. Therefore, the Christian writers’ approach to the Gospels also began to change. Origen emphasized allegorical interpretation which had been known since the Jewish philosopher Philo (d. 50) in Alexandria. Thus, he wanted to protect the contradictory texts from being seen as the source of the problem. He argued that the problem was the human mind that could not grasp the allegorical mystery of the text or the narrative in the text. Augustine had a similar approach with the suggestion that the Gospels should be read by a faithful heart. According to Augustine, it is natural that the Gospels reflect different characters because the Gospel writers describe Christ differently. In order to be able to comprehend the divine meaning in these texts, the Gospels must be read in a spiritual mood. After all, all these Christian writers aimed to respond to the criticism by the pagan writers regarding the Gospels, as well as the current suspicions in the minds of Christians.Origen was the first Christian thinker to devote an effort to solve the debates on the Gospels in a logical and systematic way. As for Augustine, he was the starting point of the Synoptic Problem since Augustine was the first to mention the links between the Gospels texts, namely the idea that the authors of the Gospels may have used each other as sources. However, in the modern sense, the Synoptic Problem has been transformed into an academic discipline by the intellectuals who followed the path of Enlightenment thinkers, such as Reimarus (1684-1768), Lessing (1729-1781), Griesbach (1745-1812), and Eichhorn (1752-1827). Because modern researchers differ from old writers based on Church ideologies, they began to demolish traditional beliefs about the Gospels. Thus, the effort to harmonize incompatible narratives in the Gospels is left aside. Indeed, the ancient writers put a lot of effort into it. Now, in the places where indirect relations can be established between the Gospels, the idea of finding the common hypothetical sources of these Gospels is prominent. The claim that the Gospels were directly connected to Jesus as a historical figure has been gradually faded away. The basis of the Synoptic Problem is the comparative reading of the Synoptic Gospels. In the modern sense, this comparison and its interpretation was made by J. J. Griesbach (1745-1812) for the first time. Griesbach was the first scholar to compare Matthew, Mark, and Luke in a way to create a synopsis. His comparison is based on a reading done by placing several passages or narratives from the Gospels side by side.Many hypotheses have been put forward for the solution of the Synoptic Problem. Two-Source Hypotheses, Four-Source Hypotheses, and Farrer Theory are the most popular ones among researchers. These views are based on Marcan Priority. In this context, independently from each other, Matthew and Luke used Mark’s text as their sources. Also, according to the Two-Sources and Four-Source Hypotheses, the authors of Matthew and Luke used another written document as their sources. This document is named the “Q” which derives from the German word “Quellen.” In this way, it is assumed that the Q-document and the Gospel of Mark are the sources of the Gospels of Matthew and Luke.The writers of the Gospels wrote their own texts by using written and oral sources. One of the scholarly methods is the redaction criticism that explores how the Gospel writers shaped the old literary documents by arranging, re-shaping, and revising them. This theory looks at whether the source used by an author is known and available today in order to understand whether how the author used his sources would provide important clues about his tendencies or ideologies. In this regard, the theory of the Marcan priority can be rendered functional along with the redaction criticism. In doing so, it is possible to reach important conclusions about Jesus and the birth of Christianity, as well as the theological and ideological ideas of the unknown authors of the Gospels of Matthew and Luke. First of all, the authors of Matthew and Luke used Mark’s text as their sources. Secondly, we have these three Gospels today. And finally, the ways in which the writers of Matthew and Luke shaped the text, phrases, or expressions of Mark reveal important results about their thoughts. The analysis shows that the authors of Matthew and Luke sometimes made additons that could be called interpolation to Mark’s text; sometimes they wanted to censor some statements in Mark; sometimes they tried to explain or clarify some statements in the Mark, or sometimes they tried to blur clear expressions and expositions in Mark's text. These authors did not do such things without a reason. They wanted to reshape Mark’s text in accordance with their theological understanding of Jesus as Christ. In this context, according to some expressions in Mark, Jesus' power had a limit. The authors of Matthew and Luke did not find these statements appropriate, because they changed Mark’s some statements to create an impression that Jesus’ power was not limited. This proves that the authors of Matthew and Luke re-arranged their resources to present Jesus as a superhuman being. Similarly, in Mark, there are lines in which Jesus declares his loyalty and servitude to the God of Israel. In such passages, he presented his personality in a low Christology context against God. However, the authors of Matthew and Luke were disturbed by such statements, because they intervened in these statements in Mark. They wanted to change some of the meanings and contexts in Mark’s text through such interventions and presented Jesus as Christ in a high Christological context to their readers. In the end, all these researches also responded to the question of to what extent the Gospels provide reliable information on a historical basis. (shrink)

Despite the unprecedented freedoms that decolonization has brought for many Black1 people – especially in specific regions of the African Diaspora – freedom and its fulfilment, adequate signs and contested meanings remain a preoccupation within Black cultural discourses and practices. At the same time, while political and cultural nationalisms have led to greater political and civil rights, racism has not been eradicated. Furthermore, the new postcolonial globalizations of capital, people and cultures have destabilized the collective identities that framed twentieth-century struggles (...) for national sovereignty and equal citizenship, without necessarily erasing them. Instead, they remain, no longer securely anchored in their old homogenous appearances, but re-configured through the inner differences and contradictions of gender, sexuality, ethnicity and religion. This article addresses these internal differences and the ways in which they produce new contestations over race, the meaning of Black representation and postcolonial freedom, negotiations that are increasingly traced on the intimate contours of the body and the self, through practices of personal consumption, erotic hedonism and style as key performances of freedom. It achieves this through examining two localized moments in the transnational and diasporic circulation of Jamaican dancehall culture, understood as a privileged public space for the performance of Black identifications and personal freedom. It argues that the eroticized discourses of ethnicity, race and gender found in dancehall culture articulate the dominance of neo-liberal conceptions of freedom at the same time as they express, resist and comment on new cultural hegemonies not reducible to racism or the power of the West; that is how dancehall expresses the new problematizations of postcoloniality. 1Except when quoting other writers, I will capitalise the word Black, in order to recognise Black identity as a historically and politically constituted experience and representational category, and not solely denoting skin colour. Despite the prominence of person‐centred care (PCC) in nursing, there is no general agreement on the assumptions and the meaning of PCC. We sympathize with the work of others who rethink PCC towards relational, embedded, and temporal selfhood rather than individual personhood. Our perspective addresses criticism of humanist assumptions in PCC using critical posthumanism as a diffraction from dominant values We highlight the problematic realities that might be produced in healthcare, leading to some people being more likely to be disenfranchised (...) from healthcare than others. We point to the colonial, homo‐ and transphobic, racist, ableist, and ageist consequences of humanist traditions that have influenced the development of PCC. We describe the deep rooted conditions that structurally uphold inequality and undermine nursing practice that PCC reproduces. We advocate for the self‐determination of patients and emphasize that we support the fundamental mechanisms of PCC enabling patients' choice; however, without critical introspection, these are limited to a portion of humans. Last, we present limitations of our perspective based on our white*‐cisheteropatriarchy** positionality. We point to the fact that any reimagining of models such as PCC should be carefully done by listening, following, and ceding power to people with diversity dimensions*** and the lived experience or expertise that exists from diverse perspectives. We point towards Black, queer feminism, and critical disabilities studies to contextualize our point of critique with humanism and PCC to amplify equity for all people and communities. Theory and philosophy are useful to understand restrictive factors in healthcare delivery and to inform systematic strategies to improve the quality of care so as not to perpetuate the oppression of groups of people with diversity dimensions. *We purposely capitalize Black and use lower case for white to decentre whiteness and as an intentional act of antiracism (see White Homework a podcast series by Tori W. Douglas). **Cisheteropatriarchy describes people with intersecting identities of dominant social groups; cisgender is the gender identity that aligns with the gender you were assigned at birth, hetero means heterosexual, and patriarchy refers to structural systems of power based on maleness where women are often excluded and hold less power. ***With diversity dimensions, we refer to subjective lived experience and material realities of people that exist outside the ‘dominant minorities' of white‐cisheteropatriarchy, meaning groups of people in society who historically and currently hold more power and through this, structurally dominate the norms and possibilities of living for other people. Rowan Williams's theological-moral reasoning regarding the formation of personal identities in relation to gender, familial and communal ties is analysed in an article review of his book Lost Icons. This is his most sustained essay in theological social criticism, and was intended for the general public beyond academic theology. Williams exposes Christian moral reasoning on these issues to forms of secular critique whilst simultaneously using theological and historical strategies from liberal Anglo-Catholicism. His argumentation is subjected to theological and social-scientific (...) scrutiny. The article calls for closer attention to debates within secular feminism and social research concerning the formation of adult men and women in relation to the wider post-Christian society. 남명에 대한 기존의 연구는 남명학의 특징을 敬義사상의 실천유학에 초점을 맞추어 왔다. 그러나 엄밀한 의미에서 역사적 인물로서의 남명을, 그의 당대에서나 그의 사후 오늘에 이르기까지, 가장 남명답게 규정짓는 요소는 무엇인가? 경과 의로 정립된 그의 철학인가? 이 점에 있어 필자는 다소 다른 견해를 가지고 있다. 당대나 후세에 남명을 평가한 모든 글들에서는 한결같이 出處에 있어 處士로서의 지조를 끝까지 지킨 남명의 출처사상을 가장 높게 평가하고 있음을 알 수 있다. 본고는 그의 출처관을 그 자신의 人物評을 통하여 살펴보고, 나아가 그러한 인물평의 저변에 깔려 있는 출처사상의 바탕을 찾아보고자 (...) 하였다. 그는 역사적 인물들과 당대의 인물들에 대한 비판적 검토를 통해서 그들의 출처를 논하였다. 남명은 그 출처가 합당한가 아닌가에 대한 기준으로서 기미를 파악하는 선견지명을 꼽았는데, 이때의 ‘幾’는 바로 선과 악으로 나뉘는 분기점인 것이다. 기미의 순간에 인욕을 배제하고 천리를 잘 보존하게 된다면 바로 吉人이 되고, 인욕이 천리에 포함되게 되면 바로 惡人이 되는 것으로 파악한 것이다. 벼슬길에 나아감에 있어서도 일을 ‘할 수 없는 시기’에 나아가는 것이나, ‘할 수 없는 일’을 하려고 하는 것은 모두 인욕이 개입된 것으로 보았으니, 곧 그 출처가 잘못된 것이라는 관점이다. While libertarians affirm personal responsibility as a central moral and political value, libertarian theorists write relatively little about the theory and practice of this value. Focusing on the work of F. A. Hayek and David Schmidtz, this article identifies the core of a libertarian approach to personal responsibility and demonstrates the ways in which this approach entails a radical revision of the ethics and American politics of personal responsibility. Then, I highlight several central implications of this analysis (...) in the American political and economic status quo. First, this analysis makes a mockery of so-called libertarian/conservative ‘fusionism’, such that libertarian personal responsibility cannot partner with meritocratic conservative thought to provide a plural grounding for rejecting progressive or redistributive economic policy. Next, preferred libertarian policies threaten the status, esteem and social bases of self-respect of citizens who are worse-off through little or no fault of their own. Finally, these policies undermine the ethics of personal responsibility that Americans from across the ideological spectrum value and many conservatives and libertarians celebrate. In the American status quo, those who value personal responsibility must reserve a central place for policies that mitigate opportunity and distributive inequalities. (shrink)

Were they furthering ‘an exploration of the erotics of the relation between teacher and student’ as the professor says—or was it part of a pattern of sexual harassment as the student later charged?” So ran (...) the copy on an envelope advertising in 1994 an “extraordinary one-time offer $9.95 trial subscription” to Lingua Franca in 1994. 1 The enclosed letter relates an anecdote about two complaints against Jane Gallop filed by two female graduate students alleging she had sexually harassed them. Gallop defended having French-kissed a graduate student in a bar in front of other students in the same class by saying it was a pedagogical performance. The letter quotes from a Lingua Franca cover story that came to Gallop’s defense [Talbot].As sex between students and professors has become a topic of new interest in the wake of sexual harassment legislation, as colleges have adopted campus sexual conduct codes or debate doing so, and as debates and incidents involving sex and teaching have attracted widespread media attention, the anecdote has become central. Some critics might want to dismiss the Lingua Franca story as nothing more than titillating tabloid gossip or take it seriously only by regarding it as an effort to combat a right-wing agenda to smear innocent professors who, as feminist or queer, are politically and intellectually well to the left of the mainstream. But the anecdotal interests us precisely because it involves more than just a tabloid scandal in any simple sense. Sex is not merely a way one can slur kinds of criticism one doesn’t like by tarnishing its proponents (for teaching sexual, transgressive material to shock, pervert, or in the extreme case—as in this instance—literally seduce students) though it can sometimes function in this way. For sex comes up in anecdotes told by cultural critics to one another, and when it comes up, it comes up in the same way it does in “tabloid” coverage. The anecdote about sex is never really just about sex, about who did or didn’t (French) kiss, suck, and/or fuck whom: it is rather a story about something in the pedagogical relation that has gone wrong, about a connection that has gone off track. Anecdotes about sex and teaching are really stories about criticism, about pedagogy itself as a form of criticism, and about failed pedagogy as the occasion for self-criticism.Yet if the anecdote is not really about sex, sex is hardly irrelevant to the production of what the anecdote is really about, namely, criticism. Indeed, we want to focus on the question of sex between students and professors because it is precisely sexuality that puts pressure on different, key aspects of the project of cultural criticism and on the present contestation over it within and outside of academia. Campus codes are being introduced [End Page 72] as new pedagogical practices, and new courses are being introduced into the classroom: disruption though impersonation, performative strategies, bringing the personal and the erotic into the classroom, and classes making use of pornography, even hardcore visual pornography, often taught by feminist women. 2 According to leading cultural critics, destabilizing gender roles shows us how gender is constructed, and tells us about power in ways that are politically and performatively effective. 3But there is often a moment when the game breaks down in the classroom. Someone gets offended, and given the way that for some sexual harassment extends from unwanted sexual advances or trading grades for sexual favors to classroom materials (both written and visual), offense can easily move into complaint, legal action, media attention, and of course administrative and professorial panic. The usual rationale for transgressive pedagogy is that this disruption will be successful, not just anarchic: it will be successful in that it gets in the way of the replication and reproduction of power (this is the new mission for teaching: to disrupt the transmission and reproduction of patriarchal power structures...
