Existing theories about the nature of conscious sensations are discussed. The oldest classification system contrasts dualist theories (which say consciousness is an abstract entity) with monist theories (which say consciousness is a concrete entity). A more recent system contrasts process theories ("consciousness is a process, not a thing") with vehicle theories (consciousness is a property of one or more of the things associated with brain processes). The present paper first points out that processes are abstracta, which makes process theories dualist. (...) It then argues that (a) dualist theories are untestable and therefore unscientific and (b) process theories which invoke information are at odds with the normal definition of information. Then two separate kinds of vehicle theory are discussed: first the neural identity theory and then a theory that pulls together the enormous volume of data generated by Crick's suggestion to forget about theories and simply measure the neural correlates of consciousness into a proposal equating sensory consciousness with certain patterns in the electromagnetic fields generated by brain function. The paper concludes with an injunction to stop researching this topic altogether, on the grounds that the results are likely to be used in unacceptably dystopian developments. (shrink)

The question of whether or not a closed border entry policy under the unilateral control of a democratic state is legitimate cannot be settled until we first know to whom the justification of a regime of control is owed. According to the state sovereignty view, the control of entry policy, including of movement, immigration, and naturalization, ought to be under the unilateral discretion of the state itself: justification for entry policy is owed solely to members. This position, however, is inconsistent (...) with the democratic theory of popular sovereignty. Anyone accepting the democratic theory of political legitimation domestically is thereby committed to rejecting the unilateral domestic right to control state boundaries. Because the demos of democratic theory is in principle unbounded, the regime of boundary control must be democratically justified to foreigners as well as to citizens, in political institutions in which both foreigners and citizens can participate. Some realists in political theory deny that the notion of feasibility has any place in realist theory, while others claim that feasibility constraints are essential elements of realist normative theorising. But none have so far clarified what exactly they are referring to when thinking of feasibility and political realism together. In this article, we develop a conception of the realist feasibility frontier based on an appraisal of how political realism should be distinguished from non-ideal theories. In this realist (...) framework, political standards are feasible if they meet three requirements: they are politically intelligible, contextually recognisable as authoritative, and contestable. We conclude by suggesting that our conception of realist feasibility might be compatible with utopian demands, thereby possibly finding favour with realists who otherwise refuse to resort to the notion of feasibility. This book challenges the dominant approach to problems of justice in global normative theory and offers a radical alternative designed to transform our thinking about what kind of problem injustice is and how political theorists might do better in understanding and addressing it. It argues that the dominant approach, ideal moral theory (IMT), takes a fundamentally wrong-headed approach to the problem of justice. IMT seeks to work out what an ideally just society would look like, and only then (...) outlines our moral obligations in realizing that ideal. In other words, it ignores the realities of everyday politics. As Michael Goodhart asserts, IMT postpones engagement with actually existing injustices and distorts our understanding of them, and it normalizes many problematic features of our world. On the other hand, the leading alternatives to IMT struggle to make sense of the role values play in politics. This book sees justice as an ideology and develops an innovative bifocal theoretical framework for making sense of it. This framework provides two complementary perspectives on justice: a theoretical perspective that situates competing ideological claims about justice in a broader political context and a partisan perspective that evaluates the structure and coherence of particular conceptions of justice. As opposed to IMT, it focuses on barriers to justice and advocates an activist political theory that takes sides in political struggles against injustice. Goodhart argues that theorists can help to generate the countervailing power necessary for social transformation through the work of articulation, translation, and mapping, work which contributes to a more comprehensive social science of injustice. In Argument, Inference and Dialectic Pinto argues that critical practice can furnish us with the necessary guidance to answer our questions about argument and inference; we do not need to develop a theory of argument/inference. Pinto’s provocative remarks raise questions about the appeal to practice, and recall problems that Toulmin encounters in development of his innovative theory in The Uses of Argument. In this paper, I juxtapose and reflect on these developments.

This book centres on Samuel Pufendorf’s moral and political philosophy, a subject of recently renewed interest among intellectual historians, philosophers and legal scholars in the English-speaking world. Pufendorf’s significance in conceptualizing sociability in a way that ties moral philosophy, the theory of the state, political economy, and moral psychology together has already been acknowledged, but this book is the first systematic investigation of the moral psychological underpinnings of Pufendorf’s theory of sociability in their own right. Readers will discover (...) how Pufendorf’s psychological and social explanation of sociability plays a crucial role in his natural law theory. By drawing attention to Pufendorf’s scattered remarks and observations on human psychology, a new interpretation of the importance of moral psychology is presented. The author maintains that Pufendorf’s reflection on the psychological and physical capacities of human nature also matters for his description of how people adopt sociability as their moral standard in practice. We see how, since Pufendorf’s interest in human nature is mainly political, moral psychological formulations are important for Pufendorf’s theorizing of social and political order. It also affords a better understanding of what later philosophers, such as Smith, Hume or Rousseau, might have find appealing in Pufendorf’s writings. In dominant discourses, migrants are mostly perceived as either victims or villains but rarely as political subjects and democratic constituents. Challenging this view, the aim of the article is to rethink democracy with respect to migration struggles. I argue that movements of migration are not only consistent with democracy but also provide a decisive impetus for actualizing democratic principles in the context of debates about the crisis of representation and post-democracy. Drawing on the work of Jacques Rancière, Étienne Balibar and (...) Ernesto Laclau and Chantal Mouffe, I develop a theory of radical democracy as practice, which, starting from the proposed notion of ‘democratic difference’, goes beyond the fixation on democratic regimes and focuses on contentious practices of enacting democratic principles. I articulate these theoretical concepts by analysing how refugees in Germany have managed to break out of a marginalized position and have challenged their denial of rights through a protest march. This book offers an account of Kant's theory of moral motivation that comprehends the most challenging and controversial aspects of Kant's theory of the will and human moral motivational psychology. It argues for a new approach to the question about the purity of the Kantian moral motive.

We give a probabilistic justification of the shape of one of the probability weighting functions used in Prospect Theory. To do so, we use an idea recently introduced by Herzog and Hertwig. Along the way we also suggest a new method for the aggregation of probabilities using statistical distances.

In the course of the long 18th century, medical theory and theories underwent profound changes. These in turn reflected discontinuities and often conflicting assumptions and premises, engendering divergent concepts of physiology and pathology. However, most theoretical considerations were only very inconsistently and partially reflected in therapeutic practice, which continued to be governed by experience with traditional and known medicinals and by patient expectations regarding provider practices. Additional factors in therapeutic decision making were economic considerations and preferences for particular therapies (...) in certain social and religious networks. The present volume deals with some aspects of this complex relationship between medical theory and therapeutic practice, using a transatlantic perspective. David Lewis argues at length against haecceitism and goes as far as claiming that, on a certain counterpart-theoretic construal, the doctrine is unintelligible or inconsistent. I argue, contra Lewis, that both qualitative and non-qualitative counterpart theory are in fact committed to haecceitism, but that this commitment is harmless since what is really at stake for a counterpart theorist such as Lewis are more general supervenience claims that are independent of haecceitism. I further argue that Lewis's formulation of the doctrine (...) suffers from two important defects that, once remedied, free counterpart theory of its haecceitistic commitments. Along the way I discuss an objection to the effect that the cheap substitute is inconsistent in the presence of an 'actually' operator. This paper therefore brings together important critical discussion on haecceitism and counterpart theory. (shrink)

A truly realistic theory of law – the possibility of which is examined in this work – should have the following characteristics. It should be more general than current theories, that is, be applicable to both common law and civil law; in consequence, it should invert the relationship, commonly instituted by positivist theories, between legislation and adjudication. Both in historiography and in legal comparison, of which legal theory is an extension to a higher level of abstraction, adjudication is (...) the central moment of the legal process, while legislation can be seen as one of the many attempts, and perhaps not even the most successful, to limit and control adjudication. An example of the explanatory capacity of a truly realistic theory is the so-called crisis of sources: legislation institutes judges, but they are, ultimately, those who set the hierarchy of sources and the hierarchical position of legislation itself. The neuropsychological and functional characterisation of mental state attribution (‘‘theory of mind’’ (ToM)) has been the focus of several recent studies. The literature contains opposing views on the functional specificity of ToM and on the neuroanatomical structures most relevant to ToM. Studies with brain-lesioned patients have consistently found ToM deficits associated with unilateral right hemisphere damage (RHD). Also, functional imaging performed with non-braininjured adults implicates several specific neural regions, many of which are located in the right hemisphere. To understand differences in perspective between Kuttner and Rosenblum’s and my view of the plausibility of theory-neutral quantum experiments, meta-theoretical differences between experimental physicists and theoretical physicists are examined. According to F.S.C. Northrop the perspective of experimental physicists is more toward the operational specification of “facts,” while the perspective of theoretical physicists is more toward how theory influences how we see “facts” and, at the epistemological level, what constitutes “facts.” It is pointed out that the same difference in (...) perspective occurs among scientists in psychology. An example of how the purely experimental perspective could lead to Kuttner/Rosenblum-type impossible experiments in psychology is presented. (shrink)

Accounts of modal knowledge are many and varied. How should we choose between them? I propose that we employ inference to the best explanation, and I suggest that there are three desiderata that we should use to rank hypotheses: conservatism, simplicity, and the ability to handle disagreement. After examining these desiderata, I contend that they can’t be used to justify belief in the modal epistemology that fares best, but that they can justify our accepting it in an epistemically significant sense. A novel account of semantic information is proposed. The gist is that structural correspondence, analysed in terms of similarity, underlies an important kind of semantic information. In contrast to extant accounts of semantic information, it does not rely on correlation, covariation, causation, natural laws, or logical inference. Instead, it relies on structural similarity, defined in terms of correspondence between classifications of tokens into types. This account elucidates many existing uses of the notion of information, for example, in the context of (...) scientific models and structural representations in cognitive science. Theory of Mind (ToM) or mentalization is the ability to understand and foresee the behavior referring to one's own and others' mental states (Premack & Woodruff, 1978; Wimmer & Perner, 1983). This capacity, which is considered the most representative mechanism of social cognition, is a multifaceted set of competences liable to influence--and be influenced by--a manifold of psychosocial aspects. Studies on typical and atypical/clinical development during life showed that ToM is frequently delayed (e.g. in deafness) or impaired in many (...) clinical conditions (e.g. Autism Spectrum Disorder, Attention Deficit Hyperactivity Disorder, Schizophrenia, Borderline Personality Disorder, Parkinson's Disease, Alzheimer's Disease) and, on the other hand, may not be unequivocally a positive experience. It is therefore possible to consider the existence of multiple kinds of Theory of Mind. In fact, ToM may vary along a quantitative and a qualitative continuum. As for the quantitative dimension, the continuum is constituted by the fluctuation between high and low levels of ToM ability in different clinical conditions. Along this continuum, impairment can mean "not enough" ToM (for example in Autism Spectrum Disorder) as well as "too much" ToM (for example in Schizophrenia and Borderline Personality Disorder). The qualitative dimension--highly interrelated with the quantitative one--regards the shift between adaptive (e.g. prosocial, nice ToM) vs. unadaptive (e.g. antisocial, nasty ToM) mental states content. The issue is discussed in light of recent evidence from outstanding researchers working on typical and atypical/clinical populations along the life-span. If it can be agreed that health care resources are finite, it follows that choices between competing needs must be made. Cost utility analysis is an application of decision theory which has been proposed as a strategy for making difficult social decisions about health resource allocations. This method is heavily dependent upon the measurement of social utilities for various health outcomes. Recent work in cognitive psychology suggests that there are important sources of distortion in such measurement. This dissertation may be conveniently divided into four principal parts. Following a brief overview of the dissertation as a whole , in the first part , I examine several fundamental problems that are peculiar to extant theories of autonomy and free agency. In the second part , I introduce and defend a basic version of the Theory of Middle Freedom---a unified, composite, acausal theory of free agency. I argue that this theory's virtues include its providing inter alia (...) a method for resolving the demarcation problem, a satisfactory solution to the problem of identification, a novel account of action control in an indeterminist framework, a plausible account of compatibilist free action, and a way of unifying within a single conceptual framework the three dominant theories of free agency that are found in the historical and contemporary philosophical literature, viz. simple indeterminism, agent-causal libertarianism, and compatibilism. In the third part , I outline the rudiments of a non-standard theory of counterpossibles by which the basic Theory of Middle Freedom may be extended. Then, in the fourth part , I apply both the basic theory and this extended theory to outstanding problems in philosophical theology involving the nature of divine freedom, the existence of evil, and the metaphysics of divine providential governance. Proponemos analizar el alcance de las nociones roigeanas de "teoría y crítica" como categorías epistemológicas para un humanismo crítico latinoamericano desde una lectura alternativa de Teoría y crítica del pensamiento latinoamericano. Indagamos de qué forma estas categorías involucran la legitimidad del discurso filosófico, decisiones en torno del problema del sujeto y de la verdad y modos de entender la historia. Mostramos cómo Roig opera una ruptura, en el marco de lo que él denomina una ampliación metodológica en el campo del (...) quehacer filosófico, al imbricar conceptualizaciones epistemológicas con ejercicios reflexivos en los que el filosofar explora la experiencia vital, construye sus propias fuentes y se abre a una dimensión axiológica. En el marco de este desarrollo, Roig revisa el "legado", incorpora otras voces e interviene críticamente la estructura axiológica de los discursos y analiza sus formas de reconocimiento. Buscamos mostrar las herramientas teóricas y críticas que ofrece este libro en particular para discutir las condiciones y posibilidades del saber filosófico como saber práctico social, situado y liberador y los términos de los humanismos que supone o interpela. We propose to analyze the scope of Roig´s notions, "theory and criticism", as epistemological categories to reach a critical humanism of Latin America, based on the book Teoría y crítica del pensamiento latinoamericano, as an alternative reading. We evaluate how these categories involve the legitimacy of philosophical discourse, and the decisions taken on the subject´s problem, the truth and the possible ways to understand history. We also show how Roig, in the framework of what he identifies as methodological amplification within the field of philosophy´s task, fixes a rupture when interweaving epistemological concepts with reflective exercises in which the art of philosophy explores the vital experience, builds and rebuilds its own sources and opens up to an axiological dimension. In this framework, Roig revises the "legacy", adds other voices, handles critically the axiological structure of discourses and analyzes its ways of recognition. We aim to present the theoretical and critical tools of this book, especially to discuss the conditions and possibilities of the philosophical knowledge taken as practical, social, established and as liberator; and to discuss the terms of humanisms that the philosophical knowledge presents or interpellates. Kant's theory of the intuitive intellect has a broad and substantial role in the development and exposition of his critical philosophy. An emphasis on this theory's reception and appropriation on the part of the German idealists has tended to divert attention from Kant's own treatment of the topic. In this essay, I seek an adequate overview of the theory Kant advances in support of his critical enterprise. I examine the nature of the intuitive intellect's object; its epistemic (...) relation to its object; its mode of comprehension; the relationship between these cognitive elements; and I ask which minds Kant regards as intuitive intellects. In The Face of Emotions, which was Carroll Izard’s first major attempt at elaborating his differential emotions theory (DET), he stated that the book “presents a theoretical framework for the study of emotions and their role in personality and interpersonal processes.” Yet, over the years, his contribution to personality theory has generally been overshadowed by the attention focused on his views on facial expressions and the structure of emotions. This article will begin with a brief overview of the (...) DET perspective on personality development. Then, it will examine how the DET framework can be used to organize recent findings from three lines of research on adult personality. It will conclude with suggestions for future research as well as some personal recollections. (shrink)

Summary: Contemporary writers often claim that chaos theory explains the thermodynamic arrow of time. This paper argues that such claims are mistaken, on two levels. First, they underestimate the difficulty of extracting asymmetric conclusions from symmetric theories. More important, however, they misunderstand the nature of the puzzle about the temporal asymmetry of thermodynamics, and simply address the wrong issue. Both of these are old mistakes, but mistakes which are poorly recognised, even today. This paper aims to lay bare the (...) mistakes in their classical (pre-chaos theory) manifestations, in order to make it clear that chaos theory cannot possibly do better. (shrink)

We present a theoretical discussion of the sociological contribution concerning decisions in organizations. Two theories stand. The first, based on the decision process from a critical theory of the traditional linear multi rational by Lucien Sfez, argues that the decision is a process of interactions and treats it as an institutional process based on the freedom of the subject. The second theory based on self-referential systems by Niklas Luhmann, interprets organizations as systems-making, and understands the concept of decision (...) as purely epistemological specificity, abstracted from the decision of all the elements and organizational variables associated with it. Se expone un debate teórico sobre la aportación sociológica referente a las decisiones en las organizaciones. Sobresalen dos teorías de las decisiones. La primera, basada en el proceso de decisión a partir una teoría crítica de la multirracionalidad lineal elaborado por Lucien Sfez, al plantear que con la decisión se trata de un proceso de interacciones, al ser considerada como un proceso institucional fundamentado en la libertad del sujeto. La segunda fundamentada en la teoría de sistemas autorreferenciales, interpreta las organizaciones como sistemas de decisiones y entiende el concepto de decisión en su especificidad puramente epistemológica, al abstraer de la decisión de todos los elementos y variables organizacionales relacionados con ella (Niklas Luhmann). This paper explores the idea that when dealing with certain kinds of narratives, ‘like it or not’, consumers of fiction will bring the same sorts of skills (or at least a subset of them) to bear that they use when dealing with actual minds. Let us call this the ‘Same Resources Thesis’. I believe the ‘Same Resources Thesis’ is true. But this is because I defend the view that engaging in narrative practices is the normal developmental route through which children (...) acquire the capacity to make sense of what it is to act for a reason. If so, narratives are what provide crucial resources for dealing with actual minds – at least those of a certain sophisticated sort. I argue however that to the extent that we mindread at all, it is likely that we – i.e. those with the appropriate linguistically scaffolded abilities to make mental attributions – rely on our basic mind minding capacities to do so. So theory only comes into play when we mind guess, but theory of mind doesn’t come into it at all, neither when we deal with actual or fictional minds. (shrink)
