The mechanisms by which delusion and anxiety affect the tendency to make hasty decisions (Jumping-to-Conclusions bias) remain unclear. This paper proposes a Bayesian computational model that explores the assignment of evidence weights as a potential explanation of the Jumping-to-Conclusions bias using the Beads Task. We also investigate the Beads Task as a repeated measure by varying the key aspects of the paradigm. The Bayesian model estimations from two online studies showed that higher delusional ideation promoted reduced (...) belief updating but the impact of general and social anxiety on evidence weighting was inconsistent. The altered evidence weighting as a result of a psychopathological trait appeared insufficient in contributing to the Jumping-to-Conclusions bias. Variations in Beads Task aspects significantly affected subjective certainty at the point of decisions but not the number of draws to decisions. Repetitions of the Beads Task are feasible if one assesses the Jumping-to-Conclusions bias using number of draws to decisions. (shrink)

Introduction. There is substantial evidence that patients with delusions exhibit a reasoning bias—known as the “jumping to conclusions” bias—which leads them to accept hypotheses as correct on the basis of less evidence than controls. We address three questions concerning the JTC bias that require clarification. Firstly, what is the best measure of the JTC bias? Second, is the JTC bias correlated specifically with delusions, or only with the symptomatology of schizophrenia? And third, is the bias enhanced by emotionally salient material? (...) Methods. To address these questions, we conducted a series of meta-analyses of studies that used the Beads task to compare the probabilistic reasoning styles of individuals with and without delusions. Results. We found that only one of four measures of the JTC bias—“draws to decision”—reached significance. The JTC bias exhibited by delusional subjects—as measured by draws to decision—did not appear to be solely an epiphenomenal effect of schizophrenic symptomatology, and was not amplified by emotionally salient material. Conclusions. A tendency to gather less evidence in the Beads task is reliably associated with the presence of delusional symptomatology. In contrast, certainty on the task, and responses to contradictory evidence, do not discriminate well between those with and without delusions. The implications for the underlying basis of the JTC bias, and its role in the formation and maintenance of delusions, are discussed. (shrink)

Metacognitive training (MCT) was developed to promote awareness of reasoning biases among patients with schizophrenia. While MCT has been translated into 31 languages, most MCT studies were conducted in Europe, including newer evidence recommending an individualized approach of delivery. As reasoning biases covered in MCT are separable processes and are associated with different symptoms, testing the effect of selected MCT modules would help to develop a targeted and cost-effective intervention for specific symptoms and associated mechanisms. This study tested the efficacy (...) of a 4-session metacognitive training for delusions, MCTd (in Traditional Chinese with cultural adaptations, provided individually), as an adjunct to antipsychotics in reducing severity and conviction of delusions, jumping to conclusions bias and belief inflexibility. Forty-four patients with delusions were randomized into the MCTd or the wait-list control condition. Patients on wait-list received the same MCTd after four weeks of treatment as usual. Assessment interviews took place before and after the treatment, and at 4-week follow-up. There was an additional baseline assessment for the controls. Jumping to conclusions and belief flexibility were measured by the beads tasks and the Maudsley Assessment of Delusions Scale. Attendance rate of the MCTd was satisfactory (84.5%). Compared to treatment as usual, there was a greater reduction in psychotic symptoms, delusional severity and conviction following MCTd. There was a large treatment effect size in improvement in belief flexibility. Improvement in reaction to hypothetical contradiction predicted treatment effect in positive symptoms and delusions. Jumping to conclusions bias was reduced following MCTd, although the treatment effect was not significantly larger than TAU. Our results support the use of process-based interventions that target psychological mechanisms underlying specific psychotic symptoms as adjuncts to more conventional approach. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Rationality, Irrationality, and Depathologizing OCDBrent Kious, MD, PhD (bio)Pablo Hubacher argues that some persons with obsessive-compulsive disorder (OCD) do not, in virtue of OCD itself, exhibit what he calls “epistemic irrationality,” which is a matter of violating rational norms related to belief and inquiry (Hubacher, 2023). The argument is complex and meticulous, but ultimately not persuasive. I outline the argument, show how it is unsound, and articulate its most (...) troubling consequences. I end by inquiring about the goal of projects like this, which, I believe, is to examine the rationality of mental illnesses in order to show that they are or are not illnesses.Hubacher starts by noting that (some) persons with OCD appear “doxastically irrational”: when they exhibit obsessions, they err in how they form beliefs. Specifically, they seem to “jump to conclusions,” inferring that a feared outcome is probable or certain from scant evidence. However, psychological research shows that persons with OCD are not more likely to jump to conclusions than others. Hubacher also observes that jumping to conclusions involves the inference, “possibly P, therefore definitely P.” This inference is irrational but not specific to people with OCD, because many of us do it, and an account of the irrationality of OCD should identify OCD-specific deviations. Hubacher concludes that persons with OCD are not doxastically irrational. He next considers whether they exhibit “zetetic” irrationality, which involves violating epistemic norms of inquiry. This might identify the irrationality of OCD, since compulsions like repeatedly checking the stove are basically ways of getting evidence. But Hubacher introduces the phenomenon of sexually focused OCD, or S-OCD. Persons with S-OCD worry about whether they have sexual desires they regard as inappropriate—for instance, incestuous desires or homosexual desires. Hubacher does not think people with S-OCD are zetetically irrational, however. Their endless doubts are actually reasonable, since it is possible—even common—for people to have repressed sexual desires when those desires are stigmatized. If a person with S-OCD worries about having incestuous desires, the bare fact that he does not feel those desires in the usual way should not be reassuring to him: those desires could simply be repressed. Hubacher adds that [End Page 151] people with OCD have high intolerance of uncertainty, which he takes to mean that they approach inquiries with high standards for confirmation; they are not satisfied with evidence others would see as compelling. He concludes that people with S-OCD are neither zetetically nor doxastically irrational, and so not epistemically irrational.This is a surprising conclusion, but it results from an unsound argument. An initial problem is his assumption that the only way persons with OCD can be doxastically irrational is by jumping to conclusions. This ignores other possible ways of being doxastically irrational. For instance, it would be irrational to retain beliefs that have been disconfirmed by evidence (Hubacher might call this zetetic irrationality, but surely, my beliefs can be disconfirmed without active inquiry). Irrationally retaining disconfirmed beliefs might even capture what happens in OCD: the person with OCD thinks something awful is likely to be true, even though she gets copious disconfirming evidence.A second problem is in Hubacher’s interpretation of the psychological evidence about whether persons with OCD jump to conclusions. He cites two studies involving a very specific psychological test, the bead task, wherein a subject is asked to determine whether a random sequence of colored beads have been drawn from a jar with a preponderance of one color or another. A “jumping to conclusions bias” is taken to be an inclination to guess the jar after no more than two beads are revealed (Huq & Garety et al., 1988). Although a few studies have shown that persons with OCD do not have this jumping to conclusions bias, we cannot conclude that they do not often jump to conclusions in real life. One might imagine, for instance, that people with OCD are still quite likely to jump to conclusions with respect to their obsessions (i.e., things that are highly anxiety-provoking, where the anxiety affects the conclusions drawn). Delusions are one of the most classical symptoms described in schizophrenia. However, despite delusions are often emotionally charged, they have been investigated using tasks involving non-affective material, such as the Beads task. In this study we compared 30 patients with schizophrenia experiencing delusions with 32 matched controls in their pattern of responses to two versions of the Beads task within a Bayesian framework. The two versions of the Beads task consisted of one emotional and (...) one neutral, both with ratios of beads of 60:40 and 80:20, considered, respectively, as the “difficult” and “easy” variants of the task. Results indicate that patients showed a greater deviation from the normative model, especially in the 60:40 ratio, suggesting that more inaccurate probability estimations are more likely to occur under uncertainty conditions. Additionally, both patients and controls showed a greater deviation in the emotional version of the task, providing evidence of a reasoning bias modulated by the content of the stimuli. Finally, a positive correlation between patients’ deviation and delusional symptomatology was found. Impairments in the 60:40 ratio with emotional content was related to the amount of disruption in life caused by delusions. These results contribute to the understanding of how cognitive mechanisms interact with characteristics of the task in the context of delusional thinking. People frequently gesture when problem-solving, particularly on tasks that require spatial transformation. Gesture often facilitates task performance by interacting with internal mental representations, but how this process works is not well understood. We investigated this question by exploring the case of mental abacus, a technique in which users not only imagine moving beads on an abacus to compute sums, but also produce movements in gestures that accompany the calculations. Because the content of MA is transparent and readily manipulated, (...) the task offers a unique window onto how gestures interface with mental representations. We find that the size and number of MA gestures reflect the length and difficulty of math problems. Also, by selectively interfering with aspects of gesture, we find that participants perform significantly worse on MA under motor interference, but that perceptual feedback is not critical for success on the task. We conclude that premotor processes involved in the planning of gestures are critical to mental representation in MA. (shrink)

When young children attempt to locate numbers along a number line, they show logarithmic (or other compressive) placement. For example, the distance between “5” and “10” is larger than the distance between “75” and “80.” This has often been explained by assuming that children have a logarithmically scaled mental representation of number (e.g., Berteletti, Lucangeli, Piazza, Dehaene, & Zorzi, 2010; Siegler & Opfer, 2003). However, several investigators have questioned this argument (e.g., Barth & Paladino, 2011; Cantlon, Cordes, Libertus, & Brannon, (...) 2009; Cohen & Blanc-Goldhammer, 2011). We show here that children prefer linear number lines over logarithmic lines when they do not have to deal with the meanings of individual numerals (i.e., number symbols, such as “5” or “80”). In Experiments 1 and 2, when 5- and 6- year-olds choose between number lines in a forced-choice task, they prefer linear to logarithmic and exponential displays. However, this preference does not persist when Experiment 3 presents the same lines without reference to numbers, and children simply choose which line they like best. In Experiments 4 and 5, children position beads on a number line to indicate how the integers 1 100 are arranged. The bead placement of 4- and 5-year-olds is better fit by a linear than by a logarithmic model. We argue that previous results from the number line task may depend on strategies specific to the task. Coyote, meantime, tries to get an onlooker to lick his genitals, and finally engages in public sexual intercourse with a female tribe member or two, then ends the dance by defecating. Though the Franciscans called such forbidden acts devilry , the Chumash maintained their Datura cult religion, along with the enforced Christianity. For the Chumash, the Earth was made of two enormous snakes that caused earthquakes when they slithered past one another—a vast reptilian tectonics. In the 20th century, long after Blessed Father Fray Junípero Serra and his cohorts had died, when asked by an anthropologist about religious contradictions, conflating the Datura and Christian cults, a Chumash man replied, incredulous: “But these are two different religions.” * When Portolá ordered that if by March 19th, the feast day of St. Joseph, the San Antonio had not arrived in San Diego Bay to relieve them, the Sacred Expedition to Nueva California would be abandoned, Blessed Father Fray Junípero Serra prayed a novena for San José’s intercession. So that today, St. John the Apostle may well be paraphrased: In the end is the Word, and the Word is Man—and the Word is with Men.” * In 1602, when Sebastián Vizcaíno and his friars sang mass on Catalina Island, as many as a hundred Pimungans witnessed the rite, asking by signs what it was about. According to Vizcaíno’s records, the Californians marveled not a little at the idea of Heaven and at the image of Jesus crucified. * Vizcaíno was brought to a prairie on Santa Catalina Island where the Pimungans worshipped their sun god. Upon the prairie they had placed an icon, a headless figure with horns protruding from the body, a figure that Vizcaíno predictably described as a demon. The Pimungans urged Vizcaíno not to approach the image of their deity, but he ignored them. He placed his crucifix against the wooden figurine and prayed the Our Father. Vizcaíno told the natives that his prayer was from Heaven, and that their god was the Devil. Vizcaíno held out his crucifix, encouraging the Pimungans to touch it and receive Jesus. He pointed at the sky and indicated Heaven. The Pimungans worshipped a sun deity, so they were impressed with this white man and his description of his god, for their gods seemed to be one and the same. It’s no wonder then that Vizcaíno’s diary reports the natives being pleased with this exchange. “Surely,” the diary says, “they will be converted to our Holy Faith.” * The Miwok women wailed and scratched at their faces when their men consorted with Sir Francis Drake and the other Englishmen who had landed on California’s coast in the summer of 1579. “The blood streaming downe along their brests, besides despoiling the upper parts of their bodies of those single coverings . . .they would with furie cast themselves upon the ground . . . on hard stones, knobby hillocks, stocks of wood, and pricking bushes.” Drake and his men fell themselves to their knees in prayer, their eyes Heavenward, so that the natives might see they prayed to God and they too might worship God then their eyes that had been so blinded by the deceiver might be opened. * Father Fray Antonio de la Ascención—Carmelite friar in Vizcaíno’s party—writes that the Indians of California can “easily and with very little labor be taught our Holy Catholic faith, and that they would receive it well and lovingly.” He calls for two hundred older and honorable soldiers to ensure brotherhood during the conquest, so that peace and love—the best tools to pacify pagans—should reign. The religious, the friar says, should likewise be wise and loving to easily quell animosities between Spaniards and the heathen, and therefore avoid war. The Spaniards should bring with them trinkets—beads, mirrors, knives—to distribute amongst the gentiles, so that they might come to love the Christians, and see “that they are coming to their lands to give them that of which they bring, and not to take away the Indians’ possessions, and may understand that they are seeking the good of their souls.” No women are to accompany the conquest, says Father Fray Antonio, “to avoid offenses to God.” * In 1955 Wallace Stevens admitted himself to St. Francis Hospital in Hartford, Connecticut. There, it’s rumored he converted to Catholicism before dying of stomach cancer, exclaiming to his priest after the baptism, “Now I am in the fold.” Stevens’s late-career poems seem less cynical, more in awe of being and death (read “Metaphor as Degeneration” from The Auroras of Autumn ). He could have chosen from at least three secular hospitals in Hartford at the time. * I was reading Stevens’s Collected Poems when I joined eHarmony and listed that as my “currently reading” book among the “more than twelve” books a year that I would read. I fell in love with my wife when she said, “Are you sending your work out to literary journals?” Prior to this, the first girl I talked to on the phone, when I explained my doctoral exams, said, “So, you’re like, reading Stephen King and stuff?” When I said not exactly she responded defensively: “He must be doing something right, since he makes all that money.” * Mom walked me, my brother, and sister, through the Stations of the Cross. We did this on Ash Wednesdays, or whenever she thought we needed extra God after church. It might’ve happened before church, though that’s unlikely because we were always late. Anyway, it’s easiest to walk the Stations of the Cross when there’s no one else around. To walk the actual Stations means one goes to Jerusalem and walks the Via Dolorosa to the Church of the Holy Sepulchre. So the Stations elsewhere—usually paintings, or low-relief sculptures upon church walls—serve as a kind of virtual Dolorosa. Mom held our hands and started from the rear of Our Lady of Refuge: the First Station. Mom said we should say a prayer at each Station and to think of all the pain Jesus went through so that we could go to Heaven. It was hard to keep thinking about that one thing for so long. My mind went to that Saturday’s little league game, to the donut and chocolate milk (our after-church reward from Castroville Bakery), and as I grew older I thought about girls. When you’re thirteen you can’t not think about the girl’s butt in the pew in front of yours as she kneels and stands to pray throughout mass. * It grew increasingly juvenile to lie awake at night daring myself to utter a simple sentence. Even if I said I didn’t believe in God, wouldn’t He know the truth? He was omniscient, like a narrator. Even the idea of Him as a him ceased making sense. Not only did this come with a budding realization of my paternalistic culture, but due to the simple question of why? If God was everything, everywhere, all knowing, then why would he be a man? There’s that question: If God is a man then God must have a penis, and if so, what for? * The Catholic Church incorporates some modern scientific research into its dogma concerning the formation of the Universe, Solar System, and Earth, as well as evolution. According to Catholic doctrine, in approximately the fifth millennia BCE, humans began to worship the one true God. Those humans were Adam and Eve, though the Church says humans had been around for thousands of years prior to Adam and Eve. The Church claims to be infallible. Every time the Church changes its doctrine it remains infallible. * One Catholic writer, Tom Meagher, writes that “Modernism[—]the idea that we come to our beliefs individually through emotional or personal experiences[—]has crept into our Catholic schools.” * Catholics believe that evil spirits, given power through Original Sin, can imbue ordinary inanimate objects of everyday use. Thus, such objects should be blessed in order to induce in them the desire to serve the good. Such objects are not limited to, but include, “new ships and boats, railways and trains, bridges, fountains, wells, cornmills, limekilns, smelting furnaces, telegrams, steam engines, and machines for providing electricity.” * In The Sound of Music Julie Andrews and Christopher Plummer sing together: “Nothing comes from nothing, nothing ever could...” * To explain competing theories on the very early universe, and pre-verse would be another book. What was the inflaton? Did (mem)branes collide, initiating the Big Bang, as opposed to Lemaître’s primordial atom, a singularity? Without a unified theory there’s gravity hanging out there, fucking everything up. We cannot make sense of the mechanics of the Planck Epoch—0-10-34 seconds into the Universe’s creation—named for Max Planck, who stumbled into the discovery of quantum mechanics in the early twentieth century. * My students often ask if I believe in God, since I espouse evolution, the Big Bang, Science, reject a strictly biblical or creationist theory of the Universe. Previous accounts of how people develop expertise have focused on how deliberate practice transforms the cognitive and perceptual representations and processes that give rise to expertise. However, the likelihood of developing expertise with a particular tool may also depend on the degree to which that tool fits pre‐existing perceptual and cognitive abilities. The present studies explored whether the abacus—a descendent of the first human computing devices—may have evolved to exploit general biases in human visual attention, or whether developing expertise with (...) the abacus requires learning special strategies for allocating visual attention to the abacus. To address this question, we administered a series of visual search tasks to abacus experts and subjects who had little to no abacus experience, in which search targets and distractors were overlaid atop abacus “beads.” Across three studies, we found that both experts and naïve subjects were faster to detect targets in semantically relevant components of the abacus, suggesting that abacus training is not required to exhibit attentional biases toward these components of the abacus. This finding suggests that the attentional biases that scaffold numerical processing of the abacus may emerge from general properties of visual attention that are exploited by the design of the abacus itself. It has been suggested that damage to anterior regions of the left hemisphere results in a dissociation in the perception and lexical activation of past-tense forms. Specifically, in a lexical-decision task in which past-tense primes immediately precede present-tense targets, such patients demonstrate significant priming for irregular verbs (spoke–speak), but, unlike control participants, fail to do so for regular verbs (looked–look). Here, this behavioral dissociation was first confirmed in a group of eleven patients with damage to the pars opercularis (BA (...) 44) and pars triangularis (BA 45) of the left inferior frontal gyrus (i.e., Broca's area). Two conditions containing word-onset orthographic–phonological overlap (bead–bee, barge–bar) demonstrated that the disrupted regular-verb priming was accompanied by, and covaried with, disrupted ortho-phonological priming, regardless of whether prime stimuli contained the regular inflectional rhyme pattern. Further, the dissociation between impaired regular-verb and preserved irregular-verb priming was shown to be continuous rather than categorical; priming for weak-irregular verbs (spent–spend) was intermediate in size between that of regular verbs and strong verbs. Such continuous dissociations grounded in ortho-phonological relationships between present- and past-tense forms are predicted by single-system, connectionist approaches to inflectional morphology and not predicted by current dual-system, rule-based models. Event-related potential data demonstrated that N400 priming effects were intact for both regular and irregular verbs, suggesting that the absence of significant regular-verb priming in the response time data did not result from a disruption of lexical access, and may have stemmed instead from post-lexical events such as covert articulation, segmentation strategies, and/or cognitive control. There are communities in which disadvantaged groups experience severe inequality. For instance, poor and indigent families face many difficulties accessing their social rights. Their condition is largely the consequence of the wrong choices of those in power, either historical or more recent choices. The lack of opportunities of these deprived citizens is due to state omissions. In such communities, it is not unusual for homeless members of these particular groups to occupy abandoned lands and build their shelters there. However, almost (...) everywhere, these actions constitute a crime. The typical response to this situation is prosecution and punishment. In this paper, I will defend the occupation of public places as a consequence of the failure of governments to solve the problem of housing, and I will argue that we must distinguish a social claim from a crime and avoid the use of criminal law in these “occupation cases”. I will also argue that our right—as a community—to blame and punish these “squatters” is eroded by the fact that we perpetrated their situation of injustice. (shrink)

Dichos trabajos fueron discutidos por penalistas, filósofos y criminólogos de habla hispana provenientes de España, Argentina y Chile. En este sentido, el workshop ejemplificó también el tipo de acercamiento que los distintos mundos académicos, en este caso el mundo anglosajón y el hispano, o de forma más general el mundo jurídico del (...) common law y el de la tradición europea continental, están viviendo en estos días. El objetivo de este trabajo es examinar el modo en que Kant concibe la relación entre el derecho político, el derecho de gentes y el derecho cosmopolita, en dos de sus textos de madurez: Hacia la paz perpetua y La metafísica de las costumbre s. El análisis de esta cuestión no solo permite esclarecer principios fundamentales de su filosofía jurídico-política, sino que aporta además nociones relevantes para la actual discusión acerca de los derechos humanos, el cosmopolitismo y el derecho internacional; (...) temáticas que posicionan a Kant como uno de los autores modernos de mayor presencia en el marco del debate filosófico contemporáneo. En primer lugar, examinaré la posición asumida por el filósofo con respecto al intervencionismo, que resulta especialmente relevante para comprender la relación entre el derecho político y el derecho de gentes, ya que obliga a pensar el alcance y los límites del principio de soberanía estatal. En segundo lugar, haré referencia al modo en que este autor concibe la conexión entre el republicanismo y la institución de una comunidad jurídica internacional, e intentaré mostrar que se trata aquí de fines independientes —y a la vez, vinculados— a los que debemos aproximarnos en un proceso de perfeccionamiento gradual de las instituciones jurídicas. En este trabajo analizamos dos defi niciones kantianas de la libertad política que han sido consideradas como defi niciones antagónicas: una de ellas parece aproximar a Kant a la corriente del liberalismo moderno; la otra daría lugar, en cambio, a una interpretación republicana del pensamiento político kantiano. El análisis de ambas definiciones permitirá mostrar que éstas no resultan necesariamente incompatibles. In this paper we shall analyze two Kantian defi nitions of political freedom which have been considered mutually exclusive: one of (...) them would allow us to consider Kant as an exponent of the liberal tradition; the other would lead to a republican interpretation of Kant's political thought. The article offers an analysis of Kant’ s “Third Antinomy of Pure Reason” (in which he examines the possibility of reconciling Transcendental freedom with natural Determinism), in order to show the lack of grounds of the interpretation that claims that the critical resolution of the antinomy implies a shift with respect to the cosmological terms in which the conflict was initially stated. Through a detailed analysis of the sources, we will suggest that the conflict analyzed in the Third Antinomy is (...) not exclusively cosmological, but rather that it also –and to the same degree– constitutes a practical conflict, and, secondly, that the critical solution is not developed in exclusively practical terms, but that it also involves certain aspects directly linked to the cosmological question initially formulated. Carlos S. Nino presentó en sus últimos trabajos una defensa de su teoría del castigo que incluía una profunda crítica al retribucionismo. Según su posición, si adoptáramos una teoría retribucionista del castigo, estaríamos asumiendo una versión del subjetivismo penal que abraza el perfeccionismo moral. Nino presenta esta idea sugiriendo que hay un vínculo estrecho entre el retribucionismo, el subjetivismo y el perfeccionismo. En este trabajo, voy a discutir esa relación y criticar el nexo que Nino cree que existe entre ellos. (...) The late Carlos S. Nino presented in his latest work a defense of his theory of punishment which involves a profound critic to retributivism. According with his position if we adopt a retributivist theory of punishment, in addition we are adopting a version of penal subjectivism that embrace moral perfectionism. Nino presents his idea suggesting that there is a chain that linked retribution subjectivism and perfectionism. In this paper, I will discuss the relationship between these three concepts and argue against the links that nino presents between them. (shrink)

This paper questions the notion that states may be justified in denying certain prisoners the right to vote as a means of distancing themselves from particularly grave wrongs. Christopher Bennett has recently defended prisoner disenfranchisement as a fair and deserved retributive punishment for crimes, and Mary Sigler and Andrew Altman have argued in favor of prisoner disenfranchisement as a civil restriction. All three proponents agree that disenfranchisement should be reserved for those guilty of the most serious offenses. I assert that (...) it is inappropriate to treat citizens in this manner and will advocate for the right to vote, whether disenfranchisement is perceived as a form of punishment or as a civil measure. I will present two arguments against disenfranchisement as it impacts both citizens and political community at large. First, it excludes citizens from the democratic arena and restricts the opportunity to reintegrate offenders into the political community. While a criminal sentence is intended to be burdensome, the burden associated with disenfranchisement extends beyond the appropriate penal scope. (shrink)

El liberalismo de Carlos S. Nino evolucionó desde sus primeros trabajos vinculados al derecho penal, hacia la construcción de una teoría de la democracia deliberativa. Desde sus comienzos, siguiendo a los autores liberales clásicos como John Stuart Mill, hasta el final en donde adhirió a un liberalismo igualitario, hubo construcciones que acompañaron este proceso, como el concepto de autonomía personal, y también ciertos ideales morales, como un oposición concreta al perfeccionismo. El texto presenta al liberalismo de Nino al comienzo y (...) al final de su obra para mostrar que el antiperfeccionismo originado en el liberalismo clásico que servía de base para construir su concepción de la autonomía, se mantuvo inalterado durante todo este proceso de evolución dificultando la compatibilización de su teoría de la responsabilidad penal con su teoría de la democracia deliberativa, orientada hacia el liberalismo igualitario. In this paper we intend to discuss the problem of the ontological status of the object given to the sensibility, as it is established in the §1 of the Transcendental Aesthetics . If -attending to the results of Transcendental Analytic- the object of experience can be thought only by the mediation of the categories, the significance of this reference to the given object in the Aesthetic appears as rather obscure. Many interpreters have tried to solve this problem stating that such (...) reference corresponds to the level of common sense. We believe, however, that there is no need to appeal to such a concept, for the distinction between reality and ideality -in both empirical and transcendental senses- introduced in the §3 of the Transcendental Aesthetics as a reference to the status of space, is useful to consider the status of the given object, with important consequences concerning the interpretation of the Transcendental Idealism. En este trabajo proponemos examinar una doble exigencia formulada por Kant en El conflicto de las Facultades –a saber, la exigencia de libertad y la exigencia del orden–, a fin de señalar la premisa básica subyacente a dicha exigencia, esto es: la idea de que el orden público constituye la condición fundamental para la preservación del estado civil, entendido como el único estado en el que los hombres pueden ejercer plenamente su derecho innato a la libertad. In their respective projects to consolidate the institutions of International Right, Rousseau and Kant address the issue concerning the binding character of international juridical norms. While Rousseau states that it is necessary to constitute a coercive supranational power, authorized to force the European States to enter the International confederation, to compel them to remain in it and to enforce international laws, Kant considers that such a power would threaten the sovereignty of the States, and leans towards a confederation of free (...) States, not subordinated to a common coercive power. In this paper I analyze the premises which underlie each of these approaches and that might help to understand the different positions assumed by Rousseau and Kant regarding the problem of the juridical regulation of international relations. El artículo expone dos visiones acerca de la legitimidad del castigo en contextos de exclusión social. En la primera parte, uno de los autores defiende la idea de que los Estados que incumplen con obligaciones legales previas no pueden inculpar a quienes cometan delitos vinculados con ese incumplimiento. No pueden hacerlo porque no tienen el estatus moral para hacerlo de acuerdo a dos objeciones: la de complicidad y la de hipocresía. En la segunda parte, la segunda autora critica esta solución (...) al sostener que la falta de reciprocidad que caracteriza a la relación política vuelve inaplicables las objeciones de hipocresía y complicidad al ámbito del castigo penal estatal. Las observaciones que Kant formula en sus obras críticas acerca de la existencia de la cosa en sí han dado lugar a importantes objeciones y agudas discusiones entre los intérpretes. En este trabajo proponemos una reflexión acerca de la posibilidad de establecer el estatus epistemológico correspondiente a dichas observaciones, haciendo uso del concepto kantiano de creencia doctrinal.

Resumen: Este trabajo examina la posición que adopta Kant en la polémica del spinozismo, la cual involucró a importantes figuras de la Ilustración alemana en un debate acerca de los alcances y límites de la razón. Con la publicación del texto Was heisst: Sich im Denken orientiren?, Kant rechaza tanto la posición de Jacobi -quien declara que la razón es incapaz de arribar a una demostración de la existencia de Dios y proclama la necesidad de un "salto a la fe"- (...) como la posición de Mendelssohn, quien confía en las posibilidades de la razón para alcanzar tal demostración. A través de una concepción de la razón como facultad crítica y autónoma, Kant toma una posición mediadora en el debate, y establece los alcances y límites de la razón, fundamentalmente en lo que atañe a la representación de Dios como ser originario. El concepto de razón esbozado en el escrito de 1786 deja entrever la insoslayable dimensión política ínsita en la noción kantiana de publicidad. El modo en que Kant concibe allí la conexión entre razón, crítica, publicidad y política trasciende los márgenes de dicha polémica e introduce cuestiones fundamentales sobre las condiciones político-jurídicas que se requieren para el ejercicio autónomo del pensamiento. Sin embargo, y pese a la radicalidad de los planteamientos kantianos, la naturalización racionalista de la creencia religiosa supone un límite de la filosofía crítica que exige revisarse a la luz de criterios actuales.: This paper analyzes the position taken by Kant in the controversy of Spinozism, which engaged many important thinkers of the German Enlightenment in a debate on the scope and limits of reason. With the publication of Was heisst: Sich im Denken orientiren?, Kant takes part in the debate and rejects both the position adopted by Jacobi -who regards reason as incapable of reaching a demonstration of God's existence and thus proclaims the necessity of a "leap of faith"-, and Mendelssohn's position, who trusts in the possibilities of reason to reach such a demonstration. By means of a conception of reason as a critical and autonomous faculty, Kant attempts to go beyond both positions, and sets the scope and limits of reason in regard to the representation of God as the originating being. The concept of reason developed within the framework of the critical project exhibits its unavoidable political dimension in the text of 1786. Kant establishes there a connection between reason, critique, publicity, and politics that goes beyond the margins of the controversy and addresses fundamental issues regarding the political and juridical conditions required for an autonomous exercise of reason. However, despite the radical character of Kant's proposals, the rationalistic naturalization of religious belief represents a limit to his critical philosophy, and should be revised by the lights of current criteria. Las observaciones que Kant formula en sus obras críticas acerca de la existencia de la cosa en sí han dado lugar a importantes objeciones y agudas discusiones entre los intérpretes. En este trabajo proponemos una reflexión acerca de la posibilidad de establecer el estatus epistemológico correspondiente a dichas observaciones, haciendo uso del concepto kantiano de creencia doctrinal.

RESUMEN Se analiza la relación entre la escritura y la presencia en la obra de Maurice Blanchot, se delimita el fundamento textual de la presencia en el orden de la literatura y se toman como referentes teóricos los conceptos de "espacio literario" y "pensamiento del afuera" de Michel Foucault. Si bien el propósito de examinar dicha relación es deconstruir el vínculo entre presencia y lenguaje, Blanchot conduce a considerar esa continuidad en términos de una presencia nunca completa ni devenida que (...) se conserva como una discontinuidad, una promesa y una ausencia que deben preservarse. ABSTRACT The article analyzes the relation between writing and presence in the work of Maurice Blanchot and defines the textual grounds of presence in the order of literature, using Michel Foucault's concepts of "literary space" and the "thought of the outside" as theoretical referents. While the objective of examining that relation is to deconstruct the link between presence and language, Blanchot leads us to consider that continuity in terms of a never complete or fulfilled presence that remains as discontinuity, as promise and absence that must be preserved. El artículo propone un análisis del tratamiento kantiano de la �Tercera antinomia de la razón pura� (en la que se examina la posibilidad de conciliar la libertad trascendental con el determinismo natural), a fin de mostrar el carácter infundado de aquella interpretación que sostiene que la resolución crítica de dicha antinomia supone un desplazamiento respecto de los términos cosmológicos en los que el conflicto es planteado originariamente. A través de un análisis pormenorizado de las fuentes, procuraremos establecer que el conflicto (...) analizado en la �Tercera antinomia� no es de carácter exclusivamente cosmológico, sino que constituye asimismo �y en igual medida� un conflicto práctico y, en segundo lugar, que la solución crítica no es desarrollada en términos exclusivamente prácticos, sino que involucra asimismo aspectos directamente vinculados con la cuestión cosmológica inicialmente formulada. Avicenna holds that since God has existed from all eternity and is immutable and impassible, he cannot come to have an attribute or feature that he has not had from all eternity. He also claims for the simultaneous causation. A puzzle arises when we consider God’s creating this world. If God is immutable and impassible, then his attributes associated with his creating this world are unchanging. So, God must have been creating the world from all eternity. But then God’s creative (...) act, one might object, seems to be no different from a matter of natural necessity. This is a threat to divine freedom, for God would then have no choice concerning his creative action. Anthony Ruffus and Jon McGinnis argue that this puzzle can be solved in such a way that Avicenna can consistently affirm divine freedom along with divine simplicity. They suggest that Naṣīr al-Dīn Ṭūsī’s interpretation might help to show that it is false that Avicenna’s God cannot choose absolutely. For it is still open to him to choose either to create eternally or to refrain from creating anything at all. Ruffus and McGinnis argue that since creating or not creating anything at all do not correspond to two distinct concepts, Avicenna’s account of divine simplicity, which denies any multiplicity in divine mind, is safeguarded along with divine freedom. I claim that God’s omnirationality requiring that he always acts for reasons is a serious threat to such an interpretation. (shrink)
