Human capital, the knowledge, skills, and abilities of employees, can be a powerful driver of firm performance, yet the mobility of human capital raises questions over how to protect it. Employee non-compete agreements, which limit an employee’s ability to start or join a rival firm, have received recent attention. While past research considers whether non-competes are effective tools at limiting employee mobility, few have considered if non-competes should be used. Filling this gap, I propose a normative schema for when employee (...) non-competes can be considered ethical. A review of the limited existing literature on the ethics of employee non-competes finds that prior research has mostly focused on questions of property rights, which I propose as being nested within other ethical constructs. Analysis of two real-world illustrative examples of employee non-competes leads to a three-prong approach to evaluating non-competes based on ethical dimensions of power, autonomy, and fairness. I end by proposing—although further research is warranted—a measure of employee-level absorptive capacity, which is closely coupled with an employee’s pre-employment human capital, as an employee-level attribute independent of, although likely coincidental with, the tripartite requirements of power/autonomy/fairness for ethical employee non-compete agreements. The article examines Husserl's work On the Phenomenology of the Consciousness of Internal Time. Firstly, it seeks to show the surplus of cosmic time with regard to the temporality of consciousness. Secondly, an attempt is made to establish whether the Husserlian description of the form of the flow of consciousness is circular, i.e., whether it does not presupposes the objective time that it purports to constitute. Thirdly, a critical analysis of the self-manifestation of the absolute flow of consciousness is advanced. (...) This book intends to introduce readers to the work of Charles E. Butterworth, and thereby to introduce students to Medieval islamic political philosophy, of which Butterworth is one of the world's most prominent scholars. In a wider sense, the Festschrift introduces its readers to the current debates on Medieval islamic political philosophy, related as they are to the questions of the relationship between islam and Christianity, the Medieval to the Modern world, and reason and revelation. Butterworth's scholarship spans six decades, (...) primarily translating, editing, and interpreting the works of the Muslim political philosopher Alfarabi (d. 950) and Averroes (Ibn Rushd, d. 1198). He began his studies of Muslim political philosophy at a time when the Middle East and islam did not have the political salience they have acquired in more recent years. instead, Butterworth's reason for engaging with islam was rooted in the question of the relationship between reason and revelation. While one possible answer was pursued in the Christian, latin West, the islamic borderlands of Greek, Roman, and Muslim civilization offered another. By exploring Averroes, who provides the possibility of an Aristotelian-Islamic political philosophy, and Alfarabi, who pursues a Platonic-islamic political philosophy, Butterworth showed how islamic civilization provided a viable alternative to the theologico-political question reason v revelation, as well as serving as an inspiration to the latin West. Se diserta sobre “RESISTENCIA TRIBUTARIA” JUSTIFICADA EN EL ECUADOR. Ello, porque gobierno del presidente Daniel Noboa estableció todo un “paquete” de “impuestos de guerra”, como la Contribución Temporal de Seguridad (CTS); un incremento del IVA, a discreción del presidente de la República, el pechaje del sector construcción, transferencias al exterior y otros impuestos. Ley Orgánica para Enfrentar el Conflicto Armado Interno, la Crisis Social y Económica (en adelante, la Ley), publicada en el Registro Oficial, Suplemento No. 516 del 12 de (...) marzo de 2024, trayendo a discusión los aspectos jurídicos que vician de posible inconstitucionalidad dicha Ley, con fundamento en la normativa constitucional y tributaria de Ecuador. Con la Ley, dado el contexto de su aprobación, el gobierno creó un ´impuesto de guerra´, para financiar una guerra inexistente, partiendo del hecho que la Corte Constitucional del Ecuador estableció que en el país no existe un “Conflicto Armado Interno” (CAI). Así lo estableció en sus Dictámenes 5-24-EE/24 del 9 de mayo de 2024 y 6-24-EE/24 del 13 de junio de 2024, en los que declaró inconstitucionales los decretos ejecutivos No. 250 de 30 de abril de 2024 y 275 del 22 de mayo de 2024, relacionados con el Estado de Excepción que ha regido en Ecuador desde el 10 de enero de 2024, soportado éste en la presunta existencia de un CAI, “decertado” y reconocido sin fundamento jurídico, pese a que no cumple con los supuestos fácticos y normativos fijados, con fuerza ius cogens, por el Derecho Internacional Humanitario (DIH)7 para ser calificado como tal. El ´impuesto de guerra´, fijado en la Ley, por inconstitucional, es confiscatorio. Los Dictámenes, en el plano de la reflexión tributaria, reflejan la patética violación al principio de la constitucionalidad y de la legalidad fiscal, resultando viciada de nulidad absoluta la Ley y, con ella, la configuración del tributo, porque el hecho imponible (CAI) es inexistente, implicando que el presupuesto establecido por la Ley para configurar cada `impuesto de guerra´ jamás tendrá materialización práctica (por inexistente) y nunca tendrá validez jurídica (por inconstitucional), resultando en un tributo confiscatorio, surgido contra la Carta Fundamental y evidente fraude a la legalidad tributaria del país, en perjucio del patrimonio personal o corporativo de los contribuyentes, residentes fiscales o establecimientos permanentes en el país a los que somete a un pago indebido sancionado en el artículo 122 10 , concordado con los artículo 306 al 307 del Código Tributario del Ecuador. La nulidad absoluta e ineficacia del hecho imponible, por inconstitucional, deriva en la invalidez plena y la irrelevancia constitucional del inexistente hecho generador del tributo -proveniente de un acto de naturaleza jurídica - por la no realización fáctica, tangible y concreta del presupuesto generatriz establecido (CAI) en la Ley para su configuración. Como consecuencia, nunca jamás surge válidamente la obligación tributaria, cuya exigencia resulta ineficaz, por ilegal e ilusoria. La obligación tributaria, tiene que calificarse, en tal sentido, como no nacida lícitamente en el ámbito fiscal. Con ello, habría de resultar confiscatorio el pago de la alicuota del `impuesto de guerra´ fijado por el gobierno ecuatoriano de modo inconstitucional abusando del ejercicio del poder tributario relacionado con la urgencia en materia económica. Ante las hondas repercusiones económicas que genera en la población y el sector productivo del país, se describen las posibles vías institucionales disponibles en la regulación ecuatoriana para impugnar la Ley ante la Corte Constitucional del Ecuador -o en la jurisdicción constitucional- sin menoscabo de la eventual activación de la competencia derogatoria de la Asamblea Nacional frente a la misma. Se reafirma el principio de justicia tributaria y la vigencia del Estado social de derechos y de justicia consagrado en la República del Ecuador y la plena efectividad de los derechos y garantías fundamentales de los hermanos ecuatorianos ubicados en la posición de destinatarios de un "impuesto de guerra" tan arbitrario como inconstitucional, que riñe con el enunciado constitucional y convencional del respeto a la dignidad humana y la incolumidad de la propiedad privada frente a actuaciones del Estado que representan un claro abuso en el ejercicio del poder público en desmedro de la legalidad fiscal, generador de un supuesto de patética injusticia tributaria adoptada a contracorriente de toda regulación en materia de impositiva con la publicación de la Ley Orgánica para Enfrentar el Conflicto Armado Interno, la Crisis Social y Económica. En la lucha contra conductas gubernamentales transgresoras de la dignidad humana y frente a leyes inconstitucionales que afectan los derechos fundamentales, la libertad económica y la propiedad privada de los hermanos contribuyentes ecuatorianos y sus empresas afectadas. Este esfuerzo intelectual, realizado por nuestra familia de abogados, es una reverencia a la gesta de nuestros libertadores y un llamado al pueblo ecuatoriano económicamente afectado a resistir, por medios institucionales, frente al pago de impuestos arbitrarios e ilegales que atentan contra los principios fundamentales del orden público económico previsto en la Ley Fundamental. Lo anterior, como una singular expresión reglada, lícita y avanzada de dar al traste con una ley orgánica fiscal tan arbitraria como injusta, activando los mecanismos de protección de los derechos fundamentales constitucionalmente establecidos en el Ecuador. La pretensión judicial traduciría, mutatis mutandis, en la activación institucional de la añeja figura de la "resistencia tributaria" (objeción fiscal, desobediencia tributaria), que, en sus orígenes, nació como expresión de la desobediencia civil frente a leyes impositivas injustas, con el precedente del escritor estadounidense Henry David Thoreau, encarcelado por negarse a pagar un tributo electoral, reticente a contribuir con la continuidad de la esclavitud y la financiación de la Guerra entre México y EEUU, basado en la idea de que las personas deben priorizar su conciencia sobre la obediencia a leyes injustas. -/- . Robert E. Butts (1928-1997) was a philosopher and historian of science whose central concerns were the distinction between the rational and the irrational. He viewed scientific rationality as our major defence against the various conditions that encourage witch hunts and similar outbursts of irrationality, with all their attendant pain and terror. Butts saw himself as a pragmatic realist, combining what he took to be the best aspects of logical empiricism with a historically informed pragmatism, deeply appreciative of the methods of (...) science, trying to describe a kind of rationality essential in the struggle to preserve human values. This volume gathers previously unpublished essays and lectures with some previously published, thematically related essays. In Différence et répétition, the transcendental field is presented through the concepts of Idea and intensity. A lot has been said about these concepts, but the relation between them is still a subject of dispute. In this article we aim to shed light upon this knot. First, we will show that intensity is actual, and not virtual nor intermediate like some interpretations suggest. In this point, our reading of the book from 1968 is complemented with Le pli. Leibniz et le (...) Baroque, to show that the actual status of intensity remains the same in the late works of Deleuze. Then, we will explore the relation between intensity and the three characters of the Idea and with the dramatization commanding actualization. After that, the bond between Idea and intensity will be thought through the problem of expression. This results, at last, in a complex articulation between these two planes from the point of view of their order of constitution. In this point, it will be key to put together concepts from both Différence et répétition and Logique du sens. (shrink)

Funke has taken upon himself the task of refining and answering the question "What is philosophy?" His answer results in the proof that all philosophy in order to be philosophy must not neglect the question as to the transcendental determination and form of its own consciousness. As such, philosophy is, according to Funke, neither merely stating facts nor describing qualities. Rather philosophy wants to know why something is the way it is, that is, why something occurs as a phenomenon in (...) exactly the way it does and not otherwise. Consequently, philosophy is a critical transcendental phenomenology that has to understand the object regressively as the correlate of a subjective achievement. Being a universal transcendental philosophy, pure phenomenology has the task of not merely seeking for the constitutive conditions of the phenomena in their peculiarity but also that of proving the validity of its own undertaking. Phenomenology as reflective consciousness has to turn back to the conditions of its own possibility. This demand leads back to an iterative regress in which each proposition about transcendentals must be justified transcendentally. The chapter on "The Reflective Consciousness and the Iterating Regress of the Conditions of Possibility" exhibits this problem while the chapter on "The Topical Consciousness and the Utopical Regress to the Ultimate Experiences of the Life-World" provides an answer and demonstrates why the phenomenological regress of reflection can and must never be completed. Interpreting Husserl, Funke explains that the transcendental reduction in Husserl does not lead back to an ego, a transcendental subjectivity as intersubjectivity, as generally assumed. Rather, as Funke attempts to prove, the state of awareness of subjectivity and the context of meaning of objectivity belong to one another correlatively and universally. According to Funke, phenomenology is essentially the method which in critical reflection makes reason advance further in its process of self-enlightenment. This book is written in an interesting and lively way and Funke does not fail to anticipate and address possible critical objections to his own position. At the same time he involves himself in an apologetic discussion with the philosophical literature on this issue.—H. E. M. H. (shrink)

The reissuing of this classic on Hume, originally published in 1925 and long out of print, is a welcomed event. A supplement, four appendices and an introduction have been added to this edition, adding over one hundred and fifty pages. The fifth chapter of the original edition, "Space, Time and Reality," has been omitted, but the topic is treated in one of the new appendices.—A. E. F.

Garelick, in this closely-argued presentation, maintains that although Johannes Climacus defines Christianity as irrational, he presents it not as an end in itself but as a means to the higher end, eternal happiness, "a choice which a reasonable man could accept." Climacus thus becomes "anti-Christian" in a twofold manner, by making Christianity reasonable and by making it a means. This book can be considered a welcome addition to Kierkegaard scholarship, even though the arguments for the final conclusion are not quite (...) convincing.—A. E. J. (shrink)

With the appearance of this book, Kierkegaard's dissertation for the master's degree, all major works of Kierkegaard are available in English. Capel's translation is felicitous, and his "historical introduction" and notes are genuinely helpful. The Concept of Irony is itself an exercise in irony, and most problems of interpretation relate to that point. Although the book is of considerable independent interest, sprinkled with wit and insight, it is likely that it will be used mainly by scholars tracing the origins of (...) Kierkegaard's thought. It should be good for a handful of dissertations, and several hands full of articles.—A. E. J. (shrink)

Durkheim écrit ce livre avec un but double : d'abord il voulait expliquer ce qui crée une société, ce qui la tient ensemble ; ensuite il voulait éclaircir l'influence qu'a la société sur la pensée logique. Pour Durkheim, la religion est la clé utilisée pour déverrouiller ces deux problématiques.Dans ce livre, Durkheim argumente que les représentations religieuses sont en fait des représentations collectives : l'essence du religieux ne peut être que le sacré. Il est une caractéristique qui se trouve universellement (...) dans toutes les religions. Le sacré, être collectif et impersonnel, représente ainsi la société elle-même. Ensuite il argumente que la société a un impact majeur dans la genèse de la pensée logique. C'est la société qui fournit à l'individu les catégories (le temps, l'espace, le nombre etc.) et les concepts nécessaires pour la pensée logique. (shrink)
