This paper defends the Blockian Proviso against its critics, Kinsella in particular, and interprets it as a law of non-contradiction in the theory of just property rights. I demonstrate that one may not lawfully appropriate in such a way as to forestall others from appropriating an unowned land because such appropriation would result in conflict-generating norms, and conflict-generating norms are not rationally justifiable and just norms. The Blockian Proviso, which precludes forestalling, operates therefore at the level of original appropriation and (...) determines, according to the homestead principle of justice in first acquisition, what may and what may not be lawfully appropriated. Hence, the Blockian Proviso is not an add-on to the homestead principle but part and parcel thereof. (shrink)

This article explores several entanglements between human judgments of intentionality and morality (blame and praise). After proposing a model of people’s folk concept of intentionality I discuss three topics. First, considerations of a behavior’s intentionality a ff ect people’s praise and blame of that behavior, but one study suggests that there may be an asymmetry such that blame is more affected than praise. Second, the concept of intentionality is constitutive of many legal judgments (e.g., of murder vs. manslaughter), and one (...) study illustrates people’s subtle considerations of intentionality in making those judgments. Third, controversial recent studies suggest that moral considerations can affect judgments of intentionality, and an asymmetry may exist such that blame a ff ects those judgments more than praise. I report two new studies that may shed light on these recent findings, and I discuss several theoretical models that might account for the impact of moral considerations on intentionality judgments and for the relationship between the two more generally. This paper looks at a recent challenge to the liberal inclusivist view that everyone on the state’s territory should have a path to citizenship. Economists have argued that giving immigrants an inferior legal status would persuade wealthy countries to admit more, with beneficial consequences for global justice. Whilst this trade-off might seem appealing from the impersonal perspective of the policymaker it generates incoherence from the perpective of the collective of democratic citizens, since it requires them to treat their own unjust (...) attitudes as an objective constraint. The paper argues that the concept of second nature has two aspects that are inherently bound up with one another. Firstly, second nature has to be conceived of as a concept that has a critical force. Secondly, art has to be understood as an essential part of what second nature is. The paper explains these two dimensions of the concept by drawing on Hegel’s and Heidegger’s conceptions of second nature as the nature of essentially incomplete beings. Since the incompleteness in (...) question always has to be reproduced, human beings have to develop and constantly engage in practices of self-criticism. As a practice of self-criticism, art is constitutive of second nature understood in this way. Thus, the specificity of art is to be found in its form of self-criticism as articulated through objects, which for their part give orientation to beings that realize their second nature through their practices. In the end, art prompts them to revise and enliven these practices. (shrink)

According to contemporary understanding of the universal tree of life, the traditionally recognized kingdoms of eukaryotic organisms—Protista, Fungi, Animalia and Plantae—are irregularly interspersed in a vast phylogenetic tree. There are numerous groups that in any Linnaean classification advised by phylogenetic relationships would form sister groups to those kingdoms, therefore requiring us to admit them the same rank. In practice, this would lead to the creation of ca. 25-30 new kingdoms that would now be listed among animals and plants as “major (...) types of life”. This poses problems of an aesthetic and educational nature. There are, broadly speaking, two ways to deal with that issue: a) ignore the aesthetic and educational arguments and propose classification systems that are fully consistent with the Hennigian principles of phylogenetic classification, i.e. are only composed of monophyletic taxa; b) ignore Hennigian principles and bunch small, relatively uncharacteristic groups into paraphyletic taxa, creating systems that are more convenient. In the paper, I present the debate and analyze the pros and cons of both options, briefly commenting on the deeper, third resolution, which would be to abandon classification systems entirely. Recent advances in eukaryotic classification and phylogeny are commented in the light of the philosophical question of the purpose and design principles of biological classification systems. Modern technology offers an increasing number of tools for teaching mathematics, but technology adoption in schools encounters many barriers. The Technology Acceptance Model explains that technology usage is dependent on intentions, which rest on perceived ease of use and perceived usefulness. Less is known about the relationship between intentions and actual behaviour. In the current study we show that the level of cognitive investment on the part of the teachers, captured by the construct of Need for Cognition (NC), is crucial (...) in the use of technology in mathematical instruction, while controlling for a variety of background factors. Furthermore NC moderates the relationship between intentions and technology use, such that high NC weakens the relationship between the perceived usefulness of technology in pedagogy and its actual use. Can ownership status influence probability judgements under condition of uncertainty? In three experiments, we presented our participants with a recording of a real horse race. We endowed half of our sample with a wager on a single horse to win the race, and the other half with money to spend to acquire the same wager. Across three large studies, we found the endowment effect – owners demanded significantly more for the wager than buyers were willing to pay to acquire it. (...) However, we also found that probability estimates of each horse winning the race did not differ between owners and non-owners of the betting slip. Our results demonstrate that distorted perception of probability is unlikely to be a mechanism explaining the endowment effect. (shrink)

Based on a review of several “anomalies” in research using implicit measures, Machery (2021) dismisses the modal interpretation of participant responses on implicit measures and, by extension, the value of implicit measures. We argue that the reviewed findings are anomalies only for specific—influential but long-contested—accounts that treat responses on implicit measures as uncontaminated indicators of trait-like unconscious representations that coexist with functionally independent conscious representations. However, the reviewed findings are to-be-expected “normalities” when viewed from the perspective of long-standing alternative frameworks (...) that treat responses on implicit measures as the product of dynamic processes that operate on momentarily activated, consciously accessible information. Thus, although we agree with Machery that the modal view is empirically unsupported, we argue that implicit measures can make a valuable contribution to understanding the complexities of human behavior if they are used wisely in a way that acknowledges what they can and cannot do. The concept of second nature promises to provide an explanation of how nature and reason can be reconciled. But the concept is laden with ambiguity. On the one hand, second nature is understood as that which binds together all cognitive activities. On the other hand, second nature is conceived of as a kind of nature that can be changed by cognitive activities. The paper tries to investigate this ambiguity by distinguishing a Kantian conception of second nature from a Hegelian conception. (...) It argues that the idea of a transformation from a being of first nature into a being of second nature that stands at the heart of the Kantian conception is mistaken. The Hegelian conception demonstrates that the transformation in question takes place within second nature itself. Thus, the Hegelian conception allows us to understand the way in which second nature is not structurally isomorphic with first nature: It is a process of ongoing selftransformation that is not primarily determined by how the world is, but rather by commitments out of which human beings are bound to the open future. States claim the right to choose who can come to their country. They put up barriers and expose migrants to deadly journeys. Those who survive are labelled ‘illegal’ and find themselves vulnerable and unrepresented. The international state system advantages the lucky few born in rich countries and locks others into poor and often repressive ones. In this book, Christopher Bertram skilfully weaves a lucid exposition of the debates in political philosophy with original insights to argue that migration controls must (...) be justifiable to everyone, including would-be and actual immigrants. Until justice prevails, states have no credible right to exclude and no-one is obliged to obey their immigration rules. Bertram’s analysis powerfully cuts through the fog of political rhetoric that obscures this controversial topic. A central theme in recent research on attitudes is the distinction between deliberate, "explicit" attitudes and automatic, "implicit" attitudes. The present article provides an integrative review of the available evidence on implicit and explicit attitude change that is guided by a distinction between associative and propositional processes. Whereas associative processes are characterized by mere activation independent of subjective truth or falsity, propositional reasoning is concerned with the validation of evaluations and beliefs. The proposed associative-propositional evaluation model makes specific assumptions about (...) the mutual interplay of the 2 processes, implying several mechanisms that lead to symmetric or asymmetric changes in implicit and explicit attitudes. The model integrates a broad range of empirical evidence and implies several new predictions for implicit and explicit attitude change. (shrink)

A widespread assumption in recent research on attitudes is that self-reported evaluations reflect conscious attitudes, whereas indirectly assessed evaluations reflect unconscious attitudes. The present article reviews the available evidence regarding unconscious features of indirectly assessed “implicit” attitudes. Distinguishing between three different aspects of attitudes, we conclude that people sometimes lack conscious awareness of the origin of their attitudes, but that lack of source awareness is not a distinguishing feature of indirectly assessed versus self-reported attitudes, there is no evidence that people (...) lack conscious awareness of indirectly assessed attitudes per se, and there is evidence showing that, under some conditions, indirectly assessed attitudes influence other psychological processes outside of conscious awareness. Implications for the concept of “implicit attitudes” are discussed. (shrink)

Robot ethics encompasses ethical questions about how humans should design, deploy, and treat robots; machine morality encompasses questions about what moral capacities a robot should have and how these capacities could be computationally implemented. Publications on both of these topics have doubled twice in the past 10 years but have often remained separate from one another. In an attempt to better integrate the two, I offer a framework for what a morally competent robot would look like and discuss a number (...) of ethical questions about the design, use, and treatment of such moral robots in society. Instead of searching for a fixed set of criteria of a robot’s moral competence I identify the multiple elements that make up human moral competence and probe the possibility of designing robots that have one or more of these human elements, which include: moral vocabulary; a system of norms; moral cognition and affect; moral decision making and action; moral communication. Juxtaposing empirical research, philosophical debates, and computational challenges, this article adopts an optimistic perspective: if robotic design truly commits to building morally competent robots, then those robots could be trustworthy and productive partners, caretakers, educators, and members of the human community. Moral competence does not resolve all ethical concerns over robots in society, but it may be a prerequisite to resolve at least some of them. (shrink)

In this paper, we develop an understanding of recognition in terms of individuals’ capacity for conflict. Our goal is to overcome various shortcomings that can be found in both the positive and negative conceptions of recognition. We start by analyzing paradigmatic instances of such conceptions—namely, those put forward by Axel Honneth and Judith Butler. We do so in order to show how both positions are inadequate in their elaborations of recognition in an analogous way: Both fail to make intelligible the (...) fundamental nexus between relations of recognition and individuals’ capacity for conflict. We then move on to reconsider aspects of Hegel's view of recognition—ones that, from our viewpoint, have been unjustly neglected in the debate about recognition: his focus on the constitution of relations of recognition in conflict and on the status of being an author of acts of recognition. On this basis, we then spell out in a more systematic way what we take to be a more convincing conception of recognition. This puts us in the position to gesture at some consequences of this conception in practical contexts, above all with regard to the justification, role and structure of political institutions. A long series of studies in social psychology have shown that the explanations people give for their own behaviors are fundamentally different from the explanations they give for the behaviors of others. Still, a great deal of uncertainty remains about precisely what sorts of differences one finds here. We offer a new approach to addressing the problem. Specifically, we distinguish between two levels of representation ─ the level of linguistic structure (which consists of the actual series of words used in (...) the explanation) and the level of conceptual structure (which consists of the concepts these words are used to express). We then formulate and test hypotheses both about self-other differences in conceptual structure and about self-other differences in the mapping from conceptual structure to linguistic structure. Evaluative conditioning (EC) refers to the change in the valence of a conditioned stimulus (CS) due to its pairing with a positive or negative unconditioned stimulus (US). To the extent that core affect can be characterised by the two dimensions of valence and arousal, EC has important implications for the origin of affective responses. However, the distinction between valence and arousal is rarely considered in research on EC or conditioned responses more generally. Measuring the subjective feelings elicited by a CS, (...) the results from two experiments showed that (1) repeated pairings of a CS with a positive or negative US of either high or low arousal led to corresponding changes in both CS valence and CS arousal, (2) changes in CS arousal, but not changes in CS valence, were significantly related to recollective memory for CS–US pairings, (3) subsequent presentations of the CS without the US reduced the conditioned valence of the CS, with conditioned arousal being less susceptible to extinction and (4) EC effects were stronger for high arousal than low arousal USs. The results indicate that the conditioning of affective responses can occur simultaneously along two independent dimensions, supporting evidence in related areas that calls for a consideration of both valence and arousal. Implications for research on EC and the acquisition of emotional dispositions are discussed. (shrink)

In this commentary, I critically assess Rex Welshon’s position on the neural substrates of ownership unity. First, I comment on Welshon’s definition of ownership unity and underline some of the problems stemming from his phenomenological analysis. Second, I analyze Welshon’s proposal to establish a mechanistic relation between neural substrates and ownership unity. I show that it is insufficient and defend my own position on how neural mechanisms may give rise to whole subjects of experience, which I call the neuro-integrative account (...) of consciousness. Lastly, I comment on Welshon’s philosophical contribution and claim that it leaves the reader theoretically stranded. (shrink)

Il n’est pas toujours évident de rappeler aujourd’hui que l’économie politique contemporaine est née d’une fusion, et non seulement d’évictions successives, entre le formalisme moderne, des conceptions non formalisées – et peut-être dûment impossibles à formaliser – mais rationnelles, et des intuitions dont le statut philosophique a été – et demeure – l’une des grandes questions traitées en théorie de la connaissance, telle que l’a en particulier illustrée la tradition allemande depuis Kant jusqu’à nous. Une des tentatives majeures pour donner (...) un statut à l’Anschauung dans la théorie économique a été conduite en Allemagne, puis en Suisse, par Edgar Salin (1892-1974) dont l’œuvre, fut inspirée par l’atmosphère régnant dans le cercle réuni autour du poète Stefan George dans l’Entre-deux guerres. Elle se présenta comme une conception alternative à celles de Popper et de Weber, tant quant à l’usage possible de l’intuition en regard du cadre de la rationalité scientifique qu’eu égard à l’architectonique et aux visées de l’économie politique. La présente étude restitue, d’une part, une brève généalogie du concept philosophique d’intuition et, d’autre part, constitue un des rares exposés en français de la doctrine développée par Salin, une pensée que le travail mené par les auteurs les a conduits à revaloriser dans l’optique d’épistémologie comparative qu’ils ont ici adoptée. Usually, the ontology of art is executed as an ontology of artworks. This has the consequence that the answer to the question what art is says nothing about why art is valuable. But it is, I argue, necessary to determine the value of art if one wants to say what art is. In order to account for the value of art, I start with the claim that art is a practice of transformation. Thus, I propose to develop the ontology of (...) art as the ontology of a practice of transformation. The practice in question has four elements: first artworks, second interpretive activities through which recipients and producers follow the constellations realized in artworks, third ordinary practices which are reflected through interpretive activities, and fourth practices of art criticism. By way of these four elements art is realized. According to the proposed conception, art is a profoundly unstable practice which challenges human beings and their self-understandings in such a way that they and their self-understandings develop further. Liberal egalitarian political philosophers have often argued that private property is a legal convention dependent on the state and that complaints about taxation from entitlement theorists are therefore based on a conceptual mistake. But our capacity to grasp and use property concepts seems too embedded in human nature for this to be correct. This essay argues that many standard arguments that property is constitutively a legal convention fail, but that the opposition between conventionalists and natural rights theorists is outmoded. In (...) doing this, the essay draws on recent literature in evolutionary biology and psychology. Even though modern property in a complex society involves legal conventions, those conventions should be sensitive to our natural dispositions concerning ownership. (shrink)
