This paper seeks to challenge the long-standing interpretation of the ius vitae necisque as a formal legal right of Roman fathers. It offers a review and critique of the evidence upon which the claim of ancient origin is founded and highlights the consequent problems in comprehending late Republican and Imperial references to the killing of sons by fathers. An alternative and more satisfactory understanding is to be found in sociological thinking and it is argued that the comprehension of (...) the ius vitae necisque as a formal right is not only invalid but obscures the real significance of its promotion as a political phenomenon in the age of Augustus and the early emperors of Rome. RESUMO O presente artigo pretende explorar um tema ainda incipiente na literatura secundária referente ao estatuto do direito em Giorgio Agamben e ao peso do direito romano em seus trabalhos. Para isso lançamos mão do debate entre Agamben e Yan Thomas, um importante historiador do direito romano com quem Agamben teve um contato bastante intenso. Ao longo do artigo pretenderemos mostrar três coisas: em primeiro lugar, a relação de Agamben com a biopolítica, destacando, sobretudo, o aspecto articulatório da noção de (...) dispositivo que subjaz suas investigações. Em segundo lugar, a importância do ensaio Vita necisque potestas de Yan Thomas, que servirá para Agamben introduzir diferenças em relação a Hannah Arendt e Michel Foucault. Por fim, lançaremos luz sobre o estatuto do direito no pensamento de Agamben, que, é a nossa hipótese, comunga da visão thomasiana: o direito não seria uma realidade metafísica ou substancial, mas funcionaria por meio de artifícios e ficções, o que nos permite pensar o direito enquanto um autêntico dispositivo biopolítico. ABSTRACT This article intends to explore a still incipient theme in the secondary literature regarding the status of the law in Giorgio Agamben and the weight of Roman law in his works. To this end, we have used the debate between Agamben and Yan Thomas, an important historian of Roman law with whom Agamben had a very intense contact. Throughout the article we will show three things: firstly, the relationship between Agamben and biopolitics, emphasising the articulatory aspect of the notion of apparatus which underlies his investigations. Then we will point out the importance of the essay Vita necisque potestas by Yan Thomas, which will serve for Agamben to introduce differences in relation to Hannah Arendt and Michel Foucault. Finally, we will shed light on the statute of law in Agamben’s thought, which is our hypothesis, communes with the Thomasian view: law would not be a metaphysical or substantial reality, but would work through artifice and fiction, which enables us to think the law as an authentic biopolitical apparatus. Right to life is an essential natural right protected and defended by law. The aim of this publication is to discuss the main issues regarding human right to life and its protection in the Roman law. Article deals with the problems of beginning and end of the human life and legal capacity in Rome, elements of legal protection of slaves and family members subject to pater familias life as well as the principle crimes attempting to human life. First of all, (...) the right to life as well as the right to liberty were held to be the institutes of natural law (ius naturale) meanwhile institutes that provided possibility to withdraw those rights (e. g. patria potestas that in the most ancient époque included right to decide on subject person’s right to life) are derived from the branches of positive law—civil (ius civile) and law of nations (ius gentium). Such attitude of the Roman jurisprudence had a solid impact on recognizing right of life to be an inherent law of every person, deriving immediately from the human nature and not conferred by the society and the state. This article proposes a rereading of the question of the body and of meaning in the work of Jean-Luc Nancy by considering the phenomenon of sound. The issues of tonality, voice and listening have been at the center of several of Nancy’s studies throughout his philosophical production, but it is from his last publication, the book Cruor, that the analysis of sound outward propagation acquires a major relevance in the thought of bodies. RESUMO O artigo tem por objetivo analisar a raiz heideggeriana do tratamento da história no jovem Derrida. Juntamente à sua análise do problema genético em Husserl, Derrida constrói sua discussão crítica da razão histórica referindo-se ao problema da historicidade originária em "Ser e Tempo". São conhecidos os seus estudos dos anos 1970 em matéria de Heidegger, em torno do problema do tempo e da diferença, porém, uma nova e mais explícita evidência sobre esta relação primária com Heidegger em torno do (...) problema histórico é oferecida pelo curso que Derrida ministrou na École Normale Supérieure de Paris no período 1964-1965, sob o título "Heidegger: a questão do Ser e da História". Nesse curso, que acaba de ser publicado, Derrida discute a questão linguística associando-a ao problema heideggeriano da contaminação ineludível entre narração e fundação. No texto que segue, pretende-se analisar os termos de tal herança heideggeriana e, ao mesmo tempo, destacar as questões críticas que emergem desse curso e detalham a distância entre o jovem Derrida e Heidegger. ABSTRACT The article aims at analyzing the treatment of history in Young Derrida under a Heideggerian basis. Together with that, add Heidegger's analysis on the genetic issue in Husserl, Derrida builds his critical discussion on the historical reason referring to the originary historicity issue in "Ser e Tempo". His studies from the 70s, in terms of Heidegger, are known, regarding the issue of time and difference, but, a new and more explicit evidence on that primary relation with Heidegger round the historical issue is offered by the course Derrida taught at the École Normale Supérieure de Paris from 1964-1965, under the title "Heidegger: a questão do Ser e da História". In that course, which has just been published, Derrida discusses the linguistic issue linking it to Heideggerian issue of the unavoidable contamination between narrations and foundation. In the text below, we intend to analyze terms such as Heideggerian heritage and, at the same time, highlighting the critical issues emerging from that course and which detail the distance between the young Derrida and Heidegger. El presente artículo pretende subrayar la relevancia de una tradición menor en la reflexión estética que ha intentado pensar el ritmo más allá del patrón del tiempo secuencial, como una potencia intensiva capaz de contaminar la variabilidad del flujo temporal y la estaticidad de la forma. En esta tradición, se vuelve inoperante la dicotomía de imagen y sonido, de figura y movimiento, y se abre la brecha para considerar el ritmo como potencia con-figurativa. Pasando por Chladni, Novalis, Benveniste y Tarkowski, (...) el artículo indica las apuestas de una consideración visual del ritmo y los rasgos para una estética capaz de superar la dicotomía de figura y sonido. Resumen: El artículo pretende realizar una confrontación entre el modelo fenomenológico de Merleau-Ponty y la propuesta deconstructiva de Derrida acerca del tema del lenguaje y de la problemática genética. En Merleau-Ponty, la cuestión genética se vincula a la noción de cuerpo y a la expresividad precategorial de los gestos, en los que el silencio describe una dimensión opaca e inalcanzable temáticamente, pero originaria y decisiva para la mirada fenomenológica. Por otra parte, Derrida es un crítico muy radical de todo uso (...) filosófico de un origen pleno, y por lo tanto también de la proyección de un silencio primitivo pretendida por Merleau-Ponty. Sin embargo, la noción de silencio de Merleau-Ponty no cumple cabalmente la función que Derrida le asigna, siendo siempre para Merleau-Ponty un espacio diacrónico y diferencial. El texto que sigue pretende mostrar los puntos de contactos y de distancias entre Merleau-Ponty y Derrida con respecto al tema del lenguaje en general, haciendo también hincapié sobre la cuestión de la literatura, a la que ambos filósofos se dedican ampliamente y a la que ambos pretenden extender las cuestiones evocadas, con el objeto de demostrar que en este ámbito los motivos de oposición entre los dos planteamientos se hacen efímeros.: This article aims to realize a confrontation between Merleau-Ponty's phenomenological model and Derrida's deconstructive proposal, with regard to the subject of language and the genetic problematic. In Merleau-Ponty, the genetic question is linked to the notion of the body and the pre-categorial expressiveness of gestures, in which silence describes a dimension that is opaque and thematically unattainable, but original and decisive for the phenomenological viewpoint. Derrida, in contrast, is a radical critic of the philosophical use of such origin, and therefore also of the projection to a primitive silence sought by Merleau-Ponty. However, the notion of silence in Merleau-Ponty does not fully meet fully the role assigned to it by Derrida, silence being always for Merleau-Ponty a diachronic and differential space. This article aims to show the points in common and the differences between Merleau-Ponty and Derrida on the issue of language in general. Also discussed is the topic of literature, with which both philosophers are widely engaged and to which both try to extend the issues under consideration in this paper. It is argued that in this area the motives behind the opposition between the two approaches become ephemeral. (shrink)

RESUMEN El presente artículo pretende definir y comparar las distintas “deconstrucciones de lo trágico” de Lacoue-Labarthe y Derrida con vistas a precisar los términos a través de los cuales han concebido la relación entre filosofía y literatura y marcar la diferencia con la que abordan el poder de lo negativo propio de la instancia trágica. El estudio de esos focos permite también aclarar el rendimiento político de la cuestión literaria en ambos autores, enfatizando las distintas herencias a la que se (...) refieren y las distancia que estas herencias producen en sus respectivos planteamientos. ABSTRACT This article aims to define and compare the different “deconstructions of the tragic” of Lacoue-Labarthe and Derrida in order to clarify the terms through which they have conceived the relationship between philosophy and literature, and in order to precise the difference in approaching the power of the negative, that is a distinctive instance of the tragic. The study of these notions also makes it possible to clarify the political impact of the literary issue in both authors, emphasizing the different inheritances to which they refer and the distance that these inheritances produce in their respective approaches. This article analyzes Heidegger’s Paris lecture, “The End of Philosophy and the Task of Thinking,” in an attempt to understand the historical “task” that Heidegger seeks to examine when confronted with the agony of philosophy today. I attempt to valorize the understanding of time and history that Heidegger stages in his reading by demonstrating its entrance to be radical and novel with respect to other moments in Heidegger’s production: history here is not of “destiny”, that is, it does not coincide (...) with the appropriating orientation of man in time already presented in Heidegger’s other texts; rather, it is understood on the basis of the opening to the future that fragilizes and suspends all hope and all historical resolution. History is thought here as the desertification of present times, the completion of metaphysical nihilism, in which there opens at the same time a “perhaps” that, repeated many times throughout the lecture, takes up in all its complexity the problem of the future’s coming, of the extraordinary, of the opening, that is, of what, from the future, exceeds destiny. Summary What is the “fantasmatic deixis”? It is a very creative and productive cognitive–linguistic operation that allows a “transfer” to other real or fantastic times, places, and “worlds”. The underlying psychological question concerns the possibility of moving and being moved with respect to something or someone who is absent (Bühler, 1965). This “fiction game” is made possible by deictic indicators (Tenchini, 2008), terms that allow motion in time and space, always considering the here–now–I system of subjective orientation. When we refer (...) to something that can be gathered by hearing or by sight, by terms such as here, there, I, and you, the receiver can easily use natural, prelinguistic aids (e.g., gestures, voice quality, facial expressions, and body orientation) to understand what the issuer intends to communicate to him (demonstratio ad oculos). But what happens when we move from the study of “immediate” behavior to that of “mediate” behavior, i.e., the field of memories (retrospection) or the constructive fantasy (prospecting)? The fantasmatic deixis implies enfranchisement from the physical position of the body and requires the assumption of the listener’s current tactile body image. Thus, the receiver assumes an inner attitude to correctly interpret the indications given by the speaker, seeing and hearing through the “inner” or “mental” eye and ear (Raynaud, 2006). In this way, the listener can bring something absent in his/her here, now, and I or feel moved to the point where the speaker leads him/her. My paper will focus on the features and types of fantasmatic deixis, providing some examples and showing how this operation involves language, motion, and cognitive processes. (shrink)

Charismatism as a non-Christian movement has been known in the world since the mid-twentieth century. He came to Ukraine relatively recently, so it is a new phenomenon, unknown, which raises constant questions not only among ordinary people, but also among specialists. Due to its heterogeneity, diversity of forms, relative independence of organizational structures, charismaticism requires additional study. But there are some problems with the lack or insufficiency of factual material, such as objective statistics, social survey results, surveys, and more.

En este trabajo destacamos los aportes del jurista socialdemócrata Hermann Heller a la teoría de las normas que, a diferencia de los que hizo a la teoría del Estado, permanecen en un lugar olvidado. Se reconstruye su concepción del (...) derecho con el fin de mostrar que sus ideas sobre la estructura del sistema jurídico y los fundamentos de los principios jurídicos dan cuenta de la relación entre derecho y poder en los Estados constitucionales modernos y del rol de los jueces en una democracia, al tiempo que resultan precursoras de las que desarrollaría con posterioridad Robert Alexy. This article concerns sound aesthetic preferences for European foreign languages. We investigated the phonetic-acoustic dimension of the linguistic aesthetic pleasure to describe the “music” found in European languages. The Romance languages, French, Italian, and Spanish, take a lead when people talk about melodious language – the music-like effects in the language (a.k.a., phonetic chill). On the other end of the melodiousness spectrum are German and Arabic that are often considered sounding harsh and un-attractive. Despite the public interest, limited research has (...) been conducted on the topic of phonaesthetics, i.e., the subfield of phonetics that is concerned with the aesthetic properties of speech sounds (Crystal, 2008). Our goal is to fill the existing research gap by identifying the acoustic features that drive the auditory perception of language sound beauty. What is so music-like in the language that makes people say “it is music in my ears”? We had 45 central European participants listening to 16 auditorily presented European languages and rating each language in terms of 22 binary characteristics (e.g., beautiful – ugly and funny – boring) plus indicating their language familiarities, L2 backgrounds, speaker voice liking, demographics, and musicality levels. Findings revealed that all factors in complex interplay explain a certain percentage of variance: familiarity and expertise in foreign languages, speaker voice characteristics, phonetic complexity, musical acoustic properties, and finally musical expertise of the listener. The most important discovery was the trade-off between speech tempo and so-called linguistic melody (pitch variance): the faster the language, the flatter/more atonal it is in terms of the pitch (speech melody), making it highly appealing acoustically (sounding beautiful and sexy), but not so melodious in a “musical” sense. The paper interpreted religious communities participate in the formation of civil society as the space establishment of universal values. The author analyzes the degree of self-organization of society at this stage, its main objective characteristics and role of the religious factor.

The aim of this work is to investigate the problem of Logical Omniscience in epistemic logic by means of truthmaker semantics. We will present a semantic framework based on $$\varvec{W}$$ W -models extended with a partial function, which selects the body of knowledge of the agents, namely the set of verifiers of the agent’s total knowledge. The semantic clause for knowledge follows the intuition that an agent knows some information $$\varvec{\phi }$$ ϕ, when the propositional content that $$\varvec{\phi }$$ ϕ (...) is contained in her total knowledge. We will argue that this idea mirrors the philosophical conception of immanent closure by Yablo (2014), giving to our proposal a strong philosophical motivation. We will discuss the philosophical implications of the semantics and we will introduce its axiomatization. (shrink)

Religion, however, appears as a certain qualitative certainty characterizing the ability and ability to satisfy the vital needs of man, religious communities and society, and helping a believer in comprehending the inner essence of the world in his transcendental co-ordinates, posing a "normative and content quintessence of experience", inherent in (...) this social phenomenon. overcoming suffering, life problems, and also contributes to the awareness of the meaning and significance of earthly life as a believer in the perspective of "the last reality". The image of the future of religions is interesting to us not only and not so much that to a certain extent presupposes or corrects the future, but also that it characterizes the religious present in which it functions, in close connection with the existing society. Situational versus general change of emphasis in the forms of existence and / or functionality of religion is the result of interaction with society, its various spheres and man. The formation of the newest religious (...) needs, due to which the functionality of religion manifests itself, is a factor in the emergence of various quasi-religious and paranute teachings, coumaromania - as components of mass social mythology. Instead of "traditionally new" religious education, there are even more recent, such as the Church of Copimizma, Pastafarian, Jedi, various manifestations of quasi-religions, etc. (shrink)

The subject of bullying has received widespread academic attention, going back to pioneering studies in the 1970s. However, work in this area has tended to take a gender-neutral/male perspective that does not distinguish between male and female bullying. While retaining a dialogue with generalist literature on the subject, this article seeks to highlight the theoretical and political-social relevance of gender-specific and intersectional approaches when exploring the question of bullying between adolescent girls. Based on the study _Il bullismo femminile a scuola. (...) Un’indagine intersezionale mixed-method_ (Female bullying at school, an intersectional, mixed-method study) – conducted in medium-sized and large cities in northern, central and southern Italy – it proposes a theoretical-analytical framework in which to consider the phenomenon of female bullying in Italian schools. Alessandro Maurini's book follows in the stream of a series of recent studies that have attempted to reread Aldous Huxley's thought, highlighting the extent to which, especially in his later essays and his novel Island, he expressed ideas and proposals that were to become extremely topical in the latter half of the twentieth century and the first decades of the twenty-first. Read from this perspective, Huxley becomes a utopian writer who anticipated not just some of the fundamental principles of ecology (...) but also those of pacifism, as well as forms of ecological and pacifist communitarian thought. There is a visible fracturing of the personal and social behaviors of its hybrid users – a process that we might call data‐clatter. While life expansion seeks the continuation of persons over time and space and beyond the physical body, there is no current (...) method for backing up the brain and transferring its processes outside the biological system. The objectives of life expansion include developing a whole‐body prosthesis as both a device for mobility and sensory perception and a system that streams cognitive functions. These systems would provide the biosphere for biological systems of humans and the cybersphere for computational systems of digital persons. (shrink)

In the rhetorical tradition of Late Antiquity, Socrates’ legend has a good fortune in the works of different rhetoricians and philosophers. In the following pages I am going to deal with some examples of this phaenomenon, through the works of Themistius and Julian the emperor : two intellectuals of the IV century who are, under many aspects, the exact opposites.They both try to ‘actualize’ Socrates’ figure, highlighting different aspects of the Athenian philosopher, on the grounds of their personal purposes of (...) self-advertisement. So Themistius, a skilled politician working as princeps’ advisor, sees in Socrates a symbol of the ‘politikos philosophos’, who speaks plainly in public with people of all ranks, in a simple and direct way ; for Julian, emperor and philosopher of the new Hellenism, Socrates, instead, is mainly the saviour of the souls, addressing all men towards the true knowledge of themselves and the true faith in pagan gods. These portraits are complementary and both attest the ability of Late Antique intellectuals in their imitatio/aemulatio of figures and myths of Classical Antiquity. (shrink)

This article aims to analyze the philosophical and religious message of Julian’s Hymn to King Helios. The emperor, using Iamblichean structures, shows how the First Cause, the Neoplatonic One, can interact with the layers or gradation below it, including the physical world ; his starting point is an original ‘pluralizing’ interpretation of the Sun analogy contained in Resp. VI 509b.However, Julian’s hymn has a political meaning, too ; it can be considered as a sort of manifesto of Julian’s imperial ideology. (...) The parallel between the emperor and the sun – already present in the ancient rhetorical tradition – is reworked by the Apostate and is part of a complex metaphysical‑cosmological system, grounded on the principles of similarity and middleness. These concepts were subject to controversy between nicene and heterodox christians in the IV century. It is possible that these controversies were largely known by Julian and that he has consciously recalled them in his panegyric to Helios intellective, mediator and saviour. (shrink)

The article outlines the methodological problems of the philosophical and religious studies discourse of the forecast activity, considers the forecast as a specific type of knowledge, the subject-object interconnection of knowledge in the conditions of forecasting. The analysis of the activity of the cognitive activity of the subject required, in turn, to consider the principle of anthropy and the vector of time changes. The article deals with the problems of the objectivity of scientific analysis of religious reality.
