The following categories can be found in the analysis of the prehistory of constitutionalism: the early constitutionalism, the ancient constitutionalism, the medieval or canonical constitutionalism. The usage of these categories raises the question: is constitutionalism the product of the Age of Enlightenment or is it an older phenomenon? The author of the article approaches this problem from another point of view: maybe the usage of the mentioned categories is an anachronism? In this case the (...) elements taken form different contexts are combined into a single unit typical to recent reality. This conjunction, when neither the single entirety nor the alterations of contexts are taken into consideration, distorts the understanding of the past, fits the past to the Procrustian bed straining it to the present standards. The existence of separate elements does not allow the consideration of the phenomenon as a whole. It also suits the category of constitutionalism. In author’s opinion, it is necessary to differentiate between: a) the prehistory of constitutionalism; b) the era of written constitutions as the legal acts of supreme power, the essence of which is expressed by the category of constitutionalism and which began in XVIII century. This paper presents a systematic study of the prehistory of the traditional subsystems of second-order arithmetic that feature prominently in the reverse mathematics program of Friedman and Simpson. We look in particular at: (i) the long arc from Poincar\'e to Feferman as concerns arithmetic definability and provability, (ii) the interplay between finitism and the formalization of analysis in the lecture notes and publications of Hilbert and Bernays, (iii) the uncertainty as to the constructive status of principles equivalent to Weak (...) K\"onig's Lemma, and (iv) the large-scale intellectual backdrop to arithmetical transfinite recursion in descriptive set theory and its effectivization by Borel, Lusin, Addison, and others. (shrink)

An obsession with constitutional reform characterized Canadian politics between 1987 and 1992. This reflected the failure of traditional mechanisms for bridging linguistic and regional differences in Canada, and the spirit of contentiousness and rightsconsciousness that has been encouraged since the passage of the Charter of Rights and Freedoms in 1982. These efforts to reform the constitution failed. In the 1992 referendum a majority of both French- and English-speaking Canadians, and majorities in 6 of the 10 provinces, rejected proposals supported by (...) the country's political and economic elites. Support for the reform proposals was greatest among the more affluent parts of Canadian society. Despite the fact that both French and English Canada rejected the proposed reforms, their reasons for doing so were quite different. In the wake of this failure, the terms of a reconciliation between the aspirations of French and English Canada are elusive as ever. (shrink)

In this paper we consider the prehistory of quantum gravity (1916–1930) from two perspectives. First, we investigate how this research field constituted itself and we propose for the first time a red thread to trace its evolution in this earliest period. Second, we focus on a case study: the earliest work of Léon Rosenfeld. In 1927 he tried to merge wave mechanics with general relativity in the context of a five‐dimensional universe. We describe how Oskar Klein, Louis de Broglie, (...) and Théophile De Donder influenced Rosenfeld's work and analyze how and why Rosenfeld attempted to reconcile Einstein's theory with quantum phenomena. We argue that Rosenfeld investigated for the first time the corrections to a classical space‐time metric generated by a quantum source. As far as we know, Rosenfeld's approach has been largely ignored until today: he himself considered it “an accident.” After having reconsidered its connection with de Broglie's ideas and Rosenfeld's interpretation of the wave function in 1927, we argue that Rosenfeld's work can be interpreted as a first attempt to introduce the pilot‐wave theory in the context of quantum gravity and we infer that this was one of the reasons that ruled it out. The world of the Hindi heroes of the 1970s, while decked in battle gear, largely belonged to the official state apparatus, either as members of vigilante self-defence squads – of which Bahadur was a pioneer – or bonafide members of the police force, like Inspector Vikram. The costumed superhero only emerged at the end of the Nehruvian period, gradually coming to defy its signature science and rationality. My article seeks to explore questions of the political economy of the superhero genre (...) and the affective valences of the supernatural in imaging/negotiating the national and transnational, through this conjunctural moment of the late 1970s and early 1980s. Canada is caught between two empires and between two constitutional systems. However, neither the British model of a "single sovereign" nor the American people's "sacred fire of liberty" matched the pluralistic identity of Canada, so Canadians engaged in constitutional experimentation. In Canada and the Ethics of Constitutionalism Samuel LaSelva argues that, in order to understand the old Canada of Confederation and the new one that followed the Charter of Rights and Freedoms, it is necessary to see how distinctive Canadian (...) constitutionalism is and how that distinctiveness does not depend on borrowings from the British or American constitutional models. LaSelva supports his argument by exploring different aspects of Canada's contribution to the ethics of constitutionalism including the limits of free expression, the Charter's notwithstanding clause, the origins and functions of judicial review, the Quebec secession debate, Aboriginal self-government, and the conception of Canada as a multicultural and multinational mosaic. Carey leaves unaddressed an important evolutionary puzzle: In the absence of a numeral list, how could a concept of natural number ever have arisen in the first place? Here we suggest that the initial development of natural number must have bootstrapped on a material culture scaffold of some sort, and illustrate how this might have occurred using strings of beads.

I discuss a textual problem at Cratylus 393bc and, after establishing the correct text, argue that the MSS readings point to the existence of a textual variant in the margin of an ancestor of the common source of our MSS, presumably an ancient edition of the dialogue. Then I make the further hypothesis that both readings originated as alternative attempts to interpret Plato's ambiguous orthography.

The significance of historical advances in human development has been widely debated within cognitive science. Steven Mithen's recent book, The prehistory of mind (London: Thames & Hudson, 1996), presents an archeologist's attempt to explain the details of cognitive development within the framework of modern anthropology and cognitive psychology. We argue that Mithen's attempt fails for a number of different reasons. The relationship between the archeological evidence he considers and his conclusions is problematic. We maintain that it is difficult to (...) draw biological conclusions from strictly behavioral artifactual evidence. To buttress his claims, Mithen borrows heavily from the very cognitive science literature to which he hopes to contribute. As a consequence, his analysis of the archeological evidence cannot promote a particular cognitive theory, since his interpretation is only as strong as those theories from which he borrows. We are also concerned that the specific details of Mithen's program are equally problematic. Mithen's claim that modular intelligences did not exist outside of hominid evolution is likely false and unwarranted. As a consequence, we argue that the central component of his claim that the uniquely human feature of our development, the move from modular to fluid minds, depends on poorly defined distinctions between a wide range of mental processes. Whether we can accept Mithen's characterization of these claims will depend, we argue, on how he chooses to clarify these terms. We suggest that the various choices will be difficult to reconcile with his theory. Moreover, we suggest that the phenomena that Mithen hopes to explain in human development cannot be explained strictly in terms of analogical reasoning. We nevertheless find Mithen's attempt at answering these questions to be both a constructive and fascinating foray into what is an under-explored topic. (shrink)

This paper takes a phenomenological perspective regarding the difficulties encountered in daily life by man in prehistory. I argue that the economics of beingnecessarily establishes man as a being that must make choices. Of these, man must eventually arrive at the realization that higher, rather than lower choices will safeguard human survival, well being and allow for prosperity. The economics of being is a form of identifying economic choice-making as a natural disposition of man’s. It is the latter condition (...) that makes man act in the world. However, even though man must act, action cannot be blind. Instead, human action is motivated and guided by man’s sense of interiority. That is, man’s existential capacity for self-reflection is also what can deliver us to autonomous rule. This form of reflective choice-making is a creative act. The paper attempts to trace this aspect of the human condition back to prehistory, in order to demonstrate that societies, institutions, invention, technology, artistic creation and economic responsibility come about as the result of human industriousness. None of the aforementioned are creations of modern man. (shrink)

In this comment to the brilliant book on the Constitutionalism in Latin-America, Gargarella, it is accepted that perhaps is the equality the empty promise among the ideals of constitutionalism in this region of the world. It is also accepted that an important part of the reason for this absence of equality lies in the institutional design, in the engine room of the Constitution, concretely in an hypertrophy of presidentialism. A complementary suggestion is added: the ideal of a constitutional (...) democracy presupposes the existence of a State with an autonomous, efficient, professional and robust public Administration. Only with a well-designed tax system and an Administration apt to carry out the proper functions it is possible to build a well-ordered society in which the Rawlsian Difference Principle is respected and honoured. The past 25 years have seen a rapid growth of knowledge about brain mechanisms involved in visual mental imagery. These advances have largely been made independently of the long history of philosophical – and even psychological – reckoning with imagery and its parent concept ‘imagination’. We suggest that the view from these empirical findings can be widened by an appreciation of imagination’s intellectual history, and we seek to show how that history both created the conditions for – and presents challenges (...) to – the scientific endeavor. We focus on the neuroscientific literature’s most commonly used task – imagining a concrete object – and, after sketching what is known of the neurobiological mechanisms involved, we examine the same basic act of imagining from the perspective of several key positions in the history of philosophy and psychology. We present positions that, firstly, contextualize and inform the neuroscientific account, and secondly, pose conceptual and methodological challenges to the scientific analysis of imagery. We conclude by reflecting on the intellectual history of visualization in the light of contemporary science, and the extent to which such science may resolve long-standing theoretical debates. The conventional history of modern scientific peer review begins with the censorship practices of the Royal Society of London in the 1660s. This article traces one strand of the “prehistory” of peer review in the writings of John Amos Comenius and other members of the Hartlib circle, a precursor group to the Royal Society of London. These reformers appear to have first envisioned peer review as a technique for theologians, only later proposing to apply it to philosophy. The importance (...) of peer review was as a technique that would permit a community of theologians or philosophers to resolve disputes internally rather than publicly, since public disputation would (they believed) sow doubt, error, and confusion, and disrupt the social order. In 1912, Ernst Cassirer contributed to the special issue of the Kant-Studien that honored Hermann Cohen's retirement—his mentor and teacher, and the recognized founding father of the so-called 'Marburg school' of Neo-Kantianism. In the context of an otherwise rather conventional presentation of Cohen's interpretation of Kant, Cassirer made a remark that is initially surprising. It is “anything but accurate,” he wrote, to regard Cohen's philosophy as focused “exclusively on the mathematical theory of nature,” as is usually done. How has the concept of wild nature changed over the millennia? And what have been the environmental consequences? In this broad-ranging book Max Oelschlaeger argues that the idea of wilderness has reflected the evolving character of human existence from Paleolithic times to the present day. An intellectual history, it draws together evidence from philosophy, anthropology, theology, literature, ecology, cultural geography, and archaeology to provide a new scientifically and philosophically informed understanding of humankind's relationship to nature. Oelschlaeger begins by examining the (...) culture of prehistoric hunter-gatherers, whose totems symbolized the idea of organic unity between humankind and wild nature, and idea that the author believes is essential to any attempt to define human potential. He next traces how the transformation of these hunter-gatherers into farmers led to a new awareness of distinctions between humankind and nature, and how Hellenism and Judeo-Christianity later introduced the unprecedented concept that nature was valueless until humanized. Oelschlaeger discusses the concept of wilderness in relation to the rise of classical science and modernism, and shows that opposition to "modernism" arose almost immediately from scientific, literary, and philosophical communities. He provides new and, in some cases, revisionist studies of the seminal American figures Thoreau, Muir, and Leopold, and he gives fresh readings of America's two prodigious wilderness poets Robinson Jeffers and Gary Snyder.
