Swiss and Japanese villagers have learned the relative benefi ts and costs of privateproperty and communal-property institutions related to various types of land and uses of land. The villagers in both settings have chosen to retain the institution of communal property as the foundation for land use and similar important aspects of village economies.1..

Most donated organs in the United States come from brain dead donors, while a small percentage come from patients who die in “controlled,” or expected, circumstances, typically after the family or surrogate makes a decision to withdraw life support. The number of organs available for transplant could be substantially if donations were permitted in “uncontrolled” circumstances–that is, from people who die unexpectedly, often outside the hospital. According to projections from the Institute of Medicine, establishing programs permitting “uncontrolled donation after circulatory (...) determination of death,” or uDCDD, throughout the United States has the potential to provide 22,000 more donation opportunities annually. In contrast, U.S. controlled donation after circulatory determination of death, or cDCDD, cases have increased progressively over the past decade from 87 to 848 donors, but currently account for only 10.6 percent of all deceased donors. Following the IOM recommendations, several projects exploring the feasibility of uDCDD were funded by the federal government, including a grant from the Health Resources and Services Administration that supported a pilot project in New York City in which the authors of this article participated.A key feature of our protocol, and indeed of many uDCDD protocols, is the initiation of preservation methods such as chest compressions and extracorporeal membrane oxygenation shortly after death in order to perfuse and preserve the donor's organs. Critics of uDCDD argue that the means of determining death deviates from generally ascribed principles. They assert that reinstituting circulation in order to preserve organs has the effect of “undoing” the prior determination of death. The result is that cDCDD is widely accepted and practiced routinely even though it only marginally increases the number of organs available for transplantation, and uDCDD is widely considered unacceptable despite being ethically embraced and proven to significantly increase organ donation opportunities in other countries. This article explores the evolution of this counterintuitive state of affairs and calls for a policy that, in line with the IOM report, allows for both cDCDD and uDCDD protocols. (shrink)

This study examined the role of reflection on personal cases for making ethical decisions with regard to new ethical problems. Participants assumed the position of a business manager in a hypothetical organization and solved ethical problems that might be encountered. Prior to making a decision for the business problems, participants reflected on a relevant ethical experience. The findings revealed that application of material garnered from reflection on a personal experience was associated with decisions of higher ethicality. However, whether (...) the case was viewed as positive or negative, and whether the outcomes, processes, or outcomes and processes embedded in the experience were examined, influenced the application of case material to the new problem. As expected, examining positive experiences and the processes involved in those positive experiences resulted in greater application of case material to new problems. According to the expertise defense, practitioners of the method of cases need not worry about findings that ordinary people’s philosophical intuitions depend on epistemically irrelevant factors. This is because, honed by years of training, the intuitions of professional philosophers likely surpass those of the folk. To investigate this, we conducted a controlled longitudinal study of a broad range of intuitions in undergraduate students of philosophy (n = 226), whose case judgments we sampled after each semester throughout their studies. Under the assumption, made by proponents of the expertise defense, that formal training in philosophy gives rise to the kind of expertise that accounts for changes in the students’ responses to philosophically puzzling cases, our data suggest that the acquired cognitive skills only affect single case judgments at a time. There does not seem to exist either a general expertise that informs case judgments in all areas of philosophy, or an expertise specific to particular subfields. In fact, we argue that available evidence, including the results of cross-sectional research, is best explained in terms of differences in adopted beliefs about specific cases, rather than acquired cognitive skills. We also investigated whether individuals who choose to study philosophy have atypical intuitions compared to the general population and whether students whose intuitions are at odds with textbook consensus are more likely than others to drop out of the philosophy program. This article proposes that we recognize ‘accountability’ as a forward-looking virtue, which disposes its possessors to live accountably in relation to those to whom they are rightly answerable, and which can be sub-divided into ‘particular accountability’, exercised within specific and limited relationships, and ‘ultimate accountability’, regarding the shape of one’s life as a whole. The article then proposes that these two forms of accountability find close analogues in two virtues which Thomas Aquinas described as ‘annexed to justice’, namely ‘obedience’ (accountability (...) to human superiors) and ‘religion’ (accountability to God). Purpose: Sensory feedback for prosthetics is an important issue. The area of forearm stump skin that has evoked tactile sensation of fingers is defined as the projected finger map, and the area close to the PFM region that does not have ETS is defined as the non-projected finger map. Previous studies have confirmed that ETS can restore the tactile pathway of the lost finger, which was induced by stimulation of transcutaneous electrical nerve stimulation on the end of stump skin. This (...) study aims to reveal EEG features between the PFM and the NPFM regions of the stumps under the same TENS stimulation condition.Methods: The PFM and NPFM regions of the two subjects were stimulated with the same intensity of TENS, respectively. TENS as target stimuli are modulated according to the Oddball paradigm to evoke the P300 components.Result: The PFM regions of both subjects were able to elicit P300 components, while their NPFM regions were not able to elicit P300 components. However, this P300 appears early and has continuous positive peaks in front of it.Discussion: N30 and P300 can prove that the two subjects with PFM can perceive and recognize ETS. The heteromorphisms of the P300 waveform may be related to the difficulty in subjects’ cognition of ETS or caused by the fusion of P150, P200, and P300. (shrink)

In the Netherlands, in 2002, euthanasia became a legitimate medical act, only allowed when the due care criteria and procedural requirements are met. Legally, an Advanced Euthanasia Directive can replace direct communication if a patient can no longer express his own wishes. In the past decade, an exponential number of persons with dementia share a euthanasia request with their physician. The impact this on physicians, and the consequent support needs, remained unknown. Our objective was to gain more insight into the (...) experiences and needs of Dutch general practitioners and elderly care physicians when handling a euthanasia request from a person with dementia. We performed a qualitative interview study. Participants were recruited via purposive sampling. The interviews were transcribed verbatim, and analyzed using the conventional thematic content analysis. Eleven general practitioners and elderly care physicians with a variety of experience and different attitudes towards euthanasia for PWD were included. Euthanasia requests appeared to have a major impact on physicians. Difficulties they experienced were related to timing, workload, pressure from and expectations of relatives, society’s negative view of dementia in combination with the ‘right to die’ view, the interpretation of the law and AEDs, ethical considerations, and communication with PWD and relatives. To deal with these difficulties, participants need support from colleagues and other professionals. Although elderly care physicians appreciated moral deliberation and support by chaplains, this was hardly mentioned by GPs. Euthanasia requests in dementia seem to place an ethically and emotionally heavy burden on Dutch GPs and elderly care physicians. The awareness of, and access to, existing and new support mechanisms needs further exploration. (shrink)

In discussing apprehension, assent, and inference in his Grammar of Assent, Newman contrasted “notions” and “things”—terms that distinguish knowledge of the abstract and “unreal” from knowledge of the singular and concrete. This essay proposes that Newman’s contrast between “notions” and “things” is an adverbial distinction, qualifying a person’s mode of engagement with the world, rather than an adjectival distinction, qualifying the metaphysical status of particular terms.

In their practice, nurses make daily decisions that are ethically informed. An ethical decision is the result of a complex reasoning process based on knowledge and experience and driven by ethical values. Especially in acute elderly care and more specifically decisions concerning the use of physical restraint require a thoughtful deliberation of the different values at stake. Qualitative evidence concerning nurses’ decision-making in cases of physical restraint provided important insights in the complexity of decision-making as a trajectory. However a (...) nuanced and refined understanding of the reasoning process in terms of ethical values is still lacking. A qualitative interview design, inspired by the Grounded Theory approach, was carried out to explore nurses’ reasoning process in terms of ethical values. We interviewed 21 acute geriatric nurses from 12 hospitals in different regions in Flanders, Belgium in the period October 2009–April 2011. The Qualitative Analysis Guide of Leuven was used to analyse interview data. Nurses’ decision-making is characterized as an ethical deliberation process where different values are identified and where the process of balancing these values forms the essence of ethical deliberation. Ethical decision-making in cases of physical restraint implies that nurses have to choose which values receive priority in the process, which entails that not all values can be respected to the same degree. As a result, decision making can be experienced as difficult, even as a dilemma. Driven by the overwhelming goal of protecting physical integrity, nurses took into account the values of dignity and justice more implicitly and less dominantly. (shrink)

Can researchers, interested in novel ways to assess HIV seroprevalence among populations which are otherwise hidden, collect condoms that have been discarded on the ground in a public sex environment and test them for HIV? Does the Code of Federal Regulations address this question, and if not, what areas of research ethics might provide guidance to an IRB considering such a study? These questions arose as part of a preliminary study to test the feasibility of collecting discarded condoms (...) from a public sex environment in Massachusetts, and testing contained semen for HIV. Although the methodology of this study is somewhat unusual, the questions raised are not. Researchers, who wish to use other types of abandoned samples such as discarded syringes, hair or saliva samples, or even excess biological samples, commonly confront similar issues, and the analysis utilized here could guide design and review of other studies. Introduction: Congenital myasthenic syndromes refer to a heterogenic group of neuromuscular transmission disorders. CMS-subtypes are diverse regarding exercise intolerance and muscular weakness, varying from mild symptoms to life-limiting forms with neonatal onset. Long-term follow-up studies on disease progression and treatment-response in pediatric patients are rare.Patients and Methods: We analyzed retrospective clinical and medication data in a cohort of 32 CMS-patients including the application of a standardized, not yet validated test to examine muscular strength and endurance in 21 patients at the (...) last follow-up. Findings obtained in our cohort were compared with long-term follow-up studies of CMS-cohorts from the literature by considering the underlying molecular mechanisms. Outcomes of CMS-ST were compared to results of normal clinical assessment.Results: Thirty-two pediatric patients with defects in eight different CMS-genes were followed by a median time of 12.8 years. Fifty-nine percentage of patients manifested with first symptoms as neonates, 35% as infants. While 53% of patients presented a reduced walking distance, 34% were wheelchair-bound. Even under adequate therapy with pyridostigmine and 3,4-diaminopyridine, CHAT-mutations led to the progression of muscular weakness partly in combination with persistent respiratory and bulbar symptoms. RAPSN, CHRND, and CHRNB1 patients with neonatal manifestation, early respiratory problems, and bulbar symptoms showed a good and maintained treatment response. CHAT and CHRNE patients required higher PS dosages, whereas RAPSN patients needed a lower mean dosage at the last follow-up. The benefits of short-term medication and long-term progression of symptoms were highly dependent on the specific genetic defect. CMS-ST was carried out in 17/21 patients, determined affected muscle groups including bulbar and ocular symptoms, some of which were not reported by the patients.Conclusions: Our findings and comparison with the literature- suggest a better treatment-response and less severe progression of symptoms present in patients suffering from mutations in CMS-genes directly associated with receptor deficiency, while patients with defects leading to synaptopathy and presynaptic defects tend to have worse outcomes. Assessment of affected muscular groups and clinical symptoms by CMS-ST may be a useful tool for optimal therapeutic management of the patients, especially for future clinical studies. (shrink)

This paper examines medical writing in Karl Philipp Moritz’ Journal of Empirical Psychology by looking at the alterations Moritz made to his sources. It shows how he rearranged the data in order to introduce a new type of text into psychology: the case or case study. He did so by altering the main parts of a report that had been published a few years earlier. In rewriting the report, Moritz introduced not only a new type of text but also (...) a style of reasoning; i.e. the casuistic form of thinking that became more widely acknowledged only later in the course of experiential psychology. The main theorem _improves_ Arslanov’s, effectively hyperimmune sets can_not_ have _effectively_ hyperimmune complements: the _improvement_ omits the second ‘_effectively_’. Two _natural_ examples of _strongly effectively immune_ sets are presented with new cases of the first proved herein. The first is the set of minimal-Blum-size programs for the partial computable functions; the second, the set of Kolmogorov-random strings. A proved, _natural_ example is presented of an _effectively dense simple_, _not_ strongly effectively simple set; its complement is a set of maximal run-times. Further motivations for this study are presented. _Kleene_ recursion theorem proofs herein emphasize how to conceptualize them. One of the most important characteristics of modern science is its replicability and objectivity. This means that a scientific result is taken as such only when it has been reproduced by other scientists. Indeed, the replicability of a scientific result in an objective and independent way by members of a scientific community is the cornerstone of science. Experimental laser physics is an example of “normal” science, where it is no doubt that the phenomenon could be replicated; however, the replication process (...) may not be straightforward since it requires a good understanding of the physics behind it, as well as good technical skills. In this article, two laboratory cases of experiments on laser physics are presented: the first one deals with a Nitrogen N2 laser with a Polloni excitation circuit, and the second one deals with a transversally excited TEA carbon dioxide laser. For the nitrogen laser, it will be shown that reproducibility failed, and therefore, the reported experiment cannot be taken as a valid contribution to the advancement and understanding of nitrogen laser physics and technology. On the other hand, for the case of the TEA carbon dioxide laser, several comments are presented on the development of this finally successful experiment. Both cases show the importance of being technically up-dated in order to reproduce or improve the results reported by other researchers. Finally, a discussion about: What can we learn about the research practice from these two cases? It is presented, as well as the conclusions about the case studies; we hope they may be useful to philosophers of science and young scientists alike. (shrink)

Still it must (...) be remembered that no one can calculate the depth of a body of water by merely scanning the surface: nor can anyone fully realize the profundity of any situation by viewing it superficially. In other words, it is absolutely necessary that the critic resort to detailed investigation. He must go below the surface to solve the complicated problems which may be presented. Thereby he will acquaint himself with the factors that mould the pattern for the times. Then again, the average human being does or says as he or she sees fit, and can very often furnish justifiable reasons therefor. Everyone reserves for oneself the privileged right of personal opinion and belief. But herein lies a decisive difference. Some people are lovers of the truth, and therefore speak candidly and act openly; others are prone to lose courage and try to hide behind a transparent veil of false modesty. Those, who can be included within this latter category, are only reticent and untrue to themselves, simply because they are in the majority. If the proportion be reversed, they would be more than glad to feel the relief from the pressure removed. But those poor unfortunates, who are forced by their nature and spurred on by their immediate environment to be outspoken, become down-trodden social outcasts. If we ask ourselves why this is so, the answer is: primarily because they are in the minority, as all persecuted classes are. No credit or encouragement is given them for their originality. Knowledge sets the standard for appropriate assertion and recent evidence suggests that it might also set the standard for appropriate belief and decision‐making. Governments spend hundreds of millions of dollars to support the creation, transfer, and mobilization of knowledge. Philosophers have created a dizzying array of Gettier case thought experiments. In doing so, many have been guilty of experimenter bias. This includes some original players who helped set the agenda for decades to come. Cognitive scientists recently began seriously investigating knowledge (...) judgments. The study of Gettier cases was motivated by work in psychology showing important cultural differences in reasoning styles and moral judgments. The nominal category Gettier case includes a variety of cases with radical structural differences that are extremely important in both theory and ordinary practice, so important as to render the nominal category, as the authors have inherited it, utterly useless. It has been argued that it is in the best interests of IT professionals, to adopt and enforce professional codes in the work place. But there is no code for usability engineers, unless one accepts that it is a branch of software engineering. The new joint ACM/IEEE‐CS Software Engineering Code of Ethics is applied to actual usability cases. This enables usability engineers to interpret this code in their profession. This is achieved by utilizing four case studies both directly in (...) terms of the ethical issues involved and in the light of the code. Also examined are the short‐comings of the code for the domain of usability engineering, and suggestions are made for enhancements for future revisions of the code. (shrink)

I began this study with Laudan's argument from the pessimistic induction and I promised to show that the caloric theory of heat cannot be used to support the premisses of the meta-induction on past scientific theories. I tried to show that the laws of experimental calorimetry, adiabatic change and Carnot's theory of the motive power of heat were independent of the assumption that heat is a material substance, approximately true, deducible and accounted for within thermodynamics.I stressed that results and (...) were known to most theorists of the caloric theory and that result was put forward by the founders of the new thermodynamics. In other words, the truth-content of the caloric theory was located, selected carefully, and preserved by the founders of thermodynamics.However, the reader might think that even if I have succeeded in showing that laudan is wrong about the caloric theory, I have not shown how the strategy followed in this paper can be generalised against the pessimistic meta-induction. I think that the general strategy against Laudan's argument suggested in this paper is this: the empirical success of a mature scientific theory suggests that there are respects and degrees in which this theory is true. The difficulty for — and and real challenge to — philosophers of science is to suggest ways in which this truth-content can be located and shown to be preserved — if at all — to subsequent theories. In particular, the empirical success of a theory does not, automatically, suggest that all theoretical terms of the theory refer. On the contrary, judgments of referential success depend on which theoretical claims are well-supported by the evidence. This is a matter of specific investigation. Generally, one would expect that claims about theoretical entities which are not strongly supported by the evidence or turn out to be independent of the evidence at hand, are not compelling. For simply, if the evidence does not make it likely that our beliefs about putative theoretical entities are approximately correct, a belief in those entities would be ill-founded and unjustified. Theoretical extrapolations in science are indespensable, but they are not arbitrary. If the evidence does not warrant them I do not see why someone should commit herself to them. In a sense, the problem with empricist philisophers is not that they demand that theoretical beliefs must be warranted by evidence. Rather, it is that they claim that no evidence can warrant theorretical beliefs. A realist philosopher of science would not disagree on the first, but she has good grounds to deny the second.I argued that claims about theoretical entities which are not strongly supported by the evidence must not be taken as belief-worthy. But can one sustaon the more ambitious view that loosely supported parts of a theory tend to be just those that include non-referring terms? There is an obvious excess risk in such a generalisation. For there are well-known cases in which a theoretical claim was initially weakly supported by the evidence. (shrink)

In the late 19th century, the questionnaire was one means of taking the case study into the multitudes. This article engages with Forrester’s idea of thinking in cases as a means of interrogating questionnaire-based research in early American psychology. Questionnaire research was explicitly framed by psychologists as a practice involving both natural historical and statistical forms of scientific reasoning. At the same time, questionnaire projects failed to successfully enact the latter aspiration in terms of synthesizing masses of collected (...) data into a coherent whole. Difficulties in managing the scores of descriptive information questionnaires generated ensured the continuing presence of individuals in the results of this research, as the individual case was excerpted and discussed alongside a cast of others. As a consequence, questionnaire research embodied an amalgam of case, natural historical, and statistical thinking. Ultimately, large-scale data collection undertaken with questionnaires failed in its aim to construct composite exemplars or ‘types’ of particular kinds of individuals; to produce the singular from the multitudes. South Africa implemented a comprehensive response to COVID-19 comprising of several coercive public health measures. As in many countries, COVID-19 measures were subject to a number of legal challenges on the grounds that these measures infringed on individual rights and liberties. Here, courts were required to assess the extent to which these limitations were justifiable against the state’s imperative to improve public health. Consequently, the acceptability of different justifications of coercive public health measures during the COVID-19 pandemic in South Africa (...) may be understood and assessed through the lens of its jurisprudence. This paper seeks to outline the approach to allowing, or disallowing, coercive public health measures as adopted by the judiciary as arbiters of allowable human rights infringements and thus permitting or prohibiting the state from exercising coercive powers. Specifically, this analysis aims to identify the principles underpinning the decisions with an expressly ethical lens with a view to providing content for the operationalisation of justifications for coercive state action such as the harm principle, reciprocity, least restrictive means in relation to the promotion of public health and the limitation of individual liberty. The concept of circular economy entails the reduction of resource inputs and the reclamation of waste in order to tackle the environmental, economic, and social challenges that sprang from the persistence of the linear economic model. Implementing a circular economy certainly has its own challenges. One of which is to find a sustainable supply chain. Sustainable supply chains are designed and man¬aged by combining practices responsible for the environment and society throughout the life cycle of a product or service. This (...) is possible to achieve through good collaboration between supply chains and having a supply chain design with a sustainable concept. Thus, this research discusses the effect of sustainable supply chain management on circular economy performance mediated by circular economy capability. The objects of this research are 82 courier service companies on Java Island. This research employed quantitative design. The data collection method involved distributing online questionnaires to middle – top managers as respondents. The results show that sustainable supply chain management has a positive effect on environmental performance, then sustainable supply chain management has a positive effect on financial performance. Furthermore, circular economy capability partially mediates the correlation between sustainable supply chain management and environmental performance, and partially mediates the correlation between sustainable supply chain management and financial performance. Even though Dmytro Chyzhevskyi introduced German scientists to Skovoroda’s work back in the 1930s, its actual reception, according to the author, began only in the 1980s. The article analyzes the research of three authors who carry out such a reception today. First, Elizabeth von Erdmann examines Skovoroda’s work in the context of philosophia perennis. Instead, Roland Pietsch began (...) his study of Skovoroda’s work by translating his works into German and later focused on demonstrating the unity of mysticism and metaphysics in Skovoroda’s phi- losophy, according to how this unity was ensured in his doctrine of self-knowledge. Pietsch demonstrated this unity in his interpretation of the Narcissus dialogue. Another essential aspect of Skovoroda’s work, explored by Pietsch, is the philosopher’s symbolic metaphysics. Pietsch’s latest works are devoted to another important issue — establishing Skovoroda’s place in European intel- lectual history, in particular, based on a comparative analysis of the concepts of Hrygorii Skovo- roda, Johann Georg Hamann, and Franz von Baader. Another German researcher who studies Skovoroda’s work today is Slavologist and theologian Günter Kollert, who has been engaged in the philosophy of Skovoroda and Pamfil Yurkevich for several years and has translated the works of Skovoroda and Mykhailo Kovalynskyi into German. The author of the article concludes that new interesting independent studies of Skovoroda’s work will appear in Germany, which will make it possible to more accurately define Skovoroda’s place in the historical-philosophical process, to think more profoundly and describe this process, as well as to pave the way to possible abandonings and comparisons of Ukrainian works thinker with other famous figures in the history of philosophical thought. In the year 308 CE, the African army raised to the purple the agens vices praefectorum praetorio Lucius Domitius Alexander. This rather unique case of a vicarius becoming emperor is deserving of investigation. Scholarly interest on the matter has traditionally focused on the broader political significance, treating Alexander as a traditional usurper. This paper argues that, contrary to traditional studies, the regime of Alexander focused on very local, African tropes. The uniqueness of the advertisement suggests that this African usurpation was (...) the product of discontent internal to Africa; in other words, it is a departure from the usurpations of the third century. The achievements of Diocletian, who supposedly stabilized the Empire, ended when he withdrew, and the rebellion of 308–310 demonstrates that there remained unaddressed tensions between the provinces and the remaining tetrarchs. With the development of office forms, the space form of super high-rise office buildings changed from the unitary efficient office space to a complex space that integrated office, communication, and experience, which also diversified the design of typical floors in the office zone. However, from the perspective of fire prevention, the placement of shared space changed the form of the plane in typical floors in the office zone, affecting the smoke spreading of fire and paths of personnel evacuation. Hence, the (...) subject on the planar relationship among high-rise office buildings based on fire prevention analysis, which optimizes space design, is worthy of discussion. After collecting many cases of super high-rise office buildings in China, this study categorized them into six typical planes and adopted the software PyroSim for comparative simulation of the smoke spreading of fire. By comparing the visibility of different zones in fires, this study analyzed the effects of the area of the office zone, the location of the atrium, and the form of the plane on the fire visibility on the typical floor and put forth the key factors that influence fire visibility, thus optimizing the plane design of the typical floor of super high-rise buildings. The findings show that in the six fire scenes, the area of the office zone is between 1136m2 and 1736m2. The peak of duration for visibility decline at 1.5 m appeared in Scene 3. Its office zone is 1536m2, and the duration of visibility decline is greater than 1000 s. In other fire scenes, the duration of visibility decline is less than 300 s. By comparing the plane arrangement features of the fire scenes, the paper concludes that in a given fire scene, establishing an atrium in the office zone, expanding the length of the adjacent edge between the atrium and the office zone, and building an evacuation corridor between the atrium and the core tube can greatly extend the effective evacuation time. Ethics instructors often use cases to help students understand ethics within a corporate context, but we need to know more about the impact a case-based pedagogy has on students’ ability to make ethical decisions. We used a pre- and post-test methodology to assess the effect of using cases to teach ethics in a finance course. We also wanted to determine whether recent corporate ethics scandals might have impacted students’ perceptions of the importance and prevalence of ethics in business, (...) so we used in-depth case studies of several of the major scandals (e.g., Enron, Tyco, Adelphia). Our results are somewhat surprising since studying ethics scandals positively impacts students’ ethical decision making and their perceptions of the ethics of businesspeople. (shrink)

Although wisdom might be considered a quaint concept in a post-industrialised, instrumental and secular world, it deserves serious consideration. This is done primarily from a philosophical perspective and is intended to encourage the reintroduction of wisdom into educational and developmental programmes, especially for managers and leaders. Mindful of the potential naïvete of transplanting systems of thinking from one epoch to another, we nonetheless examine the relevance of pre-modern thought to the post-modern condition. This is done by radically reinterpreting classical Greek (...) texts as Pierre Hadot has done to derive a meaning of "philosophy" and the place of wisdom in the ancient world. The concepts of wisdom, virtue and enacted ethics derived from this re-interpretation are then applied to an ethnographic case study involving a senior executive. This study suggests that a Stoical "wisdom of the moment" philosophy may characterize contemporary leadership practice. (shrink)

Conceived as a solution to clinical dilemmas, and now required by organizations for hospital accreditation, ethics committees have been subject only to small-scale studies. The wide use of ethics committees and the diverse roles they play compel study. In 1999 the University of Pennsylvania Ethics Committee Research Group (ECRG) completed the first national survey of the presence, composition, and activities of U.S. healthcare ethics committees (HECs). Ethics committees are relatively young, on average seven years in operation. Eighty-six percent of (...) ethics committees report that they play a role in ongoing clinical decision making through clinical ethics consultation. All are engaged in developing institutional clinical policy. Although 4.5% of HECs write policy on managed care, 50% of HEC chairs feel inadequately prepared to address managed care. The power and activity of ethics committees parallels the composition of those committees and the relationship of members to their institutions. The role of ethics committees across the nation in making policies about clinical care is greater than was known, and ethics committees will likely continue to play an important role in the debate and resolution of clinical cases and clinical policies. The purpose of this article is to examine stakeholder identification and prioritization by managers using the power, legitimacy, and urgency framework of Mitchell et al. (Academy of Management Review 22, 853–886; 1997). We use a multi-method, comparative case study of two large-scale sporting event organizing committees, with a particular focus on interviews with managers at three hierarchical levels. We support the positive relationship between number of stakeholder attributes and perceived stakeholder salience. Managers’ hierarchical level and role have direct and (...) moderating effects on stakeholder identification and perceived salience. We also found that most stakeholders were definitive, dominant, or dormant types – the other five types were rare. Power has the most important effect on salience, followed by urgency and legitimacy. Based on our case study, we offer several ways to advance the theory of stakeholder identification and salience. (shrink)

This paper is a contribution to the general study of consequence relations which contain (definable) connective of “disjunction”. Our work is centered around the “proof by cases property”, we present several of its equivalent definitions, and show some interesting applications, namely in constructing axiomatic systems for intersections of logics and recognizing weakly implicative fuzzy logics among the weakly implicative ones.

This study examines the three major Japanese multinational corporate governance cases of the past decade: Sumitomo Copper, Daiwa Bank, and Mitsubishi Motors. The analysis focuses on three particular matters: Does senior management and the board exhibit a form of “disaster myopia”? Were there clear signs of the impending problems that were ignored? Is there anything distinctive that makes these cases Japanese in character? The first two questions are answered in the affirmative for all three firms, but only (...) the Mitsubishi case exhibits a peculiarly Japanese characteristic. (shrink)

Evidence from 45 early studies of resistance to extinction following reinforcement of differing amounts, taken in sum, challenges both the basic and the augmented models of Nevin & Grace. The augmented model seems too ad hoc in salvaging the analogy between persistence in behavior and concepts from physics, as my meta-analysis of these data affirms.

As a final project for a business and society course, students presented analyses of ethical dilemmas in business settings; each dilemma was different, chosen either from the student’s personal business experience or from a recent business news event. Students identified multiple decision criteria (financial, ethical, etc.) relevant to the dilemma and then recommended a decision, reflecting a prioritizing of the multiple decision criteria. The goal of this research was to learn whether personal experience led to different decision priorities. Analyses from (...) 121 students taken from six semesters of the course were sorted by choice of topic, as well as by which decision criterion was given top priority. Results showed significant differences (Chi-square value of 38.50562, significance level of 5.45963E-10) between the personal examples and the news examples. Students typically put ethical concerns first when analyzing news events. However, whenit came to personal events, more self-serving concerns often took priority. These disparate results suggest that even when knowledge is gained from study of theory and cases, it may not be applied to dilemmas that arise in students’ own experiences. (shrink)

This article pursues the hypothesis that there is a structural affinity between the case study as a genre of writing and the question of gendered subjectivity. With John Forrester’s chapter ‘Inventing Gender Identity: The Case of Agnes’ as my starting point, I ask how the case of ‘Agnes’ continues to inform our understanding of different disciplinary approaches (sociological and psychoanalytic) to theorizing gender. I establish a conversation between distinct, psychoanalytically informed feminisms (Simone de Beauvoir, Juliet Mitchell, Judith Butler, and (...) SummaryJohn Herschel was the leading British natural philosopher of the nineteenth century, widely known and regarded for his work in philosophy, optics and chemistry as well as his important research and popular publications on astronomy. To date, however, there exists no extended treatment of his astronomical career. This paper, part of a larger study exploring Herschel's contributions to astronomy, examines his work in the context of positional astronomy, the dominant form of astronomical practice throughout his lifetime. Herschel, who did (...) not himself practice positional astronomy and who was known for his non-meridional observations of specific stellar objects, was nonetheless a strong advocate for positional astronomy—but for very different reasons than the terrestrial applications to which it was most often put. For Herschel, the star catalogues of positional astronomy were the necessary observational foundation upon which information about the stars as physical objects could be constructed. Positional astronomy practiced in the great national observatories was not about navigation or timekeeping; it was a way to standardize stellar observations and make them useful data for constructing theories of the stars themselves. For Herschel, the seeds of the new astronomy emerged from the practices of the old. (shrink)

Critiques of case studies as an epistemic genre usually focus on the domain of justification and hinge on comparisons with statistics and laboratory experiments. In this domain, case studies can be defended by the notion of “infirming”: they use many different bits of evidence, each of which may independently “infirm” the account. Yet their efficacy may be more powerful in the domain of discovery, in which these same different bits of evi- dence must be fully integrated to create an explanatory (...) account with internal validity. This study uses three audit-specific ethical dilemmas to assess the level of ethical reasoning between Chinese accounting students (as proxies for new entrants to the auditing profession) and experienced auditors. A sample of U.S. accounting students is used as a base for comparison. Consistent with expectations based on particularly salient aspects of Chinese national culture, we find the Chinese students’ levels of ethical reasoning to be significantly lower than those of their U.S. counterparts in the two cases that (...) invoked these cultural attributes. In contrast, the Chinese students’ level of ethical reasoning is slightly higher than that of the U.S. students in the third, control case. We further find that the Chinese auditors’ levels of ethical reasoning are even lower than those of the Chinese students in two cases, while not being significantly different in the third. Together, these findings suggest that cross-national differences in auditors’ ethical reasoning depend on the nature of the ethical dilemma and caution against wholesale inferences about ethical reasoning levels in China.
