This paper argues that we have wrongly and not for the patient’s benefit made a form of stark autonomy our highest value which allows physicians to slip out from under their basic duty which has always been to pursue a particular patient’s good. In general – I shall argue – it is the patient’s right to select his or her own goals and the physician’s duty to inform the patient of the feasibility of that goal and of the means needed (...) to attain it. If the goal is not one that is possible, the patient, with the physician and family, must select a feasible goal and then discuss the costs/benefits of various approaches. The physician should take a leading role in helping the patient select the goal. I argue that to simply present a laundry list of means and insist that patients choose for themselves is not only abandoning patients to their autonomy but is, in fact, a crass form of violating the patient’s autonomy. Freely choosing not to choose is a choice a patient with decisional capacity is entitled to make and one that needs to be respected. (shrink)

In this paper, we study on the ways the Intergovernmental Panel on Climate Change communicates scientific knowledge on climate change to policymakers in the Summary for Policymakers of the Fifth Assessment Report ; the most recent Assessment Report issued by the IPCC. We investigate implicit argumentation with a special focus on the ways the summary may direct the orientation of the discourse towards the evasion of climate action while appearing to be pro-action on the surface. The results of a (...) systematic analysis of polyphonic constructions in the language of the text indicate that implicit argumentation represents climate action inevitably subordinate to economic goals. In a number of constructions, the discourse reconstructs pro-economic-growth-based frames in contrast to prioritising environmental values when encouraging political action in the context of climate change. Through such language use, the discourses mediated by an institution of such high societal importance and authority as the IPCC arguably have a considerable impact in maintaining conservative climate policies and delaying, even hindering, a transition into a carbon-neutral society. Thus, we conclude that even the most authoritative climate-science-policy institutions should reconsider their use of linguistic representations in terms of implicit argumentation in their communication in order to encourage climate action in a more straightforward manner. As long as the most authoritative actors in science-policy discourse on climate change continue to reinforce cognitive frames evading urgent action to mitigate climate change, it is questionable whether we can expect the policymakers to have the courage to take ambitious action even if the figures in the natural-scientific evidence sections of the reports were demonstrating clear worsening trends. Dodging questions pervades human interaction, including interpersonal interactions, relational conversations, media interviews and political debates. Variously referred to as equivocation, evasion, obfuscation, strategic ambiguity and topic avoidance, among other terms, the concept has a rich history in the communication literature. Covertly dodging questions presents serious social and political problems. This essay focuses on theoretical issues of dodging, specifically the ability for a person to change the subject with an irrelevant answer. Discussion primarily draws upon Grice’s theory of conversational implicature (...) and deception research inspired by Grice. Theoretical impediments to detecting dodges are discussed, as well as barriers to accuracy from the perspective of discourse analysts and societal perceptions. (shrink)

The social function of jazz in its theoretical aspects is the subject of the present article. The author opens his discussion with a technical analysis of jazz music, on the basis of which the social significance of jazz phenomena is elucidated.The peculiar effects of jazz music are by no means limited to the upper layers of society ; they permeate the whole of society. The music has a pseudo-democratic quality, characteristic of the monopolistic phase of capitalism.Jazz music is usually trite, (...) and its orginality, however limited, manifests itself chiefly in the variations of forms in which it is reproduced*The realm of jazz ranges from „salon music“ to the military march* The former expresses a false individualism ; the latter a false collectivism. The Jazz represents a sort of conduit between these two poles, particularly in its form of „hot music“. A theory of jazz will have to dwell especially on this ambivalence. Its meaning is explained by an analogy to eccentric clowns whose inability to obey the norm of regular movement reveals itself finally as a superiority over these rules, which allows the eccentric to play with them. Thus the idea of jazz is to prove that divergence from the norm is observed as a rule throughout the total structure.The pattern of this breaking and observing of the rule at the same time is the syncope. The mechanism of its function is interpreted as a kind of unconscious and paradoxical unity of fear and fulfillment, through obedience and reward by society. The antagonistic character of jazz is expressed by the formula that the „subject of jazz“ permits itself to be annihilated by society in order to feel itself endorsed and vindicated by society.L'article présente certains éléments d'une théorie sociale du Jazz* Il utilise en particulier l'analyse technique, dont les résultats sont interprétés comme expression psychologique de réalités sociales. Le Jazz est défini „phénomène d'interférence“ entre une liberté d'improvisation du sujet, liberté tout apparente, et l'instance sociale à laquelle le sujet est soumis et qui est représenté dans la musique par le rythme et le son fondamentaux rigidement maintenus. Le Jazz lui-même n'est pas irrationnel ou archaïque, il est donné comme tel, il est „fuite du monde des marchandises dans le monde des marchandises“ ; ses traits archaïques sont en tant que tels modernes, c'est-à-dire des régressions psychologiques. C'est pourquoi, précisément en tant que marchandise, il doit se donner à la fois pour ancien et nouveau, original et banal.A l'origine, le produit est banal, originales sont, dans des limites très étroites, les transformations de celui-ci par la reproduction. Mais l'apparente liberté de la reproduction est démasquée par la démonstration qu'elle ne touche pas à la „substance“ banale. Même la rationalisation, en apparence progressive, du processus du travail entre production et reproduction ne correspond pas à la réalité. Particulièrement importante, sur ce point,, est la signification de l'amateur comme représentant du public. Au pôle opposé on trouve la musique d'art d'hier, dépravée et dépouillée de ses éléments progressifs : celle de l'impressionnisme.L'extension du Jazz est limitée par les pôles extrêmes de la musique de salon d'une part, et de la marche d'autre part, celle-là expression d'une illusoire subjectivité, celle-ci expression d'une instance sociale inhumaine. Entre ces extrêmes la „Hot Musique“ prend une position intermédiaire paradoxale et elle s’est stabilisée aujourd’hui en „Jazz classique“. C’est celui-ci que doit considérer en premier lieu la théorie du Jazz. Celle-ci est rapprochée de la figure de 1’ „excentrique“ : de même que l’incapacité de celui-ci d’obéir aux lois du mouvement s’affirme comme un jeu supérieur, ainsi l’idée du Jazz est de démontrer la rupture de la norme — la syncope — à travers toute la structure comme l’achèvement de la norme même. Le mécanisme qui agit dans ce cas, comme dans celui des „steeps“ ralentis (Gehtanz) est de nature érotique : unité d’angoisse, de tentative d’évasion, et d’assouvissement par le fait de trouver dans la société à la fois place et récompense. This essay introduces the novel category of “disclaimers” – distinctive normative acts which challenge third-party attributions of responsibility in a community governed by norms of mutual accountability. While the debate focuses on evasive and wrongful refusals to take responsibility for one’s wrongs, this essay argues that disclaimers are fundamental modes of exercising normative powers, whose main functions are demanding recognition, responding to wrongs, voicing disagreement, exiting alienating conditions, and calling for a fair redistribution of specific responsibilities. In particular, understood as (...) disclaimers, denials of responsibility are shown to be key modes of ethical and political empowerment, which play a significant role in producing normative changes and directing societal transformations. Pour y parvenir l’auteur propose que l’Etat autorise les protocoles de chiffrement, lutte contre l’évasion fiscale des entreprises de données, leurs serveurs devant eux-mêmes être localisés en France ou en Europe.

Deux classiques de l’un des plus importants précurseurs de l’écologie politique au Québec réunis en seul volume! Dans L’écosophie ou la sagesse de la nature, Serge Mongeau nous invite, à partir de ses propres expériences, à une profonde réflexion sur une éthique écologique. Au lieu de voir la nature comme extérieure à nous, comme un réservoir de ressources, il faut l’envisager comme un processus de vie dans lequel nous avons un rôle à jouer. C’est donc un autre mode de relation (...) qu’il faut développer et ce sont les voies pour y arriver qu’explore ce texte dans lequel l’auteur préconise un respect sans idolâtrie de la nature et propose un certain nombre de balises pour que s’établisse une véritable symbiose entre la Terre vivante et les êtres humains. Dans La belle vie, Serge Mongeau s’interroge. Tous souhaitent faire « la belle vie », tous veulent être heureux, tous cherchent le bonheur. Mais... prend-on les bons moyens pour y arriver? Quel pourrait être notre rapport au plaisir et au désir, émancipé du besoin de possession? La société de consommation offre de multiples biens à acquérir, une foule de services et une grande variété de moyens d’évasion. Cependant, bien des gens découvrent aujourd’hui qu’on ne peut tout attendre de la consommation, que la voie de la simplicité volontaire leur ouvre des portes vers un plus grand épanouissement, mais aussi qu’il ne suffit pas de simplifier sa vie pour trouver le bonheur. C’est donc à une réflexion plus globale que l’auteur a voulu donner accès en écrivant ce texte d’une grande beauté. Serge Mongeau esquisse divers chemins pour trouver le bonheur : vivre le moment présent, aimer, prendre le temps de vivre, jouer, se rapprocher de la nature, donner un sens à sa vie, simplifier sa vie, cultiver sa vie intérieure et s’investir dans des actions significatives pour changer ce qui n’est plus acceptable. Quand je relis aujourd’hui La belle vie et L’écosophie ou la sagesse de la nature, je constate qu’ils demeurent d’une actualité étonnante. Il ne s’agit pas là d’un constat réjouissant ; nous écrivons, nous constatons, nous suggérons des voies d’action et, vingt ans plus tard, nous voyons que nous avons été si peu écoutés. Tristan Murail est, avec Gérard Grisey, un des deux grands représentants de ce qu'il est convenu d'appeler la "musique spectrale". L'expression indique une référence constante à la structure microscopique des spectres sonores : c'est la vie intérieure des sons, avec leur harmonicité ou inharmonicité, leurs transitoires d'attaque ou d'extinction, qui constitue chez Murail le modèle par excellence pour construire des formes musicales. Cet ouvrage - le premier entièrement consacré à l'œuvre de Murail - évoque sa situation esthétique face à d'autres (...) courants de la musique d'après 1945. Un long entretien donne la parole au compositeur, pour retracer un parcours qui l'a mené de Messiaen à Scelsi et au-delà, ainsi qu'au pédagogue (Murail enseigne depuis plusieurs années aux Etats-Unis). Une analyse approfondie de l'une de ses pièces marquantes, L'Esprit des dunes, permet d'entrer dans son atelier, de suivre le processus de création qui conduit de l'analyse des sons à l'invention des formes. Enfin, Tristan Murail lui-même revient en détail sur chacune de ses œuvres, nous livrant son regard rétrospectif en un document précieux. (shrink)

Marcel Beaufils fut un pedagogue exceptionnel qui exerca une influence decisive sur l'evolution de l'esthetique musicale en France, a partir des annees 50. Or, parmi ses ouvrages, Musique du son, musique du verbe est tres certainement celui qui porte le plus fortement la marque de son activite d'enseignant au Conservatoire National Superieur de Musique de Paris ; cette mission, il semblait l'entendre davantage comme celle d'un declencheur d'idees, catalyseur, plutot que du transmetteur d'un savoir fige une fois pour toutes. Bouleversant (...) toute tentative de classification academique, toute certitude acquise, ce livre laisse des pointilles ; un grand souffle traverse son ecriture. N'en deplaise aux musicographes, il s'agit la d'un ouvrage de creation, qui nous rappelle que Marce Beaufils etait egalement un ecrivain qui savait manier le verbe a la fois en tant que dramaturge et en tant que poete. Firms are central to wealth creation and distribution, but their role in economic inequality in a society remains poorly studied. In this essay, we define and distinguish value distribution from value creation and value appropriation. We identify four value distribution mechanisms that firms engage in and argue that shareholder wealth maximization approach skews the value distribution toward shareholders and top executives, which in turn contributes to rising economic inequalities around the world. We call on organizational scholars to study the value (...) distribution role of firms and its consequences for society, and introduce the articles in this volume of the special issue on economic inequality, business, and society. Since the outbreak of the Coronavirus disease 2019 (Covid-19), tremendous efforts have been made by scientists, health professionals, business people, politicians, and laypeople around the world. Covid-19 vaccines are one of the most crucial innovations that help fight against the virus. This paper attempts to revisit the Covid-19 vaccines production process by employing the serendipity-mindsponge-3D creativity management theory. Vaccine production can be considered an information process and classified into three main stages. The first stage involved the processes of absorbing information (...) (e.g., digital data and open science) and rejecting unhelpful information (e.g., misinformation and fake news) for effectively acquiring useful insights. Useful insights were later employed by experts, enterprises, governments, and international organizations through interdisciplinary coordinated efforts for developing vaccines within a short period. Finally, the appearance of multiple types of vaccines enabled more strategic options for vaccine distribution and administration. Findings from this vaccine creativity management process could be used as critical lessons for further improvements of vaccination programs. (shrink)

Why is it so plausible that business organisations in contemporary society use values in their communication? In order to answer this question, a sociological, system theoretical approach is applied which approaches values not pre-empirically as invisible drivers for action but as observable semantics that form organisational behaviour. In terms of empirical material, it will be shown that business organisations resort to a communication of values whenever uncertainty or complexity is very high. Inevitably, value semantics are applied in organisations first when (...) the speakers are uncertain about which stakeholders to whom they have to address or when different stakeholder groups have to be addressed simultaneously ; second, when the identity of the organisation has to be described; and third, when future strategic options that cannot be expressed by quantitative terms have to be communicated. Values accordingly play a role in organisational practice when certain aspects are indeterminate. Therefore, they are a means for organisations to communicate under fuzzy circumstances. On the basis of these findings, new approaches to value management can now be formulated. (shrink)

Although information and communication technologies have created hope for a shared pluralistic world, democratic principles are far from being respected in the public digital environment, and require a detailed knowledge of the laws by which they are governed. Von Foerster's conjecture is one of the early theoretical results that could help to understand these laws. Although neglected for a long time, the advent of the overlying layer of recommendation and ranking systems which is progressively occupying the web has given empirical (...) evidences of this conjecture, which predicts the consequences of increasing inter-individual influences on social dynamics and the susceptibility of these latter to manipulation. With both von Foerster's conjecture and the Snowden revelations in the background, we analyse the impact of ICT on human societies and their governance, in view of the fact that they have a massive impact on the way in which people influence each other in their tastes and actions. Continuous deep sedation at the end of life is a practice that has been the topic of considerable ethical debate, for example surrounding its perceived similarity or dissimilarity with physician-assisted dying...

Deaths of Despair (DoD), or mortality resulting from suicide, drug overdose, and alcohol-related liver disease, have been rising steadily in the United States over the last several decades. In 2020, a record 186,763 annual despair-related deaths were documented, contributing to the longest sustained decline in US life expectancy since 1915–1918. This forum feature considers how health humanities disciplines might fruitfully engage with this era-defining public health catastrophe and help society better understand and respond to the crisis.

Business Ethics: A European Review, EarlyView.

The question of whether individuals retain interests or can be harmed after death is highly contentious, particularly within the context of deceased organ retrieval, retention and use. This paper argues that posthumous interests and/or harms can and do exist in the Konkomba traditional setting through the concept of ancestorship, a reputational concept of immense cultural and existential significance in this setting. I adopt Joel Feinberg’s account of harms as a setback to interests. The paper argues that a socio-culturally sensitive regulatory (...) framework does not necessarily exclude the donation of human biomaterials for transplant and science research. Indeed, when customary values are explored with open-mindedness and sensitivity it may be shown that such donation can form part of the important customs of some communities in this jurisdiction. Accordingly, a context-appropriate governance framework could utilise the cultural value of ancestorship as an incentive to encourage organ donation in the Ghanaian traditional setting. (shrink)

Hans van Maanen is professor of art and society at the Department of Arts, Culture & Media Studies of the University of Groningen, the Netherlands.

Beginning with an exemplary case study, this paper diagnoses and analyses some important strategies of evasion and factors of hindrance that are met in the teaching of medical ethics to undergraduate medical students. Some of these inhibitions are inherent to ethical theories; others are connected with the nature of medicine or cultural trends. It is argued that in order to avoid an attitude of evasion in medical ethics teaching, a philosophical theory of emotions is needed that is able (...) to clarify on a conceptual level the ethical importance of emotions. An approach is proposed with the help of the emotion theory Martha Nussbaum works out in her book Upheavals of thought. The paper ends with some practical recommendations. (shrink)

A sex difference in the tendency to outbreed (female exogamy) is a premise for the target article's proposed framework, which receives some support by being shared with chimpanzees but not with more distantly related primates. Further empirical support is provided, and it is suggested that recognition of sex differences might improve effective fairness, taking sexual assault as a case in point.

The crisis resilience of vital social systems is currently the target of constant development efforts in Finland, as their drifting into crisis would weaken societies’ functional abilities, safety, and security. This is also the case regarding the Finnish health care system. In an attempt to move beyond existing frameworks of crisis imagination, this article takes an unconventional stance by elucidating endogenous crisis dynamics present in the Finnish health care system. Delphi process was conducted for top experts in Finnish health care (...) and crisis management. With a dissensus-seeking orientation, our aim was to fertilize disagreements among panelists to reveal key vulnerabilities in the health system. Despite our efforts to evoke dissensus, the panelists ended up generating a consensus that aims to protect the underlying assumptions of the health system’s knowledge structure. Through inductive analysis of expert discourses, the data was analyzed through our research question “what constitutes a crisis-proof health system and a crisis-prone health system”. What is framed as a strength of the system by our panelists, namely the ability to maintain legitimacy, improve efficiency, and guarantee continuity, can still have questionable implications that are left ungrasped. A system’s theory approach illustrates how such effects can develop and escalate beyond the reach of social interventions, and thus be predisposed to cause objectionable yet concealed social crises. The discussion illustrates how these endogenous crisis dynamics could be seen to materialize in real-life cases. (shrink)
