The topics covered include legal theory, responsibility, and enforcement of morals, with contributions from Ronald Dworkin, Rolf Sartorius, Neil MacCormach, David Lyons, Kent Greenawalt, Michael Moore, Joseph Raz, and C.L. Ten, among others.

This classic collection of essays, first published in 1968, represents H.L.A. Hart's landmark contribution to the philosophy of criminal responsibility and punishment. Unavailable for ten years, this new edition reproduces the original text, adding a new critical introduction by John Gardner, a leading contemporary criminal law theorist.

This incisive book deals with the use of the criminal law to enforce morality, in particular sexual morality, a subject of particular interest and importance since the publication of the Wolfenden Report in 1957. Professor Hart first considers John Stuart Mill's famous declaration: "The only purpose for which power can be rightfully exercised over any member of a civilized community is to prevent harm to others." During the last hundred years this doctrine has twice been sharply challenged by two (...) great lawyers: Sir James Fitzjames Stephen, the great Victorian judge and historian of the common law, and Lord Devlin, who both argue that the use of the criminal law to enforce morality is justified. The author examines their arguments in some detail, and sets out to demonstrate that they fail to recognize distinction of vital importance for legal and political theory, and that they espouse a conception of the function of legal punishment that few would now share. In this field questions arise which are certainly difficult; but as I listened last time to members of the group, I felt that the main difficulty perhaps lay in determining precisely what questions we are trying to answer. I have the conviction that if we could only say clearly what the questions are, the answers to them might not appear so elusive. So I have begun with a simple list of questions about discretion which in one form or another were, (...) as it seemed to me, expressed by the group last time. I may indeed have omitted something and inserted something useless: if so, no doubt I shall be informed of this later. The central questions then seem to me to be the following: 1. What is discretion, or what is the exercise of discretion? 2. Under what conditions and why do we in fact accept or tolerate discretion in a legal system? 3. Must we accept discretion or tolerate discretion, and if so, why? 4. What values does the use of discretion menace, and what values does it maintain or promote? 5. In the two related works in this volume, Bentham offers a detailed critique of William Blackstone's Commentaries on the Laws of England. He provides important refelctions on the nature of law, and more particularly on the nature of customary and statute law, and on judicial interpretation.

Hart said that analytical jurisprudence is descriptive and general but did not draw an explicit distinction between conceptual questions that are in the main theoretical and others that are in the main practical. In Hart’s account, analytical jurisprudence searches for some kind of clarity about the idea of law and the other basic legal ideas as they occur in our ordinary experience. In the Postscript he explains that jurisprudence is the ‘theoretical or scientific study of law as a (...) social phenomenon’, which may, on occasion, but typically does not, rely on moral deliberation. It is to be contrasted to ‘practical’ questions as to how to live one’s life. I shall call this view ‘descriptivism’. It has been a very influential position in analytical jurisprudence and it is being defended by Hart’s followers even today. In this essay I raise some doubts about its coherence. First, I do not think Hart defended this view consistently —even though he did so in the Postscript. Second, I do not think that the position has been adequately defended, either by Hart or by his followers. There is still a great deal of ambiguity as to the precise position of jurisprudence between theoretical and practical reason.Resumen:Hart sostuvo que la jurisprudencia analítica es descriptiva y general pero no elaboró una distinción explícita entre las preguntas conceptuales que son principalmente teóricas y otras que son principalmente prácticas. En la explicación de Hart, la jurisprudencia analítica busca cierto tipo de claridad acerca de la noción de derecho y las demás ideas básicas tal cual ellas ocurren en nuestra experiencia ordinaria. En el Post Scriptum, él explica que la jurisprudencia es el ‘estudio teórico o científico del derecho como un fenómeno social’, el cual puede, en ocasiones, basarse en la deliberación moral, pero típicamente no lo hace. Esto puede contrastarse con las preguntas “prácticas” acerca de como las personas dirigen su propia vida. Llamo esta tesis “descriptivismo”. Esta ha sido una posición muy influyente en la jurisprudencia analítica y ha sido defendida por los seguidores de Hart hasta hoy. En este ensayo despierto dudas sobre su coherencia. Primero, no creo que Hart defendiera esta tesis de forma consistente. Segundo, no creo que la posición haya sido defendida de forma adecuada, ni por Hart ni por sus seguidores. Problema de investigación abordado en esta tesis de grado, fue el de explorar el alcance que tendría la conexión entre la tesis de la regla de reconocimiento y la tesis de los contenidos mínimos de derechos natural en la teoría de H.L.A. Hart. Se indaga a partir de las referencias directas y no directas, la contextualización histórica con escuelas o tendencias activas en el período de elaboración de "El Concepto de Derecho". para identificar los puntos relevantes que permiten desarrollar (...) los enlaces que inicialmente se plantean. Alcance para entender el trabajo maduro de Hart sin olvidar que ya en obras anteriores surgen las aproximaciones a la pragmática del lenguaje y el lugar que asigna a las "reglas prácticas" del derecho en el contexto social. Se culmina apoyada la argumentación en algunas tesis de J Raz en en caracter constitutivo de la regla de reconocimiento y por lo tanto, en su naturaleza de regla primaria y no secundaria como es ubicada por Hart en la obra mencionada. In this essay I argue that in some sense legal philosophy, at least as the term is now understood among analytic jurisprudents in the Anglophone world, is to a large extent a creation of H. L. A. Hart’s work. It is with him that the search for the concept or the nature of law was one established as an independent object of inquiry, that consciously tried to avoid moral or political questions. In framing the province of jurisprudence in this (...) way Hart not only departed from the work of Thomas Hobbes and Jeremy Bentham, whose political commitments are clear, but also from the seemingly much closer enterprise of John Austin. After demonstrating this difference between Austin’s enterprise and Hart’s, I criticize the direction legal philosophy has taken following Hart’s lead.Resumen:En este ensayo se plantea la idea de que en cierto modo la filosofía del derecho —al menos en la forma en que es entendida entre los filósofos analíticos del mundo angloparlante— es en gran medida una invención de H. L. A. Hart. Con la obra de Hart, en efecto, la búsqueda del concepto o naturaleza del derecho, se ha consolidado como un objeto de investigación independiente, que conscientemente pretende deslindarse de las cuestiones políticas o morales. Al definir el campo de estudio de la filosofía del derecho en este sentido, Hart no sólo se aparta del trabajo de Thomas Hobbes y de Jeremy Bentham, cuyos compromisos políticos son evidentes, sino también del proyecto aparentemente más cercano de John Austin. H. L. A. Hart and the "Open Texture" of Language tries to clarify the writings of both Hart and Friedrich Waismann on "open texture". In Waismann's work, "open texture" referred to the potential vagueness of words under extreme (hypothetical) circumstances. Hart's use of the term was quite different, and his work has been misunderstood because those differences were underestimated. Hart should not be read as basing his argument for judicial discretion on the nature of language; primarily, (...) he was putting forward a policy argument for why rules should be applied in a way which would require that discretion. En este trabajo se ofrece un bosquejo biográfico de H. L. A. Hart así como una reconstrucción del contexto cultural y filosófico en el que forjó su pensamiento. En la primera parte se proporcionan los datos más relevantes de su biografía, entre los que destaca su participación en los servicios de inteligencia durante la Segunda Guerra Mundial. Posteriormente, el trabajo incursiona en el panorama filosófico británico de principios del siglo XX, durante la llamada revuelta anti-idealista, que es donde se (...) ubican los orígenes de la moderna filosofía analítica. Es allí donde encontramos los antecedentes del método filosófico de Hart; concretamente, en la corriente de la filosofía del lenguaje ordinario encabezada por J. L. Austin.
