Although fallacies have been common since Aristotle, until recently little attention has been devoted to identifying and defining them. Furthermore, the concept of fallacy itself has lacked a sufficiently clear meaning to make it a useful tool for evaluating arguments. Douglas Walton takes a new analytical look at the concept of fallacy and presents an up-to-date analysis of its usefulness for argumentation studies. Walton uses case studies illustrating familiar arguments and tricky deceptions in everyday conversation where the charge of fallaciousness (...) is at issue. The numerous case studies show in concrete terms many practical aspects of how to use textual evidence to identify and analyze fallacies and to evaluate arguments as fallacious. Walton looks at how an argument is used in the context of conversation. He defines a fallacy as a conversational move, or sequence of moves, that is supposed to be an argument that contributes to the purpose of the conversation but in reality interferes with it. The view is a pragmatic one, based on the assumption that when people argue, they do so in a context of dialogue, a conventionalized normative framework that is goal-directed. Such a contextual framework is shown to be crucial in determining whether an argument has been used correctly. Walton also shows how examples of fallacies given in the logic textbooks characteristically turn out to be variants of reasonable, even if defeasible or questionable arguments, based on presumptive reasoning. This is the essence of the evaluation problem. A key thesis of the book, which must not be taken for granted as previous textbooks have so often done, is that you can spot a fallacy from how it was used in a context of dialogue. This is an innovative and even, as Walton notes, "a radical and controversial" theory of fallacy. (shrink)

This paper compares two alternative explanations of pragmatic encroachment on knowledge (i.e., the claim that whether an agent knows that p can depend on pragmatic factors). After reviewing the evidence for such pragmatic encroachment, we ask how it is best explained, assuming it obtains. Several authors have recently argued that the best explanation is provided by a particular account of belief, which we call pragmatic credal reductivism. On this view, what it is for an agent to (...) believe a proposition is for her credence in this proposition to be above a certain threshold, a threshold that varies depending on pragmatic factors. We show that while this account of belief can provide an elegant explanation of pragmatic encroachment on knowledge, it is not alone in doing so, for an alternative account of belief, which we call the reasoning disposition account, can do so as well. And the latter account, we argue, is far more plausible than pragmatic credal reductivism, since it accords far better with a number of claims about belief that are very hard to deny. (shrink)

Among philosophers, there are at least two prevalent views about the core concept of intentional action. View I (Adams 1986, 1997; McCann 1986) holds that an agent S intentionally does an action A only if S intends to do A. View II (Bratman 1987; Harman 1976; and Mele 1992) holds that there are cases where S intentionally does A without intending to do A, as long as doing A is foreseen and S is willing to accept A as a consequence (...) of S’s action. Joshua Knobe (2003a) presents intriguing data that may be taken to support the second view.1 Knobe’s data show an asymmetry in folk judgements. People are more inclined to judge that S did A intentionally, even when not intended, if A was perceived as causing a harm (e.g. harming the environment). There is an asymmetry because people are not inclined to see S’s action as intentional, when not intended, if A is perceived as causing a benefit (e.g. helping the environment). In this paper we will discuss Knobe’s results in detail. We will raise the question of whether his ordinary language surveys of folk judgments have accessed core concepts of intentional action. We suspect that instead Knobe’s surveys are tapping into pragmatic aspects of intentional language and its role in moral praise and blame. We will suggest alternative surveys that we plan to conduct to get at this difference, and we will attempt to explain the pragmatic usage of intentional language. (shrink)

Several authors have recently endorsed the thesis that there is what has been called pragmatic encroachment on knowledge—in other words, that two people who are in the same situation with respect to truth-related factors may differ in whether they know something, due to a difference in their practical circumstances. This paper aims not to defend this thesis, but to explore how it could be true. What I aim to do, is to show how practical factors could play a role (...) in defeating knowledge by defeating epistemic rationality—the very kind of rationality that is entailed by knowledge, and in which Pascalian considerations do not play any role—even though epistemic rationality consists in having adequate evidence. Clinicians have good moral and professional reasons to contribute to pragmatic clinical trials (PCTs). We argue that clinicians have a defeasible duty to participate in this research that takes place in usual care settings and does not involve substantive deviation from their ordinary care practices. However, a variety of countervailing reasons may excuse clinicians from this duty in particular cases. Yet because there is a moral default in favor of participating, clinicians who wish to opt out of this research (...) must justify their refusal. Reasons to refuse include that the trial is badly designed in some way, that the trial activities will violate the clinician’s conscience, or that the trial will impose excessive burdens on the clinician. It is a truism that people speak ‘loosely’——that is, that they often say things that we can recognize not to be true, but which come close enough to the truth for practical purposes. Certain expressions. such as those including ‘exactly’, ‘all’ and ‘perfectly’, appear to serve as signals of the intended degree of approximation to the truth. This article presents a novel formalism for representing the notion of approximation to the truth, and analyzes the meanings of these expressions in terms (...) of this formalism. We argue, contrary to epistemological orthodoxy, that knowledge is not purely epistemic—that knowledge is not simply a matter of truth‐related factors (evidence, reliability, etc.). We do this by arguing for a pragmatic condition on knowledge, KA: if a subject knows that p, then she is rational to act as if p. KA, together with fallibilism, entails that knowledge is not purely epistemic. We support KA by appealing to the role of knowledge‐citations in defending and criticizing actions, and by giving (...) a principled argument for KA, based on the inference rule KB: if a subject knows that A is the best thing she can do, she is rational to do A. In the second half of the paper, we consider and reject the two most promising objections to our case for KA, one based on the Gricean notion of conversational implicature and the other based on a contextualist maneuver. Beatty, Brandon, and Sober agree that biological generalizations, when contingent, do not qualify as laws. Their conclusion follows from a normative definition of law inherited from the Logical Empiricists. I suggest two additional approaches: paradigmatic and pragmatic. Only the pragmatic represents varying kinds and degrees of contingency and exposes the multiple relationships found among scientific generalizations. It emphasizes the function of laws in grounding expectation and promotes the evaluation of generalizations along continua of ontological and representational parameters. Stability (...) of conditions and strength of determination in nature govern projectibility. Accuracy, ontological level, simplicity, and manageability provide additional measures of usefulness. In this contribution the prototypical argumentative patterns are discussed in which pragmatic argumentation is used in the context of legal justification in hard cases. First, the function and implementation of pragmatic argumentation in prototypical argumentative patterns in legal justification are addressed. The dialectical function of the different parts of the complex argumentation are explained by characterizing them as argumentative moves that are put forward in reaction to certain forms of critique. Then, on the basis of an exemplary case, (...) the famous Holy Trinity case, the way in which the U.S. Supreme Court uses pragmatic argumentation in this case is discussed by showing how the court instantiates general prototypical argumentative patterns in light of the institutional preconditions of the justification in the context of the specific case. Citing some recent experimental findings, I argue for the surprising claim that in some cases the less time you have the more you know. More specifically, I present some evidence to suggest that our ordinary knowledge ascriptions are sometimes sensitive to facts about an epistemic subject's truth-irrelevant time constraints such that less is more. If knowledge ascriptions are sensitive in this manner, then this is some evidence of pragmatic encroachment. Along the way, I consider comments made by Jonathan Schaffer (...) and Jennifer Nagel to construe a purist contextualist and a strict invariantist explanation of the data respectively, before giving reasons to resist them in favor of an account that indicates pragmatic encroachment. If successful, this may suggest a new way to argue for the controversial thesis that there is pragmatic encroachment on knowledge. (shrink)

Evidentialism is the view that facts about whether or not an agent is justified in having a particular belief are entirely determined by facts about the agent’s evidence; the agent’s practical needs and interests are irrelevant. I examine an array of arguments against evidentialism (by Jeremy Fantl, Matthew McGrath, David Owens, and others), and demonstrate how their force is affected when we take into account the relation between degrees of belief and outright belief. Once we are sensitive to one of (...) the factors that secure thresholds for outright believing (namely, outright believing that p in a given circumstance requires, at the minimum, that one’s degree of belief that p is high enough for one to be willing to act as if p in the circumstances), we see how pragmatic considerations can be relevant to facts about whether or not an agent is justified in believing that p—but largely as a consequence of the pragmatic constraints on outright believing. Clear statements of both extended and enactive conceptions of cognition can be found in John Dewey and other pragmatists. In this paper I'll argue that we can find resources in the pragmatists to address two ongoing debates: in contrast to recent disagreements between proponents of extended vs enactive cognition, pragmatism supports a more integrative view—an enactive conception of extended cognition, and pragmatist views suggest ways to answer the main objections raised against extended and enactive conceptions—specifically objections focused on constitution versus (...) causal factors, and the mark of the mental. This article explores the relationship between pragmatic encroachment and epistemic permissiveness. If the suggestion that all epistemic notions are interest-relative is viable , then it seems that a certain species of epistemic permissivism must be viable as well. For, if all epistemic notions are interest relative then, sometimes, parties in paradigmatic cases of shared evidence can be maximally rational in forming competing basic doxastic attitudes towards the same proposition. However, I argue that this total pragmatic encroachment is not (...) tenable, and, thus, epistemic permissivism cannot be vindicated in this way. (shrink)

Purists think that changes in our practical interests can’t affect what we know unless those changes are truth-relevant with respect to the propositions in question. Impurists disagree. They think changes in our practical interests can affect what we know even if those changes aren’t truth-relevant with respect to the propositions in question. I argue that impurists are right, but for the wrong reasons, since they haven’t appreciated the best argument for their own view. Together with “Minimalism and the Limits of (...) Warranted Assertability Maneuvers,” “The Pragmatic Encroachment Debate,” and “Anti-Intellectualism” (below), this paper constitutes my attempt to refute the entire pragmatic encroachment debate. As I show in this paper, there is an argument for impurism sitting in plain sight that is considerably more plausible than any extant argument for pragmatism. (shrink)

Self-deception is typically considered epistemically irrational, for it involves holding certain doxastic attitudes against strong counter-evidence. Pragmatic encroachment about epistemic rationality says that whether it is epistemically rational to believe, withhold belief or disbelieve something can depend on perceived practical factors of one’s situation. In this paper I argue that some cases of self-deception satisfy what pragmatic encroachment considers sufficient conditions for epistemic rationality. As a result, we face the following dilemma: either we revise the received view about (...) self-deception or we deny pragmatic encroachment on epistemic rationality. I suggest that the dilemma can be solved if we pay close attention to the distinction between ideal and bounded rationality. I argue that the problematic cases fail to meet standards of ideal rationality but exemplify bounded rationality. The solution preserves pragmatic encroachment on bounded rationality, but denies it on ideal rationality. (shrink)

This paper offers a novel conversational implicature account of the pragmatic sensitivity of knowledge attributions. Developing an account I first suggested elsewhere and independently proposed by Lutz, this paper explores the idea that the relevant implicatures are generated by a constitutive relationship between believing a proposition and a disposition to treat that proposition as true in practical deliberation. I argue that while this view has a certain advantage over standard implicature accounts of pragmatic sensitivity, it comes with a (...) significant concession to proponents of pragmatic encroachment. On the account offered here, knowledge attributions have locally-pragmatically-sensitive implicatures because they have non-locally-pragmatically-sensitive entailments. The view thus represents a unique and powerful hybrid of these two approaches to the pragmatic sensitivity of knowledge attributions. (shrink)

How do we justify the normative standards to which we appeal in support of our moral progress judgments, given their historical and cultural contingency? To answer this question in a noncircular way, Elizabeth Anderson and Philip Kitcher appeal exclusively to formal features of the methodology by which a moral change was brought about; some moral methodologies are systematically less prone to bias than others and are therefore less vulnerable to error. However, we argue that the methodologies espoused by Anderson and (...) Kitcher implicitly appeal to the substantive principle of “moral universalism.” This sets up the positive project of the paper: an attempt to vindicate moral universalism with a pragmatic genealogy. Using resources from cultural evolutionary theory and the history of ideas we argue that the universalistic norms widely committed to in many societies today have the function of maintaining cooperation in large anonymous groups. Furthermore, while universalistic norms play this instrumental role, their functional benefits are best secured when people following such norms do so for intrinsic rather than instrumental reasons. Finally, having elaborated our pragmatic genealogy, we close by considering how this genealogy should affect our commitment to moral universalism and how it can complement the methods of Anderson and Kitcher. Theories of explanation are characterized as being either pragmatic or non-pragmatic, without a clear sense of what this is supposed to mean. The present paper offers a definition of a "pragmatic explanation-sentence", and in terms of this, of a "pragmatic theory of explanation". It is argued that van Fraassen's theory of explanation, despite claims to the contrary, is not genuinely pragmatic. By contrast, the author's own "illocutionary" theory is pragmatic. Attention is devoted particularly to (...) sentences of the form "E is a good explanation of q", which, it is urged, are pragmatic in a strong sense. In defense of this claim, and of the advantages of a pragmatic account generally, appeal is made to Rutherford's 1911 subatomic explanation of the results of his scattering experiments. Implications of a pragmatic theory are drawn for the debate between realists and anti-realists and absolutists and relativists. (shrink)

Russell famously argued that causation should be dispensed with. He gave two explicit arguments for this conclusion, both of which can be defused if we loosen the ties between causation and determinism. I show that we can define a concept of causation which meets Russell’s conditions but does not reduce to triviality. Unfortunately, a further serious problem is implicit beneath the details of Russell’s arguments, which I call the causal exclusion problem. Meeting this problem involves deploying a minimalist pragmatic (...) account of the nature and function of modal language. Russell’s scruples about causation can be accommodated, even as we partially legitimise the pervasive causal explanations in folk and scientific practice. (shrink)

In ‘Withdrawal and contextualism’, Jonathan Adler (2006) provides an argument which, if successful, undermines what contextualists take to be prime support for their view. Given the popularity of contextualist (and related) positions in epistemology, together with the fact that, thus far, no one has challenged Adler's argument, a critical assessment therefore presses. In this article, after briefly reviewing Adler's argument, I show that it fails. My reason for taking his argument to fail will then provide novel support for contextualism, one (...) that does not rely on raising the pragmatic stakes. (shrink)

Environmental ethics could be useful as an alternative paradigm for business ethics by offering new perspectives and methodologies to grant consideration of the natural environment. The mathematical concept of pragmatic truth, first introduced in Mikenberg, da Costa and Chuaqui (1986), has received in the last few years several applications in logic and the philosophy of science. In this paper, we study the logic of pragmatic truth, and show that there are important connections between this logic, modal logic and, in particular, Jaskowski's discussive logic. In order to do so, two systems are put forward so that the notions of pragmatic validity and (...) class='Hi'>pragmatic truth can be accommodated. One of the main results of this paper is that the logic of pragmatic truth is paraconsistent. The philosophical import of this result, which justifies the application of pragmatic truth to inconsistent settings, is also discussed. (shrink)

In this paper, I explore Bach’s idea (Bach, 2000) that null appositives, intended as expanded qua-clauses, can resolve the puzzles of belief reports. These puzzles are crucial in understanding the semantics and pragmatics of belief reports and are presented in a section. I propose that Bach’s strategy is not only a way of dealing with puzzles, but also an ideal way of dealing with belief reports. I argue that even simple unproblematic cases of belief reports are cases of pragmatic (...) intrusion, involving null appositives, or to use the words of Bach, ‘qua-clauses’. The main difference between my pragmatic approach and the one by Salmon (1986) is that this author uses the notion of conversational implicature, whereas I use the notion of pragmatic intrusion and explicature. From my point of view, statements such as ‘‘John believes that Cicero is clever’’ and ‘‘John believes that Tully is clever’’ have got distinct truth-values. In other words, I claim that belief reports in the default case illuminate the hearer on the mental life of the believer, that includes specific modes of presentation of the referents talked about. Furthermore, while in the other pragmatic approaches, it is mysterious how a mode of presentation is assumed to be the main filter of the believer’s mental life, here I provide an explanatory account in terms of relevance, cognitive effects, and processing efforts. The most important part of the paper is devoted to showing that null appositives are required, in the case of belief reports, to explain certain anaphoric effects, which would otherwise be mysterious. My examples show that null appositives are not necessitated at logical form, but only at the level of the explicature, in line with the standard assumptions by Carston and Recanati on pragmatic intrusion. I develop a potentially useful analysis of belief reports by exploiting syntactic and semantic considerations on presuppositional clitics in Romance. (shrink)

For much of its brief history, the field of environmental ethics has been critical of anthropocentrism. I here undertake a pragmatic reconsideration of anthropocentrism. In the first part of this essay, I explain what a pragmatic reconsideration of anthropocentrism means. I differentiate two distinct pragmatic strategies, one substantive and one methodological, and I adopt methodological pragmatism as my guiding principle. In the second part of this essay, I examine a case study of environmental policy—the problem of beach (...) replenishment on Fire Island, New York—as a pragmatic test of anthropocentrism. I conclude that the debate between anthropocentrism and nonanthropocentrism needs to be expressed in non-absolutist terms, i.e., in a language that permits compromise, flexibility, and a pluralism of values. Thechoice between anthropocentrism and nonanthropocentrism as the basis of both environmental policy and environmental ethics is highly contextual and thus requires a subtle examination of the concrete policy situation. We show that if among the tested hypotheses the number of true hypotheses is not equal to the number of false hypotheses, then Neyman-Pearson theory of testing hypotheses does not warrant minimal epistemic reliability (the feature of driving to true conclusions more often than to false ones). We also argue that N-P does not protect from the possible negative effects of the pragmatic value-laden unequal setting of error probabilities on N-P’s epistemic reliability. Most importantly, we argue that in the (...) case of a negative impact no methodological adjustment is available to neutralize it, so in such cases the discussed pragmatic-value-ladenness of N-P inevitably compromises the goal of attaining truth. We submit a normative pragmatic theory of exhorting—an account of conceptually necessary and potentially efficacious components of a coherent strategy for securing a sympathetic hearing for efforts to urge and inspire addressees to act on high-minded principles. Based on a Gricean analysis of utterance-meaning, we argue that the concept of exhorting comprises making statements openly urging addressees to perform some high-minded, principled course of action; openly intending to inspire addressees to act on the principles; and intending that addressees’ recognition (...) of the intentions to urge and inspire creates reasons for addressees to grant a sympathetic hearing to what the speaker has to say. We show that the theory accounts for the design of Abraham Lincoln’s Cooper Union address. By doing so we add to the inventory of reasons why social actors make arguments, continue a line of research showing the relationship of arguing to master speech acts, and show that making arguments can be an effective strategy for inspiring principled action. Pragmatism, the philosophy native to America, has once again grown to prominence in philosophical debate around the world. Today, the type of pragmatism that is proving to be of greatest value for fostering discussions with other worldviews is pragmatic naturalism. The fourteen provocative essays in this original collection are all by philosophers who describe themselves as pragmatic naturalists and who are active in the present-day revival of American pragmatism. Pragmatic naturalism, like all varieties of pragmatism, steers clear (...) of the extreme intellectualism too often found in philosophy. Pragmatic naturalism stresses that genuine inquiry must be conducted in a consistently empirical manner and be responsive to real human problems. It also contends that the sciences and their methodologies are superior to other modes of inquiry into the human environment. Despite the curious fact that pragmatism is often taken to be opposed to realism, the essays in this volume assert the interdependence of pragmatism with some type of realistic metaphysical stance. As such they advance the debates over the question of realism by uncovering and investigating the deepest assumptions running through recent Anglo-American philosophy. This paper answers the question how pragmatic argumentation which occurs in a legal context, can be analyzed and evaluated adequately. First, the author surveys various ideas taken from argumentation theory and legal theory on the analysis and evaluation of pragmatic argumentation. Then, on the basis of these ideas, she develops a pragma-dialectical instrument for analyzing and evaluating pragmatic argumentation in a legal context. ObjectivesTo describe reporting of informed consent in pragmatic trials, justifications for waivers of consent and reporting of alternative approaches to standard written consent. To identify factors associated with (1) not reporting and (2) not obtaining consent.MethodsSurvey of primary trial reports, published 2014–2019, identified using an electronic search filter for pragmatic trials implemented in MEDLINE, and registered in ClinicalTrials.gov.ResultsAmong 1988 trials, 132 (6.6%) did not include a statement about participant consent, 1691 (85.0%) reported consent had been obtained, 139 (7.0%) (...) reported a waiver and 26 (1.3%) reported consent for one aspect (eg, data collection) but a waiver for another (eg, intervention). Of the 165 trials reporting a waiver, 76 (46.1%) provided a justification. Few (53, 2.9%) explicitly reported use of alternative approaches to consent. In multivariable logistic regression analyses, lower journal impact factor (p=0.001) and cluster randomisation (p<0.0001) were significantly associated with not reporting on consent, while trial recency, cluster randomisation, higher-income country settings, health services research and explicit labelling as pragmatic were significantly associated with not obtaining consent (all p<0.0001).DiscussionNot obtaining consent seems to be increasing and is associated with the use of cluster randomisation and pragmatic aims, but neither cluster randomisation nor pragmatism are currently accepted justifications for waivers of consent. Rather than considering either standard written informed consent or waivers of consent, researchers and research ethics committees could consider alternative consent approaches that may facilitate the conduct of pragmatic trials while preserving patient autonomy and the public’s trust in research. A close reading of Peirce’s pragmatic maxim shows a correlation between meaning and purpose. If the meaning of a concept, proposition or hypothesis is clarified by formulating its practical effects, those also can be articulated as practical maxims. To the extent that the hypotheses or propositions upon which they are based are true, practical maxims recommend reliable courses of action. This can be translated into a broader claim of an integral relation between semiosis and goal-directed or teleological systems. Any (...) goal-directed system, to be propagating, must be capable of coordinating the information in its internal or endergonic processes with exergonic information found in its environment. Signs are critical links between these two sources of information and must also serve as steering mechanisms for that system as well. If signs detected or represented information in the environments without using that information to steer the system, it would have no practical effect on the system; conversely, if a system could steer itself, but had no representation of exergonic information, it would fail to be propagating. Obviously, to get food, it must not only find it, but must also use that information to direct its behavior in a manner that makes use of that food. Using concepts found in complex systems and modern information theory, it is argued that this analysis requires a distinction between information and meaning. The result of this investigation is the claim that meaning can be understood as the propagating work of information. The remainder of the paper follows some of the ramification of this analysis for Peirce’s semiotic theory. (shrink)
