Broadly speaking, two views of modernity are prevalent in contemporary debates. According to the first view, i.e. “modernization theory,” there is one single form of modernity, which is tantamount to liberal, capitalist modernity. The West has already and fully achieved modernity; non-Western societies have lagged behind and must simply catch up with the West. In contrast, according to the second view, “post-colonial theory,” there is no such thing as modernity. What the West erroneously calls “modernity” is nothing but a highly (...) parochial way of thought, and of economic and political organization, that developed by accident first in the West and then by the exercise of military violence or economic power was subsequently “universalized.” In this chapter, I argue that Hegel, read properly, provides a third conception of modernity, one which, contrary to the modernization theory, respects differences between societies, and yet, contrary to post-colonial theory, does not engage in dividing the human species into fundamentally different or incommensurate groups. I argue that Hegel’s theory of modernity must be sought at the conjunction of the Science of Logic (specifically the logic of the Concept) and the Philosophy of Right. I then elaborate on Hegel’s theory of modernity, thus construed. (shrink)

Published in 1821, Outlines of the Philosophy of Right is considered the definitive articulation of the legal, moral, social, and political philosophy of G.W.F. Hegel. However, shortly before its publication, Hegel delivered a series of lectures on the subject matter of the work at the University of Berlin. These lectures are unlike any others Hegel gave on the philosophy of Right in that they do not supplement a published text but rather give a full and (...) independent presentation of his mature political thought. Yet, they are also unlike Hegel's formal treatise in that they form a smooth and flowing discourse, much like Hegel's lectures on the philosophy of history, philosophy of art, philosophy of religion, and history of philosophy. Substantively, these lectures contain more extensive discussions of poverty and the proletariat than are found in Hegel's published text--discussions that carry out the retreat from optimism about the present age intimated in the preface to Outlines but nowhere evident in the text itself. Translated with an introduction and notes by Alan Brudner, Hegel's 1819/20 lectures on the philosophy of Right present his complete thoughts on law and the state in a manner that is more accessible and engaging than any other Hegelian text on these subjects. Although the emlocus classicus /emof the concept of recognition is the master/slave episode of the Phenomenology, it is readily portable into the emPhilosophy of Right/em. However, the fact that the term occurs only six times in the 400 pages of the emPhilosophy of Right/em has obscured its structural role, and accordingly scholarly effort is scant on the concept as it might pertain to this work. It is the argument of this paper that despite its lsquo;invisibilityrsquo; it governs foreground (...) proceedings as if from behind a curtain, for it cannot be gainsaid that the conceptual foundation of the Rights empresupposes/em the principle of recognition. The suspicion has been voiced that Hegel deliberately emsuppressed/em reminders of the presence of emAnerkennung/em in his philosophy of rights in order to distance himself from the perceived limitations of the Fichtean exposition of the concept. These lectures constitute the earliest version of Hegel's Philosophy of Right, one of the most influential works in Western political theory. They introduce a notion of civil society that has proven of inestimable importance to diverse philosophical and social agendas. This transcription of the lectures, which remained in obscurity until 1982, presents the philosopher's social thought with clarity and boldness. It differs in some significant respects from Hegel's own published version of 1821. Nowhere does Hegel make plainer the (...) difference between his concept of objective spirit and traditional concepts of natural law or offer a more prominent treatment of the key notion of recognition. His description of poverty is more forceful and his critique of existing social conditions more thorough than in the published edition, which had to satisfy the Prussian censor. The strictly limited powers of the monarch are more clearly delineated in the Heidelberg lectures, and the arguments for a bicameral legislature are more explicit. Hegel formulates in a more dynamic way his understanding of the relationship between rationality and actuality--the rational is not what exists but what is coming into being--and sets forth more simply and clearly the central themes of his political philosophy--freedom, justice, and community. The Heidelberg lectures are an indispensable resource for understanding the edition of 1821 and an invaluable supplement to one of the great classics of political philosophy. (shrink)

This paper will analyse Hegel's discussion of the relation between family and civil society on the basis of Marx's insight into the discrepancy between Hegel's explicitly logical structure of presentation based on �essential relationships� and his implicitly historical structure of presentation based on �external necessities�. It is intended neither to resolve the dispute between Hegel and Marx nor to apply Marx's critique to passages of the Philosophy of Right that he did not have occasion to discuss. It will attempt to illustrate the conflict between Hegel's characterization of civil society as a moment of ethical life emerging from the family in a non-contradictory manner, and his characterization of civil society's opposition to, and transformation of, the family. It is often thought that Hegel’s social philosophy is straightforwardly hostile toward liberal ideals. In this article, I contend that many such suspicions can be dispelled through a more nuanced engagement with his rhetorical and argumentative strategies. To tackle such a broad topic in this space, I focus on the shortcomings of a rights-based individualism within the Philosophy of Right — where Hegel describes civil society as a ‘semblance’ [Schein] of a rational polity. Although such passages might (...) suggest the collectivism that has long haunted his legacy, I propose that he is offering something rather more normatively attractive. More specifically, I argue that his grammar of recognition disinters the suppressed social conditions for those rights (and the individuality they protect) that are often misrecognized as foundational by liberal theorists. In this dissertation I argue that Hegel‘s analysis of freedom based on the concept of self-determination provides us with an opportunity to radically rethink personal freedom and restore it to its necessary domain: the political. I reconstruct Hegel‘s exposition of the dynamic of self-determination in the Logic by focusing on a central premise: that the exposure and overcoming of the conceptual indifference [Gleichgültigkeit] between categories – between, for example, something and other, identity and difference, or universality and particularity – is (...) the driving force of the argument leading to the Concept, i.e., the concept of self-determination. I show that Hegel‘s critiques of abstract universal free will as well as of particular arbitrary freedom use the same strategy, that of exposing the claims of indifference that sustain the legitimacy of these conceptions of freedom. I argue that the critique of indifference, explicit in the analysis and exposition of self-determination in the Logic and implicit in Hegel‘s discussion of the free will in the Philosophy of Right, offers a new perspective for thinking personal freedom. In a paper called ‘Elements of the Philosophy of “Right”’ (Philosophical Investigations (2022):1–8), I gave an account of what ‘right’ means, both ethically and generally. I was surprised to find little or no previous work on this topic. I came to the conclusion that the word means the same thing in ethical uses as it does in other non-ethical uses. However, I have since come to see that there is a seemingly convincing objection to my account, though (...) I stand by the account as given. The objection itself turns out to be a confusion. This article argues that the citizens of Hegel's state cannot maintain themselves as politically free because they are susceptible to mutual enslavement. I demonstrate this by focusing on the Roman republican background of Hegel's constitution, the potential trajectory of its dissolution and the accompanying means of its cyclical fortification through courage. Hegel, by integrating aspects of the Roman mixed constitution also adopts the idea of decadence within his conception of civil society. After locating the source of decadence in the contractual (...) relations of peace and the bourgeois inability to overcome the fear of death, I go on to argue that war for Hegel provides a theatre where freedom may be regenerated through courage. However, I also show that modern wars do not provide sufficient means of perpetuating Hegel's constitution. To demonstrate this, I distinguish three forms of war: colonial, limited and total war, arguing that only the latter offers a solution to decay of political disposition and loss of freedom, but that—by being itself susceptible to decadence—it cannot salvage Hegel's state from dissolution and reduction to contractual relations.
