In his discussion of morals in the Third Book of the Treatise, Hume claims that the taking of what I shall call a general point of view is a necessary condition of the arousal of moral feelings. This aspect of Hume's theory has not received much attention from his commentators before now, although its implications for the theory as a whole might be regarded as significant.

Concepts, Kovesi argued in Moral Notions and elsewhere, are formed from a point of view; they express relevant needs, wants, interests, ideals, and attitudes, and are formed from a point of view that can be anybody’s. The point of view need not be everybody’s (not everybody is interested in chess, for example), but it is a point of view that can be taken by anybody. The point of view expresses (...) our purpose in forming the concept (p. 48)1; it is the point of view of somebody dealing with certain sorts of problems, and that determines which material elements will come under the concept. But Kovesi refuses to explain in any of his writings what the moral point of view is, and says that it is no part of his project to explain that (see especially pp. 105 ff). This is not a matter of his refusing to say whether he is taking a Utilitarian point of view or an Emotivist point of view of anything of that sort. His question is a much more basic one about the logical structure of moral concepts and their relationships to the problems morality is formed to deal with. His refusal to explain the moral point of view is puzzling. The moral point of view that Kovesi envisaged, I think, is the point of view of members of a species the members of which have to get on together, a species members of which have the qualities of character that enable them to get on together. In this paper, I argue that accounts of the normative basis of morality face the following puzzle, drawing on a case found in Susan Wolf’s influential discussion of conflicts between the moral and personal points of view. On the one hand, morality appears to constitute an independent point of view that can intelligibly conflict with, and can conceivably be overruled by, the verdicts of other points of view. On the other hand, moral demands appear (...) to carry a distinctive sort of authority; moral reasons normally seem to take priority over other kinds of considerations, and the verdicts of morality seem to possess a distinctive place in our deliberations, in that they appear to represent standards that we are open to legitimate complaint for failing to honor. After clarifying the nature of the problem, I argue that a contractualist theory of morality can resolve the puzzle by offering a compelling vindication of the independence of the moral perspective, the normal priority of moral reasons, and the deliberative significance of moral verdicts, within a unified theoretical framework. Furthermore, I claim that this contractualist analysis can help account for the sense of deep conflict that is characteristic of the sort of troubling moral choices that Wolf calls to our attention. The existence and nature of a moral point of view is explored. There is a philosophically deep way of dividing considerations into moral and non‐moral such that even thought other context‐dependent, uses of the terms are legitimate marks the correct or significant delineation of morality. Moral considerations are a distinct type, distinct in how we find out about them and in what makes them into considerations with a call for our attention. A powerful argument (...) for the distinctness of the moral point of view is provided, and it is one that is relevant to the thesis that there are internal and external reasons for action, and to forms of agent‐relativism, which depend on it. Central to the discourse ethics advanced by Jürgen Habermas is a principle of universalization (U) amounting to a dialogical equivalent of Kant's Categorical Imperative. Habermas has proposed that ?U? follows by material implication from two premises: (1) what it means to discuss whether a moral norm ought to be . adopted and (2) what those involved in argumentation must suppose of themselves if they are to consider a consensus they reach as rationally motivated. To date, no satisfactory derivation of (...) ?U? from these two premises has been presented. Thus the present study attempts to show how one can, without begging the question, arrive at ?U? by assuming a suitable explication of these two premises, supplemented with a fairly innocuous assumption about the context of discourse. If the argument is sound, then ?U? brings both deontological and consequentialist intuitions together with a notion of solidarity that requires an intersubjective account of insight. (shrink)

Clearly written and subtly argued, this book may well come to occupy an important place in the literature of contemporary analytic ethics.--A. C. P.

Interpretations of ethical egoism as advocating the unconstrained harming of others, or as an absurd meta-ethical definition of morality, are unwarranted. The social definition of morality provided by, e.g., William Frankena, fails to rule out egoism. Instead, it forms the background against which egoism develops as a possible, normative position. Examples from "The Immoralist" and "Zorba the Greek" illustrate this possibility.

In this article, I investigate the possibility of reconciling a radically disenchanted scientific naturalism in ontology with the unconditional and non-instrumental character of the moral point of view. My point of departure will be Sellars’s philosophy, which attempts to satisfy both those, seemingly unreconcilable, demands at once. I shall argue that there is a tension between those two demands that finds expression both at the theoretical and practical level, and which is not adequately resolved from a (...) strictly Sellarsian perspective. I will then develop a neo-Sellarsian framework, close to the spirit—if not the letter—of Sellars’s philosophy, which, as I will suggest, can live up to this task. This solution depends (1) on insisting on both the semantic irreducibility and explanatory reducibility of moral normativity to non-normative facts, while simultaneously acknowledging that those two dimensions mutually presuppose and support on another, and (2) on recognizing that the instrumental facets of theoretical-scientific rationality need not imply a coercive attitude toward nature, ourselves, and others. In a recent issue of this journal, C. L. Sheng claims to havesolved andexplained the Prisoner's Dilemma (PD) by studying it ‘from a moral point of view’ - i.e., by assuming that each player feels sympathy for the other. Sheng does not fully clarify this claim, but there is textual evidence that his point is this: PD's arise only for agents who feel little or no sympathy for each other; they cannot arise in the presence of (...) a high degree of reciprocal sympathy. A high degree of such sympathysolves the PD in that it prevents PD's from arising, and a low degree of itexplains the PD in that it provides an essential condition for the occurrence of that game. This thesis is false, as some examples show. These examples are important; they prevent us from underestimating the problem posed by the PD. (shrink)

In Finnis´s methodology it is very important to build the appropriate concepts to describe, analyse and define law. As a natural law theorist Finnis goes beyond Hart when considering that the internal point of view is useless for delimiting what law is if one does not define the internal point of view of the internal point of view, that is, the moral point of view. Only from a moral point (...) of view it is possible, according to Finnis, to build an authentic theory of law able not only to describe law but also to morally evaluate it. In Finnis methodology there is also the distinction between the focal and peripheral meanings of a term or concept, whichcorrespond, respectively, to the central and peripheral or secondary cases of and object referred by such term or concept. Because of this distinction Finnis is able to use a wide concept of law avoiding in this way many of the mistakes, which, according to legal positivism, are typical of natural law theories like, for example, confusing legal and moral validity. The importance given by Finnis to the internal point of view and the distinction between central and peripheral cases in order to analyse law is not original but Finnis introduces some particularities, which is what I try to present in this paper. There are similarities between Bernard Williams and Cora Diamond as moral philosophers: both their moral philosophies are marked by an engagement with the question of what it is like to be a human being, and both are engaged with experience more than theory. Still, such similarities rest on very different philosophical grounds. In this article, I consider whether a Nietzschean (Williams) and a Wittgensteinian (Diamond) could ever converge on a characterization of the ‘moral point of (...) class='Hi'>view’ as this involves views on life, thought, and language. I argue that divergences between Williams and Diamond persist, a very important one concerning relativism: whereas Diamond adumbrates a Wittgensteinian way out of relativism, it remains a last word for Williams. Professor Frankena's Carus Lectures exhibit the analytical acumen and probing intelligence we have long come to expect from his writings. The distinctions he draws, the questions he raises, and the answers he suggests all serve powerfully to advance philosophical thought. While I shall have criticisms to make of some of his central doctrines, this must not be allowed to obscure the real indebtedness one feels for the enlightening and stimulating effect of his work as a whole.

In recent years, several philosophers - including Joshua Gert, Douglas Portmore, and Elizabeth Harman - have argued that there is a sense in which morality itself does not treat moral reasons as consistently overriding.2 My aim in the present essay is to develop and extend this idea from a somewhat different perspective. In doing so, I offer an alternative way of formalizing the idea that morality is modest about the weight of moral reasons in this way, thereby making (...) more explicit the connections between this thesis and similar issues in the epistemic sphere. In addition, I discuss how these ideas can transform our thinking about familiar questions in ethics such as the nature of self-effacement, the significance of reflective endorsement, the weight that moral reasons ought to be given in all things consideration, and the plausibility of “indirect” moral theories. Finally, I show that these ideas are compatible even with pictures of morality – such as Kant’s – on which morality might seem to anything but modest about its own importance. In doing so, I stress that it is possible to see morality as modest about the weight of specifically moral reasons, while also seeing all practical reasons as grounded in morality more indirectly – namely, by seeing morality as determining the weight that both moral and non-moral considerations deserve to have in all things considered deliberation. Hume thinks moral judgments are based on sentiments of approval and disapproval we feel when we contemplate someone from a "general point of view." We view her through the eyes of her "narrow circle" and judge her in accordance with general rules. Why do we take up the general point of view? Hume also argues that approval is a calm form of love, love of character, which sets a normative standard for other forms of (...) love. In this paper I explain why, and argue that character, as a form of causality, is constructed from the point of view of one's narrow circle. For Habermas, a moral point of view is based in the procedural requirements of our linguistic competence. For Levinas, it is the way in which we find ourselves related in speech to the face of the other that we find ourselves obliged to the other. But these differing conceptions of the moral significance of language need not be seen as opposed to each other. Rather, they can be conceptualized as complimentary accounts of the ways in which (...) a moral point of view onto life is inextricably bound up for us with our capacities as linguistic creatures. While Habermas enables us to see the importance of language as a rule-governed social practice for the constitution of a moral point of view, Levinas draws our attention to the way in which the moral significance of language so conceived lies in a form of sensibility, a sensible “exposure” or “vulnerability” to the other person, older than language itself. Appropriately coordinated, these two perspectives give us a more adequate understanding than either can on its own of the central place of language in our lives as moral agents. (shrink)

This paper points to some limitations of law and economics as both an explanative and a normative theory. In explaining law as the result of efficiency promoting decisions, law and economics theorists often dismiss the reasons actors in the legal system give for their behavior. Recognizing that sometimes actors may be unaware of why institutions evolve as they do, I argue that the case for dismissing reasons for action is weaker when those reasons make reference to rules of practices that (...) constitute the meaning of actions within those practices, or when they have otherwise been given well-considered defenses. In criticizing law and economics as a normative theory, I acknowledge that economic considerations are often important in deciding how to act in the personal sphere and how government should allocate its scarce resources. I argue that while the use of institutions to promote our ideals forces us to take their costs into account, it is a mistake to infer from this that the question of determining social policy is a purely economic problem, and that we should acknowledge the non-utilitarian moral ideals our law and practices promote. This is the basis of both an internal criticism--law and economics theorists have not sufficiently evaluated and weighed the value of fairness and other ideals in their utility calculations--and an external criticism-- these ideals are important in ways that can not be measured in utiles. Among those who know Yehuda's work, the term “two-tier thinking” is usually associated with a problematic relativist position. But “two-tier thinking” is not a name for a philosophical argument; it is best understood, I think, as a term designating certain conditions of knowledge: universal, or modern, or perhaps only postmodern conditions, but in any case, they are generalizations derived from anthropological and psychological observations on matters of facts. This is how things actually work in the sphere of knowledge: Western intellectuals (...) and scientists tend to acknowledge that their truth claims and certainly their normative claims are incompatible with other claims that stem from other belief systems, frameworks of thought or genres of discourses, and there is no final, impartial instance of judgment to adjudicate between the incompatible claims and the conflicting systems. Lack of “final,” impartial judgment does not hinder people from taking their truth claims seriously and acting as realists within the world constituted by their particular belief systems — tier 1. But when they come to reflect upon it, as some of them do, sometimes, they acknowledge the context-dependence of this realism and the fact that there is no way to make good on its claim to universality; theirs, they know, is but one particular “belief system,” or “genre of discourse,” among many. The question of responsibility plays a critical role not only in our attempts to resolve social and political problems, but in our very conceptions of what those problems are. Who, for example, is to blame for apartheid in South Africa? Is the South African government responsible? What about multinational corporations that do business there? Will uncovering the "true facts of the matter" lead us to the right answer? In an argument both compelling and provocative, Marion Smiley demonstrates how attributions of (...) blame—far from being based on an objective process of factual discovery—are instead judgments that we ourselves make on the basis of our own political and social points of view. She argues that our conception of responsibility is a singularly modern one that locates the source of blameworthiness in an individual's free will. After exploring the flaws inherent in this conception, she shows how our judgments of blame evolve out of our configuration of social roles, our conception of communal boundaries, and the distribution of power upon which both are based. The great strength of Smiley's study lies in the way in which it brings together both rigorous philosophical analysis and an appreciation of the dynamics of social and political practice. By developing a pragmatic conception of moral responsibility, this work illustrates both how moral philosophy can enhance our understanding of social and political practices and why reflection on these practices is necessary to the reconstruction of our moral concepts. This paper concerns the difficulties of imagining the subjective point of view of another human being, and the relevance of these difficulties to medical decisions. It explores especially the difficulties of imagining the experience of the mentally impaired, and examines several standards for decision-making: the 'prior expressed wishes standard', the 'substituted judgement standard', and the 'best interests standard'.

Problems of practical reasoning often arise as the result of a clash between two different points of view. What do we mean when we say that while from the point of view of prudence there is no reason to rescue one's drowning enemy, from the point of view of morality there is reason to do so? In this essay we examine how the idiom of points of view arises in practical discourse, and offer a (...) clarification of it. We will be particularly concerned with a common argument for assigning a privileged status to the moral point of view, an argument which can be seen to be fallacious once certain features of Judgments made from a point of view are clearly discerned. In this article two broad ideals or 'umbrella' concepts in management ethics—one Eastern and one Western—are examined, with an eye toward explaining their fundamental similarities. Beyond ques tions of meaning and conceptual analysis, however, are questions of implementation. Institutional izing an ethical orientation—Eastern or Western—is the theme of the last part of the article. Different approaches to institutionalization are discussed and a strategy is suggested for making the 'umbrella' concepts part of the operating systems of organizations.
