Mistaken payment is the ‘core case’ of unjust enrichment, and it has had a powerful effect on the development of this area of private law. For Peter Birks, unjust enrichment was simply ‘the law of all events materially identical to mistaken payment’—to be shaped through a process of abstraction from that core case. But this begs the question: how do we work out what counts as ‘materially identical’ to mistaken payment? The most obvious starting point, and that which Birks chose, (...) is the central characteristic of money: money is valuable. Thus, ‘the law of all events materially identical to mistaken payments’ is ‘the law of all events that unjustly enrich one party at another’s expense’.In this article, I argue that this starting point is incorrect. Rather than looking for some factual similarity between mistaken payment and other events, we should identify the role that money plays in justifying restitution. And what justifies restitution in the core case is not the ‘value’ or ‘benefit’ that money confers; rather, it is a defect in the legal transaction that links payor with payee. The payee is not liable because she has been ‘enriched’, but because she is the counterparty to a legal transaction which exhibits traits that there are institutional reasons to disavow. Just like contract and torts, the role of value is secondary: where correcting the injustice in specie is impossible or undesirable, the defendant must pay whichever sum will most nearly achieve that goal. Despite a growing literature on identity theory in the last two decades, much of its current use in archaeology is still driven toward locating and dating static categories such as 'Phoenician,' 'Christian' or 'native.' Previous studies have highlighted the various problems and challenges presented by identity, with the overall effect of deconstructing it to insignificance. As the humanities and social sciences turn to material culture, archaeology provides a unique perspective on the interaction between people and things over (...) the long term. This volume argues that identity is worth studying not despite its slippery nature, but because of it. Identity can be seen as an emergent property of living in a material world, an ongoing process of becoming which archaeologists are particularly well suited to study. The geographic and temporal scale of the papers included is purposefully broad to demonstrate the variety of ways in which archaeology is redefining identity. As global history continues to take shape as an important field of research, its interactive relationships with the history of science, technology, and medicine are recognized and being investigated as significant areas of concern. Strangely, despite the fact that it is key to understanding so many of the subjects that are central to global history and would itself benefit from a broader geographical perspective, the history of chemistry has largely been left out of this process – particularly for the modern (...) historical period. This article argues for the value of integrating the history of chemistry with global history, not only for understanding the past, but also for thinking about our shared present and future. Toward this end, it (1) explores the various ways in which ‘chemistry’ has and can be defined, with special attention to discussions of ‘indigenous knowledge systems’; (2) examines the benefits of organizing historical inquiry around the evolving sociomaterial identities of substances; (3) considers ways in which the concepts of ‘chemical governance’ and ‘chemical expertise’ can be expanded to match the complexities of global history, especially in relation to environmental issues, climate change, and pollution; and (4) seeks to sketch the various geographies entailed in bringing the history of chemistry together with global histories. I have both a smaller and a larger aim. The smaller aim is polemical. Kit Fine believes that a material thing—a Romanesque statue, for example, or an open door—can be distinguished from its constituent matter—a piece of alloy, say, or a hunk of plastic—without recourse to modal or temporal considerations. The statue is Romanesque; the piece of alloy is not Romanesque. The door is open; the hunk of plastic is not open. I argue that these considerations, when combined with (...) a proper understanding of how the use of ‘not’ is functioning, entail that the statue is the piece of alloy, and that the door is the hunk of plastic. Far from challenging the doctrine that a material thing is its matter, Fine’s observations confirm the view. My larger aim is methodological. I will show that natural language semantics can guide inquiry in certain areas of metaphysics by helping us to advance lingering debates. (shrink)

In this paper, I present an Aristotelian solution to the problem of material constitution. The problem of material constitution arises whenever it appears that an object a and an object b share all of the same parts and yet are essentially related to their parts in different ways. (A familiar example: A lump of bronze constitutes a statue of Athena. The lump and the statue share all of the same parts, but it appears that the lump can, whereas (...) the statue cannot, survive radical rearrangements of those parts.) I argue that if we are prepared to follow Aristotle in making a distinction between numerical sameness and identity, we can solve the problem of material constitution without recourse to co-location or contingent identity and without repudiating any of the familiar objects of common sense (such as lumps and statues) or denying that these objects have the essential properties we ordinarily think that they have. Assuming that there is a single relation between members of each of these pairs, is the relation “strict” identity, “contingent” identity or something else?1 Although this question has generated substantial controversy recently,2 I believe that there is philo- sophical gain to be had from thinking (...) through the issues from scratch. Many of the charges and countercharges are based on the following dichotomy: For any x and y that are related as the lump of clay is to the statue that it makes up, either x is identical to y, or x and y are separate entities, independent of each other. By giving up this dichotomy, we will be able to begin to make sense, I hope, of an intermediate unity relation that holds promise for solving a raft of philosophical problems, including the problem of how persons are related to their bodies.3 And if I am correct, then this relation—constitution without identity—is ubiquitous and interesting in its own right, apart from the light that it sheds on human persons. There is a well-known argument from Leibniz's Law for the view that coincident material things may be distinct. For given that they differ in their properties, then how can they be the same? However, many philosophers have suggested that this apparent difference in properties is the product of a linguistic illusion; there is just one thing out there, but different sorts or guises under which it may be described. I attempt to show that this ‘opacity’ defence has intolerable consequences (...) for the functioning of our language and that the original argument should therefore be allowed to stand. (shrink)

I shall attempt to identify some of the main features of ‘religious materialism’, as I understand it, and indicate some of the thinkers and themes within modern European thought that I have drawn upon in my effort to formulate it thus far. The philosophical stance in question consists of an odd amalgam of thinkers and ‘Schools’ within post-Kantian European philosophy that are often considered to be radically incommensurable – in broad terms, post-Husserlian phenomenology and post-Nietzschean philosophical naturalism.

Issues of identity and reduction have monopolized much of the philosopher of mind’s time over the past several decades. Interestingly, while investigations of these topics have proceeded at a steady rate, the motivations for doing so have shifted. When the early identity theorists, e.g. U. T. Place ( 1956 ), Herbert Feigl ( 1958 ), and J. J. C. Smart ( 1959 , 1961 ), fi rst gave voice to the idea that mental events might be identical to (...) brain processes, they had as their intended foil the view that minds are immaterial substances. But very few philosophers of mind today take this proposal seriously. Why, then, the continued interest in identity and reduction? Th e concern, as philosophers like Hilary Putnam and Jerry Fodor have expressed it, is that a victory for identity or reduction is a defeat for psychology. For if minds are physical, or if mental events are physical events, then psychologists might as well disassemble their laboratories, making room for the neuroscientists and molecular biologists who are in a better position to explain those phenomena once misdescribed as “psychological.” Th e worry nowadays is not that locating thought in immaterial souls will make psychology intractable, but that locating thoughts in material brains will make it otiose. Visible Identities critiques the critiques of identity and of identity politics and argues that identities are real but not necessarily a political problem. Moreover, the book explores the material infrastructure of gendered identity, the experimental aspects of racial subjectivity for both whites and non-whites, and in several chapters looks specifically at Latio identity.

Documents, in particular identity cards, mediate relationships between individuals and institutions. Their materiality matters and actively impacts how states govern populations and their movements. In this paper, I examine one such object, the Romanian identity card. Focusing on its temporality and agency, I explore how objects and technological procedures enact race. In Romania, people without an address or proof of residence—many of them members of segregated Roma communities living in deep poverty—can only receive a temporary identity card, (...) the Carte de Idenititate Provizorie (CIP). CIP holders do not enjoy full citizenship and are deprived of various rights, such as the right to travel without a passport within the European Union. They are also exposed to heightened surveillance as they must apply annually for a new CIP. Starting from the material object of the CIP, I explore how race comes into being as a relation at the intersection of various temporalities that are folded into the rules and bureaucratic practice entailed in its issue. I offer the concept of “permanent temporality” to analyze how racialization occurs in practices of governing people and their movement in Europe. (shrink)

La cultura material del hogar encarna tanto su experiencia y trayectoria migratoria como el proceso de integración en la sociedad chilena, representando el continuo proceso de ajuste que deben enfrentar en términos culturales, sociales y materiales. ABSTRACT This paper defends a controversial view about personal identity. It argues that it is possible to endorse both Phenomenalism and Materialism about persons. Phenomenalism is the view that personal identity is grounded in phenomenal consciousness. Materialism is the view that we are material objects. Many believe that the two views are incompatible. In this paper, I show that it is possible to accept both. I consider two objections against their combination—the argument from disembodiment and an important (...) objection by Tim Bayne. My responses are based on Kripke’s analysis of necessary a posteriori and contingent a priori statements. I make the case that both objections rest on different kinds of modal illusions. This strategy can be applied to other arguments, and the paper is intended to advocate a general approach to personal identity. (shrink)

In A Contribution to the Critique of Political Economy, Karl Marx outlined his idea of a material 'base' and politico-cultural 'superstructure'. According to this formula, a material reality - wealth, income, occupation - determined your politics, leisure habits, tastes, and how you made sense of the world. Today, the importance of material deprivation, in terms of threats to life, health and prosperity, are as acute as ever. Despite the continued importance of inequality and disadvantage, the identities apparently (...) generated by these realities are increasingly detached from material circumstances. In many casesthe identity has become a powerful signifier in its own right, and is now instrumentalised, idealised and imitated. People attempt to police the boundaries and determine the significance of the identity, so that the identity matters more than the lives of the individuals concerned. These powerful identities can be used for various purposes, from the commercial to the aesthetic to the political. This trend has accelerated in recent years, with increasing precarity and increasingly obvious inequality fuelling anger, and the internet acting as a perfect mechanism for identity theft. Identity Theft covers four different kinds of identity most susceptible to these trends - class, race, sex and age - considering how the boundaries of different identities are policed, and how different versions of the same identity can be deployed to different ends. Ultimately, the argument is not just that 'identities are more complex' than they appear, but rather that there are more important commonalities. Many totemic 'culture war' issues are not particularly contested, but have broad appeal, or little concern for most people. In the UK at least, what might be called a 'culture war' is waged largely on the periphery by crank politicians, social media groups and newspaper columnists. If there is one argument to be taken from this book, it is a call for conscientious objection in the culture wars.,. (shrink)

Material culture and technoculture not only provide openings to study culture, but raise questions about contemporary materialism and technology more generally as well. Material culture tells a story, though usually not the whole story. The meanings of things are various, and finding out what they are requires a variety of approaches, from simply asking people what their things mean or observing how they use or don’t use them, to backtracking their history, or contextualizing them in broader cultural context. The transition from hunter-gatherer life to that of agriculturally-based civilization some twelve thousand or so years ago was a great watershed of consciousness, not only radically altering the relation to the living environment, but also producing the origins of materialism. One of civilization’s dubious distinctions was to introduce poverty as well as property and wealth. Consumption is clearly a driving force on the globe today, powering economies, promising identities, providing a cornucopia of commodities. Technoculture is at its center, both in material devices and in the ideas they communicate about how what one has affects what one is and can be. The problem of materialism is not whether to have materials for living, but in allowing them to become goals in themselves. (shrink)

According to Peter van Inwagen, visible inanimate objects do not, strictly speaking, exist. In defending this controversial thesis, he offers fresh insights on such topics as personal identity, commonsense belief, existence over time, the phenomenon of vagueness, and the relation between metaphysics and ordinary language.

Since World War II Japanese artists have employed two seemingly contradictory ways of working, using aesthetics, materials, artistic methods technologies, and approaches that are either radically innovative and wildly experimental, or traditional/classical. Many other artists, however, in a move that seems paradoxical. have combined the two to explore the new themes of the post-atomic period. Three narrative works dealing with the effects of the World War II war effort and the atomic bombings that ended them, Yasunari Kawabata’s novel The Sound (...) of the Mountain (1952), Rio Kishida’s avant-garde play Thread Hell (1984), and the film Barefoot Gen (Hadashi no Gen), directed by Mori Masaki and written by Keiji Nakazawa (Masaki and Nakazawa 1983), exemplify this third approach. Set in the pre-War textile industry that enabled the War, during the atomic bombings, and the post-War American Occupation, all three explore the experience not only of the horrific objective effects of war but of the Japanese experience of psychic numbing, which damages the person’s sense of self and their sense of agency—their ability to act effectively in the world. All three utilize classical aesthetics to provide aesthetic experiences, for their readers/viewers, to make the experience of the work tolerable, and for their characters—to demonstrate the roles of positive aesthetic experience in making life worth while and in grounding a renewed sense of personal identity and selfhood in a self that has been shattered through trauma. Eric T. Olson has argued that those who hold that two material objects can exactly coincide at a moment of time, with one of these objects constituting the other, face an insuperable difficulty in accounting for the alleged differences between the objects, such as their being of different kinds and possessing different persistence-conditions. The differences, he suggests, are inexplicable, given that the objects in question are composed of the same particles related in precisely the same way. In response, I (...) show that the differences are not at all inexplicable once it is recognized that the conditions for a persisting object to be composed by certain particles at a moment of time must involve facts concerning other moments of time, and that the relevant facts are different for persisting objects of different kinds. Philosophers who neglect this sort of constraint on composition principles may be said to be victims of the 'cinematographic fallacy'. (shrink)

In this article I develop tools for analyzing the identities that emerge in qualitative material. I approach identities as historically, socially and culturally produced subject positions, as processes that are in a constant state of becoming and that receive their temporary stability and meaning in concrete contexts and circumstances. I suggest that the identities and subject positions that materialize in qualitative material can be analyzed from four different perspectives. They can be approached by focusing on (1) classifications that (...) define the boundary lines between ‘us’ and ‘them’, as (2) participant roles that refer to the temporal aspect of subject positions and outline their meaning for action, as (3) structures of viewpoint and focalization that frame meaning and order to opinions and experiences of the world, and as (4) interactive positions that articulate the roles and identities taken by the participants of communication. In the heated debates over identity politics, few theorists have looked carefully at the conceptualizations of identity assumed by all sides. Visible Identities fills this gap. Drawing on both philosophical sources as well as theories and empirical studies in the social sciences, Martín Alcoff makes a strong case that identities are not like special interests, nor are they doomed to oppositional politics, nor do they inevitably lead to conformism, essentialism, or reductive approaches to judging others. Analytic metaphysics has recently discovered biology as a means of grounding metaphysical theories. This has resulted in long-standing metaphysical puzzles, such as the problems of personal identity and material constitution, being increasingly addressed by appeal to a biological understanding of identity. This development within metaphysics is in significant tension with the growing tendency amongst philosophers of biology to regard biological identity as a deep puzzle in its own right, especially following recent advances in our understanding of (...) symbiosis, the evolution of multi-cellular organisms and the inherently dynamical character of living systems. Moreover, and building on these biological insights, the broadly substance ontological framework of metaphysical theories of biological identity appears problematic to a growing number of philosophers of biology who invoke process ontology instead. This volume addresses this tension, exploring to what extent it can be dissolved. For this purpose, the volume presents the first selection of essays exclusively focused on biological identity and written by experts in metaphysics, the philosophy of biology and biology. The resulting cross-disciplinary dialogue paves the way for a convincing account of biological identity that is both metaphysically constructive and scientifically informed, and will be of interest to metaphysicians, philosophers of biology and theoretical biologists. I propose a fourfold categorisation of entities according to whether or not they possess determinate identity-conditions and whether or not they are determinately countable. Some entities – which I call ‘individual objects’ – have both determinate identity and determinate countability: for example, persons and animals. In the case of entities of a kind K belonging to this category, we are in principle always entitled to expect there to be determinate answers to such questions as ‘Is x the same (...) K as y?’ and ’How many Ks are there satisfying condition C?’, even if we may sometimes be unable in practice to discover what these answers are. But other entities apparently lack either determinate identity, or determinate countability, or both. In these terms I try to explain certain important ontological differences between familiar macroscopic objects and various rather more esoteric entities, such as the ‘particles’ of quantum physics, quantities of material stuff, and tropes or property instances. André Gallois argues that individuals that undergo fission are on some occasions identical, but on others distinct. Occasional identity however, is metaphysically costly. I argue that we can get all the benefits of occasional identity without the metaphysical costs. On the proposed account, the names of ordinary material objects refer indeterminately to stages that belong to reference classes determined by the context of utterance or temporal adverbs. In addition, temporal markers indicating the perspective from which we count (...) objects and assign properties to them determine how many count and what is true of them. So, as Gallois holds, the truth value of claims about what is true at a time may change over time and, where fission or fusion occur, does change. The current account, however, secures this result without commitment to occasional identity: reference, predication and counting are “occasional”; identity is not. (shrink)

Social prejudices, economic discrimination, and deep-seated traditions and attitudes all harbor the seeds of systemic injustices within governing policies and institutions. The refusal on the part of a dominant class to recognize the rights and claims (...) of subaltern individuals and groups has both symbolic and material consequences. The power that one group exercises over another brings the refusal to recognize the rights and claims of others to the fore. Thanks to the moral priority that Paul Ricoeur accords to the victim against such refusals, I tie the fragility of identity to the idea of justice’s federating force. On the basis of ethnographic and historical material this article makes a comparative analysis of the relationship between public events, ceremonies and academic rituals, institutional identity, and processes of transition and power at two universities, one in Mexico and the other in South Africa. The public events examined here play a major role in imagining and bringing about political shifts within universities as well as between universities and external actors. In the so-called modern age, a transition can be observed in Western thought regarding this issue of tolerance. A perceptible shift can be seen in the understanding of tolerance as mere endurance to attempts to conceive of tolerance as a kind of well-grounded acceptance. It is regrettable, however, that this change in thinking has often remained hypothetical rather than heuristic. This certainly has to do with the fact that most of the time only large-scale theological, philosophical, or political projects were (...) negotiated. In this case, as is often happens, the directly concerned individual, the concrete person in the course of the demonstration efforts, was lost. We want to counter this loss with our study. In our investigation, which is based on a phenomenological reflection, we want to examine tolerance and respect as an existential problem couched within an individual. We wish to consider a person who desires to be tolerant and respectful; a person who accepts tolerance and respect as an existential task. (shrink)

In this chapter, I show that there is at least one crucial, non-short, argument, which does not involve arguments about spatiotemporality, why Kant’s subjectivism about the possibility of knowledge, argued in the Transcendental Deduction, must lead to idealism. This has to do with the fact that given the implications of the discursivity thesis, namely, that the domain of possible determination of objects is characterised by limitation, judgements of experience can never reach the completely determined individual, i.e. the thing in itself (...) or the unlimited real, but only objects as objects of possible experience. As such, it can be shown by reference to a key argument from Kant, that Hegel’s famous criticism that Kant is not licensed, on the basis of his core arguments concerning the original-synthetic unity of apperception, to restrict our knowledge to appearances, is mistaken on purely systematic grounds. More specifically, I argue that idealism follows already from the constraints that the use of the categories, in particular the categories of quality, places on the very conceivability of things in themselves. My claim is that, although it is not only possible but also necessary to think things in themselves, it does not follow that by merely thinking them we have a full grasp of the nature of things in themselves, as some important commentators claim we have. We must therefore distinguish between two kinds of conceiving of things in themselves: conceiving in the standard sense of ‘forming the notion of’, and conceiving in the narrow sense of ‘having a determinate intellectual grasp’. So although we must be able notionally to think things in themselves, as the grounds of their appearances, we cannot even conceive, through pure concepts, of how they are in themselves in any determinate, even if merely intellectual, sense. To put it differently, we cannot have a positive conception of things in themselves (this is in line with Kant’s distinction between noumena in the negative and positive senses; cf. B307–9). For support, I resort to a much overlooked chapter in the Critique, concerning the transcendental Ideal, where Kant discusses what it is for a thing to be a thing in itself proper, namely, something that is thoroughly determined. This concerns the real ontological conditions of things, which are not satisfied by the modal categories alone, namely, their existence conditions. I claim that the chief reason why, given Kant’s view of determinative judgement, we cannot determine a thing in itself is because of two connected reasons: (1) a thing in itself is already fully determined and therefore not further determinable and (2) we cannot possibly determine all of the thing’s possible determinations. In this context, I also discuss the notion of material (not: empirical) synthesis—of which Kant speaks in the chapter on the transcendental Ideal—which must be presupposed as the ground of the formal a priori synthesis that grounds possible experience. This material synthesis, which is an idea of reason that defines a thing as thoroughly determined with regard to all of its possible predicates and has mere regulative status, can by implication not be determined by the forms of the understanding, which synthesise only a limited set of predicates. As a result, given this definition of ‘thing in itself’, any object (appearance) as at best44 a limited set of determinations of the thing can never be numerically identical to the thing in itself as thoroughly determined individual. This undercuts a standard assumption about the identity relation between appearances and things in themselves in many contemporary interpretations of Kant’s transcendental idealism. (shrink)

The main contribution of this work is to develop the account of material constitution presented in Spatially Coinciding Objects (Ratio 24, 1982) and a series of related articles. This account was merely ‘analytical’ in that it applied generously to ‘putative’ examples of distinct entities (individuals, pluralities and masses of stuff) in the same place at the same time. The account herein is ‘critical’ in that it seeks justification for recognizing the existence of entities constituted in addition to the entities (...) that allegedly constitute them. While the earlier account used examples such as a clay statue and the clay of the statue for purposes of illustrating material constitution, the present account would consider ‘reducing’ the statue to the clay, and seeks justification for how to resist this and admit the existence of generable and perishable natural objects in general. The justification sought is ‘deep’ in the sense that (unlike the popular ‘method of cases) it does not belong to ‘descriptive’ metaphysics (in Strawson’s sense) but is sufficiently potent to counter ‘revisionist’ views. Transcendental arguments, beginning with austere assumptions of justification itself, are thereby employed. Suggestions are made about what to conclude about our own identity, which amount to supporting animalism. (shrink)

Many Christians assume that there are only two possibilities for what a human person is: either Animalism (the view that we are fundamentally animals) or Immaterialism (the view that we are fundamentally immaterial souls). I set out a third possibility: the Constitution View (the view that we are material beings, constituted by bodies but not identical to the bodies that now constitute us.) After setting out and briefly defending the Constitution View, I apply it to the doctrine of resurrection. (...) At his point of entry into practical philosophy, Kant remarked that just as theoretical philosophy must be grounded in a critical investigation of theoretical reason, practical philosophy must be grounded in a critical investigation of practical reason. He added, however, that the latter investigation must also exhibit practical reason’s “unity” with theoretical “in a common principle,” because “in the end there can be only one and the same reason, which must be distinguished merely in the application” (G, 4: 391). Soon (...) thereafter Kant published his critical investigation of practical reason, and in that work he drew comparisons between theoretical and practical reason and considered their relation to one another. […] But this problem presupposes the identity of reason. Only under the supposition that one and the same reason is at work in two applications could an apparent conflict between theoretical and practical reason pose a threat to unity. So before pressing forward to questions relating to unity, it may serve us well to ensure that we sufficiently comprehend reason’s identity. Kant’s fruitful insight that consciousness of the identity of the I think can yield recognition of the unity of the understanding encourages the anticipation that reflection on reason’s identity may similarly illuminate the unity of reason. Monists about material constitution typically argue that when Statue is materially constituted by Clay, Statue is just Clay. Pluralists about material constitution deny that constitution is identity: Statue is not just Clay. When Clay materially constitutes Statue, Clay is not identical to Statue. I discuss three familiar puzzles involving grounding, overdetermination and conceptual issues, and develop three new puzzles stemming from the connection between mereological composition and material constitution: a mereological puzzle, an asymmetry puzzle, and a (...) structural puzzle. This article engages critically with issues surrounding the theorization of the self and body relation, where the body is interpreted as material increasingly open to human intervention and choice. It is argued that this theorization rests upon a mind/body split that limits an understanding of embodied identity. The significance for feminism of undermining representational practices that rely upon this dualism are outlined and criticized for reproducing the logic of representation they set out to destabilize. An alternative strategy is (...) examined and the argument is made that to understand embodied identity the question must not be what do bodies mean but what can they do. Here feminist approaches that rely upon a radically different ontological position in order to move beyond the mind/body split are utilized. These theoretical debates are made meaningful through the lens of self narratives produced by young women–a context which demands the development of strategies for theorizing lived bodies. (shrink)

Mitochondrial donation poses the latest regulatory challenge for policy-makers in the context of assisted conception. Since 2010 the Human Genetics Commission, the Human Fertilisation and Embryology Authority and the Nuffield Council on Bioethics have all considered the policy implications of permitting use of these techniques in treatment. The Nuffield Council on Bioethics reported its recommendations in June 2012 following a consultation on the ethical issues raised by these techniques; and a separate consultation by the Human Fertilisation and Embryology Authority in (...) conjunction with Sciencewise-ERC followed in September 2012. Matters for consideration included the potential relationships created by the use of three parties’ genetic material and the associated ramifications, eg whether or not there is a need to establish records of such donations and, if so, to whom should information later be provided? Thus, mitochondrial donation poses both novel and familiar questions about the ‘genetic family’, ‘parentage’ and ‘identity’. This article explores some of the ways in which mitochondrial DNA is constructed as relatively significant in recent Parliamentary debates, policy and consultation documents. It reflects on the ways in which the role of some genetic connections, or lack thereof, are mediated in law and policy. (shrink)

In the second edition of the Essay Concerning Human Understanding, John Locke argues that personal identity over time consists in sameness of consciousness rather than the persistence of any substance, material or immaterial. Something about this view is very compelling, but as it stands it is too vague and problematic to provide a viable account of personal identity. Contemporary "psychological continuity theorists" have tried to amend Locke's view to capture his insights and avoid his difficulties. This paper (...) argues that the standard approach fails because it takes Locke to be a memory theorist, and does not focus enough on his claim that we need continuity of consciousness for personal persistence. An alternative reading of Locke is offered, emphasizing the role of self-understanding in producing continuity of consciousness. This alternative overcomes the difficulties with the standard approach, and shows how it is possible to attribute unconscious psychological elements to a person, even when personal persistence is defined in terms of consciousness. The idea that two objects can coincide—by sharing all their proper parts, or matter—yet be non-identical, results in the “Problem of Coincident Objects”: in what relation do objects stand if they are not identical but share all their proper parts? One solution is to introduce material constitution. In this paper, I argue that this is ad hoc since, first, this solution cannot be generalized to solve similar problems, and, second, there are pseudo cases of coincidence that should not trigger (...) the introduction of material constitution and these cannot be distinguished in any principled way from the allegedly real cases of coincidence. The epistemological and ontological aspect of "interpretation" in the structure of narrative identity is considered. A model for representing the structure of narrative identity in the form of a hermeneutic spiral is proposed. The problem of the significance of the narrative for human existence is analyzed from the point of view of two opposite positions. The first, arguing that the narrative is a "cognitive tool" through which a meaningful order is retrospectively constructed that falsifies the true nature of (...) the subject's experience of existence. The analysis of this point of view is based on the tradition of narrative criticism formed by such philosophers as Arthur Danto, Louis Mink, Hayden White and Peter Strawson, who conceptualize the narrative as a "cognitive tool". The opposite position is a philosophical view of the narrative as an ontological category that characterizes a special way of being a person. The analysis of narrative as a constitutive element of human existence draws on the tradition of the hermeneutic method, the work of Paul Ricœur and Charles Taylor. It is argued that the experience of human existence cannot be reduced solely to narrative, but this does not contradict the fact that narrative interpretations of experience play a constitutive role in human existence. The conclusion is formed that an important element for understanding the ontological meaning of the narrative is the fact that narrative interpretations have a real impact on our existence in the world: they allow us to construct our self, take part in the creation of the intersubjective world and influence how we interact with others. From an empirical point of view, this means that interpretations have real, material, world-forming consequences. Scholars who deny the capacity of narratives to constitute human existence, view the meaning and role of (self-)interpretation from an anti-realist point of view, and adhere to the ontological assumption that there is an experience of understanding reality that does not depend on the human ability to give meanings. This chapter examines how Spinoza deals with the identity problem by looking at his account of material and mental things. To understand how material things can remain the same over time, it looks at the “Physical Digression” where Spinoza explains the constitution of bodies. By using the structural criterion, Spinoza can solve a number of problems concerning identity and change. Spinoza would say that there is no identity between the body before and after the accident (...) because the proportion between its moving and non‐moving parts is no longer the same. Memory plays no decisive role, and can therefore be disregarded in the account of diachronic identity. Spinoza goes far beyond the Aristotelian conception by spelling out the form in kinetic terms for material things, and in representational terms for mental things. (shrink)

The Principle of the Identity of Indiscernibles, commonly attributed to Leibniz, has given rise to much discussion and debate. Thus philosophers have argued over how it should be formulated, whether it is true, and what, if any, metaphysical consequences it has.It is not my intention to add to these discussions here, having done so elsewhere. Rather, I intend to introduce and defend a closely related principle which I shall, for want of a better name, refer to as The Principle (...) of the Identity of Necessary Similarity’.In section II, I briefly recapitulate some of the distinctions and other relevant points which are customarily made in connection with. This is all too familiar material, but it is necessary in order to provide a general framework of concepts in terms of which we can discuss in an intelligible fashion. (shrink)

The ambiguous material identity of nanotechnology is a minor mystery of the history of contemporary science. This paper argues that nanotechnology functioned primarily in discourses of social, not physical or biological science, the problematic knowledge at stake concerning the economic value of state-supported basic science. The politics of taxonomy in the United States Department of Energy’s Office of Basic Energy Sciences in the 1990s reveals how scientists invoked the term as one of several competing and equally valid candidates (...) for reframing materials sciences in ways believed consonant with the political tenor of the time. The resulting loss of conceptual clarity in the sociology of science traces ultimately to the struggle to bridge the disjunction between the promissory economy of federal basic science and the industrial economy, manifested in attempts to reconcile the precepts of linearity and interdisciplinarity in changing socio-economic conditions over a half century.
