Using the emerging technology of large-scale textual analysis, this study examines the use of the term ‘customer satisfaction’ and its variants in the annual reports issued by publicly traded U.S. corporations and filed with the Securities and Exchange Commission as Form 10-K. We document the frequency of the term’s occurrence in 10-Ks over the 1995–2013 period and the differences in usage across industries. We then relate the term’s usage in 10-Ks to subsequent scores from the American Customer Satisfaction Index to (...) determine whether management’s discussion of customer satisfaction in financial disclosures is credible. The commitment of management to shareholders versus, more broadly, stakeholders is a central question in business ethics, and the integrity of management communication is a fundamental construct in the American Marketing Association’s Statement of Ethics. We document a complex relation between management’s discussion of customer satisfaction and subsequently reported satisfaction. We find that the general use of customer satisfaction in 10-K documents is negatively correlated with subsequent ACSI scores. However, for retail firms, when the phrase is located near words indicating measurement or monitoring of the phenomenon, the empirical relation is reversed and becomes positive. (shrink)

Designing security measures often involves trade-offs between various types of objectives. Multiple stakeholders may have conflicting demands and may have different ideas on how to resolve the resulting design conflicts. This paper reports on an application of value-sensitive design. Based on argumentation theory and social values, the paper develops a structured approach for discussing design conflicts, called value-based argumentation. The application domain examined in the paper is concerned with physical safety and security issues that arise in cross-border shipments. (...) We first identify the kinds of dialogues that take place in this domain, in particular, audit dialogues to determine whether security measures comply with regulations. Based on argumentation theory we develop a formal language and a diagramming approach intended to facilitate parties in identifying, discussing and reaching agreement about security risks and corresponding mitigation measures. Trade-offs can be dealt with by making underlying values explicit. Using a stylized example, the approach was successfully taught to practitioners working with EU customs regulations. Practitioners generally found the approach helpful, in particular to bring out implicit underlying motivations. We conclude by discussing how our approach can be generalized to other kinds of dialogues involving design conflicts. (shrink)

Internet of thing building sensors can capture several types of building operations, performances, and conditions and send them to a central dashboard to analyze data to support decision-making. Traditionally, laptops and cell phones are the majority of Internet-connected devices. IoT tracking allows customers to close the distance between devices and enterprises by collecting and analyzing various IoT data through connected devices, customers, and applications on the network. There is a lack of requirements for IoT edge applications security and approval. (...) There are no best practices regarding operations focused on IoT incidents. IoT elements are not covered by audit and logging requirements. In this article, a big data analytics-based customer operation system analyzes the operation. With the exponential rise in data usage, the explosive development in the IoT devices reflects the ideal overlap of big data growth with IoT. Big data analytics continuously evolving network raises trivial questions about the performance, distribution of data, analysis, and protection of data collection. IoT modifies almost all the construction industry characteristics. Human-centered artificial intelligence is described as systems that always improve because of human input while also delivering an effective experience between the human and the robotic. The IoT is the key factor that ensures greater building performance. It was the first evolution of technology in a long time to turn genuine inventions into an industry that depended heavily on paper and manual processes. The benefits of the IoT in construction are now quite obviously much heavier than those of current manual processes. As a result, more construction companies explore and incorporate IoT strategies to address their productivity challenges, increasing efficiencies and profits. The simulation analysis shows that the proposed BDA-CO model enhances the trust score of 98.5%, accuracy detection ratio of 93.4%, probability ratio of 97.6%, and security ratio of 98.7% and reduces the false negative ratio of 21.3%, response time of 10.5%, delay rate of 19.9%, and packet loss ratio of 15.4% when compared to other existing techniques. Purpose: The research explored empirical evidence to assess the impact of cyber security and supply chain risk on digital operations in the UAE pharmaceutical industry. Methodology/Design/Approach: Based on responses from 243 personnel working at 14 pharmaceutical manufacturing companies in Dubai, data were examined for normality, instrument validity and regression analysis. Cyber security and SC risk on digital operations were explored by applying convenient sampling and descriptive and analytical research design. Findings: The findings validated the significant positive association between (...) cyber security and supply chain risk with digital operations. Research implications and Limitations: The research model was developed with three variables evaluated only on the pharmaceutical industry in Dubai. Future research should focus on multiple manufacturing industries by covering a larger geographic area. Practical implications: When suppliers are highly concentrated, customer-focused organisations with uncertain levels of digital transformation could improve their ability to manage supply chain risk by diversifying their clients. Pharmaceutical firms may require a greater focus on technology-based manufacturing firms to build and maintain customer trust. El problema fue abordado desde la perspectiva de la calidad en el servicio y la satisfacción delcliente a través de la aplicación de encuestas Servqual a algunos clientes de la compañía. In Mexico, the promotional marketing has emerged as the second largest marketing investment,mainly because companies tend to outsource most often the operational aspects of marketing. Thosecompanies are increasingly demanding security and certainty in the delivery of services. As a consequence,service quality has become a determining factor in the election of a sales promotion agency. This technicalpaperwork shares a case study related to a sales promotion company facing high customer defection rate withits consequent contraction in sales, but ironically immersed in a market that has a sustained growth of 15 per cent in recent years. Approach of the problem was from quality service and customer satisfaction perspectivethrough the use of Servqual surveys applied to some customers. These surveys allowed: to identify relevantdimensions of quality service, to identify opportunities between the expected service and the actual service,and the development of an action plan which was later systematized and implemented. At present, customers’ low satisfaction and loyalty to city express service have restricted the development of city express. It is particularly important to analyze the factors causing customers’ low satisfaction and loyalty, which will promote the development of city express industry effectively. Based on SERVQUAL model and CCSI model, this paper constructs a new evaluation index system from the perspective of service quality. Through this new system, this paper first explores the factors that affect customers’ satisfaction and loyalty, respectively, by (...) fuzzy analytic hierarchy process and hierarchical regression analysis, taking the expected and perceived service quality as conversion variables. And then it analyzes the common factors that affect customers’ satisfaction and loyalty comprehensively. These two analyses will provide reference for solving the problem of low customer satisfaction and loyalty of city express enterprises. The results show that popularity and credibility, delivery time commitment, and mailing security are the common main factors affecting customer satisfaction and loyalty. The study looks into a number of factors, including digital engagement, customer satisfaction, service personalization, customer loyalty, service accessibility, trust and security. The study involves 600 banking customers filling out a questionnaire after being informed about the purpose of the survey. SPSS was employed to conduct various statistics tests such as, pearson correlation, chi square, and t-test the obtain data and variables. The result indicates a positive correlation between the adoption of digital banking solutions and increased customer engagement. Research results underscore the importance of continued investment in a digital technologies to maintain a competitive edge in the banking industry. That is why this article focuses on the need for increased awareness of externalities and liability among ICT professionals and their customers. This is critical to achieve in order to promote appropriate ICT technologies and services with comprehensible privacy and security protection. This would benefit customers and increase trust in ICT products and services which in turn may even increase suppliers' profit margin; customers would be prepared to buy more services and products if contracts and service level agreements would accept more liability. Artificial intelligence (AI) has sparked interest in various areas, including marketing. However, this exhilaration is being tempered by growing concerns about the moral and legal implications of using AI in marketing. Although previous research has revealed various ethical and legal issues, such as algorithmic discrimination and data privacy, there are no definitive answers. This paper aims to fill this gap by investigating AI’s ethical and legal concerns in marketing and suggesting feasible solutions.,The paper synthesises information from academic articles, industry reports, (...) case studies and legal documents through a thematic literature review. A qualitative analysis approach categorises and interprets ethical and legal challenges and proposes potential solutions.,The findings of this paper raise concerns about ethical and legal challenges related to AI in the marketing area. Ethical concerns related to discrimination, bias, manipulation, job displacement, absence of social interaction, cybersecurity, unintended consequences, environmental impact, privacy and legal issues such as consumer security, responsibility, liability, brand protection, competition law, agreements, data protection, consumer protection and intellectual property rights are discussed in the paper, and their potential solutions are discussed.,Notwithstanding the interesting insights gathered from this investigation of the ethical and legal consequences of AI in marketing, it is important to recognise the limits of this research. Initially, the focus of this study is confined to a review of the most important ethical and legal issues pertaining to AI in marketing. Additional possible repercussions, such as those associated with intellectual property, contracts and licencing, should be investigated more deeply in future studies. Despite the fact that this study gives various answers and best practices for tackling the stated ethical and legal concerns, the viability and efficacy of these solutions may differ depending on the context and industry. Thus, more research and case studies are required to evaluate the applicability and efficacy of these solutions in other circumstances. This research is mostly based on a literature review and may not represent the experiences or opinions of all stakeholders engaged in AI-powered marketing. Further study might involve interviews or surveys with marketing professionals, customers and other key stakeholders to offer a full knowledge of the practical difficulties and solutions. Because of the rapid speed of technical progress, AI’s ethical and regulatory ramifications in marketing are continually increasing. Consequently, this work should be a springboard for more research and continuing conversations on this subject.,This study’s findings have several practical implications for marketing professionals. Emphasising openness and explainability: Marketing professionals should prioritise transparency in their use of AI, ensuring that customers are fully informed about data collection and utilisation for targeted advertising. These tools can identify and address biases in AI algorithms, safeguard consumer privacy and extract valuable insights from consumer data.,This study’s social implications emphasise the need for a comprehensive approach to address the ethical and legal challenges of AI in marketing. This includes adopting a responsible innovation framework, promoting ethical leadership, using ethical decision-making frameworks and conducting multidisciplinary research. DNA databases have significant commercial value. Direct-to-consumer genetic testing companies have built databanks using samples and information voluntarily provided by customers. As the price of genetic analysis falls, there is growing interest in building such databases by paying individuals for their DNA and personal data. This paper maps the ethical issues associated with private companies paying for DNA. We outline the benefits of building better genomic databases and describe possible concerns about crowding out, undue inducement, exploitation, and commodification. This article investigates the claims and complexities involved in the platform-based economics of health and fitness apps. We examine a double-edged logic inscribed in these platforms, promising to offer personal solutions to medical problems while also contributing to the public good. On the one hand, online platforms serve as personalized data-driven services to their customers. On the other hand, they allegedly serve public interests, such as medical research or health education. In doing so, many apps employ a diffuse discourse, hinging (...) on terms like “sharing,” “open,” and “reuse” when they talk about data extraction and distribution. The analytical approach we adopt in this article is situated at the nexus of science and technology studies, political economy, and the sociology of health and illness. The analysis concentrates on two aspects: datafication and commodification. We apply these analytical categories to three specific platforms: 23andMe, PatientsLikeMe, and Parkinson mPower. The last section will connect these individual examples to the wider implications of health apps’ data flows, governance policies, and business models. Regulatory bodies commonly focus on the safety and security of apps, but pay scarce attention to health apps’ techno-economic governance. Who owns user-generated health data and who gets to benefit? We argue that it is important to reflect on the societal implications of health data markets. Compliance is often achieved ‘by design’ through a coherent system of controls consisting of information systems and procedures. This system-based control requires a new approach to auditing in which companies must demonstrate to the regulator that they are ‘in control’. They must determine the relevance of a regulation for their business, justify which set of control measures they have taken to comply with it, and demonstrate that the control measures are operationally effective. In this paper we show how value-based argumentation (...) theory can be applied to the compliance domain. Corporate values motivate the selection of control measures (actions) which aim to fulfil control objectives, i.e. adopted norms (goals). In particular, we show how to formalize the audit dialogue in which companies justify their compliance decisions to regulators using value-based argumentation. Did the September 11, 2001 terrorist attacks on the U.S. cause the values of teenagers in the U.S. to change? Did their previously important self-esteem and self-actualization values become less important and their survival and safety values become more important? Changes in the values of teenagers are important for practitioners, managers, marketers, and researchers to understand because high school students are our current and future employees, managers, and customers, and research has shown that values impact work and consumer-related attitudes and (...) behaviors. Further, studies that compared higher to lower performing for-profit and not-for-profit companies have found that higher performing organizations had strong values that permeated their organizations [Collins J. C., and J. I. Porras: 1994, Built to Last: Successful Habits of Visionary Companies (New York, Harper Business); O’Reilly, C. A. and J. A. Chatman: 1996, in B. M. Staw and L. L. San Francisco, Jossey Bass)]. While one study of adults found value changes, no known studies have explored if the values of teenagers also changed post-9/11. This study filled that research gap by exploring the values of a random sample of 1000 U.S. teenagers in grades 9 to 12 pre- and post-9/11, using a demographic questionnaire and the Rokeach Value Survey. The research results indicated that teenage survival, safety, and security values (a world at peace, freedom, national security, and salvation) increased in importance while their self-esteem and self-actualization values (a sense of accomplishment, inner harmony, pleasure, self-respect, and wisdom) decreased in importance, mirroring the changes for adults. Background: Identifying and safeguarding ethics in eHealth services from the service users’ perspective in social care and healthcare is important. The use of eHealth services should not prejudice the quality of services or the social interaction required in care. There is a lack of studies about the ethics of eHealth services from the service users’ perspective. Aim: The aim of this study is to identify and analyse ethical issues related to eHealth in social care and healthcare from the service users’ (...) perspective. Research design: An integrative literature review. Ethical considerations: The review followed good scientific conduct. Research context and data sources: A systematic literature search was performed using CINAHL, Scopus, PubMed/MEDLINE, Web of Science, Cochrane Library and Academic Search Premier to find relevant empirical studies published in English from their earliest up to 30 November 2018. In addition, reference lists from the identified research papers were searched. A quality appraisal of each paper included in the review was conducted before thematic analysis. Results: In total, 26 studies were included in the review, and from these four ethical themes were identified: (1) privacy in eHealth, (2) beneficence and nonmaleficence in eHealth, (3) justice in eHealth and (4) trust in eHealth. The ethical issues within these themes were related to information sharing; ownership; access to information and data protection; informed consent; defence of rights; and equity, equality and proportionality of response. Conclusion: eHealth inequality occurs in social care and healthcare. eHealth service designers and social care and healthcare professionals need to act to maintain and improve user access and data accuracy and provide different levels of security in eHealth services, relative to the information stored. There is a need for further research about ethical issues of eHealth from the user’s perspective, including the customer-oriented availability and usability of eHealth services which avoid discrimination. Advancement in internet of things and proliferation in the use of smart devices have raised concerns about the data privacy of online users. This study predicts the consequences of perceived data privacy risks on consumer behaviours in Lagos State, Nigeria using the integrated Entropy-Technique for Order Preference by Similarity to Ideal Solution. We employed Entropy to assign weights to each criterion. Subsequently, responses were systematically ranked to arrive at an inference using TOPSIS. 84.8% agree that any perceived cyber security (...) threat or a breach in their data privacy would stop them from proceeding with the transaction or activity online, or the use of a digital product. Similarly,, agree it is critical that online businesses only ask for customer information that is relevant to the use of the product or service. Thus, the findings indicate that the privacy paradox of enlightened online consumers tends to diminish when they are faced with perceived data privacy and cybersecurity risks. (shrink)

Given the rapid growth and emerging trend of e-commerce have changed consumer preferences to buy online, this study analyzes the current Indian legal framework that protects online consumers’ interests. A thorough analysis of the two newly enacted laws, i.e., the Consumer Protection Act, 2019 and Consumer Protection Rules, 2020 and literature review support analysis of 290 online consumers answering the research questions and achieving research objectives. Besides factors such as security, privacy, warranty, customer service, and website information, laws governing consumer rights protection in e-commerce influence customers’ trust. Growing e-commerce looks promising with a robust legal framework and consumer protection measures. The findings contribute to the body of knowledge on e-commerce and consumer rights protection by elucidating the key factors that affect customer trust and loyalty and offering an informative perspective on e-consumer protection in the Indian context with broader implications. In a world where issues of food safety and food security are increasingly important, the social responsibility of central actors in the food chain—producers and the main grocery chains—becomes more pressing. As a response, these actors move from implicitly assuming social responsibilities implied in laws, regulations and ethical customs, towards explicitly expressing social responsibilities. In this paper, we discuss the ethical values relevant for the social responsibility of central food producers and retailers in Norway, one of the most (...) subsidized and protected areas of food production in the world. How do the actors perceive and express their social responsibility, and—given their position in the local, national and global market—how should they handle these responsibilities? We analyze Tine and Nortura, two producers owned by farmer cooperatives with market regulator function, as well as Coop—a dominant grocery chain in Norway, with basis in the same public ownership model as the farmer-owned cooperative producers. While the complex roles of these key actors in the Norwegian food market have been criticized from several angles, we argue that these multifaceted roles put them in a good position to promote informed consumer choices in a globalized market. Generally, regulation is thought of as a constant that carries with it both a formative and conservative power, a power that standardises, demarcates and forms an order, through procedures, rules and precedents. It is dominantly thought that the singularity and formalisation of structures like rules is what enables regulation to achieve its aim of identifying, apprehending, sanctioning and forestalling/pre-empting threats and crime or harm. From this point of view, regulation serves to firmly establish fixed and stable categories of what norms, (...) customs, morals and behaviours are applicable to a particular territory, society or community in a given time. These fixed categories are then transmitted onto individuals by convention, ritual and enforcement through imperatives of law (and technology) that mark certain behaviours as permissible and others as forbidden, off bounds. In this manner, regulation serves a programming (i.e., a calculable or determinable) purpose. It functions as a pro-active management or as a mastery of threats, risks, crimes and harms that affect a society and its security both in the future and in the present. Regulation for instance, will inscribe and codify what it determines to constitute crime or harm such as pornography, incitement of terrorism, extremist speech, racial hatred etc. These determined or calculated/calculable categories will then be enforced and regulated (e.g. through automated filtering) in order to ensure a preservation of public order within society. Drawing mainly from deconstruction, this article situates law and technologies within a wider ecological process of texts, speech and writing i.e., communication. In placing regulation within disseminatory and iterable processes of communication, this article complicates, destabilises and critiques the dominant position of determinability and calculability within the regulatory operations of law. On May the 3rd, 2002, the European Centre for Ethics held the Politeia Conference in the Palace of the Royal Academy in Brussels. The conference title was The Rise of Lifestyle Politics and its Consequences for Liberty. In this issue we present the lectures delivered during this conference.The Politeia Conference intends to familiarize a broad public with innovative ideas to stimulate dialogue about the future of our society. Held every two years, the Politeia Conference invites internationally renowned academics with inspiring (...) views about social and political events.The conference is an interdisciplinary initiative. The conference enjoyed the support of the Royal Flemish Academy of Belgium for Arts and Science. It was a joint inter-university event, with the participation of K.U.Leuven, V.U.Brussels, the University of Ghent and the University of Antwerp.Until recently, political ideology provided a broad context of meaning and united a large group of people who strived for the same social ideals. The communication between the leadership of a political party and the grass-roots members went by way of local party representatives, and the voter's ballot was a sign of trust in the ability of the party leadership to translate their ideas into concrete political decisions.Now it seems that the traditional ideology-based political movements are a thing of the past. Their role and influence is in decline, while the importance of communication through the mass media has increased dramatically. Politicians are finding it necessary to show their faces on television.The efforts they make in diligently following certain issues turn out to be less 'rewarding' than submitting noteworthy legislative proposals, making audacious pronouncements, or participating in talk shows or demonstrations. What appeals nowadays to the reader or viewer — i.e., the voter — is not in the first place a specific message or a powerful argument.The focus now is on the politician as an individual, the lifestyle he personifies, and whether or not he is a smooth talker. In such an environment, political communication has a great deal in common with advertising. But when the majority of citizens entertain themselves with media spectacles and exhibit little interest in substantive arguments about decisions made at an increasingly abstract and global level, then political power withdraws from the eye of public opinion.A potentially troubling development that goes together with the waning influence of traditional political ideologies is the shift towards a more meritocratic society. The highest aspiration of a society driven by economic growth is not the general welfare or service to the community, but personal success.People are not judged on the basis of their loyalty and commitment to their organization, but on their individual achievements and belongings. However, a growing number of citizens feel they are unable to attain the kind of achievements and obtain the belongings that command respect today. This feeling of powerlessness has less to do with intellectual baggage or material considerations than with a lack of social recognition for their accomplishments.This malaise is particularly acute among those working in sectors where the emphasis is on the general public welfare and where career rewards are relatively meagre: education, health care and various other public services. Identification with the dominant political culture is also problematic among immigrants, who tend to work in low-prestige jobs and bear the stigma of a foreign origin.For these reasons, a growing number of people are distancing themselves from 'official' culture and taking refuge in the virtual enclaves of various mass media where a carefully cultivated house style ensures an attractive forum for a specific target group.A network or a newspaper that aims at a clearly definable segment of the population is an excellent medium for targeted advertising. Moreover, the creation of an atmosphere in which viewers, listeners and readers all feel at home benefits customer relations. Just as in real enclaves, the creation of a virtual enclave with an 'us versus them' presupposes a pressure to conform.Someone who does not meet the implicit expectations that are cultivated within a particular medium is denied access to the medium. Anything ugly, strange or out of the ordinary is held up to ridicule or indignation. The authority of a house style applies not only to the choice of fictional content, but also to the sort of news that is reported. News of crime and scandal is much better at strengthening the virtual solidarity of the group of insiders than abstract information concerned with the well-being of the actual society or world community.A virtual group gives the viewer, listener or reader a feeling of security, but it also undoubtedly contributes to a provincialism characterized by suspicion of everything complex, new or foreign. People who are susceptible to taking refuge in a virtual enclave are often the same people who feel attracted to political parties who favour a mono-ethnic enclave.In any case, there exists a demonstrable connection between the amount of television a person watches, a preference for commercial networks, soaps and game shows, on the one hand, and the choice of authoritarian leadership and xenophobia, on the other. This is a worrying state of affairs, in particular given the recent electoral success of anti-democratic parties in Europe.In order to resist anti-democratic feelings, we clearly need another sort of politics than 'lifestyle politics'. One aim of the Politeia Conference was to ask whether the decline of traditional ideology-based politics is an irreversible fact in light of the impact of the free market on the aspirations of citizens. Or is it possible to keep politics and the media out of the purely economic sphere, to create zones for real political debate and ethically inspired journalism? Managers often ask why their firm should have an ethics program, especially if no one has complained about unethical behavior. The pursuit of business ethics can cost money, they say. It can lose sales to less scrupulous competitors and can drain management time and energy. But as Harvard business professor Francis Aguilar points out, ethics scandals (such as over Beech-Nut's erzatz "apple juice" or Sears's padded car repair bills) can severely damage a firm, with punishing legal penalties, bad publicity, and (...) irreparably injured customer relations. Equally important if less obvious, unethical behavior can undermine a firm's organizational spirit. On the other hand, Aguilar argues, in a well run firm, ethical programs can actually enhance corporate performance, strengthening the company at every level and supercharging employee risk taking and innovation. In Managing Corporate Ethics, Aguilar shows managers how to create ethical programs within their organizations that not only discourage large-scale wrongdoing, but can contribute substantially to the achievement of corporate excellence. Aguilar's program is down-to-earth and comprehensive, and based on his extensive research on highly successful, ethical companies, both large and small. He recommends action on three fronts: first, get senior management to provide effective ethical leadership; second, set up an ethics program that promotes concern for the interests of people affected by the firm's operations and that provides safeguards against corrupting business pressures; and third, staff the company with ethical people and surround the organization with ethical advisors (including legal, financial, accounting, tax, and marketing consultants). And he details how Armstrong World Industries uses pep talks, inspirational stories, role models, and ready access to management to promote ethical standards among employees. Throughout, Aguilar demonstrates convincingly that an ethical program pays dividends: that employees, suppliers, customers, and the community at large know when they are being treated in a positive and constructive manner, and are likely to respond in kind. A legal system is any institution or set of institutions in a given society that provides dispute resolution in a systematic and reasonably predictable way. it does so through the exercise of three functions: the judicial, the legislative, and the executive. The judicial function, the adjudication of disputes, is the core of any legal system; the other two are ancillary to this. The legislative function is to determine the rules that will govern the process of adjudication (this function may be (...) merged with the judicial function, as when case law arises through precedents, or it may be exercised separately), while the executive function is to secure submission (through a variety of means, which may or may not include violence) to the adjudicative process and compliance with its verdicts. A government or state (for present purposes i shall use these terms interchangeably) is any organisation that claims, and in large part achieves, a forcibly maintained monopoly, within a given geographical territory, of these legal functions, and in particular of the use of force in the executive function. now the market anarchist objection to government is simply a logical extension of the standard libertarian objection to coercive monopolies in general.1 First, from a moral point of view, among people regarded as equals2 it cannot be legitimate for some to claim a certain line of work as their own privileged preserve from which others are to be forcibly excluded; we no longer believe in the divine right of kings, and on no other basis could such inequality of rights be justified. Second, from an economic point of view, because monopolies are insulated from market competition and hold their customers by force, they lack both the information and the incentive to provide consumers with fair, efficient, and inexpensive service. The anarchist accepts these arguments, and merely asks why they should apply with any less force to the provision of legal services. (shrink)

Le Louvre-Abou Dabi est un exemple saillant de cette tendance mondialisée, tout comme Guggenheim, il devient un jalon mobile de l’art et de la culture. Although supposed to be instructive, they are embarking on a controversial policy of pleasing the public in order to exist, the ultimate aim being to draw as many “customers” as possible to secure their future. And in pursuing these aims, they have been exporting themselves, just like any commercial brand, to nation-cities seeking a “place” on the globalised map. The Abu Dhabi Louvre is a striking example of this global trend, as is the Guggenheim, which has now become a movable landmark in the arts and culture landscape. This phenomenon of “existence through architecture” is turning architectural works into objects as well as tools to enhance communication and notoriety, a development that has more to do with marketing than with culture. But given this new status, where the building itself guarantees the museum’s existence and contemporaneity, how much interest is there in its collections? And to what extent is every museum’s share of public responsibility for collective cultural development likely to compromised by “market forces”? (shrink)

This paper presents the state of corporate social responsibility in Pakistan since it has been driven in the country by the Securities and Exchange Commission of Pakistan, the UN Global Compact, and trade liberalization under the WTO. This study is based on responses obtained from 51 Pakistani companies and 20 MNCs. It was found that MNCs were found to be more socially responsible to customers, to suppliers in terms of their purchasing procedures, to the environment, to their employees, to the (...) community by contributing more to the community’s education and health, and in their greater commitment to ethics. Pakistani companies need to improve their performance on CSR to gain competitive advantage. (shrink)

The recent takeover and merger trend cries out for ethical evaluation. This essay proposes a model for evaluating them in terms of their impact on a firm's immediate stakeholders: investors, owners, management and employees. Since mergers and takeovers are Transfers of Ownership of Firms (TOFs) they entail a property ethic of ownership, control, securing stakeholder interests, and defining which stakeholders should exercise these rights. I use the model to evaluate two fictional cases, a friendly merger and a hostile takeover. The (...) results show that neither TOF serves all interests equitably. Since the control structure of the private firm is legitimized by its interest structure, I reason that both should be reformed. Both rest on a broader economic rationale; but it is controverted. Accordingly, the economic and ethical evaluation of TOFs, I conclude, both entail the democratic reform of the control structure of the firm.A corporation represents far more than its current stock price; it embodies obligations to employees, customers, suppliers and communities. Panarchy suggests that an optimal framework for the emergence of the best states is that of free competition between states. In Panarchy, people and states negotiate the relationships between them, as sellers and buyers and formalize them in explicit social contracts. Different states may offer varying levels of services in areas such as health, education, and social security for different prices. Low costs for consumer mobility from state to state are necessary for competition. These can be optimized by non-territorial (...) states that offer services to citizens instead of rule a territory and compete over customers in a political market. The right of such states to coerce their clients differentiates them from mere protective associations, and is founded on explicit social contracts (law codes) rather than on monopoly over territory-- sovereignty. First, I explicate the unique properties of Panarchy, non-territorial states and explicit social contracts. Then, following the theories of Douglass North (1986) and Albert Hirschman (1970) I explain why Panarchy appears to be an appropriate framework for avoiding political monopolies and increasing political competitiveness and efficiency through cheap exit mechanisms. Then, I consider possible challenges to Panarchy: Panarchy may be utopian if the state is a natural monopoly; Panarchy does not advocate any political utopia but it may reify the utopian element to the meta-political level, to the preconditions for the emergence of the best states. If non-territorial states are inconsistent with human nature, they may be utopian. I also consider possible ethical objections to Panarchy. I argue that: The territorial sovereign state is not a natural monopoly. A free market in non-territorial states does not have to assume a coercive monopoly regulatory “super-state.” The territoriality of the state is not natural. Though there are valid ethical criticisms of Panarchy, from a utilitarian perspective, they are outweighed by ethical arguments that support it. Finally, I argue that several recent technological innovations have rendered the sovereign nation-state increasingly obsolete, while facilitating and reducing the costs of establishing Panarchy and running non-territorial states. Basic characteristic of Islamic heritage law, principally it has accepted the two-to-one ratio between the male and the female children/siblings in division of heritage. In Islamic inheritance law, the main/basic reason why the share of the male is twice the share of the female is no “value” judgments given to female/women in creation and gender in Islam, on the contrary, are real realities related with the roles and financial obligations that man and woman have undertaken, in other words, related with (...) “socio-economic structure/fact” in the family and society structure foreseen by Islam. As a matter of fact, “need principle” is based on in division and succession of heritageand a fair arrangement has been made in accordance with the rights and responsibilities of the husband and wife in Islamic Law. In some classical tafsīr books, the concept of “degree” in the verse “... Men have a degree (right) over women” (Al-Baqara 2/228) mentioning the mutual rights and responsibilities of women and men; and the expression of “lil al-dhakari mithlu haẓẓ al-unthayain” in the verse –the inheritance of man is the share of two women– (Al-Nisā 4/11) mentioning the inheritance shares of boys and girls is interpreted against the woman by disregarding the intended purpose and socio-economic contexts of these verses. As a result of this interpretation, the share of men in inheritance is twice the share of women in Islamic law is ontologically (existential/creation) based on a justification that “man is superior to woman”. In this article/study, an analyticallook atthe interpretations in some classical tafsīr books on the axis of “daraja/degree” and “lil al-dhakari mithlu haẓẓ al-unthayain” that today sheds light on the sociological-historical background of depriving the daughter from the heritage will be made. Summary: Just as there is no way to determine a person’s sex, it is not either possible by reason to have such an opportunity. - With the possibility of medical intervention nowadays - sex is determined by the discretion of the Supreme Creator rather than will. Indeed, it is mentioned in the Qur’ān: To Allah belongs the dominion of the heavens and the earth; He creates what he wills. He gives to whom He wills female [children], and He gives to whom He wills males (Al-Shūrā 42/49.)In addition to human biological sex, there is also social gender. Indeed, the term “sex” refers to being biologically female or male, while the term "gender" refers to the social and cultural identity of a woman or man, or the social roles that occur in the historical process.Accordingly, while it is not possible to determine biological sex (in normal circumstances in advance), determining gender is shaped by the cultural will of individuals and societies. As a matter of fact, gender is shaped according to the religions, customs and cultures of the societies and it shows differences according to time, culture and family structure. In this context, in the pre-Islamic Arab society, the gender of the girl or the woman was shaped by the custom of the ritual and customs. Indeed, it is a known fact that during the period of Jahiliyyah, in terms of social gender, the girl/woman has been deprived of many social and economic rights, especially heritage. The Qur’ān has brought the girls who, in the period of Jahiliyyah, were oppressed in terms of gender, deprived of many social and economical rights, treated as second class human, embarrassed of themselves and buried alive, to the same position as man. In this context, as it is in every field in the direction of social structure and social conditions of that day, also in the field of inheritance law, a number of regulations were made in the Qur’ān and the Sunnah being the main sources of Islam. The divisions of the inheritance were connected with religious and legal rules and the shares of the inheritance of the sons and daughters were determined by naṣṣ (verses and hadiths).However, in Islamic inheritance law, as a requirement of the structure of family and society accepted by Islam, in principle, “two-to-one” measures have been adopted between male and female children. As a matter of fact, in this aspect, it is mentioned in the Qur’ān: Allah instructs you concerning your children: for the male, what is equal to the share of two females (Al-Nisā 4/11.)On one hand, the principle that Islamic law brings between boys and girls; Seems to be an inequality in terms of the arrangement in which "the inheritance share of the male child is twice the share of the female child", while on the other hand, within the border of in the family foreseen by Islam, this regulation has not been seen as an injustice and inequity by Muslim societies, because in Islamic family law, a man is obliged to ensure the livelihood of the family after marriage. He is also obliged to give his wife her mahr when marrying.In Islamic inheritance law, “necessity principle” is taken as the basis of responsibility that women and man have undertaken in family and society. Therefore, even though giving nothing at all to those who are not in need and giving less to those who are in less need, giving too much to those who are in much need might seem contrary to the principle of equality, it is a necessity of the principle of justice and fairness. As a matter of fact, while "law equality, necessity in sharing" principle, law is arranged according to people's qualifications, goods and wealth sharing is divided according to the needs of people. In this context, there has been a fair division in Islamic heritage law based on the necessity, (distributive) justice and fairness principle. Indeed, the French philosopher Roger Garaudy (1913-2012), who chose /converted to Islam, evaluates the following about the proportion of male child in the Qur'an to that of female child: “When we consider that in the Arab society all the obligations of the family and of the care of the parents and of all the things that we call ‘social security’ today are put on the shoulders of the husband, the hereditary male child's share must be twice as high as the female child’s is”.As Garaudy argues, the difference in the inheritance of women and men in Islamic inheritance law is not a legal discrimination/inequality, but a form of divisiveness stemming from a need based on the role and responsibility that women and men have undertaken in the family and society. Therefore, giving nothing to those who need nothing, giving little to those who need little, and giving a lot to those who need a lot,even though may seem contradictious to the principle of equality, it becomes a necessity of equity and (distributive) justice principle. In this case, in Islamic inheritance law, the basic reason why the share of the male child is twice the share of the female child, is social and economic reasons and it is possible to rank them as follows:1) According to Islamic law, women are not obliged to make their own economic livelihoods. The woman’s economic responsibility belongs to her father or brothers before marriage, and then to her husband after marriage. 2) When a woman is married she is not responsible for herself or other family members’ livelihood. The male is obliged to make a living for himself, his wife and his children.3) While married, the male is obliged to give the wife mahr. The woman has no such responsibility.As it is understood from the above explanations, in Islamic inheritance law, the basic reason why the share of the male child is twice the share of the female child is not about the ontologically “value” based on creation and sex given to the woman (girl child) in Islam. On the contrary, it is the real facts concerning the family and society structure that Islam predicts, the roles and financial obligations that man and woman have undertaken, namely “socio-economic structure/fact”.In some commentaries in classical commentary books, the rights and responsibilities of women and men are referred to, like: the word “degree” mentioned in: …but the men have a degree over them [in responsibility and authority (Al-Baqara 2/228), and the talk about the inheritance shares of boys and girls in: for the male, what is equal to the share of two females (Al-Nisā 4/11). Eventually, the concepts “lil al-dhakari mithlu haẓẓ al-unthayain” have been associated with the gender of the woman/girl child ontologically (based on social fact) by ignoring the referent purpose and socio-economic contexts of these verses. As a result of these interpretations, it was desired that the Islamic law principle of inheritance share of male child being twice the share of female child, ontologically, should be based on a justification that “man is superior to woman”.In this study, some of the era’s dominant culture classical interpretations grounding women's inheritances share on her gender and based on the axis of the concepts of "degree" and “lil al-dhakari mithlu haẓẓ al-unthayain” in the related verses of the Qur'ān will be elaborated. Picking up the question of what FLaK might be, this editorial considers the relationship between openness and closure in feminist legal studies. How do we draw on feminist struggles for openness in common resources, from security to knowledge, as we inhabit a compromised space in commercial publishing? We think about this first in relation to the content of this issue: on image-based abuse continuums, asylum struggles, trials of protestors, customary justice, and not-so-timely reparations. Our thoughts take us through the (...) different ways that openness and closure work in struggles against violence, cruel welcomes, and re-arrangements of code and custom. Secondly, we share some reflections on methodological openness and closure as the roundtable conversation on asylum, and the interview with Riles, remind us of #FLaK2016 and its method of scattering sources as we think about how best to mix knowledges. Thirdly, prompted by the FLaK kitchen table conversations on openness, publishing and ‘getting the word out’, we respond to Kember’s call to ‘open up open access’. We explain the different current arrangements for opening up FLS content and how green open access, the sharedit initiative, author request and publisher discretion present alternatives to gold open access. Finally drawing on Franklin and Spade, we show how there are a range of ‘wench tactics’—adapting gifts, stalling and resting—which we deploy as academic editors who are trying to have an impact on the access, use and circulation of our journal, even though we do not own the journal we edit. These wench tactics are alternatives to the more obvious or reported tactic of resignation, or withdrawing academic labour from editing and reviewing altogether. They help us think about brewing editorial time, what ambivalence over our 25th birthday might mean, and how to inhabit painful places. In this, we respond in our own impure, compromised way to da Silva’s call not to forget the native and slave as we do FLaK, and repurpose shrapnel, in our common commitments. (shrink)

This first-time and excellent English-Arabic production of an eleventh-century work by the moral philosopher Miskawayh consists of “Conclusive Answers to Disparate Questions” put to him by Tawhidi, a literary intellectual. The book should not be viewed simply as a window for the modern English reader on what occupied the minds of thinkers in that milieu and of that period. As Vasalou notes in the introduction, the work does not quite fit into the Arabic genre of the Aristotelian Problemata literature, where (...) one expects to find straightforward arguments between opposed views on specific topics; the work is sui generis in consisting of brief but serious “teacher” responses to a series of disconnected and what often seem to be simplistic but taunting questions raised by an inquirer whom we know to have been as knowledgeable in philosophy as the respondent himself. (In one about how customs of different nations originate, the respondent's curt answer is that he neither knows nor cares to know, this not being a matter that adds to knowledge!) It is this strange feature of the work—rather than the classical answers provided by the philosopher—that has occupied contemporary scholars (like Mohammed Arkoun) who have worked on the subject. What was Tawhidi's intention in putting such questions to Miskawayh?As Vasalou points out, the questions often seem articulated more in the form of wonderment about a common fact (“Why is it so?”) than to stimulate a pedantic answer (“This is what the textbook says”). For example, why is it that we can create images for ourselves of what we consider to be the most hideous but are unable to conceive images of the finest or purest or most beautiful? Surely, if we could, we would be able to live happier lives! Miskawayh's classical answer on souls and body humors here seems to miss the point of the question completely. “Why is laughter infectious?” expresses a similar wonderment not addressed in the answer. The question “What is the wisdom of there being mountains?” elicits a scientific answer, but the reader wonders whether it is the kind of answer the questioner was after, or whether instead he was trying to draw out Miskawayh on the theory of possible worlds (as in the famous exchange between Ibn Sina [Avicenna] and al-Biruni). In a similar vein, Tawhidi asks, “Why is it that we grow older but the process isn't reversed?” to which Miskawayh readily gives the textbook answer. But is that what Tawhidi was after?On the other hand, some questions and answers (such as some on injustice, or luck, or worthiness) seem quite genuine and straightforward, but one wonders if Tawhidi is complaining in them about his own hard life and unfortunate circumstances to one of whom he is envious and considers to be less worthy and more fortunate than himself. (Unlike Miskawayh, Tawhidi was never able to land himself a secure position or income.) It is in this latter context, perhaps, that we can better understand the psychological background of the several questions on suicide Tawhidi also includes in his bag of queries. In the end, we are left to wonder whether Tawhidi was simply luring Miskawayh to show himself to be a “novice” and if the latter innocently fell into the trap. Whatever the answer, the book is informative and entertaining. (shrink)

This book examines recent developments in sources of public international law, such as treaties and custom operating among nations in their mutual relations, as well as developments in some of the primary rules of law international institutions created by these processes. It finds that public international law has become increasingly dysfunctional in dealing with some of the primary problems facing the world community, such as the maintenance of international peace and security, violations of international human rights and the law (...) of armed conflict, arms control, disarmament and non-proliferation, and international environmental issues, and that international law and international institutions face a problematic future. It concludes, however, that all is not lost. There are possible alternative futures for international law and legal process, but choosing among them will require the world community making hard choices. (shrink)

This article examines and analyzes the private sector’s commercialization and commodification of teaching and learning in higher education. An important issue related to this fast-growing relationship is the blind acceptance of the marketplace model as it relates to technology use, teaching, and learning in higher education. This relationship is suspect from the outset because the goals and purposes important to the private sector do not blend with those important to educational communities. Moreover, there appears to be little concern about implications (...) and consequences associated with the marketing and selling of teaching and learning. An argument is made that by commercializing and commodifying teaching and learning, training becomes confused with education and teaching, and learning becomes decontextualized, simplistic, and mechanistic; void of human interactions; focused on competition and securing profit margins; and the means to prepare for a future emphasizing individualism and the lifestyle goals of control, efficiency, and predictability. Higher education professionals are urged to think carefully about teaching and learning becoming just another commodity that is conveniently packaged for student customers in academic settings turned virtual marketplaces. Given the importance of data safety for psychology, the present study investigated the influence of data leaking scandal on campus customers’ financial consumption behaviors at intelligent tourism platforms in China, and explored the roles that individual characteristics play in this process by focusing on a set of participants from colleges. Data were collected through sending out an online questionnaire, where respondents were asked to finish a series of questions about their background information, their trust, future consuming intention, and defensive behaviors (...) toward intelligent platforms. After they finished these questions, a short description about an online tourism platform leaking customers’ personal information was presented to the respondents, following which they were asked to report about their future consuming intentions and defensive behaviors again. In total, 236 participants of college students and teachers were recruited. Paired samples mean comparison showed that after the stimulus was presented, the respondents had a significant decrease in future financial consumption intention, and a significant increase in defensive behaviors toward online tourism platforms due to risks perceived. Multiple regression analysis was conducted subsequently to investigate individual characteristics that may account for part of the decrease in consuming intention. Results showed that, customers with higher level of trust and monthly income, as well as older customers, tend to experience higher level of decrease in consuming intention, and increase in defensive behaviors. These findings highlighted the importance of online tourism platforms guaranteeing data security of their customers. (shrink)

Africa, before European colonization, knew no other form of legal system outside customary arrangements. Based on secondary sources and a primary survey conducted between 2009 and 2010 on the situation of women and land rights in anglophone Cameroon, this paper examines the grounds for discrimination in customary laws against women's rights to land in the context of legal pluralism, and discusses the implications of this custom of gender discrimination. In drawing from Cameroon as an exemplar, it concludes that the strong (...) influence and impact of customs on current land tenure systems have global implications on women's land rights, food security and sustainable development, and that gender equality in land matters can be possible only where the critical role of ethics is recognized in pursuit of the economic motive of land rights. This article investigates the nexus between bank-specific risks and the financial stability of the banks for a panel data set of 15 scheduled banks in Pakistan over a 12-year period from 2009 to 2020. Using the fixed-effect model, the study result shows that bank-specific risks, i.e., credit risk and liquidity risk are detrimental to bank stability, whereas funding risk has no significant impact on bank stability. Besides these, bank size has also a negative impact on bank stability, whereas the return (...) on assets revealed a positive influence. To ensure stability, bank management should establish policies that confirm secure loan granting and timely reimbursement from customers to minimize the credit risk. Besides this, management should keenly observe the liquidity position and should also effectively mobilize the customer deposits to attain financial stability. (shrink)

Since its origins in the mid-1980s, DNA profiling has become the most powerful tool for identification in contemporary society. Practitioners have deployed it to determine parentage, verify claims to identity in various civil contexts, identify bodies in wars and mass disasters, and infer the identity of individuals who have left biological traces at crime scenes. Thus DNA profiling can be used to implicate or exonerate individuals from participation in particular social relations and activities; this affords it a growing importance in (...) major social institutions such as the family, the criminal justice system, immigration services, and health services. There are key state, security, civil liberty, personal, and commercial considerations surrounding the reliability and social implications of DNA profiling in establishing the identities of “family members,” “claimants,” “customers,” “suspects,” and “citizens.”Given that DNA profiling is increasingly influential in forensic inquiries, the recently-developed practice in the UK of “familial searching” of DNA databases has the potential to become a significant aspect of investigations. Freedom! Freedom! The word "rings" with meaning to each of us! Yet, what does it really mean? Only the tyrant, living in a secure environment and operating above the law, is theoretically free to do as he chooses. For the remainder of society freedom is an elusive condition, circumscribed by a wide spectrum of personal, social, economic, and governmental restraints. Freedom is bounded most fundamentally by the nature of man and the physical universe. Merely to remain alive human beings must (...) accept a myriad of restrictions on individual appetites, actions, and desires. Personal choices are limited by levels of intelligence and the capacity to think. Effective propaganda or advertising can affect the freedom of those unable to analyze or resist it. Poor health and poverty can set serious limits to choice. No less significant are the intellectual and moral limitations which society imposes on those whom it intends to respect and honor. Social customs and mores, and the restraints they impose, set limits of necessity and respectability and thus, for most, the limits of free choice. Freedom is boundless for none. Those are most free who accept personal and social restraints as the necessary price which they and society must pay for minimum of order, decorum, security, and satisfaction. Freedom with restraint for none creates chaos; freedom with restraint for some creates injustice. Thus restraints must be public no less than private, for freedom, in practice, must be limited by regard for the freedom and welfare of others. This book brings together fourteen outstanding and concerned scholars to acquaint readers with the history, nature, and significance of freedom in America since the Declaration of Independence. Its publication should cause the reader to reflect on the meaning of freedom for the future. Following a "stage-setting" introduction, the chapters are organized to cover four essential areas of concern: Foundations of Freedom, Freedom and Governmental Processes, Freedom and the Human Condition, and Freedom and the Physical Environment. As would be expected, various points of view are presented. However, the differences are not over the facts, but over their meanings and their significance for the future. It is well documented that the application of business models to the higher education sector has precipitated a managerialistic approach to organisational structures ( Preston, 2001 ). Less well documented is the impact of this business ideal on the student-teacher encounter. It is argued that this age-old relation is now being configured (conceptually and organisationally) in terms peculiar to the business sector: as a customer-product relation. It is the applicability and suitability of such a configuration that specifically concerns this contribution. (...) The paper maintains that the move to describe the student-teacher relation in these terms is indeed inappropriately reductive, but not straightforwardly so. The problem arises in that we remain unsure of the contemporary purpose of education. We lack any firm educational ideals that, in themselves, cannot be encompassed by the business paradigm. Indeed, the pedagogical critique of education (broadly, that education is only of use in as much as it is of use to society) extends further than has yet been intimated and prevents one securing any educational ideal that does not immediately succumb to critique. This pedagogical logic is unassailable in any linear way but, when pressed, precipitates an aporetic moment that prevents it from assuming any totalising hold over education. We draw on the work of Emmanuel Levinas and Jacques Derrida to consider whether one might yet imagine an educational 'quasi-ideal' that will enable practitioners and institutions to counter the effects of customerisation. Environmentalists argued that securing the shark fin involved a barbaric practice destroying the shark ecosystem, and that the soup represented an emerging status symbol rather (...) than an intrinsic feature of Chinese culture. Case study participants will gather together as Disney management executives to discuss the ethics of serving shark fin soup in light of environmental sensitivities, cultural factors, and existing stakeholder fiduciary responsibilities. Hong Kong Disneyland’s resolution surfaced after initial indecisiveness; their current corporate policy on social responsibility should not affect each management teams’ deliberation process and rationale for a recommendation regarding shark fin soup. Both corporate and global governance seem to demand increasingly sophisticated means for identification. Supposedly justified by an appeal to security threats, fraud and abuse, citizens are screened, located, detected and their data stored, aggregated and analysed. At the same time potential customers are profiled to detect their habits and preferences in order to provide for targeted services. Both industry and the European Commission are investing huge sums of money into what they call Ambient Intelligence and the creation of an (...) ‘Internet of Things’. Such intelligent networked environments will entirely depend on real time monitoring and real time profiling, resulting in real time adaptation of the environment. In this contribution the author will assess the threats and opportunities of such autonomic profiling in terms of its impact on individual autonomy and refined discrimination and indicate the extent to which traditional data protection is effective as regards profiling. Value co-creation goes through the stage of co-production, customer experience, service-dominant logic, and service ecosystem. The integration of science and technology has become a key factor to the process of VCC. The rise and application of artificial intelligence technology has added a new driving force to VCC and began to affect its original practical logic. Based on the consumer perspective, this study uses Q-methodology to measure consumer cognitive attitude toward the use of AI technology in VCC, aiming to explore the (...) key factors that affect VCC. The study found that content quality, information security, efficiency concern, and degree of manipulation have become the important concerns of consumers for VCC under AI integration. Moreover, their different statements have their specific focus and direction. The study demonstrates and analyzes the importance of the four factors and proposes the combination of human and non-human actors to shape the new model of VCC in the future, which is worth further deepening and exploring for academia and enterprises. Mirvac chief executive Susan Lloyd-Hurwitz, not one usually associated with sympathy for tenants on the rental market, said earlier this year that ‘renting in Australia is generally a very miserable customer experience…the whole industry is set up to serve the owner not the tenant’ Her observation is basically correct and the solution she offers is to change the current situation where small investors, supported by generous government tax concessions, provide effectively all of the country’s private rental housing. Lloyd-Hurwitz wants Mirvac, (...) a property group currently managing over $15 billion of assets, to become an apartment landlord that would own not one or several properties like small investors currently do but rather thousands of properties to rent out. The proposal is for Mirvac to build apartment blocks and then, instead of selling individual apartments, rent them out on long-term or indefinite leases. This build-to-rent housing scheme would of course make the real estate–investment company a great deal of money. At the same time it would do very little to alleviate the current housing crisis. Such schemes are a nonstarter for people who want the security, stability and independence of home ownership, which is a very Australian aspiration that is increasingly becoming unobtainable not only for those experiencing homelessness, but also for the poor and middle-class. Those of us who care about finding a real solution to the housing crisis would do well to consider how we got into this situation in the first place, and then consider how this might inform what we do next. The following then, traces some of the historical and philosophical roots of our understanding of property and their institutionalisation via various levels of government, especially in the Australian context. Evidence from a University of Zimbabwe oral history project suggests that many rural women in colonial Rhodesia played an active role in undermining patriarchal customs which they experienced as oppressive. These women defied family norms by choosing their own marriage partners, prioritizing the formal education of their daughters and finding ways to generate income to secure greater degrees of autonomy. This study compliments other research which depicts women's primary form of resistance to be moving from rural to urban areas, (...) by showing what options some women exercised while remaining within rural society.
