Electronic technologies, in general, and computer-oriented technologies specifically have had a tremendous impact on all aspects of business. One area of increased concern is the protection of intellectual properties -- notably copyrights -- within the boundaries of the broadly defined technology industry. While the ability to share copyrighted information has always existed at the most basic levels, the advent of the information age has allowed the sharing of this information to take place in potentially greater quantities and without a (...) loss of quality. As such, copying creates a major threat to industries dealing in the production and distribution of copyrightable creations. The focus of this paper is to better understand how the ethical judgments of employees regarding the opportunities to recreate copyrighted works via traditional and newer technologies impact assessments of copying behavior in the workplace. Traditionally, plant viruses are viewed as harmful, undesirable pathogens. However, their genomes can provide several useful ‘designer functions’ or ‘sequence modules’ with which to tailor future gene vectors for plant or general biotechnology.The majority (77 %) of known plant viruses have single‐stranded RNA of the messenger (protein coding) sense as their genetic material. Over the past 4 years, improved in vitro transcription systems and the construction of partial of fulllength DNA copies of several plant RNA viruses have enhanced our ability (...) to manipulate and study their genomes, particularly in the context of their pathogenic interactions with host plants.Recently, two forms of genetically engineered protection against plant virus infections have been reported. In both, a virus‐related ‘interfering’ molecule was stably introduced into plants via the DNA‐transfer mechanism of Agro‐bacterium tumefaciens. To date, the choice of ‘interfering’ molecule has been guided by empirical field‐observations and each is effective against only a narrow range of closely‐related viruses. As yet, we do not fully understand the molecular mechanism(s) responsible for the observed protection.The ability to manipulate the plant–pathogen relationship is a powerful tool to increase our knowledge and improve future strategies for uncoventional cropprotection by genetic engineering techniques. The digital world provides various ethical frames for individuals to become ethical subjects. In this paper I examine – in a Foucauldian and Luhmannian way – the differences between three systems of communication: the proprietary, the open/free and the cracker system. It is argued that all three systems provide a different set of ethical codes which one can be subjected to. The language of each system is restricted and they cannot understand each other, they merely consider each other as the (...) environment. The systems generate a diversity of ethical codes as they give different shapes to digital objects. To proprietary software companies digital objects are an instrument of financial profit. The free software/open source movement emphasises transparency; the end user must be able to view and alter the source code. The cracker scene sees digital objects in a different way. For this particular system, only copy-protected digital objects are appealing. Copy protection binds its target to the world of matter. Breaking the protection is the ultimate challenge and a way to gain honour and status inside the cracker scene. A copy-protected digital object is simultaneously an utmost example of the hidden source code (the open/free system), a perfect artefact that can be owned and sold (the proprietary system) and a challenge to be cracked (the cracker system). Software piracy is a serious problem in the software industry. Software authors and publishing companies lose revenue when pirated software rather than legally purchased software is used. Policy developers are forced to invest time and money into restricting software piracy. Much of the published research literature focuses on software piracy by end-users. However, end-users are only able to copy software once the copy protection has been removed by a ‘cracker’. This research aims to explore why, if (...) class='Hi'>copy protection is so difficult to remove, do crackers invest their skill and time in this activity instead of more lucrative and legal employment. This study develops a framework of neutralisation, justification and motivation and goes directly to the initial software crackers to determine what motivates their activities. The study first applies this framework in an anonymous online survey of crackers. The study then conducts cognitive interviews with eight crackers to explore and further validate the survey’s findings. The study finds the challenge of removing the copy protection from software as the strongest motivation for the actions of crackers. Desire for social participation, while found to be rewarding, was considered unnecessary for crackers to continue their actions. Higher social status was not a motivational factor but was a perceived by-product of cracking. The study also raises areas for future research. (shrink)

Some Blackwell journals use copyright system and some Blackwell use license from authors. Now a days online journals are using creative common licenses. Under creative common license journals are open access, allowed to download, copy, distribute, and display derivative works with proper attribution to author or owner for noncommercial purpose at a free cost. Education on IPRs will support to comprehend (...) ones rights, professional code of conduct and the doctrine of "fair use" in publication. One cannot do anything with once writing. Autonomous transposable elements, generally considered as junk and selfish, encode transposition proteins that can bind, copy, break, join or degrade nucleic acids as well as process or interact with other proteins. Such a repertoire of activities might be of interest for the host cell. There is indeed substantial evidence that mobile DNA can serve as a dynamic reservoir for new cellular functions. Transposable element genes encoding transposase, integrase, reverse transcriptase as well as structural and envelope proteins have been repeatedly (...) recruited by their host during evolution in most eukaryotic lineages. Such domesticated sequences protect us against infections, are necessary for our reproduction, allow the replication of our chromosomes and control cell proliferation and death; others are essential for plant development. Many new candidates for domesticated sequences have been revealed by sequencing projects. The use of socially learned information (culture) is central to human adaptations. We investigate the hypothesis that the process of cultural evolution has played an active, leading role in the evolution of genes. Culture normally evolves more rapidly than genes, creating novel environments that expose genes to new selective pressures. Many human genes that have been shown to be under recent or current selection are changing as a result of new environments created by cultural innovations. Some changed in response to (...) the development of agricultural subsistence systems in the Early and Middle Holocene. Alleles coding for adaptations to diets rich in plant starch (e.g., amylase copy number) and to epidemic diseases evolved as human populations expanded (e.g., sickle cell and G6PD defi- ciency alleles that provide protection against malaria). Large-scale scans using patterns of linkage disequilibrium to detect recent selection suggest that many more genes evolved in response to agriculture. Genetic change in response to the novel social environment of contemporary modern societies is also likely to be occurring. The functional effects of most of the alleles under selection during the last 10,000 years are currently unknown. Also unknown is the role of paleoenvironmental change in regulating the tempo of hominin evolution. Although the full extent of culture-driven gene-culture coevolution is thus far unknown for the deeper history of the human lineage, theory and some evidence suggest that such effects were profound. Genomic methods promise to have a major impact on our understanding of gene-culture coevolution over the span of hominin evolutionary history. (shrink)

Written by epidemiologists, ethicists and legal scholars, this book provides an in-depth account of the moral problems that often confront epidemiologists, including both theoretical and practical issues. The first edition has sold almost three thousand copies since it was published in 1996. This edition is fully revised and includes three new chapters: Ethical Issues in Public Health Practice, Ethical Issues in Genetic Epidemiology, and Ethical Issues in International Health Research and Epidemiology. These chapters collectively address important developments of the past (...) decade. Three chapters from the first edition have also been reorganized: Ethicall Optimized Study Deisgns in Epidemiology, Ethical Issues in Epidemiologic Research with Children, and The Ethics of Epidemiologic Research with Older Populations. This article extends property-owning democracy to the digital realm and introduces “data-owning democracy,” a new political economic regime characterized by the wide distribution of data as capital among citizens. Drawing on republican theory and acknowledging data's unique role in the digital economy, it proposes a two-tier model that combines different modes of data ownership and corresponding rights. The first layer of “data-owning democracy” is characterized by a digital public infrastructure that enables citizens to collectively generate data and have a say (...) in how their citizen data are used. In the second layer, individuals automatically receive machine-readable copies of their data whenever they are generated—a slightly more advanced form of the European Union's existing right to data portability (Art. 20). With its focus on empowerment, data-owning democracy is designed to be complementary to existing data protection regulations. It also illustrates how political theory more broadly, and republican theory specifically, can be instructive for specifying the normative components of a new political economy dealing with questions of empowerment and digital rights. New technologies provide great opportunities for cultural heritage to become more widely accessible and for cultural experience to be more meaningful. The COVID-19 pandemic has highlighted the strengths and vulnerabilities of the cultural heritage sector and the need to accelerate its digital transformation to make the most of the opportunities it provides. The Commission Recommendation on the digitisation and online accessibility of cultural material and digital preservation (2011/711/EU) concluded that there is an urgent need to protect and preserve European cultural (...) heritage, and, in particular, endangered cultural heritage is still present. However, the diversity of legal approaches to cultural heritage by the Member States discourages the creation of a common European data space for cultural heritage as the European Commission recently proclaimed. In Greece, there have been significant efforts in recent decades to digitise and digitally preserve cultural heritage goods. However, the attention was not drew upon the accessibility and reuse of the digitized cultural heritage content. According to the relevant regulatory framework the existing rules on the use of digital technologies for the reproduction, use and preservation of cultural heritage content is obviously outdated. According to the paragraphs 4 and 5 of article 46 of the Greek Code for the protection of antiquities and cultural heritage in general (Law 4858/2021), a previous permission granted by the Ministry of Culture is required for the production, reproduction and dissemination to the public of impressions, copies or depictions of monuments belonging to the Public Sector, or immovable monuments that are located within archaeological sites and historical places or are isolated, or movable monuments that are kept in museums or public collections, in any way and by any means whatsoever, including Information Communication Technologies. Such permission is granted to natural or legal persons for a fee paid to the Hellenic Organization of Cultural Resources Development (HOCRED) upon the decision of the Minister of Culture, while the decision also specifies the temporal validity of the permission, the terms on which the permission is granted and the fee that must be paid. The production, reproduction and use of the aforementioned goods for other purposes, such as artistic, educational or scientific purposes, is again allowed for a fee paid to HOCRED, however, the fee can be waived upon the decision of the Minister of Culture. This Paper will examine the existing Greek legal framework and will attempt to propose an appropriate framework that will ensure open access to the digitized cultural heritage assets, enhance the recovery and transformation of the cultural heritage sector and support cultural heritage institutions in becoming more empowered and more resilient in the future. Geography is at the same time the only survivor of the ancient Greek literature devoted to the topic of drawing maps of the world and is the most extensive ancient list that we possess of names and locations of communities and physical features in the known parts of Europe, Africa, and Asia. It may seem astonishing that a document of exceptional importance for ancient history, geography, and the history of science should have had to wait until now for a complete critical edition. In fact the last complete edition, by C. F. A. Nobbe (1843–45), presents an indiscriminate text with no apparatus beyond a skimpy eighteen-page "Index Criticus" at the end. Two other editions, by F. W. Wilberg and C. H. F. Grashof (1838–45) and by C. Müller and C. T. Fischer (1883–1901), though furnished with apparatus, were vitiated by defective knowledge of the main lines of the textual tradition and besides were never completed. The twentieth century saw major progress in the sorting out of the Geography's manuscripts, with important contributions by (among others) Joseph Fischer, Otto Cuntz, Aubrey Diller, and above all by Paul Schnabel, whose monograph on the subject was meant as a mere harbinger of an edition that he did not live to produce. Meanwhile, scholars in need of a reliable text have had to make do with a patchwork of intentionally partial editions limited to sections of Ptolemy's geographical catalogue covering specific regions.The biggest obstacle in the way of restoring the Geography arises from one of Ptolemy's profoundest insights, that a graphical object such as a world map can be reproduced more accurately if its contents are translated into a collection of numerical coordinates representing each significant point of the drawing, in effect, a digitization. About two thirds of the Geography is thus dedicated to a list of some eight-thousand place names with the longitudes and latitudes of the corresponding localities expressed in degrees and fractions of a degree, ordered [End Page 128] so that one can reconstruct the map by plotting from point to point on a suitable grid of parallels and meridians. Ptolemy thus got rid of the analogue distortions inherent in the process of copying a picture, but he proposed no measures to protect the copying of the text and numerals of his list from errors giving rise to "noise" progressively obscuring the picture. Unfortunately, Greek alphabetic numerals, notations for common fractions, and exotic place names—many of them attested in no other document—were all liable to frequent misreading in ancient and medieval manuscripts. In such material, copying errors are difficult to detect and generally impossible to undo. The modern scholar, working with an abundance of manuscript copies (none older than the late thirteenth century), is incessantly confronted by variant readings of which at least one must be wrong but for which no rational basis for discriminating exists. To complicate matters further, many of the manuscripts contain maps, and the origin of these maps and their relation to the textual history are controversial questions for which the usual resources of textual criticism are inadequate. It is not surprising if editors' appetites have been sated with modest helpings of the Geography.Now at last we have a complete and reliable critical edition of Ptolemy's book, an accomplishment made possible in the first instance by a division of labor among a competent and well-organized team, and secondly by judicious choices about what the edition should and should not attempt to do. Gene therapy has emerged from the idea of inserting a wild‐type copy of a gene in order to restore the proper expression and function of a damaged gene. Initial efforts have focused on finding the proper vector and delivery method to introduce a corrected gene to the affected tissue or cell type. Even though these first attempts are clearly promising, seveal problems remain unsolved. A major problem is the influence of chromatin structure on transgene expression. To overcome chromatin‐dependent repressive (...) transgenic states, researchers have begun to use chromatin regulatory elements to drive transgene expression. Insulators or chromatin boundaries are able to protect a transgene against chromatin position effects at their genomic integration sites, and they are able to maintain transgene expression for long periods of time. A new theory of moral and aesthetic value for the age of remix, going beyond the usual debates over originality and appropriation. Remix—or the practice of recombining preexisting content—has proliferated across media both digital and analog. Fans celebrate it as a revolutionary new creative practice; critics characterize it as a lazy and cheap (and often illegal) recycling of other people's work. In Of Remixology, David Gunkel argues that to understand remix, we need to change the terms of the debate. The (...) two sides of the remix controversy, Gunkel contends, share certain underlying values—originality, innovation, artistic integrity. And each side seeks to protect these values from the threat that is represented by the other. In reevaluating these shared philosophical assumptions, Gunkel not only provides a new way to understand remix, he also offers an innovative theory of moral and aesthetic value for the twenty-first century. This work assesses the ethical issues arising from the proliferation of university-business partnerships. Bowie pays special attention to the question of whether such partnerships are consistent with the values of higher education, and examines procedures for protecting university values. The work concludes with an extensive section of readings, including articles by David Noble, Nicholas Wade, and Albert Gore, Jr.; copies of historical documents and case studies; and copies of conflict of interest statements from leading universities.

This paper begins with a sketch of a few themes in the philosophy of property insofar as they relate to the concept of cultural appropriation. It then offers a survey of Edmund Husserl’s account of culture. These reflections put us in a better position to ask whether property ownership provides a suitable interpretative framework for acts of intercultural copying and influence. On the contrary, Husserl’s account of culture leads us away from the claim that members of a cultural group should (...) be understood to have property in cultural formations arising within their group. By putting meaning, rather than ownership, at the center of our understanding of culture, the paper offers an alternative account of what might be wrong, when there is something wrong, with events typically labeled culturally appropriative. The paper concludes by connecting concerns for cultural appropriation with conceptions of cultural authenticity, distinguishing between an autochthonal sense of authenticity, focused on internal origins and protection from outside forces, and a Husserlian sense of authenticity, connected to reason, responsibility, and truth. This article publishes the surviving parts of a hitherto unknown Mandaean spell for the protection of a woman from childlessness. The spell has been reconstructed from two fragmentary amulets that were written on lead lamellae in the Sasanid period (MLSC 18 and 19). The overlapping sections of the two amulets show some linguistic differences but are otherwise clearly parallel copies of the same formula. The spell is narrated in the name of Iauar son of Iauar and mentions other figures (...) known from the Mandaean canonical literature. Iauar witnesses the unnatural behavior of the demons, who cause barrenness and infertility by the purloining of male and female seed, and cause infant mortality through acts of demonic violence. The text breaks off at the point where the narrator binds the demons. The formula adds several words to the Mandaic lexicon and a previously unattested form of the 1 c.s. personal pronoun. (shrink)

Additive manufacturing has spread widely over the past decade, especially with the availability of home 3D printers. In the future, many items may be manufactured at home, which raises two ethical issues. First, there are questions of safety. Our current safety regulations depend on centralized manufacturing assumptions; they will be difficult to enforce on this new model of manufacturing. Using current US law as an example, I argue that consumers are not capable of fully assessing all relevant risks and thus (...) continue to require protection; any regulation will likely apply to plans, however, not physical objects. Second, there are intellectual property issues. In combination with a 3D scanner, it is now possible to scan items and print copies; many items are not protected from this by current intellectual property laws. I argue that these laws are ethically sufficient. Patent exists to protect what is innovative; the rest is properly not protected. Intellectual property rests on the notion of creativity, but what counts as creative changes with the rise of new technologies. (shrink)

On February 3, 2010, a “Letter of Concern from Bioethicists,” organized by fetaldex.org, was sent to report suspected violations of the ethics of human subjects research in the off-label use of dexamethasone during pregnancy by Dr. Maria New. Copies of this letter were submitted to the FDA Office of Pediatric Therapeutics, the Department of Health and Human Services (DHHS) Office for Human Research Protections, and three universities where Dr. New has held or holds appointments. We provide a critical appraisal of (...) the Letter of Concern and show that it makes false claims, misrepresents scientific publications and websites, fails to meet standards of evidence-based reasoning, makes undocumented claims, treats as settled matters what are, instead, ongoing controversies, offers “mere opinion” as a substitute for argument, and makes contradictory claims. The Letter of Concern is a case study in unethical transgressive bioethics. We call on fetaldex.org to withdraw the letter and for co-signatories to withdraw their approval of it. (shrink)

ABSTRACTThe historical process underlying Darwin’s Origin of Species did not play a significant role in the early editions of the book, in spite of the particular inductivist scientific methodology it espoused. Darwin’s masterpiece did not adequately provide his sources or the historical perspective many contemporary critics expected. Later editions yielded the ‘Historical Sketch’ lacking in the earlier editions, but only under critical pressure. Notwithstanding the sources he provided, Darwin presented the Origin as an ‘abstract’ in order to avoid giving sources; (...) a compromise he acknowledged and undertook to set right in later editions, yet failed to provide throughout the six editions under his supervision. Darwin’s reluctance to publish the historical context of his theory and his sources, particularly sources which were also ‘precursors’, may be attributed as much to the matter of intellectual ownership as science, or even good literary practice. Of special concern to Darwin were issues of priority or originality over ‘descent with modification’ and especially over Natural Selection. Many later historians have argued that Darwin was unaware of the work of his precursors on Natural Selection. Darwin’s theory was an example of independent discovery, albeit along with such obscure precursors as Matthew or Wells, who were unknown to Darwin until after the publication of the Origin. Both Matthew and Wells had a medical education, like James Hutton or Erasmus Darwin earlier in the eighteenth century, or even Charles Darwin. Evolutionary theory, at least in Britain was a product largely of the medical evolutionists rather than the natural historians which ‘history’ has chosen to select for the focus of attention; and among the medical evolutionists the figure of John Hunter stands out as theorist, experimentalist and teacher: the medical evolutionists were predominantly the product of Hunter’s legacy or of the medical profession and particularly the Scottish Universities. Much recent Darwin scholarship has focused on the private Notebooks, to establish Darwin’s discovery of Natural Selection around 1837–1838 and demonstrate Darwin’s ignorance of his precursors; requiring an explicit acknowledgement by Darwin as the legitimate substantiation of any claim to prior influence. The precursors have been categorized as uniformly obscure or irrelevant to the science of evolution which may be defined exclusively as ‘Darwinian’. The inclination to acknowledge influences, however was not something Darwin was gratuitously given to doing, especially on matters of priority. The Notebooks are not Darwin’s private thoughts; from an early stage he considered them incipient public documents and later sought to protect them as proof of his originality. William C. Wells was not an obscure thinker, but a celebrated scientist whom Herschel, Darwin’s guide to scientific methodology, had recommended as providing a model of scientific method. Darwin discovered Wells through Herschel, and quickly acquired a copy of Wells’ recommended work, no later than 1831, and held it thereafter in his library at Down House. This book, the 1818 edition of Wells’ Two Essays contains a third essay, Wells’ account of Natural Selection. Later, in the Descent of Man Darwin acknowledged his separate discovery of the correlation of colour and disease immunity in man, also earlier recounted by Wells. (shrink)

The Article presents a study of opportunities and problems related to the procedural actions taken by bailiffs electronically. In the opinion of the authors, the digitalisation of the enforcement procedure seeks to ensure the maximum use of electronic documents: enforcement and procedural documents should function only in the electronic format and thereby should create an effective, transparent and easily accessible information system of electronic enforcement files, which will not only increase the effectiveness of performance of bailiffs and save costs, but (...) will also ensure the protection of the rights of claimants and debtors in enforcement proceedings through reliable and prompt service of procedural documents by electronic means, access to information about the course of the enforcement proceedings by using information technologies, and transfer of certain procedural actions taken by bailiffs into the electronic environment. Section one of the Article discusses the EU regulation in the area of unification and digitalisation of the enforcement procedure. Section two deals with the possibilities of issuing electronic enforcement orders, issuance of an enforcement order, technical measures to enable bailiffs access the information systems of the institutions issuing enforcement orders by safe electronic channels and thereby electronic enforcement orders would be transferred from the issuing institution to bailiffs electronically, without using any hard copy enforcement orders. In the opinion of the authors, considering that the majority of enforcement orders are issued by courts, it would be expedient, first of all, to take advantage of the existing information system LITEKO, making it possible to keep not only court judgments but also enforcement orders there as well as providing bailiffs with technical possibilities of access to the LITEKO system and acceptance of the electronic enforcement orders from the system. A similar principle should be followed for designing integrated information systems of bailiffs and other institutions that issue enforcement orders. Section three focuses on the main procedural documents – arrangements given by bailiffs and property attachment deeds – and on their electronic service on the participants involved in the enforcement procedure. The last section of the Article offers a study of the measures to secure the rights of participants of the enforcement procedure, namely access of the participants of the enforcement procedure to the enforcement file, possibilities for courts to obtain electronic enforcement files promptly, etc. (shrink)

BACKGROUND: There is relatively little research concerning the processes whereby Local Research Ethics Committees discharge their responsibilities towards society, potential participants and investigators. OBJECTIVES: To examine the criteria used by LRECs in arriving at their decisions concerning approval of research protocols through an analysis of letters sent to investigators. DESIGN: Four LRECs each provided copies of 50 letters sent to investigators after their submitted proposals had been considered by the committees. These letters were subjected to a content analysis, in which (...) specific comments and requests for additional information and changes in the protocols were recorded and compared. FINDINGS: Overall 24% of proposals were approved without request for changes or clarifications, but this varied by committee: one committee approved only 6% of proposals without change or clarification while the others ranged from 26% to 32%. The content analyses of responses indicated that they could be placed into four categories: (i) further information for the committee to aid in their deliberations; (ii) requests for changes to the design or justification for the design used; (iii) changes to the information sheets provided to potential participants; and (iv) changes to consent procedures. Of these, alterations to information sheets were the most common type of request. These four types of response could be seen as safeguarding the wellbeing of potential participants (the principle of non-maleficence), of promoting the scientific validity of the research (the principle of beneficence), and of enhancing the rights of potential participants (the principle of autonomy). CONCLUSIONS: The committees were consistent in the types of requests they made of investigators, which can be seen as attempts to protect participants' rights and ensure the scientific validity of studies. Without an analysis of the proposals sent to the committees, however, it is difficult to account for the variation in the requirements set by the committees before approval was given. (shrink)

One man had sold another a cow, and had represented that cow as possessing certain good qualities--adding, however, that he did not warrant her. The cow proved not to possess the qualities alleged, and the buyer sought to recover the purchase-money. As there was no dispute about the facts, the plaintiff's attorney thought that he had an easy case; for it is a well-established principle of law that a disclaimer of warranty in such a sale does not protect the transaction from the taint of fraud, if the matters in question were ones which the seller really could know and the buyer could not. Biology: The resemblance of one organism to another, or to an object in its surroundings for concealment and protection from predators. In evolutionary biology, mimicry is a similarity of one species to another, which protects one or both. This similarity can be in appearance, behaviour, sound, scent or location. Mimics are typically found in the same areas as their models. The pervasive condition (...) of African architectural education and practice is one of mimicry, in which students and architects are (sub-consciously) driven to copy ‘solutions’ posed by practitioners outside the continent, most typically European or American, whose understanding and experience of Africa is often limited in nature. Wired, switched-on and connected, current and future young African architects are able, at the click of a finger, to peruse the ‘appearance, behaviour and [even] scent and sound’ of buildings and architectural projects that they may never experience ‘in the flesh’, but whose form, material and programmes are multiplying across the continent in ways and places that their original ‘makers’ could not possibly have imagined. Maboneng is now ‘the Manhattan of Africa’; Kigali its Singapore. Unlike biological mimics, in this context a ‘cut-and-paste’ approach neither protects nor conceals: it simply exposes. As far back as 1997, the Dutch architect and theorist, Rem Koolhaas, argued that it had become increasingly important for architects to operate on a level independent of architecture in order to understand, at the most basic level, the phenomena affecting the development of architecture and the city. All’ubicazione spazio-temporale del libro nei monasteri medievali, contraddistinta da fisicità e permanenza, si sotituisce oggi un formato digitale e virtuale, che porta ad una sorta di decontestualizzazione e alla continuità del flusso di informazioni, contribuendo alla diffusione capillare del sapere. L’ottica di universalità e globalità accomuna tuttavia entrambe le epoche. Alcuni concetti-chiave dell’informatica potrebbero infatti declinarsi in (...) ambito medievale: Server-Client per la raccolta, la conservazione e la trasmissione delle conoscenze da parte dei monasteri, quali centri del sapere in Europa, agli uomini di cultura; Firewall, per alludere alla necessità di tutelare i manoscritti, mediante la copiatura e la diffusione dei codici; Community, ad indicare non solo la comunità religiosa o monastica in senso stretto, bensì l’apertura ad una costruzione del sapere mediante un’azione partecipativa. However the universal and global perspective is common to the contemporary and the Medieval periods. In fact some key-words of computer science could be applied to the Medieval context: Server-Client, for the collection, the preservation and the transmission of knowledge from monasteries, as cultural centers in Medieval Europe, to men of culture; Firewall, for the necessary protection of manuscripts, through copying and diffusing codes; Community, referred not only to the monastic and religious groups, but also to an open sharing of the building of knowledge. Problems like the authenticity of the sources, the lack of criticality in the reception of data, and the practice of quotations are well represented in Peter Lombard’s Sententiae: this work can be compared to a modern encyclopedia thanks to the collection of passages from the Holy Scripture and from Latin and Greek sources, as well as a “virtual library”. This article describes China’s century-long concern with the professional ethics of engineers, especially a succession of codes of engineering ethics going back at least to 1933. This description is the result both of our own archival research and of “philosophical history”, the application of concepts from the philosophy of professions to the facts historians (or we) have discovered. Engineers, historians, social scientists, and philosophers of technology, as well as students of professional ethics, should find this description interesting. It certainly provides (...) a reason to wonder whether those who write about codes of professional ethics as if they were an Anglo-American export unlikely to put down roots elsewhere might have overlooked many early codes outside English-speaking countries. While code writers in China plainly learned from Western codes, the Chinese codes were not mere copies of their Western counterparts. This paper contributes to the computer ethics debate on software ownership protection by examining the ontological, methodological, and ethical problems related to property right infringement that should come prior to any legal discussion. The ontological problem consists in determining precisely what it is for a computer program to be a copy of another one, a largely neglected problem in computer ethics. The methodological problem is defined as the difficulty of deciding whether a given software system is a (...) class='Hi'>copy of another system. And the ethical problem corresponds to establishing when a copy constitutes, or does not constitute, a property right infringement. The ontological problem is solved on the logical analysis of abstract machines, and the latter are argued to be the appropriate level of abstraction for software at which the methodological and the ethical problems can be successfully addressed. In lieu of an abstract, here is a brief excerpt of the content:Journal of the History of Ideas 61.4 (2000) 635-655 [Access article in PDF] The Mystery of Truth: Louis-Claude de Saint-Martin's Enlightened Mysticism David Bates "... what truth! and what error!" --Goethe on Saint-Martin 1It is hardly surprising that Louis-Claude de Saint-Martin (1743-1803), the philosophe inconnu of late Enlightenment Europe, remains almost completely unknown outside of the marginalized and exotic disciplines of esoterism, theosophy, and mysticism. Although influential in certain (...) circles, Saint-Martin failed to penetrate the mainstream of Enlightenment thought, and what influence he did have in philosophy was largely felt outside of this period altogether, revealing itself in figures such as Maistre, 2 Lamartine, 3 and German Romantics like Franz von Baader. 4 In his own lifetime Saint-Martin was met with incredulity by the forces of rationalism. Voltaire was given a copy of Saint-Martin's 1775 text Des erreurs et de la vérité by a friend of d'Alembert. Voltaire later commented to the mathematician, "I don't believe anyone has ever printed anything more absurd, [End Page 635] more obscure, more crazy, and more stupid." 5 In the Tableau de Paris, Mercier described Saint-Martin and his martinist followers as a sect which turned its back on the paths opened up by sound physics, chemistry, and all natural history in order "to run headlong into an invisible world only they perceived." Saint-Martin taught that the objects we see around us are only "fantastic and deceptive images" and that the truth lies precisely where we cannot see it, Mercier explained. "Physical experiences," the cornerstone of the dominant sensationalist doctrine, were for the martinists only "errors," an "eternal source of folly and deception," wrote Mercier. 6 One review of Saint-Martin's works described their effect as analogous to that of a "pyramid covered in hieroglyphs, erected by an unknown man in a public square," in other words, completely mystifying. 7 The revolutionary Barnave would link martinism with all the other "metaphysical follies," which were, he believed, the result of an overly speculative tendency in eighteenth-century thought. 8For his part Saint-Martin rejected what he considered to be the anti-spiritual tendency of Enlightenment thought. Responding (as a mature student) to the professor Garat, one of the idéologue followers of Condillac, at the École normale in 1795, Saint-Martin wrote: I always admire how you protect youself from materialism by endorsing... the teachings of Condillac. Although I read little, I have just gone through (very quickly, it is true) his Essai sur les origines des connaissances humaines and his Traité des sensations. Whether I have poorly grasped it, or I haven't your secret, I have come across almost no passages which do not repel me; and, I can say, have not encountered one which attracts me. This paper delves into the nature of intellectual property rights in aesthetic creations, particularly works of visual art and literary works. The discussion focuses on copyrights interests, but there are also implications for trademark and patent rights. The argument assumes a fairly conventional definition of "property," namely, the set of legal relations between the owner and all other persons relating to the use, enjoyment and disposition of a tangible thing. The problem with such a definition as applied to aesthetic creations (...) is that no ordinary tangible thing necessarily embodies a creation which can exist in multiple copies, so the paper takes the transcendent view that the tangible thing subject to legal relations is the entire terra firma or material universe being shaped in the image, sounds or words of the aesthetic creation. Therefore, the paradigm suggested for intellectual property is a monopoly on shaping the entire physical universe, thus the Worldmaking concept. It then follows that intellectual property in an aesthetic creation enables the owner to stop plagiarists from using any part of the material world to recreate in the audience the imaginative experiences first created by the protected work. PurposeThe purpose of this paper is to analyse incidents of personal information leakage in Japan based on Japanese socio‐cultural characteristics of information privacy and to consider how best to develop an effective personal information protection policy that conforms to Japanese situations as well as to the global requirement of personal information protection.Design/methodology/approachAfter describing recent incidents of personal information leakage in Japan, the paper examines the defects of the Act on Protection of Personal Information that permit these incidents (...) to continue. Subsequently, these incidents and the responses of the Japanese people in a manner that reflects the unique Japanese socio‐cultural characteristics of information privacy are analysed. Finally, the paper proposes a revision of APPI that conforms to these Japanese socio‐cultural characteristics as well as to the global requirement for personal information protection.FindingsPersonal information leakage cases and social responses in Japan reflect three Japanese socio‐cultural characteristics: Uchi/Soto awareness, insular collectivism and Hon'ne/Tatemae tradition. An effective law protecting personal information in Japan's cultural environment cannot be made simply by copying the privacy protection laws in western nations. Instead, legal protection of personal information should be drafted that reflects and takes into account these socio‐cultural characteristics.Originality/valueThis paper conducts analysis of incidents of personal information leakage in Japan based on Japanese socio‐cultural characteristics. A revision of APPI is proposed on the basis of the analysis. The paper's analysis and proposal would provide a good clue to develop effective measures to protect personal information and the right to information privacy in the global, multicultural information society. In 2015, the Retraction Watch leadership, Adam Marcus and Ivan Oransky, retracted an article that they had written for The Lab Times in 2013. According to Marcus and Oransky, in the 2013 piece, they had offered “bad advice” to academics. In the 2013 piece, Marcus and Oransky suggested that when an error, actual or potential, was detected in a published paper, that they should first contact – by name or anonymously – the editor, then the author, and finally the research (...) institute, following Committee on Publication Ethics guidelines. They also recommended readers to copy Retraction Watch on their communications – most likely so that Retraction Watch could gather a scoop – suggesting even that by mentioning or copying Retraction Watch would twist the arm of the editor, and perhaps speed up – or influence – the journal’s action, or decision. Offering such bad, flawed and unscholarly advice, claiming boldly, without any citations “that cronyism can protect obvious fraud”, the 2013 Lab Times piece was a clear act of antiscience advice. Clearly recognizing their own bad advice, and flawed and misleading logic, but taking considerable time to do so, Adam Marcus and Ivan Oransky retracted their 2013 article in December of 2015, but replaced it with a substitute offering even worse advice, indicating to concerned academics to scrap their 2013 advice of contacting authors, editors and academic institutes, and opting instead for a potentially biased anonymous option, using a whistle-blower website, PubPeer. Marcus and Oransky failed to indicate any financial or other conflicts of interest in their Lab Times piece. This is important, because, as we now know, the marriage between these watchdogs has been in the pipe-line for years now, reaching public prominence in early 2016 during a meeting in UC Berkeley, and culminating in generous financial backing – in the hundreds of thousands of US$ – by the Laura and John Arnold Foundation, to both Retraction Watch and PubPeer. This commentary examines how the retraction of one badly written journalistic piece for lack of professionalism led to the emergence of an even worse article full of biases. I have reconstructed these elements from my experience on the Health Care Reform Task Force and they are part of the health care plan that the President presented to Congress. (At the time this article went to (...) press, the actual legislation, which should answer my remaining specific questions more clearly, had not yet been released.) I perceive the most important features of the plan to be:• The legislation will create a "right" to health care for all citizens—access to care will be universal;• The plan will involve some form of managed competition in which groups of providers (called Approved or Accredited Health Plans (AHPs)) will offer comparable benefit packages at slightly (or widely) different costs;• The AHPs will negotiate with the Health Alliance (HA) to determine the price that they will charge their consumer-patients;• There will be open enrollment with no barriers to coverage, such as exclusions for pre-existing conditions;• Community rating will be in effect in different localities and enrolled persons in any AHP will pay the same premium;• The coverage for any enrolled person will be portable;• The overall structure will be a cooperative federal/state enterprise in which the states will have quite extensive abilities to fashion variations of the basic plan to meet their particular needs;• Primary care will be encouraged and incentives for physicians to train in primary care specialties provided;• Non-physician providers will be central to the functioning of the health care plans;• Efforts will be made to develop a "person power" pool so that people with an abstract "right" to health care will have real access to providers, in their localities, who can fulfill the promise that the right creates; [End Page 421]• The goal of cost containment will be central to the organization and regulation of the system;• Administrative simplicity and quality protections will be central.Co-chairing the Bioethics Working Group (BWG) of the White House Task Force on Health Care Reform was a unique experience. Approximately 40 Task Force working groups were established by Hillary Rodham Clinton, the President, and the senior Task Force staff. Various members of the President's office and other knowledgeable members of the Executive Branch selected the participants. In our group, appointments were made largely on the recommendations of the co-chairs. The BWG, among the last of the groups formed, carried the official name "The Working Group on the Ethical Foundations of the New System" and was jointly led by me and Marion Gray Secundy, a Professor of Bioethics at Howard University. The fact that the leadership of the Task Force saw fit to establish such a group, thereby confirming that bioethics is a player in the arena of health care policy, was in itself significant and was made no less so by the lack of clarity regarding the group's aims and goals.The working groups of the Task Force were organized into clusters, determined by the relatedness of the somewhat distinct, but always overlapping, content of their investigations. Separate clusters and working groups, for example, looked at mental health, long term care, and the benefit package and coverage for low-income and non-working families. On this last issue there was also a working group that explored health policy initiatives for underserved populations. This multiple focus on related issues proved to be an excellent method for ensuring that the complexity of these topics was sufficiently explored. There was a published schedule for when these groups met together, and members of other groups who had similar or overlapping concerns were invited to attend and to participate.Every week or so, all of the working groups reported to the Task Force leadership, under the direction of Ira Magaziner, in a process called a "tollgate." All major journalism ethical codes explicitly state that journalists should protect editorial copy from undue influence by outside sources. However, much of the previous research on agricultural information has concentrated on what information various media communicate (gatekeeping studies) or communication's role in increasing innovation adoption (diffusion studies). Few studies have concentrated specifically on organizational and structural constraints that might adversely affect agricultural journalists' ethical standards; those that have, focus largely on farm magazines. A study of newspaper reporters who cover (...) agricultural news found that the most pressing ethical concern is the effect of advertiser (agri-business) pressure on editorial copy, and that their concerns in general parallel those of farm magazine writers and editors. The majority reported being in situations in which they might be exposed to advertiser pressure, including pressures to change or withhold editorial copy. Large minorities suggested that advertising pressures affect the overall environment in which agricultural journalists work, and more than one in ten said they allow advertiser pressures to influence editorial decisions. The newspaper reporters who cover agricultural beats showed slightly more resistance to advertiser pressure than did farm magazine editors in a parallel study. (shrink)

However the universal and global perspective is common to the contemporary and the Medieval periods. In fact some key-words of computer science could be applied to the Medieval context: Server-Client , for the collection, the preservation and the transmission of knowledge from monasteries, as cultural centers in Medieval Europe, to men of culture; Firewall , for the necessary protection of manuscripts, through copying and diffusing codes; Community , referred not only to the monastic and religious groups, but also to an open sharing of the building of knowledge. Problems like the authenticity of the sources, the lack of criticality in the reception of data, and the practice of quotations are well represented in Peter Lombard’s Sententiae : this work can be compared to a modern encyclopedia thanks to the collection of passages from the Holy Scripture and from Latin and Greek sources, as well as a “virtual library”. Muslims are fundamentally interested in the practice of writing especially for scribing the copies of the Qur’ān. Later, the practice of scribing ḥadīths texts and writing diplomatic correspondence increased the demand for developing this practice. It is because the writing is based on a religious reference in Islamic societies; over time, the interest in writing and writing materials has also turned into an art form. Thus, writing and writing materials have been named with the selected words from the Qur’ān. Pencil, (...) book, pages (ṣuḥuf), line, stone tablet (alwāḥ) are some of the examples of those words. The writing constituted a series of professions. Calligraphers and warrāqs (book dealers/booksellers) are some examples in Islamic societies. Until the printing press became widespread, the books were written and reproduced by hand which is called istinsākh. Nowadays, these manuscripts are protected in libraries and digital archives. Codicology examines the external elements of these manuscripts such as ink, binding and paper. In addition, the critical edition method was used to bring out manuscripts to the surface. Critical edition of manuscripts is not only transferring the text to the computer. The critical edition is to compare manuscripts of work to reach the original text of the author. While doing this, the evaluation of the text has been held to reveal the historical value of it. In this article, the place of manuscripts in Islamic culture has been discussed and the basic principles of the critical edition, how to create the editing (dirāsa) and text (naṣṣ) sections of the critical edition are explained with examples. The examples were selected from the previous critical editions conducted by the author. This study aims to give an introduction to a very wide field of codicology and critical edition. This article is intended to provide basic information for researchers interested in codicology and critical edition.Summary: Classical Islamic writing culture has its method. For centuries, Muslims have written manuscripts according to this method. This method has been applied from writing the knowledge on paper to collecting and binding the fascicles.The adventure of creating a manuscript is a long process. A lot of people come around to contribute this process initiating from the writing of the first sentence. Producer of the knowledge: scientists, paper-producer: werrâq, the calligrapher: khaṭṭāṭ, bookseller, bookbinder, expert in the ink, naqqāsh who marbles the papers, sponsors of the project, collection and the librarian are some of the contributors. Today, this adventure continues with the participation of enthusiasts which are: the author who re-writes the manuscript to revive it, the restorer who repairs the damage of the manuscript, the expert who creates the digital copy and institutions which publishes the facsimile.Nowadays manuscripts are accepted as important scientific data and are examined in many ways other than their contents thus new specialities have been occurred. At universities, the institutes which examine manuscripts have been established and academic journals have been published. Moreover, the critical edition of manuscripts is the main subject of some of the M.A. and Ph.D. theses.The studies on critical edition, which initiated earlier in some of the western countries, have made a rapid development and created its method. In Turkey, there are many critical editions of works which are based on various manuscripts from Theology to Literature fields. However, there is no significant mutual method among the studies yet. Also, their understanding of critical edition differentiates. In those studies, it has to be examined that basic parameters such as the selection of convenient copy, access to all copies of manuscript or priority of copies are applied to critical edition process. Most of the time it is observed that the advisor’s way of the critical edition has shadows on studies. However, fundamentally critical edition process needs expert contribution itself. Difference between studies is related to the fact that the critical edition is relatively a new field of study in Turkey. Therefore, specific studies in the field of critical edition and codicology are still needed to be developed. On the other hand, there are various publications to establish an objective methodology of the critical edition. Significant studies are being held by the Center for Islamic Studies (ISAM) to establish a mutual language and method for critical edition studies. The factor that led to the emergence of this article is the effort to contribute to the realization of this method. The article discusses the principles to be followed during a critical edition process. Moreover, topics are explained practically with examples selected from manuscripts. Those examples have been chosen from the author’s previous critical edition works. The article would be considered as an “Introduction to Critical Edition” for the researchers who are new at this field. In this respect, the article aims to make a methodological contribution to the critical edition studies.There are many parts of a manuscript –something more than the written text on the page– which makes it a whole. These parts can be divided into internal and external elements of the manuscript. All of these are parts have different levels of contribution to the examination of the critical edition of the work and the interpretation of the texts.Some external elements of manuscript are: ink production and color, inkwell, production of paper, foliation, rule-borders, and frames, ruling board (misṭara), sewing of quires, gilt and gilding, bookbinding, stamping and tooling, frontispiece, cases and pouches, storage boxes and cabinets, flap, tabula ansata, the history of manuscript.The internal elements of the manuscript are: text of the manuscript, script, subject, authenticity, historical value and importance, proprietor, literary features, number of copies and textual variants, scribes and copyists, whether it has been falsified or not, sources used or referenced by the author, abbreviations, records of marginalia, colophon, glosses and scholia, ownership statements, seals and seal impressions, word transposition or transposition of words/letters, waqf-statements, correction signs and corrections, countermarks.While the internal elements of manuscript are the work of critical edition, the external elements of the text fall within the field of codicology. Although critical edition and codicology are considered as separate sciences, there are points where they can contribute to each other. For instance, the ink tone or binding style of a manuscript may help to determine the writing date range of it. The references used by the manuscript can give us an idea about the name or the subject of another manuscript. The literary characteristics of the manuscript may reflect the author's success in language and literature fields. Thus, we are able to inform that the critical edition process of a manuscript requires the evaluation of substantial information at the same time which is no different from an archaeologist carefully examining an arrowhead. Therefore, whatever is the relation between History and Archeology has; Islamic sciences have the same relationship with critical edition. They are both individual sciences with methods of their own and two inseparable common sciences. Thus, without the contribution of codicology or other sciences, rewriting a manuscript on a computer does not mean making a critical edition of it. According to this information, we can define the critical edition as follows, “Critical Edition is the process of reviving of any manuscript -which belongs to Islamic civilization- with comparison of all available copies to create a single text which is closest to the text of the author and to determine the sources which this main text is based, citations such as verses, hadiths and poetry.”For studies on critical edition, the priority should be given to the texts which will contribute to this science. Before initiating critical edition, the authenticity of the author of the manuscript should be determined precisely. Of course, having a person's name on the page is not enough for determination. All copies of the manuscript must be identified. From those copies, critical edition should be based on the text that the author has personally written or prepared as a draft and other copies should be compared with this. In the absence of the author’s authentic copy, new criteria will apply. For instance, the copy written by the closest student of the author or the copy with the closest writing date takes precedence over the copies with no date. After comparison of all copies, the differences are shown in the citation.Critical Edition consists of two sections entitled as Edition (Editing/Dirāsa) and Text (Naṣṣ):The Edition section includes: the author’s name, lineage, place and date of birth, scientific life of the author and his/her prominent students, works, the authentication document which is proven that the text is belong to the author, the place of the work in the history of science, studies about the work, bibliography, literary characteristic, terms in the text, the amount and characteristics of the copies, the characteristic of the main copy which is determined as the fundamental text for the research, the rules and principles applied during the critical edition, the digital images of the first and last pages of the copies used. The Edition section is the part that demonstrates the reliability of the study. All external elements of writing are being introduced here. The importance of the text is confirmed by this edition process. Thus, the final shape of the edition section must be shaped by reading and understanding the text.In the text section, the main aim is to reach the very first text which has been written originally by the author. In this section, principles of morality and objectivity are followed. The text is preserved; additions or subtractions are not made. Cited sources at the manuscript are being found. Verses and ḥadīths are written with their sources. Poems are found in Dīwāns. Text is made legible with punctuation and pilcrow. Proper names, dates of death are written together. Page numbers in the manuscript are shown in square brackets. Some simple grammatical errors are corrected without interfering with the main text. Mostly the reason for this is the letters used for men or women. At the end of the study, a bibliography with all the resources used during the critical edition process is added. The Islamic codicology and manuscripts appear to receiving interest especially in academic studies. Considering that many manuscripts from the Ottoman Era are still waiting to be revived thus, we may come across profound critical edition works in the near future. Therefore, it is understood that individual studies related to the manuscript itself and the method of the critical edition will guide the researchers. (shrink)

This paper focuses on the ritual context of the 200,000-line Chinese Great Perfection of Wisdom at Dunhuang. Beside the fact that the purpose of the mass production of sūtras was to generate merit and then present a “merit gift” for the sponsor, the copies were reused as ritual instruments in the large-scale chanting liturgy called “sūtra-rotation”. This paper examines the relevant administrative documents and liturgical texts to reconstruct the three modules of the liturgy, i.e., the preparation stage, the pronouncement of (...) a “liturgical script,” and the “long-playing” chanting. By analyzing key passages in the Prajñāpāramitā literature, the paper argues that the Great Perfection of Wisdom was taken as an apotropaic device with unmediated protective power. (shrink)

They are the sensory, informational, and computational features that make up valuable papers like banknotes and passports, and they provide the confidence required in moments of exchange and passage. These devices – which include techniques like watermarks and specialized threads, proprietary substrates and inks, or RFID chips – are the product of security printing, an industry that continuously reinvents the possibilities of paper. Importantly, these components protect paper things from counterfeiting, allowing it (...) to function as an original and authentic copy and to do the logistical work of connecting quotidian materials to global networks. The value of valuable papers is therefore not purely extrinsic, socially or discursively established, but is also performed through its intrinsic material qualities. On February 3, 2010, a “Letter of Concern from Bioethicists,” organized by fetaldex.org, was sent to report suspected violations of the ethics of human subjects research in the off-label use of dexamethasone during pregnancy by Dr. Maria New. Copies of this letter were submitted to the FDA Office of Pediatric Therapeutics, the Department of Health and Human Services Office for Human Research Protections, and three universities where Dr. New has held or holds appointments. We provide a critical appraisal of the (...) Letter of Concern and show that it makes false claims, misrepresents scientific publications and websites, fails to meet standards of evidence-based reasoning, makes undocumented claims, treats as settled matters what are, instead, ongoing controversies, offers “mere opinion” as a substitute for argument, and makes contradictory claims. The Letter of Concern is a case study in unethical transgressive bioethics. We call on fetaldex.org to withdraw the letter and for co-signatories to withdraw their approval of it. (shrink)

The article focuses on the historical, psychological, anthropological, and sociocultural aspects of the phenomenon of a double. Compared with other beings, a human is constantly forming strategies for the realization of his or her freedom. Therefore, human beings do not adapt to the world but create unusual projections of themselves. As a result, there are specific models of entering into the Being, based on a symbolic construction. Symbolism as the main component of duplication is the central point of the study. (...) The symbol allows us to intermediate various important formations of human existence, and to combine contradictory components. Reflection on the role of doubling in human existence is the main approach of this study. A human creates numerous symbolic images such as twins, a mask, a doll, the right and left hand, a mirror, a shadow. Since ancient times, people project themselves into other dimensions, go beyond the usual space and temporal coordinates, push their boundaries, and try to prolong their existence. Doubling helps individuals to assert themselves, find successful forms of life protection, get support in extreme situations, obtain new characteristics, exam the ideal modes of their prototypes. The appearance of a double does not necessarily mean a precise copy of oneself. Rather, it means exploration for a balance, a way to combine the opposites through continuous mediation, comparing oneself with the Other, and understanding one’s own alienation. Reduplication allows people to change, improve, overcome one- dimensionality, construct the identity, and achieve the fullness of their personality. This ability causes self-actualization, self-knowledge, self-awareness, and meaningful self-observation. Duality uncovers the physiological and mental asymmetry of the human being, helps to distinguish between real and virtual, facilitates social adaptation, promotes self-esteem, delineation, and localization of negative manifestations.Manuscript received 11.08.2020. This paper attempts a theoretical discussion of effects on the legal regime of copyright induced by the change from material to digital media. Specifically, a fundamental question remains unanswered: what is the relationship between an object and a copy? A conceptually clear answer to this question has been unnecessary because it has always been possible to provide an ad hoc answer through visual inspection of an object. Authorized mechanical reproductions – authorized copies – look similar to one another, and (...) unauthorized reproductions bear tangible evidence of degradation. Digital reproduction, however, makes such visual inspection impossible, as both authorized and unauthorized digital reproductions look the same. At that moment, one “would expect” that copyright protects the essence of the object, independently of how it looks. Indeed, this is precisely what copyright jurisprudence, which emphasizes originality, tries to do. However, absent the baseline of visual intelligibility, there is no criterion for knowing which object legitimately embodies its eidos and which does not. The effects of this absence stand behind many of the battles surrounding digital reproduction. In section 2, I discuss more precisely how digital reproduction undermines the original/copy distinction. In section 3, I show how the effects of this are manifest in contemporary debates. Section 4 attempts a more theoretical discussion, organized around Deleuze's discussion of Platonism (and the degree to which, for Deleuze, the Platonic original/copy distinction functions to enable the police work of good copy/bad copy). The essay concludes with some thoughts about future developments in copyright and the suggestion that the move to digital rights management technologies are appropriately seen as a response to these conceptual limitations in copyright. In May 2011, the Brazilian Ministry of Health announced the distribution of the first batch of locally produced generic tenofovir disoproxil fumarate (TDF) to support its program of universal and free access for the treatment of HIV/AIDS. The inclusion of TDF in the public health program illustrates what has been considered the ‘Brazilian model’ of HIV/AIDS response, as it illustrates the current phase of the Brazilian pharmaceutical economy. Brazil is known for having managed to control the expansion of HIV/AIDS through (...) a unique initiative combining the public health and the industrial production of generics. But, if at first local manufacturers could freely copy ARVs and produce cheaper generic versions that were delivered to the Ministry of Health, since the country started to grant patents on drugs in 1996, the sustainability of this policy has been challenged by the high cost of patented second-line HIV/AIDS treatments. In order to assure continuity of the local production of ARVs, and keep the program of public health alive, Brazilians are now forced to deal with conflicts of drugs' intellectual property rights in order to open the path to generic production. This article aims to describe the experiences surrounding TDF in Brazil and the unprecedented conflicts and challenges it has brought for our different interviewees. Blurring the frontier between the public and the private, the TDF case was driven at the same time by an ethic of drug access and regulation of drug quality, which has inspired Brazilians to intervene and transform the world they live in.
