Everettian quantum mechanics tells us that the fundamental dynamics of the universe are deterministic. So what are the `probabilities' that the Born rule describes? One popular answer has been to treat these probabilities as rational credences. A recent alternative, Isaac Wilhelm's centered Everett Interpretation (CEI), takes the Born probabilities to be centered chances: the objective chances that some centered propositions are true. Thus, the CEI challenges the `orthodox assumption’ that fundamental physical laws concern only uncentered facts. I (...) provide three arguments against the centered Everett Interpretation. First, I argue that the CEI is in apparent tension with a significant motivation for adopting Everettian quantum mechanics: rejecting the attribution of special significance to observers or agents in fundamental physics. I suggest the CEI can avoid this tension, but only at the cost of sacrificing its central claim that there are objective chances in an Everettian multiverse. My second argument concerns the CEI’s claim that the centered Born rule is a fundamental physical law. I provide two plausible notions of fundamentality for physical laws, and I argue that the centered Born rule satisfies neither. My final argument is that the CEI’s branch-relative laws cannot explain or constrain an agent’s rational credences in the way that the CEI claims. (shrink)

The ethical pre-condition of randomised controlled trials is, at present, the presence of equipoise. This refers to an opinion of the investigator that there is uncertainty as to the merits of the treatments being compared. It is argued that since the decision to enrol is the potential subject’s, the investigator’s opinion is not ethically relevant. It is proposed instead that equipoise be patient-centred, and that a trial is in equipoise for a patient when enrolling gives them the same chance (...) of a good outcome as not enrolling. It is shown that trial enrolment is normally easily the best strategy for achieving a good outcome, and that trials currently thought to be unethical may be in patient-centred equipoise. This is so for three reasons: (1) patients in trials receive superior care, (2) trial enrolment minimises the risk of being a victim of a therapeutic disaster and (3) health professionals make mistakes, and a 50% chance of receiving the worse treatment until a trial reports is always better than any chance of receiving the worse treatment indefinitely. It is concluded that so long as the standard of professional conduct is the furtherance of patients’ objective interests randomised controlled trials are ethical. (shrink)

Healthcare in South Africa is in a crisis. Problems with infrastructure, management, human resources and the supply of essential medicines are at a critical level. This is compounded by a high burden of disease and disparity in levels of service delivery, particularly between public and private healthcare. The government has put ambitious plans in place, which are part of the National Development Plan to ward 2030. In the midst of this we find the individual person and their family and community (...) staggering under the suffering caused by disease, poverty, crime and violence. There is a more than 70% chance that this person and their family and community are trying to make sense of this within a spiritual framework and that they belong to a faith-based community. This article explores the valuable contribution of spirituality, spiritual and pastoral work, the faith-based community and faith-based organisations to holistic people-centred healthcare in South Africa. This paper shows how a particular resiliency-centered approach to chance lends support for two conditions characterizing chance. The first condition says that the present chance of some proposition A conditional on the proposition about some later chance of A should be set equal to that later chance of A. The second condition requires the present chance of some proposition A to be equal to the weighted average of possible later chances of A. I (...) first introduce, motivate, and make precise a resiliency-centered approach to chance whose basic idea is that any chance distribution should be maximally invariant under variation of experimental factors. Second, I show that any present chance distribution that violates the two conditions can be replaced by another present chance distribution that satisfies them and is more resilient under variation of experimental factors. This shows that the two conditions are an essential feature of chances that maximize resiliency. Finally, I explore the relationship between the idea of resilient chances so understood and so-called Humean accounts of chance—one of the most promising recent philosophical accounts of chance. The article emphasises that the importance of Herzen’s philosophical input is related to his human-centered approach. There are three areas of investigation that are of particular importance in this context: responsibility, freedom and chance. I argue that according to Herzen, chance, by tearing apart the net of supposedly necessary causes and effects in the physico-social world, proves that the existence of man is best understood as a manifestation of man's free agency. Since Elga published his “Self-locating belief and the Sleeping Beauty problem,” there has been an intense debate about which credence between 1/2 and 1/3 Beauty should assign to (H) the coin’s landing heads, when she is awakened on Monday. The Halfers claim that she ought to assign 1/2 to H at that moment. The Thirders argue that she ought to assign 1/3 to H then. Meanwhile, Pettigrew defended a new chance-credence coordination principle, called the “Evidential Temporal Principle” (ETP), in (...) a recent edition of his book. In this paper, I provide a novel argument against the Halfer view and a partial defense of the Thirder view, respectively based on ETP. In addition, I generalize ETP to what I call the “Evidential Centered Principle,” which links one’s credences in centered propositions with their objective chances. (shrink)

Alzheimer's disease is the most common neurodegenerative disorder in today's developed world that is also increasingly picked out as a focal theme in fictional literature. In dealing with the subjectivity of human experience, such literature enhances the reader's empathy and is able to teach about moral, emotional and philosophical issues, offering the chance to see situations from a position otherwise possibly never taken by the reader. The understanding and insight so gained may well be unscientific, but the literary approach (...) offers an insight into the whole person's perspective and the particularity and uniqueness of a situation that includes ethical conflicts. A key motif of fictional literature centred around dementia remains the burden the adult-child carer is confronted with, considering the parent's remorseless decline and personality change, the sudden demand for devoted and continuous care, and the constantly changing relationship with the declining parent. In the context of an ever increasing demand for a constructive public discussion regarding end-of-life treatment of demented patients, Christine Devars (Le Piano Désaccordé) and Andrés Barba (Ahora Tocad Música de Baile) illustrate how powerful and burdensome the impact of Alzheimer's disease is on both patient and carer and what extremes may be reached under such truly exceptional circumstances. 1Preface: Malthus the Utilitarian vs. Malthus the Christian moral thinker. The chapter aims at reconstructing the deadlocks of Malthus scholarship concerning his relationship to utilitarianism. It argues that Bonar created out of nothing the myth of Malthus’s ‘Utilitarianism’, which carried, in turn, a pseudo-problem concerning Malthus’s lack of consistency with his own alleged Utilitarianism; besides it argues that such misinterpretation was hard to die and still persists in Hollander’s reading of Malthus’s work. ● -/- 2 Eighteenth-century Anglican ethics. The chapter (...) gives an overview of eighteenth-century Anglican ethics, noticing how the Cambridge tradition gave special weight to natural theology as opposed to positive or revealed theology and how two Cambridge fellows, John Gay and Thomas Brown worked out a kind of a rational-choice account of the origins of natural laws, where a law-giver God chooses among a number of possible sets of laws on the basis of a maximizing criterion, happiness for his creatures. ● -/- 3 Malthus’s meta-ethics. The chapter reconstructs the two ethical chapters of the second Essay. It argues that Malthus’s ethics is not dependent on Paley’s, but is derived from Cumberland, Butler, Gay, Brown. Besides, it argues that theodicy takes a new place in the 1803 Essays and ethics becomes a key to theodicy. The new solution is that, once it has been proved that passions can be mastered and that a world where passions are under control would be a comparatively happy place, a society where moral restraint prevailed would make the middling ranks more numerous, reduce dependence, and preserve liberty. ● -/- 4 Malthus’s early normative ethics: a morality of freedom. The chapter reconstructs young Malthus’s views on the foundations of ethics, proving his adhesion to voluntarist consequentialism. Then it reconstructs his treatment of political issues, whence a clear stance emerges in favour of traditional Whig concerns, such as political freedom, personal independence and dignity. Finally, it gives a fresh look at the theological argument in the two well-known final chapters, locating it in the context of consequentialism, voluntarism, and quasi-Leibnizian theodicy. ● -/- 5 Malthus’s intermediate normative ethics: a morality of prudence. Malthus’s normative ethics focuses on two main ‘natural’ virtues, benevolence and chastity, and three artificial virtues. These include love for equality and love for liberty. A special place is granted to another virtue, prudence, which is the link between natural and artificial virtues. This special virtue also provides an invisible link between the private and the public domains, in that it contributes to combine self-love with general happiness. This is granted by the unintended results mechanism, or “the happiness of the whole is to be the result of the happiness of individuals, and to begin first with them. No cooperation is required”. ● -/- 6 Malthus’s mature normative ethics: a morality of humanity. The chapter describes reactions by Evangelicals, such as Gisborne, Sumner, and Chalmers, to Malthus’s theory and Malthus’s transformation of his own system in order to pave objections. This amounts to incorporating The Evangelicals’ ideas into his own system. The friendly controversy with his Evangelical fellow-travellers yielded several important changes in 1806, 1817, and 1826 editions of the second Essay in the formulation of Malthusian ethics, in the adoption of moral improvement instead of happiness as the variable to be maximised, in the adoption of generalized education as the main weapon in the war on poverty. ● -/- 7 Malthus’s applied ethics. The chapter reconstructs Malthus’s treatment of a few issues in ‘applied ethics’, sexual morality, public morality, poverty, and besides, war and slavery. On the first issue, he argues the duty to marry only at a time when one is ready to carry the burden of six children as a moral duty imposed by prudence and rejects birth control because of its alleged effect of encouraging ‘indolence’. On the second issue, he defends a peculiar kind of Whiggism as anti-Machiavellian politics centred on rights, equality, and dignity. On the third issue, his final approach is a kind of Institutional approach to poverty, making room for generalized basic education, free markets for labour and allowing for a subsidiary role for private beneficence. The goal to be aimed at is bringing about circumstances which tend to elevate the character of the lower classes of society and offer them a chance of being respectable, virtuous and happy. ● -/- 8 Conclusions: strengthening the theological foundation. Malthus’s criteria for policy appraisal were not utilitarian ones. His normative ethics and his politics were sharply different from Bentham’s. Utility is just one element in Malthus’s ethics, going with laws of nature and rights, and ironically, far from being a Benthamite insertion, is the most markedly theological element in Malthus’s system of ideas. ● -/- . Ann Arbor, MI: Open Humanities Press. 2011. 316 pp. | ISBN 9781607852049. | $23.99 For two decades post-anarchism has adopted an epistemological point of departure for its critique of the representative ontologies of classical anarchism. This critique focused on the classical anarchist conceptualization of power as a unitary phenomenon that operated unidirectionally to repress an otherwise creative and benign human essence. Andrew Koch may have inaugurated this trend in (...) 1993 when he wrote his influential paper entitled “Post-structuralism and the Epistemological Basis of Anarchism.” Koch’s paper certainly laid some of the important groundwork for post-anarchism’s continual subsumption of ontology beneath the a priori of an epistemological orientation, and his work continues to be cited as an early and important venture into post-anarchist philosophy. The problem is that Koch could not conceive of an anti-essentialist and autonomous ontological system, one not subject to regulation or representation by the human mind. Consequently, he was forced to assert a subjectivist claims-making ego as the foundation of a post-structuralist anarchist politics. Saul Newman was indebted to this heritage insofar as he also posited the ego (extrapolated from the writings of Max Stirner) and the subject (extrapolated from Jacques Lacan’s oeuvre ) as the paradoxical ‘outside’ to power and representation. Todd May fell into a similar trap in his book The Political Philosophy of Post-structuralist Anarchism when he wrote that “[m]etaphysics [...] partakes of the normativity inhabiting the epistemology that provides its foundations.” 1 Whereas Newman’s approach did not necessarily foreclose the possibility of metaphysics—at least to the extent that he began with the subject of the Lacanian tradition (wherein the subject is believed to be radically split between thinking and being)—May completely foreclosed the possibility of any escape from the reign of the epistemological. There laid the impasse of yesterday’s post-anarchism. This impasse at the heart of the project of post-anarchism has forced Koch, Newman, May, and many others, to come to similar conclusions about the place of ontology in post-anarchist scholarship. The post-anarchists have all formulated a response strikingly similar to Koch’s argument that any representative ontology ought to be dismantled and dethroned in favour of “a conceptualization of knowledge that is contingent on a plurality of internally consistent episteme .” 2 By dismissing all ontologies as suspiciously representative and as incessantly harbouring a dangerous form of essentialism, post-anarchists have overlooked the privilege that they have placed on the human subject, language, and discourse, at the expense of the democracy that the human subject shares with other animals, objects, and beings in the world. This epistemological characterization of post-anarchism has held sway for far too long. It is not by chance that post-anarchism, as a concept, was first formulated by Hakim Bey as an “ontological anarchism,” 3 and subsequently repressed by the canon of post-anarchist authors. Perhaps Bey’s ontological anarchism also lacked the ‘rigour’ required of today’s scholarly audience and for these two reasons (at least) he has received very little credit for his inaugurating efforts into post-anarchism. In any case, I want to challenge this reluctance and revive the roots of post-anarchism. Levi Bryant gives us a reason to believe that we can achieve the promise of Bey’s ontological anarchism without sacrificing the scholarly standard of rigour. Levi Bryant’s newest open-access book, The Democracy of Objects , is a tour de force . His book challenges post-anarchists to take their radical critique of representation a step further by questioning the “hegemony that epistemology currently enjoys in philosophy.” Bryant maintains that post-structuralism, and radical anti-humanisms, only appear to reject the subject as the locus of political agency. Their rejection is actually more of a disavowal, a replacement of the human subject with the equally human order of language or discourse. What post-structuralism attempts to elucidate is the manner in which the subject is colonized by the Other of language, discourse and social relations. What here appears as a movement away from the determining subject of humanism and existentialism is only replaced with the determining apparatuses of structures as they are conceived by astute analysts of political culture. Post-structuralism thus re-enters the anthropocentric discourse to the extent that the cultural analyst believes himself capable of conceiving the determinative structures of society. In contradistinction to the claims of post-structuralism and post-anarchism, the role of the ontologist is not to suture the gap between epistemology and the real but to de-suture it, as Bryant puts it: “[o]ntology does not tell us what objects exist, but that objects exist, that they are generative mechanisms.” Above all else, the role of ontology, for post-anarchists, ought to be a real de-centering of the subject in relation to other objects in the non-human world such that the subject becomes conceived as one object among others within a living democracy of equality. This inevitably leads to the conclusion that objects exist whether or not the subject or analyst is there to represent them: they represent themselves and are autonomous from our dictation, just as each object finds its autonomy in relation to other objects. Ontology must now be distinguished from representation. We must shift the terms of the debate and interrogate the hegemony that epistemology has been afforded within post-anarchist philosophy. At least two possibilities are now permitted. On the one hand, one could intervene into the reigning mode of philosophy, namely epistemology, by latching onto concepts from meta-ethical philosophy. Meta-ethics allows one to easily separate the ontological from the epistemological and to answer very particular questions about each in order to formulate an overarching meta-ethical position. 4 Post-anarchism is particularly adept at this task because of its resounding ability to frame itself as an ethical political philosophy in relation to the strategic political philosophy of classical Marxism. On the other hand, Bryant argues that “[p]erhaps the best way to defeat [the privilege currently held by epistemology] is to shift the terms of debate.” Shifting the terms of debate is also something that post-anarchists have been very good at doing. Thus, instead of asking the question ‘how do representative ontological systems harbour concealed epistemological orientations toward the political?’ one might ask ‘ do epistemological orientations toward the political always harbour representative and subject-centred ontological systems?” The genius of Bryant’s book rests in its ability to convincingly argue for the radical autonomy of being and of objects. This claim speaks to some of the most compelling theories of the political in anarchist and marxist political philosophy (for instance, hegemony, representation, democracy, and so on) and it re-stages the political drama of our times across a much wider terrain. The fallacy of strategic political philosophy in the Marxist tradition, as Todd May quite correctly points out, is that it remains committed to a concept of power that is unitary in its analysis, unidirectional in its influence, and utterly repressive in its effect. Similarly, Bryant’s ontology allows one to argue that there is a fallacy that occurs “whenever one type of entity is treated as the ground or explains all other entities.” Whereas May’s post-structuralist anarchism moved away from the fallacy of the unitary analysis of power, whereby subjects are constituted by the influence of a single site of power, it nonetheless remained committed to a tactical political philosophy which is monarchical in the final analysis . It remains monarchical to the extent that the human world, the world of epistemology, is treated as the yardstick of democracy. Bryant’s argument is quite instructive: “[w]hat we thus get is not a democracy of objects or actants where all objects are on equal ontological footing [...] but instead a monarchy of the human in relation to all other beings.” The real fallacy is thus not against strategic political philosophy but philosophy itself and the way it has played out over so many centuries. “The epistemic fallacy,” writes Bryant, “consists in the thesis that proper ontological questions can be fully transposed into epistemological questions.” The point that Bryant is making relates to the way ontology is today always reduced to an epistemology and thereby loses its significance as a philosophical question. This book should be applauded for its novelty and its thesis ought to be taken seriously by post-anarchists today. Because of this book, and the attendant post-continental movement that is being called ‘speculative realism,’ we can now distinguish three stages in the life of post-anarchism. First, we can deduce what Süreyya Evren has described as its ‘introductory period.’ The introductory period of post-anarchism is defined by its inability to side-step the ontological problem in the literature of classical anarchism. During this period, post-anarchism needed to distinguish itself from classical anarchism while nonetheless remaining committed to its ethical project. The second period overcomes the problem of the separation of post-anarchism from classical anarchism by re-reading the classical tradition as essentially post-anarchistic. Some of the critiques of post-anarchism—especially that from Cohn & Wilbur 5 —are included into this period insofar as post-anarchism, for them, was always already anarchism. Whereas the first and second phases have included only explicitly anarchist literature under their rubric of worthwhile investigation, in the third period this no longer holds true. To be certain, the second period permitted the incorporation of post-structuralist literature into post-anarchist discussions (but always with a certain amount of reservation). This third period, the one that is to come—the one that is already here if only we would heed its call—will not take such care with attempts at identification or canonization. In vitro fertilisation (IVF) daily practice reveals that couples are willing to take greater risks than doctors if there is a higher chance of pregnancy. Arising from this is a frequently addressed issue regarding the embryo transfer strategy: single or double embryo transfer? The dilemma is faced by patients, as well as physicians, who are caught between the possibility of no pregnancies at all and facing the prospect of iatrogenic twin gestation. How could the couple's preferences concerning how many (...) children they would like be taken into account in determining the number of embryos transferred? How should the physician exercise his medical responsibility towards his patients and the unborn child? An effective approach could be to enhance a couple’s autonomy by advocating a medical beneficence that incorporates patients’ values. This can be achieved through a case-by-case approach in a deliberative process of decision-making which includes real patient-centred communication. (shrink)

If chances are propensities, what reason do we have to expect them to be probabilities? I will offer a new answer to this question. It comes in two parts. First, I will defend an accuracy-centred account of what it is for a causal system to have precise propensities in the first place. Second, I will prove that, given some pretty weak assumptions about the nature of comparative causal dispositions, and some fairly standard assumptions about reasonable measures of inaccuracy, propensities must (...) be probabilities. The centered Everett interpretation solves a problem that various approaches to quantum theory face. In this paper, I continue developing the theory underlying that solution. In particular, I defend the centered Everett interpretation against a few objections, and I provide additional motivation for some of its key features.

I propose an account of probability in the Everett interpretation of quantum mechanics. According to the account, probabilities are objective chances of centered propositions. As I show, the account solves a number of problems concerning the role of probability in the Everett interpretation. It also challenges an implicit assumption, concerning the aim and scope of fundamental physical theories, that is made throughout the philosophy of physics literature.

Ideas about heredity and evolution are undergoing a revolutionary change. New findings in molecular biology challenge the gene-centered version of Darwinian theory according to which adaptation occurs only through natural selection of chance DNA variations. In Evolution in Four Dimensions, Eva Jablonka and Marion Lamb argue that there is more to heredity than genes. They trace four "dimensions" in evolution -- four inheritance systems that play a role in evolution: genetic, epigenetic, behavioral, and symbolic. These systems, they argue, (...) can all provide variations on which natural selection can act. Evolution in Four Dimensions offers a richer, more complex view of evolution than the gene-based, one-dimensional view held by many today. The new synthesis advanced by Jablonka and Lamb makes clear that induced and acquired changes also play a role in evolution.After discussing each of the four inheritance systems in detail, Jablonka and Lamb "put Humpty Dumpty together again" by showing how all of these systems interact. They consider how each may have originated and guided evolutionary history and they discuss the social and philosophical implications of the four-dimensional view of evolution. Though antiretroviral therapy is the standard of care for people living with HIV, its treatment limitations, burdens, stigma and costs lead to continued interest in HIV cure research. Early-phase cure trials, particularly those that include analytic treatment interruption, involve uncertain and potentially high risk, with minimal chance of clinical benefit. Some question whether such trials should be offered, given the risk/benefit imbalance, and whether those who choose to participate are acting rationally. We address these questions through a longitudinal decision-making (...) study nested in a Thai acute HIV research cohort. In-depth interviews revealed central themes about decisions to join. Participants felt they possessed an important identity as members of the acute cohort, viewing their bodies as uniquely suited to both testing and potentially benefiting from HIV cure approaches. While acknowledging risks of ATI, most perceived they were given an opportunity to interrupt treatment, to test their own bodies and increase normalcy in a safe, highly monitored circumstance. They were motivated by potential benefits to themselves, the investigators and larger acute cohort, and others with HIV. They believed their own trial experiences and being able to give back to the community were sufficient to offset participation risks. These decisions were driven by the specific circumstances experienced by our participants. Judging risk/benefit ratios without appreciating these lived experiences can lead to false determinations of irrational decision- making. While this does not minimise vital oversight considerations about risk reduction and protection from harm, it argues for inclusion of a more participant-centered approach. (shrink)

Bayesianism is a collection of positions in several related fields, centered on the interpretation of probability as something like degree of belief, as contrasted with relative frequency, or objective chance. However, Bayesianism is far from a unified movement. Bayesians are divided about the nature of the probability functions they discuss; about the normative force of this probability function for ordinary and scientific reasoning and decision making; and about what relation (if any) holds between Bayesian and non-Bayesian concepts.

A practical hermeneutics of time. The Possible Present unfolds from within a freely reinterpreted hermeneutic perspective and provides an original theoretical proposal on the topic of time. In dialogue especially with the philosophies of Husserl and Heidegger, but resorting also to suggestions coming from a theological background (Barth and Bonhoeffer), the work proposes a personal and original theory of time centered on a conception of the present that does not reduce temporality to a succession of mere instants. When one (...) claims that time is ungraspable, one refers neither to the past (which is rather irretrievable) nor to the future (which is rather uncertain) but to the present. The present in which we are is in fact what fades from our hands without break. The present is a decisive threshold for finite existence. It is the threshold where past and future meet and can give birth to a livable horizon of meaning. Dilating the present and giving it a meaningful chance to be is a task for philosophy. It is the attempt of giving time to time and also giving it shape, place, and space. To succeed at this task while rediscovering the sources of a narrative way of thinking that in truth it has never abandoned, philosophy must go back and turn time into the primary object of discourse, like in stories, which are precisely the attempt at disposing the temporal flow of events according to a meaning. Perone argues that in time, however, what passes is not simply decline, but rather something irreducible, an exteriority that must be said. (shrink)

In “The Presumption in Favor of Requirement Conflicts” Julie McDonald has offered some serious and challenging criticisms of the recent literature centered around the moral dilemmas debate. If McDonald is correct, the philosophers who have contributed to this debate share some questionable presuppositions about the role and significance of an adequate moral theory. It is beyond dispute that the moral dilemmas debate has elevated the importance of requirement conflicts above other types of conflicts. McDonald argues that this is a (...) needlessly restrictive way to approach the issue. She maintains that the potential for unavoidable moral residue in the form of guilt, as well as the chance of moral unresolvability, are the two central concerns which motivate the issue. These concerns then figure into her diagnosis of the implicit background assumptions that explain the rationality of the debate. In what follows I shall consider whether or not the participants to this debate are forced to accept these assumptions. (shrink)

Two broad metaphysical perspectives deriving from Parmenides and Heraclitus have implications for our notion of sustainability. The Parmenidian defends a deepseated orderliness and permanence in things, while the Heraclitian finds only chance and change. Two further outlooks, the nomic (or the big-picture scientific) and the prudential, present differing accounts of our place in the world. While the nomic outlook accepts nothing privileged about the human perspective or even life itself, the prudential outlook is obviously welfare-centered. It is argued (...) that nomic views, whether Parmenidian or Heraclitian, fail to provide any rationale for sustainability measures or concerns. The only such rationale comes from Parmenidian prudentialism, which, I argue, can operate only if it disowns at its peril the nomic point of view and couches sustainability entirely under the rubric of maximizing certain preferred opportunities drawn from collective self-love. But doing so merely evades rather than answers the tension imposed by the nomic Heraclitian for whom nothing lasts and nothing human counts specially in the measure. The liabilities of Parmenidian prudentialism are examined and found to be too great for any consistent notion of sustainability to bear. (shrink)

Legal doctrine is a kind of legal research, occupying the central position in professional legal writing, e.g., handbooks, monographs, commentaries and legal textbooks etc. It consists of a description of the literal sense of legal statutes, precedents etc., intertwined with many moral and other substantive reasons. Legal doctrine has normative components, and produces coherence in the law in many aspects. It also produces some justice. However, legal doctrine has faced repeated criticism, not least from minimalist philosophers.The author proposes a “Copernican (...) revolution” as regards the relation of legal theory to philosophy. Instead of attempting to make legal theory follow one of the notoriously controversial moral theories, he tries to adjust philosophy to legal theory. In the search for philosophy adjusted to legal doctrine, he prefers cautious (weak) philosophical positions to courageous (strong) ones. He also assumes a society‐centered theory of normativity, a coherentist theory of legal knowledge and a coherentist theory of justice.However, a law theorist has no chance to elaborate such theories in detail. Hence, the author poses the following questions to philosophers: How can a law theorist assume society‐centered normativity without being forced to enter the controversies around collectivism? How can a law theorist assume the common core of morality for society without being forced to enter technical controversies in political philosophy? How can the law theorist base his thinking on the coherence theory of law without being forced to enter technical controversies around the concept of coherence? Partant du caractère énigmatique et très inquiétant de cette thèse et constatant sa résonance avec l’affirmations deleuzienne, dans Différence et répétition, « Les masques ne recouvrent rien, sauf d’autres masques », nous avons voulu explorer la possibilité (...) de prendre pleinement au sérieux la formule merleau-pontyenne et de lui donner l’envergure d’une théorie des simulacres rendue éthiquement féconde. Le contexte, un dialogue avec Sartre et Nizan entre désenchantement, découragement et nouvelles perspectives éthiques et politiques, nous projette d’emblée dans un pensée de l’adversité et des apories indissociables de la rencontre d’autrui. Il permet également d’entrer avec Merleau-Ponty dans la quête d’une théorie éthique et politique de la communauté non exclusive de l’altérité radicale. A partir d’une analyse de la notion de masques et de ses occurrences dans les travaux de Merleau-Ponty, nous montrons que toute image est essentiellement un masque ontologiquement premier, c’est-à-dire qui ne copie ni ne recouvre une réalité plus authentique. La formulation de Signes qui nous intéresse fait d’emblée apparaître la dimension éthiquement dramatique de cette ontologie. Ce qui est en cause est une hyper-crise, une pensée de l’abîme et des ruptures de sens. Comment agir quand tout être est évasif et autre que soi? Nous aimerions montrer que surgit, dans l’oeuvre merleau-pontyenne, une tension entre une première solution pratique centrée sur la foi et une seconde voie « centrée », si l’on peut dire, sur la temporalité tourbillonnaire de l’institution. Ces deux issues pratiques, qui ne sont pas si nettement circonscrites explicitement par Merleau-Ponty, mais se déploient plutôt de texte en texte sous des formes parfois entremêlées, parfois incompatibles, doivent être, selon nous, soigneusement distinguées. La première, la solution de la foi, fait trop peu de cas du caractère trompeur de l’Urdoxa et des dangers d’une action qui ne s’inquiète pas de la mystification et des biais sur lesquels, peut-être, elle repose. La seconde, la voie de l’institution ne prétend plus surmonter le vertige, mais parvient à en faire un atout. Les masques, compris comme essentiellement instituants – en même temps qu’ils éclairent sur le sens de la notion merleau-pontyenne d’institution – peuvent retrouver un rôle éthique : passer de masque en masque sans jamais trouver de visage, autrement dit répondre à côté, c’est répondre tout de même et cela peut même être la meilleure réponse et compréhension possibles puisque les masques euxmêmes, comme institutions, sont des « visées à côté » qui réclament indéfiniment de nouvelles reprises et ont le pouvoir de relier entre elles, dans une structure de dialogue sans fin, des réinstitutions pourtant minées par une opacité à soi et aux autres. Les simulacres peuvent ainsi devenir en tant que tels notre plus grande chance : véhicules d’altérité radicale et de communication pourtant ininterrompue. Cette théorie élaborée à partir des thèses et analyses merleau-pontyennes fait place aux expériences commotionnantes, mais a, en même temps et sans contradiction, le mérite d’insister davantage, sans attendrissement, sur l’heureuse nature de l’être au lieu de déboucher sur la misosophie que développera Deleuze.“Under the masks, there are no faces: historical man has never been man, and yet, no man is alone.” This article questions the meaning and the ethical stakes of this Merleau-Pontian affirmation articulated in the preface of Signs. Beginning with the enigmatic and very worrisome character of this thesis, and while noticing its resonance with Deleuzian affirmations in Difference and Repetition—“masks recover nothing apart from other masks”—we wanted to explore the possibility of taking seriously the Merleau-Pontian formula and to give it meaning as a theory of ethically productive simulacra. The context, a dialogue between Sartre and Nizan regarding disenchantment, despondency and new ethical as well as political perspectives, immediately projects us toward the thought of adversity and the inseparable aporias in the encounter with the Other. Equally, it permits us to enter with Merleau-Ponty into a search for a political and ethical theory of the community that is not exclusive to radical alterity. Starting from an analysis of the concept of masks and its occurrences in the works of Merleau-Ponty, we show that all image is essentially first an ontological mask; that is to say, one that does not copy nor recovers a more authentic reality. The formulation in Signs which interests us immediately reveals the dramatic ethical dimension of this ontology. That which is a cause is a hyper-crisis, a thought of the damage and the rupture of meaning. How does one act when all being is evasive and other than oneself? We would like to show that what surfaces in Merleau-Ponty’s work is a tension between a primary practical solution centered on faith and a second path “centered,” if we can say this, on the turbulent temporality of the institution. These two practical issues, which are not so explicitly circumscribed by Merleau-Ponty, but which rather reveal themselves from text to text in somewhat intermingled and sometimes incompatible forms must be carefully distinguished. The first, the solution of faith, makes too little of the falsifying character of the Urdoxa and the dangers of an action that is not concerned with the mystification and biases on which, perhaps, it rests. The second, the path of the institution, does not attempt to surmount the vertigo, but nevertheless manages to hold the advantage. The masks, understood essentially as “instituted,” which at the same time clarify the meaning of the Merleau-Pontian notion of the institution, are able to rediscover an ethical role: passing from mask to mask without ever uncovering a face or, stated otherwise, responding side by side, is nevertheless a response. Moreover, this might provide an even better response and possible understanding since the masks themselves, as institutions, are proximate viewfinders which indefinitely reclaim new recoveries and which have the ability to link up with each other in a never-ending structure of dialogue regarding “reinstitutions” despite being undermined by the opacity of self and other. The simulacra can also become as they are in themselves a greatest chance: vehicles of radical alterity and communication, but uninterrupted. This theory, elaborated from the theses and analyses of Merleau-Ponty, gives way to experiences of shock, but, at the same time and without contradiction, to the right to insist further, without tenderness, on the happy nature of being instead of opening itself up to the misosophie that Deleuze will develop.“Dietro le maschere non ci sono volti, l’uomo storico non è mai stato uomo, e tuttavia nessun uomo è solo”: il nostro articolo si interroga sul senso e sulla posta in gioco etica di questa affermazione merleau-pontyana che troviamo nella Prefazione a Segni. Il contesto, quello di un dialogo con Sartre e Nizan intorno ai temi del disincanto e delle nuove prospettive etiche e politiche, ci proietta direttamente nello spazio di un pensiero dell’avversità e delle aporie indissociabili dall’incontro con l’altro, e consente parimenti di farci strada con Merleau-Ponty in direzione di un’etica e di una politica della comunità non esclusiva della dimensione dell’alterità radicale. A partire da un’analisi della nozione di maschera e delle sue occorrenze nei testi merleau-pontyani mostriamo che ogni immagine è una maschera ontologicamente prima, che non copia e non ricopre affatto una realtà più autentica. La formulazione richiamata da Segni introduce immediatamente alla dimensione eticamente drammatica di tale ontologia. La sua posta in gioco è quella di un ipercriticismo, di un pensiero dell’abisso e dell’interruzione del senso. Come agire quando ogni essere è evasivo ed è altro rispetto a se stesso? Vorremmo mostrare che a quest’altezza si fa strada nell’opera merleau-pontyana una tensione tra una prima soluzione pratica, affidata alla dimensione della fede, e una seconda via d’uscita “incentrata”, se così si può dire, sulla temporalità spiraliforme dell’istituzione. Questi due esiti pratici, che in Merleau-Ponty non risultano nettamente ed esplicitamente circoscritti, ma si dispiegano di testo in testo dando luogo a sovrapposizioni e al limite a contraddizioni, vanno invece, a nostro avviso, accuratamente distinte. La prima, la soluzione della fede, fa troppo poco spazio al carattere ingannevole dell’Urdoxa e ai pericoli di un’azione che non si preoccupa di farsi carico delle mistificazioni e delle deformazioni su cui essa forse si fonda. La seconda, la soluzione dell’istituzione, non pretende più di oltrepassare la vertigine ma arriva a farne una risorsa. Le maschere, intese come essenzialmente istitutive, facendo luce sulla nozione merleau-pontyana di istituzione vengono a giocare un ruolo etico: passare di maschera in maschera senza mai trovare volti, in altri termini rispondere “a lato”, significa rispondere comunque e forse rispondere nel modo migliore, secondo la migliore comprensione possibile. Poiché le maschere stesse in quanto istituzioni sono delle “visées à côté” che chiamano indefinitiamente a nuove riprese e hanno il potere di legare tra loro in un dialogo senza fine una serie di re-istituzioni inevitabilmente opache a sé e agli altri. I simulacri possono così diventare, proprio in quanto simulacri, la nostra più grande chance: veicoli di alterità radicale e di comunicazione ininterrotta. Questa teoria, elaborata a partire dalle tesi e dalle analisi merleau-pontyane, consente di fare spazio a esperienze di grande momento emotivo, e allo stesso tempo, senza contraddizione, di insistere senza sentimentalismi sulla felice natura dell’essere, evitando infine la “misosophia” a cui approda Deleuze. Facing the risks of a spiritual malady due to a profound alienation from his very own essence, human being has to look for the best opportunities in avoiding the situation of becoming the prison of (...) an artificial existence’s captivities and of falling in barbarism. Thus, we think that a real chance for human well-being rising to the excellence of man is an aretaic propaideia; respectively, an education centered on the moral meaning of arete / virtue, by restoring the significance of golden measure, finally leading to equilibrium and harmony, to the health and the joy of an authentic human life in freedom and dignity. Mindfulness and compassion meditation are thought to cultivate prosocial behavior. However, the lack of diverse representation within both scientific and participant populations in contemplative neuroscience may limit generalizability and translation of prior findings. To address these issues, we propose a research framework calledIntersectional Neurosciencewhich adapts research procedures to be more inclusive of under-represented groups. Intersectional Neuroscience builds inclusive processes into research design using two main approaches: 1) community engagement with diverse participants, and 2) individualized multivariate neuroscience methods to accommodate neural (...) diversity. We tested the feasibility of this framework in partnership with a diverse U.S. meditation center (East Bay Meditation Center, Oakland, CA). Using focus group and community feedback, we adapted functional magnetic resonance imaging (fMRI) screening and recruitment procedures to be inclusive of participants from various under-represented groups, including racial and ethnic minorities, gender and sexual minorities, people with disabilities, neuropsychiatric disorders, and/or lower income. Using person-centered screening and study materials, we recruited and scanned 15 diverse meditators (80% racial/ethnic minorities, 53% gender and sexual minorities). The participants completed the EMBODY task – which applies individualized machine learning algorithms to fMRI data – to identify mental states during breath-focused meditation, a basic skill that stabilizes attention to support interoception and compassion. All 15 meditators’ unique brain patterns were recognized by machine learning algorithms significantly above chance levels. These individualized brain patterns were used to decode the internal focus of attention throughout a 10-min breath-focused meditation period, specific to each meditator. These data were used to compile individual-level attention profiles during meditation, such as the percentage time attending to the breath, mind wandering, or engaging in self-referential processing. This study provides feasibility of employing an intersectional neuroscience approach to include diverse participants and develop individualized neural metrics of meditation practice. Through inclusion of more under-represented groups while developing reciprocal partnerships, intersectional neuroscience turns the research process into an embodied form of social action. (shrink)

There is widespread agreement that medical care offered at the end of a life ought to accord with the preferences of the person whose life it is, at least if the care requested would not be futile. There is considerable evidence, too, that making care more “patient‐centered” in this way would tend to lower the cost of care, for the simple reason that people in those straits often prefer to avoid the most intrusive and therefore most expensive care. So (...) patient‐centered care could be a win‐win of sorts: there could be a collective benefit of lowering costs along with the individual benefit of conforming care better to what the patient wants. But to what degree should the collective benefit be an express goal of health reform, in light of the fact that a given patient might want whatever intrusive, aggressive interventions stand a chance of prolonging life? This is what I thought as I watched and shadowed a seasoned interpreter at a world-renowned medical center, during my J-term internship. The fact that I had gotten this opportunity was still hard to believe. There I was, shadowing medical interpreters at one of the best hospitals in the world during my senior year of (...) college after abruptly dropping my secondary education minor to pursue a career in medical interpreting. I felt fortunate for the opportunity and seized the chance to learn from the best of the best.When that same institution hired me after I graduated college in 2006, my training consisted of shadowing other interpreters and having them shadow me. There was no strict process, just one-on-one on-the-job training. The training I received was the best it could be at the time, but not even close to what it takes for an interpreter to become confident and prepared to interpret for most appointments.Growing up I hadn't been interested in the medical profession. When I started working as an interpreter, I soon learned that in addition to my A and B languages, I also needed to learn a C language—the language of medicine. Just as I learned Spanish, I had to learn that a CAT scan was a type of imaging study, and a creatinine level was a measure of kidney function. I was fascinated by the language of medicine. The acronyms, medications, diseases, body parts, hormones, markers, genes, everything.As fascinating as medicine was, it wasn't the reason I considered medical interpreting my calling. As soon as I started working as a volunteer healthcare interpreter at a local free clinic, I knew it was the way I wanted to make a difference in the world. The Spanish speakers I was helping were low-income, underprivileged people with serious medical conditions and a host of other socioeconomic problems. These were people who needed help. These were people who needed to be heard. These were people who needed to be seen. As an interpreter, I would be able to give them a voice. Fast forward 18 years and I am still making a difference in the lives of patients with Limited English Proficient (LEP) by giving them the gift of communicative autonomy, or the right to be in control of and responsible for their own communication.Communicative autonomy is one of the founding principles of the medical interpreting profession. It differentiates the professionals from ad-hoc interpreters and bilingual family and friends. This is because upholding communicative autonomy means that regardless of my personal beliefs, I must remain impartial in all situations. I must interpret what is said and allow all parties involved [End Page 156] to guide the conversation as they see fit. Ideally, I only intervene to mediate for cultural or linguistic reasons when needed.Some of the most ethically conflicting cases I have had to interpret have centered around pregnancy loss and abortion. When I started interpreting, I was a young single woman with a relatively liberal view on reproductive rights. However, one stillbirth and three healthy pregnancies later, my personal beliefs on the subject have become more complicated. Each time I interpret for a loss or induced abortion, I must dig deep and ask myself if I can remain impartial. I can still remember the first time I faced this dilemma.One evening, I was called to interpret for a labor and delivery case. When I arrived, I was informed that it was an induction of an 18-week-gestation fetus that had tested positive for Down syndrome on genetic testing. At the time, I didn't have strong beliefs about abortion. I had never been pregnant and really wasn't sure where I stood on the spectrum of a woman's body, a woman's choice, and abortion is murder. However, there I was, smack dab in the middle of an elective abortion on a weeknight.The bereavement nurse was seasoned and experienced. In modern hospitals in developed countries, deaths are determined usually after a prearranged schedule of resuscitative efforts. By default, death is diagnosed and determined after “full code” or after the failure of intensive resuscitation. In end-of-life contexts, however, various degrees of less-than-full resuscitation and sometimes no resuscitation are allowed after the consent and shared decision-making of the patient and/or surrogates. The determination of brain death is a unique exception in these contexts because such an end-of-life care plan is usually not (...) offered until after brain death is declared. This essay analyzes and critiques three arguments for denying the family and/or surrogate a chance to consent to or forego the diagnostic protocol of brain death and choose an alternative end-of-life plan. First, opponents of consent for the determination of brain death argue that presenting it as a selectable end-of-life plan undermines the integrity of death determination. The second argument is that it is inconsistent to allow foregoing the determination of brain death when the determination of circulatory death is non-negotiable. The third argument is that allowing the patient/surrogate to forego the determination of brain death would jeopardize the fair and appropriate utilization of intensive care resources and potentially reduce organ donor pools. After closer conceptual examinations of these three arguments, this essay concludes that these arguments are conceptually and morally problematic. It defends an alternative patient-centered end-of-life care plan based on consent and shared decision-making. (shrink)

Why should we make our beliefs consistent or, more generally, probabilistically coherent? That it will prevent sure losses in betting and that it will maximize one’s chances of having accurate beliefs are popular answers. However, these justifications are self-centered, focused on the consequences of our coherence for ourselves. I argue that incoherence has consequences for others because it is liable to mislead others, to false beliefs about one’s beliefs and false expectations about one’s behavior. I argue that the moral (...) obligation of truthfulness thus constrains us to either conform to the logic our audience assumes we use, educate them in a new logic, or give notice that one will do neither. This does not show that probabilistic coherence is uniquely suited to making truthful communication possible, but I argue that classical probabilistic coherence is superior to other logics for maximizing efficiency in communication. Background: Artificial intelligence (AI) is transforming healthcare systems by improving operational efficiency, simplifying patient care procedures, and improving diagnostic accuracy. Artificial intelligence (AI) technologies, like machine learning and natural language processing, present previously unheard-of chances to quickly and accurately evaluate enormous volumes of healthcare data, assisting with clinical decision-making and enhancing patient outcomes. Aim thorough examination and analysis of artificial intelligence's impact on healthcare leadership, with a particular emphasis on present nursing trends and their implications for the future. The study (...) tries to uncover the advantages, difficulties, and consequences of AI integration by looking at how AI technologies including clinical decision support systems, predictive analytics, robots, natural language processing, and telehealth are being used in nursing practice. Method: A comprehensive analysis including research articles published between 2015 and 2024 was carried out. To give a thorough overview of AI's present and future uses in healthcare, major themes and trends were found and summarized. Results: By stressing AI's role in improving diagnostic accuracy and patient outcomes, the study highlights the technology's major contributions to drug discovery, virtual patient care, and medical imaging. Human-centered design concerns, the necessity of educational changes, and ethical challenges surrounding the application of AI surfaced as crucial topics needing attention. Conclusion: AI has enormous potential to transform healthcare by enhancing operational effectiveness, optimizing the delivery of care, and increasing diagnostic precision. Background This study was designed to investigate how patient-reported shared decision-making relates to other aspects of patient centredness and satisfaction. Methods Questionnaire study with patients. Consecutive patients in primary care responding post visit. Associations are presented as proportions, positive predictive values, with 95% confidence intervals. Results 223 patient questionnaires were included. 62% (95% Confidence interval (CI): 55–69) of the patients indicated the highest possible rating of being involved in the decisions about their ongoing care (self-reported SDM). Self-reported SDM had a (...) positive predictive value (PPV) of between 85% (CI: 77–90) and 95% (CI: 90–98) for five other patient-centred aspects and satisfaction. Conclusion The results suggest that shared decision making is the patient-centred aspect hardest to achieve and that a patient-centred process leading up to the decision-making increases the chance of the patient being involved in the decision-making. From the earliest moments in human history, the relationship between God, the universe, and humanity has been a subject of discussion, not only among followers of divine religions but also among representatives of positive sciences. Various theories have been put forth, and numerous evaluations have been made regarding the details of this relationship. The discussions around this topic continue to be relevant today From the perspective of divine religions, one of the most notable and fundamental aspects of the Quran-centered (...) revelation system in Islam is the clear distinction between the Creator and the created. According to this understanding, all entities outside of Allah are categorized as created beings, and they owe their existence and continuity to Allah, who is incomparable to anything else. Additionally, the Quran frequently emphasizes that the universe was created with precise measures, balance, and order. Indeed, these criteria form the starting point of the teleological argument, which extensively utilizes them to demonstrate the existence of Allah, especially His unity. All of this suggests that nothing in the universe is the result of random chance; rather, it implies that the universe embodies a sense of regularity or lawfulness. In our view, “Sunnatullah” is a term used in the Quran to express this regularity or lawfulness. The issue of the unchangeability of the “Sunnatullah” has brought forth discussions on determinism first through causality and then, within the context of determinism, debates on deism. Indeed, interpreting the concept of “Sunnatullah” through a rigid deterministic understanding may open the door to deism, while attributing events in the universe to chance rather than standard laws brings about a process leading to atheism by excluding the Creator. Therefore, it is crucial to approach the phenomenon of “Sunnatullah” in the context of the relationship between God, the universe, and humans in a way that eliminates these risks. For this reason, we have chosen to focus on the relationship between “Sunnatullah” and legality within the context of “immutability.” In addressing this topic, we have attempted to consider not only the data of revelation but also the factual domain. In doing so, our fundamental approach has been not to view the Quran as a purely scientific book and not to operate under the assumption that “everything happening in nature is detailed in the Quran.” However, we have endeavored not to overlook the fact that there is harmony between nature/physics, created by the same entity, and the Quran. In our opinion, this harmony has the potential to create an objective foundation for reaching belief in Allah based on the movement from nature/physics. While composing our text, we emphasized concept analysis and highlighted historical and empirical realities. Document analysis was chosen as the method for this qualitative research. We explored the framework of the concept of “Sunnatullah” and attempted to elucidate its relationship with causality. In our research, the term “Sunnatullah” has been used in a sense encompassing all laws pertaining to society and nature within the context of the relationship between God, humans, and the universe. Additionally, it has been argued that the introduction of different laws into the nature and operation of anything in various areas and conditions of life does not imply that the law is susceptible to change. In our view, the unchangeability of the law refers to the detail that the same law will come into effect under the same conditions. Conditions may change, but the law that comes into effect according to those specific/appropriate conditions remains unchanged. Indeed, in line with His infinite knowledge and power, Allah has not overlooked any detail and has established a law for every possible situation in the universe with its causes and effects. This past decade has seen a great resurgence of interest in the perception of change. Change has, of course, long been recognized as a phenomenon worthy of study, and vision scientists have given their attention to it at various times in the past (for a review, see Rensink, 2002a). But things seem different this time around. This time, there is an emerging belief that instead of being just another visual ability, the perception of change may be something central to our (...) ‘visual life’, and that the mechanisms that underlie it may provide considerable insight into the operation of much of our visual system. This development may have been sparked by a number of factors: technology that allowed the easy creation of dynamic displays, a feeling in the air that it was time for something new, or it may have simply been a matter of chance. Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by explicitly (...) proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

While the unprecedented lockdown measures were at the heart of the debate in the first year of the pandemic, the focus since then has shifted to vaccination issues. The reason, of course, is that vaccines and vaccinations have become available by now. All experts agree: If mankind had failed to develop vaccines against SARS-CoV-2, the death toll would have been much higher. This issue seeks to explore what could be described as a “generational approach to vaccinations”. The question “What can (...) we do to avoid future pandemics?” is related to different aspects of the failures and successes of humanity’s vaccination strategy against SARS-CoV-2. Pathogens are among the existential risks to humanity that could potentially kill a large part of it in a very short time. For all the tragedy and horror it has brought upon the world, the Corona virus has not been lethal on such a large, all-encompassing scale. But it could serve as a wake-up call for more and better prevention in the future, put differently: as a call to build a “preventive society”. When people look back to the year 2022 from the year 2200, will they think of the absence of mandatory vaccination as a dangerous anachronism? And will the unequal global distribution of vaccines be seen as an unbearable vice of our epoch? And will “human infection studies” still be dismissed as unethical if a dangerous new virus boards human bodies? If intergenerational justice means improving the life chances and living conditions of future generations to the largest possible extent, then its link to (the avoidance) of infectious diseases is obvious. We should protect future generations from foreseeable damage if we have the power to do so. “We” is humankind in its entirety. Politically, humanity is divided into many single nations. But biologically, as members of the same species, we share the same vulnerability regardless of ethnicity. The regular reader of this journal might wonder why this issue of IGJR has a different structure. An unprecedented pandemic calls for an unprecedented reaction and therefore IGJR 1/2021 and 2/2021 are special issues that deal with this disruptive event. We have invited several health experts, politicians and scholars alike to share their perspectives in short opinion pieces (instead of regular peer-reviewed articles). And we are exploring something new: the publication of a FRFG policy paper. This policy paper starts off with a historical overview on how pandemics have afflicted humanity in the past. It separates moral from legal duties and formulates “epidemiological imperatives” – the way of thinking of a responsible and solidary individual facing the task of preventing an outbreak of epidemics in a community. With the discovery of vaccines, and their availability, the catalogue of duties is increased by one more: to get the jabs as an act of solidarity with others, including future generations. This would prevent states from being forced to take disease control measures that bring about drastic collateral damage. During the first two years of the Corona pandemic, states have imposed lockdowns. The closure of schools has put a special burden on the youngest members of society. This could have been prevented during the second and the further waves. The policy paper also calls for more government funding for prophylactic vaccine research and for the designation of vaccines as “global public goods”. The issue then moves on to a section dedicated to opinion papers by various different authors. The first paper, written by Agnes Binagwaho and Kedest Mathewos (both from University of Global Health Equity, Rwanda), focuses on the issue of health inequity, a concern which has gained more and more traction during the Covid-19 pandemic. The paper examines how vaccine distribution during the pandemic was mainly focused on the global north and how such actions might affect future generations’ perception of what is just, fair and morally correct. The second paper, by Samantha Vanderslott (University of Oxford), focuses on the right and wrongdoings connected to pandemic preparedness and response. The third paper, authored by Rajeev Sadanandan (Health Systems Transformation Platform, India), talks about the lessons that can and should be drawn from child immunisations. The fourth paper, by Adriano Mannino (LMU and Parmenides Foundation, Munich), delves into the question how future generations will assess our actions and our response to the current pandemic. The fifth and final paper, written by Jörg Tremmel (FRFG and University Tübingen), is centered around the question whether human infection studies could have been implemented during the early stages of the pandemic to minimise deaths and severe infections. The issue concludes with two reviews on recent books by Alberto Giubilini and Katie Wright. In his review of Giubilini’s The Ethics of Vaccination, Marius Kunte notes that it contains a “thought-provoking plea” for individual, collective and institutional obligations to reach high vaccination rates. Judith Kausch-Zongo concludes her review of Wright’s Gender, Migration and the Intergenerational Transfer of Human Wellbeing with a special emphasis on the book’s empirical findings, and praises it in its entirety as “undoubtedly important”. Both books serve as poignant reminders of how sustainable societies can only emerge once the challenges revolving around its most vulnerable members have been properly addressed. (shrink)

Assuming that both humans and nonhuman organisms have intrinsic value, the concept of a “death with dignity” should extend to the natural world. Recently, an effort has been undertaken to save the razorback sucker, an endangered species of fish in the Colorado River. Razorback are bred and raised in captivity and transferred to the river only when large enough to survive predation by nonnative fish. While this effort is well-intentioned, there is little chance that the razorback will again live (...) unassisted in the Colorado River. There may be human-centered reasons for saving the razorback. However, just as respecting a person sometimes requires limiting his or her life-sustaining medical treatment, so too respecting the razorback may require removing human assistance with its reproductive cycle. This essay is focusing on the understanding of the necessity to care more and more about the value of human life, and consequently to find a pathway of cultivating and improving the humanness of man, considering the nowadays climate with its serious moral and ecological crisis. Facing the risks of a spiritual malady due to a profound alienation from his very own essence, human being has to look for the best opportunities in avoiding the situation of becoming the prison of (...) an artificial existence’s captivities and of falling in barbarism. Thus, we think that a real chance for human well-being rising to the excellence of man is an aretaic propaideia; respectively, an education centered on the moral meaning of arete / virtue, by restoring the significance of golden measure, finally leading to equilibrium and harmony, to the health and the joy of an authentic human life in freedom and dignity. The idea of a unity of intellectual history (Geistesgeschichte) is a genuinely philosophical thought. In the shadow of Hegel, it is about the legitimation of historiographical work in a universal perspective thought centered in Europe. The legitimation strategies are complex and amount to the formation of a canon of philosophy. This project is associated with the name of the philosopher and historian of philosophy Wilhelm Dilthey. Dilthey saw it as his task to secure the unity of intellectual history. To (...) this end, he introduced a pluralism of methods – logic, psychology, anthropology, philosophy of history, hermeneutics, literary research and others – into the study of intellectual history. In order to maximize human performance, defence forces continue to explore, develop, and apply human performance enhancement (HPE) methods, ranging from pharmaceuticals to (bio)technological enhancement. This raises ethical, legal, and societal concerns and requires organizing a careful reflection and deliberation process, with relevant stakeholders. We discuss a range of ethical, legal, and societal aspects (ELSA), which people involved in the development and deployment of HPE can use for such reflection and deliberation. A realistic military scenario with proposed HPE application can (...) serve as a starting point for such an iterative and participatory process. Stakeholders can discuss this application, modify its features, and design appropriate processes around it – for instance, procedures for informed consent. We propose that organizing aspects into these three categories – ethical, legal, and societal – can help involve appropriate interlocutors at different moments: legal aspects with people in strategy or management roles, from the start of a project; ethical aspects with people in operations and medical roles, during development; and societal aspects with people in communication and personnel roles, during deployment. The presence of asymmetry in the human cerebral hemispheres is detectable at both the macroscopic and microscopic scales. The horizontal expansion of cortical surface during development (within individual brains), and across evolutionary time (between species), is largely due to the proliferation and spacing of the microscopic vertical columns of cells that form the cortex. In the asymmetric planum temporale (PT), minicolumn width asymmetry is associated with surface area asymmetry. Although the human minicolumn asymmetry is not large, it is estimated to (...) account for a surface area asymmetry of approximately 9% of the region’s size. Critically, this asymmetry of minicolumns is absent in the equivalent areas of the brains of other apes. The left-hemisphere dominance for processing speech is thought to depend, partly, on a bias for higher resolution processing across widely spaced minicolumns with less overlapping dendritic fields, whereas dense minicolumn spacing in the right hemisphere is associated with more overlapping, lower resolution, holistic processing. This concept refines the simple notion that a larger brain area is associated with dominance for a function and offers an alternative explanation associated with “processing type.” This account is mechanistic in the sense that it offers a mechanism whereby asymmetrical components of structure are related to specific functional biases yielding testable predictions, rather than the generalization that “bigger is better” for any given function. Face processing provides a test case – it is the opposite of language, being dominant in the right hemisphere. Consistent with the bias for holistic, configural processing of faces, the minicolumns in the right-hemisphere fusiform gyrus are thinner than in the left hemisphere, which is associated with featural processing. Again, this asymmetry is not found in chimpanzees. The difference between hemispheres may also be seen in terms of processing speed, facilitated by asymmetric myelination of white matter tracts ( Anderson et al., 1999 found that axons of the left posterior superior temporal lobe were more thickly myelinated). By cross-referencing the differences between the active fields of the two hemispheres, via tracts such as the corpus callosum, the relationship of local features to global features may be encoded. The emergent hierarchy of features within features is a recursive structure that may functionally contribute to generativity – the ability to perceive and express layers of structure and their relations to each other. The inference is that recursive generativity, an essential component of language, reflects an interaction between processing biases that may be traceable in the microstructure of the cerebral cortex. Minicolumn organization in the PT and the prefrontal cortex has been found to correlate with cognitive scores in humans. Altered minicolumn organization is also observed in neuropsychiatric disorders including autism and schizophrenia. Indeed, altered interhemispheric connections correlated with minicolumn asymmetry in schizophrenia may relate to language-processing anomalies that occur in the disorder. Schizophrenia is associated with over-interpretation of word meaning at the semantic level and over-interpretation of relevance at the level of pragmatic competence, whereas autism is associated with overly literal interpretation of word meaning and under-interpretation of social relevance at the pragmatic level. Both appear to emerge from a disruption of the ability to interpret layers of meaning and their relations to each other. This may be a consequence of disequilibrium in the processing of local and global features related to disorganization of minicolumnar units of processing. (shrink)

This paper attempts to shed light on three sets of issues that bear directly on our understanding of Locke and Kant. The first is whether Kant believes Locke merely anticipates his distinction between analytic and synthetic judgments or also believes Locke anticipates his notion of synthetic a priori cognition. The second is what should we as readers of Kant and Locke should think about Kant’s view whatever it turns out to be, and the third is the nature of Kant’s justification (...) for the comparison he draws between his philosophy and Locke’s. I argue (1) that Kant believes Locke anticipates both the analytic-synthetic distinction and Kant’s notion of synthetic a priori cognition, (2) that the best justification for Kant’s claim draws on Locke’s distinction between trifling and instructive knowledge, (3) that the arguments against this claim developed by Carson, Allison, and Newman fail to undermine it, and (4) that Kant’s own justification for his claim is quite different from what many commentators have thought it was (or should have been). Kant's notion of ‘discipline’ has received considerable attention from scholars of his philosophy of education, but its role in his theoretical philosophy has been largely ignored. This omission is surprising since his discussion of discipline in the first Critique is not only more extensive and expansive in scope than his other discussions but also predates them. The goal of this essay is to provide a comprehensive reading of the Discipline that emphasizes its systematic importance in the first Critique. I argue (...) that its goal is to establish a set of rules for the use of pure reason that, if followed, will mitigate and perhaps even eliminate our tendency to make judgments about supersensible objects. Since Kant's justification for these rules relies crucially on claims he has defended in the Doctrine of Elements, I argue further that, far from being a dispensable part of the Critique as commentators have tended to claim, the Discipline is, in fact, the culmination of Kant's critique of metaphysics. La crise relève d'une tension entre le spectacle et la vie, nous multiplions les tentatives de camoufler la crise dans un grand discours pseudo-culturel spectaculaire, par une pléthore de " créations " ou d'" événements " superficiels et dérisoires. Pendant des siècles, l'art et la science ont travaillé de concert (...) dans une même exigence de découverte. Aujourd'hui, l'art joue un rôle secondaire, tandis que le discours sur la consommation et le divertissement fait d'une société dominée par la science le meilleur des mondes possibles. Quelles en sont les conséquences pour l'art? Critiques, médias, artistes, publics : chacun des rouages de la machine est ici analysé avec brio.
