Corporations despite their status as legally fictitious persons are not such, and to confound them with real persons in even the minimal legal sense is to negate much of the force of the concept of rights when applied to the society. When corporations have rights individual rights become meaningless. While corporations may need some form of protection to make them financially feasible investments, they need not be given the full protection of rights which are assigned to the individual. A much (...) attenuated version of corporate rights is warranted. I would argue against Werhane's notion of a corporation possessing “secondary rights” which can be asserted only after the claims of individual rights have been met. Ibid., p. 62.One solution to the problems raised in this essay would be to ascribe rights to individuals only. This could occur without interfering with the financial independence of the corporation by a simple legal prescription that individuals within a corporation be held responsible for their activities and that the corporation p e r se not be blamed for individual actions. This is consistent with the judgments against the Nazi war criminals who were denied the defense of justifying their actions on the basis of following orders. Responsibility for those actions which are the result of the workings of the “invisible hand” cannot be ascribed to any individual or group of individuals. Donaldson is helpful on this point in recommending an “office of social responsibility” be created as part of the corporation to monitor those actions which otherwise escape scrutiny. Donaldson, Corporations and Morality, p. 207.A more radical solution is to restructure the corporation in such a way as to introduce the element of democracy in the workplace. Opponents would argue that such a practice would diminish the profit-making potential of the corporation by limiting the discretion of the corporate officers in making decisions. Similar arguments have been advanced against the democratic state. Yet democratic states have proven to be viable institutions capable of effective action and demonstrably more survivable than the authoritarian regimes which are the analogs of the corporation.Given the current hierarchical structure of the corporation and its ability to dissolve in the face of questions of responsibility, individual accountability is the only viable solution. This requires that members of the corporation not find cover behind the “invisible hand.” This in turn necessitates the granting of a greater degree of discretionary power to corporate functionaries at all levels. We cannot be responsible for a state of affairs over which we have no effective control. The courts would make the ultimate decision as to the assignation of responsibility in particular cases of corporate crime, with the stipulation that the ascription be to an individual and not “the corporation.” By making corporate officers individually responsible for their actions a much more effective deterrent to corporate crimes would be created. Corporations can easily afford most of the fines that are imposed on them, and corporations cannot be put in prison.The view of the corporation advanced here puts it in a legal and moral position greatly inferior to that of the individual as well as the state. Consequently, corporate needs and welfare must remain a tertiary concern. The rights of the individual must figure primarily, and the welfare of the state as preserver of those rights secondarily, in social policy decisions. The libertarian vision of the corporation is therefore a misguided result of the conflation of the corporation and the individual in the legal and moral realms. Corporations and individuals are ontologically distinct entities and must be recognized as such. The failure to do so has enabled corporations to abrogate individual rights with legal and moral impunity. Such a situation is inconsistent with the demands of a rights-based democracy. (shrink)

In lieu of an abstract, here is a brief excerpt of the content: Classical Art: A Life History DAVID CAST This is a wonderful book, rich in its purposes, wide in its range and, thanks to the author’s home institution, Christ’s College, Cambridge, lavishly illustrated with images of objects, many familiar, some less so. And it is written with an elegance and clarity that belies the depths of scholarship in its history. The first letter of the subtitle suggests the tenor (...) of Vout’s account, that since every age has conjured up a different idea of the classical, what is here is yet one more such history, a modest if particular account of what was and is still there in the records made of the Greek and Roman past. The basic metaphor Vout uses to define the focus of this history is that of conversation, whether such conversing is seen to exist between the objects themselves or between the past and the present, between those objects that have outgrown their intended functions to become part of a canon that has dictated taste over the ages, as she puts it, shaping culture and culture’s questions. Thus conversation is here, plus also what Vout is not afraid, when necessary, to call the misappropriations and translocations of the Greek and Roman objects she takes note of. Yet another contribution she adds to the idea of the classical comes from what she calls, perhaps a little awkwardly, the long durée approach to its subjects, seen first when these objects were produced, then as they survived Christianity and the fall of Rome and Byzantium, the French Revolution, modernism and fascism, to live Caroline Vout, Classical Art: A Life History from Antiquity to the Present, Princeton University Press, 2018. xi + 376 pages; 80 color + 132 b/w illustrations. $39.50. ISBN 9780691177038; E-book ISBN9781400890279. arion 27.1 spring/summer 2019 on in galleries and auction rooms, making the heart soar and the blood boil, as Vout claims, even today. It is a complex story she has to tell, difficult yet valuable, and its method is nicely exemplified by the first example considered, the two statues, known as the Tyrannicides, dated to 477–476 BCE, and located now in the National Archaeological Museum in Naples, attributed on the museum caption to the sculptors Kritios and Nesiotes, and dated to 477–476 BCE. The details here are crucial for, on investigation, it is clear these are not the statues that were erected in the Athenian agora to honor the men, Harmodius and Aristogeiton, who, by tradition, had killed the tyrant’s brother Hipparchus. Yet even this second group, as she notes, had been a stand-in, since the first piece to honor these men, made by the sculptor Antenor, had been stolen by the Persians in the sack of Athens in 480–479 BCE. Nor is this group here the actual second group but rather a copy, made by an unknown copyist working under the Roman Empire. What we have here are what might be called pretenders—yet ones, despite doubts about their authenticity, that have long been taken to mark a particular moment in the formal history of Greek art, the advent of the so-called Severe style in Athens and the birth of the classical moment of sculpture. Any full account of these statues depends then on a rich history, plus a range of other events; the existence of ancient casts of the Tyrannicides during the Roman Empire, marking out such statues as art, rather than having still their first meaning; the prior history in the Renaissance of the acquisition of ancient sculpture as a sign of power; the sight of the figure of Aristogeiton, then in the Palazzo Farnese in Rome, by Johann Joachim Winckelmann; the building up of these statues from fragments of other statues; in 1859 the identification of these figures as the Tyrannicides; and finally a reading of classical texts, those of Pausanias, Pliny and Lucian, that spoke, even if in contradictory ways, of all the actors here, Antenor, Kritios and Aristogeiton. In this article I attempt to examine the justification for the mandatory drug testing of employees. The justification commonly assumes the form of the productivity argument which states that an employer has a proprietary right to regulate the purchased time of the employee. Since the employer may be rightfully concerned with the employee''s productive output, so this argument goes, the employer retains the right to motivate production. By extension, the employee''s behavior outside of the workplace which affects his or her (...) productive capacity may also be regulated, including drug use which may affect this capacity. Thus it is claimed that the employer has the right to test employees for drug use and to impose sanctions when it is discovered.I argue that the implications of the productivity argument lead to unacceptable consequences and thus must be rejected. The productivity argument can be examined in light of a thought-experiment in which the reader is asked to imagine the discovery of two drugs, both of which enhance employee productivity. Calling these drugs hedonine and pononine, I imagine the first to be pleasurable to the employee while the second is accompanied by a degree of pain and discomfort. Since the mandated use of both of these imagined drugs would be consistent with the productivity argument, I maintain that the productivity argument thereby fails and so must be rejected. As employee drug testing is justified by this argument, it must also be rejected. (shrink)

All farmers have their own version of what it means to be a good farmer. For many US farmers a large portion of their identity is defined by the high input, high output production systems they manage to produce food, fiber or fuel. However, the unintended consequences of highly productivist systems are often increased soil erosion and the pollution of ground and surface water. A large number of farmers have conservationist identities within their good farmer identity, however their conservation goals (...) often need to be activated to rebalance the production-conservation meanings they give to their roles in society. In this paper we analyze US Cornbelt farmer interviews and surveys to trace how the performance-based environmental management process can be used to influence the farmer social identity and shift the overall good farmer identity towards a stronger conservationist standard. We find the continuous feedback loop in performance-based environmental management mimics the hierarchically organized feedback control processes of identity verification and can be used to help farmers activate their conservationist farmer identities at the person, role, and social levels to establish new norms for the practice of more sustainable agriculture. Christian ethical imagination was always tempered by various social prejudices prevalent in local contexts. Particularly during modernity and subsequently through colonial expansion, the role of race and caste became central to the expansion of Christianity through missionary activity. A closer scrutiny of colonial missionary Christianity clearly suggests the significance of racialised worldview shaping theological and ethical paradigms. In particular contexts, such racialised imagination underpinned and gave credence to other forms of social prejudices, such as caste in South Asia. Through a (...) post-colonial lens, I examine the role of race and caste in shaping Christian ethical frameworks and articulate the rationale for ‘decolonising’ the modern foundations of Christian ethics in pursuit of racial justice in our contemporary society. This study engages with the experiences of Dalit-Bahujan (oppressed social castes) students at a higher education institution in India. Drawing from interview-based data, it explores the students’ narratives to map their educational experiences, taking the medium of instruction as a case in point. The study aims to deepen understanding of the intersection of caste and curricular-pedagogic context of higher education and its relation to knowledge production in institutional contexts. The findings highlight a significant gap between the socio-economic backgrounds of Dalit-Bahujan (...) students and the institutional and pedagogical structures, processes, and discourses they encounter. Based on these findings, the study further examines the framing of marginality at the intersection of caste, language and background of Dalit-Bahujan students. The lack of institutional support often relegates Dalit-Bahujan students to the margins within higher education institutions, not only excluding the disadvantaged social groups but also impinging upon the democratisation of knowledge production. We conclude that the question of medium of knowledge production necessitates a critical examination of which lives and voices are included in curricular and pedagogic processes. (shrink)

Caste is a multidimensional reality in history and society, and it has manifested itself through varieties of structures of domination which are simultaneously cultural, economic, political and ideological as caste has also been related in complex ways with structures of class and gender domination. These structures of domination have led to the annihilation of self and society. This led Ambedkar to challenge us for annihilating caste. For Ambedkar, annihilation of caste calls for the realization of each person as an individual (...) and not just a caste person. It also calls for the destruction of caste privileges, discrimination and their scriptural legitimation. However, this call for annihilation mainly has been a structural project without enough attention to the project of transformation of consciousness—self and social. There is a hint of this in Ambedkar’s Annihilation of Caste when he urges us to realize each one of us as unique individuals beyond the holes of caste which is further deepened in his Buddha and His Dhamma. Transformation of consciousness is also suggested in Adi Shankara’s treatise on self, Atmastakam. The essay engages itself with Ambedkar, Shankara, Gandhi and Sri Aurobindo, among others, as they help us in the transformation of caste domination and present a new hermeneutics of self-realization and social liberation. It deals with the simultaneous challenges of structural transformation of caste as well as consciousness of caste at the levels of both self and society which can draw on multiple sources of critique, creativity and transformations in India and the world. Brahminism is the poison which has spoiled Hinduism. You will succeed in saving Hinduism if you will kill Brahminism. There should be no opposition to this reform from any quarter. It should be welcomed even by the Arya Samajists, because this is merely an application of their own doctrine of guna-karma. Whether you do that or you do not, you must give a new doctrinal basis to your religion—a basis that will be in consonance with liberty, equality and fraternity; in short, with democracy. I am no authority on the subject. But I am told that for such religious principles as will be in consonance with liberty, equality and fraternity, it may not be necessary for you to borrow from foreign sources, and that you could draw for such principles in the Upanishads. This paper explores the historical and social context of population genetic research conducted in India by focusing on a study by Reich et al which aimed to reconstruct Indian population history. The paper addresses two themes. First, it considers the agendas and modes of thinking about Indian populations and the caste system on which this study appears to be based. Second, it reflects on the medical implications of this study as they were presented in Reich et al's findings. I suggest (...) that while genetic mapping of Indian populations appears to have inherited many of the problems characteristic of population genetic research conducted in the USA and globally, the specificity of this research in India involves a peculiar interplay of the postcolonial pursuit of genomic sovereignty, desire by the Indian state to become a player in the global realm of biotechnology, and age-old discourses naturalising caste and regional differences. My argument is that, although the study has offered conceptual space for a wide range of interpretations, it has a strong potential not just for naturalising caste and regional differences in India, but also for pathologising them without necessarily bringing tangible healthcare benefits in the foreseeable future. We draw on the phenomenon of caste-based discrimination in India and signaling theory to assess whether microfinance credit scores improve the odds of female micropreneurs from a lower caste receiving loans and whether visible business characteristics further improve the odds of receiving microfinance loans. In a sample of 3,144 female microfinance loan applicants at a female-focused microloan enterprise in India, females from a lower caste, relative to those from a higher caste, have lower odds of receiving loans when their credit (...) scores are below the mean. However, when females from a lower caste have credit scores higher than the mean, the odds of receiving a loan increase. The practical effect of size is small but meaningful. Loan applicants from a lower caste with a visible signal of business ability do not improve their chances of receiving a loan relative to those from a higher caste. (shrink)

Th is paper explores the perception of urban landscapes through sound, using two case studies of cities where bells played a significant role in the city, where a particular dramatic event silenced these bells, and where the act of remaking broken or tuneless bells re-creates an engagement with the lived places of the past. At Notre Dame Cathedral in Paris, newly cast bells recreate the melodious peal last heard before the French Revolution, and ChristChurch Cathedral in Christchurch, New Zealand, bells (...) damaged by destructive earthquakes of 2011 will eventually ring out their familiar tones in an urban landscape that is physically almost unrecognisable. Both case studies demonstrate the ways that the inadvertent and the deliberate transformation of soundscapes continually interacts with ideas of place and meaning within the constantly changing city. This article addresses the important question of how “upper”-caste power is reproduced in contemporary India, in the face of organized challenges from below. It argues that this process turns on the reproduction of castelessness. A long-standing site for the cultivation of castelessness has been the postcolonial census, which has limited the enumeration of caste to certain nonelites for the purposes of affirmative action reservations. However, in the aftermath of an intensive campaign to include a full castewise enumeration in Census 2011, (...) the political leadership of the Indian National Congress Party conceded and reversed seventy years of census policy on caste. This article examines the institutional pushback within the executive bureaucracy in the year following the public concession to change census policy on caste. In doing so, it shows how bureaucratic actions and inactions reproduce both castelessness and upper-caste power in contemporary India. (shrink)

Religion and its envisaged structures have both macro- and micro-level implications for business. Of the many stratification schemas prevalent in India, two macro-social stratification schemas are important at the workplace: caste, which has been an age-old, religion-mandated, closed social stratification prevalent in Hinduism that had led to inequality in the society, and trade union, which is a relatively new and optional open workplace stratification that empowers workers and fosters equality. This study tries to decipher whether these two structures influence each (...) other; if yes how and why do they influence each other (the tensions and contradictions that may happen between them), and whether the influence is uniform for all members. We conducted in-depth interviews with 43 trade union members, three trade union leaders of two state-owned organizations in North India. Initially, we found that caste does not have any superficial effect on the relationship between union members. However, a deeper analysis reveals that roots of this social reality reflect in the social and workplace exchanges between union members, and affect their social identity and loyalty. In the discussion we present a model of twin loyalties between union and caste. From the institutional logic perspective, we also delineate the caste and trade union perspective, and show how there is a change in trade union identity because of the influence of caste-based logic. Our findings have implications for industrial democracy, worker representation, and union effectiveness. (shrink)

In this article, I survey past discussions of the Homogeneous Unit Principle, hear from its proponents and detractors, and consider the Hindu caste system, both in its traditional form and as it is experienced in contemporary South Asia. Simplistic interpretations of the caste system are rejected in favour of an understanding of caste that is more in keeping with the ethnographic realities. Caste identity is distinguished from caste prejudice which leads me to suggest that blanket condemnation of caste consciousness among (...) Christ-followers is both unjustified and unhelpful. In recent years, several cases about the legal personhood of nonhuman animals garnered global attention, e.g. the recognition of ‘basic rights’ for the Argentinian great apes Sandra and Cecilia. Legal scholars have embraced the animal turn, blurring the once sovereign boundaries between persons and objects, recognising nonhuman beings as legal subjects. The zoonotic origins of the Covid-19 pandemic stress the urgency of establishing ‘global animal law’ and deconstructing anthropocentrism. To this end, it is vital to also consider the extensive premodern (...) legal history that humans share with other animals. Over 200 so-called animal trials have been documented in premodern Europe. In these proceedings, certain nonhuman animals—particularly domestic pigs—were prosecuted, often resulting in their capital punishment or anathema. This paper takes a history of ideas approach to these historical instances where Western philosophy of law and philosophical anthropology intersect, problematising the notion that such trials constitute wholesome precedents of the kind of legal personhood presently debated in jurisprudence. My counter-hegemonic analysis of the legal prosecution and execution of several pigs in fifteenth-century France demonstrates that late mediaeval notions of criminality transcended the alleged human-nonhuman divide whilst reaffirming and reifying human distinctiveness. I propose that pig trials were local laboratories where Christian communities reflected upon the natural hierarchy of God’s creation. Ensuing the apparent breach of the prescribed boundaries of nature, these communities renegotiated and re-naturalised everyday interspecies sociability by utilising the offending animals to exemplify particular norms about what it means to be human, generally to the animals’ detriment. The effects of religion, population sub-division and geography on the prevalence of deaf-mutism were investigated using information collected in the 1921 Census of Punjab. The total sample size was 9·36 million, and comprised data on thirteen Hindu castes, seventeen Muslim biraderis and two Sikh castes. A two-way analysis of variance comparing males in Hindu castes in which consanguineous marriage was prohibited, with males in Muslim biraderis which favoured first cousin marriage, indicated major differences with respect to the patterns of deaf-mutism (...) within each religion. In the Muslim population 9·1% of the relative variation in the prevalence of deaf-mutism was inter-biraderi, 36·8% between geographical regions, and 48·8% an interaction between biraderi and region, whereas among Hindus 46·8% of the observed variation was inter-caste, 12·8% inter-region and 33·6% due to caste–region interaction. From a wider disease perspective the results obtained with the Hindu community indicate the significant genetic differentiation associated with caste endogamy. As the overwhelming majority of Hindu marriages continue to be within-caste, it can be predicted that similar levels of inter-caste differences in disease frequency currently exist. By comparison, the lower level of inter-biraderi variation among Muslims is probably indicative of the dissolution of pre-existing caste boundaries and the resultant gene pool mixing that followed the large-scale conversion of Hindus to Islam during Muslim rule in North India from the 13th to the 19th centuries. Within the realm of structures of society, the caste system, a unique example among all the aspects of human adventure, represents at the level of social morphology, that is in the manner of grouping characteristic of a society, India's most original contribution to human history within all great civilizations, to the point that India's civilization is generally identified by the principal feature of its morphology.

The caste system has caused widespread oppression within Hinduism. In this paper, I analyze the Bhagavad Gītā (c. 500 BCE–200 CE) and the Bhāgavata Purāṇa (c. 9th century CE), two highly influential Hindu sacred texts, to understand how they conceptualize the relationship between caste and devotion (bhakti). I argue that there is a societal framework that does not maintain the caste system but which is consistent with these texts' soteriological vision and can be implemented in lieu of such a system. (...) This framework demonstrates that for certain forms of Hindu religiosity, caste is not essential to uphold from a scriptural perspective. Given this framework, the caste system can be challenged and interrogated to a significant extent and alternative societal frameworks can be proposed. Anti‐discrimination laws draw a distinction between two kinds of discrimination by non‐state actors. Intimate choices are protected even if they are morally wrong. For example, even if it is morally wrong to discriminate on the basis of race in deciding whom to date, marry or befriend, anti‐discrimination laws permit these acts. By contrast, commercial decisions are commonly regulated. I argue that the reasons for regulating commercial decisions also extend to an intermediate case, commercial facilitators of marriage choices. In the context (...) of the caste system, I argue that commercial facilitators should be banned from allowing customers to filter by caste. The argument is based on two considerations. First, this could mitigate the harmful effects of such discriminatory marriages choices in the (re)production of the oppressive caste system. Second, even if the ban fails in changing behaviour, it serves as an expressive goal of communicating the state's opposition to the caste system. (shrink)

They never see the sculptures of the Parthenon, the Hermes of Praxiteles, the Victory of Samothrace, the Venus of Melos, the Augustus Caesar, the works of Donatello, the achievements of Michelangelo. The same is true of our university students—thousands of them. They hear endless talk about these things as the recognized treasures of civilization, (...) the inheritance of the ages, but they never see them.... Several ant species are known with genetic effects on caste determination but, for termites, the role of environment has been assumed to be omnipotent. Now Hayashi et al. report that commitment to the nymph and worker pathways in Reticulitermes speratus follows a simple model involving two alleles at a sex‐linked locus.1 The spread of this system of genetic caste determination seems best explained by selection at the colony level. The Cast of Character: Style in Greek Literature. Austin: University of Texas Press, 2002. xiv + 274 pp. Cloth, $45. In this ambitious and interesting book, Nancy Worman uses selected texts from Homer through Gorgias and other rhetorical theorists to examine the conjunction of a speaker's verbal and visible, corporeal mannerisms (a combination she describes in (...) Pierre Bourdieu's term, "bodily hexis") that produces a style of social behavior that conforms to Greek culture's traditional expectations and ideas (Bourdieu's "habitus"). Having "Cast" in the title thus emphasizes the visual: "the cast of character" is the set of "physical and linguistic mannerisms that mark a speaker as a type conforming to a set of socially familiar categories" (1). Its visibility and adherence to type would seem to make character transparent and behavior predictable, and so it seems they are in many cases. But a cast is, after all, an appearance. Alongside this sense of familiarity, argues Worman, the Homeric poems already show a recognition of the dangerous allure of visual style and the possibility that outward character might be separated from inner qualities—a recognition that grows sharper in tragedy and culminates in distrust of the sophists in many quarters. Worman argues that those durable characters, Helen and Odysseus, respectively, embody these two dangers, and she centers her discussion on them.This is a promising way to look at Greek literature, and Worman carries her approach out well in her readings of particular texts. Perhaps the most suggestive aspect of the book, however, is that it asks us to reconsider our understanding of "style," which we tend to think of as purely textual and rhetorical in the tradition of Aristotle. Worman argues that until the fourth century B.C.E., the Greeks had a traditional understanding of style that was much broader: the projection of character type through bodily hexis(understood as the combination of verbal and corporeal habits). Plato and Aristotle, she suggests, in different ways and each for his own reasons, suppressed the bodily aspects of style that were crucial to the traditional conception, and an adequate account of Greek ideas about style has to begin not with them but with that tradition. In Worman's treatment of it, "style" refers not just to the social performances of characters within texts but also to the performance of the texts themselves (epic, drama, and deictic oratory). Worman comments on the metapoetic (or metarhetorical) dimension of these texts, whereby the bodily hexisof the performer, often in rich costume, either confirms (and is confirmed by) the characters' behavior or undermines it. Her statements to this effect tend to be unsystematic and general, but the approach works extremely well in the case of Gorgias. In the Encomium of Helen, the orator's rich robes and delivery embody and exert the sensual power of language that Gorgias describes and that Helen herself exemplifies, whereas in the Palamedes, by calling attention to performance, the robes and delivery undermine Palamedes' insistence on the convergence of bodily hexisand essential character.It may seem peculiar that "bodily hexis" comprises linguistic as well as physical behavior, and in Worman's actual practice, the phrase does get stretched [End Page 145] considerably at times. But she insists that the Greeks thought of language as corporeal, that performance for them was "a whole-body experience of language" (194). In the 13th and 14th centuries CE the Śrīvaiṣṇava Hindu community of south India struggled to integrate the traditional values of the older brahmanical hierarchical system with the devotional egalitarianism that had come to the fore with fresh force in the Tamil vernacular tradition in the 7th and 8th centuries and thereafter. One of the most vexed aspects of this integration pertained to caste, and whether devotionalism foreclosed a continuation of traditional caste distinctions: do divine love and grace mandate radical (...) egalitarianism? Śrīvaiṣṇava theologians were divided on the issue, some more conservative, some more radical in their rhetoric about continuity and change. Yet, as this essay argues, none were willing to go to the extremes either of dismissing caste structures entirely or of entirely subordinating devotion to caste. New values were to take primary place, while old norms were to be reinterpreted and given new meanings. Analyzing well-known examples from the tradition they argued instead a balance between norms and exceptions, treating violations of caste as occasions to glorify the power of devotion but without predicting the end of caste altogether. Attention to this case sheds light on caste and devotion in the Hindu context, the nature of ethical debate in India, and consequently too ways in which rhetoric functions more widely in ethical analysis. The central topic for this book is the ethics of treating individuals as though they are members of groups. The book raises many interesting questions, including: Why do we feel so much more strongly about discrimination on certain grounds – e.g. of race and sex - than discrimination on other grounds? Are we right to think that discrimination based on these characteristics is especially invidious? What should we think about ‘rational discrimination’ – ‘discrimination’ which is based on sound statistics? To (...) take just one of dozens of examples from the book. Suppose a landlord turns away a prospective tenant, because this prospective tenant is of a particular ethnicity – arguing that statistics show that one in four of this group have been shown in the past to default on their rent. That seems clearly unfair to people of this ethnicity. But we are routinely being judged in this way – not just on the basis of our ethnicity, but assumptions are made about us and decisions taken about us based on our gender, religion, job, post-code, hobbies, blood-group, nationality, etc. Now suppose that another landlord turns away a convicted criminal, arguing that one in four of convicted criminals have been shown to be unreliable rent payers. Is our intuition the same as before? Should it be? This book is suitable for all students of philosophy, especially those with an interest in applied ethics. (shrink)

This paper focuses on how revolts against caste-based oppression in India have been made invisible due to conceptual legacies in European social and political theory. Weber’s and Arendt’s conceptualization of Pariah agency is a case in point. Arendt’s main understanding of Pariah agency is individualized and inadequate to study freedom struggles among untouchable castes. This article argues that one not only needs to move away from analyzing individual to collective action, but it is also crucial to foreground how collective mobilization (...) among excluded groups has focused on contingencies that embed a system of domination. This comment responds to Maul’s (2012) article evaluating the validity evidence and argument for the Mayer–Salovey–Caruso Emotional Intelligence Test (MSCEIT) as a measure of emotional intelligence (EI). We suggest that Maul’s standards for establishing validity evidence are unrealistically high, and may not be met by other established psychometric tests. As an example, we show that evidence for the validity of Raven’s Progressive Matrices (RPM) is of a similar standard to the MSCEIT.

The Dark Knight Rises promised to be the epic conclusion of a hero’s journey, a journey of a man’s transformation into a legend. Little was revealed in the official trailers, except that evil was rising in Gotham (...) City, and so too must The Batman. But in this essay I’d like to suggest that we didn’t need to view The Dark Knight Rises before seeing either evil, or Batman rise; by the end of the second film, evil and Batman have already risen—and together—in the sacred form of The Dark Knight.This essay first elucidates how Bruce Wayne’s strategy to inspire good among the citizens of Gotham, first articulated in Batman Begins, encompasses the hallmarks of Girard’s mimetic theory, including: mimesis, rivalry, scandal, and, finally, the outworking of the mimetic mechanism of the surrogate victim—the scapegoat. Next, this essay takes a closer look at the goodness, or lack thereof, of Batman’s climactic self-sacrifice with its attendant resolution. Finally, this essay demonstrates that interpretations [End Page 239] of Batman’s self-sacrifice in the movie have mirrored the disparate interpretations of Christ’s self-sacrifice, in relation to the climax and resolution of the Passion accounts.Mimetic Structure in Bruce Wayne’s StrategyBeginning With the EndThe final visual the audience is given in The Dark Knight is of Batman escaping on his Batpod. The screenplay’s description of this final scene reads: “The batpod streaks through Gotham’s underground streets, the Batman’s cape fluttering behind. A wraith...”; (TDK, 140).2 Commissioner Gordon’s voice is overheard saying, “... He’s not our hero. He’s a silent guardian, a watchful protector, a dark knight” (TDK, 140). Bruce Wayne has sacrificed himself for the sake of Gotham. But what kind of sacrifice has he made?3 In the words of Alfred, “The sacrifice he’s making [is]—to not be a hero. To be something more” (TDK, 73). And Batman has become something more. No longer a hero, the language Commissioner Gordon uses to describe Batman on behalf of Gotham is mythical and sacred. Girard understands this sacralization to be the completion of the surrogate victim mechanism, the satanic process whereby the sacrifice of an innocent scapegoat reconciles a community in the midst of crisis and violent upheaval.4 This sacred vision of Batman represents the final stage of the surrogate victim mechanism, providing evidence that the satanic has been at work. But if this is the case, something has gone terribly awry in Bruce Wayne’s strategy to inspire good. With this conclusion in mind, the flaws in Wayne’s strategy as it develops throughout Batman Begins and The Dark Knight become apparent, and correspond with each step in the mimetic process.Mimesis as PlotMimesis, or imitation, stands at the heart of The Dark Knight’s plot because it stands at the heart of Bruce Wayne’s strategy to inspire good.
