In a first step, the so called axioms which form the premises of the argument will be presented, most notably Boethius’ remarkable and famous distinction between esse and id quod est. In a second step, the argument itself will be discussed, especially the question: in what respect are things supposed to be good. This leads to a third step, in which it will be shown that Boethius offers a different concept of the bonum transcendentale than Aquinas does, whose concept of bonum was derived completely from Aristotle. Vol. II in English is available separately from this website. -/- The principal objective of the work is to construct an analytically precise methodology which can serve to identify, eliminate, and avoid a certain widespread conceptual fault or misconstruction, called a "projective misconstruction" or "projection" by the author. -/- It is argued that this variety of error in our thinking (i) infects a great number of our everyday, scientific, and philosophical concepts, claims, and theories, (...) (ii) has largely been undetected, and (iii), when remedied, leads to a less controversial and more rigorous elucidation of the transcendental preconditions of human knowledge than has traditionally been possible. -/- The dissertation identifies, perhaps for the first time, a projective variety of self-referential inconsistency, and proposes an innovative, self-reflexive approach to transcendental argument in a logical and phenomenological context. The strength of the approach lies, it is claimed, in the fact that a rejection of the approach is possible only on pain of self-referential inconsistency. The argument is developed in the following stages: -/- A general introduction identifies the central theme of the work, defines the scope of applicability of the results reached, and sketches the direction of the studies that follow. The preliminary discussion culminates in a recognition of the need for a critique of impure reason. -/- The body of the work is divided into two parts: Section I seeks to develop a methodology, on a purely formal basis, which is, on the one hand, capable of being used to study the transcendental foundations of the special sciences, including its own proper transcendental foundation. On the other hand, the methodology proposed is intended as a diagnostic and therapeutic tool for dealing with projective uses of concepts. -/- The approach initiates an analysis of concepts from a perspective which views knowledge as coordination. Section I describes formal structures that possess the status of preconditions in such a coordinative account of knowledge. Special attention is given to the preconditions of identifying reference to logical particulars. The first section attempts, then, to provide a self-referential, transcendental methodology which is essentially revisionary in that it is motivated by a concern for conceptual error-elimination. -/- Phenomenology, considered in its unique capacity as a self-referential, transcendental discipline, is of special relevance to the study. Section II accordingly examines a group of concepts which come into question in connection with the central theme of phenomenological constitution. The "de-projective methodology" developed in Section I is applied to these concepts that have a foundational importance in transcendental phenomenology. A translation is, in effect, proposed from the language of consciousness to a language in which preconditions of referring are investigated. The result achieved is the elimination of self-defeating, projective concepts from a rigorous, phenomenological study of the constitutive foundations of science. -/- The dissertation was presented in a two volume, double-language format for the convenience of French and English researchers. El objetivo de este artículo es analizar qué tipo de respuesta al escepticismo filosófico podemos esperar de los llamados argumentos transcendentales. La conclusión general es que los argumentos transcendentales no son capaces de neutralizar las dudas escépticas en tanto que formulaciones verbales de posibilidades lógicas. Ahora bien, teniendo en cuenta que el escéptico no puede presentar sus dudas significativamente, parece que sólo tiene tres opciones: dudar con la ayuda de un silencio místico, dudar usando las palabras de una manera metafórica (...) o evocativa, o dudar usando las palabras con sentido literal pero siendo consciente de estar diciendo algo sin sentido. Le premier chapitre d'une Phénoménologie de l'acte philosophique, que nous publions ici, met en lumière la structure onto-théo-logique de toute philosophie possible. II comporte les paragraphes suivants: 1. Existence et Pensée. – Une définition radicale de la pensée humaine présuppose une réflexion sur le Sum dans lequel s'enracine le Cogito. Cette première réflexion ne peut se faire que de manière spontanée et naïve. L'identité de l'existence et de la pensée n'est pas une possibilité humaine, mais oriente et fonde comme idéal (...) le mouvement philosophique. 2. Archè - ousia - telos. – L'essence de l'être humain est tendance et mouvement (kinèsis) d'une nature spéciale. 3. La destination (Bestimmung) de l'homme. – Par une réflexion transcendentale sur le dynamisme appétitif de l'homme on découvre la „position” ontologique d'une Fin absolue et infinie comme fondement a priori de toute vie humaine en tant qu'elle est besoin et désir. Les étappes de la voie qui conduit au Fondement ultime de la perfection humaine, sont les suivants : 1) l'accueil naïf de l'être qui se montre, 2) la perte de tous les étants dans le Néant, résultant dans une angoisse profonde, et 3) la découverte du Bien infini comme „Rien de tout cela”. 4. „Tune me chercherais pas, situne m'avais trouvé” (Pascal) ou: „Comment le Dieu arrive - t - il dans la philosophie?" Unica demonstratio Dei. – La preuve métaphysique et la preuve anthropologique de l'existence de Dieu sont deux paraphrases radicalement identiques du mouvement de „fondation” qui est l'essence de l'être humain. Tous les arguments conduisant à l'affirmation philosophique de Dieu, ne composent en réalité qu'une seule démonstration, qui coïncide avec le tout de la philosophie. Pour acquérir une connaissance explicite de ce qu'est le Fondement radical, le philosophe doit rendre plus concret le contenu de la fondation transcendentale qui relie ce Fondement au fond de l'existence humaine. Dans ce but il parcourt et traverse les stades 1) de l'existence „économique” jouissant du cosmos (argument cosmologique ; cosmo -théo -logie) , 2) de l'existence sociale se découvrant a) obligée au respect et b) appelée à la communion fraternelle (socio-théo-logie), et 3) de l'ipséité qui fait l'expérience de soi-même comme don gratuit, – pour apprendre finalement que le cercle égologique englobant les étapes énumérées, est lui-même un don du Dieu donnant, qui - peut-être - va parler. 6. Vérité et apparence. – La philosophie est essentiellement une explicitation de la fondation originaire qui affirme Dieu-dans-le-monde ou le-monde-en-Dieu. A cause de la déviation historique de toute philosophie concrète, l'expérience de la recherche du vrai comporte aussi et d'abord une (re-) Conversion au véritable Fondement, qui est la fin et le début de tout penser. 7. Itinerarium mentis in Deum. – Une phénoménologie de l'acte philosophique doit surmonter les phénoménologies superficielles par une réflexion sur les différentes philosophies de notre passé, dans lesquelles elle reconnaît des „phénomènes” systématiques explicitant l'affirmation originaire de la Vérité elle-même. Pour préparer une méthodologie de cette phénoménologie méta-philosophique, une discussion avec le projet de la Phénoménologie de l'Esprit hégélienne s'impose. Coalescent argumentation is a normative ideal that involves the joining together of two disparate claims through recognition and exploration of opposing positions. By uncovering the crucial connection between a claim and the attitudes, beliefs, feelings, values and needs to which it is connected dispute partners are able to identify points of agreement and disagreement. These points can then be utilized to effect coalescence, a joining or merging of divergent positions, by forming the basis for a mutual investigation of non-conflictual (...) options that might otherwise have remained unconsidered. Argumentation schemes can be described as abstract structures representing the most generic types of argument, constituting the building blocks of the ones used in everyday reasoning. This paper investigates the structure, classification, and uses of such schemes. Three goals are pursued: 1) to describe the schemes, showing how they evolved and how they have been classified in the traditional and the modern theories; 2) to propose a method for classifying them based on ancient and modern developments; and 3) to (...) outline and show how schemes can be used to describe and analyze or produce real arguments. To this purpose, we will build on the traditional distinctions for building a dichotomic classification of schemes, and we will advance a modular approach to argument analysis, in which different argumentation schemes are combined together in order to represent each step of reasoning on which a complex argument relies. Finally, we will show how schemes are applied to formal systems, focusing on their applications to Artificial Intelligence, AI & Law, argument mining, and formal ontologies. (shrink)

Argumentation mining is an application of natural language processing (NLP) that emerged a few years ago and has recently enjoyed considerable popularity, as demonstrated by a series of international workshops and by a rising number of publications at the major conferences and journals of the field. Its goals are to identify argumentation in text or dialogue; to construct representations of the constellation of claims, supporting and attacking moves (in different levels of detail); and to characterize the patterns of (...) reasoning that appear to license the argumentation. Furthermore, recent work also addresses the difficult tasks of evaluating the persuasiveness and quality of arguments. Some of the linguistic genres that are being studied include legal text, student essays, political discourse and debate, newspaper editorials, scientific writing, and others. The book starts with a discussion of the linguistic perspective, characteristics of argumentative language, and their relationship to certain other notions such as subjectivity. Besides the connection to linguistics, argumentation has for a long time been a topic in Artificial Intelligence, where the focus is on devising adequate representations and reasoning formalisms that capture the properties of argumentative exchange. It is generally very difficult to connect the two realms of reasoning and text analysis, but we are convinced that it should be attempted in the long term, and therefore we also touch upon some fundamentals of reasoning approaches. Then the book turns to its focus, the computational side of mining argumentation in text. We first introduce a number of annotated corpora that have been used in the research. From the NLP perspective, argumentation mining shares subtasks with research fields such as subjectivity and sentiment analysis, semantic relation extraction, and discourse parsing. Therefore, many technical approaches are being borrowed from those (and other) fields. We break argumentation mining into a series of subtasks, starting with the preparatory steps of classifying text as argumentative (or not) and segmenting it into elementary units. Then, central steps are the automatic identification of claims, and finding statements that support or oppose the claim. For certain applications, it is also of interest to compute a full structure of an argumentative constellation of statements. Next, we discuss a few steps that try to 'dig deeper': to infer the underlying reasoning pattern for a textual argument, to reconstruct unstated premises (so-called 'enthymemes'), and to evaluate the quality of the argumentation. We also take a brief look at 'the other side' of mining, i.e., the generation or synthesis of argumentative text. The book finishes with a summary of the argumentation mining tasks, a sketch of potential applications, and a—necessarily subjective—outlook for the field. Argumentation involves offering and/or exchanging reasons – either reasons for adopting various attitudes towards specific propositional contents or else reasons for acting in various ways. This paper develops the idea that the force of reasons is through and through a normative force because what good reasons accomplish is precisely to give one a certain sort of entitlement to do what they are reasons for. The paper attempts to shed light on what it is to have a reason, how the (...) sort of entitlement arising from reasons differs from other species of entitlement and how the norms by which such entitlement is assessed obtain their status as norms. According to the Bayesian paradigm in the psychology of reasoning, the norms by which everyday human cognition is best evaluated are probabilistic rather than logical in character. Recently, the Bayesian paradigm has been applied to the domain of argumentation, where the fundamental norms are traditionally assumed to be logical. Here, we present a major generalisation of extant Bayesian approaches to argumentation that (i)utilizes a new class of Bayesian learning methods that are better suited to modelling dynamic and conditional (...) inferences than standard Bayesian conditionalization, (ii) is able to characterise the special value of logically valid argument schemes in uncertain reasoning contexts, (iii) greatly extends the range of inferences and argumentative phenomena that can be adequately described in a Bayesian framework, and (iv) undermines some influential theoretical motivations for dual function models of human cognition. We conclude that the probabilistic norms given by the Bayesian approach to rationality are not necessarily at odds with the norms given by classical logic. Rather, the Bayesian theory of argumentation can be seen as justifying and enriching the argumentative norms of classical logic. (shrink)

Robert Alexy develops his influential theory of legal reasoning exploring the nature of legal argumentation and its relation to practical reasoning. In doing so he sheds light on fundamental questions of law and rationality, which are as crucial to practising lawyers and law students as they are to scholars of legal theory.

In this paper we explore the thesis that the role of argumentation in practical reasoning in general and legal reasoning in particular is to justify the use of defeasible rules to derive a conclusion in preference to the use of other defeasible rules to derive a conflicting conclusion. The defeasibility of rules is expressed by means of non-provability claims as additional conditions of the rules.We outline an abstract approach to defeasible reasoning and argumentation which includes many existing formalisms, (...) including default logic, extended logic programming, non-monotonic modal logic and auto-epistemic logic, as special cases. We show, in particular, that the admissibility semantics for all these formalisms has a natural argumentation-theoretic interpretation and proof procedure, which seem to correspond well with informal argumentation. Formal logic has often been seen as uniquely placed to analyze mathematical argumentation. While formal logic is certainly necessary for a complete understanding of mathematical practice, it is not sufficient. Important aspects of mathematical reasoning closely resemble patterns of reasoning in nonmathematical domains. Hence the tools developed to understand informal reasoning, collectively known as argumentation theory, are also applicable to much mathematical argumentation. This chapter investigates some of the details of that application. “Why are millions of dollars worth of orders being left unpaid?”. With tweets like this questioning brands’ policies, activists advocating for sustainable fashion re-discuss material starting points that are assumed by fashion brands, who argue that they are sustainable because they care about their workers’ conditions. This paper argues that activists use tweets to open _subdiscussions on material starting points_ to engage citizens and consumers, re-discussing factual _data_ that brands take for granted, such as the fact that they provide fair (...) conditions for their garment workers. Activists justify their opening of subdiscussions, often through an argumentative pattern that includes an argument based on the _locus from effects to cause_. They argue that if there are negative effects, the brand cannot claim to care about the conditions of its workers. In discussing how subdiscussions are used by fashion activists, this paper also introduces a conceptualization of Twitter argumentation as a discussion that is not isolated, but is part of a polylogical argumentation that takes place in different venues. For this reason, the argumentation used in tweets is reconstructed as a response to a fashion brand’s communication campaigns around sustainability, which extend beyond the confines of Twitter. As an empirical illustration, this paper is based on the campaign targeting fashion retailer Primark; the dataset includes the brand’s website as well as activists’ tweets. (shrink)

This essay begins with a critique of the Critical-Logical model dominant in contemporary argumentation theory. The concerns raised stem primarily from considerations brought by several feminist thinkers including Carol Gilligan, Karen Warren, Deborah Tannen and, most especially, Andrea Nye. It is argued that, in light of these considerations, and concerns of essentialism or non-essentialism notwithstanding, that the Critical-Logical model is liable to dis-enfranchise a significant part of the population with regard to modes and styles of reasoning. As the average age of the population increases, so too do the number of people living with chronic illnesses. With limited resources available, the development of dialogue-based e-health systems that provide justified general health advice offers a cost-effective solution to the management of chronic conditions. It is however imperative that such systems are responsible in their approach. We present in this paper two main challenges for the deployment of e-health systems, that have a particular relevance to dialogue and argumentation: (...) collecting and handling health data, and trust. For both challenges, we look at specific issues therein, outlining their importance in general, and describing their relevance to dialogue and argumentation. Finally, we go on to propose six recommendations for handling these issues, towards addressing the main challenges themselves, that act both as general advice for dialogue and argumentation research in the e-health domain, and as a foundation for future work on this topic. Prakken gives an argumentation‐based analysis of the manslaughter case using logical tools developed in AI. Prakken regards evidential argumentation as the construction and attack of ‘trees of inference’ from evidence to conclusions by applying generalizations. He argues that this approach clearly shows how evidence and hypotheses relate and what are the points of disagreement, but that it cannot give a clear overview over a case and lacks a systematic account of degrees of uncertainty.

This paper provides equational semantics for Dung's argumentation networks. The network nodes get numerical values in [0,1], and are supposed to satisfy certain equations. The solutions to these equations correspond to the ?extensions? of the network. This approach is very general and includes the Caminada labelling as a special case, as well as many other so-called network extensions, support systems, higher level attacks, Boolean networks, dependence on time, and much more. Abstract In this essay, I will argue that images can play a substantial role in argumentation: exploiting information from the context, they can contribute directly and substantially to the communication of the propositions that play the roles of premises and conclusion. Furthermore, they can achieve this directly, i.e. without the need of verbalization. I will ground this claim by presenting and analyzing some arguments where images are essential to the argumentation process. In this paper a theoretical definition that helps to explain how the logical structure of legal presumptions is constructed by applying the Carneades model of argumentation developed in artificial intelligence. Using this model, it is shown how presumptions work as devices used in evidentiary reasoning in law in the event of a lack of evidence to assist a chain of reasoning to move forward to prove or disprove a claim. I consider argumentation from the point of view of context-transcendent cognitive transformation through reference to the critical social theory of Jürgen Habermas. My aim is threefold. First, to make the case for a concept of context-transcendent cognitive transformation. Second, to clarify the transformatory role of argumentation itself by showing that, while argumentation may contribute constructively to context-transcendent cognitive transformation, such transformation presupposes the existence of a reality conceptually independent of argumentation. Third, to cast light on the (...) problem of how to justify argumentatively the poetically formulated, novel and innovative semantic contents that may be required for context-transcendent cognitive transformation. I conclude that the difficulties involved in argumentatively assessing novel and innovative semantic contents should not be misconstrued as evidence of an unbridgeable gap between language and experience but rather suggest the need for a more dynamic normative conception of language and for a more receptive model of autonomous agency. The paper offers a theoretical investigation into the sources of normativity in practical argumentation. The chief question is: Do we need objectively-minded, unbiased arguers or can we count on “good” argumentative processes in which individual biases cancel each other out? I address this question by analysing a detailed structure of practical argument and its varieties, and by discussing the tenets of a comparative approach to practical reason. I argue that given the comparative structure proposed, reasoned advocacy in argumentative activity (...) upholds reasonableness whenever that activity is adequately designed. In this paper we provide a proof theoretical investigation of logical argumentation, where arguments are represented by sequents, conflicts between arguments are represented by sequent elimination rules, and deductions are made by dynamic proof systems extending standard sequent calculi. The idea is to imitate argumentative movements in which certain claims are introduced or withdrawn in the presence of counter-claims. This is done by a dynamic evaluation of sequences of sequents, in which the latter are considered ‘derived’ or ‘not derived’ (...) according to the content of the sequence. We show that decisive conclusions of such a process correspond to well-accepted consequences of the underlying argumentation framework. The outcome is therefore a general and modular proof-theoretical approach for paraconsistent and non-monotonic reasoning with argumentation systems. (shrink)

This paper is aimed at combining the advances in argumentation theory with the models used in the field of education to address the issue of improving students’ argumentative behavior by interacting with an expert. The concept of deeper or more sophisticated argumentative strategy is theoretically defined and used to advance two new coding schemes, based on the advances in the argumentation studies and aimed at capturing the dialectical, or structural, behavior, and the argumentative content of each dialogue unit. These coding schemes are then applied for a qualitative analysis of a study designed to investigate how students’ argumentative behavior can be influenced by the interaction with an expert, who used specific types of attacks to the interlocutors’ positions. The twofold coding shows at which dialogical level expert–peer interactions can directly and more stably affect students’ argumentative behavior, and what effects such more sophisticated strategies can have on the discussion and the analysis of disagreements. In particular, this paper shows how a specific type of deep-level attack, the underminer, can open dialogues of a different level, focused on unveiling and debating background beliefs underlying a specific position. The Pyrrhonist’s argumentative practice is characterized by at least four features. First, he makes a therapeutic use of arguments: he employs arguments that differ in their persuasiveness in order to cure his dogmatic patients of the distinct degrees of conceit and rashness that afflict them. Secondly, his arguments are for the most part dialectical: when offering an argument to oppose it to another argument advanced by a given dogmatist, he accepts in propria persona neither the truth of its premises and (...) conclusion nor the validity of its logical form. Thirdly, he avails himself of arguments in his own open-minded inquiry into the truth about a wide range of topics. Fourthly, Pyrrhonian argumentation is oppositional inasmuch as it typically works by producing oppositions among arguments that appear to the Pyrrhonist to be equipollent. In this article, I focus on the first three features with the aim of both shedding some light on them and determining whether they are in tension or coherently relate to each other. (shrink)

In this paper, it is explained that a dialogical approach to complex argumentation can be fruitful for solving two important problems concerning the analysis of the argumentation structure. First, such an approach makes it possible to clarify the distinction between coordinative and multiple argumentation structures, and to identify clues in the presentation for each of these structures. Second, a dialogical approach can provide a basis for dealing more adequately with refutations of counterarguments.

It is often necessary and reasonable to justify preferences before reasoning from them. Moreover, justifying a preference ordering is reduced to justifying the criterion that produces the ordering. This paper builds on the well-known ASPIC+ formalism to develop a model that integrates justifying qualitative preferences with reasoning from the justified preferences. We first introduce a notion of preference criterion in order to model the way in which preferences are justified by an argumentation framework. We also adapt the notion of (...) argumentation theory to build a sequence of argumentation frameworks, in which an argumentation framework justifies preferences that are to underlie the next framework. That is, in our formalism, preferences become not only an input of an argumentation framework, but also an output of it. This kind of input-output process can be applied in the further steps of argumentation. We also explore some interesting properties of our formalism. (shrink)

A broad assumption in argumentation theory is that argumentation primarily regards resolving, confronting, or managing disagreement. This assumption is so fundamental that even when there does not appear to be any real disagreement, the disagreement is suggested to be present at some other level. Some have questioned this assumption (most prominently, Perelman and Olbrechts-Tyteca, and Doury), but most are reluctant to give up on the key idea that persuasion, the core of argumentation theory, can only regard disagreements. (...) We argue here that this assumption is false. Argument may be as much about strengthening or maintaining agreement as it is about disagreement. Once we see how argument is possible and manifestly enacted under conditions of agreement, then we have tools to explain otherwise curious fallacies and argumentative phenomena. (shrink)

A "good" arguer is like an architect with a penchant for civil and civic engineering. Such an arguer can design and present their reasons artfully about a variety of topics, as good architects do with a plenitude of structures and in various environments. Failures in this are rarely hidden for long, as poor constructions reveal themselves, often spectacularly, so collaboration among civical engineers can be seen as a virtue. Our logical virtues should be analogous. When our arguments fail due to (...) being uncivil and demagogic, since we inhabit the arguments we build, we are all crushed beneath our flawed reasoning. This mixed metaphor takes us to a self-referential analysis of argumentation, analogy, and humor. I argue that good argumentation strives to collaboratively convince rather than belligerently persuade. A convincing means toward this end is through humorous analogical arguments, whether the matter at hand is ethical, logical, theological, phenomenological, epistemological, metaphysical, political, or about baseball. The study presented here examines how interacting with a more capable interlocutor influences use of argumentation strategies in electronic discourse. To address this question, 54 young adolescents participating in an intervention centered on electronic peer dialogs were randomly assigned to either an experimental or control condition. In both conditions, pairs who held the same position on a social issue engaged in a series of electronic dialogs with pairs who held an opposing position. In the experimental condition, in some dialogs, (...) unbeknownst to them (because dialog took place electronically), the opponent was a more capable (“expert”) adult. Dialogs in the control condition were only with peers. Argumentation strategies of the experimental group who argued with the “expert” showed immediate strategy improvements in their subsequent peer dialogs, improvement absent in the control group (Cohen's d = 1.12). In particular, the experimental group showed greater use of counterargument in general and advanced forms of counterargument (undermining) that challenges the deeper premises or reasoning on which an argument is based. Implications with respect to mechanisms of change in the development of argumentation skills are considered. (shrink)

In Biro and Siegel we argued that a theory of argumentation mustfully engage the normativity of judgments about arguments, and we developedsuch a theory. In this paper we further develop and defend our theory.

Wellman identified three types of conductive arguments, the third of which contains both pro and counter-considerations in the same piece of reasoning. This paper provides a pragma-dialectical analysis of this type of argumentation, with special focus on argumentation reconstruction. It argues that the account of pro/con argumentation in the framework of argument-as-product has problems solvable by a pragma-dialectical approach. The paper asserts that pro/con argumentation should be analyzed as a dialectical strategy of a protagonist, where acknowledgement (...) of counter-considerations shows that the antagonist’s reasons have been taken into consideration, although the pro-considerations override them. Thus, the pro-considerations of pro/con argumentation should be interpreted as the protagonist’s overriding defeaters of the antagonist’s counter-arguments, the protagonist incorporating the latter as counter-considerations. The paper further argues that the pragma-dialectical framework needs an additional conceptual tool to properly reconstruct complex forms of pro/con argumentation. Finally, the pragma-dialectical approach to reconstruct pro/con argumentation has several advantages, especially to a more logical-structural approach to complex pro/con argumentation. (shrink)

Philosophy’s adversarial argumentation style is often noted as a factor contributing to the low numbers of women in philosophy. I argue that there is a level of adversariality peculiar to philosophy that merits specific feminist examination, yet doesn’t assume controversial gender differences claims. The dominance of the argument-as-war metaphor is not warranted, since this metaphor misconstrues the epistemic role of good argument as a tool of rational persuasion. This metaphor is entangled with the persisting narrative of embattled reason, which, (...) in turn, is linked to the sexism-informed narrative of the “man of reason” continually warding off or battling “feminine” unreason.
