Dialogical egalitarianism is the thesis that any proposition asserted in dialogue, if questioned, must be supported or else retracted. Dialogical foundationalism is the thesis that some propositions are privileged over this burden of proof, standing in no need of support unless and until support for their negation is provided. I first discuss existing arguments for either thesis, dismissing each one of them. Absent a successful principled argument, I then examine which thesis it is pragmatically more advantageous to adopt in analytic (...) philosophical dialogue. This requires identifying the goal of such dialogue, to the attainment of which the thesis would be so advantageous. To identify this goal, I draw on Douglas Walton’s typology of dialogues for an analysis of the types of dialogue of 110 representatively selected journal articles in current analytic philosophy. 95% of articles are found to instantiate persuasion dialogue. In light of the thus prevalent goal of persuading one’s opponent, I argue that the adoption of dialogical egalitarianism in analytic philosophical dialogue is pragmatically inescapable. (shrink)

Who carries the burden of proof in analytic philosophical debates, and how can this burden be satisfied? As it turns out, the answer to this joint question yields a fundamental challenge to the very conduct of metaphysics in analytic philosophy. Empirical research presented in this book indicates that the vastly predominant goal pursued in analytic philosophical dialogues lies not in discovering truths or generating knowledge, but merely in prevailing over one’s opponents. Given this goal, the book examines how most effectively (...) to allocate and discharge the burden of proof. It focuses on premises that must prudently be avoided because a burden of proof on them could never be satisfied, and in particular discusses unsupportable bridge premises across inference barriers, like Hume’s barrier between ‘is’ and ‘ought’, or the barrier between the content of our talk or thought, and the world beyond such content. Employing this content/world barrier for a critical assessment of mainstream analytic philosophical methods, this book argues that we must prudently avoid invoking intuitions or other content of thought or talk in support of claims about the world beyond content, that is, metaphysically significant claims. Yet as content-located evidence is practically indispensable to metaphysical debates throughout analytic philosophy, from ethics to the philosophy of mathematics, this book reaches the startling conclusion that all such metaphysical debates must, prudently, be terminated. Gottlob Frege has exerted an enormous influence on the evolution of twentieth-century philosophy, yet the real significance of that influence is still very much a matter of debate. This book provides a completely new and systematic account of Frege's philosophy by focusing on its cornerstone: the theory of sense and reference. Two features distinguish this study from other books on Frege. First, sense and reference are placed absolutely at the core of Frege's work; the author shows that no adequate account (...) of the theory can avoid analysing the notion of thought that underpins it, or explaining how it has clarified our concept of judgement. Second, the theory is situated within the development of Frege's thought; the author reveals how the theory caused Frege to alter many of his fundamental views. In doing so the author presents a clearer picture of the problems the theory was intended to solve, and delineates more sharply the characteristic features of Frege's philosophy. (shrink)

She concentrates on responses to the 'crisis' that currently confronts the American legal profession and legal education—including the increasing cost of legal services, the threat to lawyer income and the oversupply of law graduates. Rhode regards the response by the American Bar Association (ABA) through its Ethics 20/20 Commission as lacking innovation and achieving only modest reform. Surveying other countries' efforts at opening the provision of some traditional legal services to non-lawyers and outside investment in law practices, she argues (...) that the US 'is likely to lag behind other nations in its capacity to provide cost effective legal services'. This book has grown out of eight years of close collaboration among its authors. From the very beginning we decided that its content should come out as the result of a truly common effort. That is, we did not "distribute" parts of the text planned to each one of us. On the contrary, we made a point that each single paragraph be the product of a common reflection. Genuine team-work is not as usual in philosophy as it is in other (...) academic disciplines. We think, however, that this is more due to the idiosyncrasy of philosophers than to the nature of their subject. Close collaboration with positive results is as rewarding as anything can be, but it may also prove to be quite difficult to implement. In our case, part of the difficulties came from purely geographic separation. This caused unsuspected delays in coordinating the work. But more than this, as time passed, the accumulation of particular results and ideas outran our ability to fit them into an organic unity. Different styles of exposition, different ways of formalization, different levels of complexity were simultaneously present in a voluminous manuscript that had become completely unmanageable. In particular, a portion of the text had been conceived in the language of category theory and employed ideas of a rather abstract nature, while another part was expounded in the more conventional set-theoretic style, stressing intui tivity and concreteness. Cross-cultural research suggests that East Asians display a holistic attentional bias by paying attention to the entire field and to relationships between objects, whereas Westerners pay attention primarily to salient objects, displaying an analytic attentional bias. The assumption of a universal pan-Asian holistic attentional bias has recently been challenged in experimental research involving Japanese and Chinese participants, which suggests that linguistic factors may contribute to the formation of East Asians' holistic attentional patterns. The present experimental research explores differences in attention (...) and information processing styles between Korean and Chinese speakers, who have been assumed to display the same attentional bias due to cultural commonalities. We hypothesize that the specific structure of the Korean language predisposes speakers to pay more attention to ground information than to figure information, thus leading to a stronger holistic attentional bias compared to Chinese speakers. Findings of the present research comparing different groups of English, Chinese, and Korean speakers provide further evidence for differences in East Asians' holistic attentional bias, which may be due to the influence of language. Furthermore, we also extend prior theorizing by discussing the potential impact of other cultural factors. In line with critical voices calling for more research investigating differences between cultures that are assumed to be culturally similar, we highlight important avenues for future studies exploring the language-culture relationship. Many philosophical theories of self-knowledge can be understood as attempts to explain why self-ascriptions enjoy a certain kind of authority that other-ascriptions lack (the Authority Thesis). The aim of this paper is not to expand the stock of existing explanations but to ask whether the Authority Thesis can be adequately specified. To this end, I identify three requirements that must be met by any satisfactory specification. I conclude that the search for an adequate specification of the Authority Thesis leads to (...) a dilemma: it either yields an interpretation under which the thesis is philosophically interesting but false, or it produces an interpretation under which the thesis is actually true but of minor philosophical interest. According to the classical quantificational analysis of modals, an agent has the ability to perform an act iff relevant facts about the agent and her environment are compatible with her performing the act. The analysis faces a number of problems, many of which can be traced to the fact that it takes even accidental performance of an act as proof of the relevant ability. I argue that ability statements are systematically ambiguous: on one reading, accidental performance really is enough; on (...) another, more is required. The stronger notion of ability plays a central role in normative contexts. Both readings, I argue, can be captured within the classical quantificational framework, provided we allow conversational context to impose restrictions not just on the “accessible worlds”, but also on what counts as a performance of the relevant act among these worlds. There is an ever-increasing interest in the question of how and why legal norms can effectively guide human action. Kant's theory of cognition centrally builds on his conception of self‐consciousness and the transcendental use of the phrase “I think”: the ability to add the phrase “I think” to a representation is a necessary condition of the ability to cognize objects. The paper argues that “I think”, rather than denoting the content of a predicative judgement, is typically an expression of the subject's thinking. It expresses a kind of self‐consciousness that, without assertively representing the subject itself, indicates that representational contents (...) are unified in a single consciousness of a single subject. Our aim is thus to develop and defend an expressivist interpretation of Kant's “I think”. (shrink)

What is an image? An image, it might be said, is a kind of amity between the medium and the model it assumes. The purpose of this relationship is to reproduce the model and to become similar to it. Such a definition invites – perhaps in a purely playful way – some preliminary considerations.

The intervention of the divine in human history, more precisely the transition from fiction to incarnation that is peculiar to the origins of Christianity, marks a turning-point in our understanding of the genealogical principle. With a Son of Man who is also Son of God and his Mother's Father, there is no paternity and, more generally, no genealogy that is not reversible. To this questioning of elementary kinship structures we should add the contesting of the hitherto accepted distribution of genders (...) and sexes. The superimposition of the Holy Family and the Trinity created an uncertain sex whose effect is to uncouple sex from its functions, in particular procreation. Hence a circulation and instability of sex. It is from this viewpoint that we should see the notion of an androgynous Christ and the Church Fathers' thinking on the resurrected body. (shrink)

The respectably legitimate offspring of an age-old affair between writing and picture-making, the calligramme — that is, “a poem in which the typographical layout creates a picture, generally related to the ‘subject’ of the text” (Dictionnaire des littératures, Larousse) — is often seen as an esoteric minority art of dubious reputation. Starting from an exclusively Western approach to the history of the calligramme, my aim is to demonstrate that this artform may in fact represent something more than simply (here I (...) deliberately use a metaphor from the far east, as a counterargument to my theme) the “Kyogen of the No theatre” — i.e., more than a lightweight interlude between more literary, aesthetic, even metaphysical preoccupations — more elevated, more serious, or, in general terms, more extended. Apart from the play and the pleasure of an approach that is creative in terms of letters and language, it contains serious elements related to the actual exercise of writing in our media civilization. We reconstruct “the classical transformational theory” of Chomsky, and fit it into the structuralist theory of science. We describe both the formal and the empirical features of this classical account, so that one basic hypothesis of this theory – where central notions are used – can be formulated, and in which Chomsky’s “classical” distinction between surface structure and deep structure is clarified. In the empirical claim of this theory are words, sentences and high-structured entities in an inseparable way intertwined. We (...) claim that the formal structure of a natural language is not approximately the same as that of an empirical theory in general. We clarify two special points which affect the structure of the notion of an empirical theory, namely: the delineation of intended applications and the fit between data and models. We hold that the concept of the empirical claim for a linguistic theory should be generalized in comparison with the “standard” structuralist approach. (shrink)
