The concept of psychologist as clinical scientist has found increasing support in recent years from diverse corners of professional psychology. Yet differences in how these advocates understand the nature of clinical scientific practice persist, fueled by philosophical differences over the nature of knowledge. Two epistemological paradigms that are the center of much discussion in contemporary philosophy are briefly explained: internalism vs. externalism. Modern clinical psychology has emerged largely within an internalist theory of knowledge. While psychologists have discerned important features of (...) how one obtains knowledge in a clinical setting, it is argued that these discoveries are better positioned in an externalist epistemology. The implications of externalist clinical science for a number of relevant topics are discussed including: whether there is, or should be, a normative scientific method, the role of clinical judgment as a source of knowledge, and how science can be demarcated from pseudo-science without presupposing a methodological hegemony. Isaac Newton's Scientific Method examines Newton's argument for universal gravity and his application of it to resolve the problem of deciding between geocentric and heliocentric world systems by measuring masses of the sun and planets. William L. Harper suggests that Newton's inferences from phenomena realize an ideal of empirical success that is richer than prediction. Any theory that can achieve this rich sort of empirical success must not only be able to predict the phenomena it purports to explain, but (...) also have those phenomena accurately measure the parameters which explain them. Harper explores the ways in which Newton's method aims to turn theoretical questions into ones which can be answered empirically by measurement from phenomena, and to establish that propositions inferred from phenomena are provisionally accepted as guides to further research. This methodology, guided by its rich ideal of empirical success, supports a conception of scientific progress that does not require construing it as progress toward Laplace's ideal limit of a final theory of everything, and is not threatened by the classic argument against convergent realism. Newton's method endorses the radical theoretical transformation from his theory to Einstein's. Harper argues that it is strikingly realized in the development and application of testing frameworks for relativistic theories of gravity, and very much at work in cosmology today. (shrink)

The United States carceral system, as currently designed and implemented, is widely considered to be an immoral and inhumane system of criminal punishment. There are a number of pressing issues related to this topic, but in this essay, I will focus upon the problem of prison violence. Inadequate supervision has resulted in unsafe prison conditions where inmates are regularly threatened with rape, assault, and other forms of physical violence. Such callous disregard and exposure to unreasonable risk constitutes a severe violation (...) of the rights of prisoners by the state. While there have been numerous legal, political, and activist efforts to draw attention to this issue—with the goal of reforming and making prisons safer—my goal is different. I argue that inmates who are victims of prison violence should have their sentences automatically reduced. Two distinct arguments are advanced in support of this claim. First, I argue that acts of prison violence are a sort of state-mediated harm which can thus be appropriately described as punishment-constituting. Second, and more straightforwardly, I argue that the compensation owed to prisoners who are victims of prison violence may naturally take the form of a reduced sentence. (shrink)

He smothered the country with emergency currency to prevent a replay of the bank runs that swept America in 1907. And he launched the United States as a world monetary power by honoring America's commitment to the gold standard. His actions provide a blueprint for crisis control that merits attention today. McAdoo's recipe emphasizes an exit strategy that allows policymakers to throttle a crisis while minimizing collateral damage. When Washington Shut Down Wall Street recreates the drama of America's battle for financial credibility. McAdoo's accomplishments place him alongside Paul Volcker and Alan Greenspan as great American financial leaders. McAdoo, in fact, nursed the Federal Reserve into existence as the 1914 crisis waned and served as the first chairman of the Federal Reserve Board. (shrink)

The problem, as Augustine sees it, is to show how it is possible both that we voluntary will to perform certain actions and that God foreknows that we shall will to perform these actions. The argument which gives rise to this problem may be expressed as follows.

Aaron Gurwitsch's The Field of Consciousness develops with great care a phenomenological "field theory of conscience." The explorations of various aspects of, and approaches to, experience include extensive references to the literature; both mention and use are made of the work of Husserl, James, Piaget, von Ehrenfels, Stumpf, Koffka, Bergson, Ward, G. F. Stout, and Merleau-Ponty. Out of this research a phenomenological basis is provided for the concepts of an objective space, time, and existence. Roman Ingarden's Time and Modes of (...) Being, a translation of part of the first volume of his two-volume Spór o istnienie swiata, published in Polish in 1946-7, is concerned with developing for metaphysical use the concepts of all possible modes of being, once time, space, and individual existence are granted. Gurwitsch and Ingarden use highly sophisticated phenomenological tools originating with Husserl to gain phenomenological and ontological results. Nathan Rotenstreich in Spirit and Man, 1963, uses introspection as his method, accommodating himself to a number of the distinctions of phenomenology, e.g., intentionality; but the puristic stance of the phenomenologist is missing; hence the average number of conclusions per paragraph is notably higher than in either of the other works. Rotenstreich begins with awareness, like Gurwitsch; like Ingarden he discusses modes of being; but his purpose lies in discovering and interrelating the basic themes appropriate to certain conclusions about man's status in and over against the space-time world. The issue that I wish to address is, why protest and criticize the increasing hegemony of what has been called the “culture of consumerism”? This “why not?” objection encompasses three distinct sets of questions. First, is not resistance to it akin to playing the role of King Canute by the sea? Second, is not acceptance of it dictated by the current liberal philosophical consensus that acknowledges and endorses an inevitable diversity in different individuals’ conceptions of what is good, and must (...) not this consensus itself be taken as a given by all who are opposed to political and religious totalitarianisms? Third, does not cosmopolitanism, regarded as a value-orientation favorable to the dissolution or at least minimization of national boundaries and the practices of exclusivity associated therewith, make common cause in the present historical conjuncture with this same trend? I will argue for a “No” answer to all of these questions. (shrink)

The chorus of doubts concerning the continued viability of the Western liberal tradition itself, in both ideational and institutional aspects, has grown much louder over the past several years. Can this tradition be said to be in a time of twilight – that time that falls? It is this question that would be explored in this paper. While searching the confirmation of the position, indicated in the title of the paper, author turns to contemporary ideological sources of Western liberalism. Such (...) concepts as capitalism, socialism, justice, democracy are considered in this context based on the works of two thinkers, John Rawls and Fred Dallmayr. By stressing ideal justice and ignoring concrete injustice, Rawls’ ideas seem strange even apart from the present crisis. The subsequent evolution of his thoughts is estimated by the author as the transition from daylight to twilight. It has manifested in Rawls’ refusal to apply his principles of justice to the international arena, his condescending attitude toward underdeveloped countries. The atmosphere of The Law of Peoples is still redolent of the assumption of American hegemony. The author wishes to extract from Dallmayr’s book for present purposes is above all his commitment to a version of socialism. But what neither Dallmayr nor Rawls and other liberal thinkers will gainsay is that central to the twilight zone in which we are wandering is the heavy hand of global capitalism. The next problem is that the modern liberal democratic theory has always professed to make the assumption of equality, but it has never fully embraced it. The most important conceptual element in accounting for this failure is the notion of majority rule. The author mentions three difficulties with the idea of majority rule: the problem of time and the problem of the identity of the human units who compose the majority, and the problem of information. He analyzes the recent political evolutions of both the United Kingdom and the United States, and France as well, which have certainly given Western liberalism a badname in many quarters. (shrink)

According to a rights forfeiture theory of punishment, liability to punishment hinges upon the notion that criminals forfeit their rights against hard treatment. In this paper, I assume the success of rights forfeiture theory in establishing the permissibility of punishment but aim to develop the view by considering how forfeited rights might be reclaimed. Built into the very notion of proportionate punishment is the idea that forfeited rights can be recovered. The interesting question is whether punishment is the sole means (...) for reclaiming forfeited rights. I argue for a pluralistic theory of rights reclamation, according to which, there are multiple ways by which a wrongdoer can recapture her forfeited rights. In particular, I argue that offering remorseful compensation is a valid means by which a wrongdoer might partially, or fully, reclaim her right against punishment. (shrink)
