[Wilfrid Hodges] During the last forty or so years it has become popular to offer explanations of logical notions in terms of games. There is no doubt that many people find games helpful for understanding various logical phenomena. But we ask whether anything is really 'explained' by these accounts, and we analyse Paul Lorenzen's dialogue foundations for constructive logic as an example. The conclusion is that the value of games lies in their ability to provide helpful metaphors and representations, (...) rather than in any true conceptual analysis. In fact some of the standard explanations of logical notions in terms of competitive games simply don't work. /// [Erik C. W. Krabbe] In an attempt to redeem the Lorenzen-type dialogues from their detractors, it is perhaps best first to provide a survey of the various benefits these dialogues have been supposed to yield. This will be done in Section I. It will not be possible, within the confines of this paper, to scrutinize them all, but in Section II we shall delve deeper into the capacity of this type of dialogue to yield a model for the immanent criticism of philosophical positions. Section III will extend the concept of a dialogue in such a way as to conform better with our intuitive conceptions of what a rational discussion of a position should contain. This will be followed up by a concept of 'winning a dialogue' that takes position midway between the old conception of 'winning one play' and that of the full-fledged presentation of a winning strategy. Concepts of 'rational discussion' are thus shown to be, plausibly, more fundamental than those of proof. In Section IV, I shall discuss the specific problems about dialogical foundations put forward by Wilfrid Hodges. (shrink)

The author's primary objective is to show that versions of legal positivism, according to which legal validity sometimes depends on moral validity (Inclusive Legal Positivism), are theoretically preferable to those forms of positivism (Exclusive Legal Positivism) which deny this possibility. The author attempts to substantiate this conclusion by demonstrating that Inclusive Legal Positivism provides a better theoretical account of challenges to legal validity based on a document like the Canadian Charter of Rights and Freedoms. 1. My primary aim in this paper is to set the stage for a discussion of some of the central themes in the so-called "identity" approach to the mind-body problem. I have particularly in mind Herbert Feigl's elaborate statement and defense of this approach in Volume II of the Minnesota Studies. [p.225] Introduction (i) Although the following essay attempts to deal in a connected way with a number of connected conceptual tangles, it is by no means monolithic in design. It divides roughly in two, with the first half (Parts I and II) devoted to certain puzzles which have their source in a misunderstanding of the more specific structure of the language in which we describe and explain natural phenomena; while the second half (Parts III and IV) attempts to resolve the (...) more sweeping controversy over the nature of the connection between 'cause' and 'effect,' or, in modem dress, the logical status of 'lawlike statements.' (ii) The essay begins with a case analysis of a puzzle, taken from recent philosophical literature, relating to the analysis of counterfactual conditionals, statements of the form "If that lump of salt had been put in water, it would have dissolved." The diagnosis of this puzzle, which occupies the whole of Part I, shows it to rest on a misunderstanding of the conceptual framework in terms of which we speak of what things do when acted upon in certain ways in certain kinds of circumstance. Although the puzzle is initially posed in terms of examples taken from everyday life, the logical features of these examples which, misunderstood, generate the puzzle, are to be found in even the more theoretical levels of the language of science, and the puzzle is as much at home in the one place as in the other. For the framework in which things of various kinds (e.g. matches, white rats) behave ('respond') in various ways (catch fire, leap at a door) when acted upon ('submitted to such and such stimuli') under given conditions (presence of oxygen, 24 hours of food deprivation) is far more basic than the distinctions between metrical and non-metrical concepts, molar and micro-things, [p.226] observable and unobservable.. This book develops a general theory of law, inclusive legal positivism, which seeks to remain within the tradition represented by authors such as Austin, Hart, MacCormick, and Raz, while sharing some of the virtues of both classical and modern theories of natural law, as represented by authors such as Aquinas, Fuller, Finnis, and Dworkin. Its central theoretical questions are: Does the existence or content of positive law ever depend on moral considerations? If so, is this fact consistent with legal positivism? (...) The author shows how inclusive positivism allows one to answer yes to both of these questions. In addition to articulating and defending his own version of legal positivism, which is a refinement and development of the views of H.L.A. Hart as expressed in his classic book The Concept of Law, the author clarifies the terms of current jurisprudential debates about the nature of law. These debates are often clouded by failures to appreciate that different theorists are offering differing kinds of theories and attempting to answer different questions. There is also a failure, principally on the part of Ronald Dworkin, to characterize opposing theories correctly. The clarity of Waluchow's work will help to remove the confusion which has hitherto marred some jurisprudential debate, particularly about Dworkin's work. (shrink)

The most important work by one of America's greatest twentieth-century philosophers, Empiricism and the Philosophy of Mind is both the epitome of Wilfrid Sellars' entire philosophical system and a key document in the history of philosophy. First published in essay form in 1956, it helped bring about a sea change in analytic philosophy. It broke the link, which had bound Russell and Ayer to Locke and Hume--the doctrine of "knowledge by acquaintance." Sellars' attack on the Myth of the Given (...) in Empiricism and the Philosophy of Mind was a decisive move in turning analytic philosophy away from the foundationalist motives of the logical empiricists and raised doubts about the very idea of "epistemology." With an introduction by Richard Rorty to situate the work within the history of recent philosophy, and with a study guide by Robert Brandom, this publication of Empiricism and the Philosophy of Mind makes a difficult but indisputably significant figure in the development of analytic philosophy clear and comprehensible to anyone who would understand that philosophy or its history. In 2003 Zia Movahed pointed to a passage of Avicenna, written probably in 1022, which Movahed claimed anticipated the modal formula of Barcan (that ‘For every |$x$| necessarily |$\phi $|’ entails ‘Necessarily for every |$x$||$\phi $|’), and its converse. Since 2003, examination of early logical writings of Avicenna has clarified how he understood entailments between modal sentences, using his own new temporal language to provide a kind of semantics. In the light of that, Movahed’s claim for the Barcan formula needs (...) some tidying up but is basically correct. But by his semantics Avicenna should not have claimed the converse Barcan formula and probably didn’t claim it. (shrink)

Ibn Sīnā proposed an analysis of arguments by reductio ad absurdum. His analysis contains, perhaps for the first time, a workable method for handling the making and discharging of assumptions in a formal proof. We translate the relevant text of Ibn Sīnā and put his analysis into the context of his general approach to logic.

The paper analyses what is said and what is presupposed by thePrinciple of Compositionality for semantics, as it is commonly stated. ThePrinciple of Compositionality is an axiom which some semantics satisfy andsome don’t. It says essentially that if two expressions have the same meaning then they make the same contribution to the meanings of expressionscontaining them. This is a sensible axiom only if one combines it with aconverse, that if two expressions make the same contribution to the meanings of sentences (...) containing them, then they have the same meaning;and some assumption that two expressions which can’t meaningfully besubstituted for each other have different meanings. as a full abstraction principle, and as ‘Husserl’s principle’.) Moreoverthe Principle of Compositionality speaks only about when two expressionshave the same meaning; it adds nothing whatever about what that meaningmight be . Some recent discussions by writers in linguistics and logic are assessed. The paper finishes by reviewing thehistory of the notion of compositionality. (shrink)

In 1954 H. L. A. Hart wrote that Austin's work has ‘never, since his death … been ignored’. If it never has been completely ignored, interest in it has periodically waxed and waned. The interest definitely waxed in the 1980s. More books were published about Austin in this period than in any other decade since his death in 1859. Although this literature contains discussions of some of the nineteenth-century responses to his work, they are not the focus of it. Certain (...) of the responses remain completely in the dark, while there is more light to shed on at least some of the others. In short, our knowledge of nineteenth-century interpretations of Austin's legal philosophy is very incomplete. (shrink)

We consider two formalisations of the notion of a compositionalsemantics for a language, and find some equivalent statements in termsof substitutions. We prove a theorem stating necessary and sufficientconditions for the existence of a canonical compositional semanticsextending a given partial semantics, after discussing what features onewould want such an extension to have. The theorem involves someassumptions about semantical categories in the spirit of Husserl andTarski.

Constitutional Charters or Bill of Rights have been applauded because of the protection they provide to minorities and also in ensuring and protecting fundamental rights, however, Charters have been criticized for being considered morally and politically objectionable. The author responds to Charter critics most serious objections and offers some reasons for adopting an alternative framework.

Formal implication is usually represented by symbolization such as ‘ φx ⊃ Ψx,’ which may be read, “for all values of ‘x’, φx implies Ψx.” If the values of the variable ‘x’, in ‘φx’ and ‘Ψx’ be ‘x1’ ‘x2’ ‘x3’, etc., then … ‘φx’ formally implies ‘Ψx’ if and only if, whatever values of ‘x’, ‘xn’, be chosen, ‘φxn’ materially implies ‘Ψxn’ …However, this still leaves it doubtful which of two possible interpretations of expressions having the form ‘ φx ⊃ (...) Ψx’ is to be taken as correct. … It means one thing to say, “Every existent having the property φ … has also the property Ψ,” and it means quite a different thing to say, “Every thinkable thing which should have the property φ must also have the property Ψ.” The second of these holds only when having the properly φ logically entails having the property Ψ; when ‘Ψx’ is deductible from ‘φx’. … The first of them, however, holds not only in such cases … but also in every case where among existent things, one property is universally accompanied by another. In this paper I defend constitutional review against the charge that it neces- sarily runs afoul of democratic principle. In so doing, I draw both on Dworkin’s theory of constructive interpretation as well as Raz’s theory of detached normative statements and reasoning from a point of view. After arguing that constructive interpretation can be undertaken from a point of view other than that of the interpreter, I go on to argue for the following claims: (1) Constitutional interpretation and review can (...) be undertaken from the point of view of the democratic community and its constitutional morality; (2) This process can be undertaken by a judge without the deliberate intrusion of her own personal moral convictions; (3) When undertaken from this point of view, constitutional interpretation and review can be rendered consistent with democracy; and (4) This is so even when these activities require a good deal of substantive moral reasoning and argument on the part of judges.
