Le plan canonique rigoureusement normé de la domus étrusco-romaine, attesté dans la plus grande partie de l’Italie, pour l’essentiel, du vie au ier siècle av. J.‑C., a connu un succès très limité en dehors de la péninsule, où de fortes traditions autochtones, grecques ou puniques, semblent en avoir entravé le développement. Le cas de Délos présente un intérêt particulier à cet égard, compte tenu de l’importance de la composante italique de sa population. L’étude des maisons d’habitation du site, ici envisagée (...) en fonction d’une approche strictement planimétrique, montre cependant, en dépit de quelques convergences, que le plan canonique n’y a jamais été véritablement adopté par les élites locales ; les édifices qui s’en rapprochent le plus sont actuellement interprétés comme des bâtiments commerciaux. Sufficientarian theories of distributive justice are often considered to be vulnerable to the ‘blindness to inequality and other values objection’. This objection targets their commitment to holding the moral irrelevance of requirements of justice above absolute thresholds of advantage, making them insufficiently sensitive to egalitarian moral concerns that do have relevance for justice. This paper explores how sufficientarians could reply to this objection. Particularly, I claim that, if we accept that the force of the aforementioned objection comes from relational, and (...) not distributive, inequalities, different strategies are open for sufficientarians in order to be sensitive to these concerns. Drawing on recent literature about the relation between distributive and relational egalitarianism, and the possibility of reducing one to the other, strategies of ‘internalizing’ and ‘externalizing’ relational egalitarian concerns to a distributive sufficientarian framework are explored. In turn, I suggest that both strategies fail in their standard versions, but argue that a particular ‘hybrid view’ about justice is an attractive candidate for the sufficientarian theorist. (shrink)

: Background: In responsible research and innovation (RRI), innovation is seen as a way in which humankind finds solutions for societal issues. However, studies on commercial innovation show that firms respond in a different manner and at a different speed to the same societal issue. This study investigates what role organizational motives play in the product innovation processes of firms when aiming for socially responsible outcomes. Methods: This multiple-case study investigates the motives of food firms for healthier product innovation by (...) interviewing firms about the organizational motives behind product reformulation and innovation. Results: This study highlights the importance of having both instrumental and moral motives in the innovation process when aiming for socially responsible outcomes, and how both these motives interact and contribute to responsible innovation in industry. Furthermore, the study results question the nature of relational motives as a separate category from the other two categories of motives, as suggested by corporate social responsibility (CSR) scholars. Conclusions: If commercial innovation needs to contribute to solutions for societal issues, the importance of moral motives has to be stressed without annihilating the instrumental objectives of firms. Both motives contribute to the success factors of responsible product innovation in industry. (shrink)

My aim in this paper is twofold. First, I provide an analysis of the notion of cognitive homology. In contrast with the well-known concept of structural homology in biology—defined as the same structure in different animals regardless of form and function—the notion of cognitive homology captures the idea that the basic cognitive contribution of a given homologous brain structure tends to remain stable over long evolutionary time scales. Second, I argue that this notion provides a powerful conceptual tool for the (...) study of cognition. Since a cognitive homology will often consist of an evolutionarily conserved relationship between a homologous brain structure and its basic cognitive contribution, such structure–function mappings can be conceived as basic building blocks of human cognition. Kit Fine’s logic of essence and his reduction of modality crucially rely on a principle called the ‘monotonicity of essence’. This principle says that for all pluralities, xx and yy, if some xx belong to some yy, then if it is essential to xx that p, it is also essential to yy that p. I argue that on the constitutive notion of essence, this principle is false. In particular, I show that this principle is false because it says that some (...) propositions are essential to yy even though those propositions are only about some of its members. I then consider modifications to the principle appealing to consequential essence and argue that such a modification is inconsistent with a central. (shrink)

Vivons-nous dans un monde " désenchanté " ? Constater l'emprise de la rationalité instrumentale, voire procédurale, ne devrait pas nous faire oublier que modernité et processus de rationalisation ne se sont imposés, au travers de changements lexicaux notables, qu'après avoir remplacé par d'autres les plus anciennes représentations relatives à la condition humaine. D'hier à aujourd'hui, l'imaginaire n'est donc pas moindre. En revanche, nos capacités d'imaginer se sont dangereusement amenuisées, en même temps que l'imagination est devenue suspecte, sinon coupable, de nous (...) détourner de l'action responsable. Do we live in a " disenchanted " world ? Once we note the ascendancy of instrumental and even procedural rationality, we should not forget that modernity and the process of rationalisation have prevailed only after having replaced the oldest representations of the human condition, and moreover through important lexical changes. This implies that the imaginary has not decreased overnight. On the other hand, our capacities of imagination have diminished dangerously, whereas in the same time imagination is suspected or even accused of turning us away from responsible action. (shrink)

A central question that arises when interpreting the U.S. Constitution is which theory of interpretation is the best? In his recent book, “How to Interpret the Constitution,” Cass Sunstein reviews various theories of constitutional interpretation currently in vogue and then offers what he believes would be the best approach going forward. In this Article, I want to take up a more basic question presupposed by the very idea of a theory of interpretation. That is, whether it is even possible to (...) arrive at more than a provisional understanding of what would be the best interpretation in any given area of study, including constitutional law. That said, I do believe some of the interpretations suggested by Cass Sunstein and elsewhere by myself and others to be more persuasive than most others, even if only partially so. For, as Sunstein himself points out, no theory seems perfect to figure out the Constitution’s meaning in every possible world in which we could imagine it to exist. So, we best just focus on our own world or what we take to matter in our world. In keeping with this idea, I plan to begin by looking first at how we might interpret the world around us based on our past experiences by considering a somewhat imaginative recent experience of my own. Next, I consider some recent studies in the neurosciences and a previous but highly influential article by the philosopher Donald Davidson concerning conceptual schemes and whether we could ever hope to make any sense of a scheme radically different from our own. Here it should be pointed out that I will use the word “scheme” when referring to a very broad system of thought for which there may not be much outside, versus when I use the word “framework,” as referencing something far narrower than a whole system of thought, even if what is referenced might purport to be a significant part of a still larger system. My goal is to eventually adopt John Rawls’ public reason method to separate out non-workable systems of thought as might be part of a particular religious or philosophical tradition that cannot be easily tied to any other system of thought easily imagined within a pluralistic society. I plan to do this by relating how Rawls’ public reason might allow for the creation of a moral interpretation of the Constitution adopting the moral theory of Alan Gewirth. The latter I adopt because its grounding does not presuppose any prior moral or religious framework. I then apply that interpretative method to five cases Sunstein believes are fixed points in our current constitutional understanding. In short, I plan to isolate out an area of human rights where even very different understandings of the world might be able to meet, while acknowledging that there will still be other areas that simply evade any common connection. I hope what I offer here to be of help for a theory of constitutional interpretation that focuses on morality, without having to compete with various religious frameworks going forward. (shrink)

In this article I review the Supreme Court’s current use of its major questions doctrine to see if the justifications commonly offered for its existence can explain its current use. In the process of doing so, I examine what the doctrine is about, how it came into existence and how the Court has applied it, especially in context to two recent cases, West Virginia v. EPA and Biden v. Nebraska. As both of these cases implicate the regulatory state, I place (...) the primary focus of this article on how the doctrine should apply in context to judicial evaluation of the regulatory state. In so doing, I discover that the Court’s current reliance on constitutional separation of powers and checks and balances analyses seem too narrow both with respect to the concerns of the founding generation but also, and perhaps more importantly, to the Constitution’s goals for the kind of government it sought to establish going into the future. This issue of Criminal Law and Philosophy contains three papers on a topic of increasing importance within the field of "neurolaw"-namely, the implications for criminal law of direct brain intervention based mind altering techniques. To locate these papers' topic within a broader context, I begin with an overview of some prominent topics in the field of neurolaw, where possible providing some references to relevant literature. The specific questions asked by the three authors, as well as their answers and central claims, (...) are then sketched out, and I end with a brief comment to explain why this particular topic can be expected to gain more prominence in coming years. Peirce was a thinker who claimed that his mind had been thoroughly formed by his rigorous training in the natural sciences. But he was also the author who proclaimed that nothing is truer than true poetry. In making the case for Peirce’s relevance to issues of education, then, it is necessary to do justice to the multifaceted character of his philosophical genius, in particular, to the experimentalist cast of his mind and his profound appreciation for the aesthetic, the imaginative, and (...) (more narrowly) the metaphorical in their myriad guises. My aim in this paper is to go some distance, however small, toward doing such justice to Peirce. (shrink)

Dans cet article, je discuterai de l’idée selon laquelle l’École polytechnique au xixe siècle ne permettait pas aux acteurs (les élèves et les enseignants) de réaliser des travaux mathématiques originaux. En fait, plusieurs historien⋅ne⋅s pensent que les programmes d’examens empêchaient les élèves et les enseignants de prendre des initiatives. J’essayerai de nuancer cette idée, en prenant en compte plusieurs exemples liés à l’enseignement des équations numériques au cours du xixe siècle. Plus précisément, je présente dans cet article trois théorèmes attribués (...) à trois enseignants de l’École polytechnique et qui ont circulé parmi les élèves de l’École et parmi des milieux d’enseignement. Ces exemples sont intéressants car ils donnent des informations à propos de l’École polytechnique et à propos de l’enseignement et de l’apprentissage qui s’y pratiquaient. Ils permettent aussi de mieux connaître la façon dont la recherche de résultats mathématiques nouveaux pouvait, dans ce contexte, être liée à des activités pédagogiques et je vais expliquer comment ce lien a de nombreuses conséquences sur l’activité d’un enseignant comme Edmond Laguerre par exemple. While many philosophers of law spend their careers exploring the warrens of a single neighbourhood within the sprawling cities of the philosophy of law, Larry Alexander has rambled widely, exploring obscure alleyways and dense downtowns, making significant and influential contributions along the way. The volume under review, a Festschrift in his honour, draws from a correspondingly wide range of areas of scholarship, from the philosophy of criminal law and punishment to constitutional law, from analytic jurisprudence to moral philosophy. Thus, given (...) the breadth and depth of Alexander’s influence, this volume provides a partial snapshot of some of the major preoccupations of American legal theory over the last few decades. In light of the breadth of topics considered, as well as its substantial length—the book includes twenty‐two papers, an introduction by Heidi Hurd, the editor, and a substantial reply by Alexander—my discussion is selective and evocative, rather than comprehensive and detailed. All the more so, as many of the papers are important contributions in their own right that merit close scrutiny. (shrink)

The author argues for an alternative understanding of adequation to the traditional one as an illuminating gloss on part of what truth might mean. He does so in reference to a cultural context in which the very idea of truth has been in some circles rejected. Moreover, he explores this topic in conjunction with several feelings typically accompanying our responses to mendacity and simply to inadequate linguistic formulations or definitions.

Le but de cet article est de montrer les limites des théories de la ressemblance en musique. Ces théories cherchent à justifier que nous puissions attribuer des émotions à une musique, et soutiennent que l’expression musicale des émotions est analogue à l’expression émotionnelle chez les êtres humains. Une musique triste devrait alors posséder quelque propriété en vertu de laquelle elle puisse ressembler à l’expression de la tristesse chez une personne. Ces approches ont le défaut de reposer sur une notion de (...) similarité qui est à la fois vague et inadéquate. Elles ne parviennent jamais à spécifier en quoi, précisément, la musique et les émotions pourraient bien se ressembler. Je montrerai qu’il est fort peu probable que cette notion de ressemblance, fondée sur un réquisit d’objectivité, puisse nous aider à mieux comprendre la façon dont nous pouvons correctement attribuer des propriétés expressives à une œuvre musicale. A companion volume to On Understanding Understanding, this second edition incorporates corrections to the previous text and includes new readings. The works collected in this volume are mainly from the British Empiricists. The breadth of the selection is not so diverse that the pieces cannot be readily understood by a newcomer to Epistemology, they have a logical progression of development (from Locke to Berkeley to Hume), and all of the philosophers whose work is represented have had great influence on contemporary (...) Anglo-American philosophy. In the Introduction, Potter sets the selections in their historical context and urges the readers to form their own viewpoint in terms of the period's contribution to the advancement of culture, politics, and society. He gives a concise summary of the Enlightenment period, demonstrating how and why Rationalism and Empiricism came about, and challenges the reader not to simply note the points of disparity between the two schools, but to notice the similarities of their common assumptions - both substantive and methodological. Readings in Epistemology, Second Edition is an excellent classroom tool. A biographical note on the philosopher, and list of suggested books for further study, heads each of the readings. While democratic societies experience intense conflicts about topics such as migration and climate action, there is no sound theory of democratic conflict. Agonistic theories emphasize the importance of conflict for democracy, but disregard conflict dynamics. Conflict sociology has focused on international or violent conflicts and neglects democratic conflicts. This article shows how this lacuna can be overcome. First, it develops an innovative, empirically informed processual approach to democratic conflicts. To this end, it draws on a broad range of scholarship from (...) sociology and social psychology, and integrates relevant insights into a processual framework for analyzing democratic conflicts that explores mechanisms of escalation, de-escalation, and reconciliation. Second, the article illustrates how this approach can ground a more elaborated democratic theory of conflict that concretizes how and when conflicts are beneficial to democracy, and explores the practices and institutions that democracies employ to cope with different conflict dynamics. First of all, the different periods in the history of ontology in the Early-Modern age are examined, with their different characteristics and problems.
