The upcoming Regulation No 536/2014 on clinical trials on medicinal products for human use, which will replace the current Clinical Trial Directive at the end of 2021, has triggered a significant reform of research ethics committee systems in Europe. Changes related to ethics review of clinical trials in the EU were considered to be essential to create a more favourable environment to conduct clinical trials in the EU. The concern is, however, that the role of the research ethics committees will (...) weaken in at least some of the Member States because the new Regulation allows narrowing down the scope of ethics review as compared with the currently valid Clinical Trial Directive. Although the new Regulation may lead to faster approval procedures for clinical trials, which is especially relevant in the context of pandemics, high-quality ethics reviews integrating methodological aspects of a clinical trial should nevertheless be ensured. To maintain high research ethics standards as well as to foster measures to mitigate potential negative consequences of the reform, it is therefore of vital importance to start debating and sharing the reflections about the potential consequences of these transformations and trends as soon as possible. Octavio Paz fue un lúcido intérprete de su siglo. Este trabajo explora aspectos decisivos de su propia definición como poeta y ensayista, así como de su trayectoria creativa y crítica, altamente representativa de las transformaciones del artista y el escritor contemporáneos. Los ecos de sus experiencias, prácticas de sociabilidad y lecturas, unidos a su sensibilidad y lucidez, hicieron que ya desde sus primeros textos en prosa Octavio Paz contribuyera a la reconfiguración del ensayo como género. Proponemos leer algunos textos del (...) escritor mexicano en diálogo con las reflexiones de varios de los grandes refundadores del ensayo y la crítica en el siglo XX. Su búsqueda de una comunicación profunda entre poesía e historia, su esfuerzo por repensar críticamente la tradición, su exigencia de autenticidad y libertad en el quehacer del escritor, son algunos de los elementos que dieron lugar en sus ensayos a una nueva poética del pensar y a una nueva relación entre conciencia y transparencia. _El espejo enterrado_ (1992) ocupa un lugar clave en la producción ensayística del escritor mexicano Carlos Fuentes y lo confirma como uno de los más notables intelectuales de nuestro tiempo. La obra y la serie documental a ella vinculada se reprodujeron ampliamente para contribuir a la reflexión en torno al significado de los quinientos años del primer viaje de Colón a través del Océano Atlántico, así como también para pensar la posibilidad de una comunidad iberoamericana apoyada en una historia, una (...) lengua, una tradición cultural y un imaginario compartidos. Este ensayo de interpretación de la vida de América y España se piensa a su vez como una biografía de nuestra cultura y una autobiografía intelectual del propio autor. Fuentes encontró en un año tan significativo como 1992 una oportunidad dorada para escribir la biografía de una cultura que consideró unida por el que llamó “Territorio de la Mancha”, repensar la relación entre España y América y emprender una nueva valoración de su perfil, su destino y su aporte al concierto de las naciones en una nueva etapa del orden mundial. El análisis propuesto en este texto señala que, en el proceso de imaginar y hacer posible la nación moderna en la América hispánica, el Libertador Simón Bolívar invocó el origen cívico y revolucionario de los nacientes Estados, y no la uniformidad etnocultural. En este aspecto, su postura fue radicalmente moderna y antigenealógica, en tanto afirmó que la unidad del carácter que supone la nación como comunidad política no tiene que coincidir, necesariamente, con los límites de las nacionalidades. Este artículo toma (...) como referencia el Discurso de Angostura, pronunciado por el Libertador en 1819, para mostrar que, al momento de construir esa gran nación que se debía llamar Colombia, Bolívar apeló a premisas políticas y territoriales, y no a los presupuestos nacionalistas de igualdad lingüística, racial o cultural. En tal sentido, su propuesta constitucional se inscribe en la tradición del patriotismo republicano y el ideal de la nación de ciudadanos. (shrink)

The laws concerning driving licences and epilepsy in different countries are very diverse with regard to the criteria for issuance or renewal of licences, and also the methods of evaluating fitness. In 2011, a law was issued in Italy implementing the European directives on driving licences, including provisions for mandatory notification that a driver is epileptic. This was established regardless of the European rules that require compulsory notification only of patients. The Federation of Italian Boards of Physicians has made recommendations (...) against mandated physician reporting, resulting in a current confusion between legal and ethical recommendations to medical doctors. The mandatory notification enacted by Italian law raises ethical concerns about disparities in access to care and possible violations of the right to confidentiality of patient information. Moreover, the law discussed here fails to emphasise the importance of physicians ensuring compliance by the patient, by sharing the correct information about the risks associated with illegal driving and by obtaining information from the patient through regular check-ups. An urgent revision of the law is required to implement the duty of the physician to provide information and to ensure that the rule about mandatory notification should be erased in favour of optional self-reporting by epileptics as the preferred way to notify the licensing authority. The implementation of these measures could correct the dichotomy between the law and the ethical recommendations for medical doctors and protect the rights of people with epilepsy as well as those of any other patients whose pathology or impairment could imply a risk to the community. A recent report from the UN makes the case for “global data literacy” in order to realise the opportunities afforded by the “data revolution”. Here and in many other contexts, data literacy is characterised in terms of a combination of numerical, statistical and technical capacities. In this article, we argue for an expansion of the concept to include not just competencies in reading and working with datasets but also the ability to account for, intervene around and participate in the wider (...) socio-technical infrastructures through which data is created, stored and analysed – which we call “data infrastructure literacy”. We illustrate this notion with examples of “inventive data practice” from previous and ongoing research on open data, online platforms, data journalism and data activism. Drawing on these perspectives, we argue that data literacy initiatives might cultivate sensibilities not only for data science but also for data sociology, data politics as well as wider public engagement with digital data infrastructures. The proposed notion of data infrastructure literacy is intended to make space for collective inquiry, experimentation, imagination and intervention around data in educational programmes and beyond, including how data infrastructures can be challenged, contested, reshaped and repurposed to align with interests and publics other than those originally intended. This book presents an historical and conceptual reconstruction of the theories developed by Meinong and a group of philosophers and experimental psychologists in Graz at the turn of the 19th century. Adhering closely to original texts, the contributors explore Meinong's roots in the school of Brentano, complex theories such as the theory of intentional reference and direct reference, and ways of developing philosophy which are closely bound up with the sciences, particularly psychology. Providing a faithful reconstruction of both Meinong's contributions (...) to science and the school that arose from his thought, this book shows how the theories of the Graz school raise the possibility of engaging in the scientific metaphysics and ontology that for so long have been considered off limits. This research characterizes and compares the job satisfaction of fitness professionals in Portugal between genders, ages, professional experience, professional title, and educational qualifications. A total of 401 fitness professionals answered the online questionnaire Job Satisfaction Scale, which has 16 factors rated on a Likert scale with seven levels. The statistical analysis comprises descriptive and statistical tests to compare the results of two (t-test) or more (ANOVA) groups. Overall, the results demonstrated that fitness professionals were moderately satisfied with their work. The (...) lower degrees of job satisfaction were concerning salary, opportunities for promotion, and stability at work. The highest levels of job satisfaction were related to the freedom to choose their work method, their work colleagues, the physical conditions of their workplace, and the opportunity to use their competencies. There were no differences in job satisfaction in terms of gender and a few differences between professional title and between educational levels. Regarding age and professional experience, the results showed significant differences in almost all factors, suggesting that, as fitness professionals get older and more experienced, their job satisfaction is greater. The results of this study suggest that even though fitness professionals are, in general, moderately satisfied with their work, some aspects can be improved by employers to increase their satisfaction levels. Such findings would assist employers in guiding the job satisfaction of their employees with consequent enhancements in the services provided by fitness professionals, which can increase participants’ retention in exercise fitness activities. A common worry regarding normative supervenience theses is that they are easily trivialized unless we somehow restrict the set of descriptive base properties on which the normative properties supervene. The idea is that if all descriptive properties are included in the base, any two individuals that share all their base properties must be the same individual in the same world, from which it follows that they have the same normative properties. We argue that this trivial explanation for unrestricted normative supervenience (...) fails. Moreover, we argue that even if it succeeded, this wouldn’t undermine the explanation challenges associated with normative supervenience. (shrink)

Involutive Stone algebras were introduced by R. Cignoli and M. Sagastume in connection to the theory of $n$-valued Łukasiewicz–Moisil algebras. In this work we focus on the logic that preserves degrees of truth associated to S-algebras named Six. This follows a very general pattern that can be considered for any class of truth structure endowed with an ordering relation, and which intends to exploit many-valuedness focusing on the notion of inference that results from preserving lower bounds of truth values, and (...) hence not only preserving the value $1$. Among other things, we prove that Six is a many-valued logic that can be determined by a finite number of matrices. Besides, we show that Six is a paraconsistent logic. Moreover, we prove that it is a genuine Logic of Formal Inconsistency with a consistency operator that can be defined in terms of the original set of connectives. Finally, we study the proof theory of Six providing a Gentzen calculus for it, which is sound and complete with respect to the logic. (shrink)

Experimental phenomenology is the study of appearances in subjective awareness. Its methods and results challenge quite a few aspects of the current debate on consciousness. A robust theoretical framework for understanding consciousness is pending: current empirical research waves on what a phenomenon of consciousness properly is, not least because the question is still open on the observables to be measured and how to measure them. I shall present the basics of experimental phenomenology and discuss the current development of experimental phenomenology, (...) its main features, and the many misunderstandings that have obstructed a fair understanding and evaluation of its otherwise enlightening outcomes. It is commonly assumed that if normative terms are analyzable in descriptive terms, as claimed by analytic reductionists, this provides an easy explanation why normative supervenience would be a conceptual truth. This chapter argues that our knowledge of normative supervenience has two important features this explanation fails to account for: first, the idea that normative properties supervene on descriptive properties seems obvious to us and, secondly, we don’t come to accept this thesis distributively by finding it plausible in each of (...) its particular instances but rather by seeing a pattern that all normative properties must conform to. An alternative is suggested, an expressivist account of normative supervenience that allows us to explain both of these features. The chapter closes by arguing that they require explanation even on the assumption that normative supervenience is not a conceptual truth. This makes the explanation problem concerning our knowledge of normative supervenience more general than previously thought. (shrink)

The Author argues for a non-semantic theory of intentionality, i.e. a theory of intentional reference rooted in the perceptive world. Specifically, the paper concerns two aspects of the original theory of intentionality: the structure of intentional objects as appearance (an unfolding spatio-temporal structure endowed with a direction), and the cognitive processes involved in a psychic act at the primary level of cognition. Often the Spanish interpreter cannot interpret word for word; the interpreter's primary role is to find the best way to culturally convey messages between the provider and the patient so they (...) can understand each other's intended meaning. I have noted a significant change in our patients' literacy and the providers' level of experience. Because of our patients' low literacy level, the providers need to lower the complexity to obtain the answers to many of their questions; however, lowering the complexity may be more challenging than it sounds for some providers.The first question a provider asks when the patient arrives at the Emergency Department (ED) is, "Why you are here?" or "What brought you here to the Emergency Department?" It seems a simple question. However, often I hear these answers: "I am here because my wife/husband brought me in the car" or "Because in 1980, my cousin had similar symptoms and died."As interpreters, we have to repeat the question differently to obtain the answer sought by the provider. If we repeat the question word by word, the answer won't change. That is when experience as an interpreter and cultural knowledge of our patients play a crucial part.The interpreter's experience and familiarity with the target population are as vital to the communication as being proficient in both languages. Our patients often use words made up from a combination of English and Spanish, such as nursa, referring to a nurse, or friza, referring to a blanket, and derived from freezing. Our patients often refer to the leg as the foot, so when the provider asks what is hurting, the patient will sometimes say, "My foot."As an interpreter working extensively with this population, I know that body part clarification is necessary. Pinpointing the body part the patient is referring to through visual confirmation is essential to treating the appropriate ailment. It is similar to doing a dual identifiers; instead of asking for name and date of birth, we ask for location (right or left) and visualization by pinpointing, with one finger, the body part being referenced. The role of clarifier is one of the interpreter's roles, and it has become the main practice for me to make communication accurate. [End Page 167]The provider should know that what the patient verbally expresses may not be what they mean to say based on their literacy levels, mental health, cultural background, and upbringing. Words may have different meanings in different languages despite being spelled the same. For example," Take this medication once daily" may be in discharge instructions, prescriptions, or medication labels. In English, "once" means "one time," but in Spanish, it means "eleven."Communicating using the limited Spanish that a provider may have, or using Google to translate words for a patient with limited English language ability is highly discouraged but often done. The problems with these methods are often overlooked. One cardiologist told an adult male patient, "Te amo," with the patient's mom in the room. I was the interpreter on-call that night. The provider called me because he thought the patient's mother gave him a weird look after telling the patient, "Te amo," which is how Google translated the words "I like you." The provider's intended message was to say that he liked working with the patient. Google does not put the words in context, so the provider told the patient he was in love with him by saying, "Te amo." After a good laugh and an education on why using Google is inappropriate, I clarified with the patient and his mother what the provider intended to say. The provider quickly learned that Googling phrases or using a little Spanish may get you in trouble.I currently work full-time as a physical therapist assistant and Spanish medical interpreter. A relationship of mutual nourishing, of determination, even of transubstantiation is being created between the human being and space. En medio de una sociedad que nos invita constantemente a la extroversión, cabe preguntarnos si el encuentro con nosotros mismos a través de una actitud “interior” y reflexiva no puede representar un factor clave para detener, en alguna medida, el proceso de deshumanización que descompone a Occidente.

Cyclin‐dependent kinases are Ser/Thr protein kinases best known for their cell cycle roles, where CDK1 triggers mitotic onset in all eukaryotes. CDKs are also involved in various other cellular processes, some of which, such as transcription and centrosome duplication, are coupled to cell cycle progression. A new study suggests that the mitotic CDK network is active at low levels in non‐dividing, differentiating precursors of multiciliated cells, and that it drives ciliogenesis. Manipulating the activity of CDK1 or PLK1 altered transitions between (...) the amplification, growth, and disengagement phases, in a manner analogous to the control of passage through different phases of mitosis. How the dynamics of the mitotic kinase network are controlled in these post‐mitotic cells, and whether other cell cycle regulators are also involved, remains unknown. In the present mini‐review we suggest that the redeployment of cell cycle regulators to control steps of differentiation in non‐dividing cells might be a more general, hitherto under‐recognized, feature of cell regulation. En este artículo, nos proponemos revisar la consigna “Socialismo o Barbarie” en el marco del pensamiento de Rosa Luxemburgo y de Cornelius Castoriadis en vistas a resignificar la acción política en el contexto del neoliberalismo contemporáneo. Consideramos al neoliberalismo, más que como un régimen político o económico, como una “forma de vida” que impacta sobre los modos de ser, de actuar y de pensar de nosotros, hombres y mujeres del siglo XXI. Esta nueva configuración del capitalismo, que se afianza con (...) sus guerras y su creciente pobreza, que deja “a la intemperie” a jóvenes, niños, mujeres, ancianos, hace del neoliberalismo una nueva figura de la barbarie. Por ello, se hace necesario volver a pensar la acción política, el quién, el cómo y el dónde ejercerla en vistas a “transformar la sociedad” y hacer de ella un espacio-tiempo habitable. (shrink)

This book investigates whether treaty interpretation at the ECtHR and WTO, which are sometimes perceived as promoting 'self-contained' regimes, could constitute a means for unifying international law, or, conversely, might exacerbate the fragmentation of international law. In this regard, the practice of the ICJ on treaty interpretation is used for comparison, since the ICJ has made the greatest contribution to the development and clarification of international law rules and principles. Providing a critical analysis of cases at the ICJ, ECtHR and (...) WTO, both prior to and since the adoption of the 1969 Vienna Convention on the Law of Treaties, the book reveals how the ECtHR and WTO apply the general rules of treaty interpretation in patterns which are similar to those used by the ICJ to address difficulties in interpreting the text of treaties. Viewed in the light of the ECtHR's and WTO's interpretative practices, both the VCLT's general rules of interpretation and the ICJ's interpretative practice serve to counteract the fragmentation of international law.. El presente artículo aborda, desde el análisis feminista, dos ideas clave del estudio y posterior representación de la violencia asesina contra las mujeres: la violación y la culpabilidad de las víctimas. La mirada feminista descubre todo un ámbito de comprensión al colocarse desde la perspectiva de las víctimas y cuestionar algunas de las ideas más aceptadas y generalizadas alrededor de los asesinos de mujeres. En artículo se enmarca en los primeros hallazgos de la investigación criminológica y los análisis feministas de (...) Jane Caputi, Susan Brownmiller, Diana Russell y Celia Amoros, así como en las investigaciones periodísticas de algunas feministas dedicadas al reportaje y estudio de los casos. This study analyzes shells of marine gastropods of a zoological museum and the Latin epithets expressing perceptual and connotative attributes that they have received in the standard, Linnaean nomenclature. Making use of the Osgood semantic differential, we presented the subjects with digital 3-D reproductions of the shell specimens to be subjectively evaluated according to 17 pairs of attributes. The results show that, overall, the subjective evaluations given by the subjects are consistent, which suggests that an intersubjective characterization of the shells (...) as wholes according to their qualitative and morphological traits is possible and scientifically explicable. This may apply to other biological items as well. The results also show that the epithets given to the shells by taxonomists do not always reflect the perceptual evaluation of the general population, being a product of the well-known ambiguity in taxonomic categorization and naming.
