In order to facilitate the informed consent process, we suggest recording it. If investigators routinely recorded the consent process—including subsequent testing of participants’ comprehension and reeducation efforts—they could monitor the consent practices of their staff and determine what changes in procedure may be needed. In addition, should the adequacy of consent ever be challenged , investigators would have an easily accessible record of what had transpired. And finally, a pool of data would be created that could be accessed by researchers (...) who study informed consent issues and are interested in identifying ways of further improving the process. The excavation of old battlefields can yield some surprises. The old muskets or catapults turn out to be, for the age, surprisingly lethal devices, and the issues which separated the contestants, as well as the alliances which joined some of them, are often found to differ from those described to us in the official histories, written by the victors. So it is too with intellectual history. Robert Schwartz has provided a delightful example of the joys of excavation in this (...) book on Berkeleian themes in theories of vision. Aristotle's discussion of perceiving that we perceive has points of contact with two contemporary debates about consciousness: the first over whether consciousness is an intrinsic feature of mental states or a higher-order thought or perception; the second concerning the qualitative nature of experience. In both cases, Aristotle's views cut down the middle of an apparent dichotomy, in a way that does justice to each set of intuitions, while avoiding their attendant difficulties. With regard to the first issue?the primary focus of (...) this paper?he argues that consciousness is both intrinsic and higher-order, due to its reflexive nature. This, in turn, has consequences for the second issue, where again Aristotle seeks out the middle ground. He is committed against qualia in any strong sense of the term. This article explores the moral significance of consent in an unjust world by developing the view that the validity of consent depends on its causes. It defends the view that the causes of consent make it valid or invalid. It then shows how this idea helps us to distinguish different ways in which consent might matter morally where it has problematic causes. Finally, it uses this analysis to explore the moral significance of a range of problematic causes of consent, including (...) objectification, arranged marriage, and third-party threats of violence. In this paper, I argue that unification is neither necessary nor sufficient for explanation. Focusing on the versions of the unificationist theory of explanation of Kitcher and of Schurz and Lambert, I establish three theses. First, Kitcher’s criterion of unification is vitiated by the fact that it entails that every proposition can be explained by itself, a flaw that it is unable to overcome. Second, because neither Kitcher’s theory nor that of Schurz and Lambert can solve the problems of asymmetry (...) and accidental generalizations, it follows that unification is not sufficient to ground explanation. Third, some good explanations are disunifying, which entails that unification is not necessary for explanation either. (shrink)

It criticizes business schools for their failure to reduce the incongruence between doing what is right and doing what it takes to get ahead. Because of this failure business school graduates carry negative ideas, attitudes and behaviors vis-à-vis social responsibility from business schools into the business world. Recommendations are made for increasing the social responsibility of business schools.

G. A. Cohen defends and Jon Elster criticizes Marxist use of functional explanation. But Elster's mechanical conception of explanation is, contrary to Elster's claims, a better basis for vindication of functional explanation than Cohen's nomological conception, which cannot provide an adequate account of functional explanation. Elster also objects that functional explanation commits us to metaphysically bizarre collective subjects, but his argument requires an implausible reading of methodological individualism which involves an unattractive eliminativism about social phenomena.

Interpreters disagree on the origin that Francisco Suárez assigns to political obligation and correlative political subjection. According to some, Suárez, as other social contract theorists, believes that it is the consent of the individuals that causes political obligation. Others, however, claim that for Suárez, political obligation is underived from the individuals' consent which creates the city. In support of this claim they invoke Suárez's view that political power emanates from the city by way of "natural resultancy". I argue that analysis (...) of Suárez's less studied De voto and De iuramento reveals that, for Suárez, consent causes both the city and the citizen's political obligation. Moreover, close inspection of the notion of causation by natural resultancy within Suárez's metaphysics shows that what emanates from the body politic in this fashion is not, as claimed, political subjection and political obligation, but rather the city's right to self-mastership. Because for him political obligation does originate in consent it is not incorrect to regard Suárez as a social contract theorist. (shrink)

Food safety problems in China, such as deadly tainted milk, have attracted growing attention from a corporate social responsibility perspective. To examine the forces that potentially drive CSR behavior within the Chinese food industry, our study is organized as follows. First, a review is conducted on the unique history of CSR in China as well as some of the major Chinese food scandals that have taken place. The primary drivers of CSR in China that have been suggested in the literature (...) are then summarized. Next, new institutional theory perspectives are drawn upon to analyze three forces that potentially affect the behavior of Chinese firms: coercive isomorphism, mimetic processes, and normative pressures. Based on a questionnaire survey of 164 Chinese managers and employees, the CSR behavior of firms operating in the Chinese food industry is found to only be significantly affected by the institutional factor of normative pressures. The study concludes with its limitations as well as the implications of the findings. (shrink)

They recognize the soul as vital to the work of psychotherapy. Some even speak of a “mythopoetic” imagination. The soulful depth psychologists to be considered here include Frederic Myers, Theodore Flournoy, Carl G. Jung, Vera von der Heydt, Victor White, Otto Rank, Evangelos Christou, Richard Schwartz, and James Hillman. I will contend that these (...) approaches align with a Catholic anthropology. (shrink)

Despite a vast philosophical literature on the epistemology of mathematics and much speculation about how, in principle, knowledge of this domain is possible, little attention has been paid to the psychological findings and theories concerning the acquisition, comprehension and use of mathematical knowledge. This contrasts sharply with recent philosophical work on language where comparable issues and problems arise. After World War II, Japanese intellectuals believed that world history was moving inexorably toward bourgeois democracy and then socialism. But who would be the agents--the active "subjects"--of that revolution in Japan? Intensely debated at the time, this question of active subjectivity influenced popular ideas about nationalism and social change that still affect Japanese political culture today. In a major contribution to modern Japanese intellectual history, J. Victor Koschmann analyzes the debate over subjectivity. He traces the arguments of intellectuals from (...) various disciplines and political viewpoints, and finds that despite their stress on individual autonomy, they all came to define subjectivity in terms of deterministic historical structures, thus ultimately deferring the possibility of radical change in Japan. Establishing a basis for historical dialogue about democratic revolution, this book will interest anyone concerned with issues of nationalism, postcolonialism, and the formation of identities. In a period rich with controversy one should perhaps allow fading quarrels to die. It is not my primary intention to rekindle the heated debate that swirled about Miss Arendt’s Eichmann in Jerusalem, but rather to see that book within the larger context of her philosophy. The following reflections were actually prompted by a reading of Miss Arendt’s On Revolution which, at least for this reader, suddenly revealed a certain unity of structure that can be discerned in all her writings. A subsequent reading of the Human Condition, the essays entitled Between Past and Future, the book on Rahel Varnhagen, and a rereading of the Origins of Totalitarianism and other essays have suggested that the polemical attacks on Eichmann in Jerusalem, whatever their intrinsic merits, failed to do justice to Miss Arendt as philosopher.
