This study presents a qualitative description of situations at work that staff members perceive as giving rise to ethical issues. All staff members working with patients across seven wards were given the opportunity to freely describe ethical considerations in an ethical diary over the course of one week. One hundred and five staff members kept a diary. The diaries were analysed with qualitative content analysis where four dominant themes emerged: good care, order and clarity, loyalty, and inadequacy. These results contain (...) statements in which patients are respected and listened to, as well as statements that express a desire for relatively strict, routine-based care. Relatively few statements were of a reflective or discussing nature which highlights the need for clinical ethical support. There is a need of a visible and supportive leadership which encourages ethical reflection. Reflections on real cases could provide an opportunity to challenge existing practices and thereby promote ethical awareness. (shrink)

BackgroundPsychiatric staff members have the power to decide the options that frame encounters with patients. Intentional as well as unintentional framing can have a crucial impact on patients’ opportunities to be heard and participate in the process. We identified three dominant ethical perspectives in the normative medical ethics literature concerning how doctors and other staff members should frame interactions in relation to patients; paternalism, autonomy and reciprocity. The aim of this study was to describe and analyse statements describing real work (...) situations and ethical reflections made by staff members in relation to three central perspectives in medical ethics; paternalism, autonomy and reciprocity.MethodsAll staff members involved with patients in seven adult psychiatric and six child and adolescent psychiatric clinics were given the opportunity to freely describe ethical considerations in their work by keeping an ethical diary over the course of one week and 173 persons handed in their diaries. Qualitative theory-guided content analysis was used to provide a description of staff encounters with patients and in what way these encounters were consistent with, or contrary to, the three perspectives.ResultsThe majority of the statements could be attributed to the perspective of paternalism and several to autonomy. Only a few statements could be attributed to reciprocity, most of which concerned staff members acting contrary to the perspective. The result is presented as three perspectives containing eight values.•Paternalism; 1) promoting and restoring the health of the patient, 2) providing good care and 3) assuming responsibility.•Autonomy; 1) respecting the patient’s right to self-determination and information, 2) respecting the patient’s integrity and 3) protecting human rights.•Reciprocity; 1) involving patients in the planning and implementation of their care and 2) building trust between staff and patients.ConclusionsPaternalism clearly appeared to be the dominant perspective among the participants, but there was also awareness of patients’ right to autonomy. Despite a normative trend towards reciprocity in psychiatry throughout the Western world, identifying it proved difficult in this study. Purpose – This paper aims to present an overview of the various ethical, societal and critical issues that micro- and nanotechnology-based small, energy self-sufficient sensor systems raise in different selected application fields. An ethical approach on the development of these technologies was taken in a very large international, multitechnological European project. The authors approach and methodology are presented in the paper and, based on this review, the authors propose general principles for this kind of work. Design/methodology/approach – The authors’ approach (...) is based on a great amount of experience working together in multi-disciplinary teams. Ethical issues have usually been handled in the authors’ work to some degree. In this project, the authors had the opportunity to emphasise the human view in technological development, utilise the authors’ experience from previous work and customise the authors’ approach to this particular case. In short, the authors created a wide set of application scenarios with technical and application field experts in the authors’ research project. The scenarios were evaluated with external application field experts, potential consumer users and ethics experts. Findings – Based on the authors’ experiences in this project and in previous work, the authors suggest a preliminary model for construction activity within technology development projects. The authors call this model the Human-Driven Design approach, and Ethics by Design as a more focussed sub-set of this approach. As all enabling technologies have both positive and negative usage possibilities, and so-called ethical assessment tends to focus on negative consequences, there are doubts from some stakeholders about including ethical perspectives in a technology development project. Research limitations/implications – The authors argue that the ethical perspective would be more influential if it were to provide a more positive and constructive contribution to the development of technology. The main findings related to the ethical challenges based on the actual work done in this project were the following: the main user concerns were in relation to access to information, digital division and the necessity of all the proposed measurements; the ethics experts highlighted the main ethical issues as privacy, autonomy, user control, freedom, medicalisation and human existence. Practical implications – Various technology assessment models and ethical approaches for technological development have been developed and performed for a long time, and recently, a new approach called Responsible Research and Innovation has been introduced. The authors’ intention is to give a concrete example for further development as a part of the development of this approach. Social implications – The authors’ study in this particular case covers various consumer application possibilities for small sensor systems. The application fields studied include health, well-being, safety, sustainability and empathic user interfaces. The authors believe that the ethical challenges identified are valuable to other researchers and practitioners who are studying and developing sensor-based solutions in similar fields. The concept of legal pluralism has been used widely in legal scholarship to draw attention to the existence of multiple legal orders. Scholars have relied upon it to avoid the ideology of legal centralism, to counter colonialism, and to highlight the neglect of Indigenous laws. These are ameliorative approaches, which aim to expand the concept of law for particular purposes. But it is not clear that they help to explain what law is and does. In this article, I contrast these (...) normative and critical projects with analytic and descriptive approaches to the concept of law. Descriptive conceptual analysis, using empirical examples to enhance the insights of legal theorists, can better shed light on what is distinctive about law as a social form. The article illustrates this approach with a number of historical and anthropological examples. This leads us, I suggest, to form rather than function, that is, to the quality of legalism. The creation and use of general rules and abstract categories, that is, usefully distinguishes law, as a category that encompasses both state and non-state forms, from the wider class of norms encompassed by the expansive theories of the legal pluralists. Freedom and time in Nicholas Berdyaev's philosophical thought.

The digitisation of academic journals has created the technical possibility that research can be made available to any interested party free of charge. This possibility has been undermined by the proprietary control that commercial publishers exercise over the majority of this material. The control of commercial publishers over publicly-funded research has been criticised by charitable bodies, politicians and academics themselves. While the existing critical literature on academic publishers has considerable value, it fails to link questions of control within the journal-industry (...) to the wider restructuring of economic and social relations that has taken place over the last three decades. This article seeks to complement this literature by highlighting how broader profitability pressures and the subsequent attempts by state-managers to expand the social space for capitalist accumulation have structured the development of the journal-industry. Most public discussion has focused on those effects of genetic research that are considered in some way unwanted or unpleasant. For example, there has been much debate concerning the risks and the ethical appropriateness of genetic screening, gene therapy, and agricultural applications based on genetic techniques. It often claimed that genetic research may cause new problems such as genetic discrimination, stigmatization, environmental risks, or mistreatment of animals. This paper presents an enrichment of the Gabbay–Woods schema of Peirce’s 1903 logical form of abduction with illocutionary acts, drawing from logic for pragmatics and its resources to model justified assertions. It analyses the enriched schema and puts it into the perspective of Peirce’s logic and philosophy.

From Italian physician Hieronymus Mercurialis’s contention that the stomach was ‘the king of the belly’, to its promotion by the end of the nineteenth century to the ‘monarch of humanity’ in patent medicine, to Byron Robinson’s discovery of the enteric nervous system in 1907 (a mesh of neural connectivity that led him to dub the gut ‘the second brain’), there has historically been a longstanding awareness of the expansive reach of the gut in the functions of the body. In the (...) nineteenth century, the authority of the gut and its allyship with the brain became a focus for writers thinking about the intersections of illness and ‘modern life’. In medical texts, domestic health manuals, patent medicine, and fiction, the electric telegraph in particular became a way of envisaging what we would now call the ‘gut-brain axis’. The telegraphic metaphor enabled a view of digestion as not simply a mechanical or chemical process, but one that was understood in terms of time, space, and communication. However, such a framework also suggested problems of connection that were common to both systems, emphasising not only the healthy body’s quasi-telegraphic networks but also its vulnerability to delay, disruption, and pathological incoherence. This article will explore the use of telegraphic technologies as proxies for theorising gastric connection and more broadly the concept of ‘gastric time’ as a key conceit for understanding digestion as a process that was and is subject to the idiosyncrasies of bodily rhythms. The extended notion of law evoked by the concept of legal pluralism has been subjected to powerful anthropological critiques. Simon Roberts, among others, has argued that law should be kept analytically distinct from forms of negotiated order. His persuasive argument in favour of a link between law and government, however, shuts the door on examples of law which arise before, or apart from, government, but which are nevertheless not negotiated orders. Law, it is argued here, can be identified neither by (...) reference to the negotiation of order, nor by reference to government. It is, rather, an intellectual system, identified by its expressive and aspirational qualities and its ideological claims to promote order and justice. In order to distinguish law from other ideological systems it is, then, necessary for the legal anthropologist to pay more attention to the significance of the legal form. (shrink)

This paper explores the intertwining of uncertainty and values. We consider an important but underexplored field of fundamental uncertainty and values in decision-making. Some proposed methodologies to deal with fundamental uncertainty have included potential surprise theory, scenario planning and hypothetical retrospection. We focus on the principle of uncertainty transduction in hypothetical retrospection as an illustrative case of how values interact with fundamental uncertainty. We show that while uncertainty transduction appears intuitive in decision contexts it nevertheless fails in important ranges of (...) strategic game-theoretic cases. Charles Peirce’s alpha system \ is reformulated into a deep inference system where the rules are given in terms of deep graphical structures and each rule has its symmetrical rule in the system. The proof analysis of \ is given in terms of two embedding theorems: the system \ and Brünnler’s deep inference system for classical propositional logic can be embedded into each other; and the system \ and Gentzen sequent calculus \ can be embedded into each other.

One way to obtain a comprehensive semantics for various systems of modal logic is to use a general notion of non-normal world. In the present article, a general notion of modal system is considered together with a semantic framework provided by such a general notion of non-normal world. Methodologically, the main purpose of this paper is to provide a logical framework for the study of various modalities, notably prepositional attitudes. This volume aims to provide the elements for a systematic exploration of certain fundamental notions of Peirce and Husserl in respect with foundations of science by means of drawing a parallelism between their works. Tackling a largely understudied comparison between these two contemporary philosophers, the authors highlight the significant similarities in some of their fundamental ideas. This volume consists of eleven chapters under four parts. The first part concerns methodologies and main principles of the two philosophers. The Dative or Ablative of this ‘plurale tantum’ was used by one of the earlier Republican writers. It is quoted by Ps.-Placidus from a MS. which had the marginal note ‘capillis muliebribus ante, id est a fronte, pendentibus.’ These marginal notes were often direct traditions from the earliest glossographi, the ‘glossematum scriptores,’ who provided material also for Varro and Verrius Flaccus, either directly or through the writings of earlier grammatici.

The relation of the glossae breviores of Placidus, or rather Pseudo–Placidus, to Festus1 epitome of Verrius has been the subject of much discussion; but after Karl's detailed examination inDe Placidi Glossis , the view has generally prevailed that Ps.–Plac. is not dependent on Festus, and that any similarities between them are referable to the use of similar sources by Verrius and our compiler.

The book studies philosophical and mathematical-logical problems of modal notions. Its starting points are possible worlds semantics and Kripke models, and it also concentrates on proof-theoretic methods.

We describe Peirce’s 1903 system of modal gamma graphs, its transformation rules of inference, and the interpretation of the broken-cut modal operator. We show that Peirce proposed the normality rule in his gamma system. We then show how various normal modal logics arise from Peirce’s assumptions concerning the broken-cut notation. By developing an algebraic semantics we establish the completeness of fifteen modal logics of gamma graphs. We show that, besides logical necessity and possibility, Peirce proposed an epistemic interpretation of the (...) broken-cut modality, and that he was led to analyze constructions of knowledge in the style of epistemic logic. The article investigates the validity of two different versions of the slippery slope argument construed in relation to human gene therapy: the empirical and the conceptual argument. The empirical version holds that our accepting somatic cell therapy will eventually cause our accepting eugenic medical goals. The conceptual version holds that we are logically committed to accepting such goals once we have accepted somatic cell therapy. It is argued that neither the empirical nor the conceptual version of the argument can provide (...) a conclusive moral reason for banning somatic cell therapy. According to a third interpretation, referred to as the arbitrary result argument, the many apparent similarities between somatic cell therapy and eugenic-based human genetic engineering drive us to make principled choices concerning what differences and similarities between the two practices should be regarded as morally (ir)relevant. Decisions of this kind are likely to have unpredictable moral consequences. Thus formulated, the slippery slope argument has much plausibility. One objects to somatic cell therapy not so much because of what is at the bottom of the slope on which it lies, but because it is on a slope of which one does not know what is at the bottom. While the arbitrary result argument does not provide a conclusive reason for prohibiting human gene therapy, it reminds of a very important thing: when making bioethical decisions, we should be as specific and as consistent as possible about our basic moral and medical concepts. This is an interdisciplinary study of what is cognitively going on when we interpret, respresent, or evaluate cultural entities, works of art included. In addition, the role of interpretation in experience and in cultural objects is elucidated from a cognitive point of view. The book relies on theories of action, perception, possible worlds, modalities, intentionality. cognition, and brain research, and it contains anumber of case studies. The book ptovides some new insights into some much-discussed problems related to interpretation.

We present a dynamic approach to Peirce’s original construal of abductive logic as a logic of conjecture making, and provide a new decidable, contraction-free and cut-free proof system for the dynamic logic of abductive inferences with neighborhood semantics. Our formulation of the dynamic logic of abduction follows the philosophical and scientific track that led Peirce to his late, post-1903 characterization of abductive conclusions as investigands, namely invitations to investigate propositions conjectured at the level of pre-beliefs.

Two different but closely related issues in current cognitive science will be considered in this essay. One is the controversial and extensively discussed question of how connectionist and symbolic representations of knowledge are related to each other. The other concerns the notion of connectionist learning and its relevance for the understanding of the distinction between propositional and nonpropositional knowledge. More specifically, I shall give an overview of a result in Rantala and Vadén (1994) establishing a limiting case correspondence between symbolic (...) and connectionist representations and, on the other hand, study the problem, preliminarily investigated in Rantala (1998), of how propositional knowledge may arise from nonpropositional knowledge. I shall also try to point out that on some more or less plausible assumptions, often made by cognitive scientists, these results may have some significance when we try to comprehend the nature of human knowledge representation. Some of these assumptions are rather hypothethical and debatable for the time being and they will become justified in the future only if there will be more progress in the empirical and theoretical research on the brain and on artificial networks. The assumptions concern, besides some questions of the behavior of neural networks, such things as the relevance of pattern recognition for modelling human cognition, in particular, knowledge acquisition, and the relation between emergence and reduction.
